hese were the 4th Annual Awards for the Rocky Mountain region and the organizations and individuals in this journal were acknowledged by the award’s judging panel to have excelled in their work in 2015, whilst also focusing on the industry core values of Health & Safety, Environmental Stewardship and Corporate Social Responsibility. The Oil & Gas Awards champion best practice and recognize organizations operating in the upstream and midstream sectors of the industry. The media and members of the general public do not distinguish between the different sectors of the industry, which is why the Awards incorporate categories for all parts of the upstream and midstream sectors. The absent mindedness of an individual on an assembly line can have dramatic consequences months later should equipment fail when being used in the field. This reflects badly on the industry as a whole, we therefore think it is extremely important that best practice is championed from top to bottom and the Awards are a platform to promote to the press and public the great work being done. The Oil & Gas Awards are unique in highlighting the incredible innovation and commitment to positive industry development and expansion, rebutting traditionally negative mainstream coverage. The Awards celebrate corporate success twinned with organization’s commitment to health & safety, environmental stewardship and corporate social responsibility.

2016 Rocky Mountain Guest of Honor

Senator Sonnenberg Jerry Sonnenberg is a Colorado native who has been farming and ranching in northeastern Colorado his entire life. He continues to live and work on the same farm that both his father and he were raised on growing wheat, corn, sunflowers, millet and cattle. Senator Sonnenberg was first elected to the Colorado House of Representatives in 2006 and immediately became a strong voice for agriculture and rural Colorado. After serving 8 years he was elected to serve from District 1 in the Colorado Senate where he represents the counties of Cheyenne, Elbert, Lincoln, Logan, Kit Carson, Morgan, Phillips, Sedgwick, Yuma, Washinton and Weld. Because of his leadership abilities, agriculture background and experience in Colorado’s land and water issues, Jerry currently serves as the chairman of the Senate Agriculture, Natural Resources and Energy

Committee. He also serves as vice-chair of Senate State, Veterans and Military Affairs Committee and is a member of both Senate Appropriations Committee and Capital Development Committee. Senator Sonnenberg has proposed legislation during his tenure that has reinstated the ag sales tax exemption; tried to eliminate the governments use of eminent domain in acquiring water rights; authorize spending on water projects; making it easier to build water storage projects; protect agriculture data given to government from access by the public; allows trucks to be more efficient by utilizing triple axles and larger loads on secondary roads; encourage Division of Wildlife to utilize easements rather than fee-title acquisition; secure emergency funding in tough economic times for K-12 education; create a stable funding source for highways; protect law-abiding citizens from the Governor tramping on their gun rights; secure funding for community colleges; regulatory reform and removing regulations; drug testing as a condition of receiving government assistance.

Amy Oliver Cooke Amy Oliver Cooke is the Executive Vice President and Director of the Energy Policy Center for the Independence Institute, Colorado’s free market, state-based think tank. She has worked in both policy and operations since 2004. Amy began working in energy policy in 2010. She is one of the few state-level, free market energy policy experts. She has spoken to thousands of citizens, activists, lawmakers, and policy experts across the country about everything from the controversial Clean Power Plan to strategies and policies that advance affordable power. She’s famous for her provocative messaging like “Mothers In Love with Fracking” and “I’m an energy feminist because I’m pro-choice in energy sources.”

Amy has collaborated with the Competitive Enterprise Institute to expose Colorado’s phantom carbon tax and the real cost of the state’s renewable energy mandate. The work of Amy’s team led to a full audit of Colorado’s PUC Commissioners. Two of the three commissioners did not return for a second term. Amy’s team exposed shoddy accounting in the Governor’s Energy Office after receiving more than $100 million in stimulus money, which also led to a full audit and legislative reorganization Amy was part of a national coalition that worked for several months to educate federal lawmakers on both sides of the aisle about the consequences of President Obama’s nomination of Colorado’s former PUC Chairman Ron Binz to head up the Federal Energy Regulatory Commission. As a result of that effort, Mr. Binz was forced to withdraw his nomination Amy has also successfully lead efforts to stop tax increases and advance transparency in government.

Keynote Presentation

Commodity prices are set to return to normal soon, but the United States oil industry has taken over the global marketplace in the meantime.

As the price of West Texas Intermediate crude remains around $43 a barrel as of early May 2016, the oil industry continues to contend with a depressed market that has cost the jobs of thousands of people the shut-in of over a thousand rigs. On the bright side, as Christopher Guith put it during his keynote presentation to start the Industry Summit, there are plenty of reasons to be optimistic. Since oil prices began to plummet, for instance, the U.S. oil industry has earned the status as the world’s swing producer OPEC hoped to grip as it refused to reduce production despite the worldwide glut of crude. In combination with the federal government’s rescinding of the crude oil export ban, the Guith – Senior Vice President of the Institute for 21st Century Energy at the U.S. Chamber of Commerce – said the United States is in a prime position to dominate the international market for years to come. “Creating the opportunity for export was a huge deal for the country in spite of the fact that we have a depressed market right now,” Guith said. “Today, we’ve seen less exports than we did the year before, but that is frankly a measure of the market and the ability to now to be able to bring stuff to Venezuela, to Singapore, throughout Central America and Europe – it’s starting to change the landscape in very small ways. But it is creating a whole new environment as far as the geopolitical nature of the trade of crude oil.” Guith set out to remind attendees of the Industry Summit that American companies are at a distinct disadvantage in the international oil market because the largest firms control less than 8 percent of the world’s global supply. Firms like Exxon, Chevron and Shell are competing against state-owned oil firms controlled by central governments sanctioned to do whatever they can to expand their interests, according to Guith.

“As big as Exxon is, they can’t go out and offer a country in sub-Saharan Africa small arms in order to get access to their reserves, or military aircraft, which China has done,” Guith said. “That puts into perspective what our energy suppliers are facing around the world.” Despite that imbalance of power in the market, as well as increased competition from renewable sources of energy like solar and wind, U.S. fossil fuels still rule the day. According to Guith, the United States boasts 120 years’ worth of natural gas, 206 of oil and 464 of coal in technically recoverable resources. Those numbers leap to 586 years of natural gas, 536 of oil and 9,844 for coal. “All of our federal policies are based on these assumptions because most of them were put in place in the ’70s, and the old export ban was one of those examples,” Guith said. “Due to a whole lot of hard work and education both in the states especially but back in D.C., we were able to change that at the end of the last Congress. In spite of the derision most Americans have for Congress, there’s signs of hope.” Guith was quick to remind attendees about the reason why the oil industry took such a hard hit in the first place. He was among countless industry insiders – including President Barack Obama – who believed as recently as four years ago that the United States could never produce enough oil to have a negative effect on commodity prices. But that is exactly what happened as the 4.1 million-barrel increase between 2006 and today was larger than the production of every country in the world except for Saudi Arabia and Russia. “The glut has everything to do with this massive increase coming out of the U.S. and coming out of the unconventional shale plays,” Guith said. “In 2014, we had the largest single increase in the history of the country [1.2 million barrels per day] as far as year-to-year increase, but then 2015 happened.”

U.S. refineries have remained busy during the downturn, as well, with a record throughput of 17.2 million barrels per day. And with pipeline projects like Keystone XL getting rejected, crude by rail transport increased 4,000 percent from 2008 to 2014. This glut of product in combination with decreased demand created the downward pressure on commodity prices the industry experienced at the end of 2014. Guith cited the International Energy Agency, based in Paris, who expects to see equilibrium by the end of 2016. However, he also said the agency changes its projections monthly, due to the fact unconventional oil plays still are a relatively unknown resource. “We’re in uncharted territory, and a lot of that has to do with the fact that a lot of the wells we’re drilling right now in the shale places are unlike any of the wells we’ve historically dug,” Guith said. “For the unconventional horizontal wells, we just don’t have a lot of history as far as how long they last, and we’re revising them every single day.” That means producers are able to go longer, have more segments within the drill line itself and are able to get more out of each well. Guith also said production efficiency has improved as producers have increased

gains from 5 percent per formation to up to 7 or 8 percent, along with additional gains from refracking. Those numbers coincide with the steep drop in operating rigs. The U.S. oil rig count has dropped 76 percent, including 84 percent in the Bakken Shale and 70 percent in the Niobrara Shale. Gas rigs have dropped 75 percent, as well, with the Marcellus Shale mothballing 63 percent and Haynesville losing 70 percent. Guith closed his presentation by alerting attendees to forthcoming climate change regulations that will place a cap on carbon emissions. He likened the far-reaching and all-encompassing regulations that cover everything from carbon dioxide to far more dangerous gases like nitrous oxide and sulfuric oxide to forcing a square peg into a round hole. And he warned that if the regulations go into affected without a debate, it could prove costly for the American industry overall. “All of a sudden, that makes this the most profitable place in the world to do it to the least profitable place,” Guith said. “And when the demand for that stuff dries up, that means the demand for the stuff coming out of the fields here goes away, too.”

A look at the cliff we plunged over in 2015 and the horizon for 2016 The oil and gas is slowly climbing out of the depths of the latest bust cycle, but the aftereffects could resonate for some time in the Rocky Mountain region.

On the drive to the Rocky Mountain Industry Summit from Wyoming to Denver, MJ Clark realized just how different the oil and gas industry is regulated when compared to her home state. The Executive Editor of the Wyoming Business Report noticed the hidden, almost camouflaged equipment along the highway, a symbolic representation of how Coloradans may see the industry even if the statewide economy needs it to thrive badly. “Driving past the oil rigs here, it looks like Colorado slipcovers all of their oil rigs, because in Wyoming they’re just sitting out there,” Clark said. “They might be painted in a nice, lovely sage to blend in, but that’s all we do.” Considering the financial benefits the oil and gas industry brings to the state – which may be severely curtailed if 2016 projections hold true – Colorado might want to consider giving it some more exposure. As of the Industry Summit in March 2016, Colorado had 17 rigs running, a steep decline from the 40 just one year prior, according to Doug Flanders, Director of Policy & External Affairs for the Colorado Oil & Gas Association (COGA). However, in May 2016, the Denver Post reported the state lost two more, bringing the total number of oil and gas rigs in the state to 15, its lowest mark in over 15 years. The Post also listed the all-time high of 125 active rigs eight years ago. The number of permits filed in the state have dropped significantly, as well. In 2008, 8,000 permits were filed, according to Flanders, and about 29 million barrels of oil and 1.56 billion mcf of gas were produced. In 2013, there just over 4,000 permits were filed, but the oil production rose to 100 million barrels, and natural gas shot to 1.64 billion mcf of natural gas. The state again set production records in 2015 despite the number of permits submitted dropping to 2,900. As of March 2016, the number of permits filed was down to 360, but Flanders said the industry is on pace to almost match last year’s production numbers. That’s why when environmentalists say there is way too much drilling throughout Colorado, their words ring hollow for Flanders.

“A lot of that’s the lagging effect of our decline curve, but we’re still seeing natural gas and oil from a production standpoint,” Flanders said. “That’s because of the success our operators have had with horizontal drilling, hydraulic fracturing and all the rest, being able to get more with less.” If COGA’s numbers are any indication, Colorado definitely should take notice of declining energy commodity prices and the effect they will have on the state. The oil and gas industry has been a major supporter of the state’s economy since its resurgence, pumping $330 million in severance taxes just two years ago, which Flanders said was put toward local schools and many other programs preordained by the state legislature. For 2016, however, severance taxes from the oil and gas industry might break $70 million on early projections based on commodity pricing. “We’re trying to figure out how do we backfill this because when we were at our height for severance, the wisdom of the legislature started adding to the commission, and now we don’t know how we’re going to pay for all this,” Flanders said. “We’re starting to see now this slowdown of these other industries because of what was happening 18 months ago in our industry. We’re one of key leading indicators in this state, and we’re an economic driver.” L. Poe Leggette, Partner with BakerHostetler, believes the transaction market was one of the sectors of the oil and gas business hit hardest by this downturn, especially for natural gas plays in Wyoming. The nationwide statistics on this aspect of the industry align with this notion. According to a Deloitte report, there were 379 M&As in 2015, down from 709 in 2014. That figure also was down from the 409 and 389 that happened in 2008 and 2009, respectively, in the midst of the Great Recession. Oil & Gas 360 reported the total value for the sector was also down to $286.23 billion in 2015 from $353.97 billion in 2014 despite several megadeals.

“The pulse of the transaction market is weak, but it is not dead,” Leggette said. “Deals are still being done, and a fair number of them involve lenders recognizing they are dealing with capable companies who are in a massive cash flow crunch.”

Initiative No. 75 – a proposed constitutional amendment to allow local governments to regulate oil and gas development;

As a result of this crunch, Leggette said deals are being cobbled together by creditors who take amount owed to them that won’t get paid back and converting them into an equity interest borrower company.

Initiative No. 78 – expansion of Colorado’s setbacks for oil and gas operations from 500 to 2,500 feet.

Aside from that, Leggette said buyers are going after the “gems” – assets with proved developed producing resources with the potential upside for future growth. No surprise there. The change over the last couple of years, though, is what those assets will cost in today’s environment. Leggette says two years ago, there would have been a large premium attached to that future growth potential. In the current market, however, buyers almost get it for free. “There is a silver lining for small independent investors and companies through good management and good fortune are positioned well and have access to some money,” Leggette continued. “There are a lot of noncore assets that are still likely to be good, and there is a small movement of independent producers and investors picking up these assets at bargain-basement prices because they’re in a position to hold onto them for a few years before they have to start to develop.” Aside from unfavorable commodity prices, oil and gas companies in Colorado also must deal with legislative challenges in the form of ballot measures, according to Flanders. In April 2016, the Denver Business Journal reported four such proposals would, if approved by voters, cut back oil and gas operations on Colorado. Flanders is concerned with three potential measures that could land on ballots this year. According to the Business Journal, the proposals supported by Coloradans Resisting Extreme Energy Development are:

“Each one would have a different impact, but they would all be the same,” Flanders said. “It could be devastating not just for the industry, but also goes right to the heart of private property rights in the state of Colorado, and some actually go right at the heart of water rights, which if you’ve lived in Colorado for very long, that’s a fight bigger than oil and gas.” The ballot measure issue isn’t something in the thorn of the side of the oil and gas industry alone. Flanders said it is too easy for to suggest changes to the state constitution – which is four times the size of the U.S. Constitution, according to Flanders. According to Ballotpedia, at least 39 initiatives were filed for spots on the 2016 ballot in Colorado. “It’s so easy in this state to get something on the ballot, not just to change a law, but to change the constitution,” Flanders said. “There is a lot of effort outside of that trying to change some of these other efforts because it is just too easy in this state to be able to add something to a document as important as the constitution of this state.” As long as commodity prices remain volatile, John Kroshus, Drilling Manager for Integrated Petroleum Technologies Inc., said only operators can control their margins – to a certain extent. He believes there is what he calls a “shale band” that exists between $40 and $65 per barrel that oil companies can plan around moving forward. “I don’t think there is a lot of room left to come down in costs,” Kroshus said. “People think if we can stay the same, we can make money, but service costs are going to rise. So if we see $40 or $50 oil, costs will rise, margins will be less, but margins will be profitable.”

Midstream Pipeline companies remain busy as they ramp up for commodity prices to return to normal in the not-too-distant future.

When it comes to the midstream sector, where projects can extend for miles across counties, states or even the entire nation, overlooking the smallest of details could curtail progress on a job. During a panel discussion on the midstream sector led by Moderator MJ Clark, Executive Editor of the Wyoming Business Report, Haven reminded attendees of the Industry Summit just how important those details can be.

550 miles of new crude oil transportation pipeline, multiple truck injection bays, over 1 million barrels of operational storage, and at least two origination points located near Lucerne and Kersey (Riverside Station) in Weld County, Colorado. According to NGL’s website, the system is in active development and is scheduled to commence service in the fourth quarter of 2016.

“If you pay attention to the small details, it’s typically not the large details that come back and bite you,” said Haven, who serves as the Chief Business Development Officer for LOENBRO. “The details that the landowner is worried about is always those smaller issues.”

According to Jim Kahler, Manager of Strategic Planning and Market Analysis for NGL Energy Partners, Grand Mesa will add a combined 340,000 barrels of oil per day of capacity out of the DenverJulesburg (DJ) Basin, which he believes will solve the play’s takeaway problem.

Those issues are of the utmost importance to pipeline constructors these days, which are part of one of the few aspects of the oil and gas industry that can remain busy while commodity prices slowly creep upward.

“The macro environment has partially solved that problem for the DJ, but we think long term this is going to add a lot of value to the basin,” Kahler said.

Despite the current state of the oil and gas industry, midstream companies like NGL Energy Partners is adding storage capacity to its portfolio. The company is constructing Grand Mesa, which will include over

In fact, downturn in the industry already has compressed the value of netbacks from the DJ to give operators higher value for their oil. Kahler said netbacks used to trade back around $7 or $8 dollars, but those figures are down to $3 or $4.

Another pipeline project Kahler touted at the Industry Summit was Dakota Access’s Bakken Pipeline, which Kahler said had just received approval in Iowa back in March 2016. As of May 2016, however, the Texas-based company still didn’t have all the permits it needed to begin construction. According to 13 Now News in Iowa, the Iowa Utilities Board would not grant Dallas Access permission to begin construction where it had permits already because the company still is waiting for permits from the U.S. Army Corps of Engineers 37 miles under its jurisdiction. Even with Dakota Access’s slight delays, this activity shows the midstream sector is not sitting idly by awaiting commodity prices to return to more acceptable levels. “Things are happening even though we’re seeing this downturn in the industry,” Kahler said. “We continue to operate and build assets.” There are a few reasons why the midstream sector carries on, according to Kahler. Primarily, pipeline projects have long lead times, with many endeavors taking as long as three years to plan depending on the time it takes to acquire land and sign customers. Also, pipelines are different than other types of investments because they stay in the ground for decades. Most importantly, however, midstream companies like NGL do not envision oil prices staying below $50 per barrel forever. Kahler said the numbers in the DJ Basin are particularly attractive considering 50 to 70 percent of the wells completed in the play in 2014 and 2015 are “economic sub-$40.” “Looking forward, we already have somewhere between 300 and 700 wells that have been drilled in the DJ and

not completed, and you have this backlog of inventory of wells that are ready to turn on as you continue to see this upward price pressure,” Kahler said. “We feel very comfortable with the economics of the DJ, and yes, we expect to see more projects going forward.” While Kahler was genuinely excited about the midstream projects afoot, Everod Samuel, President of Samuel Engineering, insisted that he and his engineering colleagues must do a better job at designing such projects. In his opinion, there was a great deal of productivity lost during the boom cycle of the oil and gas resurgence, and he puts that squarely on the midstream sector. “We see this big glut that everyone has spoken about and it has led to one of the deepest financial downturns on record in the oil industry,” Samuel said. “From an engineer’s perspective, what we see is a severe squeeze in the service sector to drive more efficiency out of projects. “The E&P guys did a great job, and they should be proud, but I think midstream engineers, operators, all of us should be dissatisfied,” he continued. “And if we are dissatisfied today before the next growth curve occurs, we will have a bright future.” One area where midstream engineers could improve, Samuel opined, is in procurement. Too many engineers relied on a dated, price-centric procurement model for their construction materials, which did not lead to lowering the costs of the jobs as expected. Instead, Samuel suggested, engineers should join forces with other stakeholders of these projects, including construction crews and vendors, to find the best approach for procuring materials.

“There needs to be more collaboration between engineers, equipment suppliers, construction companies, and so on,” Samuel said. “With that pricecentric procurement approach, it really disincentivizes the initiative of the engineering, procurement and construction companies to offer creativity and ideas to improve project efficiency because it was all about low bids and not looking at the long horizon.”

According to the American Petroleum Institute, the United States houses over 190,000 miles of liquid petroleum pipelines, connecting producing areas to refineries and chemical plants to deliver product to consumers and businesses. The U.S. Energy Information Administration says there are 305,000 miles of natural interstate and intrastate transmission pipelines for natural gas, as well.

Samuel also said the rush to construct pipeline projects as quickly as possible played a role in lackluster engineering. E&P companies were so focused on selling oil at $100 a barrel, there was barely any time for thoughtful design.

As Kahler puts it, U.S. energy infrastructure is facing the same perils as the energy workforce needs – it is aging faster than it is being replaced.

“There wasn’t enough time to design it, so they’d just start construction, and the poor construction company in the field is being given revisions of drawings and rework, and that just translates to extra costs,” Samuel said. Many of these issues can be avoided by getting midstream engineering companies involved with projects during the planning stages. Samuel also suggested bringing in construction firms, as well, who can offer suggestions on how to build projects as efficiently as possible because of their hands-on experience in the field.

“There’s what we call the ‘demographic cliff’ that’s going to happen, or ‘the great crew change’ – the same thing is happening with pipelines: they’re all old,” Kahler said. “There’s huge opportunities for construction or engineering firms to both refurbish those pipelines or replace them, and monitoring will certainly have to increase, as well.” Aside from structural integrity, security has become a major concern for energy infrastructure throughout the United States and the world. Samuel’s company cyber security for his clients, an area which once focused on control systems but has since expanded to include potential terrorists from hacking systems.

“Many times by the time an engineering company gets involved in a project, certain aspects are set so capital costs can only be impacted so much, and operating costs and operating performance is hitting against the ceiling because of decisions that were made not in collaboration with the professionals who could run rigorous models of the process and look at material costs and different aspects of the project,” Samuel said. Along with new pipeline construction, the midstream sector has used the downturn in the oil and gas industry to refurbished existing infrastructure.

Market Update: Prognostications for Post-election Policy on Federal Land Natural Resource Management and the “Leave it in the ground” agenda. Bob Comer can only hope for huge shift in the federal government’s policy toward the oil and gas industry after eight years of the Obama administration.

Bob Comer can foresee a dystopian future where the United States squanders the vast opportunities presented by its energy resources. In fact, he already has the blueprint for how this will occur – it’s the same fate the minerals exploration has experienced under the Obama administration. Citing statistics from the National Mining Association’s Hal Quinn, the United States went from first to seventh in mineral production in the last 25 years, importing $27 billion in minerals even though the nation has its own abundant supply. “Will we do the same thing with our oil and gas wealth?” posited Comer, Partner with Norton Rose Fulbright. “Look at the local moratoria around the country, the moratoria in the state of New York, offshore leasing closures – a phenomenal source of oil and gas – and public land closures.” There is no mistaking how the Obama administration has felt about the U.S. energy industry over the last eight years. Considering the lengthy list of “accomplishments” on energy policy, as Bob Comer put it in his Industry Summit market update, the examples are plentiful. In his first term alone, President Barack Obama imposed a brief moratorium on offshore leasing after the Macondo incident; increased fuel economy standards; made climate change a political agenda mover; and created various administrative barriers to land access. Bolstered by a victory for a second term in office, Obama took on the energy industry with a vengeance: he reinstated the moratorium on all offshore leasing except in the Gulf of Mexico; vetoed the Keystone XL pipeline; ozone standard changes; cancelled numerous lease sales opposed by the keepin-ground movement; enhanced barriers to public

land mass; issued an executive order on mitigation; cancelled of 30-year-old leases; and declared the climate is the primary threat facing the world. “Compare those programs – and this is a much shorter list – to the programs and initiatives that help or support the industry,” Comer said. “That list is pretty short. In fact, I wasn’t able to come up with anything for it.” The new mitigation policy, specifically, was issued by President Obama in November 2015, and it created some moral obligation to the next generation to protect natural resources. The policy defines natural resources to exclude minerals, according to Comer. “So it doesn’t look at the importance of mineral – in fact, it kind of chastises them and segregates them,” Comer said. One of the most striking components of the mitigation policy, according to Comer, is that it requires restoration in the advance of development with performance standards. “So taken at its face, you have to mitigate the impacts you’re going to have before you even go out onto the ground,” Comer said. “So you thought it was hard to get a permit now, you’ve got a whole protocol that’s being imposed with respect to mitigation before you even get off the ground in your permitting process.” In congressional testimony, Comer said the EPA, Council on Environmental Quality and the U.S. Fish and Wildlife Services claimed the memorandum was nonbinding, but instead requires a rulemaking. Comer also pointed out the memorandum’s provisions for transparency in the process, but there has been no public participation as of March 2016.

“So it doesn’t look at the importance of mineral – in fact, it kind of chastises them and segregates them,” Comer said.

“Like many things, mitigation as a concept has greatly evolved from a tool to enable proper development to my mind to become a barrier to actual development,” Comer said. Another concerning rule for Comer has to do with the protection of the greater sage grouse. Comer’s biggest concerns with the program are three lastminute requirements that were tacked on without public notice: •

The net-conservation gain standard;

The creation of safe focal areas; and

The 3 percent disturbance cap.

Comer said there had been numerous lawsuits filed to fight the program, including two governors and an attorney general. In May 2016, the oil and gas industry followed suit when the Western Energy Alliance and the North Dakota Petroleum Council filed a lawsuit challenging the Bureau of Land Management (BLM) and U.S. Forest Service’s landuse plan amendments, according to the Wyoming Business Report.

According to the Associated Press, the federal government will refund $31,235 for the original lease payments with no added interest. With the presidential election just a few months away, Comer wondered if anything would change. As of March 2016, Democratic candidates Hillary Clinton and Bernie Sanders and Republican candidate Donald Trump had promised no leasing on federal lands. Clinton and Sanders had stated their opposition to fracking and coal, and they also believe climate change is the greatest threat facing the nation. “What does this portend for oil and gas in the future?” Comer asked. “Is it more of the same?”

The industry also must contend with sold lease cancellations, some of which were 30 years old. In February 2016, BLM announced plans to cancel 25 contested oil and gas leases in Colorado’s White River National Forest, as reported by Environment & Energy Publishing. Just before the Industry Summit, the Department of Interior announced BLM’s cancellation of an oil and gas lease in the Badger-Two Medicine area of the Lewis and Clark National Forest in northwest Montana. This lease, held by Solonex LLX, was issued by the BLM in 1982. “That’s just shocking,” Comer said. “You know a company had to put a lot of money into exploration and efforts to develop and work the regulatory and judicial processes and the challenges brought by tribal interests and environmentalists.”

Water management in current environment With a precious resource in short supply in throughout the United States, oil and gas operators must get creative to hydrate their operations.

Mark Stanley is among the uncontested experts of water management in the United States. So, when the CEO of Themark Corp. says there is a water problem in the U.S. oil and gas industry, decisions-makers ought to listen. He regaled the audience at the Industry Summit with numbers of a stark reality that should be pared down in light of the current economic conditions with the energy business. In Odessa, Texas, alone, there are 2 million barrels of oil pumped per day, which produces 20 million barrels of produced daily. Considering the drought situation, that could prove problematic for years to come. The economics of the situation show there should be some solutions en route, as well. “We look at it as paying $32 per barrel for water here, so we’re paying fractions of a cent,” Stanley said. “But we don’t protect it like we should. And we shouldn’t use it if we don’t have to.” There are creative solutions to be had if E&P companies are willing to work with engineers like Tetra Tech. Julie Vlier, Manager of Water Resources for Tetra Tech, highlighted one creative solution one of her company’s clients recently implemented. Pioneer Natural Resources is working with the wastewater treatment plant in Odessa, Texas, to acquire reusable wastewater effluent and using it for their oilfield operations. “It’s a heck of a deal for this particular company and beyond that, as you can well imagine, these wastewater treatment companies are producing effluent 24/7,” Vlier said. “So when it comes to reliability, it’s there. They’re supporting the local municipality by providing the engineering improvements and infrastructure to provide that connectivity.” According to Vlier, this client also built a pipeline that not only will convey the effluent to its operations, but also is large enough to carry more effluent as the community grows and more is available. There also is capacity in that pipeline to potentially work arrangements for other oil and gas companies to use the source.

After the grand “valve turning” ceremony in Odessa in January 2016, the Odessa American newspaper reported the partnership with Pioneer will bring the city more than $117 million over the next decade or so. Vlier believes this model can be used in other cities throughout the United States where the oil and gas industry has had troubles gaining access to water for hydraulic fracturing. “I think there’s great opportunities with other municipalities and taking effluent and putting it to beneficial use,” Vlier said. “It’s a win/win. The municipality appreciates it, the city council appreciates it, and there’s some benefits for the oil and gas industry.” In order to build trust within the community, Tetra Tech is implementing real-time monitoring stations in certain areas to scientifically support discharge in southern Colorado. According to Vlier, the data is made available on the creeks and rivers where discharges occur, broken down into 15-minute data points with a variety of parameters. The information is accessible to the general public as well as government regulators. “We have implemented those types of programs in Colorado, and it’s provided transparent data, more trust and engagement with elected officials, the community, the public, the farmers pulling the water, the fishermen out there enjoying it,” Vlier said. “We in turn have been able to get more flexible permit conditions so we can in fact surface water discharge because we’ve proven through the data and the science that those beneficial uses are protected.” Stanley said the overarching problem with water management in the oil and gas industry is that operators have 23 different sets of regulations to adhere to depending on the state they’re working within. That is because federal laws on water do not take primacy, and business will follow the road to least resistance as a result. The conundrum facing the operators in the Marcellus Shale is a prime example of this problem. Due to Pennsylvania’s water disposal regulations, there

are only seven disposal wells permitted there. However, in Ohio’s Utica Shale, there are 200 wells, a disproportionate amount for the work being conducted there.

She referenced the water monitoring program again that not only provides data for all stakeholders involved, which proves even more valuable when it builds relationships with those stakeholders.

“That particular site may have three disposal wells and is permitted for about 16,000 barrels a day, but almost every truck that comes in there is from Pennsylvania and West Virginia – almost none from Ohio because of the volume that’s produced there,” Stanley said. “That constraint is not there in Ohio where it is in Pennsylvania or West Virginia. So if you’re operating in Pennsylvania or West Virginia – I have no idea why you’d want to – those are some real constraints.”

“I think the bigger dividends on that particular effort is the building of the relationships so the communities and the regulators understand the quality of the water,” Vlier said. “While the oil and gas industry certainly needs water to take care of its business, to the extent that you have excess water, is there an opportunity to share that water with local communities?”

Constraints like these are a direct result of the fear many municipalities and county governments have when it comes to treatment and reuse of produced water, according to Moderator Adam Martin, Executive Director of the South Dakota Oil and Gas Association. As a city councilman in Sturgis, South Dakota, he understands the political pressure coming from residents of a community who want clean, potable water and the oil and gas industry who wants to operate safely. “A lot of that does come back through to determining how we reach out and becoming that voice and connecting some of those dots, so we educate our neighbors on what is really going on,” Martin says. “Certainly that public perception and buy-in provides some huge benefits.”

Despite some restrictive water rights in Colorado, this is another angle Tetra Tech has considered for its clients in the state. This could prove quite beneficial for oil and gas operators in other states with more flexibility with water rights, and Vlier encouraged those companies to take advantage of it. “There might be an opportunity to put water that you produced that could be subsequently treated and work an arrangement so a municipality could put that to beneficial use,” Vlier said. “I fully believe in my lifetime that we’re going to see that kind of flexibility here in Colorado because there’s so much for a need for water. Whether it’s for oil and gas or municipalities, we cannot afford anymore to put this water into an injection well. “It is beyond the seismicity issues and what not – it’s the fact that this water is very useful, it’s much need and it’s a scarce resource,” Vlier continued.

Vlier believes with the oil and gas industry’s overall reputation among the general public viewed as unfavorable – fair or otherwise – water conservation is one way to ease the fears of community members throughout the U.S. “In this day and age, I just feel that now is the time for the oil and gas industry to really seize the moment and to look ahead at water conservation measures in areas where you can reach out to the public and reach out to elected officials, and I think it’ll pay big dividends at the end of the day,” Vlier said.

Ensuring Fleet Efficiency, Safety and Environmental Best Practice Trucking companies still face regulatory challenges and safety concerns during the energy industry’s slow period.

Like other segments of the oil and gas industry, the trucking sector has taken its share of lumps during the latest economic downturn. However, during a panel led by Oil & Gas Awards Chief Operating Officer Oliver Bridgen, panelists revealed that there is no shortage of work to do as efficiency, safety and regulatory compliance are still a major part of the transportation industry. In order to get his fleet running at optimal efficiency, Travis Black, Regional HSE Manager Southern Division for AVEDA Transportation and Energy Services, is borrowing concepts from the manufacturing industry. AVEDA is piloting its own Lean Six Sigma 5S program. The company is relying on different aspects of the philosophy to streamline repairs and maintenance of its fleet now that there is ample time to focus on such things during the bust cycle. “When industry was running strong, this was part of the things that kind of got put on the backburner,” Black said. “Customers needed trucks, they needed their rig moved and they needed it done now. Now that the market has kind of turned, it gives us time to develop these programs, that way when it does return, we have a good process in place.” AVEDA primarily has focused on the 5S portion of the philosophy, starting with “sorting” to make sure the parts in stock are what the company needs. With parts so readily available these days, there isn’t much need for fleet managers to keep extra inventory on-site. “We don’t have to maintain such a high overhead of stored parts and extra items,” Black said. The second “S” in AVEDA’s Six Sigma journey represents “straightening.” Keeping maintenance areas organized at all times cuts wasted time out of a company’s operations. “Being able to find the tools at the times you need them and taking items that are more crucial and keeping them closer so the mechanics aren’t wasting time going to different places to look for something is important,” Black said. “This system kind of has a double-edged sword because it’s a huge aspect of safety by making sure people pick up after themselves and put items where they belong.”

When it comes to safety, Tony Lamping, General Manager of Cruz Energy Services, says his company relies on industry protocols, regulations and trade association guidelines to maintain its safety culture. But what the company leans on most is its employees’ buy in of the importance of safety. “All the systems in the world are great and they can help you out and keep people safe, but if you don’t start out with the right employee right out of the gate, then you’ve pretty much already lost the battle,” Lamping said. Much like AVEDA, Cruz Energy Services barely had time to properly vet potential employees as there was plenty of work to hire whomever was available. During the downturn, however, Lamping says Cruz Energy has taken the opportunity to identify the characteristics they want in an employee to make sure they get hires right the first time. “Over the last two or three years where we’ve got our feet under us, we’ve got the opportunity to really start putting programs and policies and procedures in place right from the start at the hiring aspect of it so that we get the right people in the door that know the industry and want to follow the rules,” Lamping said. “On top of that, we’ve started developing our safety program with dedicated safety people out there on location when we’re doing our work.” Peter Arrigoni, Vocational Fleet Sales Manager for Kenworth Trucks, advised fleet managers to keep their eyes on two regulations on the horizon that would greatly affect how they operate. Arrigoni cautioned fleet managers on the new emissions standards taking effect Jan. 1, 2017. The last change to emission rules was in 2010, and anyone who has not purchased equipment in that time frame would be best served to bone up on this rule change to make sure their fleets are up to speed. The 2017 emission rule will change the type of equipment allowed on vehicles once again in EPA’s attempt to meet a 6 percent reduction in carbon monoxide emissions, which Arrigoni said would result in about a 4 percent improvement in fuel economy.

While the regulations will save oil and gas operators money in the long run by making vehicles 200 pounds lighter, they will be required to have fleets with completely different systems than years past, which will make an impact. “I would say since you’ve stepped out of the new equipment-buying process, if there is time for maintenance departments or with your technicians or any kind of maintenance yourselves, it’s a good time to reach out and make sure you’re communicating with your factory representatives or dealer network to make sure you know what those changes will be so you can prepare yourselves as a fleet,” Arrigoni said. “When things come back, things will be a little bit different.” The second regulation Arrigoni cited is the second phase of the EPA’s greenhouse gas emissions and fuel efficiency standards for medium- and heavy-duty vehicles. This program would significantly reduce carbon emissions and improve the fuel efficiency of heavy-duty vehicles. On the heels of Phase 1, Phase 2 would benefit business and consumers, per the EEPA, by saving the industry billions of dollars in fuel and reducing the costs for transporting goods, while reducing GHG emissions by 1 billion metric tons. Under these proposed standard, the federal government expects the fuel consumption of tractor trailers alone could drop as much as 24 percent. The implementation of the first phase of Greenhouse Gas will begin in 2021. This “credit system” where OEMs must sell a certain number of energy-efficient vehicles within its product mix. For Kenworth, Arrigoni said the company sells so many aerodynamic vehicles that operate on highway, it doesn’t affect its credits when it sells mining trucks, dump trucks, cement mixers, etc. Arrigoni believes just about every OEM has done a good job of balancing these credits across their product lines, which means vocational users should not be affected by the first phase of the Greenhouse Gas program. However, as of 2021, Arrigoni said the rule will expand to include reductions in carbon

dioxide emissions in grams per ton that are emitted by all trucks in general. This means more aspects of vehicles will be inspected clolsely. Factors like idle time, slow-rolling resistance and speed limits are in play today. In 2021, transmissions, rear axles and other components will be included, which will get involved with how users spec their equipment. It may sound like a daunting task, but Arrigoni believes this regulation will be a good thing for OEMs and vocational users of heavy-duty vehicles alike. “I think that shouldn’t be too big of a concern to you because, ultimately, what it’s going to do is drive our dealer body and the people interfacing with you and fleet managers to be more educated and to spec a product that is going to be lower total cost of ownership for you, and something that is fuel efficient and, ultimately, save you money,” Arrigoni said. Parts suppliers aren’t immune to regulations from the federal government, either. According to Karl Graham, Applications Engineer for Bendix Commercial Vehicle Systems, the next regulation companies like Bendix will encounter will be for electronic stability program systems. These regulations will be for 6-by-4 tractors only, and these will go into effect in August 2017. By August 2019, Graham said, 6-by-2 and 4-by-2 tractors will be required to have ESP systems, as well. “The full trucks will not be affected by the ESP mandates, although it would be very wise to get the ESP system on your vehicle and get it functioning,” Graham said.

The Water-Tek technology has saved millions of dollars for Bakken operators in 2015 and conserved over 2 million barrels of fresh water. Incredible cost saving especially important in the current price environment.

Finding innovative ways to reduce the need for fresh water during maintenance activities is critical for long term success of any basin. GGP used their technical expertise to find a solution to a problem that operators face. The statistics on their success should be applied in multiple areas.

Hess has taken a business approach to CSR. While the approach may require a bit more documentation compared to other programs, it clearly identified key needs in the communities in which the company is active. The company has followed through with significant financial support for more than 18 community programs.

A intriguing proposition to reduce the logistical challenges this industry faces every day.

Provides unique alternatives to traditional frac sand requirements. I was particularly interested in some of their larger projects, fascinating!

IPT offer their expertise to small and mid range operators, bringing with them a wealth of experience and expertise to maximize the small efficiency gains. Small efficiency gains add up to real cost savings over time. IPT provide a complete service from permitting to production for their clients.

IPT are focussed on maximizing efficiencies for their clients across both vertical and horizontal wells on the USA. Their consultative approach and wealth of services met the criteria for this category.

They met the criteria with accuracy and have shown dedication to the region over others in this category.

Wide variety of services for heavy and bulk haulage. A good team makes for the back bone of the company’s success.

The Zero spill system is designed with rig safety in mind and is well known for its impact on minimizing repetitive accidents and incidents. The solution also minimizes release of production and drilling fluids escaping into the local environment.

Reduces costs, increases rig personnel safety and prevents environmental damage.

LOS is bucking the trend! A refreshing and honest submission that really focuses on LOS’s achievements in the last year, which are great in number. 54% more fracs in 2015 than 2014 and a real commitment to staff stood out.

Chris and the gang are a class act. They are focused on the people (no lay offs, better work schedule), the community (scholarships), technology, and great advocating for our industry.

A host of complex project work detailed and significant growth but I was most impressed with the Loenbro Employee Assistance Fund. A wonderful fund to benefit staff in times of hardship.

In such a short space of time, Loenbro have exploded onto the scene and grown into a fully fledged multi-service company that is clearly thriving.

The Omni-Cert solution is a convenient and intuitive system that enables the easy implementation of compliance strategies.

Auditing is such an important element to effective and efficient compliance. Systems such as the OmniCert solution provide rapid access to the information employees and regulators alike require. The tiered permission system is also worth noting that restricts access to different levels of employee.

One of the largest MLPs with a record to be proud of. They have fantastic policies to ensure that they mitigate risks to their workers and to the environment.

Fantastically placed across the USA and is one of the leaders in the region.

I can see that the introduction of technology such as this can really benefit the industry. To automate the survey process and to increase visibility in real time as events occur is invaluable.

The implementations of this suite of Pixel Velocity’s products have real benefits to the safety of staff on site and infrastructure. Without requiring human presence at site or monitoring from a far offers real value and assistance.
