he first “Supervisor’s Notes� appeared in “Our Towne Guilderland� four years ago this month. As I do every year, I’d like to express my appreciation to Our Towne publisher Lowell Knapp for providing this opportunity for me to keep Guilderland up to date on community happenings in an informal matter. Based on feedback we have received in the past, this seems to have been an effective communication tool, but I am always ready to consider suggestions for improving this feature. Please feel free to communicate either with me at Town Hall (356-1980, ext. 1040) or with Lowell Knapp if you have any comments or suggestions.

During June, the Annual Dinner celebration of the Guilderland Chamber of Commerce featured the presentation of awards from the Town to local businesses that have demonstrated their commitment to Guilderland by investing in improvements to their facilities. This year’s winners included: The Altamont Free Library; CafĂŠ Calabria; FIN Your Fishmonger; Gade Farm; Nosh Delicatessen; and Red Maple Land Service. We are happy to celebrate the willingness of these and others who have made investments that benefit the appearance and overall business environment within the Guilderland community. As we swing into the height of the summer season, I urge all of our residents to take advantage of the broad array of recreational and cultural opportunities offered throughout the Town of Guilderland. Park facilities range from small neighborhood venues such as Abele, Fort Hunter, McKownville Reservoir, and Volunteer Fireman’s Park, to sports-centered locations such as DiCaprio, Keenholts, and Nott Road Parks, and Tawasentha Park, our “crown jewelâ€?, featuring 5 miles of hiking trails, picnicking, playgrounds, tennis, basketball, the Town Pool, Guilderland Performing Arts Center, and the bright and colorful Ruth Lawlor Memorial Gardens. Recreational opportunities are also plentiful in the Albany Pine Bush Preserve, a 3,000-acre natural area located in part in the Town of Guilderland. The Preserve has a network of over 18 miles of trails for hiking and mountain biking, as well as a broad range of educational programming at the Pine Bush Discovery Center on New Karner Road (Route 155). I’d like to also remind you that excellent golfing is available at the Town’s Western Turnpike Golf Course, with special discounted rates for Town residents. You will need a Guilderland Resident I.D. card to obtain the discounted rates. The card is easily obtained at the Western Turnpike Pro Shop by presenting two forms of identification showing Guilderland residency. We have made a number of improvements to the course this season that players have told us that they like very much.

You may have seen newspaper coverage lately concerning a review by the New York State Comptroller’s Office of the overall fiscal condition of the State’s counties, cities, towns, and villages. In light of the economic recession experienced at the national and regional levels in recent years, it should come as no surprise that many communities, including some in the Capital District, are regarded by the Comptroller’s Office as subject to meaningful levels of budgetary and/or financial stress. I am pleased to report to you that the Comptroller’s Office has assigned a risk grade of “0â€? (Zero) to the Town of Guilderland based on its 2012 fiscal reports. This is the best score available under the Comptroller’s rating • system, and represents the view of an independent oversight agency on • ! " the soundness of the Town’s financial management in these difficult times. • While I am happy that we received this score from the Comptroller’s office, • ! ! # we will continue to manage Town finances conservatively as we work to insure that we continue to avoid financial and budgetary problems. • " • " Summertime in Guilderland is a great time to relax and visit with friends. • I regularly remind residents to travel around Town carefully, but this • $ ! ! month I would like to share another reminder with you, and that is about consideration for neighbors. We all enjoy having family and friends around, but please try to be aware of the noise level created by gatherings of family and friends, particularly in the late evening or at night. Similarly, please be aware and considerate of your neighbors when you use patio fire pits. Both smoke and sparks travel. The smoke can be an annoyance to your neighbors, while sparks can present a real fire hazard to both you and your neighbors. " % %# %$! Be safe, be considerate, and enjoy the summer!

ummer has arrived, and our usual hot and humid days and evening thunderstorms make for an interesting time! Summer camps have started and the Tawasentha Pool is open for business if you are looking for something for you or your kids to do. If you are looking for a cool spot, try the Guilderland Library or Crossgates Mall. The Great American Cookie opened at Crossgates Mall in the Food Court for you cookie lovers, Fast Trax Indoor GoCarts is opening very soon at Crossgates Commons, and Vera Bradley is also coming to the mall! For business events, there are some bigger events, just less of them! At the CSNE Complex (aka Nanotech Center), Smalbany Small Business Expo is Wednesday July 17, and the Guilderland Chamber is hosting the breakfast networking portion. That is always attended by hundreds of people. The chamber will also be joining forces with Colonie, Bethlehem and Southern Saratoga Chambers for a Golf Mixer at Shaker Ridge Country Club on August 7. Guilderland, NY – Chuck was frustrated. His home, located in a prime area of the Capital Region, had been on the market for over 700 hundred days with two different real estate agents without an accepted offer. Over that time period Chuck had endured 91 showings on his home. His wife was at her wit’s end. She spent 91 days making beds, mopping the floors, turning on all the lights and leaving home so 91 strangers could walk through. 91 times they showed the home and waited by the phone for an offer to come in. The result of this huge inconvenience and waste of time? Not a single accepted offer on the home. When I met with chuck and his wife I could feel the frustration. They were ready to throw in the towel and give up on their dream of building a home. They simply thought their home was jinxed and not going to sell. I looked at the home and location and knew we could put an end to chuck’s dilemma. I explained to Chuck how we are often hired by homeowners after their homes have been listed for sale with other agents and failed to sell. I also explained that to sell over 100 homes a year we do things differently than average real estate agents. After a short discussion Chuck agreed to let us sell his home and attempt to do what other real estate agents had failed to do. We listed Chuck’s home at an asking price only $100 less than the last Real Estate agent. However, rather than make Chuck endure months of showings we brought him an offer over the asking price in only 36 hours! So how did we succeed where others failed? We applied a fundamental sales principle that top agents use called Scarcity. In general, you will want what you can’t have or perceive as difficult to obtain. Scarce items are considered more valuable and desirable. When a home sits for 700 days it is generally not perceived as hard to obtain. Part of this is the way the sales process is handled. Typically when an average real estate agent has several showings on a home they will spread the showings out to give the buyers “time to look� at the home. They will not double book showings where there are two buyers in the home at the same time. This is the absolute wrong thing to do and one of many reasons that Chuck’s house sat on the market so long. We had 5 requests for showings the first 36 hours and booked all of them in the same 90 minute time frame. Buyers were falling over each other looking at the house. ONE YEAR AND GROWING By: Dr. Kim Leis-Keeling

It sure doesn’t seem like it has been a year since I have been practicing here in Guilderland. I want to take a moment to thank the patients and community for enduring all the changes we have made within the practice. I feel so blessed to have been given this opportunity to grow Sports & Spinal Wellness Center and expand the services. Now that we are on a role, we have a few more changes taking place. I’m happy to announce that on August 1, 2013, Dr. Robert Irwin and the Family Health & Sports Chiropractic clinic will join us at the Sports & Spinal Wellness Center. Dr. Irwin shares similar interest in treating athletes and sports injuries. He has acted as team chiropractic physician for the Albany Conquest/Fire Birds and the Willow Street Athletic Club. He has also served as assistant track coach at Guilderland High School. Dr. Irwin has contributed articles over the years to The Pace Setter, Adirondack Sports and Fitness and New England Runner. He has been treating local athletes and people in the Guilderland area for the past 14 years. The decision to merge offices will allow us both to offer more office hours and expand our services to our patients. Some of the services we offer are spinal rehabilitation, lumbar traction, sports injury care, Kinesio Taping, and modalities such as cold laser, electric muscle stimulation, instrument assisted soft tissue therapy, myofascial release, medical massage, running evaluation, orthotics and much more. emember the game of hot potato from when you were little? You would pass around an imaginary hot potato that you would quickly pass on to the next kid. The person stuck with it when you called “hot potato” was the loser. This is a similar strategy that people try to employ when it comes to dividing debt. While you may have enjoyed that hot tub you bought, the vacation, etc., none of them seem so appealing when there is a pile of debt that needs to be divided between divorcing spouses. While some debt may be caused by one spouse for obvious non-family reasons (i.e., gambling, alcohol), that is the easy pile to pass on and attribute to the spouse who incurred the debt. But what happens when the bills have piled up over time with both parties having, if not enjoyed, at least utilized, the purchase that caused the debt? A recent case that came down from our Appellate Division brought this issue to light in an interesting way. In that case, the Wife argued that the affluent lifestyle she had come to enjoy should continue after the marriage, and, by the way, all of the debt should be the Husband’s responsibility. After going through the facts, the Court held that the husband couldn’t be held responsible for supporting the wife in a lifestyle that existed on borrowed (not actual)money. The Court also did not hold the Husband solely responsible for the debt. The Wife knew about the debt, consented to a refinancing of their house, and benefited from the items they purchased and the lifestyle they led, and therefore she had a responsibility to share in repaying it. Assets are easy to divide-everyone wants them, but no one wants to be taking money out of this week’s paycheck for yesterday’s fancy dinner. Even people in the happiest relationships should consider these things as they go along in life: 1.

Do I have the money to buy this?. If I don’t, is it worth the debt? While you may need education, reliable transportation, and a place to live, do you need a boat, Jet Ski, snowmobile, etc. No matter how delicious that $200 dinner was, are you going to remember it next month when your credit card bill comes? Life is fickle. You can lose your job, get sick, and have your relationship end, etc., all on a moment’s notice. What happens then when you have a pile of receipts and nothing to show for it? Will you be forced into bankruptcy? Or spend the rest of your days borrowing from Peter to pay Paul?

All of these are things to think about not just when things go bad, but especially during the good times. Keep in mind that New York does not simply hold the person whose name is on the debt responsible in a divorce. If it was incurred during the marriage, it is the uphill battle of the person claiming it is not a marital debt to prove it.

GOALS LEAD TO SUCCESS During the first week in July Guilderland Martial Arts is taking a team of 9 students to the USA Taekwondo National Championships in Chicago. We have achieved this level by setting goals and striving to achieve them. It is necessary to have a goal and it is necessary to put yourself on the spot and in the limelight. By doing so, we put pressure on ourselves to make progress toward our goal. Without the goal and without the impending due date, we often are too lax about our progress. Our team has worked very hard to perfect their performance and develop the proper positive attitude. We are going to return to New York with medals in hand. This is the attitude one must have entering any competition. Confidence is a key factor in giving the best possible presentation whether it is floor exercise or sparring. Confidence comes with proper preparation and setting goals with a performance date forces proper preparation. Some of the things that we prepare for are set for us. As teachers, G Goodd lluckk to the h 2013 G GMAA National i l Ch Championship i hi T Team my colleagues and I have plenty of goals and dates of performance set for us. New York State Education Department takes care of a lot of that for us, but we, and you in your occupation, can also set goals to increase our knowledge or enhance ourselves by giving extra presentations or volunteering to become involved with new projects or initiatives. This will force us to prepare and better ourselves. One simply needs to decide that they want to get better at something, set a goal, put time pressure on achievement, and everything will come in place. Do it, and you will get better. How could you not? I feel like I will come back with a medal from Chicago for my performances, I really do. If I don’t it will be OK because I have become very good at what I do, and I am pretty sure that because of that, I will have helped someone among us come back with a medal. Either way, I will let you know in August. Master Rice owns Guilderland Martial Arts and holds a 5th degree Black Belt in Taekwondo. Master Rice is also a Math teacher at Guilderland High School.
