I’ve been a Realtor for 36 years. People frequently ask for my advice and opinions, and by sharing those questions and answers with you, I hope to offer some helpful information. Dear Lynn, My oh my! The real estate market is crazy! Nothing is available and if we don’t bid high enough, we don’t get our offer accepted. We haven’t even had a seller come back to us asking if we would pay more. I’ve been hearing about an “escalation clause.” Can you explain how that works? Ready to Give Up

Dear Furious, Ah, “love letters” to sellers. Yes, buyers have and still do write letters to sellers. You include a supporting letter with your offer and the seller is so moved that they chose your offer! Sounds good, right? Here’s information from the National Association of Realtors referencing laws in the Fair Housing Act: “Buyer love letters are a tactic used by some buyers in an attempt to stand out to a seller, especially in hot markets with low inventory and bidding wars. Seemingly harmless, these letters actually raise fair housing concerns, and could open real estate professionals and their clients to fair housing violations. To entice a seller to choose their offer, buyers sometimes write “love letters” to describe the many reasons why the seller should “pick them.” While this may seem harmless, these letters can actually pose fair housing risks because they often contain personal information and reveal characteristics of the buyer, such as race, religion, or familial status, which could then be used, knowingly or through unconscious bias, as an unlawful basis for a seller’s decision to accept or reject an offer. Consider where a potential buyer writes to the seller that they can picture their children running down the stairs on Christmas morning for years to come in the

house. This statement not only reveals the potential buyer’s familial status, but also their religion, both of which are protected characteristics under fair housing laws. Using protected characteristics as a basis to accept or reject an offer, as opposed to price and terms, would violate the Fair Housing Act.” The Fair Housing Act prohibits discrimination in housing based on race, color, religion, sex, national origin, disability, or familial status (includes individuals or families with children under 18 years of age and pregnant women). The Fair Housing Act applies to almost all housing in the country. With all of that being said, there are still ways to make your offer stand out! Strong offer price, escalation clause, large down payment, strong initial deposit, pre-approval letter and more. Ask your buyer’s agent to advise you. Dear Lynn, I bought a house on a busy corner where there are traffic lights. WOW! I sit on my front porch and I can’t tell you how many drivers drive right through the red lights! I’ve seen so many near-misses! I love my home but this is becoming hard to watch. Sometimes I wonder how many children may be passengers in these cars, trusting their safety to the driver. I’m thinking about putting a sign on my lawn to help people not be the cause of someone’s injury or death. Millie

Hi! Don’t give up! Yes, this is a tough time for buyers. Like Old Mother Hubbard, “the cupboard is bare!” Offers can contain an escalation clause which comes into play should the seller receive a higher offer. You can also add a “cap” indicating that you won’t pay more than a certain amount. For example, let’s say you offered $250,000 on a house. It’s your dream home and you don’t want to take the chance you may lose this house! Therefore, you offer $250,000 with an escalation clause agreeing offer $1,000.00 over the highest offer received by the seller. Your cap is $280,000. The seller reviewed all offers and the highest offer (not yours!) is $265,000. Your escalation clause would increase your offer to $266,000. In addition to using a buyers’ agent, other good ways to strengthen your offer could be a substantial deposit, high down payment, no or few added contingencies (e.g., home sale contingency, not asking the seller to pay closing costs, flexible closing date). A couple of final tips: The clause does require the seller to provide proof that they have an offer of $265,000. Also, be sure you have a pre-approval letter from a lender that shows you can go as high as your “cap.” Don’t give up! The market changes all of the time. By the time this question and answer goes to print, the market may be flooded with new listings.

Well, the seller didn’t want to read my letter! Why wouldn’t they want to know who we are? I know they got lots of offers and I hoped they would choose us because of our letter.
