What?! It’s October already??? Now that the kids have gone back to school, the summer routine of staying up late and sleeping all day has changed backed to the “normal” routine. Leaves are turning from green to hues of red, yellow, orange and brown, letting me know that I should prepare for the inevitable change to ch-ch-chillier weather soon. Change, it seems, is happening all around me, which is why I have the song “Changes” by David Bowie stuck in my head today. Many people believe that change is a good thing. I’d have to agree. That’s why I hope every mechanical shop owner and manager in Minnesota attends AASP-MN’s Mech XChange on October 17 at LubeTech in Golden Valley. Attendees will learn how shops have increased their bottom line by making changes to the

product and service options available to their customers - while complementing their core business. In addition, attendees will hear about new and/or cost-effective marketing tactics that have worked for other shops in the last three months. LEGISLATIVE UPDATE

AASP-MN Prepares Response to Salvage Title Initiative During the 2018 Legislative Session, proposed legislation would have removed key language (“late-model” and “highvalue”) from the description of vehicles subject to Minnesota’s salvage title statute. The change would result in more vehicles being stamped “Salvage Title.” The stated rationale for this change was to prevent “title washing” and protect consumers from unsafe vehicles. In particular, the proponents of the bill said that they were concerned with flood-damaged vehicles making their way into Minnesota. AASP-MN spotted this legislative proposal well into the 2018 Session. We were playing catch-up for much of the Session trying to sort out what the proponents of the bill were trying to accomplish. As we learned more, we became concerned that the proponents’ stated objectives cannot be achieved simply by removing the reference to “late-model” and “high-value” vehicles. With this simple change, our analysis points to more repairable vehicles being stamped “Salvage.” As a result, vehicle

owners will experience diminished value and some owners will lose their “affordable” vehicles and face the unanticipated expense of finding replacement vehicles. The provision nearly passed in 2018, but it was part of a large Omnibus Bill that was ultimately vetoed by Governor Dayton. Subsequent to the 2018 Session, AASP-MN has taken its concerns to several key legislators and the Department of Public Safety. We will have several more conversations on this issue before the 2019 Legislature convenes on January 3. Our goal is to ensure that the full range of consequences of the proposed law change are understood by legislators. Our objective is not to shut down debate on the Minnesota salvage title statute. We simply want the goals to be clearly stated and ensure that any changes are an appropriate response to a real consumer safety concern. For our part, we are willing to discuss options that will have meaningful positive benefits for consumers – and all stakeholders should have a say in any such solution.

Body Shop Session Highlights On Wednesday, September 19, AASP-MN hosted a Body Shop Session at Grumpy’s Bar & Grill in Roseville. During the session, attendees learned about what the Minnesota Department of Commerce does, specifically in its role regulating insurer claims practices. Representatives from the Department of Commerce explained: • Role/jurisdiction of the Department of Commerce – what they can and cannot do • How to file a complaint with the Department – what are they looking for? • The importance of documentation – what info should be provided in a well-written complaint • The Department’s process for handling complaints – what to expect after a complaint is filed • Recent enforcement actions of interest to the collision repair industry Participants also received a report on AASP-MN’s current initiatives and upcoming events.

Nearly 40 people attended AASP-MN’s B.S. Session at Grumpy’s Bar & Grill on September 19.

I-CAR SkillsUSA Golf Outing Highlights The Minnesota Volunteer I-CAR Committee, along with SkillsUSA, had another successful annual golf tournament at the beautiful Oak Glen Golf Club in Stillwater, MN on September 12. The tournament brings together the best in the auto body industry, including the leading auto body and collision repair facilities, parts vendors, automotive paint suppliers, local dealerships, towing companies, auto body equipment vendors and insurance partners. Proceeds go towards technical schools and students for scholarships and grants to continue the successful growth of the auto body industry. Congratulations to team National Coatings/Single Source (Jim Lepley, Rob Lahr, Dan House, Nick Buche), who won First place this year! Second place was team Schoonover Bodyworks (Mike Schoonover, Doug Redfield, Andy Labrosse, Matt Enright). There were many winners with all the prizes and donations presented at the dinner and awards ceremony following golf. “We couldn’t do it without our sponsors! AASP-MN Member PAM’s Auto Earns ISO Certification The International Organization for Standardization (ISO) 9001:2015 has issued its first automotive recycler certification in the nation to AASP-MN member PAM’s Auto in St. Cloud. PAM’s Auto successfully completed the ISO audit covering automotive parts distribution and automotive dismantling operations. The audit’s objective is to set international requirements for quality management systems. SCRS-Hosted I-CAR Webinar Made Available Online The Society of Collision Repair Specialists (SCRS) has released the on-demand version of a live webinar featuring Nick Notte, Senior Vice President of Sales and Marketing for I-CAR, originally aired on August 22. The 90-minute webinar detailed the culmination of nearly five years of work in improving upon the organization’s curriculum, services and recognition program, highlighting ways in which the industry’s training program has been enhanced. How can you control your mod? Your mod factor has a direct impact on your workers’ compensation premium. The key to controlling your insurance costs is accident prevention.

• The mod is calculated based on data reported to the rating bureau by past insurers. Incorrect or incomplete data can cause incorrect mod factors. Review loss and payroll data to ensure the calculation is complete and accurate. • Losses remain in the experience rating formula for three years. The experience modification factor is influenced more by small, frequent losses than by large, infrequent ones. • Safety programs, return-to-work programs and appropriate prevention procedures can help to reduce loss frequency. • An effective self-inspection and accident investigation program are critical to managing claim frequency. • Claims management programs can help your business manage outstanding reserves and focus on efficiently resolving open claims. • Any claims should be reported to your carrier immediately. • All injured employees should be provided with light duty upon their release from treatment so you can close claims and ensure the health of your employees. • Supervisory roles should have set safety performance goals. Success in achieving safety goals should be used as one measure during performance appraisals.

• All employees should be trained on their responsibilities for safety and supervisors should know how to enforce violations. • You should frequently communicate with employees on a formal and informal basis regarding the importance of safety.

ESTIMATING TIPS All Three Systems: Factory Color Packs Some vehicle OEM colors may require a special pigment toner to be mixed in-house, or a factory color pack (pre-mixed color) to perform refinishing repairs due to exotic, high-cost pigments. The cost of these color packs and toners – which are only supplied by your paint manufacturer – may cost more than your material calculator rate. Each paint manufacturer has a list of special color codes specific to each OEM and it is important for repair planners to reference this information when determining cost during damage analysis. This will also help order the necessary materials before the vehicle lands in the paint department, thereby eliminating delays in the repair process. An example of this would be Lexus color code 8Y0, structural blue, which is only available as a factory color pack from PPG Automotive. PPG shows how to repair Lexus 8Y0 structural blue on its YouTube channel, https://youtu.be/TYbKITlDRWU. Always reference your paint manufacturer’s TSBs for the latest information available regarding these special colors.

All Three Systems: Fender Caulking Recent Inquiry 12587 identified that, on 2014-2018 Chevy/ GMC Pickup trucks, the replacement fenders do not come from the factory with seam sealer and caulk on the inside panel of the wheel house. The labor and material cost to replicate the OEM appearance is NOT INCLUDED in all three estimating systems. CCC will add a statement to the GTE guide (P-Pages) under the fender group “Special Notation” to match the hood, trunk lid and door sections regarding seam sealer not being included. All Three Systems: Disassembly of Replacement Parts for Refinish Some replacement parts may come pre-assembled from the supplier in primer or with incorrect body color. Labor to disassemble these replacement parts, e.g. grilles, mirrors and various exterior-mounted body parts, is NOT INCLUDED and would require an on-the-spot evaluation. An example of this situation would be a replacement grille for a Ram 1500 PN68197703AA, which comes “primed” from the supplier. Additional labor to remove the inserts is NOT INCLUDED with the refinish labor or the body labor for r/r.

Selling and Collecting Oil and Batteries If you sell or replace oil or lead-acid batteries, you are required to follow a few rules, including posting a sign letting people know where they can take the used oil and batteries for disposal. You don’t have to collect used oil, but you must accept lead-acid batteries for recycling if you sell or replace them. Oil

The following rules apply if you sell or replace oil in vehicles or equipment. Customers can be citizens or businesses. The oil can be petroleum or synthetic. • You must post a sign that either lists where people can bring used oil and used filters or where to find that information. You can list the name and address of a nearby free collection site, list all the free collection sites in your area or list a toll-free telephone number the public can call to find free collection sites, such as 1-800-CLEANUP. This phone number is operated by Earth911.com, which is also a good resource for finding free collection sites in your area to list. Another option is to collect the oil yourself, but you are not required to. • The posted sign must be at least 8.5 x 11 inches – that’s a standard piece of paper. • The sign must have the universal recycling symbol on it – the one with three arrows forming a triangle. • The sign must have the following words on it: “It is illegal to put used oil and used motor oil filters in the garbage. Recycle your used oil and used motor oil filters.”

A printable sign with most of this info already on it is available on the MPCA’s website, www.pca.state.mn.us. Type “hw4-36” into the search box and look for the fact sheet called “Selling Motor Oil and Motor Oil Filters.” The sign is the final page of the fact sheet. You will only have to add the collection site info or phone number. If you choose to collect the oil or filters yourself, store them in sturdy, leak-proof containers. Keep the containers closed and latched except when you are adding oil or filters to them. Store the containers on a solid surface such as concrete. Label the containers “used oil” or “used oil filters.” More details about used oil storage and disposal are available on the MPCA’s website. Type “hw4-30” into the search box and look for the fact sheet called “Used Oil and Related Wastes.” The MPCA recommends keeping a log of who brings you used oil or filters and the date. This reduces your risk in two ways if you accidentally collect contaminated oil. First, people are less likely to bring you contaminated oil if they have to give their name. And second, you can use the log to apply for 18 | October 2018

reimbursement from the MPCA for the additional costs of contaminated oil disposal. If you accept used oil from a business, you must provide them with a receipt.

Batteries The rules for selling and collecting lead-acid batteries are similar to those for oil, with the added requirement that you must collect batteries if you sell them. Customers can be citizens or businesses. These rules apply if you sell lead-acid batteries or replace them in vehicles or equipment. • You must accept up to five batteries at a time from anyone for free, even if they aren’t a customer. • Charge customers a deposit of at least $10 for each battery they buy. • Refund the deposit if the customer brings in a used battery within 30 days. If you are doing the work of replacing the battery, this is taken care of and you don’t need to charge the deposit. • You must post a sign with the following words on it: “NOTICE: USED BATTERIES. This retailer is required to accept your used lead acid batteries, EVEN IF YOU DO NOT PURCHASE A BATTERY. When you purchase a new battery, you will be charged an additional amount of at least $10 unless you return a used battery within 30 days. It is a crime to put a motor vehicle battery in the garbage.” • The sign must be at least 8.5 x 11 inches – that’s a standard piece of paper. • The sign must have the universal recycling symbol on it. Type ‘hw4-07’ into the search box and look for a document called “Selling Lead-acid Batteries.” The sign is the final page of the fact sheet. Recycle used batteries through your wholesaler or other recycler. Lead-acid battery wholesalers are required to accept an unlimited number of batteries from their customers (that’s you). They are allowed to charge a reasonable fee to do so and must recycle the batteries. One more requirement for batteries: If you advertise in the newspaper that you sell lead-acid batteries, like you would to promote a sale, you must include the following words: “At least $10 additional charge unless a used lead acid battery is returned. Improper disposal of a lead-acid battery is a crime.” Overall, these rules exist to encourage proper and speedy recycling of valuable products that are more damaging than most if disposed of in a landfill or left to degrade in a basement or garage.

United Fire Group Announces New Eligibility for AASP Members with Incidental Auto Sales Exposure In the past, AASP members that had an incidental dealer plate or incidental auto sales exposure were not eligible to participate in AASP’s GaragePro property & liability program with United Fire Group. However, new guidelines recently took effect that allow acceptable risks that would not otherwise meet UFG’s garage underwriting criteria.

The new UFG underwriting guidelines include: • Risk should be acceptable within the established AASP guidelines. • Risk should be acceptable within the established nonfranchised dealer guidelines. • Sale of used vehicles only. New/franchised dealerships are not eligible. • Vehicle sales should be less than 10 percent of total revenue. • No more than two dealer plates.

• No more than 15 vehicles sold annually. • No more than $50,000 open lot limit. • Garage-Pro experience rating plan applies.

“After months of research and discussions, it became clear that we were missing out on too many good opportunities for adding new accounts into the AASP program because of an incidental exposure.
