New government must back retentions reform The attitude of one major housebuilder has highlighted the serious state of the construction industry’s rotten payment culture. When the executive chairman of a major housebuilder describes the idea of retentions as “ridiculous”, you might think he was heralding a newly enlightened strategy for subcontractor payment conditions, but you would be wrong. No. It was the idea of customers being able to hold retentions against his company that he found ridiculous. According to Redrow’s John Tutte “stuff happens” like scratched doors and loose banisters and it would be crazy to let customers withhold payment while waiting for such defects to be rectified. Yet, Redrow holds a 24-month retention against its own sub-contractors - dated from the time the final home in a development is delivered. Is this not the ultimate hypocrisy? Why, having completed their work as instructed, should Redrow’s sub-contractors have to wait 24 months and sometimes longer to

receive 100% of their due payment? Is that not “ridiculous”? It is one rule for the big builder and another one for the SME. Our iniquitous retention culture forces smaller firms to act as lenders to larger ones by, effectively, bankrolling their projects and inflating their profits.

Backing retentions reform in the new parliament would be an ideal way for the new government – of whatever colour and persuasion to emerge from the current chaos – to demonstrate its business credentials.

The ‘Aldous Bill’, which has now been scrapped due to the new Parliament session, called for a simple, but key reform to see retentions held in a statutory deposit scheme rather than being stashed away in a client or main contractor’s bank account. A similar scheme is already used in Australia and means big builders no longer have the option to use their supply chain’s cash to bolster their own finances.

It would demonstrate that it is prepared to stand up for the interests of small and medium-sized businesses and that it is willing to put them at the forefront of plans for an industrial strategy and the expansion of our economy after Brexit.

Withholding money strangles contractors’ cash flow and pushes them towards bankruptcy. This in turn puts jobs at risk and undermines investment in the people, skills and technologies needed to improve the sector’s performance and productivity.

BESA Conference gets ready to take on the big issues This year’s BESA National Conference will take place at the Millennium Gloucester Hotel, London on 21 November. Taking its overall theme as ‘Competence, compliance and the climate challenge – turning theory into practice’, the Conference will consider how the building engineering industry can meet many of the technical challenges it is now facing. These include turning the government’s pledge to achieve net zero carbon emissions by 2050 into practical actions; delivering the building safety solutions highlighted by the Hackitt Review; complying with ever tightening refrigerant legislation; and achieving higher standards in pipework, ventilation and off-site manufacturing.

Fire experts to speak out A range of experts have agreed to share their insights into the future of fire safety in buildings at this year’s BESA National Conference. Chaired by BESA chief executive David Frise, this high profile panel discussion will feature representatives from the Smoke Control Association; the Association of Specialist Fire Protection; local authority building control and building inspection. The panel will consider how the industry can implement the recommendations of the Hackitt Review to make buildings safer in the wake of the Grenfell Tower disaster. The discussion will go beyond the national debate about cladding to look in detail at broader elements of fire safety, such as the crucial role of damper maintenance and ventilation hygiene and consider how the industry can help landlords and tenants implement comprehensive fire safety strategies.

There is a natural synergy between that topic and the growing role of off-site fabrication and other modern methods of project delivery. Demo time for vent hygiene scheme A new scheme to help ventilation hygiene specialists support the industry-wide campaign to improve safety in buildings will be demonstrated during the conference.

Two key parliamentary committees – Climate Change and Science and Technical - have identified the decarbonisation of heat as the country’s single biggest challenge in the transition to net zero carbon emissions and have urged wider adoption of heat networks. Heating specialists have pointed out that the performance of the HIUs connected to the heat networks is critical to their overall efficiency and effectiveness, but historically this issue was largely ignored. BESA has, therefore, developed a new UK Test Standard and delegates at the conference will receive the latest updates on the test methodology, which is now being rapidly adopted by HIU manufacturers and heat network developers.

More leadership, less politics When you read through the pages of this publication I am sure, like me, you will be struck by the amount of activity and innovation they describe. The Association and its members are busy coming up with ideas and improvements that can help deliver a higher quality built environment for everyone in our society. The trouble is that many of our best efforts are being thwarted – and have been for the past three years. Whatever the outcome of the Brexit process and the inevitable General Election, we now need people to come together to start delivering the vital projects and solutions the country needs. It is high time we had some strong political leadership and less ‘politicking’ because all of the doubt and delay has caused real harm to the economy and to countless SMEs up and down the country. As I said during my speech to the annual BESA President’s lunch, there is so much to do, but we are not being allowed to do it. Parliament is now back sitting again, but the truth is that it has been paralysed by Brexit for three years and, as a result, we have lost crucial time on: critical infrastructure projects; nuclear power stations; housing; schools; the NHS… and many more. We are still not getting on with the projects that can improve living and working conditions, deliver social justice and move the country towards a low carbon future – and our terrible payment culture is adding to the problems because many specialist

contractors are being pushed towards catastrophe – often through no fault of their own.

building regulation in line with the recommendations of the Hackitt Review. This would lead to welcome scrutiny of technical skills and compliance across construction professions and deserves to be supported by increased government investment in training. Improving safety and competence is something every politician should be comfortable in supporting. Whether you are the party that claims to support small businesses and the working class or champions free market economics, having a better quality built environment that improves living and working conditions for all is something you can support.

SKILLcard renewals now available online Holders of Engineering Services SKILLcards are now able to renew their cards online following another upgrade of the online application system. The new system initially went live for new applications but is now open for renewals too. More than 60,000 people working in the heating, ventilating, air conditioning and refrigeration sectors hold the Engineering Services SKILLcard. It provides evidence that they have the required training and qualifications for the type of work they carry out on construction sites.

BESA took the SKILLcard process online following a survey of the sector, which showed that more than 75% of card holders would prefer to apply and renew online.

BESA launches health & wellbeing group A surge in awareness around the impact of buildings on human health, welfare and productivity has prompted BESA to launch a new special interest group. The well-being of people is by far the biggest economic factor in the life of a building, but the World Health Organisation (WHO) has highlighted serious health threats to occupants caused by the amount of pollution in the air used to supply building ventilation systems. As a result, it has called for much more effective ventilation and air purification designs. As well as the obvious economic argument, there is also a strong social and moral element to this: Poor housing costs the NHS more than £2bn a year in treating people suffering from a wide range of illnesses linked directly to living in cold and damp homes.

Grease is the word Despite intense publicity surrounding fire safety in buildings, one of the areas of highest risk has struggled for attention. That should all change thanks to a new BESA specification, according to Gary Nicholls*.

Guidance on selecting appropriate cleaning intervals are laid out in the useful tables in TR19® Grease. It explains the importance of monitoring pre-cleaning grease thickness levels and regularly reviewing the frequencies of cleaning to ensure that grease levels do not exceed 200 microns as a mean average.

BESA members continue to come across a large number of grease extract systems in commercial kitchens that have, quite obviously, never been cleaned properly. These represent a considerable fire risk – not only to the building in question – but also to its neighbours.

The existence of TR19® Grease should serve to concentrate the minds of building owners and managers – and the hope is that having a shorter document will give greater prominence to the consequences of non-compliance.

Therefore, BESA’s Ventilation Hygiene branch decided to address the problem by producing a standalone guidance document for kitchen extract systems – the newly issued TR19® Grease.

TR19® Grease was created by lifting Section 7 from the second edition of TR/19 – the ventilation hygiene industry’s primary guidance document for more than 20 years – and raising its status to a specification document in its own right. This emphasises that the cleaning and compliance of the kitchen extract system, including the canopy and ductwork, is a building services and property maintenance issue, which will typically require the services of a specialist cleaning provider.

Insurers will now expect the property manager to have complied with the law, which includes adherence to the Regulatory Reform (Fire Safety) Order 2005. Article 11 of this highlights the importance of control measures, for which the TR19® Grease specification now gives a framework. If you do not follow industry best practice and comply with legal requirements, in the event of a fire, your insurers may refuse to pay out on any resultant claim. The RRO also requires an organisation to appoint a ‘responsible person’. If fire occurs in a kitchen extract system that was not compliant with TR19® Grease, there can also be legal consequences for that person. These can include prosecution and, if convicted, a custodial sentence, especially if the fire has caused a fatality. Therefore, by following this new BESA specification and using VHE scheme registered providers end users are giving themselves vital legal protection. *Gary Nicholls is managing director of Swiftclean and a former chair of the BESA Ventilation Hygiene branch.

TR19® Grease also calls for cleaning providers to be registered with the BESCA Ventilation Hygiene Elite (VHE) scheme (see page 9) to ensure they have the right competences and to create a more robust audit trail for the end client. This will incur a minimal fee, which is a small price to pay for peace of mind and valuable evidence of compliance.

Limiting the effects of

Overheating in Building Services Applications

Rising temperatures have highlighted issues with buildings overheating, and the contribution of building services to unwanted heat gains is coming under scrutiny. Recent research from AECOM has suggested that the use of an enhanced specification of pipe insulation and insulated pipe supports on hot water and heating pipework can help reduce overheating in some buildings. BESA backs climate ‘declarations’ BESA has put its weight behind historic industry-led declarations committed to tackling the “crises of climate breakdown and biodiversity loss”. Several large construction consultants and structural engineers, including Aecom, Arup, Atkins, BuroHappold, Mott MacDonald and WSP, have signed declarations titled UK Building Services Declare, UK Structural Engineers Declare and UK Civil Engineers Declare, and have committed to 11 points of action. Some of these commitments include providing structural engineering design that achieves the standard of net zero carbon; raising awareness of the issue among clients and supply chains; accelerating the shift to low embodied carbon materials; evaluating new projects with mitigating climate change as a key consideration and upgrading existing buildings as an alternative to demolition and rebuild. BESA has urged its members to add their names as signatories. “These declarations are both momentous and timely.

Following the recent net-zero commitment by the government, it is very encouraging to see such ambitious commitments being driven by the industry itself. “However, the challenge with anything like this is to translate it into meaningful action. So far, much of the debate has been led by the design professions, but it is crucial that those actually responsible for delivering practical solutions are included and able to take the lead. “Contractors are ready and willing to play their part and we will be encouraging all BESA members to sign up to the declaration and embed these principles in their daily working practices.” To find out more and sign up to the declaration visit: www.buildingservicesengineersdeclare.com

Refcom Elite for Suppliers The industry’s main F Gas register Refcom has expanded its Elite scheme to make it more accessible for those on the supply side of the industry: manufacturers, distributors and wholesalers. Head of Refcom, Graeme Fox, says this will play an important role in preventing illegal sales of gas and equipment, which is currently undermining the whole regulatory framework. “By taking this stand on a voluntary basis, the enforcing bodies – the Environment Agency, Scottish Environmental Protection Agency, Natural Resources Wales and Northern Ireland Environment Agency – will have their resources freed up to concentrate on the non-signed up sector, including the online sellers,” says Mr Fox.

“We all need to work together to make this enforcement work, and any breaches of the regulations should be brought to our attention with as much evidence as possible.” He points out that, while enforcement continues to be a problem, the industry has come a very long way in the past 10 years and should be proud of the improvements that have been made to levels of professionalism. “We are ensuring that everyone has at least some formal training behind them – not enough but it’s a start – and starting to put to an end the deliberate venting of environmentally damaging refrigerants that was all too common in the past,” he says. “We have made huge strides, but we still have work to do.” Refcom and BESA Technical helplines are there for members concerned with issues like this to access advice and guidance. Introducing our new board members Claire Curran | LINAKER LIMITED Claire Curran, Managing Director of Linaker Limited, joins the BESA Board as a progressive and passionate professional with over 25 years in the building services industry in a multitude of roles with big names like GSH, ISS, Kier, Wates and now Linaker under her belt. In addition to her experience, she has a business and marketing degree, financial qualifications and an MBA, topped up with ‘hanging around plant rooms for far too long’.

challenge, he then decided to start his own Rochesterbased HVAC business, Norton Technical Maintenance, in 2005. His business has grown from humble origins and to become the successful group of businesses they are today, employing 28 staff with a £5 million turnover. Having grown a business from the ground up, Damien has at one time or another undertake every role imaginable from accounting, project/contract negotiations, HR, project management, client liaisons, networking, creating and implementing the business policies, procedures and strategies along the way. He is a long-term member of Institute of Directors and the Institute of Leadership and Management.

Damien joined the industry as an apprentice gas operative in 2000. After completing his apprenticeship, he worked at the same company until it was sold in 2004. Seeking a new

Young engineers embrace social responsibility The new chair of BESA’s Future Leaders group believes one of the most exciting things about being a building engineering professional is the opportunity to improve people’s living and working conditions. Reinaldo Melendez is highly motivated to bring engineering designs to life so that they make an impact on society. “I like to see how my work shapes the places where people live, work and play,” he says. Reinaldo was a founding member of the Future Leaders and represents the group on the main BESA Council. He has now stepped up from vice-chair to succeed Reanna Taylor as chair and wants to build on her achievements, particularly in the areas of mental health and the wider adoption of digital technologies – two key project areas for the group. Digital technologies also play a major role in Reinaldo’s ‘day job’ with Imtech Engineering Services, who he joined after moving to the UK from his home in Venezuela. He achieved a first-class degree in Mechanical Engineering from Universidad Central de Venezuela in 2014 and thought a great way to develop his passion for engineering further would be to experience a different continent. He was able to fund his own place at London South Bank University where he completed an MSc in Engineering Management while also holding down a full time job at Imtech. His belief in the social role of building services engineers was put into practice in his work with the charity CRASH where he was part of the team that delivered the refurbishment of a homeless shelter.

Reinaldo was also selected by BESA to attend the Primeast Leadership course, to develop his individual leadership style and capability. He believes this has been a major contributory factor in his success at Imtech. His first role at the company as a trainee was delivering the commissioning of the £8m Chelsea Creek Project, which included an energy centre and 140 luxury apartments. He is now working on Imtech’s largest London project The Madison; a 53-storey residential tower with 423 apartments. The project makes use of BIM 360 and Reinaldo is the quality controls engineer running the digital platform. This is a new position for the company and involves developing and implementing the digital strategy, liaising with the production manager and supply chain. His employer describes him as “a great role model” adding that it is only through “young, passionate and dynamic individuals like him that we will be able to develop and safeguard the future of our industry”. Reinaldo is passionate about embracing emerging technologies and collaborating with peers across the industry. He is determined to use his time as Future Leaders’ chair to improve cross-sector collaboration and share lessons, knowledge and best practice with other young engineers – both those working for BESA members and beyond. BESA mourns Brian Townsend Brian Townsend, who died in September, was one of the Association’s most popular and respected former presidents. He was only the eighth person to be awarded BESA’s Distinguished Service Award for individuals “who have rendered extra-special service to the Association and its activities”. Brian was president during the centenary year of what was then the HVCA in 2004. Having first been elected to Council in 1992 where he continued to serve until 2015. He was chair of the Membership Committee and of the North West Region. Brian also

served on the Finance, Audit and Staff standing committees and was director of the training provider Building Engineering Services Training (BEST). He founded the commissioning specialist contractor End Systems in 1976 and the company continues to grow and thrive today under the directorship of his daughter Kay. Brian was also chair of the Commissioning Specialists Association (CSA). “Brian was a champion of the industry and a true gentleman who will be sorely missed,” said current BESA President John Norfolk. “Our thoughts and sincere condolences go out to his family at this very sad and difficult time.”

What we learnt from the 2019 Political Conference Season

BESA was pleased to represent members for another year at the two main political party conferences in Brighton and Manchester.

Likewise, the un-prorogued Parliament voted against holding a recess while the Conservative Conference was on which made it harder to engage with some Government MPs and Ministers as parliamentary business continued.

The political landscape has radically altered and the fortunes of both parties appear to have reversed since 2018. We saw high drama and big pledges as the Government and Opposition prepared for the final showdown over Brexit and drew up the battle lines for an imminent General Election.

Unfortunately, thanks to Brexit tunnel vision, there has been little progress on our issues. That being said, the fringe events at both Conferences demonstrated significant political interest in issues relevant to the construction industry and improving the built environment – giving reason to hope some positive outcomes can be achieved when (and if ) this present period of madness settles down. On retentions and late payment, the proroguing of Parliament means the Aldous Bill has lapsed. Peter Aldous has kindly offered to try to reintroduce the Bill in the new session and we will know the outcome of the ballot to see which MPs get a priority slot for private members’ business by the time this magazine is in print.

The consensus from everyone attending was that the 2019 Labour and Conservative Conferences were both unusual compared to past years. But in these extraordinary times, who would be surprised by that? Far fewer Labour MPs attended Conference compared to the past, highlighting the widening divisions between large parts of the parliamentary party and the party’s more radical activist base. The Labour conference was interrupted midway by the Supreme Court’s decision to overturn the prorogation of the Parliament, which saw a sudden mass exodus of politicians, staffers and journalists on the trains back to Westminster as Parliament was recalled.

This current legislative session may be one of the shortest in history so BESA is already developing a list of policy priorities for our sector that we will be asking the major parties to adopt in their forthcoming election manifestos.

BESA REPRESENTATION

Labour Conference At Brighton BESA attended many fringe events that provided good opportunities to raise our sector’s concerns with MPs and relevant stakeholders. Some highlights include:

• Sought stronger Labour election commitment on retentions with the Shadow BEIS team and have follow-up meetings arranged with Shadow Small Business Minister, Bill Esterson MP. • Raised our national fire safety campaign at the Fire Brigades Union’s ‘Grenfell Never Again’ event. • Used a Chartered Institute of Building event on mental health in construction, to secure cross-promotion opportunities for the BESA & ECA-run Payment & Mental Health in Construction Survey and to contribute to CIOB industry mental health research. • Had discussion with Anna McMorrin MP on F-Gas issues and the environment. She expressed an interest to do a private members bill, which BESA will continue a dialogue on. • Attended several events to hear from Shadow Secretary of State for Labour, Laura Pidcock MP, Unite the Union, and the Institute of Employment Rights – the think tank that has helped design their industrial relations policies, to learn more information about how these proposals might impact BESA members. Conservatives Conference In Manchester, BESA attended many fringe events, many of which had an encouraging focus on SMEs. BESA and SEC Group teamed up to get in the ears of as many stakeholders as possible. Some highlights include:

• BESA had hoped to question Small Business Minister, Kelly Tolhurst MP at a Center for Policy Studies fringe event entitled ‘Are the Conservatives doing enough for small business?’ about what further plans the Government had planned to help construction SMEs about retentions. Unfortunately, the Minister could not attend due to Westminster business but was able to raise it with Conservative Peer, Baroness NevilleRolfe who undertook to raise it with the Minister. Informally the panellist from the Federation of Small Businesses told said he had been told by the Minister the Government may soon announce some more positive initiatives in this space – so BESA is seeking clarification on what that might be. • BESA and SEC Group managed to corner Construction Minister Nadhim Zahawi MP in a hallway. Whether he wanted to hear it or not – we made sure he heard that we need his help on retentions! • In the QandA at the ConservativeHome Business Conversation event, the new BEIS Secretary of State, Rt. Hon. Andrea Leadsom MP, was asked what more the Government would be doing on late payment. She responded positively and said resolving the problem of late payment for SMEs would be a top priority and noted her earlier involvement in advocating for the Prompt Payment Code. While this is a promising sign, she did not elaborate on what form these proposals for change might take. BESA going forward will continue engaging with these BEIS ministers with the aim of nudging them to adopt the Aldous Bill as Government policy. IN CONCLUSION With the 2019 Conferences of the two main parties over, we learnt that both sides are showing positive interest in many of the issues important to our sector, particularly around reforming late payment to SMEs, fire safety, improving the built environment and achieving net zero carbon emissions. The problem still lies in the lack of political bandwidth available to deal with issues as the daily dramas of Brexit and pre-election war-gaming take precedent. Going forward, BESA will continue engaging with both sides of politics to keep our issues on the agenda and is developing our priorities in preparation for the expected, forthcoming election.

UK CONSTRUCTION WEEK

Mental health in the industry was also a major focal point at the show, making UK Construction Week the largest event in the sector to address these issues. UK Construction Week worked alongside Public Health England to launch Every Mind Matters to the construction industry. UK Construction Week took innovation to a new level this year with its partnership with the Construction Innovation Hub (the Hub) and the new innovation zone. On a practical front there were a record number of product launches, showcases and demos providing something for all construction professionals regardless of trade. This was also the inaugural year for the colaunch of the very successful Concrete Expo.

The future of construction gets scrutinised at UK Construction Week 2019

Now in its second year, the UK Construction Week Role Model of the year award went to Anjali Pindoria, project surveyor at Avi Contracts. She is a passionate advocate for diversity and inclusion within construction.

An eclectic, forward thinking crowd of 34,327 construction professionals attended UK Construction Week on 8-10 October. There was a swell in visitors keen to learn about future technologies and how they could be applied to their businesses. The future of construction and how it is driving change was a major focus at this year’s event and it was clearly a driver to bring the crowds to the show at the NEC in Birmingham. Brendan Hourican, national sales and marketing manager at CircofloPro said: “It was an incredible show. I came away with at least 60-70 excellent business leads. One project alone will pay for the cost of attending the show. It’s been so successful, if I’d known I’d have gone for a larger stand and brought more of our team along.” Among the 300 speakers and 150 hours of content, major highlights last week included the first industry appearance for the Construction Minister, Nadhim Zahawi MP, and keynote speeches and debates featuring Lord Digby Jones, architect George Clarke, modern methods of construction (MMC) advocate Mark Farmer and diversity champion Angela Dapper, principal at Grimshaw Architects.

Summarising a very successful show, Nathan Garnett, event director said: “This year’s UK Construction Week for me was brimming with positivity. In a time of political and economic uncertainty, the UK’s largest showcase for the sector showed signs of transformation, as it adopts innovation at a faster pace than ever. The feeling all around was that we have a lot of work to do, come what may, so let’s get on with doing it in the safest, fastest and most efficient way possible by harnessing the potential of new technologies. “UK Construction Week 2019 also tackled mental health in the sector head on with the support of the Every Mind Matters campaign, as we continue the role of improving mental health in construction for good. The online service provided by Sevron, is a new provision, which will help members to reduce risk in the workplace. It will enable businesses of all sizes and sectors to create and manage Risk and COSHH assessments, acquire and manage Safety Data Sheets, and capture, record, and report workplace incidents in real-time.

• All welding fumes (including mild steel) are now classed as carcinogens. Metalworking fluids can cause occupational asthma, occupational hypersensitivity pneumonitis and dermatitis. • HSE will be inspecting engineering premises in January to March 2020. The main focus will be on welding fume and metalworking fluids. • The BESA health and safety team are currently working closely with the HSE and other Engineering Associations to raise awareness of the risk from weld fume.

Our recent poll indicates that members are prepared for the change but they are not confident their supply chain is ready. We recommend members use the template letters and checklists available on the website to engage with their supply chain in order to prepare for the next year. Employment Affairs The BESA Employment Affairs team provide practical assistance to members managing their workforce and in establishing terms and conditions of employment. A Service Level Agreement (SLA) is available on the Members’ area of the BESA website outlining the scope of services and support available on all aspects of employment and managing paid staff. We, on behalf of its Employers, negotiate at a national level with Unite the Union in respect of the terms and conditions of employment for hourly paid site-based Operatives. Members will be aware that a recent uplift in the hourly rates of pay and allowances took effect on Monday, 7 October 2019. Negotiations in respect of a pay settlement for hourly paid site-based Operatives, for the period beyond October 2020, will commence early next year.

• Q3 state of trade will be closed by publication but results will be published mid-November. Q2 results were published in August. The results showed a continued rise in labour and material costs but overall the results painted a positive picture. BESA only results can be viewed at www.theBESA.com/resource-centre/analysis-forecasts/ • BESA has welcomed the updated Prompt Payment guidance, recently published by the Government, clarifying what suppliers should take note of in their approach to payment in major procurement contracts. BESA has urged businesses bidding for public sector procurement to ensure their organisation is publishing payment reports where required and to read BESA’s Prompt Payment Code factsheet to understand how government departments will be implementing the changes from 1 September and what is expected of them. • New factsheets on practical completion, competition law guidance, the plumbers pension scheme, VAT reverse checklists, navigating business to business contracts are now available on the Members’ Area of the BESA website. The Good Work Plan outlines the Government’s vision for the future of the UK Labour market and the action it proposes to take to implement the recommendations arising from the Taylor Review of Modern Working Practices. The Government has now laid Regulations to bring into effect a number of changes with effect from April 2020; including amending the Working Time Regulations to change the holiday pay reference periods from 12 weeks to 52 weeks.
