Let the festivities begin } Jabulani Dlamini THE Mangaung African Cultural Festival (Macufe) organisers have promised a festival with a bang when this year’s edition, now in its 17th year, kicks off on Friday. Apart from the festival regulars such as the comedy show, arts and crafts market, main jazz festival and the Macufe Cup soccer match featuring giants Bloemfontein Celtic and Kaizer Chiefs, a new addition to this year’s line-up is a rugby match. The Currie Cup rugby match between the Free State Cheetahs and DHL Western Province will be used as a platform to celebrate the 2014 Macufe edition. The match will be staged at the Free State Stadium on the Saturday with the much-anticipated kick-off at 14:00. Tickets are available at the Cheetahs ticket office at the Free State Rugby Stadium or online at www.fscheetahs.co.za at a reduced rate of R20 each for the open stand. According to a statement by festival director, Mario Sefo of the Department of Sport, Arts and Culture in the Free State, the match will serve as an important platform to celebrate Macufe 2014 as part of the sports content of this year’s edition. A parade will be staged on Saturday to officially raise the curtain for the start of a week-long festival that promises to dazzle fun lovers, sports fanatics and cultural activists from across the country and beyond the borders. The parade will start at the popular Sechaba Chesa Nyama Place in Moshoeshoe Road, Rocklands, at 09:00 and proceed to the Mangaung Outdoor Sports Centre where festivities will start at 11:00. As a taste of the fun that is to be showcased during the 2014 Macufe programme, the cultural festivities at the Mangaung Outdoor Sports Centre will include performances

As in previous years, Bloemfontein Celtic and Kaizer Chiefs will do battle on 12 October while the 21,1 km Macufe half-marathon and Big Walk will also be held on Saturday.
The half-marathon will start at the Free State Sports Science Institute, President Brand and Victoria Road, at 06:00. The Big Walk will start at the historic Mapikela House in the Batho Township at 08:00. Several prizes are up for grabs. Other Macufe activities in this year’s festival include Tshepe, a Sesotho hip hop show in the form of a DJ battle on Friday, the
Macufe Gospel Show on Sunday, as well as the Homebrew performances from Monday, 6 October, until Friday, 10 October. The indoor jazz and the divas concerts will be staged on 9 and 10 October respectively. “Macufe continues to be the brand for the Free State. It will be used to promote economic growth, showcase talent and promote sports tourism in the province. We will
create a platform for progressive music legends to recognise the role they played in the liberation struggle through music,” Mathabo Leeto, Arts and Culture MEC, says. FAITH MUTHAMBI, Communications minister, says South Africa needs a strategy to iron out the challenges facing both community and commercial media. “We need a strategy to ensure that we have a sustainability model for all these community media houses, as they are complaining of not getting enough government support, especially in local government. As government, community is our baby, as it is at the doorsteps of our communities,” said the minister on Friday. She said the strategy would need to focus on encouraging local government to take advantage of community media. Muthambi was speaking at the Community Media Imbizo at the East London Golf Club in the Eastern Cape. The event was aimed at giving community media an opportunity to map out the status of their industry as well as developing the way forward. Palestine vs Israel: One-sided war
IN what seems to be a war every two years between Hamas and the Israelis, 2014 has been the bloodiest of all, claiming almost 1 900 lives and counting. Leaving scores of Palestinians homeless, with no food to eat, no roof over their heads, a countless number of children orphaned and increasing the prospects of a bleak future in the Israeli enclave of the Gaza strip. As the Israelis and Hamas continue to play a blame game, the helpless people of Palestine are left to bear the brunt of the sheer brutality of the military operations in their back-yards. In a world where morality seems to be a far cry, Gazans continue to suffer inhumane and deplorable living conditions in the aftermath of the war raging within their territory. In a desperate attempt to change public opinion on the Israeli military campaign in the strip, both Israel and its ally, the United States of America (USA), have argued effortlessly that Israel has a right to protect its people, an argument which I find extremely troubling. Why would they so desperately state the obvious, unless they are mindful of the wrongfulness of the Israeli operations in the Gaza strip. Every government has the right to protect its citizens against any

Lebohang Mafa Social Observer threat to its sovereignity as enshrined in the International Law. So, I find this public relations strategy deeply troubling from where I am standing. Backed by all big media houses (CNN and the BBC, perhaps not so surprising by their angle of reporting) who have repeatedly reported on the number of missiles Hamas militants have fired onto Israel, yet the death toll is rising on the side of Palestine with not a single building in Jerusalem, Tel Aviv, Petah Tikva, Netanya, et cetera, being hit. Surprising is that I haven’t heard till now how many missiles Israel have fired onto Gaza, but we know the Israel Defence Force (IDF) has flattened a larger area in the strip than ever before. More that 120 000 people have been left homeless, displaced, left worse off and family units disrupted, if not destroyed, bright futures ruined, the right of the people of Palestine to live has been violated and lives cut short. Across the border into Israel, kids can still go to the beach and

enjoy being kids without the trauma and fear of whether they will live to see tomorrow. Perhaps, much credit to the USA-developed iron dome. This begs the question, why are the people of Palestine not given the same technology for their protection? If not, this is a fight against the people of Palestine in general and not just so-called Hamas terrorists. In the recent mediation attempt by the USA, the UN and other regional leaders in the Middle East, the importance of proportional attack and the need for extra measures to be taken by Israel to ensure minimal civilian casualties in Gaza were stressed by all the mediating parties. However, the reality has been shocking to say the least. Israel has not taken this call to their operations, as we see a continued increase in the number of civilian casualties in Gaza, as a result of the indiscriminate attack from Israeli soldiers on the people of Palestine. In one incident that left more than a dozen people dead, the IDF targeted the UN-designated shelter, this after they were allegedly reminded 17 times by the United

IN support of International Literacy Day on 8 September, staff members of Phatshoane Henney Attorneys donated over 160 secondhand books to give to those in need. A range of books – from children’s books to fiction, non-fiction and even a complete set of Encyclopedia Brittanica – were then handed over to Engo, a non-profitable and non-governmental organisation that focuses on the care of children, the elderly, families, persons with disabilities and patients in need. Engo will now distribute the books where the need for the written word is
greatest. Jan Berry, CEO of Phatshoane Henney Attorneys, says as literacy is such a critical aspect of education, the firm believes the donation is sure to make a lasting difference in many children’s and adults’ lives. “Having access to reading material is something many of us take for granted, but is in reality a great privilege that not everyone gets to experience. In the latest display of defiance and total disregard of the rules of engagement between the warring parties, Israeli forces targeted a UN shelter where ten more people were pronounced dead as a result of the attack. The question is how long will Israel continue to kill the people of Palestine with impunity? Clearly, the verbal condemnation is not bearing good fruits for the people of Gaza who are caged in their own country with limited and/or no access to the rest of the world. All that the people of Gaza ever wanted was to be free, and have a right to self-determination, a right to be Palestinians without fear of being bombarded with heavy artillery and left for dead, without enough and expired medical stock, and for their children to grow and be safe on the playground in the same way as those of Israel. There is no denying Israel’s right to protect its citizens, but why is Israel not willing to accept the UN resolution of two states between them and Palestine? Why is the safety of the people of Israel given so much priority, why is it so much more important than that of the people of Gaza and Palestine? It was recently report the USA and other mediating parties have failed to convince Israel into a ceasefire. The US approved Israel’s request to replenish its missiles and other arsenal inventory. If indeed the USA was genuine about the ceasefire efforts, I am dead sure that this should have been more than enough leverage to
force Israel to come to the table and discuss a ceasefire and talk about other contentious issues, such blockades, the movement of people and items in and out of Gaza, and including the destruction of tunnels and demilitarisation of Gaza (if the move would be in line with International Law). Sadly, this went down as the epitome of a truly missed opportunity for the USA and the people of Gaza. It is pitiful that the African leaders have lost their conscience. I think this would have been the time for our continent’s leaders to show support for the people of Gaza by boycotting the USA-Africa summit until the USA has stopped arming the IDF to kill the people of Gaza. Americans needs to be held partly accountable for their role in the mass indiscriminate killing of the people of Gaza. Pres. Barack Obama in his foreign policy outline event argued that just because the USA had the “best hammer (military and weaponry), it doesn’t make every problem a nail”. But lending your “best hammer” to the reckless carpenter (so to speak), who sees every regional problem through the barrel of the USA-made arsenal, the USA must share the responsibility for the senseless killing of the innocent people Gaza. ) Express welcomes contributions to this column from readers. To shoot or not when in danger IN the light of recent high-profile criminal trials, commissions of enquiry and the inundation of crime and police television shows, the public at large can be forgiven for its general view that “self-defence” is an accepted mechanism to ensure your safety. IN our society where crime statistics for violent crimes are alarmingly high, it is important that you understand the principles behind the legal term “private defence” – more appropriate, as it is not limited to only the defence of oneself – and when you may or may not shoot. Not a “one-size-fits-all” defence When aggressive force has been directed against another person, a court will decide whether a crime has been committed by taking into account the conduct, the presence or absence of a specific human act, causal link whether the conduct can be linked to the accused, unlawfulness whether the act can be justified or not and culpability, whether the conduct was intentional or negligent, and whether the accused was able to distinguish between right and wrong at the time. Private defence is indeed one of the defences which can be raised to justify conduct that would otherwise be unlawful. However, this defence is not a “one-size-fits-all” defence and it must also be asked whether the level of force was reasonable or
unreasonable under the circumstances. Scenarios considered To illustrate, imagine two basic scenarios. In the first scenario, Mr A is walking down a busy pavement when he is approached by Mr B who demands his wallet. Mr B does not appear to have a weapon, but is an intimidating character. Mr A pulls out a gun and shoots Mr B in the chest, killing him. In the second scenario, Mr A wakes up to find Mr B in his bedroom aggressively pointing a gun in the direction of Mr A and his wife, with his finger on the trigger. Mr A pulls a gun out from under his pillow and shoots Mr B, killing him. Court weighs up facts of case At the trial of Mr A (in both scenarios), he pleads private defence as grounds for what he regards as the lawful killing of Mr B. Before such a defence is accepted, a court will consider the circumstances surrounding Mr A’s conduct and apply the “reasonable man test” by asking: “What would a reasonable man
JACYN MITCHLEY placed in the same situation do?” The factors which a court will then examine include whether an unlawful attack had taken place or was about to, against whom or what the attack was directed, and whether it was a person or property worth protecting. Another is whether force was necessary to protect the person or property that was threatened, or whether alternative options existed to avert the threat, whether the force was directed against the attacker and whether the force was proportional to the threat. Alternative options, lesser force Taking account of these factors, it is quite likely that a court would find that in the first
scenario, an unlawful attack could be perceived as having been imminent against Mr A and his property, and that his life and property was worthy of protection. However, a court would probably find that a reasonable man in the same situation as Mr A would consider the killing of Mr B to be unreasonable, as alternative options or lesser force could have been applied with the same result. For instance, as the attack occurred on a busy pavement, a reasonable man could shout for help, run away, or as a last resort, pull out his gun and warn the perceived attacker to back off. Additionally, a reasonable man may also be held to be aware that a shot to the chest has a far greater likelihood of fatality than a warning shot or shot to, for example, a foot. In this scenario, the probability indicates that the force exerted by Mr A was not proportional to the unlawful attack by Mr B and Mr A’s conduct would not be considered justified. Limited options, likely fatal In the second scenario, an unlawful attack would also be perceived as having been imminent against Mr A and his wife’s life, which would be worthy of protection through the direction of force against the attacker. The court would in all probability also find that a reasonable man in the same situation would assess that there were limited opportunities for
escape, that it would be highly unlikely that he could disarm or overpower Mr B without risking their safety, and if action was not taken immediately, he and his wife might be in a potentially fatal situation. Accordingly, as a last resort Mr A directed the only force which would be effective in such a situation, namely to fire on the attacker with the intent to disable him. In these circumstances a court would most probably find that the force directed at Mr B was proportional and justifiable under the circumstances. Force not considered lightly It is vitally important to remember that consequences flow from all actions and that the use of force should never be considered or taken lightly. Where no other option is reasonably available, force may be applied against an attacker. The circumstances behind each case, however, is unique, and one cannot compare one decision to exert force to a decision in another set of circumstances. Likewise, what may or may not be a justifiable defence will always need to be approached with circumspection. Anger or fear alone must never be used to justify the exertion of force, and the question of “to shoot or not to shoot” can only be answered with, “do I have any other option?” ) Mitchley is an associate at Phatsoane Henney attorneys in Bloemfontein.
Services improving GOOD progress and some achievements have been recorded in the provision of basic services over the first quarter of the fifth democratic government. This is according to Malusi Gigaba, chairperson of the Governance and Administration Cluster and Home Affairs minister, who briefed media in Pretoria on Sunday on progress relating to the implementation of government’s Programme of Action. Gigaba noted that the number of households that were connected to the electricity grid amounted to 48 751, with 3 786 using non-grid technologies.
Efforts to strengthen and broaden public participation in local service delivery through ward committees were also in progress with a total of 450 Ward Level Service Improvement Plans having been developed since May 2014. The improvement plans developed focussed on, among other things, the filling of potholes, repairing nonfunctioning traffic lights, preventing service interruptions, attending to billing queries and the cleaning of open spaces. A total of 3 294 ward service improvement plans have been developed to date, said the minister.

Men and women of faith known by actions } Mutombo Moise Kumwimba IT is easy for everyone to say that they are a man or woman of faith; but what really qualifies us are not the words we speak, but our actions in times of adversity. A man of faith does not change his position before God because of adversity, neither does he change his confession. A man of faith understands that adversity is a soil under which faith flourishes, while a faithless man – I mean a religious man – sees adversity as a way to believe God does not hear us, neither is He concerned about us. In the end of it his faith drops. A man of faith knows that no matter how long the night lasts, morning is coming. A man of faith gets a way out in the midst of life’s uncertainty, because of the unchanged position of his heart before the Lord. In Daniel 3:16 we see that for Shadrach, Meshach and Abednego it was a matter of life or death. FICKSBURG. – While most South Africans are celebrating the 20th anniversary of democracy and freedom, Julia Frees of Caledon Park near Ficksburg has not had reason to celebrate. She has described her situation as having lived in a cave with no privacy for 20 years. Frees has been sharing a four-roomed house with her neighbours. “We have been living in that house because we have no alternative. It is like a cave,” she says. Apparently, these houses were built by the apartheid government. They are four-roomed houses with two outside doors. Two families live in each house, separated only by the wall. However, life will be different from now on for 20 families in Caledon as these houses will be demolished. Some of the houses have already been demolished and five-room houses are being built, courtesy of Operation Hlasela. The houses were demolished last Tuesday by the Free State Provincial Government, led by Premier Ace Magashule, during the Operation Hlasela Outreach Campaign in the township of Meqheleng in Ficksburg. The families whose houses have been demolished are being housed in the shelters which were temporarily built for them by the Setsoto Local Municipality. “I am over the moon, even though the house is not complete. I never thought that one day the ANC government would do this for me,” said Frees.
She said the condition of the house that they were living in were not conducive to a good life. “Life was very hard in that house. You could see the neighbour through the wall and obviously there was no privacy.” Although overjoyed at finally having a house she can call her own, the mother of three said she was also worried that her husband who had disappeared many years ago might come back to claim the house. “I am afraid. I am wondering what will happen should my husband come back and claim ownership of the house. He is now living in Johannesburg with another woman,” she said. Frees said the house was registered with the husband who did not want to come home anymore. “We came here after he was given the house by his cousin. So it is clear that he can come at any time and do as he wishes.” However, the premier promised her that would never happen. “He can’t kick you out of the house. We will make sure that we register the house in your name. We’ll build this house for you,” he said. When asked why they were demolishing houses instead of building for those who did not have a house, he said, “We don’t want to see those kraals which people refer to as houses. We want people to live in quality houses. “We’ll keep on building for our people. They should be taken closer to the towns,” he said.

SEITATOLO MATSHABA has blamed their “poor defending” for their loss against the Cedara College of Agriculture in the National Agricultural Colleges’ Soccer and Netball Organisation (NACSNO) Tournament final last Friday. Her Glen College of Agriculture side were unlucky to go down 21-27 to the KwaZulu-Natal outfit in an entertaining match which was staged at Glen outside Bloemfontein. The Free Staters were off to a strong start. They deservedly led 7-6 in the first quarter, but missed plenty of scoring opportunities that would have wrapped up the game for them in the second quarter – it ended 11-13 in favour of Cedara. The KwaZulu-Natal girls maintained their lead in the third quarter (16-19). They showed more stamina and strength in play as the Glen girls waned towards the end of the match. Before Friday’s affair, Glen had won all their matches against the Taung College of Agriculture (24-10), Marapyane College of Agriculture (24-18), Owen Sithole

We fought hard and tried our best, but lady luck was not on our side. We had good chances, particularly in the second quarter, but we could not convert them. Sometimes that happens in sport,” Matshaba told Express after the match on Friday. “We are all disappointed about
the loss because the intention was to win the final. We had to walk past the cup but couldn’t hold it. We were so close to winning the tournament. “We let ourselves down by not defending well and missing chances. But it happened and we cannot change the situation anymore,” she said. Star, as Matshaba is affectionately known in netball circles, scored 19 goals in the final. For her efforts she was chosen as the best player of the match. “I have mixed feelings about the best player of the match award. I am really happy to receive it, but I am sad we lost in the final. It would have been nice to lift the trophy,” said Matshaba. Meanwhile, Glen College’s soccer team defeated the Lowveld College of Africulture 1-0 in the men’s final. The week-long tournament, which was hosted by the Free State Department of Agriculture and Rural Development, proved to be a great success. THE likes of Kovsies, Pukke, Maties and Tuks remain the strongest teams of this year’s Varsity Netball tournament, with the possibility of UJ moving up the log in weeks to come. This means that there is a chance of a 2013 repeat with Kovsies and Pukke in the final. However, Tuks has been holding the top position for a few weeks and they have shown no sign of backing down. The defending champions, UFS-Kovsies, were made to grind out a hard-fought 53-38 bonus point win over NMMUMadibaz as they look to retain their title. The first quarter started at a furious pace with both sides exchanging goals as both sets of forwards found the bottom of the net at will. The Madibaz managed to head into the first break holding a slender 14-12 lead. There was no let-up at the start of the second quarter as Kovsies managed to first draw level before taking the lead thanks to a dominant performance during the powerplay. Both sides kept the scoreboard ticking as the home side went into the half-time interval with a 28-22 lead. The Madibaz came out full of energy at the start of the third quarter as they tried to reduce
the home side’s lead, but Kovsies showed their temperament as they extended their lead to 40-31 as the final quarter approached. Kovsies managed to maintain their lead and did enough to secure a bonus point in the closing stages of the match to walk away 53-38 as the victors. Meanwhile, NWU-Pukke cruised to a convincing 76-26 victory over winless VUT in their Varsity Netball clash in Potchefstroom. The home side got on top early on and took the game to VUT who were staring down a 27-8 deficit at the end of the first quarter. NWU-Pukke took their powerplay at the start of the second period and made the most of it to pile the pressure on the visitors. VUT were giving it everything they had, but they could not hold back the NWU-Pukke wave and went into half-time trailing 43-13. The visitors had to chase the game, and ran hard in an attempt to shut NWU-Pukke down, but they could not stop the rampant home side. NWU-Pukke claimed the bonus point in the third quarter and continued their dominance until the end as VUT wilted under the relentless pressure. The FNB Player of the Match was Zandre Meyer.

Ernst Middendorp’s struggling outfit has only managed six from a possible 21 points and their dreary start to the season suggests that they will struggle to avoid relegation. The club has dropped to the 14th spot on the 16-team log. Only three points separate them from the bottom-placed Amazulu. Their woes were worsened by Supersport United who thrashed them 3-0 in Pretoria. Middendorp is still skating on thin ice after having lost three matches, drawing three matches and only managing one win from seven opening league matches. Express tried several times to get Max Tshabalala, Celtic chairman, to comment regarding the club’s position on the log and “MiddenDraw’s” future at the club. Every time Express put a call through to him, he said he was in a meeting.
