Light at the End of the Tunnel by Tom Archambault AASP-MN President

As I write to you, there are fewer snow piles in my yard than yesterday, the birds are chirping just a little earlier in the morning and the sun is setting just a little later in the afternoon. By all accounts, springtime is approaching here in Minnesota. However, we would be foolish to think that we won’t see one or two more snowstorms before we can really call it spring! I have always enjoyed spring. It is a time of new beginnings. It is a time to open the doors and windows to let the fresh air and sunshine in. It is a time to tidy up and organize things because it just feels good to do it. As great as the above-mentioned spring rituals feel, there is none more satisfying than getting outside and reconnecting with friends and neighbors! I think for most of us this spring has more meaning than in years past. One year ago, when we were yearning for that connection, it was halted due to the global pandemic. Life changed. Business changed. The operators in our industry put their heads down and started grinding away doing whatever was necessary to get through. During that time, the various boards and committees met online to conduct the business of the Alliance. One common lament was shared at every meeting…the desire

to be together in person. Under the great leadership of the Alliance’s Executive Director Judell Anderson, there is light at the end of the tunnel! Prior to Governor Walz loosening some COVID-19 restrictions in March, Judell had been working feverishly (but without a fever) on plans to get us back together in person when restrictions allowed. I am happy to report that her efforts have paid off and we will soon see each other masked-face to masked-face! So, please mark your calendars and sign up to attend the upcoming Leadership Conference on May 20 and the Annual Golf Outing on June 16. The Race for Education, typically held in January, will take place September 28 – 30. I look forward to seeing all of you very soon!

LEGISLATIVE UPDATE

AASP-MN Digs in on Legislative Issues by Kevin Walli, AASP-MN Lobbyist

As we pass the halfway mark of the 2021 session, AASP-MN finds itself working a handful of issues of interest or concern to members. Proposals to change the Minnesota Salvage Title statute are once again being debated in the House and Senate. For the past several years, we have faced a proposal which would remove “late-model” and “high-value” as qualifiers for vehicles subject to salvage title – essentially making every vehicle totaled by an insurer a salvage title vehicle (regardless of age or value). This proposal has been successfully sold to the Senate Transportation Committee as a consumer protection provision – although it’s hard to measure what consumer benefit will actually occur as a result of this change. AASP-MN does not support this revision, believing that members can and should be given every opportunity to properly repair and return these vehicles to the road. Nor do Auto Auctions or Legal Aid or even the Insurance Federation of Minnesota. In fact, these groups met together on several occasions in 2020-21 to develop an alternative proposal dealing with the Salvage Title statute. We were joined in this work by a Democrat and a Republican from the House of Representatives – Representative Cheryl Youakim (DFLHopkins) and Representative Eric Lucero (R-Dayton). What emerged from this working group is a bill that is intended to provide consumers with information about the nature of the damage to the vehicle that resulted in it being designated for a Salvage Certificate of Title. The bill, House File 145, is authored by Representative Youakim and co-authored by Representative Lucero. The nature of damage to the vehicle would be identified as flood, hail, fire or collision. We have met with the chair of the House Transportation Committee to advocate for Representative Youakim’s bill rather than the bill passed by the Senate Committee. We

will be watching closely and will remain involved in the discussions relating to changes to the Salvage Title statute. Additional bills that have been proposed deal with a growing problem across the state – the theft of catalytic converters for their precious metals. The general theme of the bills is to create greater accountability for scrap dealers and others who purchase the stolen catalytic converters. Penalties would be significantly enhanced for the purchase of catalytic converters unless the buyer complies with a number of new requirements to document the seller’s legitimate possession of the part. For our part, we have been trying to spare repair shops additional burdens for handling and disposal of catalytic converters they come by during the course of normal repair and maintenance of customer vehicles. The idea is to develop language which would exempt shops from any additional recordkeeping requirements for disposal of these materials. Finally, we have been engaged in discussions with the Insurance Federation of Minnesota on some claims practice changes. We do not expect them to result in legislative action this year, but the discussions will allow us to refine our arguments for use in future legislative sessions. The first issue relates to parts procurement. Insurers routinely call for repair shops to purchase parts for the lowest price that can be found, regardless of the vendor’s location. There has been no consideration for the quality of parts or the delays and other difficulties that arise if the parts are not as advertised and need to be returned. AASP-MN has been arguing that insurers should be required to pay a reasonable market price based on the parts available within a 150-mile radius of the shop, allowing shops the opportunity to work with local vendors that they have built a business relationship with over time. We have argued that this change would be beneficial to repair shops, consumers and insurers as it would reduce cycle time for vehicle repairs, which is in everyone’s interest. This is a fight we will have to continue. The other issue we have been examining is how to expedite the final claims settlement. The Insurance Federation has shown some movement on this front. We are working with them to develop some proposed language regarding the timeline for processing supplements so that the total cost of repairs can be agreed upon before the vehicle leaves the shop. Committee deadlines preclude advancing this measure during the 2021 session, so we will have to wait for the legislature to reconvene in 2022 to move this issue forward. We will continue working on all of these issues and will report progress at the Capitol in the next edition of AASPMN News.

26th Annual AASP-MN Golf Outing Announced

The 26th Annual AASP-MN Golf Outing is a go! The event will be held Wednesday, June 16, 2021 at Majestic Oaks Golf Club in Ham Lake. All collision repair and auto service industry professionals and suppliers are invited to attend the event to enjoy a day of golfing and socializing with industry peers. Play will begin at noon, followed by dinner (under a tent outdoors) and an awards presentation. The cost to participate is $100 per golfer or $400 per foursome. Minnesota Careers in Auto Repair & Service (MNCARS) MNCARS is a non-profit organization established in 2016 by AASP-MN. Its sole purpose is to promote careers in the automotive industry, recruit young people into the state's college-level automotive service and collision repair programs and, ultimately, into industry workplaces.

Governor Walz Announces 2021 Youth Skills Training Grants

Governor Tim Walz recently announced the 2021 Youth Skills Training (YST) grants — a total of 11 partnerships across the state to develop and implement paid-learning opportunities for students 16 years of age and older. The automotive program at White Bear Lake High School was among the recipients. The school’s Career Pathways program, titled “Training Tomorrow’s Technicians”, will offer a variety of paid, experiential and training opportunities for high school students wanting to pursue a career in the automotive and transportation systems industry. AASP-MN and its MNCARS (Minnesota Careers in Auto Repair & Service) initiative will be among several industry partners in the YST collaboration. In 2020, MNCARS “adopted” the White Bear Lake High School automotive program to provide enhanced support and mentoring during the year. The program, overseen by Derek Doescher, received MNCARS/industry support in the form of multimeters, motor oil, wheel weights and other consumable supplies. Doescher commented, “We could not be growing our program like we are without the assistance from MNCARS and our local industry. We have already taken leaps and bounds to improve the education the students receive.” “Youth Skills Training grants give Minnesota students hands-on training in the high-demand fields of advanced manufacturing, agriculture, automotive, health care and information technology,” said Governor Walz. “Our state needs talented professionals in these high-growth fields, and these innovative partnerships create career pathways for younger Minnesotans while powering our future.” Grants can be used to create programs, recruit students and employers, provide training, transport students and pay for student certifications.

NATIONAL NEWS AASP, ASA, SCRS Define Scanning, ‘Qualified’ Tool, Personnel Courtesy of Repairer Driven News, March 8, 2021 On March 5, the three national collision repair trade groups released a position statement narrowly defining both the scanning operation and what constitutes a “qualified scan tool.” The document by the Alliance of Automotive Service Providers, Automotive Service Association and Society of Collision Repair Specialists also describes what the operation would look like on an estimate and outlines knowledge that “Qualified Scanning Personnel” should have. Scanning is simply “A mechanical operation to connect a qualified diagnostic scan tool into an OBD-II port or other communication ports in order to retrieve all Diagnostic Trouble Codes (DTC)s using the most current, available OEM information to ensure a proper and safe repair.” Period. Everything else is separate, according to the trade groups. “All other procedures necessary to correctly and safely identify and address a vehicle’s electronic system faults or Diagnostic Trouble Codes (DTC)s are considered additional operations and not included in the scanning operation,” AASP, ASA and SCRS wrote. (Emphasis original.) “ADAS Calibrations”; “Prepping the vehicle for a scan”; “Researching, Verifying and Documenting Manufacturers’ Data”; “Systems Initialization”; “Systems Programming”; “Test driving”; and “Vehicle Diagnostics” were among the items which would be separate operations, according to the three trade groups. From an estimating perspective, the act of scanning represents a “necessary and not-included operation” which could appear on a repair order “with either a fixed cost, in labor hours and/or set dollar amount.” Either type of line item would involve “(a) reasonable and necessary amount that may vary depending on year/ make/model and scan tool used.” The position also holds that only “OEM approved” scan tools count as qualified ones. Some OEMs will approve tools other than their factory devices, while others only permit their own technology to be used on their vehicles. It’s also important to note that OEM approval of a tool might only qualify under specific parameters, such as the device running the automaker’s

official software. Under the AASP, ASA and SCRS position statement, a qualified scan tool is “A device approved by the vehicle’s manufacturer (OEM) to provide a repair technician access to the status of the vehicle’s sub-systems. OEM approved scan tools are specific to each OEM and have the complete suite of capabilities as determined by their service engineering groups… “Scan tools are manufactured in a variety of hardware and software configurations, including PC/laptop based software application tools connected with a vehicle’s communication interface, to handheld (embedded) tools with built in interfaces and software.” Qualified devices would be “Used to query, display and document all vehicles’ control system networks (through Security Gateways if applicable)” and must identify all diagnostic trouble codes and electronic control units. The tool must also produce a report. As far as the person doing the scanning, the position statement says a qualified worker “should be familiar with: • Scan tool operation • Vehicle specific set-up operations • Adding battery support • Researching vehicle manufacturer repair procedures • Diagnostic Code Interpretation (Minor formatting edits.) “We feel that we hit the mark with the valued input and support of SCRS and AASP,” ASA Collision Division Director Mike LeVasseur said in a statement. “This should prove to bring a more united clarity when writing, negotiating and repairing the complex safety systems in today’s vehicles.”

Six Major Takeaways: • Higher new vehicle prices, extended vehicle financing periods and longer vehicle new design intervals are combining to encourage many new car and light truck buyers to keep their vehicles longer than ever before. • The plunge in new vehicle volume resulting from the 2008 Great Recession forced many dealers to expand their service bay business to an older mix and expanded range of vehicle nameplates. • Today, buyers retain their new cars and light trucks more than two full years longer than the typical ownership cycle of new vehicles in 2008, a 50 percent increase. • With new vehicle buyers now keeping their vehicles an average of 6.9 years, dealers can leverage this extended relationship with the original buyers to attract vehicles entering the repair-age sweet-spot (six to 10 years old) into their bays. • Lower new vehicle sales in 2020 show that car and light truck buyers are keeping their vehicles longer than ever before, while, at the same time, prompting dealers to focus attention on their service bays to generate profits. • Independent (non-dealer) service outlets must recognize that the changing vehicle retention patterns of new car and light truck buyers are enabling dealers to be stronger competitors in servicing light vehicles, especially those in the repair-age sweet-spot (six to 10 years old). Nameplate Age Gap Drives Product Differences The age gap is widening between the domestic and foreign nameplate segments of the light vehicle population in the U.S. The changes in annual new vehicle sales and nameplate mix over the past 12 years have shifted the average age growth of vehicles into overdrive, especially among domestic nameplates. At the beginning of 2021, domestic nameplates were 2.6 years older in average age than foreign nameplates.

Hope for Heroes: Shops Help Veterans Get Back on the Road by Joel Gausten The past year has been a time of hardship for many, but it has been particularly difficult for our military veterans. Faced with financial and logistical struggles that have only increased during the pandemic, many vets have been forced to forego needed vehicle maintenance and repairs. This often prohibits them from having safe transportation to perform essential tasks and fulfill employment obligations. Fortunately, a growing number of shops from the AASP-MN community have stepped up to help. Late last year, AASP-MN Mechanical Advisory Committee member Dan Gleason (Pro-Tech Auto Repair, Corcoran) encouraged the association to put the call out to members to do what they could to support the Minnesota Assistance Council for Veterans (MACV), a non-profit organization that has been helping veterans and their families defeat homelessness and other life crises for more than 30 years. For Gleason (who also regularly volunteers for the veterans support organization Hues for Heroes; facebook.com/HuesForHeroes), being active with MACV enables the Pro-Tech Auto Repair team to lift the burden of vehicle repair and maintenance off the shoulders of American heroes so they can focus on “real things that matter” – employment, housing and everyday living. “Car maintenance, getting an oil change and anything like that is the last thing on Earth that these veterans are going to want to deal with.” Gleason adds that MACV is always in need of industry members who can provide services ranging from doing oil changes and replacing light bulbs to working on vehicles in need of major TLC.

Steve King, operations manager for Fix Auto’s Brooklyn Park and Maple Grove locations, answered AASP-MN's call and jumped at the chance to help heroes in need. Earlier this year, King and his crew (along with help from TGK Automotive in Brooklyn Park and LKQ) repaired a 2014 Ford Taurus that had been donated to MACV for a veteran’s use. “My dad and all my uncles were in the service,” he says. “I have a passion for helping the veterans and thanking them for their service. I do whatever I can to go above and beyond to make sure we take care of them and provide them with something they need to help with their lives.” Getting involved in MACV has provided Fix Auto with a new source of activity and high morale during COVID-19. “It’s not hard for us to do it, and if the impact serves people within our community, we’d be happy to do so,” comments Fix Auto Franchise Partner Matthew Feehan, immediate past president of AASP-MN. “We have a little more time than we have normally with fewer cars driving on the roads and fewer customers, so we wouldn’t be opposed to doing this again.” In addition to providing housing assistance and legal services to its clients, MACV has an employment team devoted to placing veterans – including those who could have served as mechanics in the military – with businesses that can help them get back into the workforce. “Employment is one of the biggest barriers we see from our clients,” MACV Operations and Property Manager Nate Martineau explains. “A lot of that has to do with them not having a vehicle or the means to purchase or fix one to get to work. Our employment team really works with the veterans and shops to get their vehicles repaired so they are able to get to a job and start earning a steady income to get back on their feet again. Editor’s note: Last month, we went over the first two safety requirements for keeping your technicians, tools and shop safe. Here is part two. Electrical tools must be grounded or double-insulated. Grounded tools have a three-prong plug. If the tool is double-insulated, its plug will have only two blades, but the tool will be marked as double-insulated or will have a box within a box symbol. Grounded tools help prevent their users from getting shocked – they provide a better path to ground than the human body. Double insulated tools have all electrical parts isolated from the outside non-conductive case. If the wiring shorts, the user will not be shocked. Keep guards in place and correctly adjusted. The most common violations we see are on bench grinders. The grinding wheels are usually mounted with the required blotters (compressible washers that go between the wheel and the flanges) and with the guard that goes around 75 percent of the wheel. But work rests are often dropped down or not adjusted to within 1/8-inch of the wheel. And it seems that few people know to adjust the tongue guard at the top of the wheel. That has to be within 1/4-inch of the wheel. The work rest keeps the work piece from being sucked into the wheel. The tongue guard protects the user from sparks and from shrapnel if the wheel explodes. The other common violation we see is lack of guarding on hydraulic shop presses. When a bearing has tons of

pressure put on it, it can burst and send fragments out toward the user. People have been killed by that. But these presses usually do not come with guards. That does not let you off the hook. It isn’t difficult to fabricate a guard to protect the user against the ejection of parts. Follow the manufacturer’s instructions. Have you read the manual for your bench grinder? One of the instructions it will give is to ring test a new wheel before it is installed. To do that, tap the wheel about a half inch from the edge with something nonmetallic. If you hear a dull thud, the wheel is damaged and must not be used. Damaged or incorrectly mounted grinding wheels can explode, sending chunks flying out at speeds above 60 miles per hour. The guards, if correctly adjusted, will help contain the shrapnel. But preventing a wheel from exploding is safer than containing it. Minnesota explicitly requires you to follow the manufacturer’s instructions. If you want to use a screwdriver as a crowbar and want to comply with OSHA standards, you either need the manufacturer’s written approval or need the okay of someone who can evaluate that use “in accordance with accepted engineering requirements.” Think that is overreach? In 2017, an employee in St. Paul punctured a car tire with a knife. The tire exploded, sending the knife into the worker’s neck. The worker was injured badly enough to require hospitalization. The company received a $3,000 citation for that.

OSHA has very few specific rules for tools. Here are a few: • If you are going to use compressed air for cleaning, you need to have effective chip guarding so particles don’t fly at the user. The employee must wear appropriate personal protective equipment. The pressure at the tip of the air blow gun must be less than 30 psi if the gun is put against a solid surface. The purpose: to prevent back pressure buildup (causing the air hose to burst or to fly around) if the nozzle is blocked. Air guns can be designed with pressure relief ports or with solid tips (so the air comes out of multiple orifices just behind the tip). We have seen air guns marked as OSHA compliant only if the air line pressure is 30 psi or less. It’s rare for anyone to reduce the air line pressure that much. Instead, you need to require employees to use air guns that will reduce pressure if deadheaded. • Pneumatic tools need to have retainers so the tool will not come off unexpectedly. The air hose and connectors must be suitable for the pressure and conditions of use. • Jacks need to be marked with their load limit. They cannot be overloaded. They must not be raised too high. And once the load has been raised, it needs to be blocked or otherwise secured so the load is kept raised even if the jack loses pressure. Jacks need to be inspected for damage at least every six months. If they are damaged, they need to be marked or tagged as out of service and not used until repaired.

Those are straightforward precautions for jacks. Notice, though, that one of the most important parts of using a jack safely, positioning it correctly, isn’t mentioned in OSHA standards. OSHA just doesn’t cover everything. Misuse of tools can damage the tool, damage what you are trying to repair and seriously damage the user. Require your employees to use their tools correctly and to keep them in good condition. That will make their job easier and will keep them safer. It’s important to always reference the specific vehicle chapter footnotes to verify if any specific operations are included. Audatex may or may not include wheel R/I labor. Always reference the estimate labor report. CCC DEG Inquiry 17764 “Estimated Release Date: Closed Proposed Resolution: MOTOR stated: After review of your concern, the R&I of Wheel is “Not Included” with Overhaul of Front Bumper.” Mitchell DEG Inquiry 17360 “Proposed Response Text: Thank you for your inquiry, Per P-Page for front and rear bumpers, removing and installing the wheel has not been factored into the R&I bumper labor allowance. Inner fender liners and wheel opening moldings are not included. It would be noted if they were.” All Three Estimating Systems: OEM Required Safety Inspections – OEM specific safety inspections may be a required procedure and are NOT INCLUDED in all three estimating system published labor times. Examples of “Safety Inspection” operations that cannot be verified by scanning could be: • Measure steering column to confirm it has

not collapsed; • Physical seat belt retractor test; • Seat frame diagnosis for twisting and/or binding; • Physical SRS component inspection. In DEG Inquiry 12928, MOTOR states, “After review of the concern, ‘Vehicle Safety Inspections’ are not listed in the MOTOR Guide To Estimating and is not an included operation.” The Audatex DBRM section 4-2 Labor Exclusions page 43 lists, “Diagnosis and testing of electronic components or systems (e.g., airbags)” under NOT INCLUDED. The Mitchell CEG section on Labor General Information > Additions to Labor Times identifies “Time to aim/calibrate/diagnose/ re-set/scan or test.” Always reference OEM repair service information for the latest and most up-to-date procedures for any recommended and/or required inspections and repairs needed. Audatex: Prime and Block Not Included for Non-exposed Inner Structure Panels – In DEG Inquiry 17915 the response from Audatex states, “Prime and Block operations are only included for exposed welds on exterior panels.” An example would be replacing inner structure items or frame rail sections. Audatex users may find this confusing when

referencing Audatex DBRM page 150, Section 4-4 Refinish Guidelines: “Feather/Prime/Block - Audatex recognizes that Feather/Prime/Block are required operations when replacing welded-on panels. Time to perform this operation is included in the Audatex time for welded panel replacement in the seamed areas, to bring the panels to the condition of a new, undamaged panel for the purpose of refinish.” In summary, Prime and Block is only included on exterior weld-on panels, such as a quarter panel installed at the OEM-designated seams or exterior aperture panels replaced at the welded seams. All Three Systems: Additional Preparation Stone Guard & Textured Areas – Some vehicles may come from the OEM with chip guard/stone guard applied to the rocker areas under the painted areas. There may be instances where a repair may only need to refinish or blend over the textured areas. Refinish times in all three estimating systems do not account for any additional labor that may be needed to properly prep the textured areas with peaks and valleys in the texture. Any additional labor to bring the panel to “new and undamaged condition” would be an “on-the-spot evaluation.” DEG Inquiry 18007 response from all three IPs: Mitchell Please reference the following from the Refinish General Information section of procedure 28. Refinish times in this Guide pertain to NEW, UNDAMAGED PARTS. The steps required for refinishing a repaired and/ or used panel may vary from those required for a new panel depending on the condition of the repaired and/or used panel. CCC/MOTOR After review of your concern, the extra prep time for the area with stone guard would need to be an “On the Spot Evaluation” mutually agreed upon by estimators. Audatex We have reviewed the current information for the stone guard. Per the database reference manual refinish exclusions, the stone guard is not included in Audatex refinish times. The database reference manual also states that the removal of protective coatings, or other materials impeding replacement, R&I, or refinishing of parts is not included. No change warranted at this time. Note: The estimating databases are all intended to be used as a GUIDE ONLY - it is important to remember that the auto body professional performing the repair is in a position to thoroughly inspect, diagnose and identify the methodology and their unique cost of the vehicle damage repair.
