The N.C. Restaurant & Lodging Expo, produced by Exposition Development Company, Inc. (ExpoDevCo) with the support of the North Carolina & Restaurant Lodging Association, has been developed as an annual trade show serving the restaurant, foodservice, lodging and hospitality industries in North Carolina. The event will launch Sept. 21-22, 2015 at the Raleigh Convention Center in Raleigh, North Carolina. North Carolina is home to more than 17,500 restaurants and 1,725 lodging establishments that ring up more than $20.2 billion in sales and employ 11 percent of the state’s workforce (supporting more than 475,000 jobs) making the hospitality industry a driving force in the state’s economy. Raleigh is also an easy access destination for outlets in South Carolina, Virginia and West Virginia. “We are very excited to offer a foodservice and lodging tradeshow for the North Carolina hospitality industry. This has been a top request and desire of the membership for the past several years. We’re eager to bring our statewide industry together for an allinclusive annual event,” said NCRLA President & CEO Lynn Minges.

Cultivating Our Future Workforce 2015 N.C. ProStart Invitational Using only two butane burners and without access to running water or electricity, student teams prepared a threecourse gourmet meal in just 60 minutes.

An impressive 80 students, interested in pursuing careers within the foodservice and hospitality industries and representing 15 North Carolina schools gathered March 23 & 24 for the 2015 N.C. ProStart Invitational, an event hosted by NCRLA’s philanthropic arm, the N.C. Hospitality Education Foundation (NC HEF). The first place management and culinary teams competed at the National ProStart Invitational, April 18-20, at Disneyland Hotel in Anaheim, Calif. Using only two butane burners and without access to running water or electricity, student teams prepared a three-course gourmet meal in just 60 minutes. Management teams developed a business proposal for an original restaurant concept and presented it to a panel of industry judges, who then challenged them to address the issues restaurant managers face on a daily basis. Judges evaluated the teams on knife skills, safety and sanitation, team skills, taste and presentation, and others. This year, Cary High School won the culinary competition and Davie High School won the management competition. Both teams

are now awarded scholarships to New England Culinary Institute, International Culinary School at The Arts Institutes, The Culinary Institute of America, Sullivan University, Johnson and Wales University, Louisiana Culinary Institute, Le Cordon Bleu, Indiana University of Pennsylvania and The Chef’s Academy. Hospitality industry leaders from across the state served as judges, including Certified Master Chef, Daryl Shular, from Le Cordon Bleu College of Culinary Arts, Chef David Ivey-Soto, from the Culinary Institute of America and David Voelz from Highland Country Club in Fayetteville. ProStart is a nationwide career and technical education program where high school students learn from an industry-driven, competency-based curriculum that teaches culinary techniques and restaurant management skills, coupled with real-life restaurant sector experiences. Industry sponsorships enable NC HEF to create this important experience for ProStart’s students, who are tomorrow’s workforce. The competition was sponsored by Golden Corral, Ecolab, US Foods, Sysco, Pinehurst Resort,

EMV payment card standard coming Oct. 1 The next generation of the payment card is coming as the United States joins the international payments community in adopting the EMV (Europay, MasterCard and Visa) standard for secure payments. EMV is a global standard for integrated circuit cards (“chip cards”) and their point-of-sale terminals. With less than a year to go until the liability shift for EMV, restaurateurs have several decisions to make. Noble Restaurants honored for honored for helping the homeless in Charlotte The King’s Kitchen of Charlotte, a Noble Restaurants property, received the NRA’s Restaurant Neighbor Award April 14 in Washington, D.C. Chef-owner Jim Noble accepted the award and a $5,000 check, which will benefit the restaurant’s mission to help the homeless in Charlotte. The King’s Kitchen is a not-for-profit restaurant that donates its proceeds to feed the poor and offers job training for those Jim Noble receives his award in who are working to get off the Washington D.C. streets. 9 Tips to Help Hospitality Owners Avoid Litigation

DUE DILIGENCE IS KEY TO MINIMIZING THE THREAT OF LAWSUITS

The hospitality industry often sees more than its share of litigation. From slip-and-fall cases to tip-related claims to disability issues and more, waves of lawsuits get in the way of doing what the industry exists to do: provide“hospitality.” Face it: No one ever decided to own a restaurant, hotel or other business so they could spend their time and money defending against plaintiffs who, in many cases, are just out to get some quick settlement cash and move on. There are no guaranteed ways to completely remove the threat of lawsuits, but following these tips will go a long way toward minimizing them.

1. Know who can be a tipped employee, know the rules for paying tipped employees, and follow the rules. Tip-related litigation is perennially one of the most fertile areas for litigation, and the Department of Labor has increased its enforcement efforts many times over. 2. Consider whether background checks in the hiring process are really needed. If they are used, ensure compliance with the Equal Employment Opportunity Commission’s guidance, as well as with the Fair Credit Reporting Act’s requirements. 3. The Americans with Disabilities Act may require that disabled employees be given reasonable accommodations, which can include additional leave time following certain absences, and the EEOC is hyper-focused on employers that impose inflexible leave policies. Be willing to consider additional leave as an accommodation. The ADA also imposes obligations regarding disabled guests and other members of the public, so become familiar with what must be done in order to provide them with appropriate access to goods and services. “Testers” and other professional plaintiffs abound in the Carolinas. 4. Ensure that an I-9 form is properly completed for every employee hired. Penalties can be severe for even seemingly-minor infractions. 5. Enlist the assistance of professionals to safeguard confidential customer and employee data against hackers and inadvertent disclosure. 6. Begin updating websites so that blind and low vision Internet users can access them. The law will soon require it. This includes hotel and restaurant reservations systems. 7. Train employees at all levels about what unlawful harassment is, how to prevent it, and how to report it. Liability can arise not only from harassment by other employees but also from inappropriate conduct by third parties (e.g., customers, vendors, etc.). 8. Conduct regular inspections of physical facilities to identify potential safety hazards. 9. Brands drive customers to act, so aggressively protect brands and all intellectual property while being vigilant not to infringe on the intellectual property of competitors and others, both within and outside of the hospitality industry. z

Act Now to Prepare for 2016 Expansions to the Law review employer mandate provision and 2016 reporting requirements

Since its inception, the Affordable Care Act has created a great deal of confusion for employers. While most are feeling the burdens of the ACA, the hospitality industry has been particularly impacted by some of the law’s provisions. With an industry characterized by high workforce turnover and a large percentage of hourly workers, hospitality employers will need to pay particular attention to the ACA’s employer mandate provision and the upcoming 2016 reporting requirements. 2015 Employer Mandate’s Impact on the Hospitality Industry The employer mandate, which took effect earlier this year, requires employers with 100 or more full-time equivalent employees or FTEs to offer sufficient and affordable coverage to at least 70 percent of their full-time employees (this increases to 95 percent in 2016) or be subject to penalties. The mandate will be expanded in 2016 to include employers with 50 to 99 full-time-equivalent employees. Employers who fail to offer coverage to at least 70 percent of full-time employees may be fined $2,000 per year per full-time employee, minus 80 employees, if one or more full-time employees obtains subsidized coverage on an exchange. For example, if you employ 100 people, you would be fined on 20 of them. In 2016 this number will change to minus 30. Again, if you employ 100 people, you will be fined on 70 of them. In addition, employers who do not offer sufficient and affordable coverage will also be subject to penalties of $3,000 per year for each full-time employee who is not offered qualifying coverage and obtains subsidized coverage on an exchange. According to a recent benchmark analysis by Marsh & McLennan Agency LLC, hospitality employers are experiencing nearly a 30 percent cost increase as they look to adopt compliant ACA strategies. Most of

this increase is attributed to offering benefits to those previously ineligible and by adjusting plan design to meet minimum standards. Start Tracking Now: 2016 Reporting Requirements Beginning first quarter of 2016, employers with 50 or more FTEs will need to report to the IRS and full-time employees regarding the health coverage offered, if any, by the employer during the 2015 calendar year. These new reporting requirements are part of Sections 6056 and 6055 of the federal tax code. u

Section 6056 requires businesses that employ 50 or more FTEs to certify whether they offered minimum essential coverage to full-time employees. Section 6055 applies to providers of health insurance, such as insurance companies and employers with self-insured plans. Reporting under this section is used to enforce the individual mandate.

Penalties for failure to comply with the reporting requirements can be $100 per return, up to $1.5M per year (or $250 per return with no upper limit for failures due to “intentional disregard”). z NCRLA has partnered with UnitedHealthcare to offer exclusive discounts to its members.
