Making the Most of Your AASP-MN Membership by Randy Notto, AAM AASP-MN Mechanical Division Director
Hello, I’m Randy Notto, the newly-elected Mechanical Division Director of AASP-MN. I’m the owner of Lenfer Auto & Transmission in Lino Lakes and Bee Line Alignment Service in Wyoming. I have been a shop owner for nearly 30 years, and worked for my father prior to taking over the business in 1989. I am honored to serve as your Mechanical Division Director in the upcoming year. I have been an AASP-MN member since 1989 and have realized a tremendous benefit from my membership and participation in the association activities, and I’m happy to be able to give back. Through my membership and involvement in AASP-MN, I have built relationships with many other members that have been extremely valuable. They have shared information on difficult repairs and discussed difficulties I may have been having in my business, often offering a different point of view or way of approaching the problem. Like many of you, I am very busy just trying to run my

business and don’t have a lot of time to find things out on my own. AASP-MN does a great job helping us stay on top of new laws and regulations so we can run our businesses, instead of our businesses running us. AASP-MN has also done the homework for us when it comes to cost-saving programs. From credit card processing and uniform and linen supplies, to workers’ compensation and property/liability insurance, the association’s programs are difficult to beat! Marketing our businesses is extremely important. I’m always trying to attract new customers and keep my existing ones. Being a part of the “Get to Know Your Neighborhood Auto Repair ProTM” campaign helps to set us apart from other shops. It’s a way to build brand recognition for independent repair shops, our association and my own shops. We are able to reach potential customers with this message as a group, where alone

AASP-MN Builds Bridges with New Commissioner In the final year of Governor Mark Dayton’s tenure, an opening came up for the position of Commissioner of Department of Commerce. Commissioner Mike Rothman resigned to seek other opportunities. Specifically, he intended to run for the position of Attorney General, but those plans ran aground when current Attorney General Lori Swanson opted to run for re-election rather than compete for the DFL nomination for Governor. The resignation of Commissioner Rothman resulted in the Governor appointing Jessica Looman as the new Commissioner for the Department of Commerce. Commissioner Looman comes with significant experience and high regard from politicians on both sides of the political aisle. Most recently, Ms. Looman served as Deputy Commissioner of the Department of Labor and Industry. She was one of the lead attorneys at the Agency, which dealt with employment certification issues. She is highly respected for her intellect and straightforward approach. She now takes over the Department of Commerce which has

jurisdiction over banking, securities, real estate, insurance and energy policy. As has been our practice over the years, AASPMN scheduled a meeting with the new Commissioner to discuss issues and concerns of the automotive repair industry. The March 29 meeting involved the Commissioner, Department staff and AASP-MN representatives. The discussion focused on insurance claims processes and other concerns which fall within the purview of the Department of Commerce investment arm. The new Commissioner was thoughtful and engaging. The sense of the participating AASP-MN members was that we have the start of a very positive working relationship with the new Commissioner. Commissioner Looman is only assured of serving in her current capacity through Governor Dayton’s term – which ends at the end of 2018. If a Democrat were to win the Governorship, it is very possible that Ms. Looman would be retained in her role as Commissioner. If a Republican were to win the Governorship, it is not at all certain that Ms. Looman would be retained in her

AASP-MN Members “Focus on Success” at 2018 Annual Meeting & Leadership Conference by Kristen Dalli On April 5, AASP-MN members from around the state gathered at the DoubleTree by Hilton Bloomington – Minneapolis South for the association’s Annual Meeting and Leadership Conference. This jam-packed day featured renowned speakers, valuable seminars and fun, engaging networking events, all designed with the intention of having attendees “focus on success.” Terry Watson, who travels the world giving presentations on the customer experience, got the ball rolling with his vibrant, energetic presentation “Bring It!” The opening session – sponsored by CBiZ AiA, AmeriTrust Group (formerly Meadowbrook Insurance Group) and United Fire Group – provided inspiration, insight and Watson’s signature sense of humor to help attendees stand out in a crowded marketplace, and become more profitable, efficient business owners. Watson started with some strategies to focus on. “Make a decision today that you’re only going to have a problem once. Too many times, we keep having the same problem again and again and again. If you don’t put policy in place to make sure whatever bad happened doesn’t happen again, it’s going to happen again.” Watson wanted to arm attendees with tools and strategies to run the most productive businesses possible.

Three 30-minute sessions were facilitated by AASP-MN member experts on topics including employee meetings, autonomous vehicles, protecting against employee fraud, setting up new employees (onboarding), estimating resources, digital inspections, tech tools that save time, key performance indicators and maximizing the benefit of paint and material calculators. For the entirety of the session, each table was packed with attendees participating in thought-provoking and beneficial discussions. Members were then treated to a lunch break, where they heard from various AASP-MN Board members. Executive Director Judell Anderson took to the podium first to honor AASP-MN Lobbyist Kevin Walli for his 25 years of hard work and dedication to the association. “He has been our face and voice at the State Capitol and before our regulatory agencies [since 1993]. From insurer claims practices and salvage title requirements, to sales tax and environmental regulation, Kevin has worked hard to advance legislation for the benefit of the industry. He’s also stepped up to play defense and stop legislation that would be detrimental. Kevin can always be counted on to give the association and its members legal counsel and sound political advice, all while good-naturedly taking the brunt of the many bad lawyer jokes that have come his way during the process.” After accepting his award, Walli provided AASP-MN members with a Legislative Update on the current short legislative session. Wayne Watson (2017-2018 AASP-MN President) was introduced next to give his year in review, in which he revealed the significant accomplishments of the association throughout 2017. Watson introduced the newest members to the AASP-MN Board of Directors: Tom Archambault, Mechanical Seat (St. Anthony Mobil, St. Anthony) and Randy Miller, Collision Seat (Collision Specialists, Inc., Austin), and recognized the full 2018-19 Board of Directors.

“Focus on becoming more efficient. Every day ask yourself: How can I make my business at least one percent more efficient? Not a million. One percent more efficient.” As an expert on the customer experience, Watson told attendees: “You want to change your businesses? Focus on your customer experience.” He then told the audience things they can do immediately to improve their customers’ experiences. “The first thing: Tell people what’s about to happen. The thing that destroys the customer experience the most is not telling them what’s about to happen. People don’t want to know as it’s happening – they want to know before it happens.” Watson closed his presentation on an inspiring, informative note. “Focus on learning what to do when things go wrong, because in a business, something always goes wrong. Stuff is going to happen to you that you’re not going to see coming, so be prepared.” Following Watson’s presentation, attendees had the

Next on the agenda, Watson acknowledged Carl Thomas and Bruce Tschida for their service as division directors during the past year. Tschida was then honored with another award, as he was AASP-MN’s Member Recruiter of the Year. Each year, the association holds a contest among its members to recruit as many new members to the association as they can. Tschida recruited three new members and provided eight additional leads, giving him the highest total number of points among all participating members. (Latuff Bros., St. Paul), Watson thanked the association’s many volunteers and sponsors, whose generosity is felt at every event throughout the course of the year. Latuff then came to the podium to give his first address as President of AASP-MN, calling the opportunity to serve the association and its members “exciting and humbling.” Latuff’s first order of business was presenting an award of his own to now-Immediate Past President Wayne Watson for his longstanding commitment and enthusiasm to the industry and the association. After Latuff’s remarks, the audience was treated to the keynote speaker, Mark Mayfield (Mark Mayfield Presentations), who presented “Momma Told Me There’d Be Days Like This,” sponsored by FinishMaster and PPG Automotive Finishes. Mayfield’s background as both a lobbyist and a nightclub performer combined to keep attendees laughing from start to finish. The goal of his discussion was to help the audience identify major areas of stress, and ultimately find balance in their lives. “If you have a pulse, you have stress,” Mayfield said in his opening comments. “Stress is a by-product of life, but I want to have a little fun here, and give you some tips to help you deal with that. “The first tip I want to give you comes from my momma, who taught us that if what you’re whining and crying about will make the six o’clock news, then you have every right to be upset, distraught, wigged out. If it will not make the six o’clock news, and these are my momma’s words, ‘Shut the hell up.’” Mayfield helped the audience identify what stress is and isn’t. He explained that many of us put stuff in the “stress pile” that really belongs in the “inconvenience pile.” He went on to say if something is
six o’clock news-worthy, it’s classified as stress; if it isn’t, it’s an inconvenience. The second part is understanding how to handle and cope with both stressors and inconveniences while remaining productive. “I don’t know your business, but I know that you have stress like everybody else in every other business.” Mayfield left attendees with a helpful, easy way to manage stress on even their worst days. “Remember one word: REACH – these are the things that you need to put in your lifestyle to help manage and deal with your stress and create some balance. Relaxation, exercise, avocation, communication and humor.” Following Mayfield’s presentation, AASP-MN members had the opportunity to choose between three different breakout sessions: Can I Have a Side Order of Service With That? Creating Dazzling Customer Service (Mark Mayfield, Mayfield Presentations), The Secrets of America’s Greatest Body Shops – Six Secrets Revealed (Dave Luehr, Elite Body Shop Solutions) and Survive & Prosper in the Auto Repair Business (Dan Gilley, RLO Training). In Mayfield’s second session, he helped those in attendance realize not all customers are the same, and helped them to maintain positive customer experiences, while also better understanding their customer bases. “Let’s be honest: We will screw up. There’s not a business in the world that’s not going to have some mistakes at some time. The customer satisfaction number is going to be all over the place, but what do you do during those tough times and how do you get it back? “Understand it’s not a static thing – once you have [customers], you don’t AASP-MN News
always have them. Once you lose them, you can get them back. That’s the mindset you’ve got to have.” In Luehr’s session, he encouraged attendees to get excited about their profession, and that keeping a positive mindset will unlock their greatest potential. “You want to spend your time working on the business, and not in it. Some of us when we start out, we have to do both. You need to put things on your list to work on the business no matter how loud things are screaming around you. The more time you spend working on the business, the less time – eventually – you’ll have to spend firefighting. It takes a lot of discipline – especially in our business, where things are screaming loud all day long.” Gilley’s presentation took an in-depth look at what today’s customers want and what shops need to do to meet – or exceed – expectations. Gilley taught attendees how to improve their efficiency, and also how tracking vital numbers can drastically change their businesses. “The more dollars we generate, hopefully the more that’s leftover. That’s the plan, right? “Our benchmarks are 90 percent productivity and 125 percent efficiency. Some of you have some really strong technicians; a strong technician will run at 150 percent. The easiest number for us to improve is productivity – we need to have technicians working on cars for more hours in the day.” When the seminars were over, members had the opportunity to visit with the various vendors in attendance at the Vendor Showcase and Social Hour, before heading to the Industry Dinner and Casino Royale. After a day full of classes, industry discussions and networking, it was a great way for everyone to relax, play classic casino games and win prizes. Overall, the AASP-MN Annual Meeting and Leadership Conference provided members in attendance with invaluable information to take back to their shops, and most importantly, allow them to focus on success.

Supreme Court Rules Auto Service Advisors Are Exempt From Overtime Pay In early April, the Supreme Court ruled that service advisors at car dealerships are exempt from federal overtime pay requirements. In a 5-4 decision, the court held that service advisors are exempt under the Fair Labor Standards Act’s overtime provisions because they are salesmen primarily engaged in servicing automobiles. “A service advisor is obviously a ‘salesman,’” Justice Clarence Thomas wrote in delivering the majority opinion for the court. Chief Justice John Roberts and Justices Anthony Kennedy, Samuel Alito and Neil Gorsuch joined Thomas in the majority. The case, which the court heard for the second time, centered on a lawsuit current and former service advisors brought against Encino Motorcars LLC for back pay. Justice Ruth Bader Ginsburg issued a dissenting opinion, which Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan joined. Jeffrey Brecher, principal at the Jackson Lewis office in Melville, N.Y., and head of its wage and hour practice group, says that this specific Supreme Court case exclusively targets dealerships, and independent repair shops are not subject to the ruling. Section 213(b)(10)(A) of the ruling states that service advisors are exempt from overtime payments, if they are employed by an establishment that’s primarily engaged in the business of selling vehicles to customers.

Surveys Win SCRS Award The "Who Pays for What?" survey series conducted by Collision Advice and CRASH Network received an "Industry Service Award" from the Society of Collision Repair Specialists (SCRS) at the association's annual awards event held in Denver in mid-April. In presenting the award, SCRS board members called the surveys "information that is invaluable to shops across the country, a tool that has made negotiations more transparent and something that has helped reshape the conversation that so many of us have on a daily basis." After minimal growth on U.S. roads during 2007 through 2013, vehicles in operation are now on the edge of a soaring growth curve that will dramatically expand the light vehicle population by more than 40 million during 2014 through 2020. There was an extended period of virtually no car and light truck growth in the U.S. from 2007 to 2013, something that had not occurred before except during World War II, over 70 years ago. Now, all that is behind us and the U.S. light vehicle population will dramatically increase between 2013 and 2020.

Do You Know Where the Hazards Are in Your Shop? Has an employee in your shop ever been pinned by a car? If so, did you chalk it up to bad luck – or did you think about why it happened? Were the brakes faulty? Did the employee put the car in drive rather than reverse? Was the technician unfamiliar with the car? Have you stopped an employee from working under a car held up only by jacks? The reason to not rely solely on jacks is probably clear to you – jacks can fail. So why didn’t the employee use jack stands? Do employees routinely use compressed air to clean dust off their clothes? Stop and think about that. Is there any hazard? Is it a good idea to blow over a hundred pounds of dirty, dust-laden air at each square inch of one’s face or skin? You provide safety glasses to your employees. Do they wear them? Or have

you seen the eye protection worn on top of heads more often than over the eyes? Some of those hazards seem very obvious, especially in retrospect. But are they obvious at the time? You notice dents in a car without even stopping to think about those. Do you ever notice safety hazards? Have you taken the time to look at the jobs that employees do, thinking about how injuries can be prevented? A key part of a good safety program is identifying and assessing hazards. A lot of that hazard identification work has been done for you, often by those who came before. We know vehicle hoists need routine inspections, because people have been killed when they failed. We know tailpipe exhaust systems have to be used, because people have suffered from carbon monoxide poisoning. Bad experiences are one way to identify hazards, but not the

only way. There are better ways – ways that don’t rely on someone being injured before a hazard is identified and assessed:
1. Ask your employees. This could be done formally, through employee surveys, or informally, in a shop meeting, over lunch or when assigning work. Do they have concerns? Are there jobs they don’t like doing, because they feel those jobs are hazardous? Is there equipment that needs to be fixed? Are they having problems with any equipment? Are there work practices that they think are unsafe? Do they have suggestions for safer ways to work? Often, just asking and listening to what employees say will make a difference. 2. Do self-inspections on a routine basis. Monthly inspections are required for fire extinguishers, to check thatthey’re

accessible, hung up and fully charged. Eyewashes need weekly inspections to make sure the water runs clear, or if gravity-fed, that the solution is current. Don’t limit your monthly inspection to the mandatory items, because these are a good opportunity to systematically look for potential hazards. Do garage doors reverse if something is under them? Are electrical cords in good condition, with no damage to their insulation and with grounding prongs present? Are the paths to exits kept clear? Do they lead safely away from the building? Check your vehicle hoists to make sure they function smoothly and the safety latches work. Are gases stored safely? Look at housekeeping and at equipment; this is your chance to find hazards before something bad happens. 3. A preventive maintenance program doesn’t identify hazards, but it does prevent them. Get your vehicle hoists inspected and serviced annually by experts. Have your heating system checked. 4. Observe. Watch how your employees work. Common sense is acquired through experience, assuming you survive your experiences. Not everyone has experienced what you’ve lived through and learned, so not everyone has the common sense that you take for granted. As you watch employees working, look for what could be hazardous. Walk through the shop thinking, “What could go wrong?” Is someone on a ladder? Could he fall? Is the area around the ladder clear? Is the ladder set up correctly?

Those warnings could have been in the form of close calls or minor incidents, incidents where no damage occurred and no one was hurt. Pay attention to those. Pay attention to any hazardous situations in your shop. Don’t

walk past them. Whether it involves an employee or a co-worker, stop and say something. You don’t want your company or your co-worker to be the next statistic. Look at your tasks. Employees move cars in your crowded shop. Ask yourself how someone could be struck by a car. Employees use hazardous chemicals – brake cleaner, acid cleaners, paints. How could they be overexposed? Could the chemicals get on their skin? In their eyes? Employees use grinders. What could go wrong with that? Could a grinding wheel explode? ESTIMATING TIPS CCC: Labor for cooling fan components NOT included in radiator labor times Recent DEG Inquiry 11920 discovered an error in the CCC system that will require users to perform a manual entry to allocate correct labor times. Radiator replacement time includes R/I cooling fan shroud as an assembly with the motor and fan blade still attached. When having to replace an individual component of the cooling fan, the part may come up as included, or with a standalone time which may also include another component of the cooling fan part. If this occurs, the estimator would need to make a manual line consideration for additional labor times. Always refer to the part selection footnotes and the CEG Guide to ensure labor is being assigned correctly. All three estimating systems: Non-OEM parts with badges and emblems It’s important to note when selecting non-OEM parts with an emblem or badge attached (i.e., grills, finish panel moldings) in the estimating system, OEM emblems and badges may not come with the part due to copyright infringement. OEM parts will typically come as an assembly, or are available to purchase separately. If sold as an assembly from the OEM, the estimating system may not allow you to select the additional part to be added for the nonOEM part. This will require a manual entry or you may want to consider using a complete assembly part from the OEM. It’s also important to look at the nonOEM part to verify the location of the badge or emblem base. They may not be identical to the OEM design. All three estimating systems: ASA not-included quick reference chart The Automotive Service Association (ASA) maintains and updates the Quick Reference Chart of “not-included” operations when installing new replacement parts. This chart gives users a quick reference between all three information providers’ not-included operations broken down by component category. It’s important to note, this is not a substitute for the actual IPs’ CEG, GTE and DBRM which can be accessed at http://degweb.org/estimate-toolbox-parent/ understanding-the-system.
CCC: Refinish labor on recycled parts CCC users may experience a variance in reported labor times on “recycled” parts vs. new replacement parts in the database. DEG’s recent inquiry 12042 discovered that clear coat labor on edges and inside is not an option that is given and it may not be available in the estimate line properties to add for clear coat on those two refinish instances. CCC/MOTOR response: Estimated Release Date: Closed Proposed Resolution: CCC’s collision-estimating tools contain limited automated logic support when recycled parts or assemblies are used. All of CCC’s tools include MOTOR’s RACED database, so the estimator has all of the necessary information, and can make the appropriate manual adjustments. CCC will be implementing additional logic in future product releases. At this time there is no estimated fix for this logic and, if applicable for that specific repair, users will need to manually enter the missing refinish labor associated for edges and insides. The following clear coat formula is available in the Guide to Estimating (P pages). Note that 2.5 Clear Coat Cap is for ONE continuous application and booth cycle. If multiple booth cycles are needed for repairs, the clear coat cap would start over and this would need to be a manual consideration. • First major panel; Add 40 percent to refinish time • Each additional panel; Add 20 percent to refinish time • Maximum time allocation; 2.5 hours If the option is available, here is a quick video showing users how to add clear coat on edges or inside panels when clear coat labor is not automatically added: https://youtu.be/2A7_XY9L-pc If users find a difference in refinish labor allowances, please submit an inquiry to www.degweb.org so we verify the concern and work with the appropriate information provider.
