T
his month marks the fifth anniversary of the initial appearance of the “Supervisor’s Notes” column in Our Towne Guilderland. This column has proven to be an effective way to communicate with Town residents on current events in Guilderland. I regularly receive comments and/or questions from residents based on things they have noted in this column. I’d like to express my gratitude to Our Towne publisher Lowell Knapp for making space available for the Town Supervisor to communicate with residents. Please feel free to contact either Mr. Knapp or me if you have ideas on ways that we can improve the way we use this column. Please take advantage of the numerous recreational opportunities available to Guilderland residents as the summer moves into full swing. Enjoy a few quiet moments at one of our neighborhood parks- Abele, Fort Hunter, McKownville Reservoir, or Volunteer Fireman’s Park. Active recreation is available at Di Caprio, Keenholts, and Nott Road Parks. Tawasentha Park, the centerpiece of Guilderland’s extensive parks system, offers a blend of active and passive recreational uses, from hiking on the 5 miles of trails, to quiet picnics, to tennis and basketball, to swimming in the Town Pool. There were two recent changes of significance in our Town parks. After 37 years of service to the residents, and especially to the youth, of Guilderland, Dennis Moore has recently retired as the Town’s Director of Parks and Recreation. I’d like to thank him for all that he has done over the years. Also, we recently dedicated the wonderful new children’s playground area in Tawasentha Park that Dennis worked very hard over the past few years to turn into a reality. I would also like to recognize the fact that this playground was funded in part with funds received from the Guilderland MudMania races that have been held in Tawasentha each June for the past four years. A significant portion of the Albany Pine Bush Preserve is located in the Town of Guilderland. This globally rare inland pine barren area features an environmental education facility, the Discovery Center, on New Karner Road, which features interactive displays and a wide-ranging educational program for visitors of all ages. There are also over 18 miles of trails available for hikers and mountain bikers. For more information

Many Guilderland residents love the game of golf, and Guilderland’s own Western Turnpike Golf Course offers one of the most pleasant golf experiences that can be found in this area. Course conditions are excellent, thanks to the work of our groundskeeping staff, Guilderland residents are always able to obtain reduced greens fees by utilizing identification cards which can be obtained without charge at the golf course with proof of residency. Please contact the Pro Shop at 456-0786 with questions, or to book a tee time. Our Town Highway Department will have crews regularly circulating through Guilderland’s neighborhoods this summer to pick up bagged lawn trimmings and bundled brush. Please bag your lawn clippings, and use twine to tie bundles of brush in a way that one worker can pick them up and set them in the truck. For instance, we are a private membership funded organization. We do not get any kind of federal or state funding (except for the occasional grant or two) and most of our revenue and operating income comes from member dues, sponsorship, and event. We are considered a not-for-profit 501c6 organization. We like to think that the chamber is a catalyst if you will, that brings all of the parts of our community together. We help businesses and their people work together with the community and community organizations to help the common goals of the community. We do everything from assist our businesses in promotion and marketing, to introducing them to a possible lead or a connection that they can benefit from. We work with other chambers and organizations in the area to bring people from different parts of the region to together to help strengthen and grow their business. We plan LOTS of events and programming to get businesses involved and meet each other through networking, referral groups, committees, social media, and community events like Souped UP on Guilderland and Ladies Night which also sees a good part of regular folks in the area come out for a fun time. On any given day chamber staff and volunteers can be meeting with a new business, a prospective member or a current member and giving them advice on how to do business in Guilderland, Altamont, Voorheesville, or any part of our region (similar to a consultant!), answer any kind of inquiries from the community about who to recommend for a roofing job, hand out maps or directories to people who come in our office, planning an event or program, doing research on how to up the value for our members and their membership in the chamber, cut a ribbon for a grand opening, attend an event for a fellow member, meeting with one of our committees, reaching out to local legislatures about an issue that is effecting our businesses, in addition to anything and everything that comes through the door that day! Basically we are the connection that bridges the gap between our people and businesses. In some way, shape or form we are all affected by local business which is why it is important to support your local chamber with a membership, so we can help support local business! REAL ESTATE EXPERT REVEALS THE #1 REASON HOMES DON’T SELL Guilderland, NY - Over the years we have been fortunate to help literally hundreds of sellers sell their homes. A huge portion of these sellers were often listed for sale for 6 months, a year and in some cases even 2 years on the market without an acceptable offer before we get called to help. There are many reasons homes don’t sell including location, condition, follow up, flexibility of the owner, and marketing. However, probably 80% of the time when we meet with a seller that has been unable to sell a home after being on the market for a year it isn’t any of these factors. The number one reason homes don’t sell is asking price. Price trumps the need for updating, location, and even marketing. We can sell a home in any condition or location no matter how bad the market is if the price is correct. While this may seem obvious, mispricing your home can literally cost you tens of thousands of dollars. Real Estate agents will always tell you how great their marketing is and how it is different from all their competitors. Sure many agents have some great marketing programs. However, the reality is the average real estate agent spends more on auto repairs in a year then they will marketing homes according to national trade group statistics. We typically will spend over $10,000/month marketing homes. Our marketing is based on proven results and systems. However, no amount of marketing is going to overcome pricing on a home that is not supportable by the market. “Let’s start high and then we will come down” that is a phrase we hear often it is one that literally costs owners more time and money then realize. Here is another one “Our real estate agent said to try this price and see what happens”. There is no “try and see what happens in real estate”. You have one opportunity. Here is why. The parade in real estate only comes by once. Meaning the first few weeks a home is on the market will generally be the bulk of activity. During this time any buyers currently in the market will view the home, after the first month or so buyers will tend to come in sporadically as everyone has seen it and you are waiting for new buyers to enter the home buying market. Price it too high and you jeopardize this initial activity. No amount of price reductions or marketing can replicate the initial “parade” and buyers generally never circle back for a second look based on a reduction in price. The longer a for sale sign sits in front of your house the lower the perceived value in the eyes of buyers. If it really sits on the market too long with multiple real estate agents there is the risk of getting a stigma. In the old days, the days a home sat on the market were a closely guarded secret in the real estate community. Now Internet sites clearly indicate the days a 10

home has been on the market, even if it has been with three different real estate agents. Put yourself in a buyer’s position, are you really going to get excited about a home that has been on the market for 265 days and no one wants? Even when you get down to the correct price buyers always ask “what is wrong with that house that it hasn’t sold?” Pricing your home correctly and selling quickly will always net you more than pricing it high and instituting a series of price reductions. Yet pricing high and then reducing the price over time is common place in the industry. AN ALTERNATIVE SOLUTION TO “DISSOLUTION”
hen I tell people that I practice matrimonial law, they often think that the only thing I do is help people get divorced. While a large part of our practice does involve representing spouses in divorce proceedings, our practice also encompasses helping married clients who want to stay that way. Sometimes spouses have differences that they want to address and commit to resolving in a formal way, or perhaps they want to address a change in financial circumstances and plan for how those circumstances will be handled in the future. If the goal is to stay married but also legally resolve certain issues, a “post-nuptial” agreement is the solution. A “post-nuptial” agreement is an agreement that is entered into after the marriage. These agreements, if properly signed, are legally binding contracts that enable spouses to spell out the terms that they want to address. For example, suppose the wife inherits a large sum of money. Under New York law, this money is the wife’s separate property. Let’s also suppose that the couple would like to buy a vacation home with the wife’s inheritance but for various reasons the husband’s name cannot be on the deed.
If the wife buys the vacation home with her inheritance and does not add the husband to the deed, then the vacation home is also considered the wife’s separate property. This means that if there were ever a divorce or separation, the husband would not be entitled to share in the value of the vacation home 1. This may not sit well with the husband, particularly if the vacation home will require a lot of upkeep on his part. As a result, the husband may be reluctant to go along with the wife’s plan. With a post-nuptial agreement, the couple could agree on how the vacation home will be treated if there is a divorce or separation. For example, they could agree that the vacation home will be treated as marital property, which would enable the husband to share in its value. Or, the couple could agree that the vacation home will remain the wife’s separate property but the husband will receive a larger share of some other marital asset(s).
Post-nuptial agreements offer many possibilities. They can be drafted to address a single issue (as in our example above), or several issues at a time. People can enter into these agreements for a myriad of reasons, including distribution of assets and debts; estate planning; or determining financial responsibilities during the marriage. They can be particularly helpful to those people who, while not happily married, cannot divorce or separate because of the presence of children or health or financial issues. Marital discord does not always have to end with the marriage being dissolved. Gum Disease
What you don’t know can’t hurt you, right? Wrong! Not in the case of gum disease which is a leading factor in tooth loss in adults. We may have gum disease and not be aware because it can be painless. Not attending to our oral health in the area of gum disease may result in totally avoidable tooth loss affecting our overall health and appearance. Gum disease, also referred to as periodontal disease, is caused by plaque , the sticky substance which is constantly forming on our teeth. The ADA lists some warning signs and risk factors for gum disease. Here are some warning signs that can signal a problem: • • • • • • •

gums that bleed easily red, swollen, tender gums gums that have pulled away from the teeth persistent bad breath or bad taste permanent teeth that are loose or separating any change in the way your teeth fit together when you bite any change in the fit of partial dentures
Some factors increase the risk of developing gum disease. They are: • • • • • • •
poor oral hygiene smoking or chewing tobacco genetics crooked teeth that are hard to keep clean pregnancy diabetes medications, including steroids, certain types of anti-epilepsy drugs, cancer therapy drugs, some calcium channel blockers and oral contraceptives The key to preventing tooth loss is to treat gum disease sooner rather than later. Gingivitis, the early stage of gum disease, is easily treated and reversible. Professional cleaning at your dentist’s office along with daily brushing and flossing is the best approach. Advanced gum disease, called periodontitis, can lead to loss of tissue and bone, which support the teeth.

hinese philosopher Laozi noted that a journey of a thousand miles begins with a single step. Well-seasoned travelers will hasten to add that having the final destination and route in mind also contribute to a journey’s success. Individuals and couples would be well-advised to take the first step on their financial journey - enter the Financial Plan! A financial plan in its most basic form typically tries to answer the question, “Can I retire?” More specifically, a plan will try to project what level of income can be available at a given retirement age, based on several assumptions such as savings rate, investment returns, inflation, etc. However, a financial plan can and should go well beyond retirement planning to address several important questions, such as: • • • • • • • • • •
Are we paying unnecessary income taxes or capital gains taxes? How will I pay for the costs associated with higher learning? How should our investment portfolio be designed to best align with our goals and objectives? What do we want to happen to our assets if we pass away, and what’s the best way to accomplish this? How can I best gift assets to charitable organizations that are important to me? Should we be concerned about estate taxes even though we’re not worth millions of dollars? Am I taking full advantage of any benefits available from my employer? Are we properly using debt to leverage our personal balance sheet? Are there any opportunities to reduce our fixed expenses? Do we have proper insurance coverage in place to protect our lives, health, income, assets, etc.?
A well-designed financial plan will address each of the above issues, and provide an action plan for any adjustments that should be made to your current situation. A comprehensive financial planner will not only prescribe solutions, but will also work with you to implement any required courses of action. Being well-informed is not sufficient – e.g. knowing that diet and exercise are the keys to physical health is not enough without actually eating healthy and starting an exercise regimen. PILLOW TALK: GETTING A GOOD NIGHT SLEEP By: Dr. Kim Leis-Keeling
H
appy Summer Everyone! I hope you are all enjoying the warm days before they are gone. I know the kids just got out of school but it always seems that after the 4th of July, the summer goes so fast. With the heat of the summer nights, getting a good sleep can often be a concern. I’ve wanted to write about this topic for a while because it is almost a daily conversation in the clinic. Patients ask all the time about what mattresses and pillows I recommend. I thought I’d share the information with you. Let’s talk about pillows for a minute. Most people stuff one or two pillows under their heads which puts the neck in a flexed position and can strain the muscles of the neck and upper back. If you are using a standard pillow, I recommend using it two different ways. 1.
If you are a back sleeper, re-create your own cervical pillow by rolling the broad edge of the pillow. The size of the roll should be determined by comfort and body size. Generally speaking, if you have a thicker chest cavity then you will need a larger roll. If you have a thin chest cavity then you may end up with a half roll. Then place the rolled part under your neck as to cradle your neck and let your head rest over the flat part of the pillow. This will help to keep your head, neck and back in alignment. 2. If you are a side sleeper, then you need to have enough pillow thickness to fill the space from the edge of your shoulder to your neck. Again, if you have broader shoulders then you may need two pillows. If you have a petite frame then one pillow should be plenty. Make sure you pull the pillow into your neck to fill up the entire space. Avoid curling up into a ball. Let your body extend and straighten. 3. If you move from your back to side during the night then you may want to invest in a cervical pillow that allows for support in both positions. The only one I recommend to patients is called a Therapeutica Pillow. This is my favorite pillow on the market and one I use daily. It looks a little goofy and may take a few nights getting used to but well worth it. They come in different sizes so you will have to measure the distance from your neck to the edge of your shoulder. They are easily available online.

A few more sleep posture tips: • Sleeping on your back is ideal for support but if you feel pressure in your lower back then try putting a pillow under your knees. • If you feel pressure in your lower back or hips while sleeping on your side, then put a pillow between your knees and one in front of your torso (as if you were hugging the pillow). • If you wake in the night due to hip pain on the side that you are laying on, then try side sleeping with your bottom leg (leg on the mattress) straight. Then add a pillow in front of your pelvis to rest your top leg on. Body pillows work great for this position. You may need to roll slightly forward to take the pressure off your bottom hip. Let’s move onto mattresses. There is not one mattress that I recommend because everyone’s preference is so different. What I can tell you is the feedback that I get from patients regarding certain ones. •

There are lots of complaints about pillow top mattresses because they tend to breakdown within a few years and leave body indentations. Try a standard mattress of your comfort and add a pillow topper that can be changed periodically. Patients that have a Tempur-Pedic foam mattress have a love-hate relationship with them. Some patients love them while others dislike them because they tend to trap heat and can leave you sweating or they are too firm. Most patients seem to be happy with the Sleep Number beds and recently there have been good reports on the Serta iComfort mattress. If you and your spouse/partner like different firmness’s then it will be tough to find that one mattress that will make you both happy. The Sleep Number Mattress allows you to each set your own firmness. If you don’t like the air mattress idea, here is another suggestion. Each person picks out an individual twin mattress to his/her liking, then put them together like a king bed. Cover both with a king mattress topper and hold them together with a mattress pad and fitted sheet. It works pretty well and both of you can get a good night sleep.

Congratulations Class of 2014 This month I would like to use my article space to congratulate all of our students in the community that finished their year in school. It was a particularly important year for me because the students I had in my 7th grade math class at Farnsworth Middle School graduated from high school. It was my honored pleasure to teach them in 7th grade, some of them again in geometry or precalculus at the high school; for an elite few, all three. I made sure to clear my schedule to attend this year's graduation ceremony on June 28. It is so wonderful to know students and work with students for so long, and especially to share in their growth into adulthood. It is also very nice that when I see my students around I feel like I am running into a niece or a nephew. Being a teacher in our district and working with your wonderful children and my most supportive colleagues and administrative staff has been the most awesome experience. District seeks applicants for building capacity focus group Completed applications must be submitted by August 8
June 26, 2014—On Monday, June 16, Guilderland Central School District held a COMMUNITY MEETING with Dr. Paul Seversky, a consultant with the Planning Service at the Madison-Oneida BOCES, to discuss the results of the recent district-wide building capacity study. More than 100 residents—mostly parents—attended the meeting to learn more about the findings and options for consideration presented in Dr. Seversky’s report. “Thank you to everyone who joined us for this important meeting. Your interest and participation was very much appreciated,” said Superintendent of Schools Dr. Marie Wiles. “However, there is still much more work to be done.” Guilderland is at the very beginning of what will certainly be a long and thorough analysis of data and research to determine whether or not there may be more cost-effective ways to deliver its K-12 programming. While Dr. Seversky presented school leaders and the community with several options for possible consideration, they are all still just that— options. No decisions have been made at this point in time and the district is not recommending one option over another. On September 20, 2014, the district will host a community focus group activity, facilitated by Dr. Seversky, to get direct feedback from residents about each of the six scenarios outlined in the building capacity study report. The focus group activity will be limited to 30-36 participants, representing a cross-section of individuals and organizations within the school district, and will run from 8:30 a.m. to 2:30 p.m. Any district resident interested in participating as a focus group member is invited to apply no later than August 8. The Board of Education will review all applications received and is expected to appoint selected volunteers to an ad-hoc community focus group committee at the August 19 board meeting. For those individuals not selected or able to participate in the focus group activity on September 20, there will be additional opportunities for district residents to weigh in on the building capacity study report throughout the fall/ winter. The district is planning to hold additional community conversations on the topic (dates to be determined) and community feedback is always welcome through e-mails, phone calls or in person. “Exploring our options about how best to deliver our K-12 program is a huge undertaking; we will not take this work lightly,” said Wiles. “We will listen carefully to the perspectives of our entire community and hope that you will join us in this critical conversation.”

GUILDERLAND GARDEN CLUB NEWS Merril-Lee Lenegar
In celebration of the 50th anniversary of the Guilderland Garden Club, we are sponsoring an art contest to create an original design for the cover of our Anniversary Yearbook. Requirements for the contest have been developed with the help of Sheila Elario, Art Educator at the Farnsworth Middle School. The contest is open to all students entering grade 6, 7 or 8 in September 2014 at the Farnsworth Middle School. The cover design must be original work done by a student and promote the love of gardening and/or floral design. Entries must be postmarked by July 18, 2014. Details about contest eligibility and requirements can be found on our website at www.guilderlandgardenclub.com. Judging of the entries will be done by a committee including an Art Educator from the Guilderland Central School District and members of the Garden Club. Students will be notified by August 15 of the judges’ decision. One winning design will be selected to be used for the Anniversary Yearbook and that student will receive a $50 gift card which will be awarded at a reception at the Guilderland Public Library on September 23 at 5:00 P.M. All entries will be displayed at the Library during the month of September.
Guilderland Central School District was ranked No. 3 among 85 area school districts in The Business Review’s annual School Report for 2014 -- up three spots from last year. A school district’s overall score is a weighted tabulation that takes into account student test score results and graduation rates.
The July 14 meeting of the Garden Club will be at the Mynderse-Frederick House. The business meeting at 10:00 a.m. will be followed at 11:00 a.m. with a presentation on Garden Treasures, Pressed Herbal Design given by Jo-Ann Lee Gannett. The public is invited to attend the entire meeting, or just the presentation after which there will be an opportunity to enjoy refreshments and visit with the presenter. TRASH TALK and KEEPING YOUR COOL by Vince Coppola A comedian once said, “This area has 2 seasons, winter and July 11th”. Time to rejoice - it’s almost July 11th!!! Summertime is here…sunshine and great times with friends…mixed drinks on the patio, shrimp on the barbie. OK, so maybe in this economy it’s warm beer in paper cups and leftover Subway in the driveway, but we’ll take it (for more about taking things, read on!). Let’s focus on the positive: it is finally nice out. But…is it too warm? Better fire up the air conditioning…uh-oh! AC on the fritz? ARGH!!! Hey it lasted a whole year, that’s practically infinity for a modern appliance these days; in fact it is an antique at this point. What to do about properly disposing of the bad appliance? Well, first some information: Older air conditioners, central air condensers, dehumidifiers, refrigerators, freezers, water fountains and water coolers all contain refrigerants (Freon) like R-12 and R-22. It is believed that these substances are part of the reason for the deletion of the ozone layer and other problems in the environment. Even modern refrigerants are not the greatest but they are vast improvements over the older technology. Don’t let just anyone take these away for you; it’s time to call Scrapster.
