When you are looking for a new home it’s all too easy to be influenced by what you see. For example you could be drawn into buying a house with rooms that are too small because there was a beautifully landscaped garden. Or the way the property was decorated and furnished might have caught your eye, or the fact that it was a bright, sunny day and the rooms appeared light and airy. Now if you are selling a house it’s worth remembering that the impact of that first impression can be a deciding factor in a potential purchaser’s determination to buy your property. So it follows, if you are buying, you should be very careful not to be influenced in this way. Viewing a property is a skill you can develop. We can all look but few of us can observe, and there’s a very subtle difference. True observation requires an ability to visualise what’s behind an arrangement of furniture and what a room might look like with your furnishings and your family’s clutter because again, most properties you visit to view will be inordinately tidy. To view productively you should be quite sure of what you really want from your next home. Just to say “more room” is not enough. Where do you want the extra room, in separate units or in terms of more spacious rooms? Do you want more reception rooms or more bedrooms? Do you want a utility room, double garage or a cellar? Then there is the matter of services and of central heating. No point moving to a property with no piped gas if that’s what you prefer to cook and heat by. No point buying a flat with no garden if you want to heat by solid fuel or oil - where would you store the fuel? And if you have a car or cars and need garaging or even a good parking space, buying a property in

a road with double yellow lines down one or both sides could pose huge problems. There are other considerations too. If you or your partner works at night buying a property next to a school, noisy factory or railway line could be counter-productive. Having a horse chestnut tree in the front garden could be a nuisance in the autumn when the children are trying to get at the conkers. So, before you even start to view, have a chat with the rest of the family to see what everyone sees as an improvement on the present home. List the requirements. Consider alternatives and acceptable compromises then, armed with the list, set off to view. As you view tick off all the points you are looking for and jot down briefly, any comments you may have. Make a point of leaving at least a free half-hour between viewings in order to gather your thoughts and note down any personal comments you might like to make - before your memory loses them. If you are wise you won’t view more than three, at the utmost four properties, in a day and you should leave a day between viewing sessions. This prevents you feeling that they all looked the same, stops you muddling the advantages and disadvantages of one property with another and helps you keep quite clear in your mind which homes you have viewed are offering you most nearly what you are looking for. Finally don’t expect to find everything you are looking for, that’s very rare. Just make sure the most important requirements are met and that any deficits are balanced by advantages you may not have thought of before you saw them. That way you stand a chance of buying the house that really comes up to your expectations.

When are home improvement not home improvements? Silly though this question may seem, it is in fact one that should seriously be considered if you ever intend, not only to sell your home, but to achieve that sale as quickly and efficiently as possible. Home-orientated publications are always exhorting home owners to carry out this or that ‘improvement’ because, apart from any other benefit it may provide, it will improve the desirability and value of the property. Unfortunately this is not always the case and if a hitch up in the value of your home is what you want, you as a homeowner, must consider very carefully before you make any structural, so-called ‘improvements’. Take replacement windows and double glazing for example. In theory they are improvements. They make the home more comfortable, cheaper to heat and more energy efficient. Unless the windows match the style and period of the house however, they will not be commercial improvements. Potential buyers who are sensitive to such things, will want a sizeable reduction in the price so they can have those new windows removed and something ‘more in keeping‘, put back in their place. And many other external, so-called improvements are looked on like this. 21st century conservatories on 19th century homes, tiled roofs where there should have been slate, ‘Georgian’ bay windows on an early 20th century terraced dwelling, brickwork painted gaily with the pointing picked out in a contrasting shade - can all remove a sizeable chunk off the value of the house.
Inside, the story is no different. The 60s and 70s fashion for removing dividing walls to give the ‘modern’ through room, is now being reversed in many homes. People have learned the value of privacy, no matter how small the resulting room. Open plan staircases, turned banisters replaced with ranch-style bars, trellis-work room dividers, bedrooms turned into balconies within sight of downstairs rooms, fireplaces bricked up or removed, and ‘modern’ doors replacing the old period ones, can all cause potential buyers to shudder and hurry away. As if all that were not bad enough, none of it is as bad as the ‘workmanship’ of the cack-handed DIY enthusiast who saws wavy lines instead of straight, hammers huge nails in where pins would have been sufficient, puts flimsy partitions and folding doors where once there were sturdy originals. The horrors executed by these well-meaning, useless individuals can not only devalue a house, they can make it potentially dangerous. If you are planning improvements on your home, do take sound advice first. Get an architect in to advise. Have a word with your local planning department, they usually have very strong ideas on what constitutes a real improvement and what does not. Then decide how you will have the work carried out. Unless you are a time-served tradesman, or a highly talented amateur, don’t bodge away on your own. There is really nothing to beat the end result of a thoroughly professional job, rapidly done. It looks good, it is a decided improvement and, in the long run, it will put value on your home and do a great deal to help you sell in the fastest possible time.

The role of a Solicitor A question that is often asked by first time home buyers is: “Do we really need to appoint a solicitor?” The short answer is “yes!” This is because, although buying a house may seem a purchase like any other, it is in fact a complex transaction like no other, and the services of a solicitor are essential to conduct the process satisfactorily. More importantly, the services of a solicitor will ensure you the buyer, are protected from losing what could be a horrendous amount of money. The wise buyer will have a solicitor ready to hand as soon as the decision to buy a house has been made. It is a good idea to have shopped around several firms and selected, not only the one that offered the best value for money, but also the one to whom you, the buyer, can relate. If you cannot talk comfortably to your solicitor after all, you will have problems later on in the process. As for the charges involved, solicitors are business people like any others and have similar interests in being as competitive as possible. As soon as you have located the house of your dreams and made a tentative offer, obtain the name and address of the seller’s solicitor, give over the name and address of yours and then make contact with your solicitor immediately. Do not leave it to the other side’s solicitor to make contact with yours. From now on make it a matter of routine to become involved throughout the process of the conveyance (the actual legal side of your purchase). As soon as your solicitor becomes aware of your decision to buy he or she will make contact with the ‘opposition’ and will commence the various searches. You will begin the process of raising the mortgage. If you are wise you will have received an agreement in principle for your mortgage before you started looking. Before granting the mortgage the lender will appoint a surveyor who will scrutinise the property and give a written opinion as to its worth, also noting any structural problems he/she might discover. This gives you some leverage where the price is concerned. You can often negotiate a reduction in the purchase price on the strength of the survey. If you are nervous of such ‘haggling’ you can place it in the hands of your solicitor who will negotiate for you. While all this is going on the searches will continue. Broadly speaking these involve close scrutiny of the deeds and the local authority’s plans for the area. They ensure the property is owned by those selling it, that there are no problems affecting your use of it and that there is no imminent danger of a motorway being run through the garden or the house itself. The solicitor will also ensure that no-one has a right of way through your garden or a right to share it. The deeds can take many forms ranging from a huge, antique sheet of vellum covered in copperplate writing and bearing a large wax seal, to a collection of invoices marking each time the property changed hands or had a mortgage entailed upon it. The deeds also contain details of covenants and restrictions of
the land’s use and, if it registered with the Land Registry, details of that also. Not all properties are so registered, though these days, the majority are. So far in the proceedings, either side may back out without loss or explanation. The seller may even offer to sell the property to someone else (UK only, Scotland operates different rules). At some stage your solicitor will invite you to sign the contracts. This is merely part of the process and does not necessarily place any obligations upon you. Signing is usually done at a convenient moment for your solicitor. Some time later when all the searches and legal niceties have been covered satisfactorily and no problems have arisen, the contracts will be ‘exchanged’. This is an important stage. It is a formal process, often done by the two solicitors concerned, over the telephone. Once the exchange has been made, the contracts are binding on both sides. Neither seller nor buyer can back out other than under extremely rare conditions. From this point onwards too, although you the buyer have as yet no legal right of access to the property, you are in fact wholly responsible for insuring the house. At this point also, a 10% deposit is usually expected by the seller’s solicitor. The final stage of the process is known as ‘completion‘. During this period your solicitor will be winding up the financial side of the purchase. Part of this will involve calculating Land Registry fees if applicable, and any stamp duty. Other disbursements may include local authority search fees and of course your solicitor’s charges. You will also have to pay for the mortgage lender’s survey fees, the cost of your own structural survey and the arrangement fees for raising the mortgage. Your solicitor will gather all these threads together, arrange for the remainder of the purchase price to be paid into the seller’s solicitor’s client’s account and bring the transaction to a satisfactory conclusion. A day for completion is arranged when you will receive the keys after which the property (and the mortgage) are all yours!
