notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - As I write this notes, we are continuing with a cautious reopening of the local economy by entering Phase 4, the last phase in the State’s reopening plan. You can learn more about the State’s plan, including descriptions of each allowed business and associated mandatory requirements and recommended best practices: https://forward.ny.gov/. Phase 4 is not the last step in the State’s reopening plan which still leaves hundreds of small business in malls in limbo, provides no discernable reopening plans for theaters and gyms, and does not yet allow families and friends to visit loved ones in nursing homes. These situations present unique and difficult situations to handle during a pandemic. The Town’s reopening plan is similarly complicated by complying with now 45 Executive Orders containing hundreds of directives which pause or modify more than a thousand laws and regulations in response to the pandemic, many of which impact the Town’s delivery of services. The NYS Department of Health has also issued dozens of new protocols and health guidelines impacting how the Town can safely provide and expand the delivery of services to residents and local businesses. The pandemic never stopped the Town’s medics, emergency medical technicians, police officers, firefighters, animal control, and building and fire inspectors from providing essential, often emergency, services. Highway, parks, and water and sewer workers never stopped performing essential maintenance services and the occasional capital improvement. Town Hall employees never stopped issuing marriage licenses and death certificates, collecting payments and paying bills, updating property tax assessments, conducting virtual public meetings and hearings, officiating at outdoor weddings, and performing other “essential” services. After three months of minimum physical contact with residents, in mid-June the Town began operating under a Moving Forward Plan which allowed public access to Town buildings only by appointment or invitation. Here’s the current Plan with appendices: www.townofguilderland.org/sites/guilderlandny/files/uploads/ towns_moving_forward_plan.pdf After three weeks of careful monitoring of this initial public access by EMS supervisors, the Moving Forward Plan has been amended to allow public access to Town building for brief transactional activities, like paying bills or obtaining licenses, at counters with a sneeze shield and physical separation, and will now permit larger and longer meetings in designated rooms under health guidelines. Any person, whether a resident or employee, entering a Town building for any purpose, will have their temperatures taken and symptoms checked. All visitors will be asked for contact information for tracing purposes. The Moving Forward Plan mandates the wearing of facial masks in Town buildings or when receiving off-site services from a Town employee. This means that, for example, when a building inspector is performing required inspections in homes or at construction sites or a Water Department employee is making an emergency repair, all persons must be wearing facial masks or the Town employee has the right to deny the requested service. This health mandate is not open to debate.

The Moving Forward Plan has special requirements, endorsed by the EMS Department, under which the Tawasentha Park pool and Summer Peter G. Barber - Town Supervisor Recreation Program are now operating. The pool has capacity limits, and reserved times for adult lap swimming and open swim. The diving board was removed for maintenance and to increase pool capacity. The baby pool is also closed. Because of these capacity limitations, entry to the pool is restricted to Town residents. The pool rules and schedule are available here: www. townofguilderland.org/parks-recreation/pages/tawasentha-poolinformation The Parks & Recreation Department is also offering swim lessons for children: http://www.guilderlandrec.com/info/activities/default. aspx The Plan’s guidelines have required a reduction in the size of swim classes. Due to the reduced capacity, you can only register for one swim lesson session per child. Children in Levels 1 and 2 will require a parent in the water with the swimmer. Lifeguards will lead each parent and child through each level’s skills. The Summer Recreation program has begun under the Plan’s guidelines. The first week of the half-day Tawasentha Park program ran smoothly with children in small groups, regularly washing hands, and wearing face masks in an outdoor setting. Registration is required for the half-day program and the sports and enrichment camps. No walk-ins will be accepted. Registration for each week’s program or camps must be made by midnight on the preceding Thursday at: http://www.guilderlandrec.com/info/default.aspx After receiving the State’s clearance to open, Western Turnpike Golf Course has had a banner season. The excellent weather has created several consecutive four-day weekends. Reserved tee times are required at: www.westernturnpike.com. The Nines, an Italian-American restaurant, has extensive menu options for golfers, guests, leagues, and outings: https://sites. google.com/view/the-nines-at-western-turnpike/home?authuser=0 The Guilderland Performing Arts Center will open in July with a modified schedule for its 41st season, starting with Overture on July 9th. All concerts are on Thursday nights starting at 7:30pm and there will be no concessions stand. There is ample space on the hill side for physical separation. The rain location this season is the pavilion at Western Turnpike Golf Course. The Town’s extensive trail system is fully open, including five-miles of hiking trails at Tawasentha Park and nine miles at Vosburgh Trails, more than 20 miles of hiking and biking trials in the Albany Pine Bush Preserve, and about 2.5 miles (roundtrip) at the Mohawk Hudson Land Conservancy’s Bozen Kill Preserve. The Assessor is completed the Town’s final 2020 assessment which will filed by the Town Clerk by July 20th and soon thereafter made available on the Town website at: https://www.townofguilderland. org/assessors-office The final roll states that the total assessed value of all property in the Town is now $4,841,168,557. The NYS Tax Department recently confirmed that the Town’s 2020 equalization rate will remain at 100% which helps maintain fair and equitable tax burdens, particularly for property owners in school and fire districts which span multiple municipalities. I greatly appreciate the hard work and long hours devoted by the Assessor’s Office in conducting and concluding a fair and transparent assessment process. During this pandemic, the Town has greatly benefitted by having its own ambulance service which is staffed by a dedicated group of medics and emergency medical technicians. The EMS Department has kept response times (the time between the 911 call and ambulance arrival) to less than six minutes, well-below the national average of over 10 minutes. Town ambulances have transported over 80 positive COVID-19 cases, and with an innovative disinfecting regimen, the EMS Department has been able to deploy a full complement of ambulances at all times. The same equipment is used for the daily disinfecting of buses and vehicles used by the Department of Senior Services to transport seniors to supermarkets and medical appointments. GETTING THE MOST OUT OF RECOVERY TOOLS By: Dr. Kim Leis-Keeling Guilderland, NY - Sports and exercise recovery tools have come a long way in the past 20 years. Back in my years of college sports, we were told to go stand in the freezing cold whirlpool for 10 minutes after our practices or just ice whatever hurts. Now there are so many gadgets, tools or techniques that are available to athletes. With their gaining popularity, I thought I’d take some time to explain what these things do and best times to use them. First, let me explain some anatomy of soft tissue in the human body. These tissues are the ones most affected by using recovery tools. From the outside looking in, the outermost layer of tissue is the skin. The skin contains multiple types of nerve endings that communicate to your brain about what is happening to your body. For example, there are nerve endings that differentiate pain, heat, and cold, light touch and pressure. The next layer is fascia which is an interconnected web of connective tissue that is a barrier between skin and muscle. It also surrounds all your muscles, connects them together and allows for tissue glide. Fascia has 9 times the sensory nerve endings than muscle. The next layer is muscle tissue. So, what does this have to do with sports and exercise? By stimulating different nerve endings with various amounts of pressure, rates of friction and vibrations, you can get a response from the body to either relax muscles, stimulate muscles, inhibit muscle spasms, or increase hydration to certain tissues. Let me try to simplify with an example of how an athlete should use these principles to maximize their workout. Pre-workout: The athlete would want to activate the muscles they are going to use with quick rapid stimulation using a foam roller, recovery tool, stretching or vibration that lasts about 10 seconds per repetition. The goal is to activate muscle contractions to prepare for sport. Post-workout: The athlete would want to use techniques to stimulate the deeper nerve endings within soft tissue to encourage relaxation by using longer sustained pressure on a foam roller or recovery tool that lasts longer than 30 seconds. The goal is to relax tissues for lengthening and recovery. Here is a chart to help you find the best techniques and recovery tools to help speed recovery and get the most out of your workout.

Tax Planning vs. Tax Preparation

M

any people focus their attention on income tax preparation at the beginning of each year, prior to the annual April 15th income tax filing deadline (or for tax year 2019, the extended deadline of July 15, 2020). While filing income tax returns in a timely manner is certainly a prudent strategy, it is often too late to engage in any effective income tax planning, as the year for which you are filing your tax return has already passed! Income tax planning should be a year-round activity. Here are some items you may wish to consider for tax year 2020: • Ensure that you are on pace to make your desired level of employer-sponsored retirement plan contributions (401k, 403b, etc.). For 2020, the maximum employee contribution amount to such plans is generally $19,500 per employee, plus an additional $6,500 for those who are age 50 or older. Additionally, many plans now offer the option to make contributions to a Roth account. • Verify whether you are eligible to make a tax-deductible contribution to a Traditional IRA or a contribution to a Roth IRA. You can contribute as much as $6,000 to such an account in 2019, plus an additional $1,000 if you are at least 50 years old as of 12/31/2020. • Taxpayers in the 12% or lower federal marginal income tax bracket (taxable income of $40,125 or less for a single filer, or $80,250 or less for joint filers) may wish to take advantage of the

0% federal long-term capital gains rate. For example, a married couple with taxable income of $50,000 could realize up to $28,980 of long-term capital gains with no federal capital gains tax bill! However, please be aware that realizing capital gains may impact the amount of your social security which is taxable, and may impact eligibility for certain incometested programs. On the other hand, capital loss harvesting can be an effective income tax reduction strategy. Taxpayers are allowed to claim up to $3,000 per year in capital losses, in addition to washing out any realized gains, as a direct reduction in adjusted gross income. For a taxpayer in the 22% marginal federal tax bracket, a realized capital loss of $3,000 can reduce her federal tax bill by as much as $660.

Consider “bunching” or “prepaying” future charitable donations through the use of a donor-advised fund. Such a fund potentially allows a taxpayer to take an immediate income tax deduction this year for planned giving which may not occur until many years down the road.

Please consult your tax preparer and/or financial advisor to determine if any of the above strategies are appropriate for your overall financial situation. With taxes, as in many other areas of life, a little bit of planning can go a long way. We encourage you to make tax planning a yearround activity, and not just the one hour per year you scramble to assemble your records for your tax preparer!

Did you know that 1 in 10 people in Guilderland are food insecure? The Guilderland Food Pantry (GFP) has been serving the Guilderland and surrounding communities for over 42 years. During this time they have strived to make sure no one in our community goes hungry through a variety of services including but not limited to the physical food pantry, food delivery service, providing holiday meals, assisting with the Guilderland CSD school lunch and backpack programs, fundraising & community events and so much more. In 2019, GFP had 787 client visits serving 908 adults, 515 children and 156 seniors.

JUSTICE FOR ALL by Margaret C. Tabak

Guilderland, NY - About 15 years ago I represented a white woman in a custody dispute with her former husband, a black man. My client was concerned that if the judge were a person of color, s/he would be prejudiced against her. At that time, there were no judges of color to be found in the Capital District, so I said, "I don’t see that as a problem." Was I going to tell the mother of black children that being a judge was not a possibility for them? Sadly, all these years later, that county still does not have any judges of color. The tragic “police involved” death of George Floyd, and other men and women of color, has brought to light many issues regarding the treatment of minorities in the justice system. If we want judges to reflect the community make up, we need to look at the pool of potential judges- lawyers. Even though by the time I was in law school in the 80’s women had made enough of an inroad to make up almost half of the law students, there was only a handful of minority students.

Supreme Court judges are elected by District. The Third Judicial District consists of Albany, Columbia, Greene, Rensselaer, Schoharie, Sullivan & Ulster counties. There is a nominating convention where the candidate is selected. This is still a relatively closed process. In many districts, one party may dominate so that even if there is a contested general election, the majority party’s candidate wins.

When I go to Albany Law School now, the class composition reflects the United Nations, with a wide swath of men and woman students. As these students mature into their careers, we at least will have the option (and hopeful opportunity) to select judges from many backgrounds. Judges in New York State are elected and therefore becoming a judge is a political process. In counties dominated by one party, it is unusual to have a contested general election. Therefore, if a candidate is opposing the political party’s choice, s/ he needs to run in a primary election. As we are just coming off the heels of one, we should be aware that primaries are particularly important, and how essential it is to vote in them.

Judicial candidates cannot campaign on issues, they are basically limited to discussing themselves and general court administration. However, many groups do hold forums to introduce candidates which are, sadly, poorly attended. For the justice system to work best for everyone, we all need to be actively involved and it is heartening to see so much interest throughout the world on these issues.

Minority judges should not just be judges that reflect the area’s racial makeup, but also ethnic and religious. I am hard pressed to think of any judges in this area that are non-Christian, whereas many religions are practiced in our community.

I am focusing on County and Supreme (trial level) Court judges In 2019, with 100,00 registered Democrats in Albany County, 20% voted. 1

MOOOOOVING FORWARD By Tim Wiles, Library Director

I’d like to start off by thanking you all for your patience as we continue working through the stages of the coronavirus crisis. As I write, New York State is in great shape compared to the rest of the country, and of course we all hope this will continue, despite troubling developments in many other states. The library industry was never told by any part of the New York State government which of the four phases of reopening we fall under. After a while, we figured we were unlikely to get an answer, and so we began devising plans on our own, working in conjunction with our 28 partner libraries in the Upper Hudson Library System (UHLS), as well as with best practices emerging around the state, the country, and the world. Administrators, Information Technology Staff, and Department Heads have all been busy keeping up with the latest developments in the virus situation and leading a group of innovative staff who have been creatively reinventing services for online delivery wherever possible, This includes maintaining library operations: payroll, bills, building upkeep and virusrelated renovations, computer management, and planning for the next budget year— all in a climate of uncertainty and with the added difficulty of doing so remotely, without access to files and other important work tools. The once-simple act of ordering cleaning supplies and Personal Protective Equipment became a quest that involved many employees spending weeks trying every avenue until adequate supplies could be purchased. Perseverance!

CURBSIDE SERVICES

We are delighted that by the time you read this, we will have had curbside pickup for holds, the return of most borrowed material and curbside checkouts well underway. On the day we shut down, March 13th, there were 17,000 items checked out to Guilderland patrons, and thousands more of our items checked out to patrons of other libraries in UHLS. On a normal day, it would be startling to have 500 items returned in one day, so we hope that not everyone in town chooses to return immediately. There will be no fines charged for anything currently checked out, so feel free to ease into returning books, DVDs, CDs and audiobooks. Please hold off on returning Library of Things items (gadgets, board games, folding tables, etc.) until we are ready to accept them. You’ll find four sheds in our parking lot, with slots put into them to allow you to return materials. Each shed will be open for one

day, after which it will be locked for 72 hours, so that we can follow CDC guidelines for quarantining the materials. It is currently thought that all signs of the virus disappear with a 72-hour quarantine. But we are not taking any chances. After 72 hours, the material will be brought inside, laid out on tables, and zapped with an electrostatic spraying device, which kills bacteria and viruses with a high degree of efficacy. The entire library industry is based on a model of sharing physical objects, and, unlike a store or restaurant doing curbside service, everything gets returned. It is essential for the health of our staff and patrons, as well as for the safety of our business model itself, that the materials are virus-free before being checked out to another patron. We thank the Guilderland Library Foundation for their generous purchase of the sheds, along with other monies dedicated to antivirus expenses, which of course we did not budget for. We are grateful in turn for all who support the Foundation financially—they were, perhaps literally, a real lifesaver this time!

VOTE RESULTS

While we are thanking people, we’d like to thank the 7,500 or so voters who sent in their ballots and supported our budget by 64 percent! A vote of confidence from the community at a time like this is especially appreciated, and we will continue to work hard to maintain your trust and serve you effectively. Conventional wisdom says that since school and library budgets are the only budgets in America over which voters have direct control, the higher the voter turnout, the more likely budgets will not pass. New York State voters made an solid investment in their future, passing over 99% of such budgets this year. Thank you! We thank the five candidates who ran for the library board, three of whom were incumbents. We are grateful to outgoing trustees Herb Hennings and Phil Metzger, who were both great library trustees. In addition to being Vice-President of our board, Mr. Hennings was also our representative on the UHLS board, and was a staunch advocate for libraries in our annual lobbying efforts downtown. Mr. Metzger was a valuable trustee who will also be missed. We are grateful to Mark Keeling for running again and winning re-election, and we are excited to welcome two new trustees, Marcia Alazraki and Dr. Richard Rubin, to the board.

LIBRARY RENEWAL PROJECT

On the building renovation and expansion front, we are excited to say that we remain on time and slightly under budget at this point in the planning process. We submitted our documents to the State Education Department right on time at the end of May, and we anticipate a fairly quick approval. The current plan is to go to bid In October, and to begin work as soon as possible thereafter. That could be right away, depending on the market for construction jobs and the weather, or it could be the spring of 2021. Either way, we continue to project a grand reopening in July of 2022. The project is being planned carefully to minimize any necessary closures and disruptions. Especially after the coronavirus situation, we are being as proactive as possible to ensure we don’t have to restrict access or services any more than necessary.
