EVERY
LITTLE HELPS? The shortage of new homes for a growing population has long been a cause for concern, and many in the housing and construction industries are hoping that the new government will incentivise the markets once again. Your Move researched how supermarket giant Tesco is getting in on the act to plan and develop schemes incorporating housing and retail - and how these are set to change the face of the UK landscape.

The background The shortage of housing making headlines recently highlighted that in England 4.5million people are currently on housing waiting lists. The National Housing Federation (NHF) found that by 2013, the number of people expected to be living in overcrowded conditions will rise by 20 per cent, with younger generations
remaining at home with their parents – and more frequently with three generations in one family sharing accommodation.
million new homes by 2010; 240,000 a year until 2016, but last year just 123,000 new homes were completed.
The rise in the price of housing and the difficulties in obtaining a mortgage due to the banks’ caution over recent months has contributed to this phenomenon, but statistics show that the government’s building targets have not been met, and the UK is not on track to complete the number of new homes needed to house the increasing population. Three years ago, the PM announced the target of building three

Factors contributing to the lack of development in recent years, alongside the major issue that developers are wary to invest in property that will not sell for a profit, include the rising costs of materials and trends towards energy efficiency – although these are less major than the issue of the lack of available funding. The Labour government addressed the problem of the housing shortage by investing £3.5billion into new affordable housing in 2009, creating 55,000 new properties, many through the Kick Start programme which successfully enabled development at a number of sites in our region. The HomeBuy Direct scheme was another initiative which is enabling key workers and a large number of first time buyers to move into their own homes, by supplying the loan for a deposit which the banks are refusing to lend. However,
whether the new government will continue to invest in such a scheme cannot yet be known.
A competitive player Into this troubled market, where affordable housing is on the agenda of every local authority, come the developers with the funding and the conviction that their housing product will sell to homebuyers. Alongside the traditional developers, the superstore Tesco is entering the market with property schemes under its development arm Spen Hill. This is, contrary to popular belief, not a new venture. The regeneration company has been in existence since 1997, and the schemes tend to focus on building residential schemes alongside civic centres, schools and communities – encompassing a Tesco store into the brief. While some are worried about the superstore’s power over whole communities and a sense of growing homogeneity in Britain’s towns and cities, others argue that without Tesco’s input in a difficult

market, many successful regenerative schemes would have been impossible. For traditional housebuilders, raising funds over the past 18 months has been difficult, as for many their equity has been tied into land or stock that is selling more slowly than expected. For Tesco, with the ready cash to purchase prime sites and begin building, the rewards are great.
Business model Peter Stoney, honorary senior fellow at the University of Liverpool Management School described the Tesco model as an example of good business performance, with the superstore’s a success a positive for those investing in it as shareholders and stakeholders – the customers. In response to recent press coverage showing concern about the supermarket’s power, and the newly coined phrase ‘Tescopoly’, he clarified: “Tesco
is not a monopoly – it is a prime player in a monopolistically competitive industry which sees several supermarket chains in competition with each other. Tesco is an excellent example of how to be successful in business: build up your domestic market in your speciality (in Tesco’s case, supermarket groceries and greens) and compete effectively on price and quality, in Tesco’s case that is the middle income sector. Then, as the domestic market approaches satiety, diversify abroad in your speciality (e.g US and China), and domestically into other offerings like clothing, banking and insurance.” He added: “Timing is of the essence, and Tesco has got this aspect off to a ‘t’ as it were, by going into banking when the existing banks have made a pig’s ear of it. Terry Leahy’s performance has been impeccable as Tesco’s
chief executive, and there is no reason to believe that future success is anything but assured.”
Opposition While the business success is assured, others in the community are wary. Friends of the Earth is calling for tougher planning rules to stop the ‘Tesco takeover’ and to support smaller businesses and shops in the community. They point to the fact that Tesco’s wide resources mean they are more than a match for any planning authority - and use this to appeal, usually successfully, against schemes which are not granted on the first application. Helen Rimmer from Friends of the Earth told Your Move that the supermarket is at an advantage from a resources point of view against small community groups, and that the supermarket’s expansion plans should be a cause for concern.
How security in a firm with a good reputation for business and provision of housing weighs against a very British fear of homogeneity in our landscapes, and pride in the local community values, will be the ultimate test - with the outcome decided in the first instance by individual purchasers. Over time, and not necessarily a long period, these choices will impact on the future of our landscapes and on the availability of choice to future generations of homebuyers. That is, until or unless the new government’s targets and incentives reenergise the property market. Should we see the creation of a level playing field for all developers, informed by the communities in which they build – coupled with the necessary finance – then the picture could be altogether very different.

Northwood, which has a branch in West Derby Village, has pledged to support Royal Marine Matt Snook and aspiring Royal Engineers Officer Pete Sunnucks in their bid to climb to the top of Everest. The two soldiers are hoping to raise £100,000, which will be split between Help for Heroes and the John Thornton Young Achievers Foundation, a charity set up in memory of their close friend and comrade who died in action two years ago.
Already part way up the mountain with around 3,000 metres to climb, the Dorset pair are hoping to reach the summit by the end of May, when they’ll be pitching a Northwood flag on behalf of their sponsor. This means that the house should not have any occupiers whether that is the tenant or the owner. Your tenant may agree to leave by the time the sale goes through and that may give you some comfort, but you should still seek certainty by the tenant vacating well before the date that you exchange contracts. The contract will state the date that the sale is to complete. If you exchange contracts and the tenant fails to leave the sale cannot proceed. You can be liable for compensation to the buyer for any delay until the sale completes when the tenant leaves. You could also lose the sale altogether. To avoid those consequences it is better that the tenant vacates before you exchange contracts Even if the tenant agrees to leave you should still send an appropriate statutory notice to bring the tenancy to an end, known as Section 21 Housing Act 1988 notice. That notice needs to expire on the last day of a period of the tenancy. If your tenant is part the way through a 6 or 12 month assured shorthold tenancy agreement your tenant will not be obliged to leave until the tenancy agreement ends, irrespective of what the contract for the sale of the property says. You should therefore carefully examine any tenancy agreement to confirm when it expires and ensure that the Section 21 notice is served on your tenant. If the tenant ignores the notice and fails to leave by the date specified in it you will need to take court proceedings to evict the tenant. That may take a further 2 to 3 months once the proceedings have been issued and that will delay any sale. Alternatively, if the property is to be purchased as an investment, an existing tenant can be an advantage in that it may be a more attractive proposition to a buyer as an income would be generated immediately through the rent following the sale. We put our property up for sale last summer and we haven’t had any viewings in months. Where are we going wrong?

If your property has been on the market for several months and you haven’t seen any interest in it from prospective buyers, then the first thing you need to do is to make sure you have priced it realistically. It is important to appreciate the significant changes in the market over recent years and to take this into account with regards to making sure your property is accurately priced. The current market conditions and area specific demands are key points to consider along with the specification and finish of the property in question. It is important to listen to your agent and consider their comparable evidence in order to attain a price the property will sell for. Another way to ensure viewings are generated is to ensure the exterior of your property is pleasant, increasing its ‘curb appeal.’ This could be as simple as maintaining the exterior of the property and ensuring it is clean and neat or even assessing external paintwork and garden areas and ensuring they are attractive. Remember, the buyer’s first impression either by passing your house and seeing the estate agent’s board, by viewing a photograph of the exterior in the estate agent’s shop, or when they go to make a viewing, can hugely influence their decision. Finally, consider the interior. Although interested parties can only look at the inside of the property personally on viewings, most people now judge a property simply by looking at the internal advertising pictures in a property magazine, or in the estate agent’s brochure. When preparing the property for pictures ensure that rooms are clean, open and presented with a lot of light in order for your agent to easily attain the best shots. I’m a landlord with an investment property which I’d like to sell. I’ve been renting it out over the past few years and I have a tenant in it at the moment. What should I do?
A
Tenants in rented properties have tenancy agreements, and the first thing a landlord in your situation needs to do is to ensure that the terms of the assured shorthold tenancy agreement are met and that the tenant is properly looked after. If there is not too long left in the tenancy agreement, then you are in a good position to inform the tenant of your decision to sell up, and you managing agent could do this on your behalf if you prefer. The tenant then has several options. You may find that they are happy to move into another property in your rental portfolio, or they may prefer to continue renting the current property. If you can sell to an investor then the tenant may be happy to continue with this arrangement and sign a lease with the new landlord. Your estate agent will be able to help you to look for interested investors. There is no guarantee, however, in which case an owner occupier may wish to move in. When the tenancy agreement ends, therefore, the tenant can move out or stay on a periodic tenancy in the property until it is sold. This means that they can give one month’s written notice if they decide to leave the property, and the landlord can also issue them one month’s notice to move out. Many tenants looking at the current sales market may be happy to stay on a periodic tenancy as they will feel that a quick sale is unlikely. If your tenant does want to stay on in the property, then this may help you keep it in good condition and make it attractive to potential investors on viewings. It’s nice and modern and it’s a good location because we both work in town. We looked at a few others but they were all quite a bit smaller than this one. We really love the space.
My decks. I bought them about three months ago. I saw Tiesto at the Arena recently and I’d have to say he’s probably my favourite DJ.
We love it. We were living out of town before and we hated getting the bus in! The apartment is in a really nice area too.
I think the bedroom is the best looking room and it’s a really good size. Considering the fact that we’re renting there’s some really nice stuff. There’s a lot of stylish dark wood furniture and the wardrobes are really deep which is great for space. On the bed you’ll find Harriet’s hippo hot water bottle.
The apartment came fully furnished although we’ve added a few of our own touches in the living room. There’s a TV and a computer for films and music. On the wall we’ve got album covers from some of our favourite bands. My personal favourite is Led Zeppelin while Harriet likes Fleetwood Mac.
A barbeque for the balcony is one of the priorities with summer coming. We’d like to get a couple of plants for the living room, but we’re really happy with the place overall.
We’ve got some nice gadgets in the kitchen like the coffee machine. I do most of the cooking. I suppose I’m a bit of a dab hand!

This month Tate Liverpool will welcome one of the most significant art exhibitions ever to arrive in the city. The Picasso: Peace and Freedom exhibition will shine new light on the artist’s life as a political activist and challenge his portrayal as a playboy. Director of Tate Liverpool Dr Christoph Grunenberg spoke to Jonathan Kearney about the forthcoming exhibition and his work at the gallery.
INTERVIEW BY JONATHAN KEARNEY How big of a coup is the Picasso exhibition for Tate Liverpool? I think it’s one of the biggest things we’ve ever done. It’s a really significant exhibition. I think it will be one of the most important, if not the most important, exhibitions happening during that time in the whole country. It’s a very substantial exhibition as well, with a number of really important iconic works from major museums but also little-known or rarely seen works. There will be around 60 paintings and about 150 works on paper, photographs and documents. I think it’s certainly the biggest thing we’d done after Klimt. Will this exhibition shed new light on Picasso’s life and work? Yes. Obviously there are quite a few Picasso exhibitions but this is unusual because it deals with a subject matter that hasn’t been properly explored in an exhibition before. For that reason I think it’s a real revelation in terms of throwing a new light on Picasso and his importance as a painter after the Second World War but also his political engagement and his commitment to the peace movement. He devoted a lot of time and donated a lot of work and money to various peace movements and humanitarian causes and from that point of view it really does shift our perception of Picasso quite radically and really shows him as a serious artist, as a committed artist and as a political artist, rather than someone who was mainly interested in women and the joys of life.
How important was Capital of Culture to Tate Liverpool? I think it was an absolutely fantastic year, not just for us but for everyone. It was just incredible in terms of how well the year went and how many visitors we had. We attracted 1.1m visitors in 2008, which is just unbelievable. It was a fantastic year but at the same time we want to continue in that vein and Picasso certainly is a legacy of that year and it’s a very important exhibition in terms of doing something which is really of the highest international standard, which is not going to be seen anywhere else in this country. Tate Liverpool also managed to secure the Turner Prize that year... We had incredibly supportive colleagues in London. They were really generous in terms of making that possible here. The challenge was to make it as good as it is in London and make it as successful. I think it was a real coup to stage the first ever Turner Prize outside of London and it was a huge success as an exhibition. Do you think people in Liverpool embrace modern art? I think they do more and more. They know what they like and I think perceptions have shifted, the appreciation has shifted and I think there’s a wider interest now. Even in the last ten years or so I think there’s been a considerable shift in attitudes. What’s a typical day for you? Running a gallery is about being involved in all aspects of it. It’s not just curating exhibitions, for which one has less and less time, it’s about juggling a huge number of balls in the air. You have to deal with immediate things but also with what’s going to happen in the next three years. It’s about fundraising, it’s
about management, it’s about the people of Tate Liverpool, it’s about the broader picture of the city being regenerated, about its national and international profile and the perception of the city. It’s also working with the tourism agencies as well as the Northwest Development Agency, and maximising the impact of the gallery being here in the city. You’ve worked in some of the most significant cities in the world. How does Liverpool life compare? Life is very good in Liverpool. It’s a very ‘liveable’ city and a very pleasant city. It’s a rich city in terms of its cultural offer and of course as a city it’s been hugely transformed over the last few years. It has become more attractive, easier to live in, much richer in terms of its shopping offer, in terms of its restaurants and the quality of life generally. I think it’s been an incredible growth and it’s certainly one of the cities I most enjoy living in. What do you like to do in the city when you’re not working? Trying to do things not connected to art! I try to relax and do nothing really. I live near Princes Park so that’s a great privilege in many ways because you are in the city but also virtually in the countryside. I love to sit on my balcony, particularly with the weather improving, and I enjoy going out for a drink or a meal on Lark Lane, which is within walking distance. You can do all that without having to get on the underground or jump in a car because the scale of the city is very manageable. The venue is ideally situated for a business lunch with city centre clients a stone’s throw away, and makes an excellent meeting point for a Table Talk with Liverpool-based construction lawyer, Sarah Duncan. Sarah is the head of construction law at JST Lawyers in Colonial Chambers on Temple Street, which acts for clients ranging from housing associations to arts and charitable organisations, developers, sub-contractors and
served the business well, but – like everyone else in the city – we’ll be glad to see the banks lend again.” Having joined the firm in 2008 from another firm in Liverpool, Sarah says she has enjoyed seeing the changes to the face of the city in that time. She added: “For the city to move forwards we need to see more provision for families in the city centre to encourage them to live here, both in terms of the accommodation and the schools and amenities that they need.” Sarah and I head straight in with our main courses, finding it difficult to choose between the

Says Sarah: “We work with a number of high profile organisations, advising them on all aspects of the law and following through construction and planning issues with them. We have longstanding clients here and overseas who we work with, and this has stood us in good stead throughout the recession when development slowed. We diversified our portfolio and we have a nimble and talented team, which has
various steaks, the lamb, and the tempting pumpkin risotto. Sarah opts for the Manx fillet of steak with gratinated potato and essence of veal, while I order a classic sirloin with pepper sauce and homemade chips – a chunky and tasty side dish to complement the grilled mushroom and tomatoes on the vine. Having moved to Liverpool after studying in Birmingham and Nottingham Sarah, originally from Ipswich, confesses that while she was attracted by Liverpool’s musical heritage, it was the friendly vibe and the enjoyable work which kept her here. Indeed, from working on a wide range of
projects, including the development of the city’s universities, she has seen her own career blossom alongside the cityscape. Sarah is modest about this: “I’ve enjoyed working in construction because there’s an end result which is very edifying to see. There aren’t a great number of women in the industry, but those that are tend to be very proactive and we have a strong network.” Sarah is well known in the property and business community in the city for organising her quarterly Women in Construction events, as featured in Your Move, which are always well attended: “We try to keep a mix of useful informative and sector-specific content in the events, and a pleasurable opportunity to network and indulge. We’ve been well supported by local businesses such as Andrew Collinge, BoConcept Liverpool and LK Bennett so there’s always been a strong lifestyle
pull to the events. I’m hoping the next one will be an afternoon tea event, with a cupcake theme.” For dessert, Sarah chooses the crème brulee which is expertly presented with fruit and a light dusting of icing powder while I opt for the chocolate fondant – a beautifully presented and perfectly cooked pudding with a warm chocolate centre that’s luxurious without being heavy – delicious. Over frothy cappuccinos, Sarah and I discuss our shared passion for reading, and her keen interests outside of work in spending time with her husband Jon, also a lawyer, looking after their baby son Leo, and her musical hobbies – playing the electric cello with a number of local bands in her spare time. Charting the highlights of her career so far, it’s clear that Sarah is keen to carry on developing her caseload, diversifying her workload and building new contacts along the way.
