I’m in the process of buying a house and I’ve heard some rumours that the neighbours are very loud, have all night parties and are generally being anti-social. How can I find out about this? Is anyone obliged to tell me?

Firstly ask the seller on the viewing about the neighbours and note their responses. Sellers by law have to complete a SPIF (seller’s property information form), which forms part of the contract between the seller and buyer. In this they are obliged to highlight any neighbourhood disputes relating to noise, boundary or shared maintenance. Unfortunately what constitutes a dispute can be contentious and a grey area but an issue that has resulted in written correspondence between neighbours or a council (or other authority) complaint should be declared by the seller on the SPIF. Failure to do so could result in the buyer potentially taking legal action against the seller. There have been numerous cases where sellers have been sued in such circumstances.

Firstly, you must check your tenancy contract because there may be a rent increase clause in there which would have been agreed and signed at the start of the tenancy. The procedure in the agreement should then be followed. If the tenancy agreement makes no provisions for the landlord to make rent increases, then the landlord has no legal right to increase the rent until such time the fixed term of the tenancy has come to an end, in which case the tenancy will then automatically become a statutory month to month periodic tenancy. In the case that your tenancy does or is due to become periodic, then the landlord can serve a Section 13 Notice of the Housing Act 1988, proposing an increase in rent, at the end of the fixed term. The notice must give you not less than one month's notice and the notice must expire on the day the rent is due. Another option is that you agree to renew your tenancy agreement at the end of the fixed term but with an increased rent.

My boyfriend and I moved into an apartment and signed a 12 month contract with no break clause. We have since broken up and he’s moved out. I can’t afford to stay on my own. I have seven months left on the contract. Can I break it?

The short answer is no. If a contract is for a fixed term and does not contain a break clause, then it will run its full term if the parties cannot agree to surrender it. If you and the landlord can agree to surrender the contract, the landlord may request that you pay an early termination fee, as the property may be vacant for some time after it is surrendered. Alternatively, you could find a replacement tenant to take your place although the landlord would have to agree. If you abandon the property, then you are still liable for the rent up until the expiry of the contract and the landlord can sue you for the remaining term.

One of Liverpool’s most historical locations, Quarry Street in Woolton, made famous by The Beatles, is being given a new lease of life by Cheshire developer Steppingstone Group. And already reservations have been made on the site, which only opened to the public for the first time at the weekend. The multi-million pound investment in Woolton, which has been voted the number one place for families to live in the country, will see a selection
of bespoke homes being built. Steppingstone identified the opportunity believing it could add to the conservation area with its exclusive approach to delivering contemporary living space. Steve O’Connor, managing director of Steppingstone, says: “The focus has been on the best use of design to create maximum light and living space and this is the reason we decided to bring in an independent architect. The recently published Tenant Arrears Tracker, published by LSL Property Services, highlights a worrying rise in the number of tenants who are more than two months behind on rent payments. In the first quarter of 2013, the figure rose from 90,000 to 94,000 – which equates to 2.3% of tenants in England and Wales. Joe Davison, of Paul Crowley & Co Solicitors, says: “We are seeing an increasing number of landlords who find themselves in difficulties when their tenants are in serious arrears. There is no easy way out, however there are some steps, which will minimise trouble.
“First, we would recommend that landlords do their homework properly. It is surprising how many landlords neglect to obtain full, trustworthy references for their tenants. If a prospective tenant can not provide two worthwhile references, then it’s best to leave the property unoccupied until the right tenant comes along.” “For extra security, run some light background checks and get the tenant to put up a guarantor.

Football star launches development project in his home town Liverpool FC and England captain Steven Gerrard went back to his roots to help launch a new project that will provide muchneeded new homes. The Reds star was on hand to mark the start of work at Bluebell Park in his home town of Huyton in Knowsley, a project that will provide 101 new homes for rent to over 55s that need extra care and support to live independently, along with an additional 21 apartments for older persons shared ownership. The £14.4m development, driven by Knowsley Housing Trust, part of the First Ark Group, in partnership with Knowsley Council, will be built on the site of the former Wingate Towers flats by contractor Bullock. It will comprise of one and two bedroom apartments designed to Lifetime Homes standards and will be completed in Autumn 2014. Steven was brought up in Huyton and was pleased to return and support this important project that will invest in the future of the town.

Rebecca Finnigan, associate solicitor at Canter, Rebecca Levin & Finnigan Berg, suggests April’s news of the continued rise in house prices could ease the strain of a financial settlement. Office of National Statistics figures show divorce numbers in 2011 had vastly increased from the 30,870 granted in 1950, but there has been a dip since the recession took hold. Rebecca explains: “The legal profession widely associated that dip with potential divorcees deciding not to proceed because they could not afford to deal with a financial settlement at a time when house prices had taken a nose dive. With the news in April that house prices had risen for the fourth consecutive quarter, now might be the time to tackle the thorny issue of divorce for those people who had put off the issue.” This house price announcement does, however, coincide with the government’s legal aid reforms. Rebecca adds: “Unfortunately family legal aid was a significant casualty in this and an estimated 75% of people who would otherwise have been eligible for legal aid no longer will be. However legal aid is still available for divorces and financial settlements (ancillary relief) if the individual can evidence they have been a victim of domestic abuse within the past 24 months.” Your Move 59

‘Boatels’ prove big hit A trio of boutique hotel boats have been making a splash down at Liverpool’s Albert Dock, with themes of Batman, The Beatles and the Titanic. Alfie Bubbles, the man behind the floating hotels, says his luxury barges have been a hit with visitors ever since the Batman boat first launched back in 2011. “It’s the novelty factor and the fact they are so unusual. Plus they are on water, and they’re also in a great location,” explains Alfie, who says his boats are currently booked up for nearly seven days a week.

Now members Andrew Hunt, Thomas Gorton, Nick Hunt, Chris Hutchinson and David Berger are preparing to showcase tracks from their debut album, Performance at this year’s Sound City. We caught up with drummer David ahead of the festival.

Will you play tracks from your new album, Performance? We haven't played in Liverpool for a while so we're very excited about it. We'll definitely be playing songs off the album, the majority of our set actually. We're still learning to play a couple of them at the moment, rearranging bits of it. The way we've recorded the album makes this process kind of necessary but it's also a lot of fun to come at the tracks more directly. You’ve made a video for your track Performance with FACT, which will be shown during this year’s festival. How did this come about? The video is actually being shown at FACT now as part of

TALENT their Art of Pop Video exhibition. Sound City approached us about it earlier in the year and we were looking for a way of showing everyone one of the tracks off the album so it worked out quite well. Andy and Nick had previously created the concept for all our videos and shot and edited most of them, and working with Isaac Eastgate (director) for this one was a nice experiment. What is the atmosphere like when you play in Liverpool compared to other cities? I guess it's always exciting to play in your home town, certainly if you haven't played there for a while. All your friends are there, they want you to be good and want to have a good time. It's infectious. At the same time it's what you want from the audience in general and in a way
it can be more rewarding when it comes from people you don't personally know. Your EP, Another Night’s Dreams Reach Earth Again received positive reviews. How does Performance follow on from that and was there more pressure while making it? The EP was a direct product of our move to London and being pretty clueless in this big city, for better or worse. I think the album still has some of that in it, Andy and Tom wrote a lot of the songs when we were down there. We came back to Liverpool to start recording towards the end of last summer and spent the winter months locked away working on it, leading fairly strange lives defined by a complete lack of connection to the real world. Maybe some of
this came through in songs written during that time. But then again these are themes even our early songs aren't exactly unfamiliar with. Because we sort of disappeared to make the record and weren't really working to a deadline we only felt whatever pressure we put on ourselves, which can be substantial and has certainly grown more so recently whilst finishing things off. Everyone who's ever made a record has probably felt like that at one point or another. We're still working out the details for the album but it looks like a late summer release at the moment. Outfit will also tour with the Electronic Voice Phenomena project soon. Can you tell us more about this? We are currently working on a

completely new piece of music commissioned by literature companies Mercy and Penned In The Margins as part of their Electronic Voice Phenomena project, which has to do with hearing unidentified voices in electronic interference. Our particular piece is inspired by the 1990 trial of Judas Priest and explores music's potential to manipulate and how this potential is being used and abused by people. The Poetry & Painting 1960-2000 exhibition brought together a collection of Henri’s pictures and poems based on common themes such as popular icons, consumer products and cityscapes. Playwright Willy Russell and Catherine Marcangeli, the wife of Adrian Henri, were among the guests at the well attended preview of the display. The exhibition was launched to run parallel with the Adrian Henri Poetry in Art Prize, as part of the Much Wenlock International Poetry Festival during April. Adrian Henri’s Poetry & Painting 1960-2000 runs at the gallery until 28 April.

1984 1 MAY 2013 Capstone Theatre An exciting performance of George Orwell’s definitive classic, 1984, is lined up for the city, as the Sell a Door Theatre Company returns. Mathew Dunster’s faithful adaptation of the dystopian science fiction novel, which is a staple of every ‘must read’ list, follows on from the company’s successful tour of Shakespeare’s A Midsummer Night’s Dream. New Zealand six-piece, The Phoenix Foundation are getting ready to perform in the city as they release their new double LP, Fandango. Back in 2011 the band received critical acclaim for their brand of psychedelic pop when they launched their fourth album Buffalo, which led to successful performances at Glastonbury and on Later...With Jools Holland. Their latest offering is said to be an expansive bold and colourful statement which sees the band explore a range of moods and musical threads.

City Wine Bar & Kitchen 21-23 Old Hall Street, L3 9BS Living just a stones throw from Old Hall Street I’ve often walked down it and thought it was missing something. The busiest street in the commercial sector, it has no shortage of supermarkets and coffee shops but is decidedly lacking when it comes to bars and restaurants. Luckily entrepreneur Jaf Siddiqi was thinking the same thing. So much so in fact that he decided to do something about it and thus City Wine Bar & Kitchen was created. Situated in the heart of Old Hall Street, just opposite the Cotton Exchange, the bar and restaurant has only been open three days when we pop in to try it out but is already proving popular. Indeed, by the time we leave at around 7pm there is standing room only in the bar area – a sure sign of success. The venue is split into two parts, the bar area at the front with its wooden

benches, high stools and cool yet cosy feel and the quirky dining area at the back, all rustic furniture, wooden floors and comfy seats. We arrive at 5pm and the after work crowd is already starting to drift in. After taking our seats in the restaurant area our friendly waitress introduces herself and hands us our menus to peruse. It’s an overused cliché but there really is something for everyone on City Wine Bar & Kitchen’s menu. This is evidenced by the eclectic variety of our fellow diners, from the two young women grabbing a bottle of wine and a sharing platter of couscous, home made coleslaw, roast peppers and artisan breads after work, to the business men conducting a meeting over some beers and the father with his children, all tucking into the delicious-looking
City burgers. Given the recent bout of semi-nice weather we’ve been having I decide to opt for a salad and, on Jaf ’s recommendation, choose the smoked duck which comes with orange segments, candied pecan nuts and a raspberry dressing – a zesty, delicious combination. My dining partner chooses the 7oz rump steak with a flash fried chilli, spring onion and soy sauce reduction and chunky chips – although he was equally drawn to the giant shrimp with garlic butter. On finishing his perfectly cooked steak however, with its unusual but fabulously flavoursome topping, he was sure he’d made the right decision. City Wine Bar & Kitchen is just what the commercial district needs – an affordable, attractive venue with a relaxed atmosphere and an impressive menu. Your Move 77

MEDIEVAL FUN AT ST GEORGE’S FESTIVAL

oung medieval knights, dragons and princesses descended on Liverpool’s St George’s Quarter as the city played host to its first St George’s Day Festival. Children’s TV star Mike the Knight made a special appearance at the fun-packed family event, which featured a funfair, a hog roast and a schedule of activities and workshops throughout the day. Landmark attractions including the World Museum, Walker Art Gallery and St George’s Hall participated by hosting indoor fun, while dragon inspired Superlambananas took up residence in Queen Square and visitors to Williamson Square enjoyed musical performances on the Liverpool Bandstand. Historical entertainment was provided by the Plantagenet Medieval Society, who worked to recreate the pageantry and action of medieval combat and courtly dancing at the festival.
