Guilderland, NY- Welcome to the New Year 2015. As I do every January, I would like to express my gratitude to Our Towne Guilderland Publisher Lowell Knapp for creating the “Supervisor’s Notes” column a few years ago. I appreciate the opportunity to reach out to Guilderland residents and to provide them with a bit of basic information about things taking place in our community in a simple, informal format. We have received a fair amount of feedback on this column over the years, and it has been a very favorable response overall. January is also the month where I like to take a minute to point out to our residents that there are a number of ways that they can keep up with what’s t’s going on in Guilderland. The Town website, www. townofguilderland.org, contains a wealth of information on community events and activities, the meeting schedules, agendas and minutes of various boards, contact information and downloadable forms from m Town departments, and links to a wide range of other government nment agencies and community organizations. zations You can also find information on Town activities and events on Channel 17 on your cable television. Channel 17 is also the home of live broadcasts and taped replays of meetings of the Town Board, the Planning Board, and the Zoning Board of Appeals. We have worked to keep Town government open and transparent by providing easy and regular public access to the meetings of the Town’s primary governmental bodies. I urge all who are interested in being well-informed about the Town and its operations to take full advantage of these resources. As we move into the heart of the winter season, I would like to ask our residents to think of their neighbors and our Town work crews by obeying winter parking regulations and by driving with care as our crews and equipment are out working to keep Town roads clear and safe during periods of stormy weather. Summer may seem a very long way off, but folks who want to use the pavilion areas in Tawasentha Park should be aware that sign-ups for pavilion rentals began on January 5, 4

and that reservations for these facilities, particularly on weekend days, fill up very quickly. Please call the Parks Department Office at 456-3150 to book one of the pavilions for your family or group. During the winter months, there is a range of recreational opportunities available for our residents in Guilderland’s parks. A limited amount of rental equipment is available. AARP’s Taxaide Program Starting Monday, February 5, and continuing through mid-April, the AARP Taxaide Program will provide free tax preparation and e-filing services on Mondays and Saturdays at the Guilderland Public Library. All Taxaide volunteers are trained and certified in cooperation with the IRS. They prepare personal Federal and New York State tax returns for taxpayers of all ages with low and moderate incomes.

s the 2014 Holiday season has now passed many of us are looking to kick off our new yearâ&#x20AC;&#x2122;s resolutions. One resolution you should definitely have on your list is regular daily flossing. Flossing between your teeth is essential for removing dental plaque which can cause cavities, gingivitis and even reach vital organs like the heart through the blood stream. While everyone agrees that brushing at least twice a day is crucial, thereâ&#x20AC;&#x2122;s hot debate right now about whether itâ&#x20AC;&#x2122;s preferable to floss before you brush (as I do) or afterwards. Iâ&#x20AC;&#x2122;ve always advised patients to floss before they brush to break up and remove the plaque matrix between the teeth before going in with the toothbrush to sweep away the bacteria and debris theyâ&#x20AC;&#x2122;ve dislodged with flossing. Flossing is crucial: Itâ&#x20AC;&#x2122;s the only way to clean between the teeth, since a toothbrush canâ&#x20AC;&#x2122;t reach these crevices. The biggest thing is to remember to brush twice a day and floss once, spending several minutes removing plaque and debris between the teeth. It takes 24 to 48 hours for oral bacteria to organize into plaque, so as long as you dislodge the plaque at least once a day by flossing, youâ&#x20AC;&#x2122;re protecting your oral health. My recommendation is to floss at night, before you go to bed. When youâ&#x20AC;&#x2122;re sleeping, you produce less saliva to clean your teeth and gums, so oral bacteria are free to do more damage. Therefore, itâ&#x20AC;&#x2122;s important to brush, floss and scrape your tongue every night to get rid of bacteria and go to bed with your mouth as clean as possible . The American Dental Association reports brushing or flossing first are both fine, as long as you do a thorough job. However, the ADA adds that a benefit of flossing first is that fluoride from toothpaste is more likely to reach between your teeth when you brush, which may help reduce cavities. LOSE FOR WINNING Guilderland, NY - The New Year is a time to reflect on the year gone by. For me, the New Year is a time to reflect on the many cases and clients that we have had throughout the year at our office. Every case is different, and with each one there is a new lesson to learn or a reminder of past lessons learned. Attorneys are bound by many ethical rules, which are set forth in the Rules of Professional Conduct (22 NYCRR Part 1200). The lawyer is an advocate for the client, and is duty bound to advocate for what that client wants.1 This means that the lawyer is also bound to abide by the client’s objectives, including the client’s decision to settle a matter. (22 NYCRR 1200 Rule 1.2(a)).
the house, the result for our client would be a foreclosure or bankruptcy (or both), or the house being in such terrible shape at the time of sale that it would negatively impact the sale price. Our client rejected Bob’s proposal. Interestingly, Bob’s proposal also put him (Bob) in a terrible financial position because he was attempting to hang onto a house that he could not possibly afford. The math was not in Bob’s favor. This was apparent to everyone involved in this case, except Bob. For me, this case is a reminder that, while attorneys have an obligation to pursue the client’s objectives, the attorney also has an obligation to exercise independent professional judgment and render candid advice to the client. In rendering that advice, the attorney may refer to the law, or moral, economic, social, psychological, or political factors that may be relevant to the client’s situation.2
In 2014, we were involved in several cases where our adversary (i.e. our client’s spouse) made a settlement offer that was completely unrealistic for our client, or the spouse making the offer, or both. For example, in one case, our client’s spouse (“Bob”) wanted to keep the marital residence. But Bob had terrible credit and would have trouble refinancing the mortgage to remove our client from the debt. Bob’s solution to this was to offer to sell the house if he could not refinance, but Bob did not want to sell the house for at least four more years. The problem with this solution was that Bob did not make enough money to afford to maintain the house. Bob’s proposal presented huge financial risk for our client. If Bob defaulted on the mortgage or otherwise failed to maintain
Sometimes a client can be so focused on achieving his objective that he fails to appreciate the consequences that achievement will bring, no matter how much candid advice his lawyer gives to him. Unfortunately, this means that for those like Bob, one can “lose for winning.” There are a few exceptions to this. FEES AND COMMISSIONS IN THE FINANCIAL SERVICES The retail financial services industry offers products and services through two very broad arms – broker-dealers and registered investment advisors. It is important for consumers of financial services to understand how their advisor is being compensated. The Broker-Dealer world consists of well-known firms such as Merrill Lynch, Morgan Stanley Smith Barney, and Wells Fargo, along with many independent firms such as LPL Financial, Commonwealth Financial, and VOYA Financial Advisors. Broker-dealers are regulated by both the Securities and Exchange Commission (SEC) and the Financial Industry Regulatory Authority (FINRA) and their revenue is generally a result of commissions generated by securities transactions. A securities transaction may be the purchase or sale of a stock, mutual fund, real estate investment trust, variable annuity, variable life insurance, etc. An advisor with such a firm is considered a ‘registered representative’ of the firm, and his/her income is generally based on transactions processed on behalf of clients. Commissions are typically built into the price that a consumer pays for a securities product, which means that the consumer is not making a direct payment to the broker-dealer firm. The Registered Investment Advisor (RIA) world is regulated by the SEC and/or the states in which it serves clients. Generally speaking, an RIA firm provides financial advice and guidance to clients in exchange for fees paid directly by the client. Types of advice offered by an RIA firm vary, but typically include cash flow analysis, retirement income planning, income tax analysis, investment management, estate distribution planning, etc. RIA firms are generally viewed as having fewer conflicts of interest with their customers due to the non-transactional nature of the relationship. The financial services industry has seen a large shift during the past 10 years away from the broker-dealer channel and towards the
RIA channel. According to Cerulli Associates in its December 2013 edution of “The Cerulli Edge: US Asset Management Edition”, the RIA channel grew at an average annual rate of 8% from 2004 to 2012, while broker-dealer channels actually saw an overall decline in business during this same period. We attribute this trend to the notion that RIA firms owe their clients a fiduciary duty, which is a much stronger duty of care than the suitability standard required by broker-dealer firms. In other words, an RIA firm is required to sit on the same side of the table as its client, while a broker-dealer firm is not. FIND THE THING YOU LIKE THIS NEW YEAR Guilderland, NY - In previous articles I have gone to great lengths to show you how Taekwondo and football are metaphors for life. Earlier today I watched my youngest son Mete bowl a few rounds in his Saturday league. It was great to watch him since I usually don’t get to and it gave me the opportunity rtunity to ponder the sport. Bowling is a lot like life and has a lot of life lessons included with the fun. You are presented with the task of knocking down a set of ten pins on a beautiful clear lane of solid shining wood. The task seems easy but it is always more difficult than it appears, is full of surprises, successes, near misses, and at times apparently insurmountable spares. Yet no matter what at happens, there is always a fresh h set of pins, a new opportunity, a fresh h start. t t The true key to successful bowling is treating each new opportunity without letting the previous result affect your focus. It is the single most difficult aspect of any sport, but it is the key to success. Each frame is a new chance, each game a new opportunity. If things aren’t going the way you want, you make changes and show patience as you apply them. When things are great, you go with the flow and enjoy it. When nothing you do seems to make it right, it is always okay because there is always a new set of pins, always a new game and always next week’s match. Bowling is a lot more like life than you ever thought, you just need to play, consider and apply it.
There are more aspects about bowling that fit into parallels of life activities, but here is one last thing about bowling from a math teacher. When I was younger there was no computer keeping the score so we had to know the rules and we had to do the math. I miss those days of the casual application of math and rules, so I make sure I use the th opportunities of score prediction to tteach my son the rules and apply the math calculations. Mental math is m important and is a valuable life skill I am happy to promote. Finding the hobby or the sport you are interested in is a great way to practice for life; it just has to be something you care about enough to make the lessons meaningful. I teach math and taekwondo to give others the chance to experience the llessons those things deliver, and the chance to experience the most they cha can out o of their life. The best reward, of course, cours is when someone returns to tell me about how something we did together helped b th them go down a path that changed their life for the better. To see how happy they are and the excitement they emote is a reward that can only be topped by one’s own children. If you want a taste of life’s parallels in other activities, find the thing you like this new year and look for the lessons it can teach you. Happy New Year 2015. May it be the year that you discover how to practice for successful life through a sport or a hobby that you enjoy.

A TEA THAT IS NOT A TEA AT ALL Guilderland, NY- Relaxing chamomile tea, healthy herbal teas, refreshing hibiscus-based fruit teas and caffeine free rooibos or “Red Tea” are all very popular. The trouble is that none of these contain the tea plant. So why do we call them teas? The beverage “tea” has become generalized for a drink made by steeping anything in hot water. Technically, if what you’re steeping isn’t from the tea plant, it is a tisane. Herbal tisanes are very popular because they are functional. Many of these tisanes are ayurvedics (a-your-vay-dics) which is the name for the Indian system of medicine. There is no denying the effects of many plantbased tisanes and the affect on the body. Most people have experienced the effects of ginger to sooth their stomach or feel calming effects of chamomile tea. Some examples of herbal tisanes we carry at Short and Stout include Chamomile Citrus, Tummy Soother, Cold Chaser, Sleep Tight and Fit and Slim. Fruit tisanes are especially popular. Most have a hibiscus base which is tart. They can be enjoyed hot and also make great iced teas. Rooibos (roy-boss) also known as Red Tea is from a bush in South Africa that is well-regarded as a black tea alternative because of its robust flavor and its natural caffeine free quality. Guilderland, NY- Looking back on my first year as Director of the Guilderland Public Library, one of the things I am proudest of is our staff of over 50 hard-working, creative, friendly and helpful people. You may have seen our staff wearing jeans quite a bit this year when you visited. Most days, we stay in professional attire, but once a month, we have a jeans day, fueled by the charitable generosity of the staff. Staff members can suggest charities that are near and dear to their hearts, and we then hold a monthly jeans day, where employees choosing to participate can donate $5 to the designated organization, and are thus allowed to don their denim. We also put out a jar on the circulation desk on that day to collect donations from patrons for that day’s cause. The program began in February, and through December, we chose ten charitable efforts, most of them local organizations, for which to collect money. The grand total for 2015 was $1405.80, an astonishing amount to raise for our local area. (Anyone reading this may wish to start charitable denim days in their workplaces as well!) For November and December, we chose to devote both months’ proceeds to the Holiday Angels program run annually by the Guilderland Chamber of Commerce. This program helps families in need to provide Christmas to their kids, and staff members not only donated money, but also enjoyed shopping on behalf of these kids, and wrapping the gifts up as well. One little boy wanted a baseball and bat, and a generous staff member also gave him a bat bag, batting gloves, a helmet, and a hitter’s training device. Not only were there lots of toys acquired, but also warm socks, coats, hats and other necessities. Some of our other recipient organizations were the Smith Center for Disability Services, and the Guilderland Interfaith Council Food Pantry (also the recipient of 10 boxes of food brought in by library patrons during our September “Can Your Fines” promotion). In April, we chose the Helderberg Bassmasters, an organization that had been taking care of our fishing poles (Yes, you can check out a fishing pole anytime from April-November) for so long that nobody either at the library or at Bassmasters remembers when they started! The club holds an annual kids fishing tournament, from which no needy child is ever turned away. Another local organization which got our support was the Prospect Hill
Cemetery, after we read an article talking about their need for funds to maintain this beautiful neighbor of ours. The most popular charity this year among our employees was the Albany-based Alzheimer’s Association of Northeastern New York, as this terrible disease has undoubtedly touched many lives among the staff. We honored the memory of the late Diane Rosenbaum, a long time library trustee and supporter, by designating “To Life!” – a local breast cancer support and education organization – as one of our beneficiaries. Yours truly, along with Sean Silvernail, Dept. Head of Information Technology, took the Ice Bucket Challenge and we raised money to fight “Lou Gehrig’s Disease,” with the funds going to St. Peter’s Hospital, a leader in the local fight against this debilitating disease. We also partnered with our neighbors, the YMCA of Guilderland, to hold a “Be The Match” event, at which we signed up 31 potential new bone marrow donors to help patients with leukemia, lymphoma, and other blood cancers. October’s local charity was the Schenectady Home Furnishings Program, which provides quality used furniture to families in need. It’s truly been a year of giving at the Guilderland Public Library, and we plan to keep the momentum going next year. In the meantime, you can help make your library stronger by giving a year-end gift to us, through our fund-raising arm, the Guilderland Library Foundation. Just stop at the circulation desk, or call 4562400, and tell the staff you’d like to donate to our Giving Tree. This year, an anonymous donor who loves the library is matching contributions, dollar-for-dollar, so when you give the Foundation ten dollars, for example, you are really giving twice that amount! Guilderland, NY - This past October I attended a national building trade conference in Baltimore, Maryland. It was nice to have a change of scenery, enjoy some local cuisine and most of all get completely inundated with all the new and upcoming ideas, materials and practices in the residential construction industry. After three days of classroom lectures and live demonstrations I was ready to come home. I picked up a few goodies at the airport for the wife and kids and boarded my plane. I met a nice couple from Washington D.C. who were going to visit their son in college in Saratoga. As we exchanged conversation about our families and other topics, careers came up. I mentioned that I was a building contractor in the Albany area and had just attended a trade conference. The woman described a remodel they had done recently and then asked if I could make a living with my profession. I said yes and described how busy our company was with several new jobs and a number of upcoming jobs. The conversation tapered off as the drink service began and I took a quick nap. As I was driving home from the airport, I thought back to my conversation with the couple. I donâ&#x20AC;&#x2122;t think the woman was trying to insult me with her comment I think she was just trying to determine if my job allowed me to support not only our company and employees, but also a growing family. Over the next few weeks I thought about her comment and the conference a lot. The main theme I took away from the conference was the importance of working with and paying attention to my existing and potential customers. I also thought more about the womanâ&#x20AC;&#x2122;s comment and put myself in her shoes as she was talking to me and thought to myself that the whole process of remodeling and construction can be exciting and result in a new kitchen or bathroom, but that the whole process can also be overwhelming and difficult when deciding who to trust with a project. All of which brings me to the focus of this article. Five or six times a month we are trusted by new and past customers to remodel a kitchen or bathroom, install new doors and windows, build a porch, remodel a basement and numerous other jobs. It can be easy
at times to overlook the intricacies of a job when we as a company are focused on the job as a whole. From the first meeting to the last clean-up of the job, we take the time to build that relationship and trust with our customers that is crucial to making the project go well. Being on time for appointments, taking time to answer questions, explaining our company background and history, providing phone call and in-person references, weekly or bi-weekly schedule and job meetings and ongoing communication in person or via text or email with our customers is how we work. All of our customers are also provided with all of our legal information, insurance, workersâ&#x20AC;&#x2122; compensation policy, a working contract for the project and all the permits and inspections as required for the local municipality. Now, months later when I think back to my conversation with the woman on the plane and her question I answer with a definite yes, my job does allow me to support our company, our employees myself and my family. We have built our company on a policy of customer service and high quality remodeling and construction and have a lot of happy customers as a result. I donâ&#x20AC;&#x2122;t see my work as a job. Itâ&#x20AC;&#x2122;s a profession, a career where we get to meet all kinds of people looking to complete a project on their home. We help customers turn their vision into a reality and provide the best experience they can possibly have with a building contractor. Time sure flies when you are having fun doing everything else besides organizing your life. Trust me, I know. There is a mound in the middle of my warehouse I call â&#x20AC;&#x153;The Pyramidâ&#x20AC;?. It started during the holidays years ago as â&#x20AC;&#x153;The Christmas Massâ&#x20AC;? which was followed the next year by â&#x20AC;&#x153;The Gatheringâ&#x20AC;?. It then it quickly grew into â&#x20AC;&#x153;Gomer Pyleâ&#x20AC;?, followed by â&#x20AC;&#x153;No Space Mountainâ&#x20AC;? and â&#x20AC;&#x153;Mount Junkmoreâ&#x20AC;?. Finally I no ced giving it cute nicknames only seemed to make it larger, and madder. It is definitely easier to accumulate than to reduce. Every once in awhile I go into a house where there is just a car, 2 garbage cans and a rake in the garage and it looksâ&#x20AC;Śwellâ&#x20AC;Ś awesome! But mostly garages, basements, a cs and storage sheds looks like 50 boxes full of games, clothes, old appliances and toys crashed into a rummage sale during a flea market at a going out of business sale. Thus, â&#x20AC;&#x153;The Pyramidâ&#x20AC;? is born. I can actually see stuďŹ&#x20AC; from cleanouts we did 3 years ago in the center. I have my own excuses, I mean, itâ&#x20AC;&#x2122;s like I move 20 mes a month, every month. I originally kept things because â&#x20AC;&#x153;I might need that somedayâ&#x20AC;?. This explains why I have 12 assorted boxes of wood matches, 11 cans of WD-40, 10 crates of extension cords andâ&#x20AC;Ś a box full of Partridge Family albums. LESSON OF THE DAY: I, AM, NEVER, EVER, EVER, GOING, TO, NEED, ALL, THIS, STUFF!!! Ini ally this year I vowed a personal resolu on to get MY house in order. For starters it would help if the word resolu on didnâ&#x20AC;&#x2122;t have the syllable â&#x20AC;&#x153;loseâ&#x20AC;? in it. Sta s cally only 8% of all New Yearâ&#x20AC;&#x2122;s resolu ons succeedâ&#x20AC;Śno one is sure if the numbers are exactly correct because the guy who said he would verify the data never got around to it. FOR ADOPTION Ivy is a small very sweet active little girl. She is a beautiful DSH hair w/ green eyes. She was found starving in an inner-city back yard. She had a severe flea allergy with very little hair on her body and looked so very helpless. Although she would run up to the home owner begging for food he choose not to feed her. Ivy was rescued and she immediately thanked us by curling up in our lap and snuggling. Although Ivy is almost one year old she still has some kitten qualities. She has energy and loves to run around the house. She loves her toys!! She also likes to take time out from her playing to cuddle in your lap or help you with your office work. She will want to cuddle up and sleep w/ you every night with no exceptions! Ivy loves to look out windows and meet you at the door when you come in. She likes to be around the home activities. Although Ivy gets along very well w/ the other 5 cats in her foster home Ivy insists on being the only cat to sleep on the bed w/ her Dad at night. He was found right before Christmas starving and trying b to protect a little hole in the wall of aan abandoned house in which he was liliving. He was so happy to be warm w/ aall the food he wants. Nicholas is handsome with his thick N long hair and his John Wayne swagger. lo He looks like a Maine Coon but much H smaller as he is medium-sized. He is very sweet and loves to be held and patted. He will always meet you at the door when you come home. Nicholas will do best in a home w/ at least one other cat as he is still a little tentative at times about what a kitty does. With each day he seems to flourish. Currently he lives in a foster home w/ five cats and thoroughly enjoys their company! He also likes to be included in all family activities except vacuuming.
