The Government is considering a new tax on homes which waste energy as part of its “Green Deal”. We seek the view of local property experts on the proposal and consider the potential implications for the market.
WORDS BY JONATHAN KEARNEY Under the proposals being considered, buyers moving to the least energy efficient homes would have to bear an additional 0.5 per cent levy on top of the normal rate of stamp duty, adding hundreds, if not thousands of pounds to the cost of a new home. As part of the scheme, initially commissioned by the previous government, those purchasing homes with an energy efficiency rating of F or G would be liable for the new tax and would only be eligible for a rebate if significant upgrades were made. The tax would penalise homes with insufficient insulation, an old inefficient boiler or draughty windows, with the cost of upgrading to a minimum E grade amounting to several thousand pounds in most cases. It is believed those who improved their property to the required minimum within an allocated time frame would be refunded the 0.5 per cent levy, together with an additional 0.5 per cent. Sue Taylor, head of Keppie Massie Residential, believes the plan would create a fresh obstacle to prospective first time buyers. She said: “This is yet another “fund raiser” by the Government which will penalise house buyers or sellers in the most vulnerable sectors 24 Your Move
of the market. We are already producing Energy Performance Certificates on all properties for sale and let, which doesn’t influence buyers or renters in any way. The market for properties in need of renovation is one of the only avenues available to some first time buyers. Let’s not deter them from entering the housing market yet again.” The proposal was part of a report by the ‘Green Investment Bank Commission’ initially commissioned by former Chancellor Alistair Darling and produced by Bob Wigley, chairman of the Yell Group. The tax could form part of the Government’s “Green

Deal”, which is expected to be launched towards the end of 2012. That initiative would again favour the most energy efficient homes, with householders offered ‘green makeovers’ as part of the wider promotion of the climate change lobby, advocated by the previous government and the incumbents. According to the
Energy Saving Trust, the Government aim to have all new homes built in Britain meet “zero-carbon standards” by 2016. Nick Dawson, head of residential at Venmore, Allerton, thinks the stamp duty penalty could be considered a form of stealth tax. He said: “I think it would be fair and justified for some form of taxation to be placed on households who fail to recycle or create excessive wastage, be it refuse or homes who fail to insulate properly. On the other hand there may be some who consider this a form of stealth taxation. From a property perspective it will further widen the gap between rich and poor with many poorer, less affluent households being unable to remedy any substandard insulation. Prices for lower income housing, unmodernisned or poorly maintained stock will continue to inevitably fall and this may cause a landslide in prices across all property classes.” A spokesman for the Department of Energy and Climate Change told Your Move that although the Government is considering introducing the tax, no plans have been finalised: “There are many incentives that we are considering to tackle the huge challenge of making homes more energy efficient and saving money on energy bills as part of our Green Deal. We

have no current plans to introduce this and no final decisions have been made yet.” Nick Stott, managing director at HOMEsure, offered an alternative to the proposal, saying: “I would suggest offering to increase people’s tax allowance so they can use the extra money they earn towards reducing their home’s carbon footprint. This way, people can choose whether to do it safe in the knowledge that they won’t be penalised for not having enough readily available cash. It would also keep the Government’s cash
reserves in a healthier state as they don’t have to pay out lump sums.” Nick added: “The suggestion of incentivising sellers to upgrade their homes before putting them on the market doesn’t make as much sense as it would seem on the face of it. Not everyone wants to buy a property that has been modernised and leaves the buyer without the opportunity to add value. Further, I think it leaves buyers wide open to negative market fluctuations. If you have the ability to add value, you can increase the equity you have in a property
which hedges against a fall in the market. If you don’t, any drop in the market value will leave the vendor with negative equity meaning they can’t sell, won’t sell, or will make a loss. I also think it’s another tax on the poorer end of the market. No one wants to have draughty windows and an old, inefficient boiler. Losing heat through windows, lofts and walls because of draughty windows means the occupier will be paying extra in heating bills, but cannot afford the lump sum to replace their windows, add extra insulation and upgrade their boiler.”

What time is best to look round a house I’m looking to rent?
A property chain is a line of buyers and sellers who are all simultaneously involved in linked property transactions. If any of the links in the chain falls through or 'breaks', all the other transactions are either held up or in the worst case scenario fail completely. Unfortunately, broken chains do happen and they have become more commonplace since tighter mortgage lending criteria has resulted in some properties being downvalued by surveyors. Other reasons for chains to break can be that buyers change their minds and withdraw their offer or even that vendors decide to stay put. The only way to avoid a chain is to offer on a property that is advertised as chain free. If the house you want has a chain you can try to minimise the risk by ensuring that your estate agent is in constant communication with other parts of the chain to ensure that any problems are addressed as soon as they arise. Unfortunately, when a chain breaks it can be upsetting and time consuming and can also hit you financially. Selling your property through a no sale, no fee estate agent will ensure that you don’t lose money on estate agents fees and if you also instruct a solicitor who works on the same basis you will not lose out on legal costs.
Even though the house inside might be perfect, there are factors, like your neighbours, how busy the street is, a rowdy pub on the corner, that might make living there a nightmare. It’s best to visit several different times, at different times of the day to get a feel of the neighbourhood, your street and the area you’ll be living in. Visit during the school run and rush hour. Is there a school nearby? Do commuters make access along your street impossible? Do parents on the school run park in your road and block the driveway ? Is there space to park outside your house if you don’t have a drive or will you have to park your car round the corner? Visit in the evening to see what activity is like. If you’re a light sleeper you probably don’t want to live on a street used by taxis throughout the night or police cars, or the route people use on the way home from the pub. Look at your neighbours houses. Is it well looked after? Knock on the door and ask them what the neighbourhood is like. Walk past in the evening and see if they’re playing loud music; one of the most common complaints from residents is the people next door making too much noise.

Q&A With Derek Dawson, Solicitor (Litigation Department) Q I am a landlord of a house and I have a tenant who is complaining about repairs needed to the roof. He is seeking compensation. Do I need to complete those repairs and do I need to pay him compensation? A As a landlord you have a duty to keep the structure of the property, which includes the roof, in a reasonable condition. You are liable to carry out repairs to the structure and to certain installations within the property, such as the hot water supply. You are only liable to complete those repairs of which you are aware, such as the roof. Your tenant should notify you of any repairs. Once you are notified you need to complete those repairs within a reasonable time of them being brought to your attention, which will depend on the nature of the repair. If you fail to complete the repair within a reasonable time then you are liable to pay your tenant compensation for inconvenience until the work is completed. You could face court proceedings being issued against you seeking a court order for the repairs to be completed, compensation, interest and costs. It is therefore in your interest to complete the repairs immediately, as that will limit any compensation and it will also protect the value of the property. Q I sold a property and contracts were signed. A deposit of 10% of the purchase price was paid. However the buyer has since changed his mind and has not completed the transaction. What can I do? A If the contract that has been exchanged uses the Law Society prescribed standard conditions of sale your solicitor needs to send to the buyerâ&#x20AC;&#x2122;s solicitors a notice to complete. If the buyer fails to complete the transaction within the time provided in the notice, normally 10 days, then you can cancel the contract which will allow you to keep the 10% deposit along with any interest that has accrued. You can then resell the property. If that resale results in a loss to you, i.e. it sells at an amount less than you agreed in the first sale, you can seek that shortfall from the first buyer, although you would need to show you have tried to minimise your loss by seeking the full market price for the property on the second sale. Alternatively, you could seek to issue court proceedings to enforce the first contract of sale, although it is unlikely the court will force the sale through a damages award would be the alternative.

What prompted the move up from London? We both really like Liverpool. Since the Capital of Culture the city has been rejuvenated. There’s a really different character to down south. There’s also twice the space here at half the price!
Why did you choose The Gallery? It came recommended. The size was a big factor and it has been so nicely furnished. Some apartments we saw were much too small and it didn’t seem as much care had been taken as here. New builds are so nice just to spend time in. It feels quite luxurious. The location is great too and it’s nice to be so close to the marina.
And the living area? We love the living room too. There are pictures of Sydney and Fiji which Kelly took and also a photo of Kelly’s first match at Anfield. There’s the TV which we bought for the World Cup. It’s large but it can fit in this flat quite comfortably. Also Kelly likes to play a lot of Mario on the Wii!
What about the bathroom? Again it’s so much bigger than other places we saw. It’s so nice to have a brand new, clean bathroom and it’s done out really well. Kelly loves to have a nice long soak in the big bathtub.
Tell us about the bedroom... I have my computer in there because I do a lot of work at home and there are more photos that we both took of Liverpool and New Zealand. They’ve done a great job furnishing the place all round.
Any plans for the place? We’d like to put some plants on the balcony and my Dad has promised me a big plant for the living room because it’s too big for his study at home! I suppose we’d like to get a few more pictures up on the walls too.
Tell us about the kitchen... We both take turns in the kitchen and we cook a lot of Mexican food. It’s larger and more modern than we’ve had before. It’s possibly our favourite area of the apartment. We’re not used to having such a big freezer. It’s changed the way we shop.

Comedy panel show regular Rhod Gilbert brings his “The cat that looked like Nicholas Lyndhurst” tour to the Liverpool Philharmonic in September. The face of Welsh tourism speaks to Jonathan Kearney about living on a desert island, performing the first-ever stand-up routine in Taiwan and his ambitions for doing not very much. INTERVIEW BY JONATHAN KEARNEY What’s the thinking behind the title of the tour? It’s all to do with this bloke who follows me round. He’ll just bring something along that relates to the title of my show, like when I did the “Mince Pie” tour he brought me a mince pie. God knows why, he’s just one of those people. I just tried to call it something so that he couldn’t bring anything. It’s all done just to annoy one person. Are you glad to be coming back to Liverpool? I always look forward to performing in Liverpool. It’s always good fun. It’s a nice city to hang round in for a couple of days. Some places I’m not that bothered about but I quite enjoy a stroll through Liverpool I must say.
aren’t to be honest. I enjoy some but others are a bit of a nightmare. It’s very difficult to do as a comedian because sometimes it can get a little bit competitive. I think you can see the ones where comedians are having fun because it probably comes across that they’re enjoying themselves. Stand-up is what I do and it’s probably what I do best. I enjoy doing these TV things but really it all comes about because of stand-up. I don’t know how much longer I can keep doing it because it’s tiring and there’s a lot of nights away but at the moment it’s what I do best. You’ve travelled quite extensively. You even spent five months living on an exotic island... Yeah I did. That was after university when I didn’t quite know what to do with myself. I ended up living on a little island in Indonesia, climbing coconut trees for my breakfast and fishing for my lunch. We used to go hunting and all that kind of thing. It was a nice way of life and quite a bit different to what I’m doing now! It was amazing and one of those things you look

It’s going to be very busy but I’m used to it now. It’s kind of easier than it used to be because of the little luxuries that I can afford now, like a driver. A few years ago I was driving myself and that’s a real killer. Do you have a laugh with the TV panel shows or would you prefer to be out on the road? Some of them are a laugh; some of them 40 Your Move
back on and think “did I really do that?” I think stand-up is a bit like that. I think once I stop doing it I’ll look back and think “was I really on ‘Live at the Apollo’?” It’s one of those things where it all happens so fast that you look back and think “did that really happen or have I made it up?” Were you really the first stand-up to perform in Taiwan? I’m not sure if I was or not! An article put that somewhere and that’s somehow
became gospel but I don’t know whether that’s a myth or not. I certainly did do a gig in Taiwan and they certainly hadn’t had much comedy there but it was actually quite good fun. There’s a guy who puts on gigs in the Far East in places like Bangkok and Hong Kong and I think he just tried it out in Taiwan. I don’t even know if he ever went back. I think I was the guinea pig. Would you like to tour more abroad? I don’t know. I’ve done quite a lot of stuff in Australia and New Zealand and it’s great fun but you have to make a real effort with it and commit to doing it every year and build up your audience there. I don’t know if I can be bothered to do that. I’m quite happy to do it here. Who is your comedy idol? I think Eddie Izzard is probably the closest thing I’d come to a comedy idol. Right now I think Gervais is pretty phenomenal too. Do you have any TV work lined up after the tour? I’ve got a BBC One series coming up which will be on Monday nights and I’ve got another series of the work experience show doing jobs like farming, so it’s all very busy for the foreseeable future. Tell us about your new radio show... Yeah it’s on Radio 2. I’ve got my Radio Wales show which I do every Saturday and I really enjoy doing that and then I’ve got this Radio 2 series which starts at the beginning of September. I just finished recording it this week. You’re really given a lot more freedom when you’re on the radio. The series I just recorded was just me and two of my mates d***ing around in front of an audience. We’ve just messed about for two or three hours and they’ve edited it down into an hour. I love it. I don’t do any preparation, I just turn up and have fun.

We live in a three storey house. When we first moved into the property we didn’t know what to do with the basement area, so we really used it as a storage area and playroom for the children. First of all I would always recommend, no matter what hi-tech equipment you are going to use for your screen, that you build a false wall in the room. A false wall will help you conceal all the cables and sockets that may be required. The False wall if planned properly could also give you hidden or open storage space that is nearly always required for CDs or DVDs. Another tip is to paint the false wall black, not only will this give you an cinematic atmosphere, but when the room is being used as more of an entertainment space it will help blend the screen into the background . I would always have all lighting in the room controlled by a dimmer switch so you can adjust the brightness levels you require. Your Move 43

and a half mile distance along the length of Liverpool docks from 1893. The coach is the first of 6,000 objects that will make its way through the doors of the new museum, which is scheduled to open next year.

Development is all about creating something to work better for us, now, and to lead to further improvements of our infrastructure. It’s about making things better than they were before.” From this vantage point, where Japanese food and chic interiors are also making their impact in a stunning, but often hidden, part of the city, I couldn’t agree more.
