Since the economic crisis hit, we’ve all become more aware than ever of the importance of dealing with reputable firms. When it comes to parting with your hard earned cash especially, it’s good to know you’re dealing with a firm you can trust. Companies that are members of governing bodies offer that reassurance.
Would you ever get into an unlicensed taxi? Or take a loan from a lender that wasn’t regulated? The chances are you’d know better than to take that risk yet strangely enough many consumers do not apply the same rule when it comes to estate agents. Whether you’re buying a house or renting a room, finding the place you’re going to call home takes a lot of consideration so it’s not surprising that so many people enlist the help of an estate agent. However, too few people take the time to check if their estate agent is regulated, which can lead to some dire consequences. “Unregulated agents can cause tenants, landlords, homebuyers and sellers unnecessary stress and hassle - and sometimes loss of money - by giving incorrect or misleading advice or offering poor standards of customer service,” says Louis. Indeed, we’ve all heard the horror stories of rogue agents collecting rent from tenants but not passing it on to landlords or cowboy operators who deliberately fail to give house hunters the full facts about a property. While estate agents aren’t officially regulated (in the way banks, for example, are regulated by the Financial Services Authority) they can join trade associations and by doing so agree to adhere to a strict code of conduct, thus giving consumers someone to turn to should a problem arise. In the estate agent sector the two main governing bodies are
the Association of Residential Letting Agents (ARLA) and the National Association of Estate Agents (NAEA). The legal entity umbrella for these two professional memberships is the National Federation of Property Professionals (NFoPP). “The membership bodies play a pivotal role in the property industry,” explains Louis Anastasiou, managing director at Andrew Louis and an advocate of regulation. “Their main functions include regulating, guiding and assisting property professionals across a wide range of disciplines.” In order to qualify for membership agents must not only follow a code of practise but must also hold Professional Indemnity Insurance, have an internal complaints procedure should things go wrong and be a member of a redress scheme such as the Property Ombudsman. And it’s not just consumers who can benefit. Louis says membership of a trade body can enhance the agent’s credibility and show their clients that they are a qualified professional and belong to a reputable, recognised professional body. “I personally believe that all agents should be licensed to practice, both to protect the consumer and to encourage and maintain high standard of service and knowledge,” says Louis. So if you want the added protection of knowing your dealing with a reputable firm and you have a trusted body you can turn to should the worst happen be sure to check your agent is regulated.

Second Home Flip falls foul of HMRC
W
e inherited a house from my parents a few years ago, which we are thinking of selling. My husband says that before we sell it we should say that the house has been our main residence as this will save us a lot of Capital Gains Tax. Can you help? A capital gain made on the disposal of a person’s individual private residence is exempted from Capital Gains tax by a relief called Private Residence Relief (often called PRR). What your husband is probably referring to is that when an individual has more than one private residence he or she can make a special election that one or other of the houses is treated as his main residence for tax purposes. The election need only be in force for a short period of time to effect a saving of tax. As you are married and jointly own the property the nomination must be made by you both.
That sounds excellent. How do we go about making the election? Well first you will carefully need to consider the circumstances. The critical point is that in order to be able to make an election the property must at some point be an actual ‘residence’ for the owners. Following on from a number of similar cases, HMRC have recently succeeded at Tribunal in denying relief to a couple who made an unsuccessful PRR election. The couple, Michael and Brenda Harte were also left a second property “Alder Grove” by a deceased relative. They owned another house, their home at Crofts Road. Before selling the Alder Grove property they made an election to treat the property as their main residence for a brief period. At all other times, Crofts Road was their main residence for capital gains tax purposes. When the couple sold the Alder Grove property they claimed PRR relief on the sale, to reduce their tax bill. The taxman denied them tax relief on the basis that Alder Grove had never been their private residence. The couple argued that they stayed at Alder Grove on odd occasions, but were not able to present enough evidence to the Tribunal to show that it could be regarded as a home. There was also no record of the dates that they actually occupied each property. So in order to make the election, not only does the election paperwork need to be in order, you must also be able to demonstrate that the property actually was your residence. Evidence of this could be provided by paperwork such as bills and statements, subscriptions at the address for Broadband and TV, evidence of furnishings and actual usage of utilities etc etc. The claim itself should be made in writing, within 2 years of the acquisition of the property in question. As always good professional advice will be required to ensure that you reach the best outcome for your particular circumstances. All our guys are local to the area they cover and knowledgeable. We only take on engineers with 15 years experience or more.” GDA is open seven days a week and customers can call up to 11pm. Dave says it’s also important to give customers added reassurance when completing work of this kind and as such GDA is the only company to offer a 10 year guarantee on all work completed. “We very rarely get a call back, which just goes to show the quality of the work, but we do offer a ten year guarantee,” he says. “Everyone else just offers 12 month’s guarantee.” GDA managed to navigate the economic downturn by cutting its

Miss England INTERVIEW WITH FOOTBALL STAR SUE SMITH
Whiston-born Sue Smith began her footballing career at Tranmere Rovers aged 14. By the age of 17 she was playing for England. Now a star player for the Doncaster Belles, she has joined forces with Sky Sports to become a mentor for youngsters. Your Move caught up with her to find out why she wants to give something back and what she thought about THAT penalty shoot out.

Had you always wanted to pursue football as a career? Why? I have always wanted to be a footballer even from the age of 5, I used to watch my brother and say I wanted to play for England one day. What has been the highlight of your career? I was selected to play in a FIFA World 11 select team so playing with some of the best players in the world was a great achievement of mine. What was it like growing up in Whiston? I love my hometown and visit regularly. Liverpool is a fantastic city and I’m proud to have been brought up here. I love the atmosphere, how friendly people are and the sense of humour. Oh and the shopping! Do you have any pre-match rituals? I am quite superstitious and I always put my left sock and boot on first. I’m not sure why but it’s something I’ve always done. You’ve got a bit of a name for yourself for having quirky hairstyles, why do you change your hair so much? I’ve always liked to stand out from the crowd and I suppose some of my dodgy hairstyles
have helped me to do this. Are you looking forward to the Olympics? What sports will you be watching out for? Yes I am really looking forward to them. I am so disappointed that I got injured six weeks ago, which has prevented me from taking part. However, I am pleased to be doing the punditry on the BBC so I can remain closely involved. I will be keeping a close eye on the football and like everyone else I love watching the athletics. How important do you think it is to have the Olympics in London? I think it is really important. It is great for promoting minority sports, such as women's football, and gives everyone a chance to watch. The Olympics have taken over everyone; even people who aren't interested in sport are getting behind Team GB so it can only be a positive thing. You’ve been named as a Sky Sports Living for Sport athlete mentor, how important do you think it is for young people to be involved in sport? It’s very important to try and encourage youngsters to get active, not only does it keep them fit and healthy but it also gives them life skills which they can take on into their adult lives. I am so proud to be involved with Sky Sports Living for Sport and grateful to have the opportunity to give something back and help
the youngsters be the best that they can be. Finally, did you follow Euro 2012? Yes, I did. I was a positive England fan and believed we would go all the way to the final to be honest. I am so disappointed that we went out on penalties, as a footballer myself I know how that feels, but I do think that the best team won. Italy kept possession better and seemed fitter than England. I felt sorry for the team, it's such a shame I really thought it was going to be our year.

City Central B.I.D has commissioned a bandstand on the square as part of its Summer of Love campaign and now organisers are searching for the best talent in
Liverpool to take to the stage during the free, four-week festival. Thanks to Arts Council England funding the Summer of Love Liverpool Bandstand will be operated four days a week (ThursdaySunday) by Open Culture, with a professional sound engineer to support four performances a day from noon to 5pm. The pop-up bandstand, which measures 13ft high and 18ft wide and will feature seating for the public, will also be available for ‘free play’ on Monday to Wednesdays. Royal Court reopens
The Royal Court Theatre is reopening its doors to the public next week after the completion of the first phase of its £10.6m redevelopment. Workers have spent the last 14 weeks completely renovating the theatres auditorium. The entire auditorium has been repainted in classic black and gold. New lighting and seating have been installed, the bar area has been remodelled and the toilet facilities improved. The work was paid for by a £867,000 Heritage Lottery Fund grant and more than £200,000 raised by theatregoers.

A Wirral-based luxury boutique hotel has become the only five-star rated hotel in Merseyside. The Hillbark Hotel & Spa has been awarded five AA stars making it the smallest hotel with five stars in the country. Garland’s elaborate escapism is swinging to another destination as the madness encamps to somewhere totally new. The UK’s second biggest carnival, behind only Notting Hill, will grace the streets of Liverpool again. rts-fans gathered at Kasbah on Bold Street for a celebration of the opening of Liverpool’s Arabic Arts Festival. Guests enjoyed Arabic refreshment and music while meeting some of the festivals performers including the ‘Arab Billy Elliot,’ Ayman Safiah and festival director Razanne Carmey. Highlights of the festival include veteran film actor Nadim Sawalha who is directing the play ‘Rest Upon the Wind’, a musical world premiere from the Alif Ensemble at Liverpool Philharmonic Hall, stand up comedy from US comedienne Maysoon Zayid and a presentation of political satirical cartoons at the Walker Art Gallery from artist Reem AbdelHadi. The eleventh annual festival is the only festival of its kind in the UK and takes place from 6-15 July 2012 in various city centre venues. There is also a popular family day in Sefton Park.
