Zoners approve two components of Swanborne application

The members of the Jackson Zoning Board of Adjustment have approved two parts of the Swanborne, LLC, application and will consider the third and final component of the application during a meeting tonight, Jan. 18.

The board’s action to approve two portions of the plan occurred during a Dec. 7 meeting after the attorney who represents Swanborne asked the board members to reconsider their previous denial of preliminary and final major subdivision approval for the application.

The Swanborne application proposed to subdivide a 159-acre property that is bounded by East Veterans Highway (Route 528), South Hope Chapel Road (Route 547) and Whitesville Road (Route 527) to permit the construction of an inclusionary residential development with 253 units, including 205 single-family market rate homes; a lot for the construction of six multi-family buildings containing 48 residential units affordable to very low, low and moderate income families and individuals; and a lot for the construction of a two-story house of worship with 8,226 square feet of building area and parking areas.

The property is in Jackson’s Regional Growth 2 zone and the proposed uses are conditionally permitted in the RG-2 zone, according to attorney John A. Giunco, who represents the applicant.

According to a legal notice published by Giunco prior to the Dec. 7 meeting, on Oct. 5, the zoning board members voted on and failed to approve the preliminary subdivision portion of the Swanborne application, which resulted in a technical denial of the entire application.

“Nonetheless, there is clear evidence on the record that at the Oct. 5

hearing, the board was mistaken as to which portion of the application was being voted on. As such, the applicant is entitled to seek reconsideration by the board as a result of this mistake,” Giunco wrote in the legal notice.

The applicant’s request for reconsideration was the topic of discussion and consideration when the zoning board convened on Dec. 7.

During his remarks, Giunco contended that during the Oct. 5 meeting, the zoning board “made mistakes of law and fact. … There was confusion on what was being voted on and how it was being voted.”

Giunco discussed each aspect of the application: the subdivision of the property, which he said a New Jersey statute says “shall be approved” and should stand on its own; the site plan for the affordable housing in the development; and the site plan for the proposed house of worship, which includes parking in a front yard.

“I would request the board to reconsider that application … for a practical reason … the advancement of Jackson’s affordable housing plan for approval,” he said.

Giunco told the board members his requests were being made to avoid what he said could be 24 to 30 months of costly litigation if his client went to court to overturn what turned out to be an inappropriate denial of the Swanborne application.

The applicant was seeking conditional use variance relief to permit the affordable housing units in attached dwellings with eight units per building, where a Jackson ordinance permits attached dwellings with a maximum of four units per building.

During public comment, resident Randolph Kubacz of South Hope Chapel Road asked if an environmental impact statement had been conducted on the property.

He said the proposed residential development would be congested and

that traffic in the area would also be congested.

Kubacz asked the board members to deny the application again as they had done in October.

During a discussion by board members, James Hurley said he agreed in part with Giunco’s argument and disagreed in part. Hurley said he wants a better site plan for the proposed house of worship.

Lynne Bradley, the board’s vice chairwoman, said, “I have major issues with the traffic,” over which she said Jackson has no control, and added, “I

am not ready to address the house of worship.”

Board member Carl Book Jr. said the Swanborne discussion “was a complicated application.”

In the first order of business following the discussion, Book made a motion to grant reconsideration of the previous denial of the subdivision of the property.

On that motion, Book, Hurley, Bradley, Chairman Scott Najarian and Joseph Riccardi voted “yes.”

Jackson zoners deny request for reconsideration of warehouse application

JACKSON — The members of the Jackson Zoning Board of Adjustment have denied an applicant’s request for reconsideration of a previous denial of a development application.

The motion for reconsideration of the County Line Holdings, LLC, application was heard by the board members during a meeting on Nov. 16 and decided that night.

Attorney Adam D. Pfeffer, who represents County Line Holdings, applied to the zoning board for reconsideration of its previous denial of a use variance regarding property on North County Line Road in the Highway Commercial zone.

The applicant sought approval to permit warehouse/office uses to accommodate four buildings in the HC zone where warehouse/offices are not a permitted use.

The applicant proposed to construct Building “A” with 81,900 square feet of warehouse space and 13,000 square feet of mezzanine office space; Building “B” with 42,500 square feet of warehouse space and 10,000 square feet of mezzanine office space; Building “C” with 105,000 square feet of

warehouse space and 5,000 square feet of mezzanine office space; and Building “D” with 168,095 square feet of warehouse space and 6,800 square feet of mezzanine office space.

Additional proposed improvements included a loading area for each building and parking for a total of 439 vehicles. Access to the site was proposed from County Line Road.

Pfeffer described the proposed space as “general warehousing” and said contractor warehousing is permitted at the site now.

Contractor warehousing typically requires less space than general warehousing, according to other applications that have recently been considered by the zoning board.

Pfeffer said when the County Line Holdings application was presented a year ago, the applicant’s financial witness was not available.

During the Nov. 16 meeting, Pfeffer presented Robert Benecke to provide financial information in a bid for reconsideration of the proposal.

Benecke said the proposal for 400,000 square feet of warehouse space “would provide for a better range of uses” by an array of businesses.

He said the site generates about

$65,000 in annual property taxes now, but if it was developed as proposed, he said the annual property taxes could approach $1.5 million.

During his testimony, Benecke sought to make the case for general warehousing at the location. He said the project would cost about $70 million to construct and added, “We would like to have as much rentability as possible across a range of businesses.”

Engineer and planner Brian Flannery testified regarding the proposed use of the site and not the specific site plan. He said the applicant was seeking a use variance for the general warehousing project.

Flannery said the development would benefit Jackson’s tax base and provide employment opportunities. He said the property has been cleared and vacant for many years, but has not been developed.

During deliberations, board member James Hurley said the applicant’s representatives may want to approach Jackson’s municipal officials to discuss the financial implications of the

development and the current zoning on the property.

Municipal officials have the authority to change the zoning on a property and to determine the types of uses that are permitted on a property without the need for a use variance.

Hurley said financial issues are not within the purview of the zoning board and he said he did not find the general warehousing use to be an inherently beneficial use to Jackson.

“The financial information is not relevant for me to make a decision” on the use variance, he said.

At that time a motion was made to deny the applicant’s request for reconsideration and to affirm the findings of denial of the previous zoning board hearing.

On a roll call vote, Chairman Scott Najarian, Vice Chairwoman Lynne Bradley, Jeanine Fritch, Carl Book Jr., John Spalthoff and Hurley voted “yes.” Board member Steve Costanzo voted “no.”

The applicant’s request for reconsideration was denied in the 6-1 vote.

Each person knows an individual who gives back to the community by creating positive change. The Russ Berrie Making a Difference Award has been recognizing those changemakers for almost 30 years.

Nominations are now open for the 2023 awards through Feb. 10. Established by the late Russell Berrie and hosted by Ramapo College of New Jersey, the awards honor New Jersey residents whose outstanding community service and heroic acts have made a substantial impact on the lives of others, according to a press release.

With more than 400 honorees since the inception of the Russ Berrie Making a Difference Award in 1997, more than $3.9 million in cash awards have been presented to recognize the personal sacrifices and commitments the selected individuals have made to serve others, according to the press release.

Their work is improving people’s lives and making communities stronger. The nominees include community leaders, affinity groups, ethnic and religious organizations, nonprofit leaders, volunteers, among many others in such areas as community service, volunteerism, social justice, community life, environmental issues and a range of advocacy topics.

Ten outstanding changemakers will be honored at the 27th Anniversary Award Ceremony on May 5. There will be one top award of $50,000; two $25,000 awards; and up to seven $7,500 awards. Nominations can be submitted through Feb. 10 at www.BerrieAwardNJ.org.

N.J. recorded environmental highlights in 2022

The year 2022 will go down in history as one defined by many challenges. The COVID-19 pandemic dragged into its third year, the war in Ukraine destabilized world security and finances, and record heat, droughts and storms again brought home the reality of a changing climate. New Jersey, like everywhere else, shared the pain.

Despite these difficulties, this state we’re in made encouraging progress in 2022 on environmental protection, conservation and outdoor recreation.

Highlights include reduced plastic pollution, a partial ban on pesticides that harm bees and other pollinators, a task force studying ways to boost protections for public forests, work to implement the Environmental Justice Act, steps to advance clean offshore wind and solar energy, and more.

Plastic bag ban –

gas emissions while providing critical habitat for wildlife, outdoor recreation, and clean air and water.

Yet the vast majority of New Jersey’s public forests are not adequately protected against inappropriate logging, over-browsing by deer and invasive species. In 2022, a Forest Stewardship Task Force was established to develop recommendations to the state Legislature to better protect and manage public forests.

• More offshore wind and solar energy – A key part of New Jersey’s climate action plan is a transition from fossil fuels to clean, renewable energy.

• Warehouse development – In 2022, New Jersey continued to see significant development of massive warehouses in many parts of the state, threatening prime farmland and communities already overburdened by pollution.

The State Planning Commission issued voluntary guidelines to help municipalities plan for warehouse development, but the state and municipalities are still lacking the tools needed to deal with this challenge.

In May, New Jersey’s ban on single-use plastic shopping bags went into effect. Thanks to the state’s 2020 Plastic Pollution Reduction Act, shoppers were required for the first time to supply their own reusable bags.

By the end of the first year, New Jersey will have avoided using an estimated 3.44 billion plastic bags and 68 million paper bags, preventing tons of waste from going into landfills and waterways.

• Protecting pollinators – In 2022, Gov. Phil Murphy signed the Save the Bees bill, which limits neonicotinoid pesticide applications in non-agricultural settings like gardens, lawns and golf courses.

“Neonics” don’t just kill insect pests; they also wipe out beneficial insects, including butterflies, wild native bees and domesticated honeybees. In turn, bird populations decline because of the loss of food sources.

While the new law is a positive step, neonics are still allowed in New Jersey for agricultural uses.

• Forest Task Force – Forests and other lands sequester and store about 9% of New Jersey’s annual greenhouse

The New Jersey Board of Public Utilities took a step forward in 2022 by implementing a new utility-scale solar program that will result in more clean energy while bringing down the costs of solar incentives and ensuring sound siting to protect important farmland soils and forests.

• “Outside Together” – New Jersey began working on the new Statewide Comprehensive Outdoor Recreation Plan, which will set strategies for open space and recreation for the next five years and is required to maintain eligibility for funding from the National Park Service.

• Black Heritage Trail – A new state law signed in 2022 will establish a Black Heritage Trail linking landmarks, heritage sites, museums and attractions highlighting moments of political, military, artistic, cultural and social importance in the state’s Black history.

Despite this progress, New Jersey still has plenty of work to do on environmental and conservation issues:

• Environmental Justice Law – For years, New Jersey’s poor, urban, black and brown communities have borne the brunt of environmental contamination.

In 2020, Gov. Murphy signed the landmark Environmental Justice Act to help protect overburdened communities. Rules implementing the act were introduced in the summer of

• Fixing state parks – In 2022, a partnership of conservation organizations – including New Jersey Conservation Foundation – launched the “Fix Our Parks” campaign highlighting the need for more funding and stronger enforcement to protect New Jersey’s state park system.

A report commissioned by the Pinelands Preservation Alliance found that state parks are underfunded, understaffed and facing threats from illegal off-road vehicle use and dumping. The Governor and Legislature should make increased funding a priority in the upcoming budget.

• Flood prevention – In 2022, the state Department of Environmental Protection published draft rules to better protect communities from flooding from extreme storms, like the remnants of Hurricane Ida in 2021. The public comment period ends on Feb. 3.

If adopted as written, the new rules will raise flood plain elevations by 2 feet, making it harder to build in areas near rivers and streams, protecting lives and property.

“We have heard the board’s concerns” regarding the house of worship, the attorney said.

The Jackson School District will hold a preschool lottery from Jan. 19 through Feb. 10 to offer open spots to residents interested in the district’s free preschool program for the 202324 school year.

The preschool lottery form will be available after 9 a.m. Jan. 19 on the district website at www.jacksonsd.org/ preschool. The lottery signup form closes at 4 p.m. Feb. 10.

Respondents will then be chosen at random and contacted according

to their lottery positions to be offered a spot in the district’s preschool program, according to a press release.

The district’s preschool program offers a free, full-day program to students who will be either 3 or 4 years old by Oct. 1, 2023. The program is taught by certified teachers and features developmentally appropriate, fun and interactive learning experiences that transition easily into the district’s kindergarten curriculum, according to the press release.

The program is free due to a competitive grant earned by the school district. The grant allowed district administrators to expand enrollment, however, spots are limited.

The preschool lottery determines the order in which parents will be contacted to register in the program. Families currently enrolled in Jackson’s preschool program do not need to reapply.
