Employers to face court They allegedly contravene domestic worker legislation
A WARRANT of arrest has been issued to Marais le Roux, a domestic worker’s employer in Bethlehem. Le Roux failed to appear before the Bethlehem’s Magistrate’s Court last week. He faces charges of contravening the Domestic Sectoral Determination, a legislation protecting workers in this industry. Le Roux faces three charges, including paying his domestic worker wages less than stipulated on the domestic worker’s legislation. He is also accused of not registering the employee with Unemployment Insurance Fund (UIF), as well as failing to appear before a labour inspector when subpoenaed in terms of section 66 of the Basic Conditions Of Employment Act (BCEA). It is alleged the employer has been paying Mmadingaka Maria Maseko a minimum wage of R700 a month instead of a prescribed wage of R1 491,86 in Area B for revised wages of 2013 and 2014 of the legislation. Meanwhile, the owners of the Wulf Alarm security company, Anel Exley and Diedricks Jurgens Exley, from Bethlehem appeared before the court yesterday. They first appeared before the same court last week. They are being accused of undermining a labour inspector’s instructions. At the time of print the outcomes of the court sessions were not known. The court also issued an order for the employer to allow inspectors to conduct inspections in the workplace. The security employer is accused of not complying with the Sectoral Determination for Private Security by failing to pay workers’ wages prescribed on the legislation, declaring of workers for UIF and paying contributions, failing to pay Compensation for Occupational Injures and Diseases Act (COIDA) assessments as well as Occupational Health and Safety Act. If found guilty, each employer may face a jail term of up to 12 months or be issued a fine.

All users must pay for electricity THE country, as far as electricity is concerned, is on its knees. All citizens need to help Eskom. According to a spokesperson of Rural Free State, illegal connections and bypassed customers – whether residential, commercial or industrial – lead to an immense pressure on the availability of electricity in the country. Currently in Maluti-a-Phofung 40% of electricity users are still using electricity without paying and are therefore directly responsible, with all the other such users, of Eskom having to load-shed paying citizens. Rural Free State strongly believes if you use electricity, you have to pay for it and they are going to assist Eskom in decreasing the load by disconnecting non-paying users of electricity. The country’s future depends on all of its users cooperating. The spokesperson says they simply do not have a choice and requests the community of Maluti-a-Phofung to assist them. The dedicated staff, consisting of a house manager, supervisor, six care-givers and cooking, cleaning and laundry staff, runs the facility and sees to every need of the children. School-going children are transported to their different schools and toddlers attend nursery school.

Three rapists get heavy sentences THREE men are carrying heavy life sentences on their shoulders after two of them were found guilty of raping two elderly victims in Kestell and another for raping a victim at Tseki Village in Qwaqwa. The Bethlehem High Court and the Phuthaditjhaba Regional Court sent a crystal-clear message to would-be rapists that crime does not pay. The court put heavy sentences on the shoulders of the accused, Joshua Nhlapo (23) and Kahlolo Mokoena (26), on the charges of rape, housebreaking and theft, the victims being two elderly sisters, aged 68 and 75, residing at Kestell. They were found guilty on all charges on 28 February. For rape they each got four life sentences and for housebreaking and theft they each were sentenced to 15 years’ imprisonment. In April 2013 two young men found the two sisters in their home by gaining entry through a window, raped both the elderly women and stole their jewelry and their car. The car was circulated and later recovered in Ladysmith with one suspect, Nhlapo, and two other occupants. The three were arrested for interrogation by the Ladysmith Police who handed them over to the Phuthaditjhaba police. The two other occupants were released after their fourth court appearance because they were learners and in their parents’ custody. They were not linked to the case. On 24 July 2013 the second suspect positively linked to the case was arrested. Both suspects went on trial for a week at the Bethlehem High Court, which saw them receiving a heavy sentence. The Phuthaditjhaba Regional Court also passed a heavy sentence on Zulu Amos Khumalo (33) of Tseki Village in
Qwaqwa after finding him guilty on three charges of rape, attempted murder and two counts of assault with the intent to cause grievous bodily harm. Both cases were investigated separately by the Phuthaditjhaba FCS and the Tseki Detective Service, but brought together for finalisation in court. Therefore the accused was sentenced to three life sentences for rape and another life sentence for attempted murder, two housebreakings and theft. In July 2009 an 18-year-old victim was humiliated by the accused, who raped her in the street and inside the house where he kept her. He wanted to rape another girl, but was confronted by a 60-year-old man, who tried to stop him. He became angry and stabbed the pensioner several times with a knife. During a housebreaking the accused found a mother and her daughter inside the house. He attacked them and the daughter (15) fled. He then followed her and raped her. The same suspect was arrested by police at the Bolata Shopping Centre. A victim recognised the accused at the centre and immediately phoned the police. His arrest was a great success, because it stopped him in his tracks and prevented him from continuing with his vicious acts within the community. “It is great and wonderful work by all the investigators from the police and Tseki who were involved in the investigations, ensuring the security of denying the suspects bail. “The contribution of the complainants by reporting the cases and attending court hearings was vital,” says Maj. Gen. Baile Motswenyane, the Free State provincial commissioner.
Monument unveiled } Tladi Moloi TJHETANE MOFOKENG, the executive mayor of the Dihlabeng Local Municipality, has unveiled a monument that marks the 150-year anniversary of Bethlehem. The unveiling took place on Thursday at the Bethlehem Town Hall. It started with a church service which saw the hall packed to capacity with members of the different churches in their colours. Mofokeng said the Bethlehem community should be proud to celebrate that milestone. “God has guided us thus far and we should be proud of that. We went through struggles, hurts and pains to be here. But God knew what was ahead of us,” said Mofokeng. He said South Africa had changed and added that everyone was aware of that. “Our country and Bethlehem have walked a long and hard way to freedom.” The mayor mentioned that
the community would love to be remembered for some good things during the next celebration. He said there were many challenges in the municipality, such as alcohol abuse. “It is very disappointing that Bethlehem is known for alcohol abuse and we should ensure that we end that bad spell. Alcohol has destroyed many families and some of our children have died because of that.” Mofokeng said they wanted peace and harmony in Bethlehem and that could only be achieved by working together with the community. Qwauta declares taxi fare increase } Nkareng Moloi
FROM 1 April commuters are expected to add R2 onto what they have been paying for taxi fares. “Yes, it is true that there will be a price increase of R2. It is not an April Fools Day joke,” says Thabiso Mokhasi, chairman of the Qwaqwa United Taxi Association (Qwauta). Mokhasi says they would have loved to keep the price where it was, but could not, since the price of petrol and diesel increases now and then. They are also motivated by the price of the maintenance of vehicles and paying the drivers a living wage,” he says. More passengers will have to pay R10, but it will only be R9 for those living near the Setsing Shopping Complex. Commuters from Reitpan’s pockets will be hit hard as they will be paying R28 to and from town. Mokhasi appeals to passengers to co-oporate with the drivers. He also emphasises that these price changes will benefit passengers as they want to be transported with roadworthy vehicles.

African Warriors score a goal } Tladi Moloi AFRICAN WARRIORS have signed an 18-month contract with the former Platinum Stars and Bloemfontein Young Tigers head coach, David Vilakazi. Vilakazi, who has been forgotten in football, joined the National First Division (NFD) side on Wednesday. He came to fill the position left by Thami Ngubane who had jumped ship earlier this year for Thanda Zulu Royal. Balekile Mzangwa, the team’s managing director, confirmed the agreement with Vilakazi and added he would start with his duties a day after the deal had been sealed. “Abraham ‘Waya’ Nteo will remain our assistant coach. He has been doing a good job for the team since Ngubane has left and we salute him,” he said. Mzangwa said many had applied for the coaching position, but they had chosen Vilakazi because of his experience as a coach. “We know him very well and we believe that he can drive the team to the play-offs. With his experience in coaching some of the Absa Premier League teams anything is possible,” he said. “I am happy to have been entrusted with the position of guiding a big team of Warriors’ calibre,” said the former Free State Stars player. “I am excited to be back after spending some time without a team. “The management of the team

THE SUPER EAGLES hope to get back on their winning ways when they encounter the Bloemfontein Young Tigers FC at the Bohlokong Stadium on Saturday. Kick-off is scheduled for 15:00. The two teams are sitting first and second on the second tier of the South African Football Association (Safa) and sparks will surely fly when they fight for the much needed three points. The Bethlehem-based Eagles are leading the race with 28 points after 13 games with Young Tigers coming second with 26 points in 12 games. The ability of coaches to plot each other’s down fall will be key in this encounter. They will be watching the game with hawk eyes, hoping for the strikers to convert the chances created during the game. However, the home team come into this clash with fresh wounds after they were upset by the Celtics Colts, losing by 1-0 in an away-game on Saturday. This was the Eagles’ first loss while Tigers have not lost a league game yet. Tigers played to 1-1 against the Shamrock Flowers FC on Saturday at the Clive Solomons Stadium in Bloemfontein.
Jordaan slams corruption DANNY JORDAAN, the president of the South African Football Association (Safa), has warned that corrupt activities will not be tolerated, especially in the ABC Motsepe League. The Second Division has for years been plagued by alleged corruption involving referees and team officials. In February 2013 Phil Setshedi was sentenced to eight years in jail, with five years of the sentence suspended, for match-fixing stemming from one of the games during the 2011 Vodacom Play-Offs in Cape Town. In an effort to change the image of the league, Jordaan tells KickOff.com corruption will not be tolerated. “Match-fixing will not be tolerated . . . there is no place for such things in football. We will work very strongly with law enforcement,” Jordaan says. “As you know, it is a worldwide problem and with more money to be won (the Second Division champions will get R1 million), that does not mean the problem will just disappear.” Meanwhile, Jordaan also reveals that there are plans to set up provincial structures to administer the league, rather than the current situation where the Second Division is wholly administered nationally. The Second Division has 144 teams nationwide. “What we have to do, is to strengthen the provincial structures and are building two provincial structures with head offices and other infrastructure. They (each province) will administer the league. For now, the league is administered nationally,” Jordaan adds. – KickOff.com
