My First Body Shop

It is so strange how life can just pass you by. A blink of an eye and boom, 40 years have gone. It really shouldn’t take a pandemic to make us all realize that. We all need to live while we are alive. Fear is a terrible thing, and it will paralyze you in so many ways. Don’t be paralyzed, because tomorrow you may turn around and boom… It was around 40 – in fact, 42 years – ago that I first came into contact with the auto body business, not knowing that it would be a part of the rest of my life. I’ve told the story many times of how I went out for a Whopper at Burger King and ended up getting hit by an 18-wheeler that decided to run a red light before I even had a chance to “have it my way.” When I woke up in the hospital, one of the first things I asked was, “What happened to my car?” Page 1 Now, everyone knows that your first car is special. Mine was a 1978 Camaro, silver on the outside with black leather inside and a kick-ass eight-track tape

deck. I had only received it as a graduation gift a few months earlier, so it was my baby. When I was told it was brought to a body shop in Belleville, I kind of nodded and fell back to sleep. Since I was never really a car guy, I had never been to a body shop. So, my very first visit to J.A. Auto Body was an eye-opener. First of all, it was hidden down a tiny residential street on the Nutley/Belleville border. Secondly, the shop was the “official” body shop of my dad’s construction company, and I didn’t know my dad had an official anything. Lastly, when I met the owner, I couldn’t understand a damn thing he said. His name was Yoshio Sugawara, and he was one of the nicest, funniest guys I have ever met. I also thought it was really strange how my dad and his brothers, who were never the most tolerant people in the world, contracted with this place to do all their

repair work. But once I got my car back, I began to understand. Yoshio did an incredible job, and my prized Camaro looked good as new, even though my back and neck certainly weren’t (and never would be). Fast-forward to 1984. I had started working in publishing, and I attended my first AASP/NJ meeting in Rochelle Park. As I was nervously sitting there not knowing anyone, who should walk in but Yoshio, who I hadn’t seen since he repaired my Camaro. “Tom, what are you doing here???” I couldn’t believe he remembered me. “I’m covering the meeting for the association’s magazine.”

“Oh, very good. Can you put my picture in it?” “Uh, that’s not my decision, but I will ask.” “Very good, Tom. Say hello to your Captain Ralph for me.” (My dad...Captain Ralph? LOL.) Now, since I have been privileged to stay in this industry for the past 36 years, I have seen Yoshio several times. We always chat briefly, and he always asks if I will put his picture in the magazine. And I always say I will do my best. Last October, I happened to be going through some old family photos and came across a picture of Yoshio with my parents. There was no date on it, but since my dad passed away in 1984, my

guess is it was taken some time in the ’70s. I immediately scanned it and emailed it to Yoshio. “Yosh…Do you recognize the guy in the middle? He responded immediately. “That was my younger brother!” “LOL. Long time ago…Do you remember where that was?” I replied. “Your cousin’s wedding or Captain Ralph’s daughter’s wedding. This picture is a precious memory. Your parents were very good to me. Thank you again for the great picture.” “Thanks, Yosh. That means a lot.” Continued on page 25

PRESIDENT’S MESSAGE by JERRY MCNEE

The past few months have been like nothing else I’ve seen in the 45 years I’ve been in the collision repair industry. I know, this is the understatement of the century, but I’ve been working to figure things out just like every other member of AASP/NJ. It’s been like trying to catch a dozen fish in a bowl with a single swoop of a net. I hope everyone reading this is still keeping their businesses moving forward – or at least keeping steady – as the mysteries surrounding COVID-19 continue to present themselves. Just about everybody I know in the auto body industry has taken out a PPP loan, and it has been a blessing for many of us. Now, with the time required to pay back these loans recently extended from eight weeks to 24, we are facing new logistical obstacles on the financial front. If you’re unsure of how to deal with your loan, please contact AASP/NJ and we will direct you toward the most current and accurate information available. Everything involving this pandemic is a moving target, but we’re here to assist you in getting the answers you need. Although it has threatened to creep into our business

in a big way for a very long time, photo estimating has obviously become a common practice now in light of coronavirus. As we feared, this has created new administrative burdens for many shops. Several insurer estimates I’ve seen based off photos make me wonder if the people writing them had their eyes closed at the time. Negotiations between shops and insurers are becoming more problematic, and jobs are taking longer to complete as a result. Things are stressful enough right now; the last thing we need is a new hurdle to overcome. The insurance industry is looking to reduce the expenses for each claim it handles, and keeping estimators off the road is a good way to do that. I get it, but it isn’t right that they expect to put that on our shoulders. I don’t get to negotiate my premium with my insurance carrier; I can’t say to them, ‘I received my premium bill. You know what? Let me send you a quarter of it.’ That wouldn’t work, but they have no problem doing it the other way around. The use of photo estimating is bound to grow, but the system as it is right now is a

Level the Scales by Knowing the Rules! EXECUTIVE DIRECTOR’S MESSAGE by CHARLES BRYANT

Can anyone imagine playing a game – football, for instance – without knowing the rules or having to rely on someone on the opposing team to lay them out? Well, I would be willing to bet that you would rarely win. Knowing the rules is crucial to anything we do in life. With that said, why do so many collision shop owners depend on or allow insurance companies to dictate what they can or cannot charge for? With all due respect, I think the answer to that question is related to a lack of knowledge. AASP/NJ is about to change that! For as long as I can remember, it has been a common practice for insurance appraisers to say, “We don’t pay for that.” They also like to say, “You are the only one who charges for that.” It actually irks me to repeat that first quote. When collision shop owners hear this, they mostly seem to just take it for granted that it’s okay for an appraiser to refuse to pay for an item that is necessary to safely and properly repair a damaged vehicle. The other excuse, “You are the only one who charges for that,” still baffles me to this day. I ask you now, what is the relevance? Just because someone else in another shop chooses not to charge for an item or service that has to be done does not mean that you are not allowed to charge for it. Based on many years of experience in the collision industry, I have come to know that many shop owners are craftspeople who saved their money and worked their way up to running a business. Many have a tendency to seek guidance from other shop owners in the industry. Although it may not be true that you are the only one who charges for a particular procedure or item (but it is true that an insurer saying they won’t pay for something is NOT a legal basis for their refusal to pay for a necessary repair procedure), seasoned shop owners very well may advise a new shop owner to go along with it and don’t make waves because even these experienced professionals may not know how to reject such things themselves. So, what or where are the rules that insurance companies must follow during the settlement of auto accident damage claims? Are there even rules that insurers must follow? The answer is yes. It’s no secret that many things in the past were based on a Let’s Make a Deal scenario. An insurer might have said something like, “We don’t pay for that,” as I mentioned before. That insurer might have followed that up with, “However, I will give you an extra half hour on another item to make up for it.” Maybe the insurer would

say, “We only pay X amount per hour, but I will give you a couple extra hours on the frame.” That is exactly how insurers have held Labor Rates down for years to an amount less than bicycle shops get paid for their services. With today’s vehicles, those days are over. There are specific repair procedures that must be followed and have to be performed in order to put the vehicle back to a safe operating condition after it’s damaged in a collision. With that said, collision shop owners need to know where to find these rules. Some of them include (but are not limited to):

q a customer’s right to a timely inspection of a damaged vehicle;

q a customer’s right to choose the shop of their own choice;

q the requirement of good faith negotiations on the cost of repairs;

q insurers remaining liable for hidden damage; q rules on improper betterment deductions; q limitations on the use of inferior aftermarket parts;

q rules that insurers must follow before stopping payment of storage charges; and

q a customer’s right to be paid for rental reimbursement and loss of use.

AASP/NJ often holds meetings to discuss issues like these. However, due to the COVID-19 pandemic, faceto-face meetings are not an option at this time. Therefore, on August 19, AASP/NJ will be holding a special Zoom meeting to inform our members of the rules on these and other issues. Attendees can take part from the comfort of their own homes. I strongly recommend that AASP/NJ members keep an eye out for the meeting details and make every effort to attend. See you there. NJA

AASP/NJ Virtual Meeting Helps Members “GET BACK TO WORK” Safely AASP/NJ held its first-ever virtual training meeting on July 9 to provide member shops with the proper resources and direction needed in order to bring their employees back to work because of the COVID-19 pandemic. Dozens of AASP/NJ members logged on to Zoom for “COVID-19 - What’s Your Game Plan? Return to Work Safely Strategy!” to hear from Jack Spottiswood and Bob Plett of American Compliance, who provided details on the steps being taken to reopen the country, preventative measures, training and how to be aware of and handle employees with symptoms. “Obviously in the world we live in today, this ‘new normal’ is not the old normal...These are the things we need to do to protect ourselves and our employees,” stated AASP/NJ President Jerry McNee. Spottiswood informed the automotive community about the Families First Coronavirus Response Act (FFCRA), which grants full-time employees with two weeks’ (up to 80 hours) worth of pay if they are sick or caring for a family member who is sick. For part-time employees, the paid

leave would amount to the equivalent of their total hours over a two-week period. Via the Act, employers can get a refundable payroll tax credit on the two-week paid leave. “If additional sick time is needed, the employee will have to use whatever amount of sick time they have available through their employer,” explained Plett. “One of the points [of the Act is] trying to get people to know that they should stay home if they are sick and that you are going to pay them,” added Spottiswood. In addition to going over the basics of making sure to enforce hand washing and mask wearing, they advised AASP/NJ members to take a look at their work environment and see how things can be set up to make employees practice social distancing by limiting areas where people may tend to congregate, such as a break room or a lunchroom. Spottiswood suggested that due to the circumstances of these extreme times, it may be safest to have employees eat their lunch at their own workstations instead of at a table shared by many.

Other strategies toward creating a safer environment include having nonessential workers telecommute, staggering work shifts and restricting entry to the facility for non-employees, including delivery people who can just easily leave items outside rather than enter the building to hand them off. Spottiswood suggested employers consider keeping their employees informed about their community, workplace and the steps that need to be taken around the facility in order to help staff members understand why these measures are so crucial. “If workers aren’t buying into it, it’s not going to happen...If you tell them ‘just do it’ but they don’t know why, they may not do it. A Smoother Ride:

PPP Loans Keep Shops Moving “We can only take it day by day. We don’t know what’s going to happen tomorrow.” When Joe Dolcemascolo, shop manager at B&C Auto Service in Rutherford, recently said those words to New Jersey Automotive, he summed up the current mindset of everyone involved in the collision repair industry. Although nobody has a crystal ball to determine what the next few months will bring, the good news is that Dolcemascolo and various other AASP/NJ members are staying strong thanks to keeping a positive attitude and receiving financial assistance through Payroll Protection Plan (PPP) loans. At Dolcemascolo’s shop in particular, things are finally looking up after months of uncertainty. When the COVID-19 lockdown hit, he suddenly found himself repairing vehicles solo without the help of his usual seven-person staff. Adding further stress to this unsettling eight-week period was the fact that he usually had only one vehicle to repair every seven days. “When there was nobody on the road, there was nobody coming in. When I was here those first eight weeks when everybody got shut down, I was lucky if the phone rang once a day.” With the support of his wife, Tricia, Dolcemascolo kept the shop moving until he eventually received a PPP loan and was able to bring back his full crew. To make the situation even better, his employees’ return several weeks ago coincided with a welcome jump in work as summer arrived. Paul Sgro of Lee’s Garage in West Long Brach is another association member who benefitted greatly from PPP loan support. “It was very helpful for us in the very beginning, because things [back then] were like someone turned a water faucet off. It did help us retain our employees and enabled us to continue on.” Thanks to this assistance, Sgro’s 26-person staff has stayed in place. He also credits the loan with keeping morale high on the shop floor. In his mind, working to maintain the positive mental health of his workforce is just as critical as ensuring their technical skills and training. “Helping them and enabling them to feel secure and

comfortable in knowing that you’re there for them and got their backs is very important. I hope a lot of companies wouldn’t forget that, because these guys and gals who work for us are very, very important to us. “Entrepreneurs have to be leaders,” he adds. “We have to lead our people knowing what we’re doing and how to get through it. Some new owners and businesspeople don’t have a lot of battle scars from going through all the years of challenges we went through in the ‘80s and ‘90s. [This profession] has always been something you have to survive and be able to work through. Your employees look to you for that leadership; you’ve got to be able to be strong and know you’re going to get through it and move forward.” Down in Toms River, John Hyers of Hyers Auto Body has kept his 10-person team on board thanks to securing a PPP loan and is slowly returning to a more normal schedule. This upward trend is being helped along by Hyers’ commitment to diversifying his services. About a decade ago, he drastically reduced his shop’s collision repair services in favor of specializing in upfitting trucks for landscapers, contractors, dealerships and other clients. Although he still keeps a light auto body schedule, he primarily focuses on customer-pay work these days – giving him fewer headaches than most shop owners at a time when insurers are pushing for photo estimating and refusing to do inperson negotiations in light of the pandemic. “Now, if [the job] doesn’t go my way, I don’t fix it.” After securing the loan, Hyers was able to keep his crew working even when he faced delays in getting the parts needed to work on trucks. “We had trucks sitting here waiting for components, so we weren’t getting paid. We kept all of our employees on from the very beginning, but there were days when there was nothing in the shop because we didn’t have the components we needed. Guys were cleaning and sweeping floors, sorting bolt bins – whatever they had to do.” While it is impossible to predict how the Government would provide help during a second wave of COVID-19 and/or another lockdown, recent changes to the PPP loan Continued on page 28

Jeff Peevy Named I-CAR VP of Technical Products, Programs and Services

I-CAR has announced the addition of renowned collision repair industry veteran Jeff Peevy, AMAM, to its executive leadership team as vice president – technical products, programs and services. In this new role, Peevy will spearhead the strategic development and growth of all I-CAR curriculum and technical relations efforts while leveraging his 20-plus years of executive management experience in the industry. Most recently, Peevy served as president of the Automotive Management Institute (AMI) since 2015 and as the 2019-2020 chairman of the Collision Industry Conference (CIC). structure could offer some additional relief to businesses struggling in the here and now. Passed on June 5, the PPP Flexibility Act is designed to increase the likelihood of greater forgiveness for borrowers and simplify the overall forgiveness application process. Additionally, it extends the timeframe for loan recipients to use the funds provided to them from eight weeks to 24. As of this writing, PPP funds must be used by December 31. The current deadline to apply for a Payroll Protection loan was August 8 at press time. As New Jersey and the rest of the country reach the sixth month of our national crisis, the auto body industry is moving ahead in a state of cautious optimism. There is certainly plenty of ambition to keep going, but there exists an equal amount of ambiguity over how the rest of 2020 will play out. Perhaps the only undeniable truth to this situation is that the industry will enter 2021 much differently than it did last January. “I’m sure other shops will agree that business is not going to be as it was in the past,” Sgro says. “It’s going to be different, and we have to be able to adapt to that and what’s coming forward.” NJA

While this year’s in-person show at the Meadowlands Exposition Center has been postponed until 2021, AASP/NJ is pleased to offer a virtual alternative for the vendors and thousands of attendees who would have comprised the brick-andmortar event.
