DOES 2020 REALLY MEAN SOMETHING NEW FOR YOU IN THE NEW DECADE?

Forgive me that this is not the first month, but as January is starting off as I write, a lot of things have hit me. If I was really cliché – which I am – then I’d be saying that 2020 is the year of “vision.” Get it? Like 20/20 vision? Okay, maybe that’s a bit lame for you. But when a new decade begins – like starting your twenties, thirties, forties, etc. – there can be a lasting sentiment in your approach forward. If you’re looking at it begrudgingly, then you’ll have a demeanor of living in the past, repeating old habits, staying in the same rut or, worse yet, making that rut a home. However, if you’re intent on making it the best next 10 years of your life, then it’s like getting a new lease on a brand-new life. Like a new car smell.

Do Numbers Really Matter? Some numbers seem irrelevant, like the barcode on the loaf of bread you’d never take note of, but some numbers mean everything. If you’re talking about the numbers representing dollars in the bank account, then you’d agree that numbers can matter greatly. If they’re up, you’re relaxed or happy even; conversely, if they’re down, you could be seriously ramping up the anxiety factor. Personally, the new decade will also usher in a new decade of age for me. (I’ll let you guess which one.) It’s one of those really reflective times where you assess your position on life, family, work, faith, friends, etc. I’m not really a goals-oriented person, because it’s usually a short-lived effort, but I so badly want to reorganize some of my priorities to accomplish new things.

If you’re like me, then this year could kick off a new “lifestyle change.” Rather than a goal, let’s talk about creating a lifestyle that implements habits that lead to positive change. Don’t be the person at the gym or with a new diet fad that only lasts three weeks before you quit. Let’s make one small choice, followed by another, like tiny baby steps that help us get to the lifestyle we want. You Have to Know What the Lifestyle You Want Looks Like – What Is Your 2020 Vision? What options are there for your career? Let’s say you’re a shop manager or an estimator. You could take the first 15 minutes of your day to have a staff pow-wow to assess the goals of the day and give everyone a high five. Or you could decide that every Tuesday at 9am, you meet with one employee for 30 minutes to ask them about their own career and lifestyle and how to improve their trajectory. There’s also an option to say, “I want to take one day for an education class each month.” Schedule out all 12 – and they could be job-related, personal or something completely different. My point is to make this an intentional effort to create a decade of your life that moves toward your own vision. Put on your own glasses and see it. Let’s make this the best way to get to 2030 we’ve ever imagined! Cheers!

NEWS VIRGINIA BUREAU OF INSURANCE OPENS COMPLAINT PROCESS TO SHOPS Although it is widely believed that only consumers are able to submit complaints to the entities overseeing and regulating the practices of insurers in their state, WMABA reports that this is no longer the case in Virginia. While the association is unclear when this change was entered into law, it was informed at a recent meeting with the Virginia Bureau of Insurance (BOI) that repair facilities are indeed permitted to file complaints on behalf of consumers. “It’s exciting to see if this opportunity is utilized by the repairers to at least show where problems are arising,” comments WMABA Executive Director Jordan Hendler. “The Department is having a hard time equating what we tell them with the complaints because there just aren’t any. Without actual submissions, they will not act on behalf of our interests.

“The BOI seems eager to receive complaints,” she adds. “This is its main avenue to determine conduct issues outside of its insurer market conduct studies, which haven’t led to any change for our industry. We’ve seen a few shops really encourage customers to file when issues arise, but not that many do this. Now that shops can file themselves, it’s unclear how many we will see, but we are hopeful this gives more options.” With a system in place to better address consumer issues in Virginia, Hendler and the rest of the WMABA Board of Directors plan to investigate similar remedies in other member areas. “Our Board agreed to pursue this recent advancement in Virginia to see what happened before putting a lot of effort into other states. Maryland, as an example, has a way for the repairer to file the complaint, and there is even an appeals process involving administrative hearings. The consumer can represent themselves, but the repairer would have to have representation by legal counsel if they were to act directly. All that said, it remains that the biggest mechanism for change is to actually send in the complaints. WMABA is here to help that process in whatever state in our region a repairer is in.” WMABA has provided the following verbiage that a shop in Virginia can use and have a consumer fill out to include in that shop’s complaint on that consumer’s behalf: I, <<policyholder name>>, authorize <<Shop Name>> and their representatives to file a Property and Casualty complaint on my behalf to the Virginia State Corporation Commission Bureau of Insurance. This permission is limited to the discussion of repairs to my vehicle, and policy provisions if applicable. For reference, 38.2-517 C allows repair facilities, with the written authorization of the insured or the claimant, to submit a complaint.

SPOTLIGHT Kenwood Auto Body Kenwood Auto Body has been delivering quality service and expert care to customers for nearly three decades. Ken Steiding founded the business back in 1991 when he opened a small shop in Bethesda, MD. The business quickly grew from there, requiring a move to Germantown in 2000 that expanded the shop into a stateof-the-art, 10,000-square-foot facility that was the first of its kind in the area. The Germantown location still stands today, and the business has expanded substantially with the opening of two more locations. The Gaithersburg shop opened in 2014; last September, they opened a third shop in Rockville. The business tripled in size not just with the additional locations, as its crew also expanded from 15 to 45 members over the past decade. “It’s been a whirlwind over the past four or five years,” says Ken’s son, Mark, who joined his father in the business in 2010. Mark took over Kenwood Auto Body in 2017; his father One of three Kenwood Auto Body locations serving the WMABA community

still works alongside him. “He still comes to work, and we bounce ideas off each other. I want him to keep working. It’s nice having him in the business. My dad is working harder now than I think he did 10 years ago. I truly enjoy having him still involved in the business and appreciate everything he does.” Although he was born into the industry, Mark says his love for the collision repair world really didn’t start until he got his hands dirty working at the shop. “I did the college thing, and I really had no interest in getting into the business,” he admits. That changed when he started working at his father’s shop soon after he completed college. “I just fell in love with it; I had a real niche for it.” Taking care of customers is Kenwood Auto Body’s top priority. “Our customer service and repair quality

BY ALANA BONILLO are what really differentiates us,” explains Mark. “We offer a great experience from start to finish.” Mark credits Kenwood Auto Body’s excellent team for making sure the high-quality repairs that define its brand are always met. The business has acquired multiple OEM certifications, including (among others) Tesla, Ford, GM and Nissan. He believes going the OEM certification route is the right direction in today’s ever-changing industry. “We made the commitment and investment to repair cars properly and safely for the consumer.” Training is very important to the operation, and all team members do their part in making sure they stay up to date. All three shops are I-CAR Gold. Mark is grateful to be a member of WMABA, which he believes is always on top of the latest industry news and is the first to share it with its members. He finds the association’s insight and research to be worthwhile and hopes to be able to get more involved with the association and its community down the line. When asked what he loves most about the collision repair business, he didn’t hesitate to say it’s the excitement that comes with being presented with new challenges and opportunities. “Some days are good; some are bad. NEWS BIPARTISAN SUPPORT DRIVES CONSENT DECREE CAMPAIGN The industrywide fight to preserve the 1963 Consent Decree is far from over, as 2019 closed with considerable bipartisan support for the long-running consumer protection document. In late November, Senators John Kennedy (R-LA) and Richard Blumenthal (D-CT) sent a joint letter to the Department of Justice (DOJ) urging it to preserve the Consent Decree in support of consumers. The letter reads in part:

In addition, they expressed to me that, should this [C]onsent [D]ecree be terminated, it would eliminate a long-standing agreement to protect consumers against price fixing for auto repair claims and against compelling – commonly referred to as steering – consumers to use only those repair shops beholden to insurance companies.

Eliminating this agreement would turn back the clock on automotive consumer protections. It ensures that consumers are not coerced or directed to car repair shops that have sweetheart deals with certain insurers. It continues to promote competition and continues to be in the best interest of the American consumer.

This is an issue of great importance not only to collision repairers across the nation, but to every American consumer.”

“We are enormously grateful to Senator Kennedy and Senator Blumenthal for this letter,” commented Society of Collision Repair Specialists (SCRS) Chairman Brett Bailey in an association press release. “This is an issue of great importance not only to collision repairers across the nation, but to every American consumer.” In late December, the DOJ received a letter in support of the Decree from US Representative Mike Johnson (R-LA), who serves as chairman of the Republican Study Committee. Johnson made it clear that his position was prompted by the outpouring of concern expressed by industry members: In August of this year, following the [D]epartment’s proposed review of nearly 1,300 antitrust judgments enacted without any sunset dates, I heard from numerous concerned constituents – many of whom are small businessmen and women who support this administration’s policies – who continually express how this [C]onsent [D]ecree continues to promote competition and

Last April, the DOJ announced plans to review nearly 1,300 antitrust judgments enacted without end dates; in August, the 1963 Consent Decree was identified as one of the actions proposed for termination as part of a much larger de-regulatory initiative by the current administration. The DOJ held an open comment period, which was extended to last October specifically for comments on the Decree. The document quickly became one of the two most-commented-on Decrees of the 1,300 proposed for termination. H&D At the time of this writing, industry representatives are at the Capitol advocating for additional support of this Decree. While it may not seem like a “big deal,” losing a foothold we can stand on is always a blow to our industry. Anywhere that proper accountabilities – in law – can be maintained, the better it is for every shop in our country. One of the most popular speakers in the global automotive industry, WMABA veteran Mike Anderson (Collision Advice) will be among the featured Collision P.R.E.P. presenters for the 2020 show. “Next to SEMA, there is no other industry event that has the level of participation from OEMs and training offerings like NORTHEAST,” he says. “There isn’t anything in the same league. Now, you see people from Texas, Kentucky, Florida and other places around the country.” WMABA Board member Steve Krieps (Greg Cline Automotive; Winfield, WV) plans to attend NORTHEAST for the third year. ASK MIKE What Can Non-Certified Shops Learn from Certified Ones? This month, we “ASK MIKE” for his thoughts on how noncertified shops can still implement practices from OEM-certified facilities to their advantage. We at Hammer & Dolly hope you find this following exchange useful, and we encourage you to reach out to us if you have a question for Mike on this or any industry-related matter that he can answer in a subsequent issue.

Hammer & Dolly: Although more and more collision repair facilities are becoming OEM-certified all the time, some shops are still not considering and pursuing this option. For those businesses that are passing on becoming certified at this time, what are some things they can still take away from the certified mindset that can improve their skills and service apabilities? Mike Anderson: First of all, I think OEM certifications are an absolute must. If you’re not pursuing them, then you’re making a mistake. You need to pursue at least some OEM certifications. Even if you don’t, I think you still have to make sure you’re repairing the vehicle safely and properly. You also need to make sure you’re using the right equipment and accessing the OEM repair procedures regardless of your certification status. Even if you’re not OEM-certified, you still have access to those procedures. It’s an absolute must from a liability standpoint to

research them. Right now, you cannot be Toyota-certified unless you’re owned by a Toyota dealership, but you can still send your people to Toyota factory training. You should still take advantage of that if you’re repairing Toyotas. If you’re not certified, make sure you can still buy the parts, particularly for high-end luxury vehicles. Audi, for example, restricts parts sales in some instances. Others may do the same. If there are parts restrictions and you start getting into that car, now you’ve started something that you can’t finish. You need to know that before you even start to touch that vehicle, which could end up being a total loss if you do an improper repair. A lot of OEMs have really pushed the quality of welds in our industry. I credit Audi and Mercedes-Benz for that. OEMs are pushing the envelope on that and making us better in order to weld. If you’re not a certified shop, you still need to get your employees into any type of welding training you can versus having one technician tell another technician how to do it. Make sure you take advantage of the things you know you need to do to maintain proper training at your facility.

H&D: With a new year here, the focus on accessing and utilizing OEM procedures is very likely to grow. What do you see as either a new point of concern or one that already exists but will escalate in the months ahead?


Good advice for all shops.

MA: We’re starting to see telematics start to grow. Collision repairers will have to become educated as to how to place the vehicle in ‘service’ mode so that when they take it apart, it doesn’t trigger an email to the customer that there is something wrong with their car. My sister had her Lexus fixed, and the shop took the door off. That door was connected to Safety Connect, and she got six emails in one day saying, ‘Hey, there’s a problem with your door.’ Even if you’re not certified, more cars will be connected in the future. You have to research the procedures for how to put those vehicles in ‘service’ mode; otherwise, you’re going to have a lot of unhappy customers wondering what’s wrong. H&D
