LEGISLATIVE UPDATE

Legislative Session Off and Running by Kevin Walli, AASP-MN Lobbyist

The State Legislature convened on January 3 with approximately 20 percent of the legislators being elected to their first term in the House or Senate. The early weeks of the Session are largely spent on orientation for members old and new. Oftentimes veteran legislators are reassigned or ask for reassignment of the Committees on which they serve. AASP-MN faces somewhat of a challenge in 2017, as we have new leadership – with long ties to the insurance industry – particularly in the Senate. Nonetheless, we will be advancing our legislative agenda and meeting with legislators – even those with whom we don’t always see eye-to-eye. We will look for opportunities to advance our agenda on the insurance claims practices front. We will also be involved in issues of interest or concern that may emerge in the areas of environmental regulation and business taxation. Among the tax issues that are likely to be considered is partial exemption and/or freezing the business property tax rate, which is paid to the state general fund. The Tax Bill that was vetoed at the close of the 2016 Session would have provided an exemption from property taxation for the first $100,000 of value for businesses across the state. There was talk early in the current Session that the exemption may be extended to a somewhat higher level – perhaps $200,000 or even $300,000 of value. There is also interest in repealing the inflator that is associated with the state business property tax rate. There is a statutory inflation factor for increasing that rate which a number of busi-

ness organizations would like to have repealed. It would stop the automatic growth of this tax and make any future increase subject to specific action by the Legislature. AASP-MN will be watching the tax issues very closely and we will keep members informed of any changes – for better or for worse – on the tax front. Members are encouraged to make their way to the Capitol during the Legislative Session. The Capitol building itself has been restored to like-new condition after a three-year, $300 million-plus remodeling project. We may try to have an AASP-MN meeting at the Capitol building so that you can see the building in all its renewed splendor – and give you the opportunity to stop and see your legislators to share with them the concerns of the auto repair industry. Whenever you make your way to the Capitol – in conjunction with AASP-MN or on your own – please feel free to call the Fryberger office at (651) 221-1044 and we will give you advice on how best to reach out to your legislators while you are in close proximity to them. Every contact that we make helps our industry legislative efforts.

LOCAL NEWS AASP-MN Hits the Track to Support Student Scholarships AASP-MN recently raised over $9,000 during its 2017 fundraising campaign to support the AASP-MN Automotive Education Fund. The majority of that money was raised at the association’s 15th Annual Race for Automotive Education, held January 10 and 11 at ProKart Indoors, Burnsville, and will fund scholarships for automotive students enrolled in NATEFcertified mechanical and collision repair programs in Minnesota. During the course of the two-night event, 120 racers tore up the track in state-of-the-art European karts, reaching speeds of nearly 40 miles per hour. Many fans and spectators were also on hand to cheer their teams on. Twenty-four teams of mechanical and collision repair shops and industry suppliers were represented and the competition was fierce. Trophies were awarded to the 1st place and runner-up teams. They were: Tuesday, January 10 1st Place – St. Anthony Mobil, St. Anthony Runner-Up – Hopkins Auto Body Team #1, Hopkins Wednesday, January 11 1st Place – LaMettry’s Collision Team #1, Richfield Runner-Up – aaa Auto Parts Team #1, Rosemount

TSCHIDA IS AASP NATIONAL PRESIDENT The Alliance of Automotive Service Providers (AASP) has elected its Executive Committee for 2017-2018. The election was held at AASP’s Board of Directors meeting on November 2, 2016, in Las Vegas, Nevada. Minnesota shop owner and AASPMN member Bruce Tschida (Lake Marion Collision, Lakeville, MN) was re-elected as President. The following AASP board members will join Tschida on the Executive Committee: • Bill Adams, Fairport Exxon, Pittsford, NY • Mike Moehlenkamp, Gary’s Auto Service, Florissant, MO • Ron Reiling, AASP-Missouri, St. Charles, MO • Rick Starbard, Rick’s Auto Collision, Revere, MA

ESTIMATING TIPS Material Costs in CCC One – When replacing or repairing a part in CCC One, material costs are not included in any labor operation. This can be found in the Guide to Estimating on page G3 and DEG Inquiry 8871. Audatex Door Blackout – The refinish of the blackout on a door frame is a not-included operation in Audatex and would require a manual entry. This can be found in DEG inquiry number 5108. “We have reviewed your inquiry and the refinish black-out of the window/door frame is a manual entry. This operation is not considered a two-tone or included in the refinish time of the door panel/shell. No other changes are warranted at this time.” Fender Edging is Not the Same as Refinish Inside with CCC One – When replacing a fender, there is an option in CCC One to “Add for edging.” Edge is the area between the exterior and interior surface. If you need to refinish the inside of the fender, that

would require an on-the-spot evaluation with a manual line. This can be found in DEG inquiry 4926. Replacing a Liftgate in CCC One does not include the Wiper Motor – The Motor Guide to Estimating shows on page G24 that replacement of the Liftgate includes “Internal mechanisms” but shows in the “does not include” column the back glass wiper or washer. In DEG inquiry number 7523, CCC explains that “The Wiper Motor being the major component of the Wiper System is not an included operation.” “According to the MOTOR Guide to Estimating, “Back glass wiper or washer” are not included. The Wiper Motor being the major component of the Wiper System is not an included operation. A test estimate in CCC One has revealed when Lift Gate R&R is selected, the Wiper Arm and Wiper Motor R&I/R&R is correctly displayed on the estimate displaying the appropriate estimated work times.”

Mike Anderson is the former owner of Wagonwork Collision Centers, two highly-acclaimed collision repair shops located in Alexandria, Virginia. He is an Accredited Automotive Manager (AAM). He has served in many positions over his career, including the Mitchell and MOTOR Advisory Boards, ASE Test Review committee, Director of ASA Operations Committee, Board of Directors for WMABA, Virginia Automotive Legislative Committee, and Chair of the State of Virginia Skills USA/VICA contest. Mike is also an active member in many industry associations. He is the owner of Collision Advice, a consulting firm to the collision industry, and currently serves as a facilitator for Axalta Coating Systems’ highly recognized Business Council 20 Groups in the United States and Canada. He also facilitates numerous courses for Axalta’s Educational Series.

Raymond Chew is a National Account Manager for CCC Information Services, Inc. He has been with CCC for over 17 years in a variety of customer-facing roles. He also serves as consultant and provides his expertise across a wide breadth of industry topics, working primarily with repair organizations with multiple locations.

Jeremy O’Neal grew up in a service station and began his career in the auto repair industry by washing headlights at 8 years old. He’s been recognized as one of the industry’s most talented and skilled service advisors. In 2010, he founded Advisor Fix in an effort to help service advisors master the skills needed to excel in their field. Having worked in independent repair facilities, as well as new car dealerships, Jeremy draws from personal experience and provides real-world training to his clients. Josh Dye currently serves as the Marketing & Outreach Coordinator for HousingLink, a Minneapolis-based nonprofit. During his tenure at HousingLink, the organization reached all-time highs in website traffic and individual donations. He also spearheaded the recent launch of HousingLink’s first earned income ventures, Twin Cities Rental Revue and Housing Hub. Weekly Rounds Minnesota’s hazardous waste rules require you to inspect your hazardous waste storage containers every calendar week and document the inspection. Here’s what to look for on your weekly rounds. Check that each hazardous waste container is (1) labeled with the words “Hazardous Waste,” a description of the waste and the date waste was first added to the container. Containers of used oil and used oil filters only need to be labeled with a description of the waste. Labeling containers with this information makes it safer for emergency responders. Using stickers or writing directly on the container with a permanent marker are common and acceptable ways of labeling. Check that the label is readable and hasn’t been covered or destroyed by drips down the side of the container. Clear labels also help you (2) confirm that incompatible wastes are separated. While you’re looking at the label for each container, check that the date is within your (3) time and (4) volume storage limits. Very small quantity generators (VSQGs) can store up to 2200 pounds of waste – about four or five drums – indefinitely. After you hit 2200 pounds, you have 180 days to get rid of the waste. Small quantity generators (SQGs) can store up to 6600 pounds of waste – about 12 to 15 drums – for 180 days from the date waste was first added to the container. Next, confirm that wastes are (5) in containers that are appropriate for the waste. The containers that new products are delivered in are a good guide: corrosive wastes in plastic containers

that won’t deteriorate, flammable wastes in metal containers that can be grounded. Check that each container is (6) in good condition and free from rust, damage or cracks. Look for puddles, stains or debris that could mean there has been a leak. Check that each container is (7) latched, snapped or screwed closed. Containers must be able to hold their contents if they are dropped or tipped over. Locking funnels must be locked. Check that containers are (8) stored on a surface that is impermeable to the waste. Do not store used oil on asphalt. If containers are stored near doorways, floor drains, cracks in the floor slab or outdoors, confirm that (9) secondary containment is present and doing its job. Confirm that (10) outdoor storage is secure and covered. Check that there is enough (11) aisle space for you or emergency responders to reach or move a container without moving anything else. Check that emergency equipment is (12) available and (13) appropriate for the wastes. This includes fire extinguishers, spill clean-up materials and personal protective equipment for employees. Do these 13 items sound like a familiar refrain? They are among the most common violations found by state and county environmental inspectors. Doing a thorough job on your weekly rounds will help you stay on top of things, keeping your property clean and your employees safe. The MPCA has an inspection log you can use to document

your inspections, available by searching for “hw2-41” on the MPCA website at www.pca.state.mn.us. Consider making a customized checklist with your shop’s wastes and storage areas on it along with the requirements for each. The MPCA’s inspection log and this article are good examples to start with. You can keep paper or computer records documenting the inspections, whichever is easier for you, but you must keep the records for at least three years. Some wastes have different requirements than the ones listed in this article. For information about hazardous waste stored in tanks search for “hw1-05” on the MPCA website. For wastes such as car batteries and fluorescent light bulbs, search for “hw4-62” on the MPCA website. Airbag Compliance: Airbag recalls may leave you with a new waste: undeployed airbags. Shops are allowed to deploy airbags if you follow the airbag manufacturer's instructions. The deployed airbags can then be recycled with scrap metal. Airbags that remain undeployed must be managed as reactive hazardous waste. Use waste code D003. More information can be found by searching for “hw4-63” on the MPCA website at www.pca.state.mn.us
