notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - As I write these notes, spring weather has arrived, with Town parks and open space being readied for anticipated heavy usage. Last summer, the Town’s outdoor venues, including Western Turnpike Golf Course and the summer recreation program, provided a respite from pandemic hibernation and set records. For this second pandemic summer, the Town is expanding outdoor options by adding more hiking trails in the Vosburgh Open Space, and increasing sports, camp activities, adding swim lessons, and other fun options. Registration is open online (http://www.guilderlandrec.com/) for the 2021 Summer Recreation Program and Tawasentha Park HalfDay Camp, which starts on Monday, June 28th. Unlike last spring, when thousands of bright yellow freshly printed brochures intended for “back-pack mail” delivery were left unused, this year Parks & Rec staff designed an online brochure, with descriptions and an interactive calendar that is easy and fun to use. Parks & Rec is targeting the opening of the Tawasentha Park pool for Saturday, June 19th. The Guilderland Performing Arts Center will feature its “Jammin’ at GPAC” Summer 2021 season with Thursday concerts at 7:30pm, starting with Cryin’ Out Loud on June 17th. Other concerts include the Town Band, Damn the Torpedoes, Skeeter Creek, Madison VanDenburg, The Red Wagon, and Broadway Sings Young Artists Program. The spacious grounds allow plenty of room for spacing, and provide for an enjoyable entertainment experience. For a second summer, the Town is expanding its outdoor music offerings by hosting “Pines Pavilion Concert Series” on Wednesday evenings at 7pm at the outdoor pavilion at the Western Turnpike Golf Course, starting on June 9th. The course’s restaurant, The Nines, will have food and beverages available. More information about these events is available on the Parks & Rec webpage: https://www.townofguilderland.org/ parks-recreation. On Friday, May 14th from Noon to 6pm, the American Red Cross is holding a blood drive at Town Hall. You can make the required appointment by calling 1-800-RED CROSS or visiting RedCrossBlood.org with the sponsor code: guilderlandtown. You can expedite sign-in by completing a pre-donation questionnaire at: RedCrossBlood.org/RapidPass. With construction season now underway, several important projects in Town are scheduled to advance this year. The Town’s engineers are securing rights of way and easements, and completing design work for new sidewalks on West Old State Road to Lynnwood Elementary School and on Western Avenue to the Guilderland Public Library. The construction contracts should be awarded in early summer with construction completed by late fall.

DOT’s new roundabout at the Carman Road and Lydius Street intersection is also advancing. It has Peter G. Barber - Town Supervisor been coupled with a new roundabout a short distance away on Carman Road at the I-890/90 intersection in Rotterdam. The project, which is mainly funded by Federal dollars, addresses known safety concerns for pedestrians and motorists, improves traffic flow, reduces idling, and improves air quality. The project also includes the Town’s request, supported by funding secured by Assemblyperson Pat Fahy, for an additional new sidewalk on Carman Road to the Pine Bush Elementary School. Town staff recently met with DOT officials on final details, including landscaping of the roundabout’s center and adding green space on the unused part of the former Nedco site. The tentative schedule calls for awarding the construction contract this fall, with some site preparation work, like the removal of the Nedco building, likely taking place in the winter. The intersection will remain open during the roundabout’s construction next spring. The Town’s effort to establish a Conservation Easement program is advancing in the State legislature. The program allows the Town to provide property tax benefits to owners interested in protecting farmlands and sensitive areas from development, and complements the Town’s other environmental tools, including planned unit developments, country hamlets, and conservation subdivisions to preserve open space, old-growth trees, grasslands, and water resources. Assemblyperson Fahy is sponsoring Assembly Bill No. A7096 and State Senator Michelle Hinchey will sponsor a similar bill in the State Senate. The Assembly's Memorandum in Support states that: “Guilderland has been studying open space issues for several years, including legal methods of reflecting the benefits of conserved lands in property taxes, and would like to offer this exemption, pursuant to local law and other actions of the town board.” I was honored to participate in this year’s Women of Distinction Awards sponsored by Assemblyperson Fahy. Among the women honored was Town Board Member Patricia Slavick for her decades of service to the Town and its residents. I had the honor of sponsoring Beverly Bardequez of the Rapp Road Historic Community for her passionate advocacy for her community and support for the Albany Pine Bush Preserve. While local infection rates remain much higher than last summer (2.5% v. 0.5%), and daily positive case are also elevated (40+ v. 0), there have been significant improvements in halting the spread of the virus, including increasing vaccination rates (over 50% of Continued pg. 6

the population) and very infrequent COVID-19 transports by EMS ambulances (4 and 5 transports in March and April v. 61 in January). The State extended its State of Emergency until Monday, May 19th, and the Town’s emergency was extended to Friday, May 7th. For now, entry to Town buildings is by “buzzer entry” for brief transactions at counters and pre-scheduled meetings with fewer than 10 people in a designated room. The wearing of face masks is required even if fully vaccinated. Due to ventilation and capacity limitation in indoor spaces, all Town boards and committees will continue to meet virtually. The Medical Director and EMS Director monitor local conditions, and will make medical-based adjustments to the Town’s Moving Forward Plan. Town EMS medics have vaccinated nearly 1,000 residents at several vaccination clinics at Station 1, at a special event for students and staff at Guilderland High School, and in the homes of nearly 100 housebound residents. EMS has been the leader in the area’s response to the pandemic, with its ground-breaking use of ozone generators and UV-C lights for rapidly disinfecting ambulances after transports of positive cases and senior buses after each use, and helping our community partners at the Guilderland and Altamont Libraries to maintain a safe working environment for essential workers. The Town Board recently amended the current year’s budget to add more EMS staff to further improve response times, and to respond to increasing calls for emergency services. So far, EMS has transported 275 positive patients to hospitals during the pandemic. EMS is now seeking to expand its community para-medicine license, which now allows for off-site COVID-19 vaccinations, to include other important advanced life support options, including telemedicine treatments, more release and treat options, and transports to urgent care and specialized clinics.

The Governor signed legislation that legalizes the adult use of cannabis, and creates the “Office of Cannabis Management” to draft regulations. The legislation provides that each local government, like the Town, may opt-out of allowing adult-use cannabis retail dispensaries or on-site consumption licenses by adopting a local law by December 31st. The Town cannot optout of adult use legalization. The legislation discusses the need for State DOH to conduct further research to evaluate methods for detecting cannabis-impaired driving, and the creation of a “robust public health and education campaign.” There is no mention that this research and education will take place before year’s end. If the Town Board takes no action, the default is opt-in on both uses. This opt-out option should make for very interesting discussion over the next eight months.

CRANIOSACRAL THERAPY By: Dr. Kim Leis-Keeling

Do you suffer from migraines or headaches? If so, then you are among a large percent of the population. This is one of the most common conditions that we treat at the Sports & Spinal Wellness Center. One of the best methods of treating and managing headaches that we utilize is called CranioSacral Therapy.

What is CranioSacral Therapy? Craniosacral Therapy is a light touch technique that focuses on calming the central nervous system by balancing the fluid that protects your brain and spinal cord. This fluid flows from your brain to your sacrum or tailbone and has pulse similar to your heart rate, but much slower. During the treatment, the patient remains fully clothed while resting on a chiropractic or massage table. The therapist holds certain places around the head, neck and sacrum while using a gentle pressure to balance the fluid flow and relieve cranial pressure. To the patient, it may not feel like much is happening but to the hands of the trained therapist, it is like discovering a symphony of movement.

Who can perform CranialSacral Therapy? CranioSacral Therapy was pioneered by Dr. John Upledger, a professor of Biomechanics at the College of Osteopathic Medicine at Michigan State in the early 1980’s. Today, it is a commonly used technique used among physical therapists, occupational therapists, massage therapists and chiropractors. A certification is required to become a CranioSacral Therapist. In our office, we have 3 certified therapists including Dr. Boccio, Eileen Hebert, and myself.

Covid and Dental Issues... We know all too well how Covid-19 has touched and altered our daily lives. Dear Friends and Neighbors, Spring is in the air and there is a new sense of optimism as we turn the corner after a rough 2020. Yes, the pandemic has changed our daily lives but we are slowly seeing normal activities, including food drives, fundraisers and volunteering opportunities once again taking place. Unfortunately some of our neighbors are still fighting health issues and working to support their families as the economy slowly recovers. Many friends and neighbors continue to struggle with ‘food insecurity.’ Did you know: • • • •

3% of families in Guilderland (1100) have incomes at or below the poverty level. 14% of residents in Guilderland (4970) are 65 years of age or older. 20% of residents in Guilderland (7150) are age 18 or younger. Approximately 550 families with school-aged children qualify for reduced lunches.

The Guilderland Food Pantry (GFP) remained open throughout the pandemic meeting the needs of our neighbors six days a week, 52 weeks a year.

Guilderland Food Pantry has 175 families as registered clients. GFP provides these families with food for 5-7 days, once per month. In 2020, GFP had 838 client visits serving 960 adults, 463 children and 329 seniors. GFP provided food for 15,768 meals. Each week GFP supplies 60 children at 6 schools with weekend meals through our ‘Backpack Program’.

WHAT ARE YOUR RIGHTS AS PARENTS? by Margaret C. Tabak

Guilderland, NY - All too often we hear of stories regarding children who are injured (or worse) while in the care of their parents and ask “how can the parents still have any rights?” Having your rights as a parent extinguished is very difficult to do, after all, what is more sacred to us than our children? There are two ways to terminate parental rights: 1. Voluntary termination also known as surrender.1 A parent can voluntarily terminate their rights to allow a child to be adopted. 2. Involuntary Termination - This is when an authorized government agency files a petition in Family Court under certain grounds to terminate rights.2 Before a parent’s parental rights can be terminated, there first must be a finding that the parent has abused or neglect the child.3 After a finding of abuse of neglect, there will be a disposition, similar to a sentencing part of a trial, where the court will determine what is in the best interest of the child.4 Involuntarily terminating parental rights is not something that is done lightly. The Legislative intent states: (i) it is desirable for children to grow up with a normal family life in a permanent home and that such circumstance offers the best opportunity for children to develop and thrive; (ii) it is generally desirable for the child to remain with or be returned to the birth parent because the child’s need for a normal family life will usually best be met in the home of its birth parent, and that parents are entitled to bring up their own children unless the best interests of the child would be thereby endangered; (iii) the state’s first obligation is to help the family with services to prevent its break-up or to reunite it if the child has already left home; and (iv) when it is clear that the birth parent cannot or will not provide a normal family home for the child and when continued foster care is not an appropriate plan for the child, then a permanent alternative home should be sought for the child.5 There are five grounds that, once a negative finding has been made against a parent, a petition terminating parental rights can be brought:6 (1) Abandonment, (2) Permanent Neglect, (3) Mental Illness, (4) Intellectual Disability, and (5) Severe and Repeated Abuse. Abandonment is when a parent shows that they intend to waive their parental rights and obligations by their failure to visit or communicate with the child.7 Permanent neglect is when the child is in the care of an authorized agency, and the parent has failed to maintain contact or visit the child within the last year or 15 / 22 months since the child was placed with the agency.8 For both abandonment and permanent neglect, the parent is physically and financially able to visit and communicate with the child, but they choose not to. Even if someone is incarcerated, it is presumed that a parent can maintain contact with their child. Once a parent’s rights are terminated, they are no longer legally required to support the child financially and lose any rights to visitation or custody. You can appeal an order of termination, which requests that an appellate court examine the decision. The parent needs to file a notice of appeal within 30 days from the date the order was served.9

And a totally different topic: AM I WRITING CHECKS FROM THE OTHER SIDE OF HEAVEN?

Most matrimonial agreements will require that spousal maintenance needs to be paid for some period of time, but could end if the recipient remarries, holds herself out as someone’s spouse, dies or the payor dies. But what would happen if the only termination event was the recipient’s re-marriage? Could the payor (or his Estate) be required to continue to make payments? “The term “maintenance” shall mean payments provided for in a valid agreement between the parties or awarded by the court in accordance with the provisions of subdivisions five-a and six of this part, to be paid at fixed intervals for a definite or indefinite period of time, but an award of maintenance shall terminate upon the death of either party or upon the payee’s valid or invalid marriage…” NY CLS Dom Rel § 236 [B] [1] [a]

The rule is, unless the parties modify or extend the duration of maintenance by a contract, a spouse’s obligation to pay maintenance terminates upon their death. If the parties want to modify or extend their obligation, it must be made explicitly clear in an agreement. If it not explicitly clear, then the court will need to look at the four corners of the document in its context and examine each provision to determine the overriding intent. The inclusion of independent sources of support can show a party’s intention to continue maintenance post-death.10 The State’s highest Court has held that generally a spouse’s obligation to make maintenance payments terminate upon their death.11 However, parties may modify or extend the duration of maintenance by contract. Factors to look at are designation of a former spouse as an irrevocable beneficiary on a life insurance policy, lump-sum transfer in the discharge of claims against the estate, and other distributions accruing upon the death of the payor spouse. While it is unlikely you will be responsible to make payments when you are on the other side of heaven, the easiest way to be sure is to have clear language that spousal maintenance payments end upon the death of the payor. There's a beehive of activity buzzing at your friendly local library! You can see the construction progress as you pass by our building on Western Avenue, and inside the transformation evolves daily as well. The ever-changing "controlled chaos" is exciting to see as it unfolds before our eyes, and we can't wait to show you around when it's done. I'll come back to that. But first, I want to highlight important information on our upcoming vote.

complete the project. We have been the beneficiaries of excellent planning by our board, architects, and construction manager. Voters will recall that we pledged to have the library open as much as possible during the construction project, with only a few short closures of several days to a week here and there. Our plans were upended by the pandemic, and shortly after construction began on


October 7, 2020, we made the aggressive decision to handle the construction not in seven separate modules, but to begin the first three modules immediately. This was because visitors were not allowed into the library due to the pandemic, and it was a waste of space, time, and money to stick to the original approach. While this is inconvenient to library users, we have faith that in the long term, it will turn out to have been the most responsible way to manage your investment in a renovated library, and that the payoff on the other end of the process will be thrilling for our community. We have recently begun the fourth and fifth zones or modules of the construction, which all takes place in the front of the building and the parking lot. On our original schedule, we would have completed one construction zone, and would be looking at an additional 15 months of construction at this point, rather than 4 months. For now, this continues to limit us to curbside pickup and to online and telephonebased services, but the physical picture is beginning to clear up, and we hope to allow some physical browsing relatively soon. For those who long for the days when they could drop by their library and browse around, we miss you too! When we are able to take that step, we will likely follow the example of our peer libraries in the area, most of which have a limited number of patrons allowed in the building at any one time due to the continued need for social distancing. Since your library is a member of the Upper Hudson Library System in Albany and Rensselaer Counties, you have access to 28 other libraries, including nearby facilities in Altamont, Voorheesville, the Pine Hills Branch of the Albany Public Library, and the Colonie library. The “degree of openness” in each of these libraries is subject to change (that pandemic again), so I suggest you call first, or go to the Upper Hudson website www.UHLS.org, where a frequently-updated list will provide the hours and procedures. I recently made a quick stop at Colonie myself, and found that their “people counter” at the front door indicated that 12 of the currently permitted 30 patrons were in the building. I thank the citizens of Guilderland for their patience as we deal with the concurrent epic challenges of construction and the pandemic. I also urge those of you who have not tried curbside pickup yet to give it a go; we are circulating quite a bit of material this way-it’s easy and safe. During the past year, we issued nearly 2,000 new library cards online, and many people have discovered our streaming, audiobook, e-book, newspaper and magazine reading options online. Our virtual programs continue to be well attended, and many patrons have thanked us for keeping them stimulated and connected to others via this novel medium. We continue to plan for outdoor programs, virtual programs, and summer reading activities for kids.
