Lowell Client Forgot

On February 21, 2023, I got a bill from a client in Lowell, Indiana. It was on my desk when I arrived at the office.

The client was getting a bill for $147.19 from a medical firm. The client did not know why she was getting the bill. I checked it for her.

With some editing to protect the privacy of our client, here is the letter that I sent to her after I checked the bill to make sure it was legitimate and accurate.

You sent us a bill from (the medical firm) and asked us to check it.

The bill seeks $147.19. It is your bill. You should pay it. Here is why.

You bought a Plan G Medicare supplement policy. Plan G policies DO NOT pay the Medicare Part B annual deductible. This year, that figure is $226.

The bill for $147.19 was for date of service 1/13/23. Another bill for date of service 01/04/23 was $78.81. Those two bills add to exactly $226. You are responsible for paying these bills because Medicare counted them to add to your Medicare Part B annual deductible.

Question: We contracted to buy a home on the 1st of the month. Closing is in 45 days. Ten days prior to closing there was a huge storm which took down a large tree in the backyard and damaged the house. Is the seller obligated to fix the house and replace the tree?

Answer: At the time you bought the property, the day the contract was signed, you purchased a home with a given physical condition -- not perfect, but as you saw it. The seller has an obligation to deliver the property in substantially the same condition as it was on the contract date.

In the situation you describe it’s likely that the owner’s insurance will cover some or all of the bill. If the repairs are not completed by closing, then establish an “escrow” or trust account at from the seller’s funds at closing to assure that the work is completed.

As to the tree, it was going to fall at some point. The storm was plainly an act of nature. The owner is obligated to clean up. If you’re on good terms with the seller, maybe ask for firewood.

Question: Four months ago we saw a house we liked and said we were interested, but didn’t make a firm offer at that time. The owner now wants to take the home off the market. Is there any way we can make an offer on the house?

Answer: An owner is not obligated to eternally offer a home for sale. You could have made a written offer when the owner was actively marketing the property.

You can still make an offer -- I have had people approach me to buy property which was not for sale. But an owner has no obligation to review an offer or accept it.

Van Beek

Roger Glenn Van Beek, 83, of Lansing Illinois passed from this life to his home in heaven on Sunday, February 19, surrounded by his family. Roger was born on November 14, 1939, in Pittstown, New Jersey to Peter and Nellie (Noteboom) Van Beek. He was the third of six children. In his school years, the family moved from New Jersey to California to Illinois before settling in Wisconsin. Roger grew up farming, but chose not to follow that path. He always gave 110% to all he did including his family, work and service to the Lord. Roger married Janice Dykema on March 18, 1960. They were blessed with three children Randy (Ruth) Van Beek of Lansing Illinois, Sandy (Joe) Mulder of Delavan Wisconsin and Paul (Gail) Van Beek of Pella Iowa. He was a devoted husband and father. He was a loving grandfather to thirteen grandchildren Ryan (Olivia), Jeff (Laura), Alexa, Andrea, Ross (Amy), Jon (Susan), Andrew (Meghan), Jared (Maggie), Hannah, Abby, Nick (Jori), Jeremy (Ashley), and Emily. Roger and Janice also are blessed with ten great grandchildren. He loved his family dearly and had no greater joy than to know each one walked with the Lord. Roger was an avid Cubs fan and a loyal Packers fan. He loved to play sports and was proud to talk about his basketball career in HS. Although his education ended with high school, he encouraged his children to pursue college. He loved to sing, and was a member of the Crusaders quartet for 17 years. His love for sports and music were passed on to his children and made him a faithful spectator at many of his grandchildren’s athletic events, concerts, plays and musicals. Roger was devoted to Christian education and served as a school board member in his children’s school. He served several terms as an elder in churches in WI and IL, was a Sunday School teacher and Cadet leader. Roger was a man of deep faith and was always ready to give an answer for the hope that was in him. He was known to share that faith with his family, with neighbors, with travelers and workers at the Oasis where he walked, with his coffee buddies at McDonalds and all those who provided his health care. In his last days, he continued to share that faith in the hospital and was known by all the nurses for his singing.After working in the building industry for 17 years in Wisconsin, he fulfilled a dream to be in ministry when he began to work at Bible League International in 1985 as the vice-president of finance. During his 22 years of service, he helped guide the ministry finances, visited field offices in several foreign countries and led the building project for the current facility in Crete, Illinois. He is survived by his beloved wife of 63 years, his children, grandchildren, and great grandchildren. His brother Lynn and sister Char, sisters-in-law, and many nieces and nephews.

He was preceded in death by his parents and brothers Gerald, Donald and Clifford. Visitation will be held Friday, February 24, 2023 from 4:00 – 8:00 p.m. at Smits Funeral Home in Dyer, Indiana. A memorial visitation will be held Saturday, February 25, 2023 from 9:45 a.m. until the time of the Celebration of Life Service at 11:00 a.m. at Crete Church 24755 S. Elmer W. Kerstowske, age 88, passed away on Tuesday, February 14, 2023 at Franciscan Saint Margaret’s Hospital near his home in Dyer, IN, formerly of Dolton, and South Chicago, IL. He was born on March 14, 1934 in Chicago, IL, to Joann E. (Gorecki) Kerstowske and Elmer Kerstowske. He married Barbara Ann Michalak at Immaculate Conception church in South Chicago on September 21, 1958. He was a graduate of Mount Carmel High School and Wilson Jr. College, and attended Roosevelt University. He worked as a production manager at Crain Communications in Chicago, IL from 1970 until his retirement in March of 2000. Affectionately nicknamed “Blinky” by his family, Elmer was a kind, considerate man with a quiet nature and sharp wit. He enjoyed simple pleasures such as golf, bowling, word-searches, eating hot fudge sundaes from Gayety’s, and watching The Cubs. He was a loving husband and father, and a doting grandfather. He will be deeply missed. He is survived by his wife, Barbara, his daughters Kathleen Kerstowske and Judy (Mark) Swisher and granddaughters Mallory Kroll (Mike) and Kate Swisher. She loved to travel with Mark, and enjoyed scuba diving and windsurfing in far off places. She also got the opportunity to travel internationally with her sister, Marianne. She was Mark’s soul mate; always inseparable, donating her kidney for him so they could continue living their lives together to the fullest. She was a dog mom; always having two well groomed long haired shih Tzu’s following after her around her house and yard. Chris’s loving and caring attitude, and commitment to family and friends, was also evident in her own personal interests, such as plants and gardening, as well as baking. Chris will always be remembered as someone who truly demonstrated a strong Christian faith, and love for the Lord.
