KING OF YOUR CASTLE The road to buying your own home usually ends with popping the champagne cork. Once the ink dries on your lease, what can a leaseholder do to protect themselves from unscrupulous landlords? Bad management can devalue a property between 10 and 50 per cent. From knowing where your service charge is going, the implications of not paying the service charge, to your rights if faced with an incompetent landlord, Your Move examines the ins and outs of building management. SERVICE CHARGE From safety of the building to landscaping of gardens, service charge is an all-encompassing expense for every owner of a flat in a building, paid to a company who manages the building. It is normal practice for developers today to set up a block management company for the building and employ a managing agent upon completion of a new-build. The block management company deals with the utilities such as the electricity in the communal area, lifts, landscaping, cleaning, insurance, and maintenance for the exterior of the building. The managing agent collects the service charge and deals with day to day issues. They also assess the level of service needed for the building, such as 22 Your Move

whether to have a concierge, and do a proposed budget report which is used to calculate the level of service charge. Each leaseholder of an apartment is effectively a shareholder (with one vote) in the company who can vote on how the budget is spent, what the service charge should be and choose the managing agent. So why appoint a managing agent at all? Running a building is as complex as running a business. As Louis Anastasiou, managing director

of Andrew Louis, explains, the role of a managing agent is essential to running a building well and preventing owners losing value on their home due to a badly maintained exterior. “We manage in excess of 60 buildings in Liverpool, Manchester and Hull,” he commented. “As a managing agent we get discounts on bulk purchases and certain contracts like lifts, cleaning, building and maintenance and we pass those discounts on. RIGHT TO MANAGE What happens though when a building has no block management company? The building still has a managing agent but they are only legally accountable to the freeholder, leaving the leaseholders with very little say on maintenance and service charge cost. Right to Manage is the process where leaseholders take

over the management of their residential building. There is still a large number of apartment blocks in Liverpool where the developer is the freeholder. They appoint the managing agent but no block management company. The number of disputes across the country over service charges is rising fast, but challenging a property management company or freeholder through a tribunal can be a lengthy, demanding and exhausting process. The road to Right to Manage is legally a relatively straightforward procedure and you don’t have to prove the existing managing agent is at fault. All you need is at least 50 per cent of leaseholders on board, and the building selfcontained with at least 75 per cent of it residential. Ian Magenis, partner at Scanlans Property Management, explains: “This legislation exists to give leaseholders the opportunity to take control of the running of their development. It’s surprising how few apartment owners are aware of the Right to Manage legislation and how they can

time. On some blocks you can get as high as 25 per cent of leaseholders not paying the service charge.” On behalf of the managing company, a managing agent would send out the overdue letters, with enough time for owners to pay or negotiate a payment plan. However if the owner still dodges payment court action is taken which leads to a CCJ and may end with repossession. Before purchasing an apartment, it is vital to research the building’s managing agent to make sure value will be retained through regular maintenance. If already living in an apartment and looking for a new managing agent, experts recommend holding a ‘beauty parade’ of at least three different managing agents before selecting one.

SUPER SERVICE STARS he 2011 Ambassador Awards honoured the men and women who go that extra mile to make sure visitors experience an outstanding Liverpool welcome. The 12 awards were presented by the Lord Mayor Hazel Williams at the Crowne Plaza Hotel, with TV comedy star Neil Fitzmaurice hosting the awards. Award winners included Amy Louise Keating, of Boudoir Boutique, who won Young Person of the Year and Liverpool ONE who scooped five awards on the night. The city council’s tourism team organised the event working in partnership with Liverpool ONE and City Central BID. More than 550 nominations were received – a record breaking number – and these were whittled down to a shortlist of just 41 lucky people who work across the city.

Following on from previous amnesty arrangements for dentists, medics and holders of offshore bank accounts, the taxman is now encouraging plumbers and those in associated trades to come clean. Under the PTSP (Plumbers Tax Safe Plan) plumbers (and other taxpayers) are given the opportunity to fix any leaks in their tax affairs, by making what is called a voluntary disclosure to HMRC. In return they will be offered lower penalties of 10-20% on any unpaid tax, compared with up to 100% normally. The scheme despite its name is also available as a general tax amnesty. HMRC are following up this incentive with a threat to track down errant plumbers using information they have obtained from Gas Safe (formerly CORGI). The areas which the taxman will be focusing on are likely to be: ‘Cash’ Jobs Plumbers have been singled out because they do a lot of cash work, and the taxman believes that tradesmen in receipt of cash may not have declared all of their income. They will also be on the look out for businesses and individuals which have breached the VAT registration limits, but not registered for VAT. Over claimed Expenses Many plumbers are self-employed and so have the potential to incorrectly claim expenses for working from home, for home to work travel and for subsistence. Training costs Training to become a plumber is costly, and some plumbers may have been tempted to incorrectly claim the cost of the training and course fees to obtain their registration. If anyone has not yet told HMRC that they have started working for themselves then the PTSP offers an opportunity to make a fresh start. Anyone thinking of entering the PTSP scheme will have until 31 May to notify HMRC of their intentions so they must act quickly.

KNOWSLEY SAFARI TURNS 40 One of Merseyside’s favourite attractions, Knowsley Safari Park, is to commemorate its 40th anniversary later this year and asking people to join in the celebrations. The safari park is planning an exhibition, which will look back at its four decades of caring for exotic animals from all over the globe. Knowsley bosses want contributions from visitors to be a key part of the summer show. Situated on the famous estate of Lord Derby, the vast reserve, which opened in July 1971, is home to many different animals including elephants, giraffes, lions, bongos, tigers and baboons. General Manager, David Ross, explained: “As well as covering the major milestones in our history, we want the exhibition to reflect the impact the park has had on some people’s lives. This could be because someone has visited us hundreds of times over the years, or because a bride was proposed to in front of the baboons in our monkey jungle. “We want visitors to get in touch

with their stories, photographs and examples of old park memorabilia to provide a human angle to the exhibition.” Knowsley was the first safari park in the country to be created close to a large city - just eight miles from Liverpool City Centre. It aimed to replicate the experience of visiting the drivethrough game reserves of East Africa, with humans caged in their vehicles and animals running wild. Today, its 550 acres of parkland are home to more than 700 animals living in near-natural conditions, including many endangered species like the white rhino and Pere David’s Deer. Liverpool Enterprise Zone announced Liverpool is set to get a new Enterprise Zone, aimed at boosting business in deprived areas. The government announced ‘Mersey Waters’ had been chosen as the Enterprise Zone. The area straddles the River Mersey, and covers both sites of the 30-year regeneration projects - Wirral Waters and Liverpool Waters.

Recession no impact survey Over a quarter of Brits say that the credit crunch has made no difference to how they view the property market, according to a Miller Homes survey. The nationwide survey polled over five thousand new and potential home-buyers to gauge their confidence in the property market. Anita and David Scanlon, who runs David Scanlon Architects from home, bought a four double bedroom house in Grassendale L19. The £233,000 property bought from Move Residential underwent six weeks of structural refurbishment before the Scanlons moved in a week ago.

The landing didn’t have a window so it was very dark and dull so we took away the fifth bedroom, which was tiny and made it into a landing.

The house has been completely redone head to toe. I grew up in this area and our previous house was down by the waterfront, which was too isolated for us. Location was the main reason for the move and we wanted something a little more traditional because we work in architecture. We used to live in a 1930s semi and we’ve come back to it because we missed it. It took us a while to find a house because it was quite hard to buy a house around here with the size we wanted for a family of five. We are quite minimalist, I do like green and it goes perfectly with all our furniture. Our youngest daughter Eve plays a little guitar which matches the colour of the room all pink.

Part of the renovation was turning the loft into a boudoirstyle room for our eldest, Fern. I would like to get some of the elegant Laura Ashley oldeworlde style furniture for the room eventually. With the kitchen we had a vision of what we wanted to do straight away. The kitchen was an L-shape, very narrow, and we have just boxed it off and made it more airy we have the folding doors that lead into the garden as well. The privacy gives it a nice aspect.

What do you remember about growing up in Liverpool? I grew up in a tenement in Parliament Street, with my nan and granddad, mum, dad and four brothers. We were poor, but if everyone else is the same, you don’t know you’re poor, do you? At school the teachers said I was thick. When I went in that was. A lot of times I stayed at home looking after my mum, who was bad with her nerves, but lovely with it, and my little brothers. There were things that happened that weren’t nice, but there were lots of good times too. When you’re playing out as a kid, everything else goes out of your head. Walking up Parliament Street was a real experience in those days – all the different smells. It felt alive. How did the book come about? Nobody knew I’d written one. I learned to read and write at adult education classes when I was 25 or 26, and we wrote about our lives to improve our writing. I would write then shove it in the draw. I filled two drawers then four. I wrote to make sense of my life. There was no beginning, middle or end. I 40 Your Move

How did you become a stand up comic? I have a lot of nervous energy. I would say something and people would say, you should be on stage. I’d say, ‘me? I’m about as funny as piles.’ I entered a few competitions and won them but although I’d been in some films and TV, I never did anything like that other than for charity nights. About seven years ago I had just had some operations for cancer and afterwards I just decided to start life again. So I went to Spain and started being a comedian. How did Benidorm come about? I was working every night at hotel El Presidente and Captain Morgan’s Tavern in Benidorm. One night two men and a woman came in and said they were writing a TV series and were looking for someone to play the person who runs the hotel. One of the men was Darren Litten, the series’ writer. Morgan’s Tavern is actually Neptune’s Bar in the show and for the first few episodes I would film at Morgan’s during the day and be back there at 6.30pm to do my own show. What do you think of your character, Janey York? I love her. With Janey, what

you see is what you get. I can imagine her when she was young, going round thinking life was going to change, but she’s still stuck there. I’m nothing like her. I’m happier! Are sun, sand and free cocktails your idea of relaxing? No, I don’t drink! I love New York and Prague because I love buildings and history. I don’t like sun or sand, probably because I had it for seven years. I couldn’t wait to get indoors everyday after filming. I was like Miss Haversham, skin as white as a sheet. Everyone slates Benidorm, but it’s brilliant. It’s like Blackpool in the sun or even Vegas. It’s like being back in the old days when there were social clubs. Where do you go out when you come to Liverpool? I hardly go out. But I go to Mecca Bingo on East Prescot Road one Sunday every month with my friend Margie. The bingo caller, Steve, is an old friend of mine and we do a lot of charity work together, like raising money for cancer. I see people there I grew up with. I’m not Crissy Rock to them. They say, ‘have you had any luck,’ and I say ‘no’.

I have recently moved into a new home and there is lots of work that needs doing. After the expense of moving and saving for my deposit I now have a very limited budget, and most of the work I will have to do gradually. In the meantime I have decided to smarten up the rooms with a lick of paint here and there. The kitchen is causing me problems, the units and tiles are modern and practical but they look so boring! A friend has suggested that I could paint the tiles; do you have any other suggestions?

We are currently renovating a house; everything from the skirting boards, floor boards and ceilings has been stripped bare. We have now completed all of the major building tasks and are now looking at putting the interiors back together so the space starts to resemble a home of some sort. Our first task is to look at deciding what kind of architectural features we want. We would like to use very contemporary/unusual features, to give the rooms a unique character. When we have tried to find contemporary plaster mouldings or skirting boards most companies just show us plain or smooth mouldings. Are there any companies that sell more unusual contemporary mouldings?

They could instantly transform your kitchen in a matter of minutes. They are really easy to apply, you can create your own patterns and the great thing about them, is when you tire of the design you can easily peel them off. Painting novice Over the Easter break I am planning on painting the spare room. I have just finished decorating my room and I am planning on using the accessories that once were in my room in the spare room. I want the spare room to look different though! This is where I need your help. In the past I have always had a problem choosing paint colours, I get so frustrated and lack so much confidence that I resort to picking an off white or cream. I am determined not to make the same mistake. The accessories I would like to use in the room are traditional. I have an oriental rug which is very faded, but I love the colours in this which I would class as, soft purple, pink, grey and terracotta. Could you help me by suggesting a paint colour I could use?

he Liverpool Half Marathon was declared a huge success with thousands of people taking to the streets in a friendly run. The winner was Ben Fish, from Blackburn, who completed the 13-mile course with a time of one hour and seven minutes. The Half Marathon took runners from Wapping Dock, along the historic sites of the Anglican Cathedral, Princes Road Synagogue, through the warm breeze of Sefton Park and along Otterspool Parade. The Half Marathon is one of a series of events for local runners this year, with the highly anticipated return of the Liverpool Marathon in October.
