‘It’s a crime’

Residents take officials to task for spillages

Three criminal charges have been made against the Matjhabeng Local Municipality at the Virginia Police Station. In addition to these woes, Matjhabeng has been placed under administration.

The determination of a Virginia resident, Kevin Ostermeyer, to have the extreme sewage problems in Saaiplaas addressed, has paid off.

On 4 February, the Free State Department of Water and Sanitation (DWS) laid a criminal charge against the municipality in terms of the Water Act. The DWS’ case states contravention of section 151 of the national Water Act.

Ostermeyer says that Nkhumeleni Musekene, director of Water Regulation at the DWS, confirmed the charge.

“He stated in an email to me that the DWS has done everything within its power to get the municipality to comply.”

Ostermeyer has been fighting an uphill battle since 2023 concerning 28 Mimosa Street in Saaiplaas, Virginia.

He has, in this time, actively engaged with the Human Rights Commission (HRC), the DWS, and the Matjhabeng Municipality in a desperate attempt to have the sewage issues addressed.

Ostermeyer says the residents at 28 Mimosa Street have already lost a family member as a direct result of the sewage.

A young woman contracted tuberculosis (TB) and died from the effect of the disease a mere three months later. Ostermeyer fears for the health

and life of the youngest child at this address, who has also contracted TB.

He says Veronica Sotenjwa, ANC councillor of ward 8, has done nothing for these residents who have been plagued by raw sewage spillages for a period of more than 11 years.

“Given that the Department of Cooperative Governance and Traditional Affairs (Cogta) in Bloemfontein treated this matter in a very mediocre manner, I then took an informed decision to contact Musekene of the DWS in Bloemfontein who did a site meeting with me along with his colleague, Zoleka Mathiso, on Friday, 24 January.”

On Tuesday 11 February, Hansie du Plessis, Virginia

resident and DA councillor, laid two criminal charges against Matjhabeng; one according to the Water Act and the other according to the Environmental Act.

The DWS is the first plaintiff in these cases, and Du Plessis the second plaintiff.

He says the Virginia sewage fiasco started on 11 February 2022, when the main sewer works were vandalised by armed robbers.

He says he has reported the pollution of the Sand River to the municipality on numerous occasions. All of Virginia’s sewage has been flowing into the river system since before 2023.

The fourth whammy was the announcement that the

Matjhabeng Local Municipality had been placed under administration by the provincial ANC executive council.

An informed source told Vista, however, that previous studies have highlighted that Section 139 interventions have generally failed to address governance challenges, and administrators usually do worse than the municipal officials.

“The centralisation of power to a few administrators, that might be deemed as cadre deployment, and the limitation of oversight by elected councillors, creates the perfect condition for the misuse of power and resources,” he told Vista

He says it cannot be ignored that a lot of factionalism is played out at municipal level,

and sometimes individuals might be appointed to positions not to solve municipal problems, but rather to strengthen factions.

Tshediso Tlali, Matjhabeng spokesperson, says a contractor has been appointed in Mimosa Street.

“They have begun line investigations using closed circuit television (CCTV) technology to accurately determine the root cause of the issue before proceeding with excavation.

“Over the weekend, blockages in Marico Avenue and Qolora were successfully cleared; however, a new obstruction has since developed further upstream in Marico.”

Life claimed by geyser

A young girl in Thabong died when an external geyser fell on her.

The mounted geyser fell on the child (8) while she was playing near it.

“The girl was playing in the yard on Thursday, 6 February, when a mounted outdoor geyser allegedly fell on her.

“The police were called to a house

in Thabong, where they found the body of an eight-year-old girl,” Free State police spokesperson, Capt. Lorraine Earle, said.

“Reports indicate that she was under a mounted geyser when it suddenly fell and hit her.”

Emergency medical services (EMS) personnel were called to the scene, and pronounced the child dead on arrival.

The Welkom police are investigating an inquest.

Learners given a boost

The Bring Back the Smile campaign is a concept brought to the community by the Welkom Runners group. This is an ongoing project where members of this group continue with their wonderful community outreach activities through donations of food parcels, clothing items, and more to the very needy living amongst us. “It is enough to

see the smiles our donations bring to the children’s faces, and we would like to request more community members to help where they can,” says Nkhetheni Masupa, convenor of the group of runners.

Learners of the Setshabelo Primary School could not wait to go back to the classroom on Tuesday, 11 February, after receiving their full set of uniform on Monday. “The impact of this gesture was immediately visible on the faces of the

educators and children, many of whom had been struggling with worn-out shoes and old torn uniforms. Representatives of the Welkom Runners donated school uniforms, sanitary towels and clothes,” he says.

The principal, Pheko Mokoena, was grateful for the donation. He said when children have uniforms their behaviour and attitude change, and their academic performance often improves because they gain self confidence.

Falling in with the rest

The Lekgarietse Secondary School is the 19th school in the Free State to implement the Communities and Justice Programme. A total of 120 learners, from Gr. 8 to Gr. 11, will be taken through the Criminal Justice Value Chain. The programme started in 11 February and will conclude with an award ceremony on 28 March. “We extend our heartfelt gratitude to the principal, Azwimpheleli Enos Maravha (left), and his team for embracing this initiative,” says Pitso Mereko (right), the provincial coordinator, who will lead the programme.

Residents left to regret their choice of leaders

I was born in Virginia in 1960 and attended the Tikwe Primary School, matriculating from the Mamello High School.

Afterwards, I studied engineering at the University of Zululand (UniZulu). I joined the Harmony Gold mining company in 1984, servicing different shafts in the Goldfields, North West, Gauteng, Papua New Guinea, and Australia until my retirement in 2024.

Much of my early life and family was in Virginia and the Goldfields. The Goldfields were buzzing with many opportunities and the standard of life was very competitive. Virginia, in particular, prided itself in being the wealthiest and cleanest in the region and province.

In 2000, I was one of the

first people to complain about amalgamating Virginia into Matjhabeng because I felt other towns did not have the financial and human resource expertise Virginia had to run the municipality efficiently.

Fast forward, we visited Virginia and spent the festive season with my family for the first time in 13 years after relocating to Australia.

I had the shock of my life when I arrived on 23 December. My wife literally shed a tear when driving to my parents’ house.

Ladies and gentlemen, what has happened here? Why did you allow this mess to happen?

My eldest daughter, who was

born here 40 years ago, could not believe her eyes. There is sewage spillage almost everywhere, uncollected refuse for weeks, broken street lights, and constant water leaks. It is dark at night and I am told home burglary has skyrocketed.

The first question we asked my family and friends was whether there is still a municipality here?

Instead of celebrating our return, our discussion was dominated by the poor state of affairs including the political infighting in the ANC and municipality.

The empty promises they have been sold by the comrades; the empty rhetoric by the president and Matjhabeng municipality leadership, and the rampant corruption they read about week in and out.

Almost everywhere we have

been, people complain about tribalism at the municipality.

Apparently the locals are only given Expanded Public Works Programme (EPWP) jobs while a particular tribe rules the municipality with an iron fist.

This was confirmed by relatives in Thabong and Kutloanong, who say our Xhosa brothers and sisters from the Eastern Cape have been preferred over the local Sothos.

They say you cannot be the mayor, speaker, or municipal manager if you are not Xhosa.

They say this has been consistent in Matjhabeng, together with recycling the same people around the district, province, and Matjhabeng.

Residents tell me even when these people have committed misconduct, they are protected by the ANC because there are allegations that they steal together‍.

I heard over R3 billion has been mismanaged and misappropriated in Matjhabeng in the past three years.

In the district municipality, they claim that about R30 million has disappeared, while there is alleged corruption at the Lejweleputswa Development Agency.

I hate racism and tribalism and I hope the leadership of the ANC can do something about one tribe calling the shots. One thing we have concluded from this trip is that our people trusted the wrong people to run their affairs and lives.

I would have loved to buy retirement property here, but we will now join the rest of the leadership at either the Vaal River or Cape Town. I hear most prefer to buy properties in the DA-run municipalities. – Letter shortened, editor.

Welkom once a thriving city, it now finds itself in a state where crime, particularly vandalism, occurs in broad daylight with little fear of repercussions.

Criminals take whatever they can, regardless of ownership, and even undocumented foreigners seem unafraid of our legal system.

When comparing South African jails to those in neighbouring countries like Lesotho, it is clear why there is little deterrence.

In Lesotho, jails are feared, with few willing to endure incarceration a second time.

The iconic Welkom Showgrounds, a landmark of the past, is no more – another victim of inaction by those entrusted with safeguarding our community assets.

In response to questions about law enforcement’s role in preventing vandalism, Brig. Makhele of the South African Police Services (SAPS), says he feels it is unfair to try to dump such conduct at the door of the police.

He says that over the past two months, they have held three meetings to address critical issues related to the property.

“The liquidator confirmed that no funds are available in the liquidation to cover security costs.

“Consequently, we requested an affidavit permitting arrests on the premises. This affidavit has been provided and forwarded to the Community Policing Forum (CPF) and the SAPS for necessary action.

“The buildings you are referring to are having either an individual or a company holding its title deed, like your house and my house.”

We are responsible for security, not the police.

Here, however, our correctional facilities are often described as “hotels,” offering little to dissuade repeat offenders.

“Furthermore, we have addressed the municipal account to facilitate the potential sale of the property. A resolution has been reached to enable this process,” he says.

While poverty and unemployment are often cited as drivers of crime, it is worth noting that many of these criminal acts are not impulsive but carefully planned.

“Should one open a case where his or her property has been damaged in any manner, that is when the police come in to investigate. But we are not responsible to guard any private building to ensure it is not vandalised.

To ensure a sustainable future for the mall, the municipality is actively engaging with stakeholders to identify potential investors capable of rebuilding and taking ownership of the property.

The energy and strategic thinking employed in such activities could rather be channelled into more creative and constructive endeavours, benefiting the community rather than continually harming it.

The cityscape bears the scars of unchecked vandalism.

Scrapyards, seemingly the main beneficiaries, thrive on the remains of what were once valuable properties.

Amogela Mall, a prominent structure, has become a symbol of neglect. Its oncebustling premises now lie in ruins, posing both a danger and a disgrace to Welkom.

The decay extends beyond the mall.

A building adjacent to the Matjhabeng Municipality and various banks, not far from the police’s operational offices, has

“Should the police arrest anyone for such vandalism, the case will not even stand in any court, as the court would want the statement of the owner who pressed the charges against whoever. The police cannot do that on their behalf.”

Brig. Makhele’s response underscores the importance of property owners taking initiative to secure their premises and pressing charges to enable the police to act within the confines of the law.

When approached for comment, Tsiliso Tlali, spokesperson for the Matjhabeng Municipality, highlighted efforts to address the state of the Amogela Mall.

The situation in Welkom underscores a dire need for accountability and community involvement.

It is time for communities to take collective responsibility, either by demanding action, speaking out against observed wrongdoing, and fostering collaboration to restore and protect the city’s assets.

The decay of Amogela Mall and other properties is a stark reminder of the cost of complacency.

INTRODUCTION AND BACKGROUND

Moqhaka Local Municipality (the Municipality) currently owes Eskom R1 542 873 536 11 excluding the current account of a further R42 951 752 55 which is due and payable on 06 February 2025 Despite all the avenues that Eskom Holdings SOC Ltd (“Eskom”) explored and efforts to accommodate the Municipality, the matter has reached a point where Eskom can simply no longer afford to accommodate the Municipality without further financial strain and harming its own business In terms of the Constitution and the Intergovernmental Relations Framework Act 2005 (IRFA) the Municipality is supposed to cooperate and assist Eskom with fulfilling its mandate of ensuring that citizens have access to affordable electricity The Municipality has breached these obligations by not paying Eskom for the bulk electricity it supplies, making it impossible for Eskom to fulfil its mandate Eskom cannot operate and remain financially viable without payment from the Municipality When entities like the Municipality fail to pay Eskom on time or not pay Eskom at all it forces Eskom to borrow additional money at considerable

Since 2016, the Municipality has maintained an erratic payment on its electricity bulk account To its credit, the Municipality would catch-up on the arrears through payment arrangements agreed with Eskom From December 2022, the Municipality started to default on subsequent payment arrangements with Eskom

A letter was sent to the Municipality on 10 February 2022 requesting a meeting to discuss the short-paid current account as well as Active Partnering to assist the Municipality to collect the debt and improve on service delivery Active Partnering entails services by Eskom to the consented municipalities in areas such as reticulation and distribution of electricity to the customers of the municipality, revenue collection, as well as associated services such as tariffs, billing, losses management, knowledge and skills transfer, etc Eskom received a letter from Moqhaka requesting an extension to submit its revised payment plan on 05 April 2022

In March 2023, National Treasury introduced the Debt Relief Programme through Circular 124, within the context of section 34(1) of the Municipal Finance Management Act, 2003 All municipalities were invited to apply and participate in the Debt Relief Programme The Circular stipulates that Eskom is to write off the municipal debt over three years subject to, among other conditions, the municipality paying its current account henceforth Should a municipality fail to perform during the duration of the Debt Relief Programme the benefits under the Programme to that municipality will immediately cease Eskom will be obliged to implement its credit control and debt management policy on the municipality and the municipality must immediately start repaying its Eskom arrears, interest, and penalties Eskom may resume any legal proceedings (relating to the municipality’s arrear debt, interest, and penalties as of 31 March 2023), including attaching the municipal bank account

On 01 December 2023 the Municipality was admitted to the Debt Relief Programme The Municipality has failed to meet the conditions of the Debt Relief Programme by among other conditions failing to pay invoices in full within 30 days for the bulk supply of electricity On 16 February 2024, Eskom issued a breach notice to the Municipality and National Treasury wherein it demanded the following:

Immediate payment of the amount of R31 226 429 39 for the January 2024 invoice, which was due on 07 February 2024, and

• Failure to pay should result in National Treasury issuing a non-compliance notice to the Municipality ending the Municipality s participation in the Programme

On 18 March 2024, National Treasury held a meeting with Eskom, Free State Provincial Treasury, COGTA and Free State municipalities to address the non-compliance by municipalities to the conditions of the Debt Relief Programme

The Municipality failed to remedy the default even after the support received from stakeholders present at the abovementioned meeting organised by National Treasury This warranted Eskom to write a letter on 16 April 2024 to both the Municipality and National Treasury wherein it expressed the views that the Municipality’s participation in the Debt Relief Programme has been terminated due to non-compliance to the conditions

The Municipality has continued with erratic payments of its bulk electricity account and the Debt Relief Programme has failed to yield the desired results in respect to this specific municipality This is illustrated on the table below which depicts the payment pattern since its admission to the Programme The amounts below exclude the ring-fenced total debt of R843 592 625 63, which the Municipality would have benefited for a one-third write-off in the first year had it complied to the conditions of the Debt Relief Programme The table below outlines the accumulated arrear debt post the Debt Relief ring-fencing amount given above

CONCLUSION

Under the circumstances, it is appropriate for Eskom to explore further remedies to stop the debt from spiralling out of control The only option available to Eskom is reduction, disconnection and/or termination of the supply as empowered by the Electricity Regulation Act, 2006

Eskom appreciates the hardships the community and the economy will suffer should it exercise its statutory powers to disconnect the Municipality There are no other meaningful options available for Eskom to stop the debt from growing and to collect for current consumption on bulk supply

The Municipality charges, collects and receives money from its customers for the supply of electricity and fails or neglects to hand over the portion due to Eskom This is at Eskom’s detriment, and it is not sustainable if the status quo remains The Municipality is responsible for discharging a constitutional obligation but decides to withhold payments to Eskom

Riebies shine with medals

The Riebeeckstad High School finished fifth overall in the medal standings, with a small team receiving nine gold, four silver, and three bronze medals –totaling 16 medals – and setting four records at the SHS Willie Roux Invitational Athletics meeting held in Sasolburg on Friday, 7 February.

A total of 18 athletes of this school participated.

The two athletes who performed the best on the day are Andries Morekind and Sylvia Lesige. Andries took first place in both the 1 500 m and 800 m, setting records in both events. Sylvia

also came first in both the 1 500 m and 800 m, improving the records in each.

Four athletes placed in the top 50.

Orifilwe Tau finished first in the 1 500 m and third in the 800 m.

Ofentse Selekoe secured second place in the 1 500 m.

In the 800 m, Mapule Mohale placed third, and Bania Lsulna performed exceptionally well, winning both the 100 m and 200 m.

Reaipela Mokatsane came second in the high jump, and Atlehang Erasmus finished first in both the 800 m and 1 500 m. Kabelo Thlone earned second place in the 1 500 m and was third in the 800 m.

Swimmers excel at Midmar

The annual aQuelle Midmar Mile took place on the weekend of 8 – 9 February near Howick in KwaZulu-Natal.

The 1.6 km swim is one of the largest open water swimming events in the world . This year some 12 000 swimmers from all over the world took part, which makes the achievements of the Welkom swimmers remarkable.

The event attracts all types of swimmers, including amateurs, professionals and paraswimmers.

The group of Welkom swimmers included Shaunagh Reynders 43:36, Gemma Mansill 41:08, Corinne Mansill 39:18, Genevieve Venter 42:10, Jordan Wiesner 31:40, Nathan van Rensburg 45:22, Dirk Nel 30:14, Japie Nel

45:19, Mareze Flylinck 24:18, Louise Viljoen 38:38, Nicole van Rensburg 45:22, Ryno van Rensburg 45:23, Cayley Karpakis 41:18 and Julie Hundermark (56:22).

The seven WelkomGimnasium swimmers are Ashley Seymour (29:06), Noa Mansill (25:30), Kaira Nel (32:59), Tatum Venter (29:29), Shyenne Laubscher 28:34, SJ Nel

(23:25) and Tristan Venter (26:35).

Adriaan du Toit, a learner of Naudeville Primary School completed his swim in a good time of 30.47 minutes. SJ Nel, Noah Mansill, Tristan Venter and Shyenne Laubscher achieved the top 100, and Tatum Venter and Ashley Seymour achieved Top 200. They are all Gimmies.
