NSCM: The Military Committee is a key element of NATO’s organization. Could you explain its role/mission within the overall NATO structure?

geNeraL BarteLS: The Military Committee (MC) is fundamentally the Chiefs of Defence of the 28 nations and, for evident reasons they cannot be present on a day-to-day basis. They, therefore, have their military representatives here in Brussels. The purpose of the MC is, together with the two Strategic Commanders, to provide the advice of NATO’s military authorities to the Council. Our aim is that this advice should be timely, relevant and possible to implement should the Council so desire. Decisions are made by the Council but military advice is provided by the MC which builds a position of consensus (based on the views of the 28 military representatives & the two Strategic Commanders) and supports this position before the Council. The process of reaching consensus is certainly complex but runs along wellestablished procedural lines, it is supported by working groups at various levels, in particular within the International Military Staff (IMS).

NSCM : Le Comité Militaire est un élément-clé de l’organisation de l’OTAN. Pouvez vous nous expliquer son rôle/sa mission au sein de la structure globale de l’Alliance ?

NSCM: You have only a very limited staff to support you personally. How does that work and how do you make sure that you are supported most effectively? What are the dynamics between your staff and the IMS? geNeraL BarteLS: Yes, I have quite a small staff coming from 8 different nations. I believe that the Chairman of the MC should be supported by a multinational staff as this brings to light different facets of issues which you would not necessarily see from a national perspective. I am a great believer in the wealth of ideas, knowledge and culture that is revealed when you bring different nations together.

We, of course, work very closely with the IMS, which belongs to the MC and acts on guidance from either the MC or the Chairman of the MC. There are specific working groups chaired by members of the IMS, which work on issues even before they are brought to the MC. You could say that the IMS is the machinery which makes it possible to bring together the military advice from the Strategic Commanders to the 28 allies.

geNeraL BarteLS : Le Comité Militaire réunit en principe les CEMA des 28 pays membres qui, pour des raisons évidentes, ne peuvent être présents quotidiennement. C’est pourquoi chacun d’eux a un représentant militaire ici, à Bruxelles. Le Comité Militaire est chargé, en coopération avec les deux Commandants Stratégiques, de fournir au Conseil l’avis des autorités militaires de l’OTAN. Notre objectif est que cet avis soit rendu en temps voulu et qu’il soit pertinent et possible à mettre en œuvre si le Conseil le souhaite. Les décisions sont prises par le Conseil, mais les conseils militaires sont donnés par le Comité Militaire, qui forge un consensus (à partir des points de vue des 28 représentants militaires et des deux Commandants Stratégiques) et défend cette position devant le Conseil. Le processus de création d’un consensus est indubitablement complexe, mais il suit des procédures clairement établies et il s’appuie sur des groupes de travail à différents niveaux, en particulier au sein de l’Etat-major Militaire International (EMI). NSCM : Le personnel qui vous assiste est très restreint. Comment travaillez vous et comment vous assurez-vous qu’il vous seconde au mieux ? Quelles sont les dynamiques à l’œuvre entre vos collaborateurs et l’EMI ? geNeraL BarteLS : Oui, je suis épaulé par une petite équipe originaire de 8 différentes nations. J’estime que le Président du Comité Militaire doit disposer d’une équipe multinationale, car cela lui permet d’appréhender les questions sous des angles variés, ce qu’il ne ferait pas forcément s’il n’avait qu’une perspective nationale. Je suis intimement convaincu que réunir des nationalités différentes est une source de richesse en termes d’idées, de connaissances et de culture.

NSCM: You are now a little over half-way through your three-year term as Chairman of the Military Committee. Could you give us some insights into the demands and challenges of this position and what you personally have learnt from it? geNeraL BarteLS: I see my main role as being here to facilitate the creation of consensus on military advice. The Alliance is made up of nations of common values and common interests but that does not mean that we have common interests on all issues. Geographically we are very spread. For evident reasons there can be divergent views. In some areas it can be very difficult to reach a consensus but in most cases we manage it. A very positive experience of working as Chairman of the MC is to see first hand how nations really work hard to achieve consensus and try to take into consideration other perspectives. It is an incredible strength. When the decision has been made, it has been made by 28 nations. Other than this, I have two major priorities. My first priority is to support, to the best of my ability, our ongoing operations. The second, but on the same level of importance, is to make sure that the Alliance, from a military perspective, is ready to face new challenges from 1 January 2015 when a substantial amount of our forces will have come back from Afghanistan. NSCM: Consensus building is at the basis of every decision taken at the Military Committee level. How does this happen in practice and what main obstacles do you face? geNeraL BarteLS: The process of how a paper or policy gets discussed is as follows: When we have an issue, whatever its character, advice is provided either by both Strategic Commands (SCs) or by a single SC. Where the issue is

Il va de soi que nous travaillons en étroite collaboration avec l’EMI, qui appartient au Comité Militaire, et agit sur instruction du Comité Militaire ou de son Président. Plusieurs groupes de travail présidés par des membres de l’EMI travaillent sur des questions spécifiques avant même que le Comité Militaire ne s’en saisisse. L’EMI est en quelque sorte l’outil permettant la prise de décision par consensus des commandements stratégiques et des 28 nations. NSCM : Vous avez accompli un peu plus de la moitié de votre mandat de trois ans. Pouvez-vous nous en dire plus sur les contraintes et les difficultés de votre fonction et enfin sur les défis que vous souhaitez relever ? geNeraL BarteLS : Ma fonction consiste essentiellement, selon moi, à faciliter la prise de décision par consensus. C’est une force incroyable. Lorsqu’une décision est prise, elle l’est par 28 nations. J’ai deux grandes priorités. La première consiste à soutenir, dans toute la mesure de mes possibilités, nos opérations en cours. La deuxième, tout aussi importante, revient à m’assurer que l’Alliance, d’un point de vue militaire, sera prête à relever de nouveaux défis à partir du 1er janvier 2015, soit une fois qu’une grande partie de nos troupes seront rentrées d’Afghanistan. NSCM : La recherche du consensus est la pierre angulaire de chaque décision prise par le Comité Militaire. Comment cela se passe-t-il dans la pratique, et quels sont les principaux obstacles ? geNeraL BarteLS : Le processus de discussion d’un document ou d’une politique générale se fait comme il suit : Lorsque nous sommes saisis d’une question, un avis est donné par les deux commandements stratégiques, ou un seul, en fonction de sa nature. Lorsqu’elle est principalement opérationnelle, cette question est traitée par le Commandement Allié Opérations de Mons (Belgique) ; lorsqu’il s’agit essentiellement de politique générale (comme l’entraînement), elle fait intervenir le Commandement Allié Transformation de Norfolk,

when NATO political authorities are considering military action, such as the isAf operation in Afghanistan, a critical part of the information needed to make informed decisions that all nations can agree to, comes from its military authorities.

essentially operational, this will be dealt with the Allied Command Operations in Mons (Belgium) or, where it is mainly policy, then it will involve the Allied Command Transformation in Norfolk (Virginia, U.S.A.). This advice is provided to the MC, which then distributes it, in the form of a position paper, to the 28 nations in order to get their perspectives. Meetings will start at what we call MC working groups, at action officer level, where they thrash out their differences and narrow down the paper to a common perspective. These are the first steps towards consensus. When the document is considered mature enough to go for nations approval, it is then sent out under the procedure known as ‘Silence’ which means that the document is sent out and unless there is a so-called ‘break of silence’, the document is accepted by the set deadline. It is then signed off and sent to the Council. Once the Council endorses the document it becomes an effective document rather than just a proposal. Once this stage is reached, the decision is then enforced by 28 nations. We could say that this is the big added value of the MC - translating pure military advice into political-military advice.

The North Atlantic Council tasks the Military Committee to produce military advice that can be agreed by all 28 NATO Chiefs of defence.

SteP 2

The international Military staff, in support to the Military Committee, translates the political guidance into military direction and tasks one or both strategic Commands for their best military advice on how to organize and conduct what has been asked for, including an assessment of the personnel and financial resources required.

SteP 3

The input from the strategic Command(s) is provided to the Military Committee (i.e. to the Nations) for consideration, usually with an initial assessment by the international Military staff.

SteP 4

The Military representatives provide their response and advice from a national standpoint -28 views need to converge into consensus advice that can be passed to the North Atlantic Council.

SteP 5

NSCM: How does the relationship with the Secretary General and the North Atlantic Council (NAC) work in practice? geNeraL BarteLS: I meet on a regular basis with the Secretary General and I am participating in all meetings of the Council, both formal and informal. When the Council travels, I travel with them and I have the possibility to intervene in the meetings be they formal or informal. I may also be called upon to provide advice on an ad hoc basis. NSCM: What does a typical week look like? geNeraL BarteLS: In a typical week we will have at least one MC meeting, at least one Council meeting, a number of visitors and a number of coordination issues to pick up. I will also attend several coordination meetings with the Secretary General. In addition, we have meetings with partner countries in various contexts. For example, I have regular meetings with ISAF and KFOR participants and meetings within other formats, as part of the Euro-Atlantic Partnership

The final agreed product, plus the initial advice from the strategic Command(s), is then sent to the North Atlantic Council to inform their deliberations, consultations and decisionmaking.

This is a continuous process for every activity, be it an operational plan, a conceptual paper or a policy proposal.

Council, the Mediterranean Dialogue and the Istanbul Cooperation Initiative. We also have special relationships with Georgia, Russia and Ukraine with whom we hold regular military meetings. I travel from time to time as well. Primarily visiting Chiefs of Defence/Staff of Allied countries and partners in their capitals, but also visiting ongoing operations. For example, I was very pleased to go to Djibouti recently to visit the Ukrainian frigate deployed in Operation Ocean Shield, and talk with the Ukrainian Chief of Defence who welcomed me aboard. We worked very hard together in the Alliance to get the ship ready and now it is there and operational. It is the first time that a non-NATO ship participates in our counter-piracy mission and I am very proud of it. It shows the high level of interoperability the Alliance can achieve with its partners.

NSCM: What do you see as the main challenges for NATO in the coming years? geNeraL BarteLS: I would say there are two main challenges. First of all, we have to prepare for whatever happens in the future, which in most cases we will not be able to predict. So we must be ready to face the unpredictable. Another challenge of course is that, in the context of the current economic crisis, we have limited resources available, which we need to use in the most efficient and effective possible way. The Defence budgets of most nations are on the decrease and of course this has an impact.

Les réunions débutent dans les groupes de travail du Comité Militaire (au niveau des officiers traitants) qui décortiquent leurs différences et dégagent une perspective commune. Ce sont les premières étapes menant au consensus. Lorsqu’il est jugé suffisamment développé pour pouvoir être soumis à l’approbation des nations, le document est diffusé selon une procédure dite « de silence », c’est-à-dire qu’à moins d’une rupture du silence, le document est adopté à l’échéance fixée. Il est ensuite avalisé et transmis au Conseil. Une fois approuvé par le Conseil, il devient un véritable document (et non plus une simple proposition). Cette étape franchie, la décision est alors entérinée par les 28 Alliés. C’est là qu’est la grande valeur ajoutée du Comité Militaire : faire en sorte qu’un avis purement militaire devienne un avis politico-militaire. NSCM : Quelles sont vos relations avec le Secrétaire Général et le Conseil de l’Atlantique Nord ? geNeraL BarteLS : Je rencontre régulièrement le Secrétaire Général et je participe à toutes les réunions du Conseil, tant formelles qu’informelles. Lorsque le Conseil se déplace, je l’accompagne et j’ai la possibilité d’intervenir durant les réunions, qu’elles soient là aussi formelles ou informelles. Je peux aussi être sollicité pour donner un avis au cas par cas. NSCM : De quoi sont faites vos semaines ?

geNeraL BarteLS : En temps normal, mes semaines sont rythmées par, au minimum, une réunion du Comité Militaire et une réunion du Conseil, ainsi que par plusieurs entrevues avec des visiteurs et diverses questions de coordination. Je participe également à plusieurs réunions de coordination avec le Secrétaire Général.

De plus, je rencontre les partenaires dans différents contextes. Je participe ainsi régulièrement à des réunions rassemblant les pays participant à la Force Internationale d’Assistance à la Sécurité (FIAS) ou à la Force pour le Kosovo (KFOR), ou s’inscrivant dans le cadre du Conseil de partenariat euro-atlantique, du Dialogue méditerranéen ou de l’Initiative de Coopération d’Istanbul. Nous entretenons également des relations spéciales avec la Géorgie, la Russie et l’Ukraine, que nous rencontrons régulièrement. Il m’arrive aussi de voyager, principalement pour rencontrer les Chefs d’état-major d’armée des Alliés ou des partenaires dans leur capitale, mais aussi pour me rendre sur le théâtre des opérations en cours. Dernièrement, j’ai ainsi eu le plaisir d’aller à Djibouti pour visiter la frégate ukrainienne déployée dans le cadre de l’Opération Ocean Shield, et de m’entretenir avec le CEMA ukrainien qui m’avait accueilli à bord. Nous nous sommes particulièrement impliqués, au sein de l’Alliance, dans la préparation de ce bâtiment, qui est aujourd’hui sur zone et opérationnel. C’est la première fois qu’un navire d’un pays non OTAN participe à notre mission de lutte contre la piraterie et j’en suis très satisfait. Cela témoigne du haut niveau d’interopérabilité que l’Alliance peut atteindre avec ses partenaires.

geNeraL KNUd BarteLS Chairman of the Nato Military Committee* General Bartels has been serving NATO as Chairman of the NATO Military Committee since January 2012. Prior to this, he served, from 2009 to 2011, as Chief of Defence of Denmark, the highest ranking oﬃcer in the Danish Armed Forces and the principal military adviser to the Danish government.

NSCM : Selon vous, quels grands défis l’OTAN va-t-elle devoir relever ces prochaines années ?

Before assuming command as Chief of Defence, General Bartels served as Denmark’s Military Representative to the NATO Military Committee and the EU Military Committee from 2006 to 2009, and so is no stranger to the task before him.

General Bartels enrolled as a soldier in 1972, and to a large extent soldiering has remained at the core of his career. His rise through the ranks from junior to general oﬃcer is dominated by operational duty at home and in missions, ranging from company to division commander, interrupted only by courses at the Ecole Supérieure de Guerre in Paris and the US Army War College in Carlisle. Furthermore, he has held postings as instructor at both the Army Combat School and the Royal Danish Defence College, including an appointment as Director Army Command and General Staﬀ Course.

geNeraL BarteLS : Je dirais qu’il y en a deux principaux. Premièrement, nous devons nous préparer à toute éventualité, car nous ne savons pas précisément ce qui nous attend. Nous devons donc pouvoir parer à tout imprévu. Deuxièmement, il est évident que compte tenu de la crise économique actuelle, nous disposons de ressources limitées et que nous devons faire en sorte d’utiliser celles-ci avec le plus d’efficience et d’efficacité possible. NSCM : Quel est le rôle du Bureau des affaires juridiques ? Peter OlSON : Officiellement, nous avons pour mandat de donner des avis juridiques sur des dossiers d’actualité au secrétaire général, au Cabinet et au SI, et, dans une moindre mesure, de prodiguer des conseils sur des questions de politique qui, dans l’immédiat ou à plus long terme, risquent d’avoir des implications d’ordre juridique. NSCM : Pouvez-vous, à l’aide de quelques exemples, nous expliquer en quoi consiste votre travail concrètement, et quels sont les problèmes auxquels vous devez faire face ? Peter OlSON : Nous nous occupons, par exemple, des aspects juridiques de la mission de l’OTAN prévue pour l’après-2014 en Afghanistan. Nous sommes aussi chargés des questions d’immunité de juridiction, pour lesquelles nous avons un rôle général de conseil et de coordination à l’échelle de l’OTAN tout entière. Nous sommes également très impliqués dans des dossiers relatifs aux ressources humaines, en raison des nombreux problèmes juridiques soulevés par les réformes en cours. Outre sa fonction de conseil, le Bureau a pour autre tâche principale de défendre devant notre tribunal administratif interne les décisions prises par la hiérarchie dans des affaires concernant des membres du personnel international. Ce nouveau tribunal a été mis sur pied pour remplacer celui qui était en place depuis près de 50 ans, et nous avons largement contribué à le porter sur les fonts baptismaux. Le sous-effectif est sans doute le principal défi auquel nous sommes confrontés. Nous sommes une petite équipe de six personnes au total – ce qui est peu, comparé à la taille de l’Organisation. Par conséquent, nous devons en permanence faire le tri parmi toutes les questions, pour retenir celles qu’il convient de traiter en priorité.

NSCM : Quels sont vos liens avec les autres bureaux juridiques de l’OTAN ?

NSCM: What is the role of OLA? Peter OlSON: Formally, our mandate is to give legal advice on current matters of interest to the Secretary General, the Private Office and the International Staff (IS) and, to a lesser extent, advice on upcoming policy issues – breaking issues or matters that are going to be coming up in the future that have legal implications. NSCM: Could you give some examples of what your work entails in practice and what kinds of challenges you face? Peter OlSON: We are involved in the legal aspects of the anticipated post-2014 NATO mission in Afghanistan. Another example is judicial immunities, where we play a general advisory and coordinating role within NATO as a whole. We are heavily involved in HR issues, as the ongoing reform efforts raise any number of legal questions. In addition to providing advice on such matters, a principal function of the OLA is to defend management decisions made in cases involving international staff in our internal administrative tribunal. A new tribunal has recently been set up to replace the one that had been in place for the past 50 years or so, and we played a large role in shepherding that tribunal into existence. Understaffing is probably the biggest challenge we face. We have a very small staff for the size of the Organization – around 6 people in all - so it’s a constant ‘triage’ to decide what we need to deal with as a priority. I would also say that there is a difference in the way we work in comparison to many other international and national organizations, including our col-

Peter OlSON : Je ne suis pas conseiller juridique pour l’ensemble de l’Organisation et je n’ai pas de lien hiérarchique avec mes confrères de l’OTAN, qui sont environ une centaine. La plupart d’entre eux travaillent du côté militaire, mais d’autres encore sont présents dans les agences. Mon bureau ne gère pas toutes les affaires juridiques de l’Organisation, mais seulement celles qui concernent le SI. Et mon rôle n’est pas de définir la politique des autres bureaux ou conseillers juridiques. Par contre, notre bureau est celui qui fait autorité et qui est le plus proche du processus de prise de décision au siège de l’OTAN. Dans de nombreuses sphères, les autres bureaux juridiques nous sollicitent pour des tâches de coordination ou pour l’interprétation de directives politiques. De notre côté, nous essayons évidemment de garder à l’esprit que les avis que nous rendons ont des répercussions dans toutes les composantes de l’Organisation et nous veillons donc à ne pas perdre de vue leurs intérêts. Depuis quelque temps, nous organisons des conférences annuelles à l’intention de tous les conseillers juridiques de l’OTAN – tant militaires que civils – et de leurs homologues nationaux qui travaillent sur des dossiers otaniens, afin de discuter de questions d’intérêt commun. Ces conférences d’une semaine sont traditionnellement organisées par les deux commandements, mais elles sont néanmoins l’occasion pour l’ensemble de la communauté des experts juridiques de se réunir et de partager des perspectives et des préoccupations mutuelles. Le monde des juristes de l’OTAN est suffisamment petit pour que nous nous connaissions tous. Nous avons le sentiment de former une communauté sui generis, ce qui, je crois, est inhabituel voire sans équivalent dans le reste de l’Organisation. Et ces conférences annuelles sont très importantes pour donner force à cette cohésion. L’an dernier, nous étions 150 participants, issus de l’OTAN pour la moitié d’entre nous et d’administrations nationales ou d’autres organisations internationales pour le reste. leagues on the military side of NATO. In such bodies there is usually clear policy direction which it is the bureaucracy’s job to implement. On the NATO policy side, however, a large part of the work is involved in divining the views and wishes of Nations and attempting to identify and create consensus among 28 nations. Working in those two environments can be quite different.

Peter OlSON: I am not the Legal Adviser for the whole of NATO, and have no hierarchical relationship with the other 100 or so legal professionals throughout the Organization. Most of these are on the military side, but there are also others in the other Agencies. This office does not handle ALL the legal work for the organisation, just the IS part of it. I can’t tell any other legal office or officer what their policy is or should be. On the other hand, ours is the “senior” legal office in NATO, as well as the one closest to the policymaking process at Headquarters, and in many spheres the other legal offices look to us to provide a coordinating function, to interpret the political guidance for them. On our side, of course, we are well aware that our advice often has implications throughout NATO, and to keep the interests of other NATO elements in mind as we provide that advice. In recent years we have also held a regular annual legal conference for all NATO lawyers, military and non-military, and even national lawyers involved with NATO, just to talk for a week about issues of common interest. This conference has historically been organized by the two commands, but is a very important opportunity for the entire NATO legal community to come together and share common interests and perspectives. The legal community in NATO is small enough for us all to know each other. We have a sense of ourselves as a discrete community, which I believe is unusual if not unparalleled elsewhere in NATO, and this annual conference is very important for building that. We were 150 last year, a little over half from NATO and the others from national governments and other international organizations. NSCM: As one example of the type of work you do, could you tell us how you have been involved in Libya? Peter OlSON: Although there are some current issues, our principal involvement was during Operation Unified Protector -- the Libyan air campaign and maritime embargo carried out in 2011. During the campaign, we provided advice and guidance in particular with respect to the interface between the UN Security Council and subsequent NAC mandates for military action. The Allies decided to implement the UN mandate jointly, through NATO, rather than individually. This led to the adoption of the NAC ‘Operation Unified Protector’ mandate, which was not identical to the UN mandate. We had a role to ensure consistency between the two. Towards the end and after the operation, an International Commission of Inquiry on Libya was set up by the Human Rights Council in Geneva. Originally this was to look into the misdeeds of the Gadhafi regime, but it was expanded to include all parties active in Libya including NATO. A number of questions were raised about the military campaign, many implicitly questioning the lawfulness of NATO actions. We spent a tremendous amount of time developing detailed legal and factual responses to these questions

NSCM: How do you and your office relate to the other legal offices within NATO?

Notre rôle a été de garantir la cohérence entre les deux. Alors que l’opération touchait à sa fin, une commission d’enquête internationale sur la Libye a été mise en place par le Conseil des droits de l’homme à Genève. Initialement constituée pour se pencher sur les exactions commises sous le régime de Kadhafi, cette commission a vu son champ d’action s’élargir à tous les acteurs présents en Libye, y compris l’OTAN. Un certain nombre de questions ont été posées au sujet de la campagne militaire, dont beaucoup mettaient en cause la légalité des actions de l’OTAN. Nous avons passé énormément de temps à élaborer des réponses juridiques et factuelles circonstanciées, qui ont permis de faire taire une fois pour toutes les interrogations. La campagne de Libye est l’une des plus « propres » jamais menées, les dommages causés aux populations et aux infrastructures civiles ayant été réduits au minimum. Je pense sincèrement qu’il n’aurait pas été possible de conduire cette opération d’une meilleure façon. Il était par conséquent important que nous récusions toute allégation du contraire. Le Bureau s’est chargé de le faire au nom de l’Organisation, des Alliés et des pays partenaires ayant participé à la campagne. Et je dois dire que la défense de cette cause a été très gratifiante sur le plan professionnel et qu’elle illustre parfaitement la façon dont le droit – et, grâce à lui, le Bureau – peut servir et faire triompher les valeurs et les intérêts de l’Alliance.

NSCM : L’OTAN, comme la plupart des organisations internationales, bénéficie d’un certain nombre de « privilèges et immunités ». Pourriez-vous nous expliquer ce que cela signifie, et quelles en sont les implications dans la pratique ?

which firmly and successfully dismissed the challenge. This was one of the “cleanest” military campaigns ever in terms of minimizing harm to civilians and civilian facilities -- I truly think it could not have been better conducted -- and it was therefore important that we push back against any attempt to suggest otherwise. Our office took a lead in this on behalf of the Organization and the Allied and partner nations involved in the campagin, and I will say that conducting this defense was both professionally very satisfying and a shining example of the ways in which the law, and the Legal Office, can defend and uphold Alliance values and interests.

Peter OlSON : Sur le papier, l’OTAN jouit d’immenses privilèges et immunités. Essentiellement les mêmes que ceux de l’ONU. En substance, la règle veut que les tribunaux des États membres ne peuvent pas exercer leur juridiction sur notre Organisation ni rendre de jugement à notre encontre. L’idée était de protéger notre capacité – et celle des autres organisations internationales – à agir en toute liberté, sans être soumises à des pressions de la part des tribunaux des pays membres.

NSCM: Like most international organizations, NATO benefits from a ‘privileges and immunities’ status. Could you explain what this means and the implications of this status are in practice? Peter OlSON: On paper NATO has terrific privileges and immunities; they are essentially the same as those of the UN. Basically, the rules say that no Allied courts have jurisdiction over us and no Allied courts can give judgement against us. The reason for this is to protect our ability, and that of other international organizations, to act freely without being subject to pressure through the courts of individual state parties.

Cette conception était plus ou moins la norme dans les années 50 et 60, mais les points de vue des juristes et des politiciens à l’égard des privilèges et des immunités sont en train de changer. Ces dernières années, nous avons assisté à la mise en place d’institutions judiciaires supranationales qui n’existaient pas lorsque ces immunités nous ont été accordées. De nos jours, et notamment en Europe, l’opinion s’attend à ce que tout litige soit porté devant la justice pour qu’elle dise le droit. Au regard du droit international, il s’agit là d’un développement relativement nouveau, qui ne fait absolument pas l’unanimité au sein de la communauté internationale. Ainsi, et notamment dans des affaires concernant des membres du personnel, nous retrouvons-nous souvent cités devant des tribunaux nationaux où l’on nous reproche de n’avoir pas respecté la Convention européenne des droits de l’homme. Nous pouvons, bien sûr, arguer que nous n’avons pas signé cette convention, mais j’ai bien peur que le problème soit loin d’être résolu…

This was pretty standard stuff back in the 1950s and 1960s, but legal and political perspectives towards privileges and immunities are changing. In recent years, we have seen the establishment of supranational judicial institutions of a sort that did not exist back when our immunities were being established. Today, particularly in Europe, there is an expectation that there should be judicial oversight and resolution of any legal dispute. This is, in terms of international law, a relatively new development and one that is by no means accepted throughout the international community. So we find ourselves quite frequently, in staff cases for instance, being challenged in national courts on the basis that what we have done is not consistent with the EU Convention on Human Rights. We can, of course, argue that we are not a party to this Convention, but I expect that this is going to be a continuing challenge for us.

NSCM : Quel est le droit qui s’applique à l’OTAN ? L’Organisation a-t-elle ses propres lois et tribunaux ? Peter OlSON : Officiellement, très peu de lois s’appliquent à l’OTAN – mais cela ne signifie pas que nous sommes une « zone de non-droit ». NSCM: Which laws apply to NATO? Does NATO have it own laws and its own courts? Peter OlSON: Formally, very little law applies to us -- but we are by no means a “law-free zone.” We are bound by our own treaties -- the North Atlantic or Washington Treaty, the Ottawa Agreement, the Paris Protocol and so on -- and effectively by the UN Charter as well. NAC decisions create internal law that is binding on us. But Host nation law does not apply to us – at least not directly or most of the time. On a practical level we do base ourselves on Belgian law for certain things, such as health and safety, because we need standards and NATO cannot develop its own rules in every area. With regard to criminal matters, the Secretary General can waive our immunities. Our premises are inviolable, so the host nation cannot enter the premises without permission. If that permission is granted, however, then in certain circumstances they may be able to apply their own laws on NATO premises. We have international legal personality –actually, three of them. The civilian side has legal personality under the Ottawa Agreement. The Paris Protocol extends legal personality separately to the military side, and SHAPE and Norfolk have separate legal personalities. Interestingly, under the Paris Protocol, the military ARE subject to the jurisdiction of host nation courts, which means that they can be sued and judgments can be entered against them. They are immune from execution, but I imagine that it would be an unusual case in which they would refuse to implement a valid court judgment against them. NSCM: You have been at NATO almost four years now. Do you have any reflections on what has been different about being NATO Legal Adviser as compared to your previous work at national level? Peter OlSON: People in this Organization come from very diverse bureaucratic cultures with differing attitudes to law and lawyers; finding and establishing our proper role in this context is much more difficult than when dealing with a single known bureaucratic culture. This is not always a problem, however: my own national bureaucratic culture is one that tends to overlawyer matters, and I have quite honestly found it a relief at times to spend a quarter of the time on a matter and get it 98% right – more than enough for relevant purposes - rather than working it absolutely to death. Still, it is a continuing challenge to ensure that policymakers throughout the house realize when they have a legal issue, and appreciate that our involvement will generally help them achieve their goals by identifying and addressing issues early rather than down the line when addressing them may be much more difficult. There is also a high turnover of staff, which means that relatively few NATO staff members have deep knowledge of the organization; it also means that some people’s fundamental point of reference is not NATO but the home systems to which they expect soon to return. Overall, I have to say it has been a terrific professional experience. The issues are interesting and highly varied, those working on them are dedicated and knowledgeable, and the process of developing consensus among 28 Allies on matters that are often of absolutely fundamental importance is endlessly fascinating. NSCM : Vous êtes en poste à l’OTAN depuis bientôt quatre ans. Quelle différence y a-t-il, selon vous, entre votre emploi actuel et celui que vous occupiez auparavant au niveau national ? Peter OlSON : Ici à l’OTAN, les gens sont issus de cultures organisationnelles très diverses, et leur regard sur le droit et sur les juristes diffère ; il nous est donc beaucoup plus difficile de définir précisément et d’asseoir notre rôle dans ce contexte que dans une culture unique qui nous serait familière. Mais cela ne constitue pas toujours un problème : je viens d’un pays qui a une tendance à la « surjudiciarisation » et, pour être tout à fait honnête, c’est parfois un soulagement pour moi de passer seulement un quart du temps nécessaire sur une affaire pour obtenir un résultat à 98 % – ce qui est amplement suffisant – plutôt que de m’échiner à vouloir décrocher les 2 % manquants. Cela étant, c’est un défi permanent pour nous de veiller à ce que nos décideurs politiques sachent à quel moment nous solliciter et comprennent bien que, si nous devons les aider à atteindre leurs objectifs, il est préférable que nous soyons saisis des problèmes en amont, car plus le temps passe plus il est difficile de les traiter . Par ailleurs, le taux de rotation du personnel est très élevé, ce qui signifie que relativement peu d’agents ont une connaissance approfondie de l’Organisation et que, pour certains d’entre eux, la référence fondamentale n’est pas l’OTAN mais le système national qu’ils comptent bientôt réintégrer.

Peter OlSON legal adviser to the Secretary general peter Olson is the Director of the office of Legal Affairs and Legal Adviser to the Secretary General & the International Staff of the North Atlantic Treaty Organization, and the senior lawyer in NATO. He is responsible for all legal aspects of NATO headquarters’ institutional, internal and external relationships and operations.

Mr. Olson served over 30 years in the Office of the Legal Adviser of the U.S. Department of State. Following initial assignments in treaty, maritime, environmental and nuclear nonproliferation law, he was in succession the principal legal adviser at the Department of State for inter-American affairs, for ethics and personnel, for arms control and verification, and for European affairs. His core professional focus before arriving at NATO was on European Organizations, notably the European Union and the OSCE, and on Balkans matters.

Flying to Yerevan is the easiest way to access the landlocked country. ujourd’hui, l’Arménie, ce sont des monastères pittoresques, des paysages montagneux, une cuisine exquise et un sens infini de l’hospitalité. En 301 après Jésus-Christ, l’Arménie fut le premier pays au monde à adopter officiellement le christianisme, après que le roi Tiridate III d’Arménie libéra Saint Grégoire (futur Grégoire l’Illuminateur) de la fosse dans laquelle il avait été jeté à Khor Virap, et que Grégoire guérit le roi. Aujourd’hui, le monastère de Khor Virap est l’un des sites de pélerinage les plus visités du pays. On peut encore descendre dans la fosse dans laquelle Grégoire fut emprisonné pendant 13 ans.

Make your way to the ancient monastery Khor Virap, located just 40 km south of Yerevan, not only for an incredible view but similarly for an introduction to the early Christian life. In 301 AD, Armenia was the first country in the world to officially adopt Christianity, after King Tiridates III of Armenia freed St. Gregory (later “the Illuminator”) from his pit at Khor Virap, upon which Gregory cured the king’s disease. N’hésitez pas à grimper l’étroit escalier qui mène au niveau supérieur de la petite église pour la traditionnelle photo. Outre les innombrables vieilles églises que l’on trouve même dans les endroits les plus reculés d’Arménie, les khachkars, stèles de pierre ornées de croix sculptées à la main, sont une autre expression de l’identité chrétienne du pays. Symboles d’une tradition arménienne hautement appréciée, les khachkars font aujourd’hui encore partie de la culture du pays. Bien entendu, l’Arménie possède également un héritage non chrétien bien préservé, comme le temple païen de Garni ou encore la mosquée bleue d’Erevan, datant du 18e siècle.

In winter, some of the lake’s surrounding villages transform into ski resorts, offering fun for all ages, and at a fraction of European costs.

To dive into Armenia’s Christian roots, check out Tatev, a 9th century monastery close to Goris in the southern part of the country. The impressive Vorotan River gorge cut it off the rest of the world for the entire winter season, until in 2010 the world’s longest free hanging cable car (5.7 km) connection was installed, which is logged in the Guiness Book of World Records. As it was so remote, Tatev is one of the best preserved monasteries, offering a stunning view and numerous hiking sites in its proximity. The 13th century monastery Noravank is another must-see, most beautifully located at the end of the Amaghu Valley. Surrounded by brick-red cliffs, the monastery’s churches were constructed out of the same reddish rock, just as its old khachkars (see picture). Climb up the narrow stairs to the upper floor of the small church for a popular photo opportunity. Alongside countless old churches covering even the most remote areas of Armenia, the Christian identity is additionally expressed by khachkars. These stone crosses are carved by hand, a cherished Armenian tradition and still part of today’s culture. And naturally, Armenia offers also well preserved non-Christian heritage, like the old Pagan Garni temple or the 18th century Blue Mosque in Yerevan.

Khoravats, a typical Armenian skewer-grilled barbecue with roasted vegetables topped with fresh herbs, is one of the meals that should not be missed on a visit. Apart from the usual pork, lamb, chicken and beef, the unique crayfish kebabs and barbecued vegetables are highly recommendable. Try it with homemade thin bread, lavash, in which meat, vegetables and cheese can be rolled up. Armenians love enjoying their food outdoors and this traditional barbecue is often prepared under the open sky, especially by riversides or at one of Lake Sevan’s beaches. For dessert or just while having a drink in a café or bar, do not miss the fresh pomegranates and apricots, known in Latin as the Armenian fruit “prunus armeniaca”, and often served dried during the winter months. Alongside their meal, Armenians love jazz and rock music and many restaurants and bars offer highly professional live performances. More traditional places offer Armenian folk with the duduk, an indigenous woodwind instrument. Still, an Armenian meal or concert without a drink is not complete and the country has much to offer when it comes to liquor. Armenian wine has been exported since Bible times, but today, it is mainly cognac-style brandy that visitors and locals are after. Triumphant over Yerevan in vibrant orange-red brick stands the Yerevan Brandy Company, with a distillery that has been producing wine and the famous Ararat brandy since 1887, and was bought in 1998 by the French international company Pernod-Ricard. The combination of fresh spring mountain water and the warm and dry climate make for a delicious brew, a fact that even Winston Churchill noticed when he claimed that one should always “drink Armenian cognac.”

he latest land registry data made public by the Department of Finance speaks for itself. Over half of houses (53%) are more than 52 years old, whilst more than half of all buildings and apartment blocks (52%) are aged over 43. “It is becoming very difficult these days to buy an existing property without counting on having to do some renovation work. Especially when we know that a house which is over 20 years old will need almost everything redoing,” explains Gery Dohmen, managing director of Illico travaux. This no doubt explains the following: 75% of buyers carry out renovation works in the year following their purchase!

Nowadays, any prospective buyer will consider the question of renovation. They will ask themselves about the advantages of undertaking work to reduce their energy bill. “They also ask themselves about the cost involved.

Ten years ago, when buying, the prospective buyer would take a strong interest in the interior design, the state of the windows and of the roof. Today, mentalities have changed. “We are all sensitive to energy issues, we are better informed and, particularly, we have become more demanding,” continues the building contractor.

Ceci explique sans doute cela : 75 % des acheteurs effectuent des travaux de rénovation dans l’année qui suit l’achat !

€ 700 à € 1.000/m² Il y a encore dix ans, lors de l’achat, l’acquéreur s’attachait au décor, à l’état des châssis et de la toiture. Aujourd’hui, les mentalités ont évolué. « Nous sommes tous sensibilisés aux problèmes énergétiques, nous sommes mieux informés et surtout nous sommes devenus plus exigeants », poursuit le courtier en travaux. De nos jours, à peu près tout candidat à l’achat se pose la question de la rénovation. Il s’interroge sur l’opportunité d’effectuer des travaux en vue de diminuer sa facture énergétique. « Il s’interroge également sur le coût de ceux-ci. Le prix d’une rénovation est très difficile à objectiver », convient Gery Dohmen. D’où l’intérêt de s’adjoindre l’aide d’un professionnel pour se faire rapidement une idée des travaux à envisager et de l’enveloppe à prévoir. « Grosso modo, pour une rénovation en profondeur, il faut compter entre € 700 et € 1.000/m² », estime l’expert.

LES piègES à éviTER Autre souci : planifier efficacement et intelligemment les travaux. « L’acheteur qui investit dans une maison des années 80 voit bien qu’il va falloir refaire la décoration. Il se doute que la toiture n’est pas isolée et que sa chaudière n’est pas performante. Mais, finalement, il ne sait pas très bien par où commencer et où placer les priorités. » Quelques règles de base permettent de s’éviter bien des soucis. Ainsi, avant de faire quoi que ce soit, il est indispensable de régler les éventuels problèmes d’humidité. Si l’on souhaite mettre sa maison en conformité avec les normes énergétiques d’aujourd’hui, on investira dans la toiture et on s’assurera ainsi d’une isolation efficace. « Dans bon nombre de cas, il s’agit d’enlever la couverture du toit et de réaliser une bonne isolation… suffisamment efficace pour obtenir des primes », détaille Gery Dohmen. Ce poste est coûteux, « mais il est possible

Hence the interest in soliciting the aid of a professional to quickly estimate the work needed and the budget to be set aside for it. “In general, for an in-depth renovation, you should count between €700 and €1000 per m2,” the expert tells us.

TRApS To Avoid Another concern: planning the works efficiently and intelligently. “A buyer investing in a house from the 80s will see that they will need to redo the decoration. They will suspect that the roof will not be insulated and that the boiler will not be very efficient. But, at the end of the day, they will not really know where to start and how to prioritise.” There are some basic rules which can help avoid many problems. For instance, before doing anything else, it is necessary to tackle any possible humidity problems. If you want to bring your house into line with today’s energy norms, you will have to invest in the roof and ensure that there is effective insulation. “In many cases, you will need to remove the roofing cover and put in a good insulation… effective enough to qualify for the grants available,” explains Gery Dohmen. This budget heading is costly, “but it is possible to recoup almost 100% of the investment. I usually advise a renovation in two stages, so as to ensure optimal tax advantages.” Next, the windows will need to be changed. Then you will want to think about replacing the oil tank with a heat pump connected to solar panels and an electric water heater for a little extra help. Not forgetting electrical compliance testing, which, thankfully, is not an expensive element. Then comes the loft conversion and redecorating, including the installation of a modern bathroom and kitchen.

pREcioUS SUppoRT Renovation is synonymous with the unknown… and with an administrative and technical obstacle course. Building works frighten home owners concede the estate agents. Those undertaking renovation works are, moreover, increasingly seeking help in this important project. In addition, certain ‘turnkey’ building contractors are becoming active on the renovation market. They offer a tailor-made service and propose the coordination of the building works from A to Z. “The help of a renovation ‘broker’ is increasingly valued,” notes Gery Dohmen, active in this profession. The brokers support and advise the client both on an administrative level (building permit, environmental permit, grants) and with the tasks of requesting estimates, choosing contractors, selecting materials, overseeing the site, or controlling the budget – a service which is increasingly appreciated. “Overheads that get out of hand is one of the owner’s greatest fears when undertaking a renovation. That is why it is important to plan everything in advance and leave nothing to chance. The key word ? Look ahead… in order to avoid any unpleasant surprises.

Un AccompAgnEmEnT pRéciEUx La rénovation est souvent synonyme d’inconnu… et de parcours du combattant tant sur le plan administratif que technique. Les travaux font peur aux propriétaires, s’accordent à dire les agents immobiliers. Les candidats à la rénovation sont d’ailleurs de plus en plus nombreux à se faire accompagner dans cet important projet. Aussi, certaines entreprises de construction « clé sur porte » commencent à se lancer sur le marché de la rénovation. Elles offrent un service sur mesure et proposent la coordination du chantier de A à Z. « L’aide du courtier en travaux est par ailleurs de plus en plus prisée », constate Gery Dohmen, actif dans la profession. Les courtiers accompagnent et conseillent le client tant sur le plan administratif (permis d’urbanisme et d’environnement, primes) que dans l’obtention des devis, le choix des entrepreneurs, des matériaux, le suivi du chantier ou encore le contrôle budgétaire, un service qui est de plus en plus apprécié. « Les suppléments non maîtrisés sont effectivement l’une des plus grandes craintes du propriétaire qui entreprend un chantier de rénovation. C’est pourquoi il est important de bien tout prévoir et de ne rien laisser au hasard ». Le maître-mot ? Anticiper… afin de s’éviter de mauvaises surprises.

La mesure est déjà en vigueur depuis le 1er septembre pour les nouveaux arrivants. Elle s’appliquera à partir du 1er janvier 2014 pour ceux qui sont déjà en place. Mais pas à tout le monde. Les diplomates de l’Espace économique européen (les « 28 » plus la Norvège, l’Islande et le Liechtenstein) bénéficient d’une couverture automatique en Belgique. Cela ne changera pas à l’avenir. Par contre, pour tous les autres pays - tous ceux qui ont une carte d’identité émise par la direction du protocole des Affaires étrangères -, elle s’applique. Mais certains pays ont déjà fait le choix d’une couverture via des assurances privées et ne sont donc pas non plus concernés.

3.000 personnes « Cette mesure concernera environ 3.000 personnes », calcule Christian Horemans, expert en affaires internationales pour l’Union nationale des Mutualités Libres. Et parmi les délégations, ce sont essentiellement des pays d’Afrique, d’Amérique du Sud et d’Europe de l’Est (hors Union européenne) qui sont touchés. Parfois de manière importante puisque certains ont des missions non seulement auprès de la Belgique mais aussi auprès d’institutions internationales basées en Belgique (OtAN, UE, SHAPE, etc.). « Selon nos calculs, l’économie pour la sécurité sociale belge sera environ de 11 millions d’euros par an », précise Christian Horemans. Ce qui n’est évidemment pas négligeable par les temps qui courent. Selon certains observateurs, la mesure était dans l’air depuis un certain temps. Mais le gouvernement aurait en tout cas préféré attendre la décision de l’OtAN de

he many diplomatic missions in Belgium are in shock. In the middle of August, they received a letter from the Federal Foreign Affairs administration which came as something of a surprise. Indeed, the letter explains that, within the context of budgetary restrictions, a part of the diplomatic corps, including Embassy staff, will no longer be able to voluntarily subscribe to the Belgian health care system through the mutual insurance scheme. to be clear, they will now need to take out a private health insurance in order to access health care in this country. This measure is already in effect since the 1 September for newcomers. It will apply to those already established here from 1 January 2014. But not to everyone. Diplomats within the European Economic Area (the ‘28’ plus Norway, Iceland and Liechtenstein) have automatic cover in Belgium. This will not change in the future. On the other hand, for all other countries – all those that have an identity card issued by the protocol department of the Ministry for Foreign Affairs – the new rules will apply. Certain countries have already opted for cover through private insurances and are therefore no longer concerned.

3,000 people affected “This measure will affect around 3,000 people,” calculated Christian Horemans, international affairs expert for the National Union of Free Mutalities. And amongst the delegations, it is primarily the African, South American and East European (non EU) countries that are affected. Sometimes quite considerably as some of them have missions both for Belgium and for the international institututions based in Belgium (NAtO, SHAPE, EU, etc.). “According to our calculations, the saving for Belgian social security will be around €11 million per year,” clarifies Christian Horemans. Not a negligeable amount these days. According to certain observers, the measure was being considered for some time. But the government wanted to wait for NAtO’s decision to maintain its Headquarters in Belgium before taking a decision. Apart from the financial saving, it is also said to be motivated by abusive use of the system – particularly with regard to dental care – given the generosity of our social security. And by the fact that someone who has only been contributing for a couple of years, but who has full access to Belgian healthcare (surgery, childbirth,…) is a heavy burden on the system. Nowadays we cannot afford to be as generous, explains the Foreign Affairs office. All the more so because there is no reciprocity for our own diplomats.

Mais pour s’assurer via une assurance privée, il faudra désormais compter environ 1.500 euros par employé. Pour Valery Safarian, directeur commercial chez le courtier Concordia, spécialisé dans les missions diplomatiques, « la situation entraîne des risques. Notamment, comme le délai est court, qu’on voie se développer des nouvelles offres d’assurances, peut-être bon marché, mais pas adaptées à la situation des missions diplomatiques. »

Rendez-vous GaRe maRitime C’est un événement à noter sans faute dans vos agendas, un week-end par an, l’Ancienne Gare maritime de Tour & Taxis à Laeken accueille l’une des plus grandes braderies design d’Europe dédiée au mobilier des années 50, 60, 70 et début 80. On y trouve de belles pièces, mais n’espérez pas trop y dégoter un fauteuil Charles et Ray Eames ou des chaises Panton vendus au quart de leur valeur par un vendeur non averti… Une preview payante est organisée le samedi après-midi pour les marchands, les collectionneurs et amateurs éclairés. The ‘Ravik redesign’ area also proposes unique creations, or limited edition pieces, made by designers from all over Belgium. Jaloa At the far end of the Place Sainte-Catherine, on the Quai aux Barques, nestles one of the last vestiges of the Convent de la Sainte-Croix. In an old xvth century building you will find the very gourmet Jaloa. The restaurant has made the most of the architecture of the original site by combining it with a decidedly contemporary decor for an atmosphere that is at once elegant and cosy, and which invites intimacy. In this ‘boudoir’, the chef, Gaetan Colin, proposes a gourment cuisine with a Belgo-French flavour. No need to browse a banal menu. Here, the dishes change according to what’s fresh at the market. The menus are served to suit the appetite or wishes of the diners, in four, six or nine courses devoted to culinary surprises and discovery. The key concepts chef Gaetan Colin ? Authentic produce and inventive culinary combinations. It should be mentioned that he has been awared a Michelin star and a score of 16/20 by Gault et Millau in 2011.

Tout au bout de la place Sainte-Catherine, sur le quai aux Barques, se niche un des derniers vestiges de couvent de la Sainte-Croix. C’est dans vieille bâtisse du xve siècle que se trouve le très gastronomique Jaloa. Le restaurant a su tirer profit de l’architecture du site d’origine en la mariant avec un décor résolument contemporain pour une atmosphère élégante et intimiste, qui invite au tête-à-tête. Ici, les plats évoluent selon les arrivages du marché. Les menus se déclinent selon l’appétit ou les désirs des gourmets en quatre, six ou neuf services dévolus à la surprise culinaire et à la découverte. Les maîtres-mots du chef Gaëtan Colin ? Un écrin romantico-chic niché au milieu de la chaussée d’Alsemberg, à Uccle, et une cuisine française sans fausse note orchestrée par Paulo Bothelo : voilà ce que propose le restaurant Les 2 Frères. Le soir, une ambiance tamisée, bourrée de charme, de chaleur et de séduction invite à un tendre tête-à-tête. Les bougies et objets chinés confèrent au lieu une atmosphère vraiment cosy. En entrée, on craque pour le Carpaccio de bœuf aux copeaux de foie gras (€ 16), les Raviolis de chèvre chaud aux herbes potagères (€ 13) ou encore la Variété de gourmandises en salade spéciale « 2 Frères » (€ 20), qui marie croquette aux crevettes, foie gras, carpaccio de bœuf… En plat, le Filet pur du Charolais grillé nature, beurre maître d’hôtel avec sauce au choix (€ 27) ou le Cabillaud rôti à la sauce miel et moutarde, purée de poireaux à l’estragon (€ 24) valent le détour. diNNer at home it comes less frequently to mind, but for a gourment moment with your other half it is not always necessary to go out to a restaurant. a good idea : cook at home, choosing ingredients known for their arousing virtues and season it all with love and a pinch of seduction. here are two recipes from the book ‘diners romantiques’ by thomas Feller (éd. First).

A chic-romantic setting on the Chaussée d’Alsemberg, in Uccle, and a faultless French cuisine orchestrated by Paulo Bothelo : this is what is on offer at the restaurant Les 2 Frères. By evening, the sultry atmosphere, packed with charm, warmth and seduction is perfect for a dinner for two. The candles and eclectic objects give the place a really cosy feel. For starters, we fell for the Beef carpaccio with foie gras shavings (€16), the hot goat’s cheese raviolis with garden herbs (€13) or the Gourmet selection in a ‘2 Frères’ special salad (€20) which combines shrimp croquette, foie gras, beef carpaccio… As a main course, the pure grilled filet of Charolais beef, with maître d’hôtel butter and choice of sauce (€27) or the roast cod with honey and mustard sauce and leek and tarragon mash (€24) are worth trying. The establishment also proposes a surprise menu which consists of four courses prepared depending on what’s fresh from the market and the chef’s imagination (€55).

Seabream tartare with mango Ingredients for two : 150g of ﬁlet of sea bream, skinned and boned - 1/2 peeled tomatoe - 1/2 chopped shallot - 1/4 ripe mango - 1/2 squeez of lime - 1 vanilla pod - 4 tbsp. olive oil - 6 sprigs of coriander, chopped - salt - pepper cut the bream into smal cubes. do the same to the mango and the tomatoe after removing the seeds. cut the vanilla pod in two lengthways and scratch out the inside to remove the seeds. in a bowl, mix the lime, vanilla, oil, salt and pepper. in a small salad bowl, combine the sea bream, tomatoe, shallots and mango. Serve your tartare on the plates and pour over the sauce. Sprinkle with coriander before serving. Citrus Passion with Tarragon Ingredients for two : 3 oranges - 2 sprigs of fresh tarragon - 1 passion fruit 4 tbsp. olive oil - salt - pepper With the help of a knife, cut off the round ends of the orange, then peel closely : take the skin off without leaving any trace of white then detach the segments. cut the passion fruit in two. With a spoon, grate out the inside to remove the juice and the seeds. Put them in a bowl with the oil, salt and pepper. take the leaves off the tarragon and chop. divide the orange segments onto two plates, pour over the vinaigrette and sprinkle with tarragon.

In an old house just a stone’s throw from the Grand Place, the Sablon and the Marolles, Bleu de toi has clearly been playing the card or seduction and romanticism since 1992. Its name alone tells a story in itself… As you may expect, special efforts are made for Valentine’s Day. And a menu is concocted especially for lovers, with a variety of aphrodisiac spices. For example, this is what was proposed last year (€70) : glass of champagne flavoured with melon vodka, accompanied by latino-inspired appetizers, carpaccio of tuna with mild and aphrodisiac peppers and a crispy salad of Japanese mix shiso, crayfish ravioli with ginger and coconut sauce, green apple sorbet and Manzana liqueur, organic Bintje potatoe stuffed with Canadian lobster (half lobster) and it crustacean flavoured butter sauce, fresh herbs and colourful Mesclun salad, Saint Valentine’s heart, fresh fruit and passion fruit coulis, home-made petit-fours with either coffee or jasmin tea.

bluE CHoColatE On the charming Place St Job, here is a spot that, with its exposed brick, dark tones and low lighting, spontaneously invites romanticism. On the food side, Blue Chocolate has effectively reinvented itself since the arrival of chef Patrick De Hertogh in August last year. Gone are the the minimalist portions, the not-always-successful fusion dishes…the chef proposes a generous cuisine that respects the authentic flavour of fresh produce, with a menu that changes with the seasons. Worth a mention are the crispy garden snail ‘bonbons’ with snail butter and a hint of sweet garlic (€15) and, as a main course, the rack of lamb with goat’s cheese, olive-stuffed apple, creamy chive brown gravy, seasonal vegetables (€22). And for Valentine’s Day, a menu at €50 : glass of Piollot Brut champagne ; duo of tuna and wild salmon tartare, garden herbs ; warm scallop cake with shrimps ; braised veal medaillion, savoury brown gravy and seasonal vegetables ; and sugared pear with iced champagne sabayon. SMOKED FLOUNDER KUPINATA BUTE

PREPARATION TIME: UP TO 8 HOURS SERVES ONE FISH PER PERSON

INGREDIENTS

Fresh flounder. Traditional Latvian smoked flounder is smoked using alder wood. If used in combination with apple tree, smoked fish will have a darker color and sweeter taste. And you will need a lot of patience as the process can take up to 8 hours. You can also use barbecue if you do not have a smoker. The actual smoking time on a barbecue will be shorter that in a smoker.

PREPARATION 1. Prepare your fish for smoking: clean it, cut the head off and rinse thoroughly several times under running water. Then leave it to dry for a few hours. 2. Once the fish is dry, hang it by the tail in the smoker or place it on the barbecue grill. Smoking is done at around 50-60°C, but should not exceed 70°C. For the first hour the fish should be smoked with the doors of the smoker open (or lid off, if barbecue used). During this time, the fish builds a protective coat that will keep the fat in. 3. You can close your smoker when the fish has obtained a golden color and its tail is dry. From this moment the fish should be smoked for three to four hours, depending on your smoker. 4. To finish the smoking process, slightly salt the fish while it is still warm and leave it to cool for several hours. 5. Traditional Latvian smoked flounder is best enjoyed cold with a bottle of cold Latvian beer. Smoking fish at home is popular for families living along the 500 km of Latvia’s coastline.

PRÉPARATION 1. Préparez le poisson pour le fumage : nettoyez le poisson, enlevez la tête et rincez-le plusieurs fois sous l’eau courante puis laissez-le sécher durant plusieurs heures. 2. Dès que le poisson est sec, pendez-le par la queue dans le fumoir (ou placez-le sur la grille du barbecue). Le fumage s’effectue autour de 50-60 °C, mais sans dépasser 70°C. Durant la première heure du fumage, la porte du fumoir (ou le couvercle du barbecue) doit rester ouverte. Cette première période de cuisson donne au poisson une croûte dure qui permettra de retenir graisses et sucs. 3. Lorsque le poisson présente une belle couleur dorée et que la queue est sèche, fermez le fumoir (ou le couvercle du barbecue) et laissez ensuite encore fumer pendant trois ou quatre heures. 4. Pour terminer le processus de fumage, salez légèrement le poisson quand il est encore chaud puis laissez refroidir avant de consommer. 5. Ce flet fumé traditionnel se déguste avec un verre de bière blonde bien fraîche. Fumer le poisson chez soi est une coutume traditionnelle importante et populaire pour les familles qui vivent le long des 500 km de littoral de la Lettonie.

INGREDIENTS

300 g dry rye bread

100 g sugar 50 g butter 300 g cranberries 200 g cream Cinnamon Vanilla essence

PREPARATION 1. Melt the butter in a pan. Add the finely grated dry rye bread and half of the sugar (50 g), sprinkle with cinnamon and mix well. Remove the pan from the heat and let the mixture cool. 2. Beat the cream with 30 g of sugar and vanilla essence. In a separate bowl, mix the cranberries with 20 g of sugar.

PRÉPARATION 1. Dans une casserole, faites fondre le beurre. Ajoutez-y la mie de pain de seigle sec finement râpée, la moitié du sucre (50 g), saupoudrez de cannelle et mélangez bien le tout. Ensuite sortez la casserole du feu et laissez refroidir le mélange. 2. Battez la crème fraîche avec 30 g de sucre et un peu de sucre vanillé. Dans un bol séparé, mixez les cranberries avec 20 g de sucre. 3. Dans 4 petites verrines, alternez successivement une couche du mélange de pain de seigle, une couche de cranberries, une couche de crème fraîche et répétez. Terminez avec la crème fraîche battue et garnissez avec quelques miettes de pain de seigle sec et quelques cranberries.

orthopedic practice iS baSed on a Sound knowledge of the anatomy NSCM: What does an orthopedist do? FÉLIx: Orthopedics is an area of medical specialisation that deals with the locomotive system. That includes the bones, the muscles, the tendons, the ligaments and the joints. Quite frequently patients think that the orthopedist just takes care of feet, but the word orthopedy comes from the Greek: orthos (straight) and paidon (child), and not from podos (foot). In fact, originally, this discipline consisted of correcting growth defects and childhood deformities. Today, orthopedists are all trained surgeons, with the skills required to manage trauma cases. We are therefore qualified to care for a range of injuries, from torn muscles and ligaments to sprains and fractures. In parallel to trauma injuries, we have what we call ‘cold orthopedics’ which consists of treating muscular and osteoarticular dysfunction, wear and tear or aging of the joints. When a joint is too worn out, it is common to replace it with a prosthesis, but thankfully we have a range of treatments at our disposal to avoid reaching this stage – or at least to slow down the process. In addition, every orthopedist will have their area of expertise, like a sort of sub-specialisation. For example, some are specialised in hip, knee, shoulder, spinal or foot surgery. NSCM: Do you operate on a lot of patients? FÉLIx: People should be reassured; surgeons do not have as their aim to operate at all costs! On the contrary, we often say that a good surgeon is one who knows when NOT to operate. In fact, we always try to favour ‘conservative’ treatment, with medication or orthosis, but also with the help of physiotherapists and osteopaths. Surgery is always a last resort. On average, barely 5% of patients seen in recent years at the NATO Staff Medical Centre have needed an operation. Orthopedic practice is based primarily on a sound knowledge of the anatomy. Careful examination of the patient and carrying out certain relevant clinical tests can allow us to make a diagnosis, but most of the time additional tests (mainly medical imaging) are needed. It is only when we are certain of a diagnosis that an appropriate treatment will be prescribed. And it will rarely be surgical. NSCM: What disorders do you see most often? FÉLIx: Back pain is one of the most frequent reasons to see an orthopedist. In this case, our job is to differentiate muscular pain from more delicate injuries such as a slipped disc. The second most frequent reason for seeing us is knee pain and, in this case, we need to determine if the problem

NSCM: Que fait un orthopédiste ? FÉLIx: L’orthopédie est la spécialité médicale qui traite le système locomoteur, c’est-à-dire les os, les muscles, les tendons, les ligaments et les articulations. Assez fréquemment les patients pensent que l’orthopédiste soigne exclusivement les pieds, mais le mot orthopédie vient du grec : orthos (droit) et paidon (enfant), et non pas de podos (pied). En effet à l’origine, cette discipline consistait principalement à corriger les défauts de la croissance et les difformités infantiles. Aujourd’hui les orthopédistes sont tous chirurgiens de formation, avec les compétences requises pour la prise en charge des cas de traumatologie. Nous sommes donc habilités à soigner diverses blessures comme les déchirures musculaires ou ligamentaires, les entorses et les fractures. Parallèlement à la traumatologie, il y a ce que l’on appelle « l’orthopédie froide » et qui consiste à traiter les dysfonctionnements musculaires et ostéo-articulaires, l’usure ou encore le vieillissement des articulations. Lorsqu’une articulation est trop usée, il est courant de la remplacer par une prothèse, mais heureusement nous avons toute une série de traitements à notre disposition pour éviter d’atteindre ce stade ou du moins ralentir le processus. De plus, chaque orthopédiste aura son domaine d’expertise, comme une sorte de sous-spécialité. Par exemple certains sont spécialisés en chirurgie de la hanche, du genou, de l’épaule, de la colonne, du pied, etc. NSCM: Opérez-vous beaucoup de vos patients ? FÉLIx: Il faut rassurer les gens ; les chirurgiens n’ont pas pour but d’opérer à tout prix ! Au contraire, on dit souvent que le bon chirurgien est celui qui sait quand il ne faut pas opérer. En fait, nous essayons toujours de privilégier un traitement « conservateur », au moyen de médicaments ou d’orthèses, mais aussi avec l’aide des kinésithérapeutes et des ostéopathes. Le recours à la chirurgie ne sera que la solution ultime. En moyenne, à peine 5 % des patients vus ces dernières années au NATO Staff Medical Centre ont eu besoin d’une opération. La pratique de l’orthopédie repose d’abord sur une bonne connaissance de l’anatomie. L’interrogatoire du patient et la réalisation de quelques tests cliniques adéquats permettent parfois de poser un diagnostic, mais la plupart du temps des examens complémentaires (principalement radiologiques) seront nécessaires. Ce n’est que lorsque le diagnostic est connu avec certitude qu’un traitement adéquat peut être proposé. Et il sera rarement chirurgical.

when a meniScuS beginS to tear, it iS recommended to remove the leSion by arthroScopy before it getS any worSe is actually inside the knee joint (cartilage damage, torn meniscus, pulled ligament) or around the knee (sprain of the collateral ligaments, tendinitis, etc.). Patients regularly come to see us for pain in the foot or various types of tendinitis or sports related injuries. The most common are obviously sprained ankles and blocked shoulders. NSCM: Are certain surgical procedures necessary? FÉLIx: When a meniscus begins to tear, it is recommended to remove the lesion by arthroscopy before it gets any worse. This technique is very simple these days and is, in fact, carried out in a one-day clinic. But there are other situations when surgery is probably necessary; I am thinking, in particular, of carpal tunnel syndrome, a synovial cyst or of a slipped disc putting pressure on a nerve root. NSCM: Do you also take care of children? FÉLIx: Paediatric orthopedics is a sub-specialisation and, for serious cases, I would probably refer the child to a colleague, but thankfully this situation has never arisen at NATO. On the other hand, I often see children for walking disorders. In most cases it is the result of flat feet but occasionally I discover a scoliosis or anisomelia (leg length discrepancy). In general, the treatment will be conservative (orthopedic insoles or physiotherapy) and will have a greater chance of being effective if it is started at an early age. NSCM: What message would you like to communicate? FÉLIx: I think that we need to raise people’s awareness that it is not normal to experience chronic pain. You should not hesitate to consult a doctor before possible lesions become more serious or even irreversible. Unfortunately, we often see patients who have waited too long or who have tried several alternative treatments before having been diagnosed. As a general rule, prevention is better than cure!

NSCM: Quelles sont les troubles les plus fréquents ? FÉLIx: Le mal de dos est l’un des motifs de consultation les plus fréquents en orthopédie. Dans ce cas, notre travail consistera à différencier des douleurs d’origines musculaires d’autres atteintes plus délicates comme une hernie discale. La deuxième cause de consultation par ordre de fréquence est la douleur au genou, et dans ces cas-là, il faudra déterminer si le problème se situe dans le genou (lésion cartilagineuse, déchirure du ménisque, rupture d’un ligament croisé…) ou autour du genou (entorse des ligaments collatéraux, tendinite, etc.) Des patients consultent régulièrement pour des douleurs plantaires ou pour diverses tendinites ou blessures liées au sport. Les plus communes sont évidemment les entorses de cheville ou les blocages d’épaule. NSCM: Certaines opérations sont-elles nécessaires ? FÉLIx: Lorsqu’un ménisque commence à se déchirer, il est recommandé de retirer la lésion par arthroscopie avant qu’elle ne s’aggrave spontanément. Cette technique est tout à fait anodine de nos jours et se fait d’ailleurs en chirurgie ambulatoire. Mais il y a d’autres situations où une intervention est probablement nécessaire ; je pense notamment à un syndrome du canal carpien, à un kyste synovial ou encore à une hernie discale comprimant une racine nerveuse. NSCM: Vous occupez-vous aussi d’enfants ? FÉLIx: L’orthopédie pédiatrique est une sousspécialité, et pour des cas graves il est probable que je référerai l’enfant à un confrère, mais heureusement cette situation ne s’est jamais présentée à l’OTAN. En revanche, je vois souvent des enfants pour des défauts de la marche. Dans la majorité des cas, ce sont des pieds plats, mais occasionnellement il m’arrive de découvrir une scoliose ou une anisomélie (différence de longueur des jambes). En général, le traitement sera conservateur (semelles orthopédiques ou kinésithérapie) et aura d’autant plus de chances d’être efficace qu’il sera entrepris à un jeune âge. NSCM: Quel message voudriez-vous faire passer ?

FÉLIx: Je pense qu’il faut sensibiliser les gens au fait qu’il n’est pas normal de ressentir une douleur de manière chronique. Il ne faut pas hésiter à consulter un médecin avant que les éventuelles lésions ne deviennent plus graves ou même irréversibles. Nous voyons malheureusement assez régulièrement des patients qui ont attendu trop longtemps ou qui ont essayé toute une série de traitements alternatifs alors même qu’aucun diagnostic n’était établi. De manière générale, il vaut mieux prévenir que guérir !

NSCM: Could you tell us about the club, its history and its structure? The NATO Bowling Club was founded in 1976. To start with, certain members of the US Delegation found out that the SHAPE bowling alley was being renovated, and immediately asked if they could have the old bowling lanes in order to install them in the NATO Staff Centre which was then being built. These are the lanes that are still being used today. No TV screens displaying or calculating the scores – it’s all done on paper and by hand, like in the good old days! The bowling alley was inaugurated by the Secretary General at that time – Mr Joseph Luns. During the inauguration, the Secretary General had a go at this sport and bowled a STRIKE! The Bowling Section was subsequently opened up, on a reciprocal basis, to outside teams (Sabena, Sabca, Eurocontrol, etc), some of which are still there today. The first President of the Section, Paul Moncaster, was British. The club now has 80 members in two leagues, one for men only and the other mixed. Each consists of eight teams. NSCM: How are the competitions and matches organized? What is the atmosphere like in the club? In the beginning, the bowling alley was used mainly by NATO delegations for internal competitions and socializing. Since then, there has been a mix of nationalities. The Men’s League plays on Tuesday evenings at 18.15 and 20.30, and the Mixed League plays on Thursday evenings at the same times, in the Staff Centre’s Bowling Bar. Each competitor plays three games per evening, and in the mixed league, at least one man and one woman must play. The season starts at the beginning of September and ends in May. It includes eight series of four evenings, during which each team plays all the others in turn and then takes part in a position night on the basis of its ranking. NSCM: Are there bowling lessons for people who have never played before? At the moment, there are no lessons given officially or on a payment basis: newbies train as they go along, with friendly tips from more experienced members: players are always ready to help learners while they play. NSCM: Can you give us a good reason to join the club? Are there any special activities apart from the bowling itself, such as outings, postmatch drinks, etc? Bowling requires a great deal of skill, just like darts, billiards or pétanque. But it is also a real sport: the bowling balls weigh between ten and sixteen pounds!

NSCM: Pouvez-vous présenter le club, son histoire, sa structure ? Le NATO Bowling Club a été fondé en 1976. Au départ, certains membres de la délégation américaine ont eu vent d’une rénovation du bowling au Shape et ont aussitôt demandé à récupérer les anciennes pistes pour le Centre du Personnel de l’OTAN, alors en construction. Le bowling a été inauguré par le secrétaire général en place à ce moment là, M. Joseph Luns. Lors de cette inauguration, le secrétaire général s’est essayé à ce sport en lançant une boule avec laquelle il a fait STRIKE ! Après sa création, la section Bowling fut étendue, par réciprocité, à des équipes de l’extérieur (Sabena, Sabca, Eurocontrol, etc.), dont certaines sont encore là aujourd’hui. Le 1er président de la section était Paul Moncaster (UK). Le club compte actuellement 80 membres répartis en deux ligues, une masculine et une mixte, de huit équipes chacune. NSCM: Comment se déroulent les compétitions et les matchs ? Quelle est l’atmosphère au sein du club ? A l’origine, le bowling était utilisé principalement par les délégations de l’OTAN pour des rencontres internes dans un but convivial. Depuis, les nationalités se sont mélangées.La ligue « Messieurs » joue le mardi soir à 18 h 15 et 20 h 30, et la ligue « Mixte », le jeudi soir mêmes heures, au Bar Bowling du Centre. Chaque compétiteur joue trois parties par soirée, et en mixte, il faut aligner au moins un homme et une femme. La saison commence début septembre et s’achève en mai, et compte huit séries de quatre soirées où chaque équipe rencontre toutes les autres à tour de rôle, puis joue une soirée de barrage en fonction de son classement. NSCM: Y a-t-il des cours de bowling pour ceux qui n’ont jamais joué ? Il n’existe pas, actuellement, de cours de bowling officiels ou payants : la formation des « petits nouveaux » se fait sur le tas, avec les conseils bon enfant de membres plus expérimentés. Les joueurs sont toujours prêts à rendre service pour un apprentissage en cours de jeu.

Competition nights, which are very cosmopolitan, are also an opportunity to meet lots of people, not only from the HQ, delegations and missions, but also from outside. And after all the effort, of course, comes a quantum of solace with a well-deserved drink and the chance to get to know each other better in a friendly atmosphere, regardless of our jobs or grades. NSCM: How much does it cost? The Club’s annual subscription is €5. Each member must then pay €8 to play three games. In order to encourage the teams to take part in full, the Club fines them €3 for every “blind” (absent player). The sums collected are used to pay the NATO Staff Centre for the games played and for a buffet dinner and dance offered at the Staff Centre at the end of the season. This is a very enjoyable event where all the players are rewarded for their final rating. NSCM: What happens on a normal evening at the NATO Bowling Club? The “pros” bring their own gear, but the Centre provides shoes and bowling balls for those who need them. The aim is to knock down as many bowling pins as possible in one go (“strike”) or in two goes (“spare”), while avoiding “splits”. Paradoxically, the best players bowl the fewest balls! In other words, if you score 300 (the maximum), you’ve bowled 12 balls. If you haven’t made any strikes or spares, you have bowled 20! A real sport for layabouts... NSCM: How do you join the club? Is there a minimum age? NATO passholders need only sign up with a Committee member and choose a team which needs players. People from outside NATO must have a Staff Centre access card and must be sponsored for membership. The minimum age is 18.

NSCM: Pouvez-vous citer une bonne raison de joindre le club ? Y a-t-il des activités spéciales en dehors de la piste de bowling (sorties ? verre de l’amitié après la partie ? autres ?) Le bowling est une activité qui demande beaucoup d’adresse au même titre que les fléchettes, le billard ou la pétanque. Mais elle est malgré tout très sportive : les boules pèsent de 5 à 8 kilos ! Les soirées, très cosmopolites, sont aussi l’occasion de côtoyer beaucoup de monde, tant du Siège ou des délégations et missions que de l’extérieur. Et, bien sûr, c’est après l’effort que vient le réconfort d’un rafraîchissement bien mérité qui offre l’occasion de mieux faire connaissance en toute convivialité et sans barrière de fonction ou de grade. NSCM: Combien coûte la cotisation ? La cotisation annuelle au club est de € 5. Ensuite, chaque membre doit s’acquitter d’un montant de € 8 pour les trois parties lorsqu’il joue. Afin d’inciter les équipes à venir au complet, le Club les « taxe » d’un supplément de € 3 par joueur absent. Les sommes recueillies servent à payer les parties au Centre du Personnel de l’OTAN et comprennent une participation au buffet-soirée dansante de fin de saison, qui se passe au Centre du Personnel dans une très bonne ambiance et où tous les joueurs sont récompensés en fonction de leur classement final. NSCM: Comment se déroule une soirée ordinaire du NATO Bowling club ? Les « pros » viennent avec leur propre matériel, mais le Centre met des chaussures et des boules à la disposition des autres. Le but est d’abattre le plus de quilles possibles en un coup (« strike ») ou en deux (« spare ») tout en évitant la « valise » ! Paradoxalement, c’est ceux qui jouent le mieux qui en font le moins ! Autrement dit, en faisant un score de 300 (le maximum), vous jetez 12 boules ! Si vous ne faites aucun spare ni strike, vous en jetez 20 ! Un vrai sport de paresseux… NSCM: Comment adhérer au club ? If you are hoping to grab yourself some bargains, you can’t improvise with the Sales. First reflex: do an inventory of your wardrobe. A thorough inspection of the items to keep, to revamp or to give away. Tartan is back big time this winter ? See it as an opportunity to bring out that old checked shirt you loved sometime back in the 90s and which has been buried at the back of the wardrobe.
