Ok, boomer by ThOmaS GrECO, publiShEr

I recently became aware of a new phrase that is making its way into our culture. I happened to be watching the latenight show Lights Out with David Spade. (Check it out if you long for the days of talk shows without politics.) A few of the comedians on the show were making some older comedic references, and the “millennial” or “Generation Q” or whatever you want to call her on the show uttered the phrase, “Ok, boomer.” Now, I’m not an idiot. I kind of figured that the put-down was meant for baby boomers who like to reminisce about the “good old days.” In other words, it’s a phrase used by losers in their teens, twenties or thirties who can’t remember anything culturally significant prior to the Kardashians. (It’s also an incredibly crappy song.) But I get it. I’m sure people my age used to say something similar when our parents referenced some old Sinatra song or Bogart movie while disparaging the latest Beatles or

Stones record. But there is a difference… There hasn’t been anything better since the Beatles or the Stones. Want proof? The Beatles just released an expanded copy of their Abbey Road album last month. Know where it landed on the charts? Number ONE. Know when it was recorded? FIFTY YEARS AGO! I’ll make anyone reading this a promise. If Drake, Lizzo or Taylor Swift has a Number One album 50 years after it was released, my kids or grandkids will buy you a hot dog. Mark it down. I digress…So, of course, I was riding on a train when I came across an article that pissed me off. The gist of it was the author was trying to do a hit job on the former coach of the New York Rangers hockey club, John Tortorella. Now, I am not a big hockey fan, and I am especially not a Rangers fan, but I always liked Tortorella because he was like an old school, tough-as-nails kind of coach I grew up with. In this “article,”

the “author” was trying to get Tortorella’s past and present players to talk about how his methods were outdated and whether or not they felt intimidated or abused by him. Hell of a premise, right? It must have been a shock to the writer that he couldn’t find one player to support his thesis. (Someone fishing to try and oust a successful leader…Seems to be a common hobby these days.) What’s this all got to do with anything? Well, like I said, I was alone on a train, so of course I had to comment on it. You can guess what happened:

Me: “I thought professional hockey was the last hope for fans who were brought up with a ‘sticks and stones’ mentality. I guess that’s over now. They buried Don Cherry, and here you tried to bury Tortorella. What’s next? Boxers crying, ‘The other guy hit me’? Everything about today’s sports, from management to players to writers, is soft. Sad.” Thus, I stupidly opened the door…

B.S.: “In the developed world, you cannot place your hands on another person without the very real possibility of prosecution, not to mention losing your job. Playing a sport is one of the very few exceptions - PLAYING, not coaching. What is so hard to understand about that?”

Me: “The players must shake in their skates at a 61-yearold who weighs 175. And God forbid he insults them! Take a

history lesson and Google ‘Fred Shero and the ’70s Flyers’ or ‘Terry O’Reilly and the ’70s Bruins.’ They weren’t afraid to get hurt – feelings or otherwise.” B.S.: “Ok, boomer.”

There it was!!!

Me: “Lol. Original. Creative writing major?”

B.S.: “Such a boomer thing to say.” Strike two.

Me: “My bad. It must have been an English major. Can you think of a synonym for boomer, youngster?” B. S.: “Ok, boomer.”

Got $1.40 to Save your industry? If you really think about it, you’d probably be amazed by how much money you go through in a single day without even realizing it. Do you grab a bagel and coffee on the way to work? That’s a good four dollars right there. How about lunch? That’s another $10. How about all the gym fees and online media subscriptions you pay each month that you never end up having the time to even enjoy? Those little things add up in huge ways. Now, with that in mind, here’s a question for you: Would you even miss $1.40 a day? That’s nothing, right? Well, if you agree, set that figure aside for your industry. At the end of the year, you’ll have a little over $500 to donate. Imagine if every body shop in New Jersey did that. With that kind of money, we could change this industry. That money could go to a number of things: The AASP/NJ Legal Defense Fund, the hiring of a lobbyist, addressing issues head on, improving the technician shortage and providing more intensive training for our members, just to name a few. Also, imagine if the shops’ employees – the ones who would really benefit from a brighter future – chipped in as well. There’s no telling how far we’d go.

I don’t think there’s anyone out there who’s truly happy with the insurance industry’s behavior and its constant restrictions on procedures or paying fair and reasonable rates. I hear from insurers all the time that our industry doesn’t stick together and that we’re our own worst enemies. The problems we face are not going to go away on their own, and we can’t fight these battles individually. I’d like to see drastic, positive change in this industry in my lifetime, but I’m one person who can’t do it alone. If the past few years were any indication, 2020 is going to be a rough time for this profession. We’re facing the greatest technological and financial demands in our history. Insurers won’t back down without a fight, and we need to hold our heads up high and perform proper repairs for our customers. Our costs are skyrocketing, and we can’t sustain our present conditions another year, let alone five. We need to fight back - it's no longer just a suggestion. We need to survive; we need to save our industry. And it all starts with $1.40 a day. There is strength in numbers.

attention all Collision Shop Owners!

EXECUTIVE DIRECTOR’S MESSAGE

Legislation has been introduced to force insurers to follow the rules or pay the price, just like any other business providing a service to New Jersey consumers! If you want to know what the problem is here in New Jersey that allows insurers to treat consumers any way they like, refuse to pay for needed and necessary repair procedures, limit the payment for Labor Rates to an unreasonable amount, fail to adopt an accurate method of calculating the cost of paint and materials and much more, then listen up! Please pay close attention to this message, and be prepared to take action. Long ago, insurers outsmarted the collision industry and worked out a system that would put them above the law. That’s right; insurers are above the law when it comes to following the rules and regulations governing fair claim settlement practices. In New Jersey, there is no private right of action for a violation of the regulations that govern fair claim settlement practices, even when an insurer blatantly abuses a claimant or mishandles a claim by straying from the law. In such a case, the only method of dealing with such abuse is to file a complaint with the New Jersey Department of Banking and Insurance. Even then (under the current rules), a violation of the regulations is not considered valid until there is evidence that the insurer has done it enough to create what is considered a “general business practice.” Are you kidding me? That’s like making it illegal to run a red light and then requiring a police officer to catch the same person doing it at least three times within a week before they can give that person a ticket. The regulations governing fair claim settlement practices are only designed to give people the warm and fuzzy feeling that there are a set of rules that insurers must follow. In reality, the current rules that are in place to govern insurers conduct during the claim settlement process are violated on a regular and daily basis. Even certain insurers that were once considered the best in the state are now almost completely ignoring the rules because there is little consequence when they violate the regulations. Anyone who has recently submitted a claim has likely seen the tactics that certain insurers use to shortchange or deny payment. Also, anyone who has recently had the unpleasant experience of crashing their vehicle and submitting a claim for the repairs has likely witnessed the games certain insurers play in an attempt to keep payments to a bare minimum, even when those tactics are extremely likely to put the vehicle owner and their family back in an unsafe vehicle.

In the past, when an insurer refused to pay for a certain repair operation (like blending the paint to make the color match or aiming the headlights), the shop would usually just accept it and perform the procedure without being compensated for the work. Other times, the shop owners would just refuse to perform the procedure because they were not being paid to perform it. Now, because of sophisticated vehicles equipped with ADAS that require scanning and re-calibration after a collision, a shop cannot let the vehicle leave without performing every repair procedure that the vehicle manufacturer mandates. Ignoring this could result in liability associated with an improper or unsafe repair. In reality, these vehicles are just a step away from driving themselves, and the equipment and training required to repair them are extremely expensive. Such training and equipment cannot be paid for on restrictive Labor Rates that are less than what bicycle and lawnmower shops are currently charging and being paid. The current regulations that govern unfair claim settlement practices address all of the issues related to claim settlements, from the time a claim is first reported until it is settled and closed. If the regulations were adhered to, there would not be a problem; they are comprehensive and spell out how claims should be handled from start to finish. However, because there is currently no private right of action that can be filed when the regulations are violated or ignored, most insurers act as if they don’t even exist and commit violations on a regular basis. To make things even worse, the New Jersey Department of Banking and Insurance is of little help in resolving the issues because of the power insurers have over it. The good news is legislation (S-2144 & A-3850A/A4293) has been introduced to create a private right of action where a claimant may file a civil suit in court of law to address and resolve any claim settlement issue under the following terms: 3. a. (2) any violation of the provisions of section 4 of P.L.1947, c.379 (C.17:29B-4). b. In any action filed pursuant to this act, the claimant shall not be required to prove that the insurer’s actions were of such a frequency as to indicate a general business practice. c. Upon establishing that a violation of the provisions of this act has occurred, the plaintiff shall be entitled to: (1) actual damages caused by the violation of this act; (2) prejudgment interest, reasonable attorney’s fees and all reasonable litigation expenses; and (3) treble damages. If the provisions above sound familiar, it’s because they are basically the penalties found in the New Jersey Consumer Fraud Act that a collision shop would be subject to if they were to charge a consumer for a part and then put it on the vehicle and repair it instead. The provisions that insurers are supposed to be following in the regulations are not changing one bit under this legislation. The bad news is certain insurers are now starting to send out letters to their insureds, making false and misleading comments in an effort to prevent the legislation from becoming law. One claim that is being made is that the New Jersey Legislature is fast-tracking this legislation and that it will substantially increase the price of personal automobile and homeowners’ insurance coverage in the state. This is certainly incorrect and apparently stated to mislead people at best. This legislation is not on the fast track. It was first introduced in March 2018 and then referred to the Assembly Financial Institutions and Insurance Committee that June. It has been stalled there ever since. Bills similar to this one have been presented in the past and got buried in the same way and eventually dumped. This legislation will also not substantially increase the price of personal and homeowners’ insurance coverage in the state. An insurer cannot abuse its insured or improperly deny an insured’s claim and then be forced by a court of law to pay what the insured was actually owed or entitled to – along with court cost, attorney fees and treble damages – and then use those additional costs that resulted from their own wrongdoing as a basis to obtain a rate increase. Insurers are claiming that this legislation is not necessary because claimants already have the right to challenge a carrier’s actions under existing laws. They also claim that New Jersey’s current insurance consumer protection laws are among the strongest in the country. Again, are you kidding me? That statement is absolutely untrue. The existing law is basically useless. It has no private right of action, which means one cannot file a suit to get a resolution to a claim issue even when an insurer is trampling on the regu-

lations governing fair claim settlement practices. Give me a break! This legislation was introduced for this exact reason. It validates a one-time violation of the existing regulations and subjects an insurer to the same penalties that any other business would be subject to when they cheat a consumer during the course of a business transaction. Certain insurers are claiming that the special interests behind the legislation are actually trying to create an imbalance in the present system by permitting and encouraging frivolous and unnecessary lawsuits to generate higher costs and legal fees. What a joke! Insurers and their supporters are now encouraging their insureds to call their legislators and tell them this legislation is a bad deal. Well, insurers are right that consumers should be calling their legislators, but not for the reason the insurers want them to do so. Consumers – especially those who have been abused by an insurer when they put in a claim to cover a loss and were either shortchanged on their claim or had it improperly denied and received no help from the Department of Insurance – should be calling their legislators and telling them to vote “yes” to this bill. The issue of insurers refusing to pay for repair procedures and lowballing Labor Rates and material costs is not a new occurrence, although it is worse now than ever before. This has been an ongoing battle for as long as I have been around. The difference now is that if the manufacturer-recommended/required repair procedures are not followed, cars will be improperly repaired. The structural integrity of the vehicle may not be recreated, and people are likely to die should that vehicle be involved in a future collision. Even one small alteration or step away from the OEM manufacturer’s repair guidelines can cause a catastrophic result. A typical example of what can happen when modern vehicles are repaired in a manner other than what the OEM recommends is shown in the infamous John Eagle Collision Center case, in which a dealer shop in Texas had to pay the plaintiffs (Matthew and Marcia Seebachan) $31.5 million in damages. (Background on the case is is featured in the November and December 2017 issues of New Jersey Automotive, available at grecopub lishing.com.) The bottom line is that insurers are not going to start paying for all the required repair procedures at Labor Rates that allow for a reasonable profit just because a shop got sued for improper repairs and lost millions of dollars. The main reason they won’t is because the current system does not have any serious consequences. However, this legislation has the ability to change that and hold insurers accountable. Once it has been established that the insurer has violated the regulations governing fair claim settlements, the claimant (or plaintiff, in this case) shall be entitled to the actual damages caused by the violation of the rules, prejudgment interest, reasonable attorney’s fees, all continued on page 26

insureds out of millions (if not billions) of dollars for years because of the lack of accountability for their wrongdoing. What has been happening between insurers and their claimants is equivalent to consumer fraud when any other type of business goes into a contract with a consumer and then fails to deliver what is promised in the contract.

Insurance companies know this legislation will hold them accountable for the improper and fraudulent actions that they have been able to get away with for years. That is why insurers are sending false and misleading letters to their insureds claiming that this legislation is a bad thing and that it will raise the cost of insurance. It’s a scare tactic. Well, collision industry, you have experienced exactly what I have laid out in this article for years. I know this because I have run the AASP/NJ Hot Line for over two decades and have heard it over and over, day after day. During this time, I have also seen and gathered answers or responses to complaints made to the Department of Banking and Insurance telling the person making the complaint that it is basically unable to offer further assistance and is closing the file. Every collision shop in New Jersey should be contacting its legislators and requesting that they support this legislation. Every shop owner should be educating their customers about the issues described herein and how this legislation can make a change for the better. The only way insurers are ever going to follow the regulations that govern fair claim settlement practices is if or when they are held accountable for their own actions. This legislation does exactly that. AASP/NJ will soon provide more information on how collision shop owners who have seen the abuse of the regulations firsthand can do their part in making sure that this legislation passes. I will expect every member to drop whatever they are doing when this information is provided and take the action necessary to make this legislation become the law of the land! Stay tuned. Class action Suit against New Jersey manufacturers insurance moves forward

The Union County Superior Court has rejected a motion to dismiss filed by New Jersey Manufacturers Insurance (NJM) in a class action lawsuit brought against it in New Jersey. The suit, filed in June and led by plaintiffs Sam Mikhail (on behalf of the now-dissolved Quality Auto Painting Center of Roselle, Inc. d/b/a Prestige Auto Body) and BMR Automotive Service, Inc. (d/b/a Robbie’s Automotive & Collision Specialists), alleges that NJM committed a number of offenses including violations of the Racketeer Influenced and Corrupt Organizations (RICO) Act, the Consumer Fraud Act (CFA) and the New Jersey Antitrust Act (NJAA), as well as individual claims for injurious falsehood and tortious interference with prospective business advantage. The plaintiffs, on behalf of themselves and the class members, seek actual/punitive/treble damages, interest, costs of the suit, attorneys’ fees and “such other and further relief the Court deems just and proper.” Additionally, the suit seeks injunctive relief to prevent future injury. “At this point, we have rather significant positive action against NJM, including for violations of RICO and antitrust,” comments the plaintiffs’ attorney, Joshua Bauchner of Ansell Grimm & Aaron, PC. “We believe this is the first action against an insurer of this nature in New Jersey. We have some pretty substantial evidence regarding steering and the disparagement of the plaintiffs.” Prestige Auto Body alleges that it was forced to substantially cut its labor and paint charges to meet considerably lower “take it or leave it” rates set by NJM. Additionally, Prestige claims that NJM did not compensate them for the extra time needed for the installation of aftermarket parts and will only permit payment for a regular OEM part if an auto body shop first attempts and fails to install the aftermarket part. The suit states that “it often takes months to secure a refund for the aftermarket part which could not be installed and to secure agreement for payment from [NJM], without accounting for the delay suffered by the consumer.” Robbie’s Automotive & Collision Specialists owner Robbie Berman, who participated in NJM’s Direct Repair Program (DRP) for more than two decades, claims to have left that program last year after receiving unsatisfactory reimbursement from the insurer for his services. The suit includes various examples of NJM subsequently steering work away from Berman’s facility by “intentionally misrepresent[ing] to insureds that Robbie’s and other targeted

body shops are not on [the insurer’s] ‘preferred list of shops’ - even though they are not permitted to have such a list and insureds did not request a recommendation from [NJM].” “For the past five years, they were promising me some kind of increase [in the Labor Rate],” Berman says of his decision to leave NJM’s Direct Repair Program. “The last time they presented me with a contract, not only did they not give an increase, but they took things away. They told me that washing cars was a part of me doing business, and they cut back on sublets. Cars keep getting more technical, and employees keep getting more expensive. The cost of the cars keeps going up, but somehow the Labor Rate to repair them keeps going down.”

Charles Bryant, executive director of the Alliance of Automotive Service Providers of New Jersey (AASP/NJ), believes a successful conclusion to this lawsuit could help put an end to a host of issues that continue to negatively impact collision repair facilities throughout the state. “This suit was brought on by the insurer because of greed and their unwillingness to pay a fair and reasonable amount to repair vehicles damaged as the result of a collision. The insurer is dictating what it will pay rather than making all reasonable efforts to negotiate an agreed price to repair an automobile as required by the regulations governing fair claim settlement practices, while the New Jersey Department of Banking and Insurance looks the other way. When a collision shop fails to surrender and take whatever the insurer wants to pay, the insurer engages in unlawful ‘steering’ activity by claiming that the shop is being unreasonable and overcharging; they then pressure insureds to have their vehicles repaired at specific ‘preferred’ repair shops that can afford to fix the vehicles at lower rates because of the high volume of work being steered to them. This type of suit has to happen because of the unwillingness of greedy insurers to work these issues out and pay fair and reasonable rates for the procedures now required to safely and properly repair vehicles on the roads today.” NJA

The Alliance of Automotive Services Providers of New Jersey’s (AASP/NJ) NORTHEAST® Automotive Services Show returns to the Meadowlands Exposition Center in Secaucus March 20-22. Now in its 43rd year, the show continues to be the fastest growing regional show in the country. The New Jersey Workers’ Compensation Rating and Inspection Bureau has released the newly promulgated rates for 2020: The Auto Dismantling rate decreased from $18.32 to $15.58. Auto Body Repair decreased from $4.54 to $4.32. Auto Garage decreased from $6.29 to $5.69. Clerical decreased from $0.19 to $0.18. Iron or Steel Scrap Dealer decreased from $15.44 to $13.61. Salesperson decreased from $0.44 to $0.42. Store: Retail Accessories (Counterperson) decreased from $5.10 to $4.76.

PLEASE NOTE: The Store (Counterperson) code must be approved prior to use. The operation must be physically separated from salvage and parts storage, and it must not have any interchange of labor. This code does not include drivers. Also, the executive officers’ annual minimum payroll is $34,320, and the annual maximum payroll is $137,280. Lastly, if your insurance policy is written in the New Jersey State Plan, you are going to be charged an additional 20 percent (minimum) for the Plan Premium Adjustment Program and will lose the Premium Discount.
