BLUEKNIGHT TO GROW ASPHALT TERMINALS

Blueknight Energy Partners LP has announced it has entered into a definitive agreement to acquire an asphalt terminal and 200acre industrial park in Colorado and, in a separate arrangement, entered into a definitive agreement to organically expand the storage, logistics, and product capabilities at an existing asphalt terminal owned by Blueknight. The projects were approved by Blueknight’s board of directors. The combined capital requirements for the two growth projects are expected to range between $14 and $16 million

initially, with potential future expansion opportunities ranging between $5 and $10 million in additional growth capital.The projects will be funded with borrowings available under Blueknight’s revolving credit facility and are expected to deliver attractive investment returns in-line with management’s long-term targets. The weighted-average customer contract term related to the two projects is approximately eight years. “We are pleased to announce projects that showcase our ability to identify and execute accretive opportunities with high-quality customers that fully align with our growth strategy and further enhance Blueknight’s asphalt terminalling portfolio,” commented Andrew Woodward, chief executive officer. Blueknight has entered into a definitive agreement to acquire a 200-acre industrial property in Colorado from an undisclosed seller. The site includes an asphalt terminal with approximately 335 thousand barrels of liquid asphalt

storage capacity, of which 155 thousand barrels of storage capacity is operational and currently leased by an existing Blueknight investment grade refining customer. Blueknight plans to further expand current utilization of the existing asphalt terminal and other industrial services at the site not currently factored in its return expectations. Closing is expected to occur in the next 30 to 60 days subject to customary closing conditions. The company has also entered into a definitive agreement with a current thirdparty customer to materially enhance the site capabilities of an existing asphalt terminal owned by Blueknight. Project scope includes the construction and installation of inbound rail logistics, blending equipment for polymer modified asphalt, and additional tank storage. Blueknight anticipates the project will be in service during the fourth quarter of 2022 with initial construction pending final permitting and regulatory approval.

MODULES 1 | Introduction Safety share, introduction of presenters, and introduction of modules and learning objectives of each 2 | The Goldilocks Story (or is it the Three Bears Story?) There are lots of lessons to be garnered from this 19th century tale. By looking at Goldilocks and her antics with the three bears we can understand how level of risk acceptance is not absolute, but relative, and this will help understand when processes and procedures are required, recommended, or merely suggested. 3 | Definitions Some highlighted definitions are essential to understanding hazards in the facility and often misunderstandings can lead to errors. 4 | Hazards in the Plant This module is a thorough examination of potential hazards found in a terminal, many of which that are often overlooked, along with a mitigation strategy applying the hierarchy of controls. 5 | Product Transfer The risks are highest when product is transferred. This module looks at the requirements of the latest edition of API 2350 for overfill protection as well as mitigating hazards when transferring product by vac truck and when tanks are being opened and cleaned.

7 | Emergency Planning and Confined Space Rescue Expect the unexpected! The better that you can plan or anticipate emergencies and their consequences, the better prepared you are to deal with them when they occur. 8 | PPE Discussion This discussion centers on personal protective equipment and other equipment that is commonly used in the facilities, but not universally treated with the same risk acceptance level. This includes cell phones, gloves, and fire retardant clothing as well as other commonly used items. We will explore the “gray” areas of safety equipment selection that vary from facility to facility. 9 | PHMSA, OQ, Drug Program Compliance and Return-to-Service PHMSA and DOT affects many facilities, even if the entire facility is not subject to DOT. The failure to follow these regulatory requirements may subject the facility to citations. As with many regulations, there is not always a defined path forward and this module discusses the OQ rule as it applies to different tasks as well as the drug testing requirements in detail. It includes a review of strapping and strapping schedules as well as risk mitigation when performing a return to service.

INDUSTRY SUPPORT FOR LARGE-SCALE CCS TECHNOLOGY CONTINUES MOMENTUM IN HOUSTON

Three additional companies have announced their support for exploring the implementation of large-scale carbon capture and storage (CCS) technology in and around the Houston industrial area. Air Liquide, BASF and Shell are joining Calpine, Chevron, Dow, ExxonMobil, INEOS, Linde, LyondellBasell, Marathon Petroleum, NRG Energy, Phillips 66 and Valero to collectively evaluate and advance emissions reduction efforts in and around the Houston industrial area. The announcement increases the momentum for CCS and aligns with efforts to reduce emissions around the world. The 14 companies are evaluating how to use safe, proven CCS technology at Houston-area facilities that provide energy and products for modern life, including power generation and advanced manufacturing for plastics, motor fuels and packaging. In December

2021, the companies held a series of workshops at the University of Houston to discuss collaboration and activation of this important, large-scale emissionsreduction effort.

Together, these companies and others in the region could capture and safely store up to 50 million metric tonnes of CO2 per year by 2030 and about 100 million metric tons per year by 2040, helping to significantly reduce emissions in the Houston region.

Wide-scale, affordable deployment of CCS in the Houston area will require the support of industry, communities and government. If appropriate policies and regulations are put in place, CCS could help the United States and Houston reach net-zero goals while generating new jobs and protecting existing jobs that are important to Houston’s economy. CCS could also promote long-term economic growth in Southeast Texas and beyond.

These efforts have already gained broad support in the Houston region, including from Houston mayor Sylvester Turner, the Harris County Commissioners’ Court, the Greater Houston Partnership and the Centre for Houston’s Future. “Large-scale carbon capture and storage in the Houston region will be a cornerstone for the world’s energy transition, and these companies’ efforts are crucial toward advancing CCS development to achieve broad scale commercial impact,” said Charles McConnell, director of University of Houston’s Centre for Carbon Management in Energy and former assistant secretary in the US Department of Energy. “As the energy capital of the world, Houston has the expertise and leadership—including industry, academia and policymakers—to realize a low

CCS is one of the few proven technologies that could enable some industry sectors that are difficult to decarbonize, such as manufacturing and heavy industry, to decrease greenhouse gas emissions. The International Energy Agency projects that CCS could mitigate up to 15 percent of global emissions by 2040, and the UN Intergovernmental Panel on Climate Change estimates global decarbonization efforts could be twice as costly without the technology. Discussions continue with other companies that have industrial operations in the Houston region, potentially increasing the projected total CO2 that can be captured and safely stored.

SPCC & FRP FY18 & 19 Inspection Findings, Common Problems and Innovative Practices, Mark Howard and Troy Swackhammer, EPA Office of Emergency Management (OEM), Oil Branch (Invited) Come see EPA’s Headquarters National Oil Program Implementation Managers present information on SPCC and FRP inspection findings from FY 18 and FY 19, explain/clarify some of the rules’ confusing requirements and provide materials to assist with SPCC and FRP compliance. The Environmental Protection Agency (EPA) conducted an internal quality and consistency review of a sample of Spill Prevention, Control, and Countermeasure (SPCC) Plans and Facility Response Plans (FRPs) required under 40 CFR part 112. The review was to inform the Agency’s continued outreach to provide regulatory clarity and improve SPCC and FRP compliance. EPA surveyed regional offices for data related to SPCC Plans and FRPs reviewed during routine compliance monitoring activities for Fiscal Years 2018 and 2019. Facilities with identified Plan deficiencies were reviewed in order to assess Plan inconsistencies with the applicable rule requirements, and EPA subsequently developed a fact sheet showing the most frequent deficiencies found. This presentation will provide details and examples of the most common SPCC and FRP Plan deficiencies with the aim of clarifying SPCC and FRP requirements and improving compliance at regulated facilities. The presentation is targeted to tank owners and operator, tank inspectors, environmental compliance staff, facility owners and operators, and professionals want to learn more about the SPCC and FRP rule (40 CFR part 112). Mark Howard: Mark Howard is an Environmental Scientist with the Headquarters Office of the United States Environmental Protection Agency’s Office of Emergency Management (OEM), Regulation Implementation Division (RID) in Washington D.C. He is the Spill Prevention Control and Countermeasure (SPCC) National Technical Expert. He also serves as the SPCC Team Leader, national project manager for the Inspector’s Training Program, the Oil Program representative/instructor for the OSC academy, and the lead for the Oil Program Technical Workgroup. He is also the lead technical member of the SPCC rulemaking workgroup and is one of the authors of the SPCC rule (40 CFR part 112). Mr. Howard served as the OEM lead for reviewing the Keystone Pipeline Environmental Impact Statement

(EIS) and Agency Hydraulic Fracturing Study. Mr. Howard was consulted by the National Academy of Sciences on their diluted bitumen paper. Mr. Howard is an active voting member of the STI SP001 committee. Mark also is the EPA executive Committee representative for the International Oil Spill Conference. EPA has awarded Mr. Howard with a 2018 National Notable Achievement Award for inspector training, a silver medal and several bronze medals. Prior to his Federal service he worked ten years as a State oil/ Haz-Mat responder and AST inspector with the Commonwealth of Virginia’s Department of Environmental Quality. Mr. Howard holds a Master of Science Degree in Biology (Specializing in Environmental Science and Policy) from George Mason University. He holds Virginia Emergency Services certifications as a Hazardous Materials Specialist and Incident Manager. He is most proud of his relationship with his wife Christine and daughter Hope. Troy Swackhammer: Academics: B.S. Chemical Engineering, University of Virginia, 1988 M.S., Civil-Environmental Engineering, Virginia Tech, 1994 Work Experience:• Versar, Inc. and SAIC, Virginia offices, 1988-1992: Environmental consulting engineering work in the areas of insurance and property acquisition audits, UST compliance and site remediation. • Metropolitan Washington Airports Authority, 1992-1996: Environmental engineering work for DCA and IAD, with focus on AST and UST compliance under the Phase 1 Capital Development Program. • U.S. EPA, 1997-present: Member of Oil Branch in Office of Emergency Management working on oil spill prevention and preparedness policies and regulations under 40 CFR 112, which includes the Spill Prevention, Control and Countermeasure (SPCC) and the Facility Response Plan (FRP) regulations. The purpose of the Spill Prevention, Control, and Countermeasure (SPCC) rule is to help facilities prevent a discharge of oil into navigable waters or adjoining shorelines. This rule is part of the U.S. Environmental Protection Agency’s oil spill prevention program and was published in 1974, under the authority of Section 311(j)(1)(C) of the Federal Water Pollution Control Act (Clean Water Act). The rule may be found at Title 40, Code of Federal Regulations, Part 112. A facility is covered by the SPCC rule if it has an aggregate aboveground oil storage capacity greater than 1,320 U.S. gallons or a completely buried storage capacity greater than 42,000 U.S. gallons and there is a reasonable expectation of an oil discharge into or upon navigable waters of the U.S. or adjoining shorelines.

PLANNED IN PERSON: Spill Prevention Control and Countermeasure (SPCC) Overview and review of the Guidance Document for Regional Inspectors Mark Howard, U.S. EPA, Office of Emergency Management (invited) The short course is available for all SPCC stakeholders. This short course will provide an overview both the rule and the SPCC Guidance for Regional Inspectors. The session will be approximately four hours long, including time to address questions. This short course will describe the requirements for SPCC facility owner/operators and certifying professional engineers. The course will include an overview of the rule, the elements from the revised inspector guidance document and implementation issues encountered since the last course. This overview will include but is not limited to: • Applicability • Jurisdiction • General plan elements • Oil Filled Equipment (OFE) • Testing requirements • Qualified facilities • Specific requirements for bulk facilities • New for 2022: Report out on SPCC FY 18/19 inspection findings. An abbreviated version of the full conference presentation on an EPA analysis on inspection finds will be presented. This will provide attendees with feedback from actual SPCC inspections on common violations and best practices. The intended audience for this short course is stakeholders in the SPCC regulated community, which include, but are not limited to, Professional Engineers (PE), consultants, insurance professionals, and facility owners who maintain SPCC Plans or will be updating SPCC Plans. This presentation is similar to the presentation provided to EPA. You do not need a background in SPCC to attend.

In 1994, EPA finalized the Facility Response Plan regulation at 40 CFR Part 112.20 and 112.21. Promulgated under the authority of the Oil Pollution Act of 1990, the regulation requires certain facilities that pose the risk of substantial harm to the environment to prepare plans to respond to a worst-case discharge of oil. FRP-regulated facilities must prepare and submit a plan to their EPA Regional Administrator. EPA reviews and approves FRPs for certain facilities that have the potential to cause significant and substantial harm. There are about 3,800 FRP plan holders in the U.S.

TEXAS LNG AND ENBRIDGE SIGN PIPELINE AGREEMENT

The parties signed the deal for a term of at least 20 years. VCP consists of a 160-mile pipeline originating at Agua Dulce and extending to the Port of Brownsville. So, a ten-mile lateral will now extend the pipeline to Texas LNG’s facility. This is in addition to the compression facilities on the existing pipeline.

Texas LNG Brownsville, which is developing an LNG export terminal in South Texas, has signed a long-term pipeline gas supply agreement with Enbridge. Texas LNG Brownsville is a controlled subsidiary of Glenfarne Group. It is developing a 4 million tons per annum (mtpa) LNG export terminal in the Port of Brownsville, South Texas. Enbridge, a North American energy infrastructure company, has now executed a pipeline transportation precedent agreement. The deal specifically refers to the expansion of the Valley Crossing Pipeline (VCP). Under the deal, Enbridge will deliver approximately 720 million cubic feet per day of natural gas to Texas LNG’s facility.

Furthermore, VCP’s pipeline header interconnects with ten gas pipeline systems with a total receipt capacity of 7 bcf per day. The compression facilities at Agua Dulce will use electric motors, thus reducing CO2 emissions. “We can leverage Enbridge’s leading natural gas pipeline expertise to safely transport responsible natural gas to our ‘green by design’ LNG facility,” said Vivek Chandra, CEO of Texas LNG, in conclusion. “Enbridge is committed to the development and advancement of the VCP as it serves Texas LNG and helps the facility meet global LNG demand,” added Bill Yardley, Enbridge’s executive vice president. “We welcome the opportunity to expand our pipeline solutions in support of LNG efforts.”

Glenfarne is a developer, owner, and operator of energy transition infrastructure. Through its controlled subsidiaries, is the managing member and majority owner of Texas LNG. Glenfarne’s CEO Brendan Duval said: “The execution of this agreement is the next of several important milestones Texas LNG will achieve as the facility moves toward a final investment decision. Our agreement with Enbridge helps us accomplish our strategy of delivering LNG to our own gasconsuming projects around the world and to third-party customers.” Therefore, Texas LNG expects to achieve the final investment decision (FID) in 2022 and commercial operations in 2026. The agreement is subject to routine conditions precedent and other industry-standard provisions. The 4 mtpa capacity of the facility fills the need of LNG customers seeking smaller contracted volumes to diversify their gas supply portfolio.

HARVEST MIDSTREAM SIGNS PSA TO ACQUIRE ARROWHEAD ST HOLDINGS

Houston based Harvest Midstream have announced the signing of a Purchase and Sale Agreement (PSA) to acquire the remaining interest in Arrowhead ST Holdings, LLC (ASTH) from its joint venture partner. Harvest is already the operator of ASTH and a 25 percent owner of the joint venture. ASTH, a fully integrated Eagle

Ford midstream business, spans the most active areas of the Eagle Ford. The system delivers to numerous crude export docks and into Flint Hills Corpus Christi and Valero Three Rivers refineries. This is part of Harvest’s ongoing efforts to expand its suite of crude oil transportation and logistics services for upstream and downstream customers. “This is another example of our continued commitment to South Texas and the Gulf Coast. When we close this transaction, we will own 100 percent of these assets that we have safely and reliably operated for over a decade,” said Jason Rebrook,

CEO of Harvest Midstream. “This is an exciting opportunity for Harvest to continue to grow and provide first-inclass service. We believe strongly in the outlook for the Eagle Ford as a top producing oil basin.” The ASTH system includes about 515 miles of pipeline with a total throughput capacity of 380 m bpd. The system is a key link between the Eagle Ford Basin producers and Corpus Christi, the leading crude export market in the United States. Pending regulatory approval, the sale is expected to close in the first quarter of 2022.
