Tips for Hiring a Contactor M

ost homeowners will experience at some time the need to hire a contractor. This could be an unplanned event, such as needing to hire a contractor quickly to make repairs after damage is done by a broken pipe or fallen tree. Or this could be the culmination of a years’ long dream to transform your dated kitchen into a gourmet cook’s dream, or to enlarge your cramped bedroom into a luxurious master suite. Whatever the situation may be, hiring a contractor to make repairs or improvements to your home is not a decision to take lightly. Below are some tips and suggestions to help you make good decisions when hiring a contractor. 1. Is the contractor licensed, bonded, and insured? You can verify this by calling the State of Washington’s Department of Labor and Industries at 1-800-647-0982 or visit the L&I website at www.lni.wa.gov. Ask if there have been any complaints about the contractor, and if any, the status. 2. Is the contractor a member of Olympia Master Builders? The Olympia Master Builders (OMB) is a professional trade association representing member companies. OMB helps educate members on new products, construction techniques, business practices, and industry issues. 3. Don’t be afraid to ask questions. Good communications with your contractor is vital to a successful project as it helps clarify exactly what you want done. Get the answers that satisfy your needs; after all it is your home! • Are they a local company? • How long have they been in business? • What types of work are they licensed to do? • To what local trade associations do they belong? • How many jobs have they done similar to yours? • Have they done work before that requires a permit? • Who are their materials supplier references? 4. Does the contractor possess a good reputation among customers and industry peers? Ask the contractor to share names and numbers of customers. Check references thoroughly. Visit past work done by your contractor and ask the homeowners for their opinions on the work done. 5. Examine your bids carefully. Bids that are noticeably lower than all others should be questioned. The difference may be in the quality of the materials used, experience of the crew doing the actual work, something is missing on the bid requirements, or it can be an indication that the contractor is not covering all the legitimate business costs. Don’t automatically disregard a high or low bid, ask questions!

6. Obtain a written contract. Be sure that it includes price, payment terms, sales tax, permit fees (if applicable), the specific work to be performed, materials to be used, warranties, and payment schedules. It is also a good idea to include change-order processes, final review, sign-off procedures, and cleanup. Put all change-orders in writing and ask questions as work progresses. Avoid verbal contracts, and be very cautious about paying for incomplete work. 7. Permits are for your protection! Make sure permits are in place and inspections are made as the work progresses. Make sure the name of your contractor appears on the permit. 8. Does the contractor offer a warranty? If so, what kind, and for how long? Be sure you understand what is covered under the warranty and what isn’t. y first adventure in home buying concerns a piano. As I first toured the house I really wanted with the realtor, I saw a piano in the basement. The realtor asked if I played. “Maybe a little,” I answered. The realtor said I could have the piano. The sellers didn’t want it. After closing and as I was moving in, I noticed the piano was gone. Of course we hadn’t written it into the purchase and sale agreement. Which brings up the first rule in home buying: Tip #1: Put it in Writing All real estate sales must be in writing and signed by the seller and buyer. If not, the transaction is unenforceable per the oddly named statute of frauds, which more aptly would be called the statute to prevent frauds. Tip #2: How Much House Can You Afford? Your lender will provide you with a Good Faith Estimate that will give you the information you need in order to compare loan products from different lenders and to be assured that the loan you receive is the best fit for you. Tip #4: Inspections and Deadlines and The Dreaded Waiver Even after you receive the disclosures, have the home inspected by a professional. And accompany the inspector on the inspection. Your purchase and sale agreement has deadlines for inspections and for curing problems uncovered. Honor the deadlines or suffer the consequences—the dreaded waiver, defined as voluntary relinquishment of a known right. In other words if you have a right to inspect the house by a certain date, and you miss the deadline, you may lose the right—you have voluntarily relinquished a known right. Tip #5: Closing and the Mysterious HUD Closing is when you sign your life away. The HUD is the mysterious accounting form that shows money in and money out. Have the closing agent explain each line and calculation. If the closing agent can’t explain the mystery, you might get some money back. Tip #6: HOA, CCRs, and 240 You’re in your new house. Welcome to the neighborhood and the homeowners association. Might turn out to be Paradise Acres or Frankenstein Estates. Time to read the CCRs, also known as Covenants, Conditions, and Restrictions. For example, maybe the kids want chickens, but the CCRs prohibit poultry. Or you build a fence, take some trees down, or paint your house without first notifying the architectural control committee. These items are frequently governed by the CCRs. If you don’t read the CCRs and abide by them, you could be sued by your neighbors or the HOA. And you could end up paying the filing fee in Superior Court: $240. Tip #7: Maintain and Mitigate Look for signs of water damage, cracks, stains, and other indications that your home is not weathering so well. Many problems if fixed promptly can be inexpensive and add many years to your house. If you want the seller to

fix the problem, then you also have a duty to mitigate damages—meaning if you know or should have known of a problem and failed to mitigate, failed to stop the problem from growing worse, you may be limited in any damages you hope to collect from the seller. Tip #8: Warranties Express and Implied Your house is full of warranties, from the toaster and microwave to your deed. Your builder may have provided certain warranties, and your major appliances likely carry warranties. The law also provides implied warranties, especially on new home construction, called the implied warranty of habitability. This warranty runs only from the original builder to the original purchaser and covers only habitability issues—plumbing, heat, weather tight, etc. The warranty doesn’t cover sidewalks, landscaping, nicks and scratches, and the like. Tip #9: Liens and Contractors If you don’t pay the contractor, the contractor may lien your home. If the contractor doesn’t pay the supplier, the supplier may lien your home. L&I requires contractors to provide you with a pre-claim notice, prior to any lien. The notice explains how to avoid liens. http://apps.leg.wa.gov/RCW/default. aspx?cite=60.04.031 And for gosh sake, make sure your contractor is licensed and bonded. You can check on your contractor through L&I’s website: https://fortress.wa.gov/ lni/bbip/Search.aspx Tip #10: Contracts and Lawyers Don’t sign it if you don’t understand it. Most lawyers will charge a very modest fee to review a contract, purchase and sale agreement, and related documents. It’s generally worth it.

The Economic Impact of Home Building in Washington State by Laura Worf, Executive Officer Olympia Master Builders

hen residential construction occurs, it generates substantial economic activity in the state where it takes place. The economic activity generated includes income and jobs for state residents, as well as revenue for state and local governments. It also typically imposes costs on state and local governments—such as the costs of providing primary and secondary education, police and fire protection, and water and sewer service. Not only do these services require annual expenditures for items such as teacher salaries, they typically also require capital investment in buildings, other structures, and equipment that state and local governments within the state own and maintain. The National Association of Home Builders (NAHB) has developed a model that captures the effect of the construction activity itself, the ripple impact that occurs when income earned from construction activity is spent and recycled in the state. The model also estimates the ongoing impact that results from the homes becoming occupied by residents who pay taxes and buy goods and services produced in the state. NAHB recently compiled information based on the 13,825 single-family homes built in Washington in 2011. The estimated one-year economic impact of building these homes include: • $3.1 billion in income for Washington residents, • $728.8 million in taxes and other revenue for the state and local governments in this state, and • 41,018 jobs in Washington.

The additional, annually recurring impact of building these homes includes: • $448.6 million in income for Washington residents, • $198.5 million in taxes and other revenue for the state and local governments in the state, and • 7,231 jobs in Washington. These are the ongoing, annual local impact that results from the new homes being occupied and the occupants paying taxes and otherwise participating in the state economy year after year. The ongoing impacts also include the effect of increased property taxes, assuming that raw land would be taxed at the same rate as the completed housing unit. These homes resulted in an estimated $728.8 million in tax and other revenue for the state government as well as local governments in the state, $96.4 million in current expenditures by the state and local governments to provide public services to the net new households at current levels, and $176.4 million in capital investment for new structures and equipment undertaken by the state and local governments. The analysis assumes that state and local governments finance the capital investment by borrowing at the current rate of 4.62 percent on tax-exempt bonds. In a typical year after the first, the single-family homes result in $198.5 million in tax and other revenue for the state and local governments, and

$192.8 million in state and local government expenditures needed to continue providing services at current levels. The difference between government revenue and current expenditures is defined as an “operating surplus.” In this case, the first-year operating surplus is large enough so that all debt incurred by investing in structures and equipment at the beginning of the first year can be serviced and paid off by the end of the first year. After that, the operating surpluses will be available to finance other projects or reduce taxes. After 15 years, the homes will generate a cumulative $3,606.8 million in revenue compared to $2,983.9 million in costs, including annual current expenses, capital investment, and interest on debt. NAHB’s analysis of the economic impact of the single-family homes built in Washington State reaffirms the role the home building industry plays in generating jobs and tax revenue in this state.

Don’t Ignore These Home Maintenance Chores Exterior Tasks

hile the prospect of relaxing into a lazy Sunday schedule calls to many home owners, don’t sleep on essential home maintenance tasks. There are plenty of maintenance chores to take care of when you own a home. Here’s a checklist of items you should address on an annual basis.

1. Maintain your gutters. Remove all debris from your gutters so water can properly drain. This minimizes standing water and slows the freeze/thaw expansion process that occurs in cold weather. Clogged gutters can cause landscaping, lawn and shrubbery, walls, foundation, basement, crawl spaces, and existing gutter system damage. Consider installing “gutter guards,” which will prevent debris from entering the gutter and direct the flow of water away from the house and into the ground.

2. Trim your trees and remove dead branches. Inclement weather can cause weak trees or branches to break and damage your home, car, utility lines or someone walking on your property. Keep an eye out for large dead branches in trees; detached branches hanging in trees; cavities or rotten wood along trunks or major branches; mushrooms at the base of trees; cracks or splits in trunks; leaves that prematurely develop unusual color or size; and trees that were previously topped or heavily pruned. If you see any signs of hazards, call a professional tree service. 3. Maintain your steps and handrails. Repair broken stairs and banisters to prevent falls and injury. 4. Inspect your roof. Be proactive and prevent emergency and expensive repairs. Things to look for include damaged or loose

5. Inspect your home’s exterior walls. Look for possible weather-related damage, like cracks and loose or crumbling mortar. Wood trim and siding can suffer from deteriorating paint or become loose. Windowsills may be cracked, split or decayed.

Indoor Chores 1. Check your home’s insulation. Your attic should be 5 to 10 degrees warmer than the outside air. Otherwise too much heat escapes and causes frozen water to melt and refreeze which can result in a collapsed roof. Don’t neglect your basement and crawl spaces, and well insulate pipes in those spaces to protect against freezing. 2. Maintain your pipes. Wrap your pipes with heating tape every winter and insulate unfinished rooms

such as garages, if they contain exposed pipes. Check pipes for cracks and leaks and have any damage repaired immediately to prevent costlier repairs later. Keep your house warm — at least 65 degrees. 3. Check your heating systems. Be sure to maintain your furnace, fireplace, boiler, water heater, space heater and wood-burning stove. Have your heating system serviced every year. Check smoke and fire alarms and carbon monoxide detectors. Change your heating and air conditioning filters regularly. 4. Know your plumbing. Learn the location of your pipes and how to shut the water off. If your pipes freeze, the quicker you shut off the water, the better chance you have of preventing pipe bursts. Check weather stripping and caulking around windows and doors and replace or repair as needed. Caulking helps keep your house weather-tight, lowers your heating and cooling bills, and can also help keep insects and rodents out of your house. Also look for chipped or peeling paint around window frames and trim. Repair broken glass and loose or missing putty.

When needed, use a modern glazing compound instead of putty for a waterproof seal. 5. Clean and vacuum dust from vents, baseboard heaters and cold-air returns. Dust build-up in ducts is a major cause of indoor pollutants and can increase incidences of cold-weather illnesses. Check all your faucets for leaks and repair any you find. Replace washers if necessary. By setting aside a few weekend days, you’ll save yourself from a lot of hassle later.
