Dear Lynn, What if we’re selling our house and don’t want to accept an offer? Can we just flat out say no to any offer or do we have to counter offer until we finally arrive at a price that the buyer will pay? Will we be doing something illegal if we just say no and move on? Do we have to give a reason why we are rejecting the offer? Would we owe any one any money because we received an offer we didn’t accept? A Reader

Dear Reader, You can reject an offer and it would be legal if you do it for the right reasons. Many reasons are acceptable such as, concerns about the buyers financing, the offer is too low. Sellers are not legally allowed to discriminate against individuals that are protected under your state and federal laws. So, with that said, there are several reasons to not accept an offer. Ask you Realtor to explain the advantages and disadvantages of the offer that you’ve received. Here are some of the reasons you may want to reject an offer. The offer you received may not be high enough. No one wants to take a loss on their home. You may have some doubts about the ability of the buyer to buy your home. Maybe they don’t have a pre- approval letter or can’t show you verification of funds. You certainly don’t want to find out deep into the transaction that the buyer’s not able to buy your home. After all that time you have most like lost a buyer that can buy. What if you decide that you don’t want to sell anymore? It’s your house. You are not obligated to say why you have decided not to sell. You can decide not to move. You may end up owing your listing agent a fee. Check your listing contract. So, with all that said you don’t want to not sell for reasons that are illegal. The Fair Housing Act states: It illegal to “refuse to sell… after the making of a bona fide offer, or to refuse to negotiate for the sale… or otherwise make unavailable or deny, a dwelling to any person because of race, color, religion, sex, familial status or national origin. You can go to The United States Department of Justice for more detailed information.

Hi Scott, You’re off to a great start! Sure, I can offer a brief summary of the process, but it may be a little different depending on your situation. Here’s a basic overview. Once you’ve located the home that you want to buy you’ll write up an offer with your buyer’s agent (let’s assume you have one). Your agent will submit for you: the offer to purchase, a deposit check, copy of your pre-approval, and a lead paint disclosure if applicable. Once the offer is accepted, and there may be some negotiating to get to that point, that’s when the process starts. You’ll have dates to comply with. The dates may include, but are not limited to, a second deposit, mortgage application date, home inspection date, home insurance and mortgage commitment date. You also may have a septic system inspection date but we’ll keep this simple and save that for another question. Now you and the seller have signed the offer, what next? You contact an attorney, set up your home inspection, and apply for your loan and insurance. Your buyer’s agent can recommend an attorney, home inspector, insurance compa-
ny, contractor etc. should you need help locating these professionals. Typically after your home inspection period is over you will have a second deposit that will be due. Once you have received your commitment from your lender, a letter saying, “Congratulations, you have your mortgage!”, then the buyers and sellers attorney will get everything ready for your closing. Within 24 hours of the closing you have an opportunity to do what’s called the “final walk through” at the home. At this time you can check and be sure the home is in the same condition it was in when you placed your offer. Closing day! This is the day you have been waiting for! Once you close on the home and are given the keys all you have to do is unpack and make it your own! Remember, this is a basic description of the process and it may differ in your situation.
