A Breath of Fresh Air

As I write this story, I am waiting to board the train to Orlando. It is a Thursday. I should have been on the one that was supposed to run four days ago… I have written and said it many times: I am afraid to fly. Not for lack of trying. Over the past few months, I spent a lot of time researching how to get over my fear. I even found a training course that sounds promising. I spoke to the trainer (who is a decorated pilot) and he explained the course in detail, which includes him joining me on my first flight. It sounds great. I’m not ready. Not yet. But I’m getting closer. So, I booked a train to Orlando for our annual trip to enjoy the Halloween festivities at Universal, Disney and Busch Gardens. Returning there is bittersweet because

it will be the first time back without my late sister Diane. But I am taking her kids along with my family, so we hope to be able to enjoy it the way she’d want us to. Unfortunately for me, over the past few years, Mother Nature has started to dislike my obsession with trains. Last year, she sent Hurricane Irma to Florida and pushed back my train trip several days. Ultimately, I made it as far as Jacksonville and drove the rest of the way. This year, Irma’s sister Florence decided to make a dent in my plans. My train - originally set for Sunday was cancelled. Monday, cancelled. Tuesday, cancelled. Wednesday, cancelled. Thursday? Well…so far, so good. As much as Mother Nature may have against me, someone else must be looking out for me. Sunday night, when I should have been alone on the train, I was walking out of a movie theater when all of a sudden, I couldn’t catch my breath. I told my son to take me to the nearest emergency room, which was luckily only a few minutes away. It was a very scary moment for both of us, but he acted like a champ. Got me there in record time. When I got to the ER, fortunately I started to calm down and my breath came back slowly. They did all the tests they normally do when dealing with someone with a heart history like mine. And unfortunately, with a heart history like mine, no matter what the tests say, they have to keep you overnight. After about four hours in the ER, they took me up to a room for an endless night of worry and stress. By midday Monday, all the tests had come back negative. They didn’t seem to think it was my heart. I visited my cardiologist the next day and he didn’t think it was my heart, either. But none of them could say what caused it. The consensus seemed to be that it was probably stress-related. Who knows? I’m just glad I’m still here to write this down for all of you. Hopefully, the Orlando sun will help as well. Oh well, back on the train. Don’t worry. This time, I dragged my wife with me. NJA

FLYING BLIND Last month’s New Jersey Automotive cover story explored a variety of ways that current industry members are working to attract and retain new technicians. While it is true that there is a major lack of young talent hitting our shops, we’re also facing a critical shortage of experienced techs who have what it takes to maintain the expertise necessary to succeed these days. I’ve seen potential hires with years of shop experience come through my door and write some of the most shockingly inaccurate and incomplete estimates imaginable. I’ve also seen insurance appraisers – who I know have gone through I-CAR training – fail to acknowledge OEM procedures. Yes, getting everyone properly trained is a big issue, but even some of the

people who’ve been through classes are throwing away what they’ve supposedly learned. This is a huge problem for the customers who depend on shops and insurers to keep them safe after a collision. Both sides of the repair equation need to keep their eyes open to reality and know what’s needed on every repair. On the shop side, ignorance leads to accepting whatever the insurers give you. On the insurance side, a failure to write for – and pay for – proper procedures leads to everyone going backwards as technology keeps racing ahead. We’re swimming in dangerous waters here. If you fly blind, you likely have no idea how a non-OEM part could improperly interact with other components in the vehicle. It doesn’t

matter if that is the only part you’re getting paid to use. If that part fails and your customer gets hurt, it’s YOUR fault – not the insurer’s. If you’re a shop that is committed to keeping up with training and doing things the right way, then I empathize with your struggles. At my shop, I’ve gone as far as to create a full-time position for someone just to keep track of our various I-CAR, ASE and OEM certification training requirements. It’s an expense and a headache, but it’s necessary. Think about the next 10 years. Will you still be here? I hope you are, but many shops won’t be unless they take proper action today. NJA

Proper documentation during the repair process is now just as important as the equipment we use daily in our shops. What I would like to discuss this month is another tool that greatly benefits all who use it. The Database Enhancement Gateway (degweb.org) is a free webbased resource that was designed to help resolve issues within the three major estimating systems (CCC, Mitchell & Audatex). DEG users have the ability to help fix omitted and inaccurate information found in the estimating programs by submitting Database Inquiries. The database can also be utilized to verify and document necessary operations that have been addressed by other users and confirmed by the estimating systems.

As more Database Inquiries are submitted and more corrections are made to the DEG, the information in the estimating systems will be constantly improved. Whether you’re dealing with incorrect labor times or bad part number information, you can submit a free information request and get a response – and hopefully an update made to the estimating systems – within an average of three days. I personally use the DEG when writing estimates by searching past entries on the same vehicle; there is always some information to benefit from. I use it as another tool to document operations and reaffirm the information within the P-Pages pertaining to included and non-included items. As an added benefit, I always try to update part number changes or submit specialty clip part numbers, because receiving the wrong part due to an incorrect order is never a fun day in the shop. If we all correct these errors by submitting them to the DEG, it may help us all out in the long run. NJA

Lessons Learned from State Farm’s $250M Settlement

EXECUTIVE DIRECTOR’S MESSAGE

The suit against State Farm for allegedly bankrolling the campaign of an Illinois judge who ultimately cast the deciding vote to void the $1.06 billion judgment against the insurer for the use of inferior aftermarket parts has been settled for $250 million. In my opinion, this is a travesty of justice. Many in the industry might say this is confirmation that no one can win against a mighty insurer with money to burn. I hope it sends the opposite message. It is reported that the plaintiffs and State Farm agreed to settle the litigation for $250 million because they believe it is in the best interest of all parties to avoid protracted litigation and appeals that could last several more years. Part of the settlement will include recitals that State Farm denies liability, considers the claims to be without merit, considers that it is settling under the unjust enrichment claim and that the settlement itself was made simply to bring an end to the litigation. When I heard about the settlement, I immediately felt sick to my stomach. I could have swallowed heavy and lived with it to bring this to an end, but hearing that State Farm gets to deny liability and consider the claims without merit after years of litigation will never sit right with me. This all started because they attempted to shortchange their own insureds, going so far as to be accused and sued for basically buying a judge to get their way while claiming to be a “good neighbor.” At the very least, I think the Court should force State Farm to stop using “good neighbor” as a selling tool. Anyone who conducts themselves in such a manner is not someone I would consider a good neighbor. Now, we must think about where we go from here. Do we just give up and accept that everything is for sale, or do we dig even deeper and vow to never let something like this happen ever again? I say let’s make sure it doesn’t happen ever again! How do we do that? Well, it happens that I have been running a Hot Line for several years, so I can speak a bit about what I have seen in the past in terms of what effect something like this might have on the industry. Interestingly, only a few days after the settlement was announced, the Hot Line rang with a member complaining about an insurer pushing used parts. According to the caller, these parts were “garbage.” Guess the insurer that was pushing these parts.

The caller informed me that he was unwilling to accept the used parts that were being suggested but had voluntarily offered to try aftermarket parts as an alternative as long as he could use his chosen vendor. However, when he made the offer, it was like he had said a bad word. The representative from the insurance company had a fit and said, “No aftermarket parts!” The shop owner informed me that it was obvious that the appraiser had been instructed to stay away from aftermarket parts at all costs. That tells me a lot. There was no way the insurance appraiser wanted to discuss the possibility of using aftermarket parts on a job his company was paying for. That tells me that even though State Farm got around the $1 billion judgment they were facing, more good may have come from the case than one might think. Has anyone ever heard of an insurer

running away from a suggestion of using aftermarket parts? Well, this one did. What the collision industry needs to do now is keep that ball rolling. Frankly, I think this one was a little too close for comfort! It is a shame that our system would allow anyone to drag out this type of litigation for years and years and then allow such a ridiculous settlement to take place. The important thing that the collision industry should take away from this case is that we should not allow this to take the wind out of our sails. Instead, this should be a reason to fight even harder to never let something like this happen ever again. Every time any insurer mentions the use of inferior aftermarket parts, show them a copy of this settlement. Use this as a tool rather than allow it to get you down and cause you to give up. I have fought issues like this for a large part of my adult life, and even this will not stop my ultimate goal of preventing this wrongful activity. Even as you are reading this message, things are going on in the background to help prevent this type of improper behavior. Stay tuned! NJA

OEM Parts Obliterate Aftermarket in Latest Todd Tracy Crash Test NATIONAL NEWS

Texas-based attorney Todd Tracy, known for his $42 million legal victory against John Eagle Collision in Dallas and his subsequent Honda Fit crash tests, has taken his fight against the use of unsafe aftermarket replacement parts to a new level. On September 15 during the 2018 Texas Auto Body Trade Show in Fort Worth, Tracy, the Auto Body Association of Texas (ABAT), the Houston Auto Body Association (HABA) and New Jersey-based shop owner Jerry McNee (Ultimate Collision Repair; Edison) unveiled the results of a new crash test of a 2010 Honda Fit that was repaired according to OEM procedures using OEM parts. Tracy had the same parts replaced with OEM as the parts he had replaced with aftermarket (or, in his words, “imitation”) versions in his previous crash testing. The crash test results revealed that the genuine parts performed exactly as intended to ensure passenger safety, while the previously crashed aftermarket partsinstalled vehicle produced results that Tracy called “total and massive destruction” in critical areas. McNee, who helped finance this most recent crash test performance at KARCO Engineering in California. “However, insurers are willing to twist, turn and use the position statements incorrectly. They make comments like, ‘It’s just a fender,’ ‘It’s in their policy’ and ‘LKQ parts are the same.’ They’re dictating what they’re paying for to unjustly enrich themselves, but numbers and test results don’t lie. This OEM-repaired car fared exactly like the undamaged Honda Fit. When there is a 400-800 percent difference in the results between the OEMrepaired car, the aftermarket-repaired car and the improperly repaired car, it’s staggering. This could be the difference between broken bones, permanent injuries, life or death – or, in the Honda Fit case, people trapped helplessly while their vehicle is on fire. Mr. Insurance Company, please tell me how these parts are the same and ‘like kind and quality.’ Show me the proof! Would you put your kids in an improperly repaired car? Do you feel

lucky? Your odds are 400-800 percent.” In addition to McNee, Burl’s Collision Center and HABA, financial contributors to the latest crash test include Dominic and Mario Martino of Gold Coast Auto Body in Chicago and John Mosley of Clinton Body Shop in Mississippi. The support of these facilities shows that the push to bring scientific clarity to the aftermarket parts issue is a nationwide collaborative effort. Never one to mince words, Tracy offered some powerful food for thought during his presentation in Texas. “By dictating improper vehicle repairs for decades, insurance companies have killed thousands of customers who were driving around in time bombs…Your industry has to work together with politicians and state agencies so that insurance companies stop jeopardizing family safety.” NJA

Repairer Driven Education Set for SEMA 2018

In late October, automotive professionals from around the world will hit the Las Vegas Convention Center for the 2018 SEMA Show. Although the annual four-day event will officially begin on October 30, the Convention Center doors will open a day early for the launch of the 2018 Repairer Driven Education (RDE) Series. Once again presented by the Society of Collision Repair Specialists (SCRS), this year’s RDE schedule includes dozens of seminars and programs designed to provide SEMA attendees with the knowledge and training they need to thrive as business owners and automotive repair professionals. In addition to enlisting the expertise of several past participants, this year’s RDE slate boasts a slew of firsttime presenters. “It’s important to make sure we continue to reinvent the content as well as bring on new faces so we constantly present new thoughts and new ideas for attendees,” explains SCRS Executive Director Aaron Schulenburg. “This keeps things fresh and adds value to their experience year after year.” John Shewbridge of Hunter Engineering Company (“The Importance of ADAS System Resets When Performing Wheel Alignments during the Collision Repair Process”), David Willett of Intrepid Direct (“How to Protect Your Business When Facing Increased Complexity & Liability”), David Smith of Auto Damage Experts (“Why You Should Embrace Post-Repair Inspections”) and veteran repairer Wade Ebert (“More than Just a Hand Shake: The Professional Administrative [Legal] Documents You Really Need to Operate a Successful Shop”) are just a few of the many industry experts making their RDE debut this October. Following a nearly five-year comprehensive process of gathering and applying industry insights and feedback about its education and recognition programs, I-CAR has announced a variety of revisions to its curriculum and standards that it plans to implement in the first quarter of 2019. Gold Class will now be recognized when shops train 100 percent of structural role technicians and 50 percent of all other roles to ProLevel 2 and continue to train those repairers annually to Platinum requirements (collision repair only). Additionally, technicians will complete annual Vehicle Technology-Specific Training courses, and electrical/ diagnostic and mechanical theory courses will be completed at the shop level. Perhaps most significantly, the I-CAR revamp will also include discontinuing the Road to Gold program. A transition period over the course of 2019 will be available for all shops that are Gold Class at the end of 2018. I-CAR plans to work closely with each and every one of its 7,200 Road to Gold and Gold Class shops to guide them through the change.

Shops new to I-CAR in 2019 and beyond will need to achieve the minimum ProLevel 2 with the 100 percent/50 percent trained technician scaling for their shop. A detailed transition plan will be announced before SEMA 2018. Nick Notte, I-CAR senior vice president of sales and marketing, further explained the organization’s decision to conclude Road to Road during an August 22 webinar hosted by the Society of Collision Repair Specialists (SCRS).

“Road to Gold was not a destination; Road to Gold was a means to get to I-CAR Gold Class. Road to Gold was a 12-month journey to get to Gold Class. There are shops that have been Road to Gold shops for multiple years.” Notte added that it is “extremely important” for Road to Gold shops to get to Gold status by the end of this year. “If you are Gold Class by the end of 2018, you’ll be grandfathered in as a Gold Class shop even though you’re not Gold Class to ProLevel2. What you need to do as a grandfathered shop is keep training.” I-CAR may make exceptions in

situations where a requested I-CAR class is canceled due to lack of attendance (an issue most common in rural areas). “We don’t want anybody negatively impacted because we can’t provide the training,” Notte said. I-CAR’s upcoming advancements follow last year’s rollout of the In-Shop Knowledge Assessment program, which fosters direct dialogue between I-CAR representatives and shop technicians to determine readiness for ProLevel 1. “We actually boil down a three- or four-hour live I-CAR class into a 17minute conversation. In that time, we cover all of the really salient points of that training. If the technician knows that information, we give them credit for it. They don’t have to take that three or four-hour course.” Grandfathered Gold Class shops will have 12 months following the Assessment to reach ProLevel 2 under I-CAR’s new requirements. Part Two As a continuation of the discussion featured in last month’s New Jersey Automotive cover story, we sit down with Bill Stage, director of delivery for I-CAR, and Brandon Eckenrode, director of development for the Collision Repair Education Foundation (CREF), to discuss some of their organizations’ efforts to grow the automotive employee base. New Jersey Automotive: Bill, how does I-CAR’s current Official Training Site program help foster the development of automotive repair skills at the vocational school level? What is the program’s current footprint in New Jersey?

Bill Stage: The program is in its second year, and it’s going really well. We have just over 260 Official Training Sites under contract, and we’re utilizing a little over 300 around the country. Those sites are not all schools; some of the schools – particularly high schools – were difficult to get open to the public. About 75 to 80 percent of the sites are schools right now. We currently have four Official Training Sites in New Jersey, and three of them are schools. Throughout the country, we provide all of our live courses. This year, there are 22 of those courses offered at those fixed training sites. With the new Professional Development Program that comes out in the first quarter of 2019, that

number of live courses will go down somewhat, but we’re still going to need those sites to provide live I-CAR courses locally to the industry. Any school that enters into an agreement with us to become an Official I-CAR Training Site gets the curriculum for free, and that’s a $1,100 annual value. They also receive all their student ‘starts,’ which is $50 per student. They receive all of their student ‘grad’ fees covered, and that’s $100 per student. We are also working on marketing programs by the beginning of next year that will promote the entire network of Official Training Sites. NJA: Brandon, for those who may be unaware, what are the CREF Makeover Grants? What are some ways they have assisted vocational schools nationwide? How can school programs apply for these Grants? Brandon Eckenrode: The Makeover Grant is an opportunity for a school to apply and provide us with a profile of

the collision program and what they are currently facing – issues such as budget, student count and tools/equipment – and where they need assistance from the industry to become better. When we are approached by companies with donations, we reach out to our Makeover applicant schools first with the opportunity to receive these donations in addition to providing monetary grants to these schools to obtain items for their program. Schools have from January to May to complete the grant application, and these applications are reviewed by a volunteer group of industry members. We announce grants to these schools during our industry reception at SEMA and continue to support these programs throughout the school year. greater communication between vocational students and potential employers?

BE: These events bring together local students and local/national employers from many different segments – collision, auto service, mechanical, diesel, etcetera. Students get to meet actual employers, network, gather business cards, see product demonstrations, take part in mock interviews and more. I believe we need to see double to triple the amount of employers participating in these events, as there are hundreds of students attending each event and we understand that businesses are facing an aging workforce and the need for entry-level staff. We actually have a Career Fair taking place at the College of Automotive & Diesel Technology in Jamaica, NY on November 27. It’s the first time we’re bringing this event to New York. We will be inviting schools from a several-hour radius to attend. It would be great for that local area to have as much support from companies as possible. NJA: Based on your experience, what can the independent shop side of the industry do more of to inspire those leaving school to pursue collision repair as a career?

BS: Get involved with a local technical school that has auto collision repair. They are always looking for qualified Advisory Board members. There are thousands of shops across the country, but there are usually fewer

than 10 people on those Advisory Boards. If you get on that Board, you can direct the local school to produce the kind of individuals you will be willing to hire right out of the school. If you buy a Big Mac anywhere in the country, it’s a Big Mac. We’re trying to do the same thing with the schools. If they follow our curriculum, they can easily produce – in a typical two-year program – an entry-level technician who is non-structural or refinish. With the current program, students actually graduate with a Platinum certificate. It’s the same Platinum certificate that a technician in the industry can earn. That Platinum certificate has value for a Gold Class operation. If a shop loses a nonstructural tech, they can actually hire a student who has that and fulfill their Gold Class requirement. BE: The biggest opportunity is getting directly involved with the school, the program, the instructors, the students and the administration. Participating with the schools’ collision Advisory Boards and talking to the administration about the industry’s needs is a great start. Also, they can help these collision programs look like professional learning environments through things like sponsoring new student uniforms for the students, providing a new coat of paint on the walls/floor, helping to coordinate tool/equipment/supply donations, etcetera. NJA: One of the biggest hurdles to getting new recruits in the automotive industry is convincing parents and guidance counselors that this is a strong career choice. How would you answer a parent or counselor if they asked you why a

young person should consider this industry? BE: Students in this field can get a technical degree cheaper than a traditional four-year degree. This degree comes with better job prospects after school [with less student debt] and the ability to increase pay quickly. The demand is high for entry-level staff due to the aging workforce.

BS: When shops get involved with the local school Advisory Board, they should touch base with guidance counselors as well. That’s a paradigm we need to shift, because those counselors have exposure to students and parents. We’ve got to paint a good picture of what this industry can offer. A lot of students can use their hands better than their brains, and this is the kind of industry that rewards that. They need to have the smarts, but this industry offers the rewards of repairing and returning things back to their original look and safety features. Most importantly, one of the things that parents don’t seem to realize is the potential income for the students. With the way the industry is structured, new techs start kind of low, but they move really fast. Some of the painters and body techs make over $100,000 a year. It’s based on your skills and your speed. You can make a very comfortable living. Also, most of these kids come out of school with no debt. There are numerous jobs in this industry. You don’t have to be the person fixing that dent. You can be the person ordering parts, delivering paint or managing a group of people. There are a lot of opportunities out there. NJA

Full Autonomy, Car Sharing, Electric Vehicles:

Where Do They Leave Independent Shops?

At Tesla’s Annual Shareholder announced Meeting in June, that the CEO company Elon Musk would enter the collision repair business directly. His plan called for adding body shops to 10 existing Tesla service centers throughout the country. Tesla’s plans to go where no other car manufacturer has gone before – and doesn’t plan to go at any time in the foreseeable future – comes as no surprise. Musk beats to a different drum. He was born and raised in South African but he is Silicon Valleybred. He was a billionaire – from PayPal, primarily – before he became the lead investor in the company that tapped the latest battery technology and created the first practical electricpowered car. Fail Fast Silicon Valley has always had a much – much – different mindset than Detroit. The point was made vividly clear a few years ago by a meeting between Ford and Google to discuss a deal related to the latter’s autonomous vehicle technology. Ford CEO Mark Fields and his underlings arrived at Google’s California headquarters in a convoy of Lincoln Navigators. Their entrance had all the

subtlety of a Trump tweet. On the other hand, Sergey Brin, a Google cofounder and one of the top dozen richest men in the world, typically rides a bike to work. “Tesla is doing what a technology company does,” says Sean Carey, a Chicago-based consultant with over 30 years of experience in the automotive industry. “They fail fast, learn from their failures and go again. The fact that Tesla is doing it to brick and mortar shouldn’t surprise anyone.” After Musk became CEO of Tesla, the rest of the general public discovered what those in Silicon Valley had known for years. He can be prickly, and he says things that don’t always check out. A month after he announced Tesla’s body shop initiative, he committed to cover the bill for any household in Flint, MI to clean water contaminated above FDA levels. “No kidding,” Musk insisted. Nothing has happened since. Musk’s peculiarities aside, Tesla’s move into the collision industry begs the question of whether traditional car manufacturers will follow suit. In his recent book Autonomy, The Quest to Build the Driverless Car – And How It Will Reshape the World,

former General Motors executive Lawrence Burns predicts a mobility revolution that will blow up the 100year-old model of nearly every adult owning a vehicle powered by an internal combustion engine and 30,000 highway deaths a year. Instead of buying cars, consumers will rent transportation and thousands more of them will survive. Underpinning this radical change, Burns writes, are car sharing, electric vehicles and full autonomy.

The Future Is Here All three exist today. What started in 1999 with Zipcar’s innovative take on the rental car business has expanded worldwide with Uber and Lyft’s attack on the taxi business. In the process, car sharing has embedded itself among urban residents and is quickly spreading to suburbia and even rural areas. It’s cheap, convenient and reliable. Despite Tesla’s rocky production performance to date, electric vehicles are gaining broad appeal. Electric cars lost the automotive sweepstakes to gas-powered ones early in the previous century because most Americans had better access to gas than electricity at the time. By all other considerations, electricity has always

been a superior power supply for vehicles. Electric cars accelerate faster and produce less noise and pollution. With fewer moving parts, they require less maintenance. And lithium-ion batteries have increased the range between charges to 300 miles or more, comparable to a full tank of gas. Fully autonomous vehicles – that is to say, cars with no steering wheels or brake pedals – are nearer than you might think. Detroit has come a long way since rumbling up to Google’s front door like a battalion of tanks. Early this year, GM petitioned the National Highway Traffic Safety Administration for approval to deploy its brake-pedal-and-steering-wheelfree Cruise AV in 2019. In his book, Burns writes about a meeting between Google and OEM executives in Detroit where the Google reps bragged about their autonomous technology. Over 100,000 miles on California roads completely free of human control, they said. The executives were shocked – not by that startling accomplishment, but by the risk. Without even asking about the safety precautions Google had followed, which were extensive, the executives labeled the undertaking morally reprehensible. Those days are long gone. Now, you would be hard-pressed to name even one OEM not intricately tied to autonomous technology by either funding research at a company they bought or doing it in-house, or both. Combine all three of the requirements Burns cited, and you have a public that pays for mobility rather than cars. Transportation is provided by fleet-owned, autonomous, on-demand vehicles at a fraction of the price it costs to own a car. No more paying the tab for a vehicle that spends 90 percent of its useful life idle in driveways and parking lots. No insurance bills, no repair bills and – given that autonomous technology will drive cars smarter than humans – far fewer fatal accidents (or accidents of any kind, for that matter). The safety, convenience and cost savings of car sharing in energy efficient, autonomous vehicles will be too appealing to resist.

But does all of this point to the Tesla model of collision repair? Perhaps.

Inescapable Liability One school of thought is that each fleet of autonomous cars, whether independent or owned by OEMs, will have its own body shops. The risk of trusting outsiders to repair what are essentially four-wheel pods mounted with sensors, computers, batteries and seats will be too much. The manufacturer’s software drives the

car, making liability for a faulty repair almost inescapable. The only way to ensure quality is to bring repairs inhouse. Yet another school of thought is that owning shops is a step too far for OEMs. That’s not their craft any more than it was Allstate’s when it bought Sterling Collision Centers in 2001 (and sold it in 2014). Besides, car sharing in the form that Burns envisions is years away from going mainstream. Still, as John Eck, GM’s collision manager for customer care and

NATIONAL FEATURE aftersales, points out, the OEMs and collision repairers in the coming years must deal with vehicles that aren’t fully autonomous but super complex nevertheless. “Look at the 2018 Buick Regal,” Eck says. “It has a pedestrianactuated hood, a camera behind the windshield and bumper sensors. The repair levels required today don’t necessarily correspond with what’s necessary to fix today’s vehicles. We need to push training levels up to handle the technology.”

Enlightened Market The method won’t be to take over shops, but to have a network, which GM launched earlier this year, of certified shops that enforces strict compliance of the manufacturer’s training standards and repair procedures. Meanwhile, GM will do more than ever before to inform its car owners about shops in their areas that have undergone a vetting process. Some might call that steering. Eck calls it customer service. Either way, certified shops will be the lodestars of collision repair, attached at the hip to the OEMs more firmly than ever. Carey, the consultant, agrees that OEMs will push hard to up repairers’ game but stop short of taking them over. He also thinks insurers will get proper-repair religion. “It won’t work any longer to say, ‘We didn’t repair the vehicle, so we’re not responsible,’” he says. “The technology of these cars will force an enlightened repair market, more like what it should be if you decided to start over and do it right. There will be a lot more collaboration as opposed to one side trying to beat the other.” Maybe this enlightenment will continue to evolve as mainstream technology moves from driver assistance to autonomous driving and independent body shops hold their place in the repair market. Then again, day by day, the OEMs are becoming more like Silicon Valley and less like Detroit. Musk might get proven correct after all. NJA

Wharton Insurance Briefs

I read an article regarding workers’ compensation wherein an employee was injured while using machinery in the course of his duties. Apparently, the guard on this machine was removed in order for it to move faster and allow larger pieces of material to be processed. An employee subsequently lost his hand while operating that machine. The employee then sued the employer, claiming that the loss of his hand was the result of the guard being removed. The employee also claimed that the employer instructed the employees to work knowing that the guard was not there. It is important to know that Part Two – Employers’ Liability Insurance excludes bodily injury caused by any “intentional” wrong act committed by the employer or the employees. As a result, the insurance carrier denied to defend or pay any damages. The moral of the story is to make sure you are operating within the OSHA guidelines and regulations. Please note that all medical bills and indemnity were paid by the insurance carrier under Part One of the workers’ compensation policy As always, please contact me with any questions.
