I Hit the JACKPOT! by Dave Bock, AASP-MN Associate Division Director

While I didn’t come home with bags of money, I did travel to Las Vegas last month to take part in Industry Week and the Aftermarket Auto Parts Alliance “Aftermarket Jackpot” National Convention. Industry Week attendance numbers are staggering, with over 2,500 exhibitors and 162,000 visiting aftermarket professionals from 135 countries. Over the course of three days, our APH/Auto Value conventioneers experienced the AAPEX and SEMA shows, business management training and technical seminars and listened to industry leaders share the important contributions of our automotive aftermarket industry to the overall global economy. Bill Hanvey (President/CEO of the Auto Care Association) opened my eyes with these impressive facts and figures during a pre-breakfast presentation at our hotel:

• Every single day: There are over 2,250,000 vehicles brought in for repair in the U.S. • Every single day: There are over 9 million product catalog look-ups in the U.S.

• Every single day: 158,000 brake jobs are performed in the U.S. • Every single day: Our industry contributes $1.5 billion to the U.S. economy ($392 billion annually) • 4.6 million jobs are provided by the aftermarket industry • Out of 535,000 total U.S. aftermarket businesses, 50 percent are independent service providers • Our industry keeps 280 million registered vehicles on the road and provides transportation freedom to 221 million licensed drivers

It wasn’t hard to walk away with the conclusion that our industry keeps America’s economy and vehicles moving. With 2018 coming to a close, it’s time to reflect on the “facts and figures” of our individual businesses and set the operational targets for the coming year. LEGISLATIVE UPDATE

Voters Have Spoken; 2019 Session on the Horizon The 2018 General Election has served up a number of significant changes that AASP-MN will need to respond to as we prepare for the 2019 Legislative Session. DFL Gubernatorial Candidate Tim Walz won by a fairly comfortable margin over Republican Jeff Johnson. Although the Governorship remains in DFL hands, there will be a number of changes at the Agency level. We will be watching the Department of Commerce to see whether Governor Walz will retain Jessica Looman as Commissioner. We have had an opportunity to meet Commissioner Looman and would regard her as a quality candidate for the position, but all Commissioners serve at the pleasure of the Governor and it remains to be seen who will emerge as the leader at Commerce. We will also be watching to see who is named to lead the Minnesota Department of Public Safety, Minnesota Department of Revenue and Minnesota Pollution Control Agency. These are the Administrative Agencies with whom we interact on a regular basis and we will be working to establish or re-establish our relationships with Commissioners in the new Administration. At the Legislature, there was a dramatic shift in power in the

Minnesota House. Going into the 2018 Election, Republicans were in control of the House. Democrats needed to “flip” at least 12 seats to take the majority. By the end of the night, they had “flipped” 18 seats and had taken a fairly resounding majority in the lower chamber. Having secured majority control, all leadership posts in the House will now shift from Republicans to Democrats. The new Speaker of the House is Representative Melissa Hortman (DFLBrooklyn Park) and the new Majority Leader is Representative Ryan Winkler (DFL-Golden Valley). The Speaker has reorganized the House Committee structure and has named new Chairs. Representative Laurie Halverson (DFL-Eagan) has been named Chair of the Commerce Committee and Representative Carlos Mariani (DFL-St. Paul) has been named Public Safety Committee Chair. These two committees are key to AASP-MN’s efforts at the Capitol, as they are where the bulk of our business is considered. This will be the first committee Representative Halverson has chaired, as she is only starting her fourth term. We plan to meet with her early in the Session to help establish our

Having Issues with a Vehicle? Check for OBD-II Dongles, NASTF, Kia Say The National Automotive Service Task Force and Kia have warned auto technicians that customers’ third-party OBD-II plug-ins might create issues during the diagnostic process and even affect the transmission on a Kia. NASTF Executive Director Donny Seyfer in an interview recently said the same Tier 1 supplier that built the Kia powertrain control module supplies other OEMs, so the issue might not be limited to a single make of vehicles. “Since 2011 KIA has been producing documents outlining issues that can occur with their CAN-equipped vehicles when certain devices are introduced to the vehicle electrical system,” a NASTF email citing Kia information stated in September. “KIA is not unique in this problem; however, there are some drivability problems that can be very frustrating for techs to diagnose. These can be remedied by identifying and removing these devices.” “For those of you who want the bottom line, DLC Dongles are particularly troublesome and can cause diagnostic failures and drivability problems,” Seyfer said. Seyfer said once such an OBD-II plug-in is removed, the CAN will return to normal operations. He also advised having the device off the vehicle the entire time the car’s in your shop. Subaru Tweaks Position Statement Language to ‘Require’ Pre-, Post-Scanning Starting in 2004 MY Subaru recently revised its scanning position statement to declare pre- and post-repair diagnostic checks mandatory on all vehicles dating back to the 2004 model year. The OEM’s statement supersedes a July 2017 document declaring that Subaru “recommends” the diagnostics operations. “For Subaru vehicles from model year 2004 and forward involved in a collision, Subaru collision repair procedure requires that pre-repair scanning be performed,” Subaru wrote. “Pre-scanning will reveal DTCs for items that are not functioning properly in the vehicle. It allows a shop to identify any issues early in the estimate process, allowing a more complete estimate and encompassing repair process. “Additionally, Subaru collision repair procedure also requires that post-repair scanning be performed on these vehicles,” the statement continued. “Post-scanning is critical in ensuring the malfunctioning items have been repaired and there are no remaining DTCs. It may also assist in assuring the appropriate calibrations and re-initializations have been performed.” Subaru’s revised statement still “recommends” shops use its Subaru SSM4 diagnostic tool for all scans. If the shop lacks this device, Subaru “recommends” the repairer use an asTech, which “performs a diagnostic scan remotely using a genuine Subaru scan tool.” “Subaru decided to change the language on its scanning position statement to reinforce its belief in the importance of evaluating a vehicle after a collision,” Subaru national wholesale parts manager John Lancaster wrote in an email, “Not doing so can have a direct effect on how that vehicle operates putting the safety of the customer at risk. 10 | December 2018

Exemptions to Digital Millennium Copyright Act To Allow Access for Independent Repair Providers In a victory for auto service and collision repairers and their suppliers, the Librarian of Congress expanded exemptions to the Digital Millennium Copyright Act (DMCA) that allow greater access to vehicle software by independent repair providers for diagnostic and repair services. Several national automotive aftermarket trade associations had requested these exemptions in the DMCA to protect consumer choice in both automotive replacement components and service. In an October 26th notice published in the Federal Register, the Acting Director of the U.S. Copyright Office acknowledged comments in support of expanding exemptions for vehicle repair to allow third-party providers to service vehicles on behalf of owners. The existing exemption for vehicle software only applied to vehicle owners and prevented third party service providers from performing diagnostic and repair work. The new exemption for motorized land vehicles “removes the requirement that circumvention be undertaken by the authorized owner of the vehicle, instead providing that it apply where such items are lawfully acquired.” This could extend to third party service providers, provided they do not violate anti-trafficking provisions of copyrighted software. In addition, the Copyright Office also removed the language excluding access to computer programs for the control of telematics or entertainment systems, due to the “increasing integration of vehicle computer systems.” However, the Copyright office stated: “While the broadened exemption permits incidental access to a vehicle infotainment system, it provides that such access is allowed only to the extent it is a necessary step to allow the diagnosis, repair, or lawful modification of a vehicle function” and includes the additional requirement that circumvention may not be “accomplished for the purposes of gaining unauthorized access to other copyrighted works.” The ability to access vehicle systems is a key need for auto service and collision repairers, particularly as embedded technology and advanced driver assistance systems have increased the need to diagnose and calibrate systems before, during and after repairs. GM Announces Collision Repair Network Has Nearly 1,000 Dealer and Independent Facilities Enrolled General Motors’ Customer Care and Aftersales division announced that in just a few short months since it launched, nearly 1,000 dealers and repair facilities have begun enrollment in the GM Collision Repair Network to help with safe and proper repair of GM vehicles. “The industry response means that repair facilities are seeing business value in becoming a part of GM’s Collision Repair Network,” said John Eck, collision manager, GM Customer Care and Aftersales. “Collision repair professionals are telling us they see how the Network can help make their business more efficient, speed up the repair process and give confidence that vehicles are repaired accurately and safely.” More information about the network can be found at www.genuineparts.com. The announcement was made at the SEMA show, where GM showcased the repair procedures related to the all-new 2019 Chevrolet Silverado 1500.

CCC/MOTOR: Deduct for Overlap Grille Labor – Recent Inquiry 12871 discovered that when grille R/I is being performed on bumper cover R/I or R/R labor, Deduct for Overlap is still being applied to the R/I grille labor when the time has already been adjusted to the R/I labor value based on the H Notes section. Below is the response from CCC: “It appears the attempt to allow the difference of labor time between R&R and R&I grille is not working properly when the R&R grille is selected with the R&R Bumper, and the bumper includes only the R&I grille per the footnote. This is causing a negative impact that was not identified initially. CCC does not currently have the ability to support the R&I portion of labor time being deducted from the R&R grille time when selected with the R&R or O/H Bumper. The overlap deduction currently in place will need to be removed, and this concern will be added to the backlog for further review when time permits.” All Three Systems: ADAS Measurement Labor – Vehicles equipped with ADAS Blind Spot Monitor systems may have a procedure in the workshop manual to measure the mounting bracket position. This procedure can be labor intensive and require additional r/I work to access certain control points on the vehicle. Labor to measure, verify and repair – if needed – is NOT INCLUDED and should be determined by an on-the-spot evaluation.

The Senate was divided, with 33 Republicans and 33 DFLers and one open seat. A Special Election was held on Election Day to fill the seat which had been vacated by Republican Senate President Michelle Fischbach, who had stepped into the role of Lieutenant Governor by operation of the Constitution when Lieutenant Governor Tina Smith was appointed by Governor Dayton to fill out the remainder of Senator Al Franken’s term in office. This was a solid Republican District which stayed in Republican hands. Representative Jeff Howe was the Republican candidate for that Senate seat and County Commissioner Joe Perske was the DFL candidate. In the end, Representative Howe won the election and will serve out the remaining two years of Fischbach’s Senate term. This result means that Minnesota will go forward with divided government in its legislative branch. We are now the only State in the Union that is operating with one legislative chamber controlled by the Democrats and the other controlled by the Republicans. As always, we would ask AASP-MN members to let us know if they have any relationship with legislators - new or returning. Knowing of your relationships with these key public officials paves the way for us to communicate association concerns as we advocate for industry interests at the Capitol.
