Rent up frustration – the impact of rent on Entrepreneurs Relief

I

am an estate agent, and my business operates as a limited company. I own the premises which the business uses personally and I charge rent (plus VAT) to my limited company. My accountant has told me that, unless I stop charging rent when I sell the premises, I will not be able to claim Entrepreneurs Relief to reduce the Capital Gains tax on the sale. What should I do? Entrepreneur’s Relief (ER) can reduce the tax rate on qualifying gains to 10% up to a lifetime limit of £10 million (Compared to a tax rate of 18/28% normally). Assuming that your limited company meets the necessary ER conditions then if you were to sell the building/premises at more or less the same time as the business then you could qualify for Entrepreneurs Relief on both disposals, which can save substantial amounts of tax. However, and this is what your accountant is taking about, the amount of Entrepreneur’s Relief is restricted if.

If rent has been charged then the tax relief will be restricted by reference to the proportion of the market rent which was charged. This catches many people in your situation out as the previous taper relief rules did not include this restriction. OK, well I am planning to sell my business and the building in a few years and retire, so I will stop charging rent straight away! Is there anything else to think about? Yes, isn’t there always! Stopping charging rent can sometimes lead to a major VAT headache. If the building has ‘Opted to Tax’ which means that VAT was not suffered when it was purchased and VAT is charged on the rent, then ceasing the rent means that you may not be making taxable supplies, and you will be obliged to deregister for VAT. This will unfortunately give rise to a VAT liability of 20% of the Market Value of the building. I have heard of several examples where the tax man has caught up with unwitting taxpayers in exactly your position, so good advice is vital. Finally, the Chancellor gave his Autumn Statement on Wednesday, and it is possible that Capital Gains Tax rules may change...Watch this space!

So how was it for you? After a tough time for the property market 2012 was the year that things finally turned around. Confidence returned and those green shoots we’ve all been hoping to see finally made an appearance. Here we take a look at the last 12 months as we bring you Your Move’s round up of the year.

JANUARY With the New Year came a new start for the industry and 2012 began with distinctly more confidence than the last few years. And after plenty of negative reports claiming first-time buyers had no chance of getting onto the property market we embraced the market’s newfound optimism, bringing you news of the government’s latest schemes to help firsttimers take the plunge as well as the launch of the third annual First Time Buyers Show.

Iconic brand Harvey Nichols announced plans to open a new concept store in the city and anyone looking to be their own boss in 2012 was given a helping hand thanks to the Merseyside Franchise Show 2012.

It was a great month for LSL Land and New Homes, which scooped a gong at the Estate Agency of the Year Awards, sponsored by the Sunday Times. And Paul Crowley & Co Solicitors announced it would be extending its hugely successful free legal clinics.

The start of spring brought plenty to smile about for would-be buyers as momentum continued to build for the First Time Buyers Show 2012 and the government launched a brand new initiative to help get the housing market moving. NewBuy was developed to encourage lenders to lend more by removing some of the risk involved. Developers and the government would underwrite the mortgage, providing a guarantee for banks. However, it wasn’t all good news. The stamp duty holiday, which saw first time buyers exempt from paying the tax on properties under £250,000, came to an end on March 24. One of Liverpool’s most iconic buildings, the magnificent Albany, was given a new lease of life as its newly refurbished apartments were put on the market by City Residential. Meanwhile Andrew Louis became the first agent in the city to use cutting edge iPad 3 technology to market its properties.

APRIL

MARCH FEBRUARY Political fever gripped Liverpool in February as the debate over whether or not the city should have an elected mayor gathered pace. We took to the streets to get your views; with the majority of you deciding a new form of leadership would be a good thing. However, while we gave you a chance to have your say the council did not, with council members

And the city come to a stand still as the Sea Odyssey giants took over Liverpool, capturing the public's hearts as they went.

holiday, a show-stopping concert and the customary wet British weather. The Olympic torch came to Liverpool on its UK tour with taxi driver Bernie Buxton chosen to be one of the torchbearers. Bernie was picked out of 20,000 nominees for his charity work with the Liverpool Taxi Drivers Children in Care Outing Fund. Riverside opened a brand new show home at its Millbrook development and Abode continued its growth with the recruitment of Stephanie Walker as a new agent.

JULY The Olympics were the big event of the summer with the likes of Jessica Ennis and Mo Farah doing us proud. Meanwhile developer David Wilson Homes was busy winning gold too, receiving the Gold Award for customer satisfaction following an independent national survey. More than 200 customers of the developer were surveyed over a 12-month period and every customer questioned said they would recommend David Wilson Homes to others.

In May council leader Joe Anderson become the first ever elected mayor of Liverpool, winning the public vote by a landslide. The former social worker achieved 59% of the vote. Paul Crowley & Co Solicitors announced it would be sponsoring the Merseyside Landlords Expo 2012 and Reeds Rains launched its City Living brand in Liverpool, opening a branch on North John Street.

But while the weather may have been miserable the industry certainly wasn’t. Indeed, there were celebrations all round as Paul Crowley opened a new branch in West Derby, Go Direct Lettings welcomed a new franchisee and renowned interior designed Elaine Cunningham scooped the Best Lifestyle accolade at the Liverpool Business Awards.

SEPTEMBER The Merseyside Landlords Expo 2012 was one of the highlights of September with hundreds of visitors – from experienced landlords to newbies – descending on the Crowne Plaza hotel to make the most of the free event. With 30 exhibitors and a jampacked seminar schedule the event proved to be the best one yet. And no sooner was one event over than excitement was building for the next. Preparations for the biggest event in the industry calendar, the Your Move Property Awards, were well under way and Keppie Massie became the latest big name to get involved when it signed on to sponsor the Regeneration Award.

And Sutton Kersh was celebrating after figures from market research provider Vizzihome, revealed the agent was number one for property sales in Allerton and South Liverpool in the first half of 2012.

JUNE The start of summer saw the Queen celebrate her Diamond Jubilee with a double bank

AUGUST August saw the typical British summer reach new depths as the annual Matthew Street Festival and the dance music extravaganza Creamfields were both called off due to bad weather.

Meanwhile developer New City Vision launched its latest show home at the stunning Ellergreen development.

OCTOBER By October the Your Move Property Awards had sold out completely, making the event the most successful one to date. Gleeson unveiled its latest show home at Cawdor Park in Granby after enlisting the help of a budding young designer, schoolgirl Jumanah Alqfaili. Bellway offered buyers the chance to save

Merseyside’s first Apprenticeship Awards  Nominations are being invited for the first ever Liverpool City Region Apprenticeship Awards. Across the city region, many thousands of people are taking their first step on the employment ladder by training with local firms and local organisation, First Ark Group, (parent company of Knowsley Housing Trust and Vivark Ltd), is the latest organisation to show its support to the stars of tomorrow by becoming a sponsor of the apprenticeship awards 2013. The first ever apprenticeship awards for the Liverpool City Region will celebrate the star workers of tomorrow and recognise employers who go the extra mile to provide support and encouragement for apprentices. The Knowsley based not for profit organisation recently took on nine new apprentices, bringing their total across the trust to 23

and are sponsoring the Liverpool City Region Apprentice Employer of the Year Award 2013 for the SME category. The awards are open to apprentices and employers in Halton, Knowsley, Liverpool, Sefton, St Helens and Wirral, and are sponsored by Greater Merseyside Learning Providers Federation. The awards will recognise the ‘Apprentices of the Year’ (set into two categories for sixteen to twenty-four year olds and over twenty-fives) and ‘Apprentice

 The Educate Awards 2012 shone a spotlight on the success of Merseyside schools with a glittering awards ceremony at the Crowne Plaza Liverpool on 3 December. The awards celebrated the achievements of Liverpool, Sefton and Knowsley schools and pupils. Merseytravel was the main sponsor of the event and awards category

Despite a tough few months for schools across the country, organiser of the Educate Awards Kim O’Brien, says: “There has never been a better time to put the spotlight on education in the area and celebrate its successes”. Landlord pledge taking shape  A new initiative that aims to set new standards for Liverpool landlords is gaining momentum. Liverpool City Council’s Ten Point Pledge plans to reward good landlords and Cllr Ann O'Byrne target those who provide an unsatisfactory service is gaining momentum The pledge sets out a balanced approach to assisting good landlords, whilst at the same time making it clear that unsatisfactory housing and poor standards of management will not be tolerated. A key part of the pledge is the Citywide Voluntary Registration Scheme, which is now up and running. Landlords can register their contact and portfolio details (although the council will accept just contact details if landlords have reservations about sharing their property addresses). Registered landlords will have access to Property Pool Plus for advertising vacant properties and more incentives will be made available for good landlords. A rogue landlord hit squad has also been created. It will seek out and investigate non-compliant landlords and letting agents, take appropriate action and publicise successful prosecutions. Now councillor Ann O’Byrne is calling on all private landlords in Liverpool to support the pledge. Harrogate-born Russell Harris made his name as a TV and radio presenter, fronting the likes of “The Dice Man” and “I own Britain’s best home”. He also caused a stir on the property scene when he bought and renovated an old water tower in Lymm, Cheshire – turning it into a state of the art home. Now he has turned his hand to art, exhibiting his work for the first time at Corke Gallery on Aigburth road. We caught up with the man of many talents ahead of the exhibition.

GRAND DESIGNER INTERVIEW WITH TV PRESENTER RUSSELL HARRIS

INTERVIEW BY CHRISTINE TONER You’re a property developer, designer, artist and TV presenter – which came first? Which is your first love? I’m a TV presenter really. I actually started out as a club DJ, working in Southport. I’ve done lots of radio and television, so I’m a presenter first and foremost. The property developing and art came later. Have you always been creative? Yes. I make films for a living, that’s what I do now. I produce TV. Whether it’s musically or visually, I’ve always been doing something creative. It’s all been leading towards this point of getting into painting really. You’re well known for converting the water tower in Lymm, which has recently featured in Kevin McCloud’s latest book as one of his top 75 houses in Britain. Tell us a bit about that project. We bought it 15 years ago in 1997 and spent seven years renovating it. We’ve been living in it ever since. It’s 90 foot high and has six floors. It’s got 5,500 square foot of floor space and there’s a hot tub on the roof. It’s

fantastic. We’re very lucky and we worked very hard to achieve it, there was a lot of blood, sweat and tears. It has won lots of awards, including one from the Royal Institute of British Architects (RIBA). It’s quite an iconic building. You’ve presented plenty of TV programmes, what’s been your favourite show? I’m most well known for a show called ‘The Dice Man’ which was fantastic. A friend and I went round the world with a dice, throwing the dice to determine what we did next. It was good fun. It’s amazing 12 years later we’re still selling DVDs of the series and it still gets shown around the world. The thing I enjoyed most is the fact

that people got it. It’s awful to do a programme that no one notices but they really embraced it. The most recent thing I’ve done was a programme for channel five called ‘I own Britain’s best home’. It was great getting to see people’s houses. Your work will soon be exhibited at the Corke Gallery, how did you get into art? I’ve always wanted to paint. I’ve been inspired by people like Damien Hirst and I thought ‘Why not? What’s stopping me?’ I rented a studio in the Northern Quarter in Manchester and build some kit that I needed to produce the work and got on with it. Your pieces are based on spin art, can you explain what that’s about? It’s no mystery, I’m not a trained fine artist. I built a machine, I fit the canvasses to the machine and spin them at high speed and then I put the paint on. What I’d like people to take from this exhibition is that everyone can do it. Finally, what are your plans for Christmas? I’ll be sitting in the hot tub in my roof garden, 90-feet above the Cheshire countryside, with snow falling all around, the family, the bells of the local church peeling and a glass of Leffe beer...what could be more perfect?  Russell’s work will be exhibited at The Corke Gallery, 296-298 Aigburth Road, 8-23 December.

Nordic Church Christmas charity concert A local social housing worker is raising funds to build houses in Malawi by putting on a Christmas charity concert with a difference. Catherine Corkish, sales and new business manager at Riverside Homes has organised a concert in aid of Habitat for Humanity at the stunning and atmospheric Nordic Church in Liverpool. Opera singer Jess D’Silva will perform classic carols, a string quartet and members of the choir Indigo Vibe will also perform a mixture of Christmas pop classics. Catherine Corkish, organiser of the event says:

“With the concert and fundraising for my trip we want to raise awareness of the work of Habitat for Humanity and remind the local community in Malawi that they haven’t been forgotten about.” The concert takes place Saturday 15 December, tickets cost £10 for adults and £5 for children and include homemade mulled wine, hot chocolate and a mine pie on arrival. Breathtaking inside and out, the high-end decoration and stunning original features mean that the development won Best Show Apartment in the Your Move Property Awards 2012. “It’s been very popular,” says Martyn. “In the last few years there have been so few new projects, it’s mainly old stock being churned out, so when something high quality and new comes to the market, people can get really excited about it.” The response from the public has been excellent, since the launch two weeks ago three of the apartments have already sold with just two now left on the market. Martyn’s croque monsieur is also well received, a Swiss cheese and ham toasted sandwich topped off with a yolky egg. The steak on my ciabatta is exactly the right texture and comes with tangy mustard mayonnaise, which goes down a treat.

As we tuck in I’m intrigued to know just what it is about Jones Lang LaSalle that attracts such a roster of large clients through their doors for commercial, residential and investment property deals. “What clients love about Jones Lang La Salle Liverpool is that it’s a one stop shop,” says Martyn. “Our clients can feel comfortable that they’re getting good quality advice on all property matters from one of the most renowned international companies in the world.” Looking ahead to next year Martyn tells me that there are several high profile projects Jones Lang LaSalle is set to be involved in. The company will also relaunch West Tower for the new owners and market the remaining properties in Mann Island phase 2. Indeed, it looks like 2013 is set to be as busier than ever for Jones Lang LaSalle and, as a man who obviously loves what he does, it’s clear Martyn wouldn’t have it any other way.
