I want to take this time to thank all the people who donate their time and resources to this association. Serving on the AASP National Board has allowed me to see that Minnesota’s affiliate is the star of the country. It takes an amazing staff and exceptional volunteers with a passion for this industry to promote change, support our businesses and encourage the next generation to consider a career in the automotive industry. I recently wrote about shops becoming certified, and quality employees are a large part of that. I truly appreciate the shop owners who contribute to helping us find a solution to our technician shortage through AASP-MN’s Minnesota Careers in Automotive Repair and Service (MNCARS) program. One remarkable donation is from a family who would prefer to remain anonymous, but I beg to differ. I think people who give back should be recognized in the hope that others will be inspired to do the same. I met this man through the association, and over the last several years, he has become a great friend. Roger Bonn of Peter’s Body Shop in St. Cloud, who recently retired, has yet again done something that shows his true belief in our industry

and the good people in it. He and his wife Jill have offered to donate his custom-built 2012 Fat Bagger Razorback Harley Davidson motorcycle—with a brand-new trailer—to the association to be raffled off, with all proceeds going to the MNCARS initiative. The association is currently making plans to sell raffle tickets to win the bike, and the raffle will take place this coming summer. Watch for news about this opportunity to win a great prize and acknowledge the good deed of one person, while also taking part in supporting a program that helps ensure a future workforce for our industry.

Will the 2018 Legislative Session Be the Shortest Ever? by Kevin Walli, AASP-MN Lobbyist
With the Legislature still steaming over the Governor’s lineitem veto of its appropriation, and the Supreme Court’s decision which failed to decide the matter, the Legislature is limping into 2018 with very limited resources and an abbreviated schedule of meetings in the months ahead. The way things will proceed next Session is an open question. One legislator claimed it could be the shortest Session ever. He said, “We’ll start with the Pledge of Allegiance, have our opening prayer and then we’ll see if we have a bill to restore legislative funding with enough votes to override the Governor’s veto.” There has already been some discussion about whether the Legislature would convene on February 20 and immediately recess for a few weeks to preserve limited carry-forward funds and to see whether an agreement can be reached to restore full funding or nearly full funding for the Legislature. The Legislative Sessions in even-numbered years are always
more limited in scope. The state’s budget is set in the oddnumber year of each two-year cycle, and the major focus in 2018 will be to approve a Capital Investment Bill to build or repair public infrastructure. Failure to pass a Capital Investment Bill would delay needed repairs for public facilities but it will not result in a government shutdown. The only essential action by the 2018 Legislature would be to balance the state budget IF the February Revenue Forecast shows the state to be running a deficit. The State Constitution requires that the Legislature balances the budget, and that is the only task that might require legislative action in 2018. Of course, the risk of doing nothing is that you’ve done nothing, and that can be hard to explain to voters in the fall.

LOCAL NEWS 16th Annual Race for Automotive Education Announced The 16th Annual Race for Automotive Education is planned for January 9-11, 2018 at ProKart Indoor Racing in Burnsville. The event serves as the primary fundraiser for the AASP-MN Automotive Education Fund, which provides financial resources to support automotive students, enhance automotive programs and raise awareness of career opportunities in the automotive service industry. Since its inception, the fund has disbursed nearly $210,000 directly to students enrolled in automotive programs through the association’s scholarship program and SkillsUSA competition. AASP-MN members and other industry supporters will organize teams to compete in kart racing at speeds of up to 40 miles per hour. When the final checkered flag waves, the Race for Automotive Education is expected to raise over $11,000. The majority of that money is earmarked to fund scholarships for students enrolled in NATEF-certified automotive programs (collision or mechanical) in the state of Minnesota. Scholarship awards will be distributed in the fall of 2018. See page 9 or log on to www.aaspmn.org for more details.
Employee Right-to-Know (ERTK) programs, including training applicable to the automotive industry. Attendees also received a template for developing written Hazard Communication and ERTK programs on their own. In response to the recent surge in lawsuits around the state targeting businesses for not removing physical access barriers as required by the Americans with Disabilities Act (ADA), AASPMN offered “Protect Your Business – Become ADA Compliant” on October 19 during its Body Shop Session and on October 24 during its Mech XChange. David Fenley, ADA/Access Coordinator with the Minnesota Safety Council on Disability, presented ADA basics and the most common fixes and technical guidelines. Attendees gained the tools and knowledge necessary to meet the obligations under the ADA and building code to avoid lawsuits. AASP-MN Fall Activities Highlights On October 10, AASP-MN hosted a free OSHA Workplace Safety Consultation Workshop in Duluth. The workshop, “Hazard Communication and MN Employee Right-to-Know for Auto Shops,” was held at Lake Superior College. The session covered mandatory requirements for Hazard Communication and

City of Minneapolis Minimum Wage and Sick & Safe Time Ordinance Updates Minimum Wage In June 2017, the City of Minneapolis Mayor and City Council passed a Municipal Minimum Wage Ordinance. Effective January 1, 2018, large employers (defined as more than 100 employees) will be required to pay employees no less than $10 per hour for work performed within the City of Minneapolis. Effective July 1, 2018, large employers rise to a minimum wage of $11.25, and small employers (defined as 100 or fewer employees) will be required to pay employees no less than $10.25 per hour. Scheduled increases will continue yearly on July 1 until reaching $15.00 per hour in 2022 for large employers. John Eagle Collision Case: Collision Shops Should Take a Note from Mechanical Repairers by Kristen Dalli On October 2, a jury concluded that Dallas-based John Eagle Collision Center was guilty of negligence in the improper repair of a 2010 Honda Fit. The couple involved in the 2013 crash, Matthew and Marcia Seebachan, were awarded $42 million for their ordeal, with John Eagle Collision responsible for 75 percent (or $31.5 million) of the liability. The jury decided that Jack Jordan, the other driver in the accident, was responsible for the remaining 25 percent, but since he wasn’t involved in the case, he is not legally obligated to pay this amount. The accident occurred four years ago when the Seebachans were struck head-on by a hydroplaning pickup truck, and were trapped inside the car as it was engulfed in flames. They made it out of the car, but Matthew suffered fourth-degree burns, and Marcia is still experiencing trauma. Following the crash, the Seebachans learned that the previous owner of their 2010 Honda Fit had the roof replaced at John Eagle Collision Center. Not only was this troubling because of the clean CARFAX report they received from the dealership, but also because they were told the roof had been replaced using industrial adhesive (as opposed to welding, as defined in Honda’s OEM repair procedures). This led to the Seebachans’ lawsuit against John Eagle, as the couple argued that when the roof separated, one of the walls curved enough to puncture the gas tank under the driver’s seat. This case has ignited a great deal of debate within the collision repair industry regarding not only insurer-shop relations, but perhaps more importantly, the potential consequences of ignoring OEM repair procedures. Jurors believed that an OEM’s “recommended procedures” weren’t just a suggestion, but rather an obligation by the repairer to follow the procedures to the letter. John Eagle argued throughout the trial that the insurance companies often dictated what repairs would or wouldn’t be completed based on what they were willing to pay, regardless of whether it brought the vehicle back to pre-accident condition. This case also serves as a wake-up call for collision repairers to learn from their mechanical counterparts when it comes to following OEM guidelines. Because they are under no obligation from insurance companies, mechanical shops
have much more leeway when it comes to pre- and post-repair scanning, for starters, but also with repairs in general. Without insurer pressures, mechanical shops have the freedom - and have for years - to consistently follow OEM repair procedures. Though this case is undoubtedly a learning opportunity for a number of reasons, utilizing mechanical repairers as a roadmap for stringently following OEM procedures is an important takeaway. Senate Commerce Committee Approves Vehicle Data Amendment On October 4, the U.S. Senate Committee on Commerce, Science and Transportation voted to approve the “American Vision for Safer Transportation through Advancement of Revolutionary Technologies” (AV START) Act (S. 1885) - legislation that would support the development of highly automated vehicle safety technologies. The bill included an amendment sponsored by Sen. James Inhofe (R-Okla.) that would convene a federal advisory committee within 180 days after the legislation’s enactment comprised of stakeholders to address “ownership of, control of, or access to, information or data that vehicles collect, generate, record, or store

in an electronic form that is retrieved from a highly automated vehicle or automated driving system.” Under the Inhofe amendment, which the Auto Care Association strongly supports, the advisory committee would be required to file a report with recommendations to the Senate Commerce Committee within two years regarding consumer access and control of data transmitted by autonomous vehicles. The advisory committee would include representatives from not only government and vehicle manufacturers, but also the automotive aftermarket, consumer safety groups, insurance companies, vehicle rental industry and fleet management organizations. The legislation now moves to the Senate floor for a vote. In early September, the U.S. House of Representatives passed its own version of autonomous vehicle safety legislation entitled the SELF DRIVE Act (H.R. 3388); however, an amendment on vehicle data ownership was not included. If the Senate votes to keep the amendment, both chambers will go to conference where the amendment would be considered for inclusion in the final legislation.

COMPLETE HEALTH ENVIRONMENTAL & SAFETY SERVICES An April 3 Wisconsin headline read: “Man Airlifted After Fall at Auto Body Shop: A man was airlifted to a regional hospital after he reportedly fell off a ladder at a nearby auto body shop and suffered a traumatic injury.” We don’t know anything about that Wisconsin injury, but it’s hardly the first serious injury from falls in automotive shops. You probably give little thought to how many people can fall in your shop. It isn’t the most obvious hazard in automotive repair—but it’s a surprisingly common cause of injuries. Think about it. Does anyone use a ladder? What about a small scaffold? Does your roof have exhaust fans or air handlers that need servicing? Ever have wet floors from melting snow or washing cars? OSHA recently did a major revision of a group of standards—Walking-Working Surfaces—which address the situations that result in falls. The new standards cover a lot of ground, but the requirements are pretty straightforward. Keep floors in good shape. Try to keep

Walk This Way them dry. In wet areas, provide drainage and mats so people aren’t slipping and sliding. If employees need to use ladders, the ladders have to be in good condition and suitable for the job. Check their condition before each use. They must be used correctly: The climber needs to face forward and keep three points of contact, always having at least one hand on the ladder when climbing. Don’t let employees use ladders when carrying anything that could cause a loss of balance, such as large, heavy or bulky items. If you’ve been storing bumpers on a mezzanine accessible only by ladder, you need to stop that practice, or find some way to get those bumpers to the ground other than carrying them. OSHA doesn’t discourage the use of ladders, but we caution that ladders make poor work surfaces. Rolling ladder stands or small scaffolds are much easier to work from. If you use the small rolling scaffold we see in a lot of shops, it must be kept in good condition. You can’t mix and match parts

from different manufacturers, unless you have proof that the hybrid will be structurally sound. Inspect it before each use. Don’t use a ladder on a scaffold. Lock the casters in place before anyone climbs on it. Guardrails on these small scaffolds aren’t mandatory, but they are a good idea. Have you added a storage mezzanine to your shop? Do people need to go on it? If you have an unprotected edge with a drop of four feet or more, you either need to prohibit anyone from going up there, or you need to put in some fall protection. The easiest type of fall protection: Guardrails. You can build them yourself out of construction lumber or purchase guardrail systems. Include a gate that’s easy to swing aside. If you decide to build your own guardrails, make sure they meet the requirements: The top edge needs to be about 42 inches high (plus or minus three inches). Put a mid-rail halfway between the top and the bottom, or use screen or something mesh to block the opening. Include a toeboard if there’s any chance of objects falling off. Make sure the railing is sturdy enough to handle 200 pounds of force. If you don’t want to or can’t install guardrails on your overhead storage area, figure out how else you’re going to protect someone who climbs up there. You can use safety nets or personal fall protection systems, but those are usually more of a nuisance than guardrails. Think about how people get onto that storage mezzanine. If you have a ladder attached to the side, it needs to meet certain design requirements. You need to extend the side rails 42 inches above the mezzanine, so people have something to hold onto as they step up. The ladder itself needs to have sufficient space for both hands and feet. What if you have a repair pit? It isn’t practical to put guardrails up around that, because you couldn’t drive cars over it. As long as it isn’t deeper than 10 feet, you can mark the floor six feet out, and post signs to warn people of the opening. Then allow only authorized employees within that six foot area. Do you ever go onto the roof? If anyone needs to work within six feet of the edge, fall protection is needed. You don’t need guardrails around the entire roof, only in the area where people need to work. As continued on pg. 21

Sick & Safe Time The Sick and Safe Time Ordinance Frequently Asked Questions document is intended to provide the public with information about how the Department of Civil Rights may guide its personnel in processing and investigating reported violations and interpreting the Sick and Safe Time Ordinance. In response to public comments and numerous requests for technical assistance received from individuals and stakeholders during spring and summer 2017, the Frequently Asked Questions document has undergone revisions.
The final version is available now on the Sick and Safe Time website (http://sicktimeinfo.minneapolismn.gov) in the Employee and Employer Resources pages. Revisions are intended to resolve ambiguity. The Department of Civil Rights’ substantive interpretation of specific Ordinance provisions has not changed. The way the Department communicates some of this information has been revised slightly. The Department carefully considered every comment and question it received and incorporated many into its guidance.
Both New Minneapolis Labor Standards require workplace notice posters, which are now available for download at http://minimum wage.minneapolismn.gov/employer-resources.html. Effective January 1, 2018, these posters will replace existing Sick and Safe Time (SST) posters, and fulfill the posting requirement contained in both the SST and Minimum Wage ordinances. A variety of languages, in addition to English, will be available for download this fall. Both employers and employees should contact enforcement staff regarding any outstanding questions or to request technical assistance.
