On December 20, 2018, Congress and President Donald Trump officially signed the 2018 Farm Bill — essentially legalizing the production of hemp in the United States. This monumental move changed the course of the CBD products and hemp industries but also, more broadly, marked an historic moment for the United States in general. While perhaps not as monumental as the passage of the 21st Amendment in 1933, it marked a substantial and important return of power from the government to the free market. The story as it originally appeared online; then, updates on some of the effects we’re already seeing: Multiple sources report that after passage of House Resolution 2, otherwise known as Farm Bill 2018, through House on with a vote of 213 Aye to 20 Nay, and through the U.S. Senate on with a vote of 87 Aye to 13 Nay , President Donald J. Trump has signed the bill on December 20, 2018. The cultivation of industrial hemp is now decriminalized across the United States.

Hemp has been illegal to grow without a permit in the United States since the signage of the Controlled Substances Act in 1970, due for the most part to its close relation to marijuana. That prohibition is finally over. Now, with few exceptions, hemp is legal to cultivate, process, buy and sell, possess, and use across the United States. But it’s what we didn’t know in 1970 about the health benefits of CBD that makes the return of hemp to the free market a paradigm change in consumer health. No more should CBD retailers and entrepreneurs have to “buck the system” or fall sleep at night wondering if they’ll wake the next morning to discover that the DEA or a state-level analogue agency has raided and emptied their stores. President Trump spoke at length about rural broadband internet access, combating the opioid crisis within the United States, welfare reform, lightly boasted that the improved economy has lifted 4.6 million Americans from government dependence and back into a living workforce.

Although the historic decriminalization of hemp didn’t receive direct mention from President Trump, the effects expected from this move have been seen and anticipated by members of the industry. Said Joe Bradley of Bradley Brands:
But, according to Dunson, the passage of Farm Bill 2018 is about to clear the waters significantly.
Michael “AuNatural” Dunson, founder and owner of Pinnacle CBD, had this to add:
“Just like Alabama, when it passed through Congress, they fell into line the next day. But what you had was, a lot of states just couldn’t interpret that kind of muddy language and all that gray area when it came to hemp, so they just defaulted to “it’s all illegal.” But now that they’re saying, at the Federal level, it’s not illegal anymore, you have all these states just falling into line with that new status.”
“The 2018 hemp Farm Bill, a couple things it does is it clears up a lot of the gray areas that were in the 2014 hemp Farm Bill. Also, it removes hemp and any hempderived products from the Controlled Substance Act. So it actually just makes it very clear. The problem is actually that a lot of states have just misinterpreted the law and said it was illegal this whole time, but that wasn’t the case.
When it comes to the legality of CBD, then, there is no longer any doubt — it is now legal at the Federal level, provided it is sourced from hemp. Still, states such as South Dakota, where lobbyist influence has established a monopoly, may be a different matter. There will be battles fought in courtrooms in that state, possibly in others. CBD Magazine will report from the front lines to keep our readers apprised of the results.

And the results have been flooding in. States which previously have been taking a wait-and-see approach are now moving ahead to align state policy with the new Federal policy; just one example is Texas, which this week saw its House Committee on Agriculture and Livestock release an interim report urging state lawmakers to decriminalize hemp for the sake of the state’s farmers, economy, and environment. Meanwhile, CBD products proliferate across the nation, in forms from edibles to e-liquid for vaping to sublingual tinctures; even shoes stores in the Dallas Fort Worth area now carry CBD-infused health and beauty products. Porsche’s new track-bound beast the 718 Cayman Clubsport incorporates hemp body panels. When it comes to hemp cultivation, processing, and the industries and products that are springing from it across the country, an historic page has been turned. CBD Magazine is excited to be here to guide you through the next chapter.

It’s a popular misconception that vape products and CBD products are one and the same — especially by those outside of the industries. The two are not synonymous with each other, so let’s clear that right now and put them in two categories.
1) Vape products, such as e-liquid, are for the purpose of smoking cessation and contain a regulated drug called nicotine. 2) CBD, or Cannabidiol, is a nonpsychoactive hemp derivative known for its healing properties. In fact, it’s said Queen Victoria used CBDrich cannabis for menstrual cramps in the 19th century. So it’s been around just a little while.

What exactly is CBD? CBD is one of many parts of the cannabis plant. Because it is missing the psychoactive component of THC, CBD will not get you “high.” Its value is in its intrinsic ability to lock onto receptors in the human endocannabinoid system, and aid the physiological process in things like pain management, and memory, as well as anti-inflammatory and other autoimmune functions.
For people who suffer with chronic pain, anxiety or depression, CBD has proven to be a viable alternative in place of medications including opioids, opiates, and benzodiazepines. The number of combined e-liquid / CBD companies that are looking to get in and cash out quick is increasing at an exponentially alarming rate.
Yes, you can vape CBD, and yes, you can add CBD to e-liquid. But just because you can do something, doesn’t mean you should or that it’s the only option. Sadly, many companies out there are not about bringing this industry up. By not employing best business practices, they are tearing it down by putting questionable products into the hands of consumers. Regulation is imperative and impending. But until that time, manufacturers must hold themselves accountable. This means using quality raw materials, proper facilities with real accreditations, proper extraction methods, proper bottling practices like batch codes, and adjacent reports for purity and quality. This product is going into someone’s body with the intention of supporting heath and wellness because they believe in CBD. Consumers deserve the best product, the best business practices, and the explicit transparency of manufacturers to ensure that what they are buying meets what the product is being sold as. There is a lot of “quality of myself”

going around in those bottles, rather than quality product with optimum benefits. That needs to stop. Choosing to play fast and loose with people’s health denigrates this amazing product and its benefits, and is the exact opposite of what CBD is about. I think Ben Harper said it best, “what’s from the earth is of the greatest worth.” And as more research is done to bring CBD’s benefits to the forefront, the potential to transform the quality of life for millions of people grows. But part of that transformation must come from proper business practices from the CBD companies making it.

She is known as the woman with one name: Annie. And anyone who has been in the CBD space for a few years is familiar with her company, Organabus. Annie Sais started Organabus in 2010 after graduating from New Mexico State and knew she wanted to run her own company. She had inspiration and motivation from her sister, Erin, and brother in law, Roger Kay, who entered the vape market with the Tasty Puff e-liquid line, so that was a good pattern to follow. They were also the former owners of HQ magazine, the first alternative magazine that gained a following. Sais started with a detox product as a way to start a company and placed an ad in an alternative products magazine, but she kept running into questions about CBD. She started taking the CBD product in 2010 and liked it. She also wanted to sell it and wanted the packaging to be trendy and hip but wanted great ingredients. The biggest requirement was that they be healthy, tested and organic. Annie wanted to stay organic and since CBD was often confused with cannabis she smashed the

two words and came up with Organabus. That name also led to a great logo which consists of a bus with a cannabis leaf logo on the side. She started production in 2010 which was a big step, but made easier with her sister and brother in law’s guidance. She started with liquid since they already had bottles, and followed the Tasty Puff model with packaging, distribution, and retail. “In the early days it was a challenge to learn dosages and processes, which got more complex with edibles and animal products,” she shared “I wasn’t too concerned about legalities, but we had scares over the years. We made sure that everything was tested before importation, before manufacturing and with the end product. We had

to be sure we had no THC in order to protect ourselves.” Even today there is still confusion over regulations, and many potential buyers balk when they worry about legalities, even with the Hemp Farm Act passage which removes federal restrictions on commercial hemp.
Doing it backwards Sais is a pioneer, but she is the last to admit it. Anyone who starts a business out of college and develops a following like Organabus is a force to be reckoned with! They now make about 100 SKUS, and the major sellers are still tincture drops since they’re easy to control dosage, but bath balms are getting momentum But one of the more notable variations with her model is that she did this whole thing backwards.
Most businesses in vape or CBD start at the retail level, then go distro with their own and other products and then sometimes go into manufacturing. After all she has done so far, now, after 10 years, she is finally opening a retail shop. And what a shop it will be! Though still under construction, with an opening in Q1 of 2019, it will be 3000 square feet and be adjacent to her current facilities. The supply chain could not get much closer than that. She actually purchased the building after many years of begging the sellers, and the new shop in Albuquerque, NM, will offer all her CBD products plus more. Hemp clothing and free-trade items will be part of the offering, plus hydroponic equipment and other alternative type products along with clothing and cooking supplies.
“I’m really excited about 2019,” Sais said. “We’re coming out with about 10 new products and since the CBD world does not have the same FDA restrictions as vape, there is much more room for expansion.”

UNDERSTANDING CBD EXTRACTION

Cannabidioal (CBD) is an extracted compound from the cannibis, or hemp, plant, known to have a slew of different health benefits. Digging around, you’ll find a few different CBD products that make all sorts of claims as to why theirs is the best, but most commonly referencing their extraction process as the reason to their
product’s superiority. This is for good reason, as a high yielding extraction process is crucial to any CBD product on the market, more so even than the base form of the plant. In other words, without a quality extraction method, the best hemp that ever existed won’t be worth the dirt in which it was grown.

Why CO2?
Reducing the plant to its baser compounds is the general idea. There are several methods including olive oil extraction, dry ice extraction, and ethanol extraction. As interesting as most of these sound, they’re mostly home methods used for those individuals that grow their own. Most the time, you won’t see CBD products promoting these methods.
CO2 has been used in all sorts of food and beverage products over the years. The reason it’s so fantastic is because it behaves like a solvent without all the nasty byproducts. It’s often used because it doesn’t cause too much harm to the products themselves, but still can extract oils and other things like impurities. The reason it works so well is because of the high level of pressure, which is how we get it to behave like a solvent.
Unfortunately, the yield on these types of extraction isn’t very high, which in turn means for a manufacturer it’s not really worth the risk. If you ever see these methods used, it may be for the high oil it produces for foods or a local grower, otherwise they’re not usually promoted in the mainstream of CBD products at the disposal of typical consumers. There are a few benefits to these methods, but they can be dangerous, can spoil quickly, not to mention the possibility of messing up the entire process which wastes a whole lot of good CBD.
This is why the most common method utilized by large scale manufacturers is the CO2 extraction method. This method involves pressurized carbon dioxide (CO2) to “pull” out the CBD from the hemp plant. CO2 behaves like a solvent at certain temperatures and pressures, but without the risk of ruining the product. Sadly, it requires expensive equipment, something local growers can’t usually afford.

But how? The first part involves pressurizing and cooling the CO2. The CO2 is, by this process, turned into a liquid. From here the liquid CO2’s temperature is increased enough to turn it ‘Supercritical.’ It sounds cool but its really not, requiring over 1071 psi and nearly 88 degrees! In this state, it can act like a liquid with its density but also fill a pressurized container like a gas. This, is in large part, why CO2 extraction using this method is so expensive.
Next, the CO2 is passed through the hemp plant, typically of higher quality. What comes out are trichomes and terpene oils. Trichomes are the crystalline structures that naturally occur on cannabis plants, terpene on the other hand is a part of the plant that can bind to the endocannabinoid receptors in your body. More or less, terpene oil helps your body utilize all those wonderful bits of CBD you’ve just ingested, while the trichomes are rich in CBD.
CO2 extraction can also be used via “subcritical” extraction, which is literally cooler. The lower temperature and pressure allow the extractor to preserve more of the terpenes, but sadly doesn’t extract as much oil due to the lack of pressure. By itself, this isn’t that great, however, using this process, and following with the supercritical extraction allows for the most maximized yield. From here the process mostly involves purifying the extraction, and sometimes converted to isolates, which is a whole other process we won’t even get into here. CO2 extraction is the most common process used for any mainstream CBD product, and for good reason. The high yield of the process, the simplicity, efficiency and consistency of it simply makes the other methods obsolete so long as you can afford the equipment. If you’ve tried CBD, then more than likely this was how it was made. The home methods, unless your a grower, can be unsafe and can get messed up in the processing. Moreover, if there’s a company you’ve grown to use regularly it would be a good idea to check in on their website and find out exactly what processes they’re using, and whether or not they’re incorporating their terpenes.

Hawaiian native Chris Taloa is best known in homes across America as Drew, the leader of the ‘local crew’ in the movie Blue Crush. Growing up on Oahu’s North Shore, he is no stranger to aches and pains. As an ex-pro and expert at surfing Hawaii’s deadly breaks like pipeline, Chris knows better than anyone that “surfing beats the shit out of you some days!” Though still catching waves daily, Chris has put acting aside for a bigger purpose, channeling his heart and energy into his CBD company, Global CBD. How does one go from professional surfer to actor to CBD activist and company owner? For Chris, two major life events and one trippy dude from Maui shifted his perspective towards a wellness-based lifestyle. It began 12 years ago when Chris welcomed his first daughter into the world. “I don’t know, I just wanted to focus on being more holistic in my choices, like looking at water and air instead of gas and electricity. Or, maybe I was a cheap ass, but I had this gift now. Her name, Numia, in Hawaiian means divinity or deity, so I have to live up to the name I gave her and provide the best things in every way.”

In 2016, Chris received news that his close friend, legendary surfer Brock Little, was diagnosed with and eventually passed from liver cancer at the age of 48. Chris recalls, “Brock was my hero. Hero to a lot of us surfers. At the time, so many people I knew were getting cancer. It just made no sense.” According to the U.S. Department of Health and Human Services, Native Hawaiians, Samoans, and Pacific Islanders have the highest cancer rates in Hawaii. Global CBD came to fruition after a fateful run-in with his future partner, a man he describes as a “trippy hippie” living in a rough part of Maui. “The Polynesians liked him,” Taloa said. “So he was white, but he was Hawaiian in his spirit — by heart.” Recalling his first encounter with CBD, Chris laughed, “I told this guy you can’t sell this! It’s snake oil bro, Jesus juice. There is more THC in Trader Joe’s hemp cereal!” But after a few days of trying, Chris began to feel the benefits. “My joints just felt, I don’t know, better. My knees and my back too. Among the many modern emerging industries we are also witnessing the development of several advancements that are in the realm of consumer goods— products for human consumption. The Cannabidiol compound known as CBD has been one of the prime ingredients in this rising sector of consumer goods. In addition, another industry in particular has been developing a number of fascinating theoretical concepts combined with proven research to create specific supplements used for cognitive enhancement. This industry is manufacturing supplements that are referred to as “Nootropics.”

NOOTROPICS DEFINED The word “Nootropics” is basically considered as an umbrella term for some naturally-occurring and/or man-made classes of chemicals that have potential to provide cognitive advantages to the human brain. Overall, the man who coined the term “Nootropic,” Dr. Corneliu E. There’s no denying the massive, radical shift CBD has brought to the market. Equally undeniable is the fact that the legality of CBD can vary wildly from state to state, and even from county to county within a single state. Despite the passage of H.R. 2 in December of last year, CBD remains a controlled substance in the Lone Star State.

The cloudy nature of CBD legality rests on the fact that, despite its newfound legality at the Federal level, states retain the right to schedule hemp at the state level. What’s legal in California, Nevada, or New York might or might not be legal in Texas — and vice versa. The problem is further complicated by the fact that even within the state of Texas, enforcement isn’t consistent from one county to another. Tarrant County has issued a warning that the purchase and possession of certain CBD products could result in consumers facing felony drug possession charges. Larry Moore, criminal division chief for the Tarrant County District Attorney’s Office, went on record saying about CBD, “It’s illegal. And until the legislature changes that, it’s going to continue to be illegal.” Other Texas prosecutors, however, are not taking so hardline a position. Some reportedly went on record with NBC 5 Investigates saying that they would not aggressively pursue cases where the only substance found in a consumer’s possession is CBD. Still others reportedly have yet to take a position of any kind with regard to CBD product possession. Texas’s Attorney General Ken Paxton’s office has not made a statement on CBD legality in the state. As tough as the CBD legality situation in Tarrant County is, though, it may be on its way to easing, at least slightly. Texas State Representative Stephanie Klick (R-District 91) has already authored “compassionate use” legislation to open three CBD dispensaries within the state where patients suffering from severe epilepsy can purchase CBD products prescribed by a medical practitioner. Representative Klick’s support for CBD is not unqualified, however. Stressing lab testing to ensure that CBD products aren’t mislabeled or adulterated, she said, “The buyers really should beware because they really currently do not know what these products contain.” Pharmacist and CBD shop owner Dallas businessman Emile Abdo agrees with Klick about the necessity for quality assurance and truth in labeling, commenting that, “there’s a lot of products out there that are mislabeled.” He insists, however, that access to high quality, accurately labeled CBD products is strongly needed, particularly now. “As a pharmacist, and being on the front lines of the opioid epidemic, I think it’s

important for us to be able to provide different therapies that aren’t addictive.” What the future holds for CBD legality in Texas is tough to predict.
