I’ve been a Realtor for 34 years. People frequently ask for my advice and opinions, and by sharing those questions and answers with you, I hope to offer some helpful information.

Dear Lynn, My partner and I are buying a home and have a question about snow. The yard is full 18 or so inches of snow, and the only things that are cleared are the walk and driveway. There is reason to be concerned that we may find “surprises” when the snow melts in the spring. No one has said that there’s anything but I just have this feeling due to the fact that the house was not really well-maintained and had lots of stuff that had to be removed from the garage and around the garage. That stuff we could see but we can’t see under the snow! Do you have any suggestions that may help us? Nervous 1st Timers Dear Nervous, This is not such an unusual question. I’ve experienced both good and bad outcomes to this problem. The good was an amazing flower garden and lots of springtime flowers that were beautiful and a cell phone that the new owners returned to the previous owners and the phone worked! The bad was a chassis of a truck that had been there for a while and was all rusted out. Other discoveries have been street toys, trash, rakes, trash cans and the like. So, what do you do? Ask your buyer’s agent to be very specific when trying to find out if anything is on the property that wasn’t disclosed to you. Ask the agent prepare something in writing stating that the seller has not left any personal property that cannot be seen (i.e. Hidden under 18 inches of snow!) and if personal property is found, they will come back in the spring and remove it. This is particularly important as it might cost you money to have the item(s) removed, such as a truck

chassis. Most purchase and sale agreements have a clause that describes the condition of property at closing, however when you do your final walk through before the closing and you find everything to be satisfactory and the sale is completed then the home has been considered acceptable. Considering that you did say you “just have this feeling”, another option would be to give your attorney a call and talk it over. He or she may have a good solution for you. Dear Lynn, My sister, who lives in eastern Massachusetts, closed on a house last month. I told her I would email you and get your thoughts on what happened. They were told that under the bedroom carpets (there are 4), were hardwood floors. There were actually visible hardwood floors in the living room, dining room and the hall that leads to the bedrooms. This past weekend they began to pull the carpeting up to expose the hardwood floors. You guessed it! PLYWOOD! My sister doesn’t think anything can be done as it’s been a month since the closing. What do you think they can do? May Pull

Hi May, What a disappointment for sure! I would suggest a few things. Your sister should contact their buyer’s agent who in turn can contact the seller’s agent. All of the signed paperwork should be reviewed including the listing sheet, any documents such as the Sellers Statement of Property Condition (This form is not used everywhere and is not mandatory for the seller to fill out.), and of course the purchase and agree-

ment. The seller will most likely be contacted by their agent and hopefully a solution can be found. If that approach fails, I would suggest your sister a call the attorney that represented her in the purchase. My advice for buyers is this. When you look at a home that has wall-to-wall carpeting and you’re told that there are hardwood floors underneath, ask if a corner of the carpet can be pulled up to reveal the flooring. A good time to check this is during your home inspection as long as you don’t damage the carpet, trim, or floor.

Hey Lynn, We’ve heard that if we put our house on the market, we have to tell everyone that we have Ring, Alexa any another filming or recording devices in our home. We’d like to see who’s in our home and hear the comments that are being made. What do we really have to do? Keeping Our Home Safe Dear KOHS, There are rules/laws in the country that require you to disclose to a potential buyer that you have recording/listening devices such as Alexa, Google, RING, baby monitors, security cameras etc. There may be rules/laws in your area requiring your listing broker to disclose the presence of recording devices in a home that they’ve listed. Buyer’s agents should ask the listing agent and make sure that their clients are aware of recording devices in the home. You may want to have this put in writing. Some real estate listing forms have a clause stating that these types of devices are in the home.
