A city agent believes a proposed increase in capital gains tax poses a threat to the private rental market. The coalition government intends to double the rate but it is not clear when the measures will take effect. If new policy is brought into force, sellers could be liable for 40 per cent of their capital gains, rather than the current 18 per cent rate. Paul Sutton, managing director at Sutton Kersh, commented: “We don’t know how or when the new policy might apply. It might be from the date of the Budget or it might be from the start of the next tax year. Potentially, this could trigger a fire sale situation. Professional investors may look to sell their current portfolios now before the new legislation is in place. If this is the case we will see a significant rise in auction stock as investors look to achieve a quick sale. The worst-case scenario for investors would be if it was back-dated to the start of this tax year.”

The average deposit required for a first time buyer in 2009 was 25% - out of reach for many young people. Urban design experts from the Chapel Street store take part in Dragon’s Den event BoConcept Liverpool store owner Elaine Cunningham and retail manager Helen Kauffman were among a panel of five dragons at Liverpool Community College on Myrtle Street. The event organised by designer Ilsa Parry offered 18

students at the college the opportunity to sell their ideas to the judges with a four minute pitch. Following the deliberations of the dragons, five of the students were eventually deemed the pick of the bunch in five different categories, each walking away with HMV gift certificates. The overall winner secured £250

towards the set up of his own events company. BoConcept’s Helen Kauffman commented: “It was a really good afternoon. Some of the students were only 17 so there was quite a range of ideas but it was nice for them to have some real feedback from the business world. I have seen a property I really like in South Liverpool, I know it is a buyers market and I am thinking of offering less than the asking price but I don`t want to lose the property. What would you advise?

A

Whilst it is a buyers market and generally speaking the market is oversupplied, there are still areas of the city that are highly sought after and where properties do not become available very often. South Liverpool has many addresses that are highly sought after and in these areas properties can sell in just a few weeks, often attracting interest from more than one party. It is tempting to offer less than the asking price as everyone wants to get the best deal that they can but if this is the house of your dreams and you are likely to stay for a number of years, would you really want to risk losing it for a few thousand pounds? My advice would be to offer the full asking price subject to your survey or mortgage valuation, you can always make a revised offer if your surveyor values the property at less than the asking price. The vendor is not obliged to reduce and may still hold out for the asking price, particularly if there has been a lot of interest. Remember that when choosing between potential buyers, best price is not the only consideration, the Agent will be checking the buyer’s ability to proceed. A vendor may accept a slightly lower offer from someone that is in an immediate position to proceed over a higher offer from someone who has a property to sell and has not yet found a buyer. There is no text book answer to your question, every vendors circumstances are different and no two sales are alike but you will give yourself the best chance of being successful if you offer the full asking price. Many landlords choose to find their own tenants and manage the property themselves; however the benefits of instructing a reputable agent to find a good tenant and to manage the property during the tenancy are often underestimated. Whether you have a property portfolio or you are considering letting out your home, then it is a good idea to choose a fully managed service. Managed services are available for landlords to assure that the entire process of renting the property goes smoothly from move in to check out. Opting for the fully managed service can be incredibly valuable for landlords who are relatively new to the whole process. Nonetheless, even the landlords who have prior experience in renting property often opt for the managed service as it often saves a lot of time and hassle. By having a fully managed service, a landlord does not only have the benefit of having the property let out, but the managing agent will take the responsibility for looking after the property throughout the tenancy. This includes property checks at regular time intervals, rent collection and chasing arrears and arranging maintenance and repairs of the property when required. Q&A With Julia Ford, Solicitor Q I bought a flat from a local developer six years ago. The lease is made between the developer and myself (there is no management company as a party) who has retained the freehold and delegated management to a local management agency. The developer has now been struck off at companies house for none filing and the management agency is threatening to resign over none payment of service charge/insurance rent. Who is responsible for repairing and insuring? A We are seeing this as a frequent issue in the current recession. Striking off for none filing is a simple means of winding up without the appointment and cost of a liquidator, if there are no creditors. It is highly likely that there is no outstanding charge on the freehold (if all the flats have been sold off, any finance will have been paid from the proceeds). Normally a lease does not provide for anyone to step in. This means the covenants to insure and repair given by the landlord are unenforceable. Similarly there will be no party ie landlord able to enforce the covenants to pay insurance rent/service charge against the defaulting tenants. If there are no enforceable rights given to a management company in your lease, then the management agency cannot take action against the defaulting tenants. Unfortunately in the above circumstances you will not be able to remortgage or sell your flat with good and marketable title. The Council of Mortgage Lenders Handbook (to which most banks and building societies subscribe) state there has to be enforceable covenants for repair and insurance against the landlord or a management company. The management agency is not a party to your lease. So as long as the management agency acts and resigns its appointment in accordance with its terms and conditions of appointment and any professional regulations there is no action you can take against it, even if it doesn’t your course of action is limited as the appointment was made by the developer. I’ve always been interested in England and John Moores gave me the opportunity to study what I wanted so I haven’t looked back since. The people are friendly and I’ve got a lot of friends here now. I’m applying to do a PhD next year and I’m more than likely to stay here.

I’d looked around the city centre but this was a clear favourite. I’d say the view is the best thing about it. It’s nice waking up in the morning and seeing the docks and the Liver Buildings. Obviously it’s in a great area as well. There are bars and restaurants on your doorstep and if you want more of a relaxed night you can go to the Odeon in Liverpool One.

It’s a really nice bathroom. You can tell by the quality they’ve put a lot of care into it. Some places you see look run down after six months!

The apartment came fully furnished and I had a choice of the style. I went for the more contemporary look. I love the orange couch and watching the flat screen TV on the wall. I watch a lot of football and I’m a big Fulham fan like my Dad and Granddad. I went to the final and the two semi finals recently. I also like to watch other sports and documentaries.

As a postgraduate it’s ideal because I didn’t really want to be living in a place with a lot of undergraduates where it would be a lot noisier. Everyone is well behaved and really take care of the building because it’s so nice. I also got two free years at the gym when I bought the flat. I love the shape. It’s like a continental style the way you can pass food through to the living space. It’s all modern and everything I needed was included. I just brought in a kettle and toaster and things like that. My Auntie has a lot of Australian friends so she’s brought me a lot of cool Australian stuff for the kitchen. I’ve been away from home for five years so I’m pretty good at cooking now. I cook a lot of Belguim dishes like beef stew and things like chicken stir-fry. With my course I stick to a diet plan.

Africa Oyé is the UK’s largest free celebration of African music and culture and takes place annually in Liverpool. As well as fantastic live music, the Oyé Village offers an arts and crafts market, a variety of African, Indian and Caribbean food, massages, smoothies and a beer tent. The Sefton Park event is free and takes place between 12.30pm and 9.30pm on 19 and 20 June.

Inspired by 22 of ABBA's greatest hits, this musical tells the story of a mother and a daughter the night before the daughter's wedding. he Crosby Music Festival over the recent Bank Holiday saw 80 acts put on a spectacular show in the village, including The Christians, and Morecrofts Solicitors in Crosby was proud to be a sponsor of the annual event. She adds: “The high street is being taken over by multinationals, but we need to keep fighting

She takes care of clients who want to release their equity, transfer property within a family, and all property matters. Says Tracy: “I knew I wanted to work at Morecrofts because I could see that it’s a place where the team really get to know their clients, and do their best to help them. It’s got

At Morecrofts, we describe ourselves as a city lawyer in the village; we can offer the expertise you expect from the city but we’re a local firm and we understand local needs and interests.” As we relax in the Pioneer, Tracy enjoys an omelette while I sample the Thai green chicken curry as we discuss Tracy’s career, from working as a nurse and retraining in property law. Her on the job training, distance learning and the commute to Halifax for additional training after work reveal dedication and commitment to her career,

although she is also a married mum of two and until recently, was an active member of the BNI networking organization. Over coffee and a perusal of the dessert menu, which highlights sticky toffee pudding, treacle tart and cheese and biscuits among its selection, our discussion turns to the firm’s growth. Morecrofts has four branches across the north-west, in Tithebarn Street, Liverpool Crosby, Birkenhead and Woolton, but maintains a small firm feel with a personal approach to dealing with clients. This attribute is becoming increasingly rare in the legal profession, where bigger firms take a factory approach to the business, often dealing with clients only on the telephone or encouraging them to use online

resources. Tracy is keenly aware that, while useful, technology is no substitute for receiving the right advice when it comes to matters this important. She comments: We’re increasingly being marketed the idea that the internet makes experts of us all and that anyone can access any services they need cheaply online. It’s just not true. Trained professionals have spent years learning their skills, and the facility to, for example, write a will online can’t replace that.” Judging by the firm’s loyal client base, Tracy is not alone in holding this viewpoint, and on the firm’s 200th birthday in 2013 the celebrations of its enduring services to the community will be a fitting tribute to those values.

PAGEANT OF POWER fantastic display of speed and style took place on The Strand and Liverpool’s waterfront, the first Liverpool Pageant of Power. Brought to the city by the organisers of the well-established Cholmondeley event in Cheshire, the spectacle saw high-powered Grand Prix, Le Mans, rally and supercars with racing bikes roar through The Strand while Formula 2 and 4 power-boats and jet-skis raced around the docks and acrobatic displays took place in the skies above. The festivities, which saw 25,000 spectators gather at Liverpool One and the docklands, were certainly an excellent complement to Liverpool One’s second birthday. 5
