I heard the name Lee Vetland for quite a long time before I ever met him. Back in the early ’80s when I first started doing this stuff, the state was broken into four separate auto body associations. Although there were technically four, there were only two that had real power. Imagine it like The Godfather. Sure, there were other

families, but everyone looked to the big guns on the block: The Corleones and the Barzinis. In my mind, the association I worked for (the North Jersey Auto Body Association, or NJABA) were the Corleones. The Central Jersey Auto Body Association (CJABA) were the Barzinis. Each had their own board of directors, magazine and

executive director. Yes, they worked together for the greater good, but there was always a bit of a rivalry going on. After a few years, I started hearing about this guy from the CJABA named Lee Vetland. I heard his name so often that I assumed he was their “Don.” Both associations would have events during the year and I Visit us at NORTHEAST® Booth 108

distinctly remember finally getting introduced to Lee. He grabbed my hand, looked me up and down and said with a straight face: “TOMMY GRECO. So, this is the guy who wants to get rid of Spray Dust (the CJABA’s magazine).” Then he pulled me in and gave me a big hug. From that day on, every time I walked into the room and Lee saw me, I would hear, “TOMMY GRECO, how the hell are you doing?” He’d call me over and give me a big hug. Once I had my health troubles, he would always make me sit down next to him and ask if I was taking care of myself. And he would scold me if I ever said anything other than “yes.” It’s funny, thinking back now. He never, ever

called me Tom or Greco. In person, on the phone, even in a text, it was always “TOMMY GRECO.” I can hear his voice as I write this. As you will see in our story about Lee on page 22, he had that kind of effect on people. You may see only four pages worth of stories but trust me, we could have gotten 100 people to tell you how Lee helped them. He was a mentor, a friend, a father and a real body shop guy. He was one of the few people that meant it when he told you, “If you need anything, just call me.” A couple of years ago, Lee underwent bypass surgery and joined our zipper club. We texted back and forth about it. That was one of the few

times I felt I could actually help him instead of the other way around. It was now my turn to ask, “Are you taking care of yourself?” A few months later, we spent an evening together at Eddie Day’s birthday party comparing notes and we talked a lot about the experience and how to rebound from it. We laughed about how hard it was to stay away from the bad foods we both loved so much. It was great to see him up and around. He was a giant in the New Jersey body shop industry. He was a giant wherever he went. Rest in peace my friend, LEE VETLAND. NJA

Who would you say is the person standing in the way of your success the most in this industry? Is it that insurance estimator who comes in and writes for a repair that won’t come close to bringing the vehicle back to pre-accident condition? Is it that person on the corporate side of the insurance industry who tells you that the Labor Rate is the most that insurers are able to pay despite the fact that their employer makes massive quarterly profits? These people aren’t exactly your friends, but you have an even more dangerous adversary trying to bring you down. Want to know who that is? Take a good look in the nearest mirror.

It is our responsibility as shop owners, managers, estimators and technicians to do everything we can to keep our shops thriving – and it is our fault if we’re not receiving what we need to survive. There are owners out there who sit back and say, “I’ll do it for less. Send me all the work.” These people are part of the problem. As an industry, we’re largely holding ourselves back and allowing insurers to raise rates by miniscule amounts – if at all – at a time when our equipment, certification and training costs are constantly increasing. Frankly, I don’t blame the insurance industry for playing the cards we’re dealing them. Where do you stand when an insurer tells you, “That’s all we’re paying”? If you’re not going to spend time on your business to learn your numbers, push back as a professional and stand up for what’s right, who’s going to do it for you?

Accept Industry Changes NOW! The collision industry as we once knew it is now a thing of the past. It will never again resemble the way it used to look, to say the least. Collision shops can no longer use heat to straighten severely bent metal, and some of the items that were repairable only a few years now need to be replaced. The appraisers collision shops once knew on a personal level are no longer employed at the insurance companies they once worked for because they have been replaced by what is commonly known as “photo estimating” or “picture estimates.” Automobiles being repaired today are nothing like the ones that were being repaired just a few years ago. Today’s automobiles actually resemble what some call “rolling computers.” The older technicians who did not stay up on the required training can no longer make the repairs, nor do they choose to. As a result, there is a shortage of experienced collision repair technicians like never before. The equipment required to repair these automobiles does not even closely resemble the equipment that was required in the past. In more and more cases, certain

damaged automobiles have to be taken to a particular shop that specializes in these vehicles because the equipment is too expensive for the average facility. Technicians are now required to spend many hours in special training classes in order to obtain the knowledge required to repair these complicated vehicles. This training is extremely expensive; in most cases, the cost must be absorbed by the shop owner with no guarantee that the technician will stay on after he or she is fully trained and certified. position statements are now issuing documents dictating how the automobiles should be repaired by including the word must when discussing a particular procedure. Most now require a pre- and post-repair vehicle scan. As a result, shops are forced to spend hours and hours of administrative time researching these procedures prior to commencing their work. What hasn’t changed is the insurance industry’s reluctance to acknowledge these advancements and pay a reasonable Labor Rate that takes these changes into consideration. Over the years, the collision industry has had to fight with insurers for every penny they are paid for the services they provide and play Let’s Make a Deal through methods like cost shifting, which does not accurately reflect what is actually being done to a damaged vehicle. A prime example would be when an insurer refuses to pay for a required repair procedure that would return a damaged vehicle back to a safe operating condition. Instead, they say things like, “We don’t pay for that.” However, when pressured, the appraiser will often say, “But I will give you a couple of extra hours of labor to make up for it” in order to get what is commonly referred to as an “agreed price.” However, quite often, if this type of negotiation cannot be worked out (or the shop is not willing to enter into this type of unethical negotiation), the shop will simply perform the repairs without the requested procedure. The difference now is that the manufacturers are no longer just recommending that certain procedures be followed; they are stating that certain repair procedures MUST be done. Many shops seem to think that not doing things they aren’t paid for will clear them of any liability should the vehicle fail to perform the way it was designed if it were to get into an accident and passengers are injured. Think again. The bottom line is we have to stand up to any insurer that fails to pay a fair and reasonable Labor Rate so a facility can realize a fair and reasonable profit, and we must refuse to repair a damaged vehicle when an insurer refuses to pay for an OEM-required procedure. The old way of doing business has to stop. AASP/NJ is here to support its members when faced with situations like this and other industry issues. Lee Vetland

1947 – 2019

I knew Lee Vetland since 1983. He was generous, giving and always there to help. As a Board member, he had some of the best qualities of anyone I ever met. We were fortunate enough to have him as a state president; he had the personality and the ability to work personalities and bring people together to get the job done. He was excellent at that. No matter who met Lee, no matter what part of the country we were in, people remembered him. He was a lot of fun to be around, knowledgeable and always ready to help anyone. n January 1, longtime AASP/NJ member, shop owner and association Hall of Fame inductee Lee Vetland passed away at the age of 71. Vetland owned Lee’s Auto Body and Pine Top Service in Avenel, NJ and was the co-owner of the Colonia Country Club (the site of AASP/NJ’s annual Golf Outing) in Colonia. In addition to his long history with AASP/NJ, he was a longtime member of Auto Body Distributing Co. and served as president of the Garden State Automotive Federation, one of the groups that merged to form AASP/NJ nearly 20 years ago.

Lee was a part of Auto Body Distributing Co. since 1977. He had a big influence on our company, and he served on the Board for many years. He helped make it what it is today. I don’t think our company would be as great as it is today without him. Lee was a very kind and caring man; he helped everyone. There aren’t a lot of guys around anymore who care the way he did. I first met Lee in 1978; his shop wasn’t too far from mine. He was the consummate professional. A leader. He inspired all of us. I would have never been president of the association for eight years if it weren’t for him. When I was younger, he was a mentor to me – just like he was to everyone around him. He led by example. Without Lee, there would be no AASP/NJ. Back in the day, there were four auto body associations. At the time, Lee was president of the Garden State Automotive Federation, which was supposed to include all four associations. Only three merged – one did not, which was ASA. After Lee’s tenure as president and we formed AASP/NJ, Lee was always there in the background. I just can’t say enough good things about him. He was a few years older than me, and he showed me a lot of things, like investing in real estate. Nobody else had the experience to teach me. I have rental properties now because I listened to Lee as a young man. If he knew you and liked you, he would literally take his shirt off if you needed it. He will be missed for sure. If he didn’t like something, he’d tell you in a minute! Lee will certainly be remembered as an industry icon for his many hardfought battles and what he accomplished to make the industry what it is today. He will be dearly missed by all who knew him.” Like many, Bryant was a recipient of Vetland’s generosity and kindness – especially years ago during the days of Bryant Associates. “Fax machines had just come out; they weren’t really popular yet,” he recalls. “They were pretty expensive when they first came out. Lee called me one day, and my fax machine had just gone down. He yelled at me, ‘Get in your car and get up here!’ I went up there, and he had just bought a new fax machine. He gave me his old one and said, ‘Go get to work!’ That’s the way he was.” Vetland was born in Rahway, NJ and resided in Avenel and Colonia his entire life. He founded Lee’s Auto Body in 1975. To honor Lee’s memory, the Lee Vetland Memorial Fund (facebook. com/LeeVetlandMemorial) has been created. This fund was established to continue Lee’s legacy of generosity by offering support to the less fortunate through donations, scholarships and other acts of kindness. continued on page 24

I started working at Lee’s Auto Body in 1989 as his painter. Lee was passionate and knowledgeable about the industry. He cared about this profession and our customers. Lee always wanted to repair vehicles the best way possible. I later became his business partner, but he was so much more than that to me. Lee believed in always doing the right thing and never hurting anybody. You need to be someone who cares. Thirty-three years ago, I made a friend named Lee Vetland. But he became so much more than that over the years. He was not only a mentor, but he was a sort of moral barometer, too. We’d talk all the time, and he would constantly preach to me the importance of doing things the right way. He promised me that doing it right would make a difference, both in the shop and in the larger picture of the industry. And it was something I would question sometimes, especially at times when it seemed those who didn’t subscribe to that philosophy were out there doing so well. But he was right. Lee was the type of person you could always bounce ideas off of. Whenever I wanted to venture out into another business, I’d always call him first. Even though he’d usually try to tell me, “Go with what you know!” he was always supportive and always had good insights. These new generations say that people from Lee’s generation are dinosaurs, but that’s not true. His generation of repairers kept up with every bit of new technology. They’re smarter than the rest of us. They paved the way, and we learned from them. And these days, I get it – there’s not as much time to socialize, everything is digital and we’re all working so hard all the time – but back then, it really was something magical. And it

was because of the people – we cared deeply for each other, and we got things done. And Lee was a large part of the success of that time period. He was a giant, as far as I was concerned. He was a sincere and knowledgeable man; peaceful, compassionate, hard-working and a smart, great leader in this industry. I remember going out of state and meeting other associations that would always remark on the relationships we have: “Nobody is closer than those guys in Jersey.” And it was true. We couldn’t wait to get together we were like kids. We played together, we partied together and we worked together so well. We were nonstop in those days – Lee called them the glory days – we’d help each other anytime, anywhere. It showed in the strides we made in the industry back then. It was an amazing time with Lee at the helm, and it was something that not many groups like ours get to experience. I’ll always remember his laugh, his infectious smile, his friendship, his advice and leadership and the tremendous impact he had on all of us. I’ll miss it all. I first got to know Lee when we were both part of the Garden State Automotive Federation. What you’re looking at today with AASP/NJ was mostly shaped by him and others. Lee was one of the first in the Jersey area – and maybe even the East Coast – to really push the issue of job costing and being involved with computerized estimating. He pushed the issue of bringing Mitchell into the mix with their Guide. He made it very apparent that we needed to be paid for paint and materials. He was the go-to mentor for a lot of shop owners; there are people who patterned everything they did after things Lee did and talked about. If you couldn’t run something by Lee and get his nod on it, then you probably didn’t want to do it. You could call him any time of the day or night, and he would be there for you. He wanted to create an atmosphere in the auto body industry where people were friendly, shared information, did the right thing for their customers and didn’t treat each other like competitors. The most important things in Lee’s life were his mother and father, his sister and of course his daughter, Katie. He was a great, great person. With just one more month to go until the NORTHEAST® Automotive Services Show, excitement and anticipation are growing minute to minute. Hosted by AASP/NJ, the 42nd annual show takes place March 15 to March 17 at the Meadowlands Exposition Center in Secaucus. Attendance numbers are expected to break records once again as the event continues to attract thousands of attendees all across the East Coast and beyond.

Injuries and Lawsuits Involving Minors

This morning, I appeared before an Essex County judge in order for that judge to approve a settlement on behalf of a minor. My client was a 14-year-old girl who had been hit by a vehicle while crossing a busy street in South Orange. As we all know, a minor cannot sign legal documents and be bound by contract, so I was retained by her mother, who essentially became my client (on behalf of the minor). She made all the decisions regarding the case and its resolution. The court rules demand that any case involving a minor be approved for settlement by a Superior Court Judge, and that the proceeds of such a settlement be held for the benefit of the minor until he or she becomes 18 years old. There is an exception when the settlement amount is $5,000 or less. The court retains the right to make decisions regarding the settlement of these cases in order to protect the well-being of the minor and to make sure they are not being taken advantage of by the attorney or their parents/guardians, who may have more nefarious purposes for settling the child’s case. The funds are mandated to be held in a special interest-bearing account by the Surrogate’s Court at the direction of the Surrogate. This is mandated in order to

protect the minor’s funds from being mishandled or misappropriated by either well-meaning parents or lessthan-well-meaning parents or guardians. The funds may only be removed from the Surrogate’s account by application to the Surrogate, and the use of said funds may only be for the health, education or welfare of the child/minor. While this interpretation can be ambiguous, I would consider it safe to say that most Surrogate offices are quite conservative about allowing money to be spent from these settlement funds. Today’s settlement netted my minor client just under $70,000, which in a few years can provide her a significant start on a college education or perhaps a down payment on a home. I should add that attorney’s fees on the settlement of cases involving minors are reduced by the rules of court in New Jersey. A maximum of 25 percent contingent fees are allowed as opposed to the standard 33 percent for adult contingent fees. Why Are OEM-Approved Scan Tools the Best Option?

At the August 2018 Collision Industry Conference (CIC) in Atlanta, industry consultant and former shop owner Mike Anderson (Collision Advice) publicly disagreed with a presenter’s endorsement of aftermarket scan tools, citing potential telematics issues when they are used on vehicles equipped with systems such as OnStar and Toyota Safety Connect, which OEM tools detect for disabling during a repair. This month, we “ASK MIKE” to elaborate on his position. We at New Jersey Automotive hope you find this following exchange useful, and we encourage you to reach out to us if you have a question for Mike on this or any industry-related matter that he can answer in a subsequent issue. New Jersey Automotive: You’ve taken a public stand in support of OEM-approved scan tools. Why do you believe these tools provide the best opportunity for technicians to perform a safe and proper repair?

Mike Anderson: Some people don’t like my insights into this, but I feel strongly about it. When someone says to use an aftermarket scan tool, are they also saying that if Ford says I have to use a certain rivet gun that it’s okay to use another one? What about when Audi says to use a certain welder? You have to remember that Ford and Audi tested that equipment. Their engineers have done validations on that equipment for accuracy. I have a hard time when people say it’s okay to use an aftermarket scan tool but that they have to use a certain welder or rivet gun. I work directly with several car manufacturers, and I have personally scanned vehicles with aftermarket tools versus OEM. There is a difference. I was in a shop recently that had a car come in with 17 miles on it. The customer bought it brand new and wrecked it pulling out of the dealership. You’re not going to find an aftermarket scan tool that is going to be able to scan a vehicle that new. Generally, when OEM scan tools roll out, they’re usually six months ahead of any new releases. Aftermarket scan tools generally lag behind. Sometimes, when aftermarket scan tools don’t have access to the data,

they provide phantom or ghost codes, so your tech is chasing down something that is not even legitimate. But we know that the OEM scan tool has been engineered and designed by that vehicle manufacturer. Aftermarket scan tools are not tested. I wouldn’t want that liability. After I spoke at CIC, some people said that my comment about disabling OnStar and Safety Connect was far-fetched, but it’s not. My own sister’s car, which was a Lexus, went to a body shop. They didn’t disable Safety Connect, and my sister got inundated with emails. At the end of the day, how do you disable that? You disable that by using a factory scan tool. If you don’t disable it and it generates an email to Lexus and then the customer receives emails, then you have to replace a back-up battery. General Motors did a manual process, which means I can manually disable OnStar. But I’m waiting for someone to show me how to utilize an aftermarket scan tool to manually disconnect Safety Connect on a Toyota or Lexus. I just think this situation is a Pandora’s Box. NJA: Scanning really gained a lot of attention when the position statements started coming out a few years ago, but proper OEM scanning was a part of repair procedures long before that. As the scanning trend has grown thanks to these position statements, so has the insurance industry’s reluctance to pay for it. Based on the “Who Pays for What?” surveys you conduct with CRASH Network, how would you gauge where the insurance industry is right now as compared to three years ago in terms of understanding the need for this?

MA: I think we’re at a tipping point. We’re right there at the top of the mountain, and we can either backslide all the way down or push over the other side. One of the problems is that people are trying to lump everything into a labor time for scanning. I think you have to separate the diagnostic and research time from the actual scan time. To me, the researching and recording of the diagnostic trouble codes and the time to troubleshoot them should be totally separate from the actual scan time. The industry needs to


get more educated to understand there’s a difference between the diagnosis of the problem versus the recording of the diagnostic trouble codes.

NJA: As a former shop owner, how would you respond to an owner who says they are not performing scans because insurers won’t pay for them?

MA: When I had my shops, if the insurance company would not pay me to do what I thought was required for a safe and proper repair, I charged the consumer the difference. At the end of the day, an insurance company refusing to pay me to do a safe and proper repair did not remove me from the liability. I think shops also need to move away from relying on position statements. They also need to put the scanning or initialization procedures as specific line items on the estimate, and they need to create a bulletproof file. Through my consulting, I still work at shops at least once a week every other month. In this capacity, I’m still negotiating with insurers and putting my estimator hat on. I was recently writing an estimate on an Infiniti, and all I had was a grille. I could imagine an insurer telling me, ‘I’m not going to pay for you to scan this car. It’s just a grille.’ Well, I went into Nissan/Infiniti’s technical information and looked up the R&I grille procedure. I saw that there was a part attached to the grille that had a ‘one-time-use’ symbol – which is a black circle with a white x. It turned out that it was an Intelligent Cruise Control cover. I selected that part and looked up the R&I procedure for that, and it told me that it required a calibration. When I clicked on that calibration, I saw that the vehicle needed a full tank of gas and a fourwheel alignment. I ended up with a huge supplement, and the insurance company looked at me like I had two heads. I had to take the time to show them what was needed to be done step by step. I got reimbursed, but I couldn’t just give them a position

President’s Message The Good Old Days

While speaking with an auto recycling consultant as we planned our 2019 goals, we asked ourselves, “Are these the good old days?” It seems to be a consensus among his clients that we will look back five to 10 years from now and wish for today. The amount of change occurring in the auto recycling industry is unbelievable. E-commerce companies like eBay and Amazon are selling recycled auto parts. OEM repair standards and the true definition of recycled auto parts are affecting auto parts sales to our body shop customers. The amount of mechanical and electrical parts that need programming from OEM dealerships are affecting auto parts sales to independent repair shops. The auto recycling industry is going through a transformation right before our eyes at a breakneck pace, and we have not even discussed electric and self-driving vehicles! How do we deal with all these changes? The answer is training, education and communication. We need to evaluate the people, processes and products in our businesses to understand how to improve upon them and work towards efficiencies to better serve the customer. I don’t think we need to reinvent our business, but we need to focus and fine-tune it. The auto repair process is becoming more complicated with parts and repair procedures, and we need to rise to the challenge that has been presented to us. So, will today be considered the good old days? Only time will tell.

Consider also that in many countries, it is illegal to have nonadmitted insurance, which is what the American general liability policy is considered from the other country’s perspective. An international/foreign insurance policy can provide you with coverage to protect your products, employees and assets. This one policy can combine several different coverages, such as Workers’ Compensation, Employers Liability, General Liability, Automobile Liability and (most importantly) Repatriation coverage. A loss in one of these areas could have a devastating effect to your company’s financial position. You see it coming across the country. As much as you think it won’t come to this area, you have to be ready for it. This won’t be good for business. This reminds me of when Home Depot comes in and all the small hardware stores disappear because they can’t compete.

It’s going to hurt the industry. This will lead to lower industry standards and quality workmanship, and that is becoming the new norm. It’s all about quantity over quality. Small businesses can’t really stay afloat and compete with these big conglomerates.

It doesn’t really affect me. I just keep on moving on. I guess it’ll be fun to see what happens...They are just going to start buying others out.

It sucks for little independent places. They come in and buy up these shops and take over the marketplace, squeezing out the little guys.
