Q: The Apprenticeship Boost Programme is highly valued by employers but it ends shortly. The support enabled employers to retain existing trainees and take on new apprentices even through Covid-19. Has the Government considered adopting it as a permanent measure to support employers willing to take on an apprentice, and if not, why not? A: The Apprentice Boost Programme (ABP) was designed as a time-limited emergency support programme to assist employers in keeping early-stage apprentices employed and training towards their qualifications following the economic shock of the Covid-19 pandemic. It was initially funded to run for 20 months and then extended to two years, allowing employers to continue to claim support for eligible first-and second-year apprentices until 4 August 2022.
We hit up Minister of Transport Michael Wood for answers on the issues that matter to members. We’re grateful to the Minister for taking the time to give an extensive reply. We are repeatedly told by members that one of their biggest concerns is a shortage of skilled workers. The widespread shortage of skilled/qualified tradespeople is impacting on businesses nationwide. Immigration settings are not seen as enabling industry to succeed. Automotive technicians are not all highly paid and few workshops can afford to pay their qualified technicians the $86,000 salary minimum required for an Essential Skills Work Visa.
Q: What can the motor trade do to persuade the Government that criteria for skilled work visas should be linked to qualifications and experience relevant to the work being done, rather than the annual salary? A: Qualifications and experience are
already an integral part of the visa assessment process. When applying for an Essential Skills Work Visa, people must demonstrate that they have the necessary qualifications and experience to work in that job. Prior to offering that person the role, the employer must also check and see if there are any New Zealanders available to do it. Before 27 July 2020, Immigration New Zealand used skill bands to determine the conditions of Essential Skills Work Visas. The skill bands were determined by a combination of the ANZSCO skill level of the job (which is linked to qualifications and experience) and remuneration thresholds. Feedback indicated that the skill bands were complex, and that ANZSCO was outdated and didn’t work well for some occupations. This led to employers providing a significant number of incorrect

or inflated job titles, creating administrative work for both the employer and Immigration New Zealand, as well as delays in visa processing. As a result, skill bands were replaced by a remuneration threshold test, which acts as a proxy for the skill level of the job. The Government also wants to apply some pressure to ensure that wages for important roles like this are increased. To build a truly sustainable sector that doesn’t constantly rely on imported labour, we need to attract talented New Zealanders to these roles, and good remuneration is a part of that. The introduction of the new Accredited Employer Work Visa, which is set to be introduced in July this year, will require migrants applying for the visa to meet any skills and experience requirements stipulated in the Job Check passed by employers.
Starting on 1 January of this year, apprentices (and those doing long traineeships of over 120 credits) can still benefit from the ongoing Fees Free policy if they have limited prior tertiary study, or are recent school leavers. Budget 2021, will provide increased support for training subsidies for apprentices and industry training. In 2022, the training subsidy for a 240-credit apprenticeship programme will increase to $11,432. From 2023, providers will be funded to deliver workplace learning through the new Unified Funding System (UFS) that is being developed to support the reform of Vocational Education. The Tertiary Education Commission will be working closely with providers, Workforce Development Councils and Regional Skills Leadership Groups to implement the new UFS.
The other issue we hear repeatedly is around the supply chain.
Q: What will the Government do to ensure supply chain issues are heard and addressed as soon as possible? A: The ongoing Covid-19 pandemic has had, and continues to have, a significant impact on the global supply chain. I have been following the issue of supply chain disruption and congestion closely, and officials have been keeping me updated regularly. Access to consistent and secure supply channels is essential for New Zealand’s economic recovery activity, and I want to acknowledge the hard work and innovation in how industry has pulled together to respond to the supply chain congestion and to keep freight flows moving. As New Zealand is a small player on the global stage, our ability to influence international developments and
commercial decisions is limited. However, officials from the Ministry of Transport have been focussing on what we can do to alleviate domestic pressures from supply chain disruptions. Examples of this work include supporting our ports to boost their productivity, facilitating more operational flexibility by shipping lines, and addressing
specific instances of supply chain blockages. I have directed officials to develop a long-term New Zealand Freight and Supply Chain Strategy in collaboration with stakeholders. The Issues Paper, which lays the foundation for the strategy, is expected to be available for public consultation in the coming months. MTA Radiator Magazine March 2022

Q: A question from MTA member Denise Tunnell: There aren’t enough Warrant of Fitness inspectors to meet demand. What will you do to address the shortage? Can there be more training, and can the time period to become an inspector be made shorter?
A: Waka Kotahi have advised me that they are not aware of an overall shortage in the current number of Warrant of Fitness inspectors, although they do know there is a wider skill shortage across other areas of the inspector and certifier industries. The current Warrant of Fitness inspector training generally takes 2-3 days and an applicant must also have the appropriate qualifications or work experience when they apply. Applicants are encouraged to check requirements in the Vehicle Inspections Requirement Manual to ensure they meet the criteria before they apply as this helps with the application process. Waka Kotahi are working with industry partners to review the Warrant of Fitness/Certificate of Fitness regime as part of a longer-term piece of work, to ensure it remains fit for purpose and delivers on supporting road safety. On top of this, the Road to Zero Action Plan includes an action to investigate our Warrant of Fitness/Certificate of Fitness systems to ensure existing vehicles in New Zealand are as safe as they can be. This work is at an early stage, but it is an opportunity to consider workforce issues to ensure we have the people we need to support our future vehicle fleet.
Q: Does the Minister support a review of the WoF regime to require older cars (say, those over 10 years old) to go through a six-monthly inspection rather than an annual inspection. Currently, any car registered after 2000 needs only an annual WoF inspection, yet these cars can be up to 22 years old and more prone to wear and tear. A: The Road to Zero Action Plan includes an action to investigate our warrant of fitness and certificate of fitness processes to ensure existing vehicles in New Zealand are as safe as they can be. As part of that, we will consider opportunities to introduce methods to improve current testing procedures, including electronic scanning tools and other improvements in vehicle testing. The frequency of the WoF check was most recently changed as part of the 2014 Vehicle Licensing Reform, which sought to reduce the regulatory burden on drivers while maintaining important safety standards. Drivers are legally responsible for ensuring their vehicles are roadworthy. The safety case for the 2014 work was based on continuing Police enforcement of roadworthiness requirements, which is essential to reducing deaths and serious injuries on our roads.
Q: A question from MTA members Miles and Rachel
Crellin, Morrison Diesel/CoolCar Air-Conditioning Centre Onehunga: How does the Government propose that small businesses such as mechanical workshops where employees cannot work from home will survive financially through repeated instances of extended staff absence brought about by (possible) exposure to Covid-19 and the associated isolation requirements?
A: Firstly, a big acknowledgment to Miles and Rachel, along with countless other MTA members who have continued to provide incredibly important services to New Zealanders over two years of ongoing Covid disruptions. When New Zealand moved into Phase Two of the Omicron response on 15 February, two options became available for businesses facing staff absence as a result of Covid-19 exposure, ensuring businesses can continue to operate through the expected Omicron peak in coming months. These options allow vaccinated workers who are a close contact of a Covid positive case, and are asymptomatic, to return to work if they can follow specific health requirements. An asymptomatic and vaccinated worker who is a close contact can work in ‘a bubble of one’ provided they are not customer-facing. Alternatively, if the business is registered as a critical service provider, they can utilise the Close Contact Exemption Scheme. Under the scheme, a worker can return to work if they follow health requirements and return a negative rapid antigen test each shift or day.
Isolating
Q: A question from a member who would prefer to be anonymous: New Zealand’s vehicle fleet is one of the oldest light vehicle fleets in the developed world at 14.7 years in 2020. Has your department considered that perhaps a contributing causation of this seemly excessive fleet age could be that the collision repair market is not operating as a ‘free market’ here in New Zealand and because of this, collision repair costs are being artificially suppressed by dominant insurance market forces, resulting in fewer vehicles being written off and sent for scrappage. A: The relatively high average age of our vehicle fleet relative to other OECD countries is likely to reflect a number of factors. An important one is that unlike other developed countries New Zealand allows the import of used vehicles. New Zealand also places no restriction on the age of used vehicle imports entering the fleet. Prior to the Clean Car reforms, the average age was 10 years. It is expected that the reforms will bring younger used imports into the fleet and, as a result, the average age will decline in the coming years. The Government is keen to see a fair, competitive insurance market and I know that my colleague, the Minister of Commerce and Consumer Affairs, is considering these issues carefully.
Both of these options require workers to continue isolating outside work hours. If a worker tests positive or develops symptoms, they will need to go home and isolate immediately. Importantly, health and safety legal obligations still apply; however, businesses that follow the official guidance will likely be considered to have met their health and safety obligations to mitigate Covid transmission risks. Given the risk of transmission from a close contact, it is important that businesses are careful about the extent they use either option, as a Covid-19 case at work could result in greater absenteeism in the future. I would encourage businesses to consider the criticality of the worker to the business’ operations, and only use ‘bubble of one’ and/ or access the Close Contact Exemption Scheme where necessary. We’re also aware of the financial strain on businesses and recently announced a support package to help those who are finding it really tough through the current Omicron outbreak. The package includes the following: • A new targeted payment of up to $24,000 per fortnight, to help businesses most affected by Omicron's impact. • A new ‘top up’ loan under the Small Business Cashflow Loan Scheme to help businesses that have already drawn on support. • Extra flexibility for businesses around tax payment dates and terms to help with cashflow pressures.

Q: What is the Government’s position on a national vehicle scrappage scheme – does the Minister support an incentive payment to encourage owners to scrap high-emission, unsafe vehicles? A: The proposal to have a vehicle scrappage scheme to support low-income New Zealanders’ shift to lowemissions transport was included in ‘Transitioning to a low-emissions and climate-resilient future: emissions reduction plan discussion document’ (the ERP consultation document). The proposal is a way to respond to the risk that transport decarbonisation will stall unless low-income New Zealanders can buy safer, low-emission vehicles, or access them through convenient and affordable alternatives, like EV car share services. As outlined in the discussion document, the proposal would introduce a vehicle scrappage scheme for low-income New Zealanders. This scheme could have income-tiered rebates, coupled with financial support for the installation of home EV charging. It could also offer financial incentives for people to opt for lowemission alternatives, such as bicycles, rather than replacing their vehicles. Consultation on the document closed on 24 November 2021. Ministers are expected to make decisions in the first half of this year on whether some kind of vehicle scrappage scheme for low-income New Zealanders will be included in the first Emissions Reduction Plan. This Plan will be published in May 2022, and further work and engagement on the design of a scheme would follow if the proposal is adopted. It has been really good to work with MTA to draw on your expertise as to how such a scheme could work.

Intel Corp’s Mobileye unit intends to scale up its selfdriving technology and has joined with Benteler EV Systems and Beep in the USA to launch on-demand driverless shuttles in the US and robotaxis in Israel and Germany (pending regulatory approval). The vehicles will be operated in "contained geofenced areas" where speed limits are 35 miles an hour or less, Hinrich Woebcken, advisory board member for Beep, a mobility service provider, says. Mobileye plans to deploy robotaxis in Israel and Germany by the end of this year pending regulatory approval. It is also working with Silicon Valley startup Udelv to put automated electric delivery vehicles into service in the US by 2023. Mobileye will prove to US federal and state regulators that its self-driving system would be safer than a human driver, said Johann Jungwirth, vice president of Mobility-as-a-Service (MaaS) at Mobileye. "On a technology perspective, we feel very, very bullish and very strongly that the technology is actually close to being ready," he says. The executives say shuttles will help save on driver costs, address driver shortages, and address urban problems such as emissions and congestion. Benteler EV Systems, part of German automotive parts group Benteler International, will build the shuttles that meet automotive industry and safety standards for public roads.

Motor trade accountant and business mentor Peter Morton is putting his own succession plan into action and gradually easing into retirement.

His colleague Niki Adam is the Group’s Chief Executive. Peter says he is still passionate about the motor trade and will continue indefinitely to mentor business owners. It was that passion that led him to set up Automotive Solutions Group. “The idea came from Phil Smith of the Waiau Pa garage. Phil and I had a meeting about it and then got a few others interested. We formed the company in 2000 with eight shareholders and now have 60.” He says the group is a network for sharing ideas and information and providing support for each other. “I knew we would develop it into a brand and the buying group it is now, but essentially everyone is there to help each other.” Peter grew up in the motor trade (his family owned a dealership and service station in Tokoroa), he is a former director of MTA and is a Life Member. He has also contributed decades of leadership to Round Table New Zealand and remains the chair of its charitable trust.
World news round up Chips with that? There are just not enough chips for everyone. The semiconductor industry is struggling to keep up with demand, forcing some automakers to cut production or adapt their specs to keep new cars rolling off the assembly line. The shortage is expected to ease this year, but according to IHS Markit’s analysis, concerns are emerging over the supply of analog chips. MCUs (microcontrollers) and analog chips are the main automotive chips affected by the current shortage. However, as the world moves into electric vehicles, the demand for analog chips is going to rapidly increase. An electric car uses hundreds of analog chips and the forecast is for a 26 percent increase in demand for them in 2023. Production of MCUs is increasing, but there is not the same investment happening in analogue chip manufacturing. As a result, the forecast is for more disruption of production lines until chip manufacture catches up.

Hydrogen fuel network gathers steam
As fuel company Waitomo builds its nationwide network, it is selecting some sites for their suitability as hydrogen stops. Four of its new stations being built in the North Island this year will have hydrogen as a refuelling option provided by Taranaki-based Hiringa Refuelling New Zealand (HRNZ). Waitomo is actively looking for new South Island sites, says Waitomo Chief Operating Officer Simon Parham. Billions of dollars are being invested globally to develop hydrogen fuel options for transport and New Zealand is among the early adopters of the technology. Waitomo is working in partnership with HRNZ, which is leading the establishment of a hydrogen production and refueling network. HRNZ will own and operate the assets and partner with other companies to set up the necessary infrastructure. HRNZ Head of New Business Ryan McDonald says, “Unless New Zealand is out there paving the way, we are just going to get forgotten about when it comes to zero emission transport options. We are a long way from the rest of the world.” The first of 25 heavy HFCEV (hydrogen fuel cell electric vehicles) trucks due to operate in New Zealand this year have landed. Later this year, they’ll be able to fill up at HRNZ pumps in Auckland, Tauranga, Hamilton and Palmerston North. South Island sites will be added to the network next year. Within five years HRNZ expects to be providing hydrogen (mainly for the MTA Radiator Magazine March 2022
heavy truck sector) from 24 refuelling sites scattered strategically along New Zealand’s main freight routes. Ryan says that they have had great support from the heavy transport industry and government, but there’s been no shortage of challenges to being the first to take a hydrogen project of this scale through to the build phase in New Zealand.

Waitomo leading the way Waitomo is moving into hydrogen without any government support. “We are using our own capital and see the investment as ‘hydrocarbon financing hydrogen’,” says Simon Parham.
“The challenging thing was to line up government, investors, customers, vendors, councils and partners, as they all had a part to play in reaching the final stages. “We are forging a new trail here, so it was never going to be easy, but to reach the build phase last year and start ordering equipment and trucks was a real buzz for the team and has made it all worth it.” Funding for the hydrogen refuelling network, and for the 25 heavy HFCEV, has come from a mix of private investment and government support.

“We are spending a lot of time and energy on making hydrogen available to the truck fleet.” Hydrogen production sites need more land than a standard fuel stop and getting the relevant consent can take time. “But Hiringa Refuelling has done a lot of work and this includes educating the councils and providing all the safety analysis”, says Simon. He says Waitomo hopes to use its early involvement in hydrogen to gain a market advantage over other brands. “We are spending a lot of time and energy on making hydrogen available to the truck fleet.” Simon says the company has also started providing EV chargers; it has one at its Mystery Creek site in Waikato and plans another at its Ruakura flagship site, currently under construction. However, hydrogen is its major focus at present. “I look forward to the day, perhaps in about 10 years, when we are building just a hydrogen fuel stop,” he says. MTA Radiator Magazine March 2022

TR Group early adopter Heavy transport leasing and fleet management company, TR Group, has bought 20 FCEV trucks from US and Europe manufacturer Hyzon, which will land in New Zealand in September. They are being leased by several different transport operators who will trial them for New Zealand conditions. TR Group’s General Manager, Brendan King, said these early adopters know they have to get in the game early – or wait 10 or 12 years for the mainstream brands like Volvo or Daimler to bring right-hand-drive FCEVs to New Zealand. Government support is helping get the trucks on the road, but they will still be more expensive to operate than diesel. “The transport industry is pretty

socially responsible. We have to start the transition to greener fuel somewhere, build the fleet and the fuel network and take the risk until it becomes financially viable. Everyone has skin in the game. He says TR Group also has about 30 EV trucks in its fleet and is also trialling new technology to cut down on oil use and make fuel savings. “If we are serious about reducing our impact on the environment, it is important that we embrace and seek to understand this technology and help develop it for New Zealand conditions, as well as helping to develop the support networks for it, such as service and repair expertise and the vital refuelling infrastructure. This can only be done with realworld use of this technology.”
A review of the Road User Charges regime includes looking at whether hydrogen fuelled trucks should be officially exempted from RUC. At the moment, only EVs charged from

exemption, or reduced rates for a temporary period. In the meantime, TR Group (which will shortly own 20 Hyzon HCEV trucks) says their vehicles have an external power connection and will be exempt on that basis.

Hyundai trials about to start Meanwhile, the first of Hyundai New Zealand’s five hydrogenpowered fuel cell electric XCIENT trucks are also now in the country. They are being converted to RH drive and fitted with a body before being taken into private freight fleets to start hauling goods later this year. Hyundai New Zealand General Manager Andy Sinclair says, “As a Kiwi-owned company, we are big believers of implementing alternative fuel technology here in New Zealand.” The trial will provide insights into how the trucks fit into timetables, capacity, maintenance schedules, refueling, driveability and usertraining specific to New Zealand. A hydrogen-powered truck can save around 50 tonnes of CO2 emissions per year (equivalent of 80,000km on diesel fuel).

Owning a successful business can provide a good living, but it comes with sacrifice and stress, according to first-time business owners Nathan and Kelly Sargent, who took over their Wairarapa motorcycle business in 2008. “We started out small and thought we’d keep things simple with just one or two staff. But the customers kept coming and the business kept growing. In 2020 we moved into our third workshop and there are 16 people working here now,” says Kelly. The Covid-19 pandemic has impacted on turnover, with struggles to bring in new stock and source available parts. Sales have slumped noticeably. “But we have been very busy in the workshop. If people can’t buy a new one then they need to repair the old. It’s been a difficult time but most people have been very good about it,” says Nathan. Customers come from the local towns and rural communities, including a growing influx of lifestylers and weekenders. “More people seem to be moving here from Wellington. They buy a quad bike or a recreational bike from us and that has helped our Polaris and Yamaha sales. It was particularly noticeable at the beginning of last year. We have also been selling more children’s bikes in the past couple of years.” Sargent Motorcycles also has a strong online outlet, selling motorcycles, accessories and parts and sending them out around the country. Nathan started out as an apprentice motorbike mechanic and was a passionate competitive motocross rider on the local circuit. He manages much of the operational side of the business while Kelly, with a background in administration, runs the office, stock and accounting. “Our goal was to earn enough to pay the bills and pay our salaries,” says Kelly. They say it can be daunting at times but they back themselves and work hard.
All in all, the couple say the last few years have been pretty challenging, and followed on from a particularly stressful few years as they tried to get their new premises up and running. In 2015, the business was operating out of two sites in Carterton and they had begun looking for a larger, single site. “Word got out that South Wairarapa Auto Services, which, like us, ran a 24-hour tow and salvage service, was moving out of their premises on the main road. It was a large site, with room to extend the building. We were told by the council the area was zoned residential with commercial use. So we thought it would be a good fit,” explained Nathan. “The council told us it would be simple.” Quite wrong. “We put all the plans into the council, they were accepted and we began building the 600-square-metre workshop that would join the existing building. “A neighbour became concerned by the height of the roof and went in to complain. All the trusses and framework were up but the council discovered they had given us permission for something
that was outside of the rules for that area. So we had to get it all re-engineered and put a hip in to reduce the height from the boundary fence,” explains Nathan. Kelly says the neighbour still wasn’t happy and the council issued a ‘stop work’ notice. Then a property developer at the back got involved – he was selling
sections for new houses. “We ended up having to buy the neighbour’s house and get the other neighbours to agree to our building. But the developer kept going with his action and we ended up in mediation.” Since the council had made the costly mistake there was also some legal action, which the Sargents can’t discuss. MEMBER PROFILE: SARGENT MOTORCYCLES - CARTERTON The final outcome was the project was held up for about 18 months; they had to put in a fence and plant some trees along the rear boundary of the new property development and go through a long period of noise monitoring. Kelly says, “Looking back, it all worked out. We are really grateful to the banks, which kept lending us the money we needed. We managed to rent out the house we bought. The person who bought our other building let us stay on as tenants until we could move in to the new place. But we were in a world of debt.” The business now has the building consent it needed and has approval to work out of the building. “But we still don’t have resource consent - and won’t get it until the noise monitoring ends in a few months,” says Kelly. They are not expecting it to become a further hurdle. “In some ways, we were really lucky. If we were trying to do this today, the new financing laws would stop us getting the extra money we needed.”
Nick Smith has been working on engines for 18 years, starting out in marine then moving over to vehicles and now motorbikes. He doesn’t hold a qualification as a motorbike technician but wanted to do the theory, so has started an adult apprenticeship. “I’ve done all the theory and there’s the practical to get through now. It’s a lot of photography and writing so I’m going through it with Jack, mentoring him and he can help with the photography.” Nick says he’s learned from a lot of talented people over the years and is happy to keep learning and helping others with their careers.

Sales Manager Jim Parkinson says people are spending more money on bikes since Covid. Rural sales are particularly strong. “Side-by-side sales have taken off – they’re replacing the quad bikes on farms, probably because two people can ride on them and they are more stable, less rollovers.”
New apprentice Jack Fisher is the third of three brothers to work at Sargent’s. Luke was Nathan’s first apprentice - staying on for several years before moving further afield. Brother Craig also worked at Sargent’s for a few years before deciding to take on a diesel apprenticeship. Jack started off as a 14-year-old grooming and generally helping out until he left school last year. “I wanted to do my apprenticeship here.” Like many of the others in the team, he’s keen on motocross and has a few bikes of his own.
Parts Manager Jason McCutcheon says they’ve built up stocks to offset the problems within the supply chain thanks to Covid. “It can take a week or more for some parts to arrive and, of course, the bigger they are the more expensive it is to ship now.”
Mechanic Jadin Galway enjoys working on bikes. “I’ve got quite a lot at home and used to race road and dirt bikes – but we have just had our first child so that changes. I’m doing more hunting these days.”

Penalties loom for ‘dirty’ cars Dealers will queue up this month to register any unsold and high CO2 emission cars, vans and utes ahead of the penalty fee being introduced on 1 April. The second stage of the Clean Car Discount (feebate) scheme offers a sliding scale of rebates for zero and low emission cars (EV and hybrids) and penalties for high emission ICE vehicles. Rebates end at 146g CO2/km while fees start at 192g CO2/km. Dealers around the country have had strong sales over the past 12 months and some report being very low on stock. There are lengthy waiting lists for new cars, while the battle to find quality used stock in New Zealand and overseas has put pressure on prices and supply.
Expect high demand Matthew Foot (Brendan Foot Supersite) in Wellington is expecting “massive” commercial vehicle sales in March as businesses wind up the tax year and upgrade their utes ahead of the introduction of the fee. “Some dealers have accumulated a lot of stock ahead of this, so they will need to pre-register any unsold, high emitting utes before the end of the month.” But he warns that dealers will need to be careful not to flood the market. “This is the year that manufacturers will clear their ‘dirty’ range ahead of the new Clean Car Standard that takes effect in New Zealand at the beginning next year.” However, those brands with limited EV or hybrid models are going to pay a hefty penalty under the Standard. “I’ve heard of one manufacturer who is facing around $30 million in fees because they will have just one hybrid available here in 2023.” The Clean Car Standard encourages importers to bring in zero/low emission cars to offset the high

emitters they import – using a tradeable credit and debit system. Just what impact the new clean car regime will have on demand is unclear; however, Matthew Foot is certain of one outcome. “Cars are going to get more expensive.” A brand that has to pay an extra $30 million to sell its cars in New Zealand is going to pass that cost on to the customer, he says.
“They don’t want a Leaf or a plug-in hybrid – they are too small or there’s nowhere to plug them in at their homes.”
“There’s nothing in the EV or PHEV line for the commercial sector, as yet.”
Brent Cooper at Wairarapa Mitsubishi also has very little stock left to worry about pre-registering it ahead of 1 April. The brand’s PHEV models are selling well with a new model Outlander arriving this month. His tradie customers will bear the brunt of the new fee.

“Customers claim the rebate after they have registered their EV, PHEV, or hybrid, but they have to pay the fee before they register their high emission car.” At the time of writing this article, there was no guidance from Government on how dealers must advertise or manage the process.
Muscle car market Darryn Caulfield owns Auto 66 in Hamilton and specialises in importing used muscle cars for enthusiasts. Many of his cars will attract the maximum $2,875 CO2 fee for used imports, and he’s not sure if this extra cost will put off some buyers. “I will be competing with the New Zealand-new used cars already in the fleet, which won’t have the tax on them. We will just have to wait and see what the market does.” He has about 20 vehicles to preregister before 1 April.

Craig Wall of Wall Motors in Onehunga sells a range of larger-engined used vehicles, including American left-hand-drive muscle cars for the enthusiasts. “I think that once the pre-registered stock runs out, we will see a big change in sales.” He’s not worried about his American car sales: “People who are prepared to spend $30,000 to $50,000 aren’t going to be put off by another $3,000.” However, he’s not so sure about sales of two-litre and six-cylinder cars. Demand for those may reduce as the price tag goes up and if petrol prices stick at $3 or more a litre, he reckons. “Next year I will have to bring in small engine hybrids to even out the average CO2 emissions of my stock so I can meet the Clean Car Standards that come in at the beginning of the year.” He’s worried that his customers won’t want the smaller cars. He says most of them are looking for big cars for big families.
MTA dealer sector specialist Tony Everett says the government’s last-minute rush in February to get the legislation through has left dealers short on detail for managing the ‘feebate’ in the sales process.
“It’s also not clear what happens if a car is successfully rejected and returned to the dealer. Will the Government refund the fee, or claw back a rebate? Does the dealer wear the costs, or does the customer?” In the absence of government guidance, we may have to wait for tribunal decisions to see where this will land.” The tables below are our best estimates of the likely rebates and fees on popular models using the information available.

Myths and misconceptions
about modification thresholds: part 2 In our second article about modification thresholds, we aim to de-bunk a few more misconceptions regarding when specialist LVV certification is required. In our previous article published last month (February), we discussed how to look at a modified vehicle from an AVI’s perspective; whether the modifications on an uncertified vehicle require LVV certification, or if the modifications on a previously LVV-certified vehicle match what the vehicle was LVV certified for. This month, we’ll begin working through some regularly misinterpreted sections of the LVV thresholds (which you can download here), starting with section 2-1 (External Projections). It’s important to note that LVV certification is required for external projection-related modifications, unless they meet the conditions under the ‘not required’ section of the LVV threshold. There are a few simple things that can be fitted to a vehicle that do not require LVV certification as long as they meet in-service requirements: • Towbars. • Trunk racks. • Roof racks and roof-mounted solar panels. • Additional or substituted rear-view mirrors. • Aerials. More complex modifications will often require LVV certification, and sometimes it can be difficult to determine where the cut-off point lies. Following are a few common situations in which the line can be mistakenly crossed.
Bumpers An otherwise unmodified Nissan Skyline sedan fitted with a GTR-style front bumper wouldn’t require LVV certification, as long as the bumper was attached securely to the OE mounting points and has met all other applicable LVV threshold wording. However, if the frontal structure of the vehicle had been modified as part of the installation, or the bumper bar had been cut out to fit a frontmounted intercooler behind the bumper, this would

Wide-body kits A wide-body kit on the same vehicle would not require LVV certification as long as: • the guards have not been cut during modification; and • modified mudguards or extensions have no sharp protrusions; and • mudguard extensions are securely attached to the vehicle; and • the mudguard/mud flap is no less effective than OE. Cutting a guard lip or inner guard structure would usually require the vehicle to be LVV certified, as would any other structural changes or alterations to a door retention system as part of the kit fitting. If an entire panel is being replaced, it’s important to note there are only certain situations where fitting fibreglass replacement panels (such as front guards) do not require LVV certification, and this will be detailed further in a future article.

The same logic applies to a full body kit, which does not require LVV certification as long as: • the fitting system does not weaken the vehicle structure; and • no frontal impact components have been removed where the vehicle is required to comply with a frontal impact occupant protection standard; and • the kit or components do not present any forward-facing external projections that could cause injury to the occupants or pedestrians or present a snagging/hooking risk to a vehicle or person; and
•
the driver’s vision has not been affected; and • the performance of any lamp is not affected as a result of the kit or components. These requirements are also applicable to bonnet projections and utility canopies.
Auxiliary bars and bull bars (including winches) Generally, the addition of auxiliary bars, bull bars, and winches to a vehicle would not require LVV certification as long as they meet the requirements of the threshold.
A-frame attachment In order to fit an A-frame to a vehicle, it must meet the requirements set out in the LVV threshold as it cannot be LVV certified (the same as towbars). In certain cases, the brackets to attach an A-frame to a vehicle will require LVV certification, such as when the brackets are welded to the vehicle structure. The LVV certification in this case will apply only to the brackets, and not to the A-frame that attaches to them.
Utility trays and decks
This is a good example of a guard modification that should be referred to a LVV certifier - not only has the cut-out removed strength from the wheel arch, but it has also changed the side-impact characteristics of the passenger compartment.
If a vehicle is presented with rolled guards (the inner lip of the wheel arch has been rolled flat with the vertical plane of the guard), LVV certification would not be required as long as there has been no heating, welding, cutting or drilling involved.
A ute tray fitted to a vehicle prior to 1 January 2021 only needs to meet in-service requirements, and it’s very rare for the vehicle to require LVV certification. For a vehicle first registered after 1 January 2021, it is required that: • the tray or deck has no sharp protrusions (the edges must have a radius of at least 3mm); and • no forward-facing pedestrian traps exist; and • the tray or deck either: o protrudes no more than 100 mm from the widest part of the vehicle cab/body structure (excluding mirrors); or o has forward edges that are tapered rearwards at an angle of not less than 30 degrees from the tray or deck’s front edge, or have an equivalent, or better, form of pedestrian protection. These requirements apply equally to a box or any other load-carrying compartment fitted to the back of a cab-chassis utility or small truck.

PARTNERS IN TRAINING Through this I was lucky enough to get the job with Midas.” Gabrielle’s current employer Brenan Emson says that her previous experience stood out as a factor in hiring her for the job. “We were looking for a new apprentice as our old one had left. Gabrielle’s CV came across our desk and I saw that she had realworld experience in an automotive shop. This made it an easy choice for us to select her for this role.” Gabrielle has shown great motivation and determination in completing her apprenticeship. Brenan has found Gabrielle to be a great employee. “Gabrielle has been awesome as an employee and as an apprentice. She gets stuck in and does the work. She tries to find the fixes to the problems that she comes across. She’s just been really good.” Gabrielle is enjoying her role with the larger jobs being her favourite part. “I really enjoy the bigger jobs at work. I love removing engines and taking everything apart and putting them back together. Just seeing how everything works together and being able to put it back so it’s working again is really enjoyable.”

From the desk to the workshop floor How 21-year-old Gabrielle is paving her way in the workshop. “Highly motivated”, “a really great worker”, “she just gets stuck in”. These are all phrases that have been voiced by Gabrielle Boyd’s training advisors and employers over the past few years as she has been doing her apprenticeship. Gabrielle is currently completing MITO’s New Zealand Certificate in Light Automotive Engineering at Midas in New Plymouth. She is hoping to have this finished by the end of the year. Gabrielle’s interest in the automotive industry arose from her distaste for sitting at a desk all day. “I was working a desk job before getting into an apprenticeship and didn’t enjoy being stuck inside or at a desk all day. I wanted to do physical work and decided one way would be to get into an automotive apprenticeship.” Gabrielle was living in Hamilton when she began her apprenticeship and contacted local businesses MTA Radiator Magazine March 2022
to get started. “I contacted a few local businesses and one of them had a pre-trade course available. I signed up and was able to get my Level 3 pre-trade automotive engineering qualification. Once I had my Level 2 and 3 qualifications, I was able to move up and get into a full apprenticeship with another Hamilton business.” Partway through her apprenticeship she moved from Hamilton to New Plymouth. Moving towns, Gabrielle thought it would be impossible to carry on. “Moving from Hamilton to New Plymouth I honestly thought I wouldn’t be able to get a new job. Having not completed my apprenticeship and being halfway through was a big concern for me.” However, with perseverance and great references she was able to get employed. “I put my CV out to a few different automotive places around New Plymouth and contacted a few mechanic shops.
In the future Gabrielle would love to specialise in engine rebuilds but is also looking at getting her Warrant of Fitness certificate as well. As Gabrielle nears the end of her apprenticeship, she shares some advice for future apprentices: “Stick to one job at a time and get it done. Make sure you are informing your boss about what you need to do to get your apprenticeship completed. It is all about communication.” And if there are any female apprentices out there, Gabrielle says not to hold back. “Sometimes people are surprised that I am a woman in the industry and can underestimate what I am capable of. However, I just stick to the jobs at hand and do my best to get it done. Part of the comfort philosophy is keeping things straightforward in terms of the drive. There aren’t too many things to play around with. In D there’s just a touch of the braking regen when you lift off the go pedal, while B mode (a button press away) adds more force, but not enough for true one-pedal driving. There are three drive modes – Sport, Normal and Eco – but you’ll likely keep to the default intermediate setting. Apparently you only get the full 260Nm in Sport mode, and there is a noticeable hike in the oomph offered, but then power use also increases. Eco you’d employ only if your range anxiety was peaking. This delivers genuinely unfussed urge for urban ramblings, with no transmission delay or turbo lag to sully things. It gets up to 100km/h at a reasonable clip (9.7sec vs 8.7 for gas power) though the zoom does button off once up to the legal limit. The brake pedal is a tad sensitive; you need to tread thoughtfully or the process can be jerky as it transitions from motor regen to mechanical braking.
The ride is decent – it’s a Citroën – so this aspect is almost assured. And the steering is light and breezy, good for city driving and parking (so too the turning circle), but not so helpful in the curves where it lacks sensation. No biggie really, as the C4 is all about the comfort. The extra weight of the batteries is carried low, giving it a grounded feel but, much like the regular C4, understeer isn’t too hard to find when it’s biffed at a bend. While the ‘comfort’ suspension isn’t
so worried about suppressing the roll, it’s adept at mopping up the bumps, doing so quietly. This is for those who prefer dignified progress. The relatively quiet refinement of the electric propulsion suits the C4 well. The e-C4 is otherwise just like its more gaseous petrolpowered sibling. It’s right-sized for city life, and those who only occasionally fill the back seat. And it’s a fairly spunky looking thing, a Citroën that’s interesting without being weird.
Vive la electric life! Excuse our appalling French, another subject we failed at school, but those wanting electric drive with their helping of Citroën styling and comfort can now satisfy that urge with the new e-C4. Are there any caveats? While Peugeot has landed its e-2008 here, its Citroën cousin, the e-C4, is still months away from reaching Aotearoa officially. This leaves room for the grey importers to lure the keen early adopters with cars sourced from the UK. Such an example is this e-C4, from GVI in Auckland. In Shine specification, this was listed at $69,880, less than what the e-2008 costs new here. However, being first registered overseas, it’s only eligible for the $3,450 Clean Car rebate. That said, it’s hardly used, having all but delivery kms on its clock. Still, this MTA Radiator Magazine March 2022
is almost double the price of the regular C4. That’s unfortunate as the electric powertrain marries sweetly with the C4’s core philosophy, which doubles down on comfort and refinement. There’s only one powertrain for the e-C4 with a 50kWh (45kWh net) battery and a 100kW/260Nm motor, the latter mounted under the bonnet, turning the front wheels. A WLTP range of 350km is the claim, though real world figures could vary from 200km in cold weather right up to 370km or more in slow-churning city running. At a 100kW charger,
you’d get about 10km of range a minute, they say, with a charge from 10 to 80 percent in 30 minutes. We gave it a quick top up at the 50kW freebie charger, the battery rising from 18 to 47 percent in 20 minutes, adding just under 100 kms of range. Owners should install a wallbox at home, where the majority of your charging should take place. Hooked to a 32A box, it can be fully juiced in 7.5 hours. Charging using a three-pin plug (charge cable supplied) is described as ‘possible’ but would take the best part of a day to fully charge. MTA Radiator Magazine March 2022

We also like how nothing screams EV, no faux grille or aero wheels, just an ‘e’ on the front guard. The seats have the comfort label attached to them also, and aren’t too shabby either, with ample padding and a distinct lack of bolstering. There are just enough soft points about but also a fair amount of hard plastics and old switches that date back decades. You can change the view of the digi dials to give you ample drive info or reduce everything to just a speed readout. There is useful cabin storage here, not a usual trait in a Citroën, and this one comes with a tablet holder on the dash. There’s also a natty little drawer below to store the device out of sight. The glovebox on RHD cars is still half-size due to the fuse box in behind, but otherwise this has decent cupholders, a conveniently located charge pad and a cubby at the base of the centre stack with another secret hidey-hole beneath. This article is a true description of an AECS technical help desk problem and how it was solved.
Kawasaki KLF400 ATV
Diagram In the diagram (below left on previous page) I have highlighted the wires to and from the CDI unit.
Problem presented to the Technical Support Team “This hardly used farm bike intermittently does not want to start. It has been to a number of motorbike workshops and it had been parked up for a few years now. We are thinking about throwing it away as it just takes up space in the workshop. Is team AECS interested in looking at it over the holidays?” “No, we are not”, was our stern answer, as it has been a very hectic and tumultuous 2021 and we could have done with a break. But, the bike appeared one morning as a gift. We couldn't turn it away, could we?
Where to start? On jumpstarting it, we noticed there was plenty of compression, so likely no mechanical problems on this low-kilometre bike. We whipped the spark plug out and found that to be dry, like the tank. After filling up the tank, the spark plug remained dry. No flow from the carburettor drain screw. We removed the carb and found the bowl full of black tar. Went all out to clean all jets and channels only to discover no flow from the tank tap. We cleaned black tar out from the tank and tap, now finally have flow from the drain screw. For those who are young, a carburettor is a type of fuel injection device
Wet Winding over the engine didn’t work; this time the spark plug did get wet though.
Winding over with the spark plug out did show a spark though. Maybe a mixture problem? Spark plug back into the head and ‘presto’ the engine ran. It ran quite well without changing the mixture. It crossed my mind that we had a good, cheap and easygained bike.
Lucky? However, I have never been lucky with things like this. Sure enough, the next morning no firing-up of the bike, a wet spark plug, and this time no spark when winding over with the plug outside the combustion chamber.
Measure Time to measure with the scope and better nail down where the problem is before the spark returns. The bike came with an owner’s manual tht contained the appropriate wiring diagram, making it easier to diagnose.

Many small bikes (dirt and farm bikes) have an ignition system called CDI (Capacitor Discharge Ignition). I do not deal with CDI systems very often (in AECS tech support we deal more with EFI systems, where ignition coils are switched to earth by the ECU or an ignitor). A CDI system works very differently.
- The red-coloured wire is the ignition on power supply to the CDI unit. - The black-coloured wire is the earth wire of the CDI unit and the coil. - The green-coloured wire is the output wire through which the CDI unit discharges its capacitor into the ignition coil, to create the spark. It is important to note that the ignition coil’s primary is connected permanently to earth. The signal the CDI units needs is the signal from the inductive crankshaft sensor (pickup coil). Scoping the crankshaft signal and the output of the CDI unit showed a nice big flat line at zero volts, while the crankshaft signal was clearly visible. To make sure that the module had everything it needed to work, the power supply and earth had to be measured. The power supply stayed present; the only fluctuations seen are the voltage drop as a result of the starter motor fighting the compression of this single-cylinder engine.
Simple It’s really not that hard, is it? The CDI unit had a crank signal, earth and power supply. That could only be a crook CDI unit. Just order a new one and again, presto! Not so quick. No new or secondhand parts are available. That would in all cases spell the end of this otherwise nice bike. Maybe we could get a unit from a similar bike, like the KLF300? The ignition system is likely the same and the ignition system is not really affected by engine size. Having spent about $70 on a new KLF300 CDI unit, we found that the unit had the same number of wires (5x) but only a different plug (3-pin instead of 4-pin with one unused position). Easy, just take the 3-pin plug apart and put the pins of the new CDI into the old plug. Plug the unit in and .... NO GO.

Better have a look at the wiring diagrams of the KLF300 and see if there are differences. The number of different wiring diagrams that came up was unbelievable. Many exactly the same as the KLF400, and some very different. No luck finding the answer on Google. I happened to know someone with a KLF300 who still had the owner’s manual for that bike. Pictured right is a diagram, and instantly visible are two major differences: 1) The coil in the KLF400 is connected to earth and the ignitor. The coil of the KLF300 is connected to 12V and the ignitor. 2) The CDI unit in the KLF400 is called DC-CDI. The ‘CDI’ unit in the KLF300 diagram is called the igniter. Look at the diagram section where the main connections are highlighted in red, black and green.
After fitting the KLF300 coil, the bike started and ran fine: A quick resistance test showed that the CDI primary coil had a resistance of 0.2Ohm and the KLF300 coil was 1.7Ohm. The resistance of the CDI primary coil was simply too low to be able to be switched to earth by the ignitor. There is a maximum amount of current that can be switched by the poor little ignitor!

Conclusion All in all, I do not know if the holiday job was worth it, as in the end a fair bit of time was burned up in this bike. However, it is a perfect runner and might be handy for someone one day. How lovely that the ignitor was sold as a KLF300 ‘CDI’ unit! There is no way of telling from the outside and certainly not without the ATS500XM scope recordings that it was NOT a CDI unit. I hope this information is helpful as there are plenty of these bikes for sale for parts only (without CDI units). Think outside the square and just make it work!
Too easy This was going to be an easy solution: simply connect 12V to the ignition coil positive and the thing should finally go! NOT. Still no go. No spark, but some signal of a weak spark on the scope. When zoomed in on the release of the coil, there was actually no spark, just some oscillations. When we looked at the voltage where the ignitor tried to switch the coil to ground you can see that the voltage only is being pulled down only to 10.3V. I expected a value closer to 0 Volt.

Back to the drawing board After doing some testing on the bench of the CDI unit, which decided to work again for a short period of time, I saw that the coil of the KLF400 produced perfect sparks, yet when connected to 12V and the KLF300 ignitor it did not, because the new ignitor was not able to properly switch the coil to earth. A quick check of the actual KLF300 bike revealed that the size of the coil was very different.

The Advocacy & Strategy Team works with Sector Managers and members to monitor issues across the automotive industry. This column updates you on recent and proposed law changes, MTA meetings with stakeholders, and MTA Advisory Group activity.
As you read this, the industry is preparing for the second stage of the ‘feebate’ scheme known as the Clean Car Discount, which takes effect on 1 April 2022. The scheme is intended to influence consumer demand for low emission vehicles; providing a rebate to register ‘clean’ cars, and imposing a fee on the first-time registration of high-carbon-emitting vehicles.

MTA has been vocal in its view that the scheme, while addressing a serious problem, faces huge challenges to alter the composition of the vehicle fleet. Such change will be decades in the making, yet we are told that carbon emissions are a problem right now.
With petrol prices hovering around the $3 per litre mark, we think there is a massive incentive for customers to have their current vehicle serviced so it uses less fuel. This could come from simply tuning the engine, replacing the catalytic converter or installing new oxygen sensors. We know there are many MTA members with emissions testing equipment sitting in a corner gathering dust. MTA will work continue to stress the importance of testing and will work with Government to see how it can fit into the existing in-service inspection process.
And do we even know how big that existing problem is? Not really. Much of the policy work from Government has looked at the CO2 profile of vehicles as they are listed on the Motor Vehicle Register. But we all know that emissions systems deteriorate over time – components wear out, systems fail, and the emissions profile of the fleet could be much higher, we think. In fact, we have found research that suggests a vehicle that has done 150,000km could be MTA Radiator Magazine March 2022

The thing is, we just don’t know for sure. We could be more accurate if we introduced systematic emissions testing of the fleet. With the resulting information, we could identify the vehicles causing the biggest problem and encourage the owners to carry out servicing and repairs to improve fuel efficiency and reduce carbon emissions.
But there is no time like the present for members with the means to bring out their testing equipment, fire it up, and start offering testing to customers. Many people want to do their part for the environment, but they are not able to buy a new car (or a fresh used import) with low emissions. With your help, they can understand their existing emissions and how they can improve fuel efficiency, lower their travel costs, and do something good for the environment.

Reducing the emissions profile of tens of thousands of cars imported each year is a step in the right direction, but it does not address the emissions right in front of us.

What's new Clean Vehicle Discount and Standard Schemes The respective Land Transport (Clean Vehicles) Amendment Bill finally passed into law in late February. This is the culmination of work started in 2019. The passing of the Bill sets the scene for the rollout of the second part of the Clean Car Discount Scheme (the extension of rebates to additional low-emitting CO2 vehicles (146gm/km and below) and the imposition of registration Fees on higher emitting CO2 vehicles (192gm/km and above). The provision of rebates or imposition of fees will be triggered at the time of vehicle registration. All light vehicles being registered for the firsttime into the New Zealand fleet (as new or fresh used imports) will be subject to the scheme in one way or another. Part 2 of the Clean Car Discount Scheme takes effect from 1 April 2022. The scheme
is a demand-directed scheme focussing on consumers. The Bill also sets the scene for the implementation of the Clean Car Standard – a supply-focussed scheme targeting vehicle importers. The Standard will take full effect from 1 January 2023. However, a trial period will start in the second half of this year for vehicle importers to test the processes and systems before financial impacts come into effect on 1 January 2023. The Clean Car programme will introduce a mix of credits and debits on importers that will have to be settled at vehicle compliance either on ‘a pay as you go’ or an annual settlement basis. Operational details of the two schemes will be set out in new regulations that are yet to be released. Collectively these two programmes will have a significant effect on the new and fresh used import markets. Settings will change in progressive years.

Submissions Review of Motor Vehicles Traders Register fee and Motor Vehicles Disputes Tribunal levy A short submission was sent to MBIE in response to proposals to increase the Motor Vehicle Traders Register fee and the inclusive Motor Vehicle Disputes Tribunal levy. We understand MBIE sent the discussion document to all traders in late January. MTA supported proposals to increase the fee and levy on the basis that increased enforcement activity will benefit the trader community in the long run. A copy of MTA’s submission can be accessed on the MTA website.
MTA was not against the concept of maintaining a certain level of fuel stock to sustain the country through disaster or disruption. We suggested that industry was best placed to determine the level of risk and thus the ultimate level of holdings required. We did not support the creation of a new agency to monitor the industry’s compliance with this stockholding requirement.

Market overview - February 2022 Used import vehicles With 11,608 units, February was a good month - up 21 percent on same month last year. 10,734 used import passenger vehicles, up 18 percent. 874 used import commercial, up 72 percent. Used import arrival volumes of 7,669 units in February were 3,939 units below the sales count, resulting in a net reduction in inventory levels.

Strong sales for luxury market 2021 proved to be a big year in the New Zealand luxury new vehicle ranks, assuming we accept Tesla as a ‘luxury’ brand (ie based on cost, specs and/or public perception). Before we get into the specifics, sales in the so-called luxury passenger world were strong last year – 13,224 units, up 47 percent (compared with a total passenger market that was up 39 percent). So, up in volume, and up in share. Tesla was the main reason.

That said, aside from Tesla, only Volvo (up 67 percent) and Aston Martin (up 74 percent) can claim to have done substantially better than the overall luxury market.

Top-selling models amongst the luxury brands were: Tesla Model 3 with 3,284, Land Rover Defender, 409, Mercedes-Benz GLE 359, Volvo XC40 350, Audi Q3 322. Yes, I know the proposition of what luxury is starts to get a bit thin at this level, but that’s the way it is.

Mercedes-Benz was the comfortable winner of the ongoing battle between the German premium brands (BMW and Audi). Despite doing better than 2020, in volume, all three lost ground in the overall market.

The market lift mirrors the trends for sales of many ‘discretionary goods’ categories. Motorcycles, boats, campervans, etc have all had high sales recently. Many commentators attribute this to robust property prices. In short, people with property have seen their paper-wealth grow substantially and many are feeling quite comfortable. Tesla took out the top spot with a huge jump in sales over the prior year. Most of that volume (78 percent) came in the second half of 2021 on the back of the Government’s EV rebate, and perhaps a consequential lift in supply volumes.

Good start to the year January WoF inspections got off to a steady start around the country with Auckland pulling out in the lead – possibly putting through post-lockdown vehicles that couldn’t be inspected pre-Christmas. In terms of what to expect for the year ahead, now is a good time to get the WoF and service reminders out to your customers to help even out the dip that is expected in April. This dip will not be as bad as the “WoF trough” we saw last year, but with two public holidays in mid to late April there is the potential for some regions to see a noticeable drop-off in work. May, June and July look like being busy months once again, so remember to take some time away from work to look after your mental health. This applies to your staff members as well, the last thing we want is burnt-out technicians and inspectors. August will be the new “WoF trough” so some careful planning will need to be done to combat this. You don’t need to target new customers (it’s actually cheaper and easier to reconnect with your existing customers) so getting WoF and service reminders out on time will be vital. You may also want to consider running a promotion to get customers through the doors.

Interestingly, the number of tyres failing at WoF inspection has fallen steadily for several years, despite members saying they are seeing more tyre problems. A possible explanation is that worn and dangerous tyres are being replaced when the vehicle is in for servicing, so by the time the WoF rolls around, the tyres pass inspection.

Insights from mediation After a year with the MTA Mediation team dealing with questions and complaints relating to vehicle sales, it seems timely to note some of the common issues that have arisen.
existence and effect of the exclusion clause. It is contained in the fine print of the VOSA, which is the dealer’s own standard form agreement. The customer does not have this familiarity with the VOSA and could argue that the exclusion clause in the fine print was never pointed out to them, or that they didn’t understand the effect of signing these clauses. If you chose to use section 43 of the CGA to opt out of the CGA, these clauses should be signed on the VOSA, but you also need to be able to show that the effect of doing so has been explained and understood by the customer. You could do this with a separate form that explains the exclusion

We are unable to provide legal advice, but will give you the benefit of our experience, information and common sense. Any legal input should be provided by your own lawyers, who would be properly briefed with all the relevant evidence and information.
Deposits A growing number of customers are complaining that their purchase was not completed and the dealer refuses to return the deposit. While there can be a variety of reasons for the noncompletion of a sale, there are limited reasons for withholding a deposit. The Motor Vehicle Disputes Tribunal (MVDT) has questioned whether a deposit forfeiture clause in the VOSA provides complete justification for retaining the entire deposit. Their view is the forfeiture clause has the potential to be a penalty, ie it allows one party to penalise another for failing to perform their obligations under the agreement. Section 46M(c) of the Fair Trading Act (FTA) recognises that a term that penalises, or has the effect of penalising, one party (but not the other party) for a breach or termination of the contract may be an unfair contract term. The MVDT does not have powers to make orders on unfair contract terms under the FTA. However, the FTA’s unfair contract term provisions provide useful guidance in determining whether a purchaser is entitled to relief under section 43(1) of the Contract and Commercial Law Act (CCLA), which the MVDT can rule on. Generally, a trader can only claim for legitimate loss or damage resulting from the failure to complete the contract.

While many members have already built up knowledge and experience in the sale of used EVs, those who are new to the market need to be aware of some traps. could lead to the customer rejecting the vehicle. The issue is that the Clean Car Discount Rebate is separate to the vehicle sale with the application made to Waka Kotahi by the first registered owner. Should the vehicle be rejected after the Clean Car Discount Rebate has been applied for, the dealer must refund the purchase price, but there is no process for the rebate to be refunded by the owner so it can be passed on to the next owner. Even if the rebate has not been claimed, only the first registered person is eligible to claim the rebate. Waka Kotahi is aware of this situation and has been assessing the issue on a case-by-case basis. We are aware of one instance where the rebate was assigned back to the car after it was rejected.
Trade sales and opting out of the CGA When selling a vehicle to a business for ‘in trade’ use, there is provision for opting out of the CGA (in accordance with section 43 of the CGA). Most dealers are aware of clause I3. and 8.2.1 of the Terms and Conditions in the VOSA; however, simply obtaining signatures beside these clauses on the VOSA is not enough to successfully opt out of the CGA. There is a perceived imbalance in the bargaining power between the dealer and the customer, because the dealer knows of the
