s it autumn already? Summer, which this year gave us alternating spells of cool and hot and wet and dry weather, seems like it arrived only yesterday, now here we are, breaking out the sweaters and blankets and reading dire forecasts for the upcoming winter in The Farmer’s Almanac. Speaking of the cooler weather, the arrival of fall finds many of our residents using their fire pits, both portable and back-yard varieties, once again. These devices are an opportunity for pleasant socialization, but I would ask that all of our residents be very much aware of fire safety when using them. I would also remind everyone that it is important to be considerate of the neighbors in terms of the hours that fire pits are used, and in terms of the sound volume generated at gatherings. Let’s all enjoy the season! We have been hard at work for the past couple of months on the 2014 Town of Guilderland budget. This has been a challenge since the beginning of the economic downturn that started in 2007, but strict cost controls and workforce restructuring have enabled us to hold the line on the Town tax rate during the downturn. This year, we have maintained our conservative approach to budget preparation, and are at the same time benefiting from the slow rebound in the national and regional economy. The Supervisor’s Proposed Budget has been reviewed at several public budget workshops. It has now been officially submitted, and is available at the Town Clerk’s Office or on-line at www.townofguilderland.org. The Town Board will vote on this proposal when it meets on Thursday, November 7. The annual leaf pick-up program conducted by the Guilderland Highway Department will begin this year on Tuesday, October 15. The collection schedule was mailed to residents as an insert in the Guilderland TowNews newsletter that was sent last month. The schedule is also posted on the Town website, www. townofguilderland.org. Highway Department work crews will have their leaf vacuum trucks circulating through our neighborhoods while you are working on your fall yard cleanup. Please rake only leaves and evergreen needles to the curb for pickup by our vacuum trucks in those areas of town where these vehicles are able to operate. Other Highway Department crews will pick up bagged leaves and brush tied in bundles where it is appropriate. Please be conscious of safety while you are doing your yard cleanup. Avoid piling leaves or brush so high that they interfere with the visibility of pedestrians, cyclists, or cars. If you have any questions about this program, please contact the Guilderland Highway Department at 861-5108. There are all sorts of things to do in Guilderland during autumn. Recreational opportunities abound in our Town parks, at Western Turnpike Golf Course, and in the Pine Bush Preserve. I encourage everyone to get outside and enjoy the fall weather. Here are several ways to prevent cavities from Halloween candy: • Limit the total amount of candy (sugar) • Eat a few pieces at one time, instead of several times throughout the day • Avoid extra hard or sticky candy • Brush and floss the teeth to remove sugar and plaque before it can do damage • Drink water to dilute the acid and remove food debris • Chew sugar free gum to remove food debris and stimulate protective saliva flow Using a combination of these steps will help minimize the risks of cavities in your family’s teeth, especially when our homes are filled with Halloween candy this fall.

A
few days ago, I was looking at some old pictures with my son and I came across this photo of him at age 2. I dressed him in this lion costume with a thick furry mane around his face. All you could really see were his big blue eyes and his chubby cheeks. I donâ&#x20AC;&#x2122;t even think he could say â&#x20AC;&#x153;trick or treatâ&#x20AC;? yet. Of course I thought he was adorable and he was too young to give me his opinion on my costume choice, so I took advantage while I could. Needless to say, he was pretty h embarrassed when he saw the picture and was not happy with me for dressing him like the Cowardly Lion. With Halloween almost here, I was planning on writing aboutt all the statistics regarding the amount of sugar in candy and soda. I was going to explain why sugar is bad, what health problems it causes, how it can lead to cavities, blood sugar issues, obesity, inflammation, etc. But then I decided that you have probably already heard what I was going to say. Instead, I would like to invite you to try something new with that Halloween candy this year. The dilemma is that our little zombies and lions get all excited about seeing how much candy they can accumulate in a few hour time span and then the parents spend the next few weeks telling them they canâ&#x20AC;&#x2122;t eat it and trying to figure out ways to get rid of it (without eating it all themselves ). Show Me the Money Do you remember the movie “Jerry Maguire”? Even if you don’t remember what the movie was about, you undoubtedly remember the scene where sports agent Jerry Maguire (played by Tom Cruise) is talking on the telephone to his football star client Rod Tidwell (played by Cuba Gooding, Jr.). During their conversation, Jerry asks, “What can I do for you?” Rod’s response: “Show me the money!” The scene culminates with Rod cajoling Jerry into shouting “show me the money” at the top of his lungs. The point that Rod was trying to impress upon Jerry was that the NFL team could (and should) pay Rod more money to compensate him for his incredible talent. Jerry’s job was to go find the money. I know what you’re thinking. What does this movie clip have to do with family law? In many family law cases, child support is an issue. In New York, a parent has an obligation to support his/her child until the child turns 21 years old. A non-custodial parent will be required to pay “a fair and reasonable sum” for child support to the custodial parent as determined by the Court.1 New York presumes that a certain percentage of a parent’s income is reserved for child support. For example, if there is one child, the non-custodial parent must pay 17% of her adjusted gross income for child support. The more children there are, the higher the percentage.2 To determine the amount of child support, the Court applies a statutory formula and calculates the percentage based upon the parent’s gross total income “as should have been or should be reported in the most recent federal income tax return.”3 This calculation is fairly easy to do when the non-custodial parent has stable employment and her earnings are reported on a W-2. But what happens when the non-custodial parent is self-employed, or unemployed, or paid “under the table”? How can the Court calculate child support when the non-custodial parent’s income may not be fully reported on an income tax return?
In those circumstances, the Court will essentially say “show me the money” so that it can impute income to the non-custodial parent. It will be up to custodial parent to find the money that the Court could impute to the non-custodial parent. This can be done by proving that the non-custodial parent did not include all of her income on her income tax return, or that she has other resources from which the Court can impute income, such as “money, goods, or services” provided to her by family and friends.4 Where the non-custodial parent is unemployed, the custodial parent will need to prove what that parent is capable of earning. If he is successful in doing that, then the Court can calculate the non-custodial parent’s child support obligation based on what she could be earning and not on what she is earning. Imputing income is a sophisticated process and can be difficult to do, and so it would be wise to seek the counsel and advice of a skilled and experienced family law attorney before you attempt that process on your own. Love Where You Live!
I
always loved the fall. Maybe because my birthday is in the fall and growing up as a kid makes that season really important. Maybe it is because football starts up. Maybe I just like the leaves and the chilly air or the return to things academic. Probably it is a combination of all of those. I have an appreciation of all seasons and that’s why I love where I live. In the same year it can be 100 degrees with 100 percent humidity and minus 20 and my car’s engine won’t turn over. That amazes me and I love it; variety is the spice in our area. These differences are actually really small on the scale of our universe, but they entertain me tremendously. I love following thunder storms in the summer and snow storms in the winter. The lesson here is to love where you live. Enjoying where we live and being part of a community is very important. If you don’t like the climate where you live, you must have a plan in place to change it. If you don’t then you are denying yourself of a major portion of a happy life. Don’t do that to yourself. If you have plans, or desire to make them, I caution you to consider how it fits in with your family needs. Too many people I know make a huge move to a warmer climate, but are denied the family activity they were used to, or at least have much bigger plans for visits than become a reality. No matter what your situation try to always look on the positive side of everything. If you don’t like certain aspects of the weather, at least for goodness sake don’t complain about it. All you will do is spread crabbiness. Too many people just love to spread crabbiness, don’t be one of them. Life is full of yin and yang; it has to be. You cannot appreciate your idea of ideal weather unless you experience your idea of bad weather. The study of martial arts provides many examples of the combination of yin and yang and how it parallels our everyday life. It helps me focus on what is really important in life and it helps me understand the balance that makes up our lives. When you understand these things you appreciate everything that comes your way: the soft and harsh, the warm and cold, the sadness and joy, the winning and losing. Get out there, enjoy the fall, and be happy where you live because it is awesome. If you can, catch a football game at Guilderland High School. The last two home games are October 4th and 18th. There is a lot of energy, excitement and fall weather at those battles, and it is full of yin and yang.

Established January 2013, Published September/October 2013 Q. Where are you located? A. I’m a Guilderland resident- I have a home office (but people don’t need to come to my home- I am on the road a lot. Last September I was at an event down state (“The Festival of Change”, which was a weekend inspirational retreat). It was sponsored by the local edition of Natural Awakenings Magazine (Rockland/Orange Counties). I am a previous small business owner, and for the past few years I had been feeling the itch to break out on my own again in some way and really live a more fulfilling life doing something I love. I hadn’t figured out what that would be, but when I was at the event and I saw the magazine and flipped to a page with a girl jumping up in the air and read the words, “Turn your passion into a business”…own your own magazine… it was like a lightning bolt moment where I knew that the perfect thing had arrived in my hands. Being a publisher for Natural Awakenings Magazine combines all of my personal strengths. It’s like everything I’ve ever done in my life had lead me to this profession. Q. Are you known for anything special? A. My smile and positive outlook (I will always spin things that way). I also sing with Capital Community Voices in East Greenbush and have performed on stage in musical theater productions with Class Act Productions in Troy. Q. What do you love most about the business? A. The best thing has been getting out in the community and meeting the most wonderful people! Every day I get to be out interacting with the nicest individuals. The support for the publication has been so overwhelmingly positive. Q. What do you want the community to know about you? A. One thing to mention is that in 2011 I suffered a lengthy, debilitating illness that baffled me and the medical community. I don’t tend to get sick, and it takes a lot for me to even go to the doctor. This condition kept me bed ridden and unable to carry out my daily activities for several months. It was extremely disheartening and the doctors sent me for so many tests. I finally decided to take matters into my own hands and take an alternative approach. I found The Stram Center for Integrative Health and Healing in Delmar where they got to the bottom of a toxic reaction I was experiencing in my environment. The experience of being ill for so long, of course, gave me much time to think and really evaluate my life too (since I look for the meaning in EVERYTHING!). I knew I was working in a job that was running me into the ground physically from so much perpetual stress (retail management), and I was not ultimately feeling fulfilling on any real level or living as an authentic expression of who I really am. That year was a turning point for me in so many ways, and in 2012, as I regained my full strength, I was determined to make changes for the better. All of that led to me seeking new opportunities to express myself and seek out a new career/entrepreneur opportunity.

Meet Chopper (aka Homer)! 1 1/2 years old neutered male; UPD on shots. Chopper walks well on a leash, is potty trained, knows basic commands, is extremely eager to learn, has been to many events including boating on Sacandaga, downtown Saratoga to restaurants and shops, the car show in Lake George, etc. He is excellent with all dogs, kids, and people. Being that he is still a puppy he will need guidance, additional training, and an active owner. He (like any other puppy) still chews. He loves car rides. He has consistently displayed an even and calm temperament with other dogs and children. Despite his size and appearance, he can be a very gentle dog.
