South Florida Takes Pride in Historic Significance

O

n an early April day, a bit more than 500 years ago, Spanish Explorer Ponce De Leon landed near what is now Saint Augustine and claimed it for the Spanish crown. He subsequently sailed down the east coast surveying the land in what is now Broward and Miami-Dade Counties. It is amazing how far we’ve come since those fateful days. At the time of Ponce De Leon’s arrival, the only residents of South East Florida were a Native American tribe known as the Tequesta. The region’s total population at the time is estimated to have been between 800 and a few thousand inhabitants. The population remained largely unchanged for the next 400 years. Shortly after its founding, Broward County had a population just over 5,000 people and consisted mostly of uninhabitable wetlands. Today, Broward and Miami-Dade Counties are home to more than five million people; few areas in the world have grown faster over the past century. We have the fifth and sixth largest school districts in the United States. The region also boasts a vibrant economy and diverse culture. The area’s rapid growth and unique climate have brought unique challenges: Will we be able to continue to create jobs for continued immigration and the maturation of the huge population of school-aged kids? How will we manage rising sea levels in a region so dependent on tourism? Can we continue to integrate the varied backgrounds and perspectives of residents and newcomers? How can we guarantee freedom and safety for all? We are optimistic. South Florida is a young, dynamic region that has solved difficult problems in the past and will do it again in the future. Our brightest days are still ahead. We, for our part, are proud to be part of this community and can’t wait to see what the future holds. Sincerely,

EAB Installs Free Little Libraries in Two Cooper City Locations BY DEBBY TEICH

C

ooper City residents now have access to free books 24/7 and they don’t even need a library card. The Cooper City Education Advisory Board (EAB) recently dedicated two fully-stocked Little Free Libraries in Cooper City. They are located in front of the Cooper City Pool & Tennis Center, 11600 Stonebridge Parkway, and at the north entrance to the Cooper City Sports Complex, 10510 Stirling Road. The libraries house books of all genres for children, teens and adults. The Little Free Library is a nonprofit organization that inspires a love of reading, builds community, and sparks creativity by fostering neighborhood book exchanges around the world. Through Little Free Libraries, millions of books are exchanged each year, increasing access to books for readers of all ages and backgrounds. To fund the project, EAB received $1,025 from the City of Cooper City to build the handmade boxes. They also capitalized on a promotional offer through the Little Free Library organization, which sent Cooper City a box of books, including a variety of fiction and non-fiction books, romance novels, children’s books and more. Local schools and

residents also donated books to the libraries at the ribbon-cutting and continue to do so. EAB members serve as the library stewards, maintaining the inventory, as well as the grounds surrounding the posts. “The members of the 2017 Education Advisory Board are so pleased to be able to bring this to you,”

said Jena McClure, Chair, Education Advisory Board. “We are so grateful to the generous Cooper City Commission who approved the funding in our budget to allow for this and other projects which the EAB endeavors to bring to the children and families of Cooper City.” To borrow a book, simply open the door to the library and browse through the inventory. You can read your book of choice at home, while you wait for your children to finish soccer or during a workout on the treadmill. When you are finished reading, share it with a friend or neighbor or bring it back to any Free Little Library site to continue the sharing. If you have a new book to share, add it to the existing collection. According to an informal survey of over 3,000 Little Free Library stewards and fans conducted by the Little Free Library staff: ▸▸ 74% of people report they’ve read a book they normally would not have read because of a Little Free Library. ▸▸ 73% of people say they’ve met more neighbors because of a Little Free Library. ▸▸ 92% of people say their neighborhood feels like a friendlier place because of a Little Free Library. In the 1970’s and 1980’s, it was also home to the Kapok Tree Restaurant, where many celebrated weddings, anniversaries, graduations and other momentous occasions. The Kapok Tree closed in 1988 and the county bought the property two year later. In 2008, it became the Long Key Natural Area and Nature Center. want to give credit where credit is due. So, perhaps a confession can help clear the air so there’s no misunderstanding. Before I talk about my confession, though, let me say a few other things first. Let me start by explaining the photo in this letter. You know, when I meet people in town they usually say, “Oh, yeah, I know you, you’re Dr. Rick. I’ve seen your ad with that picture of you and your family.” Well, I’m the guy on the left. Twenty-five years ago something happened to me that changed my life forever. I was a junior in high school and I started getting migraines. I had suffered from intense headaches since childhood. Over the years, I consulted many medical doctors, and specialists. I went through all kinds of tests, MRIs, and treatments. I tried every drug in the market; our medicine cabinet looked like a hospital’s infirmary. And still, nothing helped. But there’s more… A friend of mine convinced me to give a chiropractor a try. The chiropractor examined me, took X-rays, and then “adjusted” my spine. The adjustment did not hurt; it actually felt good. And guess what…I started feeling so much better! Artis Senior Living to Open New Memory Care Assisted Living Community in Davie

I

n July 2018, Artis Senior Living will be opening a 72-suite memory care community in Davie for seniors affected by Alzheimer’s and other forms of dementia. Residents will be able to move freely among neighborhoods in the one-story, 35,000 square foot community. They can also take advantage of an outdoor area on three acres of secured land. The community is strategically located at 2794 S. Flamingo Road, so it is easily accessible from Florida’s Turnpike, I-595, and I-75. Amy DePreker, Vice President of Sales & Marketing, answered some questions about the new Memory Care Assisted Living Community. Describe the community. The community will be comprised of four neighborhoods designed to create

an intimate environment with familiar living spaces. Find a New Pet at the Dog Adopt-A-Thon BY DEBBY TEICH

T

he 2nd Annual Dog Adopt-A-Thon, sponsored by the Cooper City Recreation Department and the Cooper City Teen Council, will be held on April 21, from 10am-1pm. Approximately 100 furry friends will be looking for loving homes. The event will be held at Memorial Park, located behind the Community Center and City Hall. “This event is important to promote not only dog adoption, but fostering,” said Felicia Trainor, Recreation Program Specialist. “Lots of rescues are limited on the number of animals they can help, because they are short on foster homes. We hope this event can also assist rescues in finding families willing to foster.” The Adopt-A-Thon will have small meet-and-greet areas, where guests can play with the dogs to see if they are a good fit for the potential owner’s lifestyle. It will give them an opportunity to bond with the animals before making a selection. The event also includes all of the resources a new pet owner might need, such as local vets, groomers, pet stores and trainers. The dogs are coming from local rescues. They have already been vaccinated,

so most can be taken home from the event. Some of the Rescues require house checks, which can be done the day of the event for residents of Cooper City and neighboring communities. The Cooper City Teen Council consists of ten members that range in age from middle school to high school. This year, the teens coordinated holiday cookie decorating and card making at Light Up Cooper City, as well as this year’s Color Run. Danielle Selevan, who is in 8th grade, has been a member of Cooper City Teen Council for the past three years. She joined because she wanted to help the city and take on a leadership role. She has a dog and a cat. “The adopt-a-thon is important, because there are so many dogs that are looking for a loving family,” said Danielle. “It is a great way for families to find the perfect dog, since there are so many different dogs in one place.” Kimber Counts, who is in 10th grade, has been a member of Cooper City Teen Council for almost five years. She has a dog named “Rocket.” “The adopt-a-thon is important, because there are too many dogs out there without homes and participating in the adopt-a-thon will help them find them,” said Kimber. “People should attend our adopt-a-thon to spread awareness and get more dogs adopted.” For information, visit www.coopercityfl.org.

housands of residents from Davie and across Broward County gathered for the 81st Annual Orange Blossom Festival, Parade & Rodeo. “Orange Blossom continues to become more successful every year with the addition of new vendor displays, entertainment, youth groups and sponsorships,” said Jeffrey Pohlman, Assistant Director of the Town of Davie Parks, Recreation and Cultural Arts Department. “For 81 years, the tradition of Orange Blossom has become rooted in the Town’s history and is a special time for all Davie residents to enjoy and make new memories with their family and friends.” There were over 250 displays including arts and crafts, cottage foods, plants and more. The festival featured an animal petting farm, “Cowboy Town”, Native American display, western carriage display, commerce corner, information displays, green product displays, rides, climbing wall, family entertainment, and four local bands. Real cowboys and cowgirls from around the country competed for championship titles as they challenged 2,000-pound bulls, rode bare back, wrestled cattle, competed in barrel racing and more. Visitors purchased fresh home-grown vegetables and fruits at the old fashion farmers market. The Town of Davie and Central Broward Water Control District are looking for groups, families, or individual residents who want to help clean and pick up trash from the area’s canal banks on April 21. They will be participating in the 21st Annual Waterway Clean-up, a public awareness campaign to keep the waterways clean. The deadline to register is April 6. “The Town of Davie Waterway Cleanup provides a personal experience connecting volunteers with the issue of trash pollution,” said Leona Henry, Town of Davie Public Relations Coordinator. “Volunteers recognize first-hand the need to keep our waterways clean and free of debris and dispose of waste responsibly.” In the past, volunteers found many large items,

18th Annual Relay For Life of Davie/Cooper City Helps Fight Cancer BY DEBBY TEICH

I

n the U.S. this year, there will be an estimated 1.7 million new cancer cases diagnosed and 601,000 cancer deaths. On April 28, thousands of people who have been touched by cancer will gather for the 18th Annual Relay For Life of Davie/Cooper City, hosted by the Town of Davie. It begins at 6pm at a new location, Bamford Sports Complex. The 12-hour overnight event, for ages 3 to 93, will last all night, because cancer never sleeps. “The family-friendly event honors cancer survivors and their care givers in an attempt to fulfill the American Cancer Society’s mission to save lives, celebrate lives, and lead the fight to a world without cancer,” said Dayami Gomez, ACS Community Development Manager. Relay For Life is the nationwide signature event of the ACS. It gives participants a chance to celebrate the lives of people who have battled cancer, remember loved ones lost, and fight back against the disease. Anyone can volunteer, form a team, or join a team. This year’s event will have the same key elements as always, in addition to some new ones. It will still feature the traditional activities honoring and supporting those who have had cancer, such as the Opening Ceremony/Survivors Lap (6pm), Luminaria 26 APRIL 2018 | OURCITYDAVIE.COM

Ceremony (9pm) and Closing Ceremony (6am). Teams will also have an opportunity to walk all night and are encouraged to dress up and decorate their campsites in this year’s theme - “Come One. Cure All. The Greatest Hope on Earth.” It is the first year that the event will be held at a park instead of a high school. It includes several new activities for people who want to attend, but do not want to stay all night. There will be live entertainment, dancers, crossdressing pageants, celebrity and sports personalities, interfaith services and more. There will also be vendors, selling handmade jewelry, art and more. Forty-two teams participated in last year’s event and raised over $135,000. This year, organizers are

hoping to have approximately 50 teams and raise over $150,000. Teams have already held a variety of fundraising events, such as David Posnack JCC’s Yoga with a Purpose; City of Cooper City’s Color Run; Cooper City Optimist’s Quarter Option and more. This is the 4th year that the City of Cooper City will have a team. Last year the Cooper City Purple Posse raised approximately $5,000 and they are hoping to raise even more this year. “We must fight cancer and try to find a cure,” said Denise Lasarte, team leader. Students Read to a Horse During Rotary Literacy Event BY DEBBY TEICH

H

orses are a common sight in Davie. They are typically ridden, trained, fed, groomed and loved. Approximately 350 first grade students from Flamingo Elementary, Davie Elementary and Driftwood Elementary recently had the unique opportunity to read to them during the 13th Annual Wild Horse Tales Children’s Literacy event at the Bergeron Rodeo Arena. Hosted by the Davie-Cooper City Rotary Club in conjunction with the South Florida Trail Riders Association, the program promotes literacy by combining live horses with classic horse literature. In January, the students got to see and touch a horse at their school. The Davie-Cooper City Rotary Club also provided each of them with a hard cover copy of “Little Black, A Pony” by Walter Farley. In the book, a little boy is in love with horses. When he gets into trouble, he relies on Little Black to save him. The story is about friendship and unwavering loyalty. After the students spent five weeks reading the book in class, their Wild Horse Tales reading adventure continued at the Bergeron Rodeo Arena. “This Wild Horse Tales Children’s Literacy event is amazing,” said Steve Chorba, Davie-Cooper City Rotarian, who is a former teacher. “For several years, I have had the privilege of assisting these first graders at this event to read to a horse. It just gets better and better.”

The morning began with members of the South Florida Trail Riders making a grand entrance into the arena and circling around to demonstrate some of their riding skills. Next the children rotated to ten different stations to learn about horses and how to care for them. After weighing a horse, an entire class stepped on the scale to see who weighed more. They learned how to groom and shoe a horse; put on a saddle; and identify the parts of horse. They also toured a horse trailer and learned about the history of cowboy gear and attire. The most exciting part of the day for many of them, however, was when they got to read a portion of their book to the horse. “This Wild Horse Tales Children’s Literacy event is truly the most impactful thing that our Rotary Club is involved with,” said Darrell Stuehrenberg, who has been a Davie-Cooper City Rotarian for forty years. “The students are blessed with an entertaining and educational opportunity to assist their ability to read.” Established in 1971, the Davie-Cooper City Rotary Club currently has 25 members, many of whom have been in the club for over 20 years. They live in Davie, Cooper City and the surrounding areas. The club meets on Wednesdays, at 12:15pm, at the Blue Moon Diner in Cooper City, and welcomes visitors. End School Shootings with Real Solutions Marjory Stoneman Douglas Senior, Richard Doan, Shares His Account of the Horrific Parkland Tragedy and Demands Action to Keep Schools Safe verybody looks forward to senior year. After three years of high school (some after just one or two), many people can’t wait to leave and head off to college. Personally, I was looking forward to prom, graduation and infamous senior year shenanigans. I had hopes and dreams of attending a university and embarking on a future career in finance. Preparing for graduation and college was all that was important to me, but within a matter of minutes, all of those beloved goals and aspirations vanished. It was Valentine’s Day. It was supposed to be a day of love and joy, and for most of the day, it was. Up until 2:20 p.m., when the fire alarm went off. I was in the newspaper room when it all happened. We followed the traditional protocol and walked to our designated evacuation zones. We were on our way downstairs when I saw kids running back inside. Teachers yelled at us to run as well. I ran as directed, but in the back of my mind, I thought it was just a drill. Ever since the school board has implemented stricter safety policies this year, there was a rumor going around that we’d have an active shooter drill on campus. For many of us, that’s what we thought it was. The teachers said it was a code red, but that didn’t mean it wasn’t all a drill. We rushed back to the newspaper room, shut the lights off, and huddled into the corner of the classroom. I heard sirens wailing and choppers echoing in the distance. Soon enough, we saw a tweet from the Coral Springs PD to stay away from Stoneman Douglas. That was

when we realized it was not a drill. It was real. Eventually, we transitioned to the classroom closet where we stayed for about an hour and a half. We were scared. We were worried. We were in disbelief. We followed the news as it unraveled online. We watched live streams and kept a close eye on Twitter. It was hot and cramped in the closet, but none of that mattered in this life-ordeath situation. We hear voices in the hallway. “Police reporting,” they said. It was multiple voices. Then with a faint rattling of what I presumed to be keys, our classroom door was opened. I recall someone asked if anyone was there. We didn’t move. We didn’t know who it was. It could’ve been the shooter for all we knew, but my teacher’s intuition told her otherwise. She opened the closet door to the three men in our room. At that moment, I didn’t know if I was going to be shot or be saved. Thankfully, it was a rescue mission. They were SWAT — heavily armed and heavily protected. Their flashlights shone upon our faces, and we were ordered to step out with our hands up. The SWAT team then secured our room and the building. Eventually, they escorted a large number of students and faculty from neighboring classrooms to our room. One hundred sixty-seven students and teachers in total gathered in this one room. Later, we were moved to the media center where we sat and were given directions about evacuation for a few minutes. the floor along with Valentine’s Day flowers and stuffed animals. When we stepped out, our eyes met a sea of law enforcement, ambulances and media surrounding our school. I was in utter shock. This is my school. This all happened here. Initially, I was in complete disbelief. I didn’t process it all yet. I am probably still processing it. This is my hometown: Parkland, Florida. Marjory Stoneman Douglas is my school. This is supposed to be a safe place. Virginia Tech, Sandy Hook, Las Vegas. This is the stuff we hear on the news, but no one ever thought it could happen here. If a mass shooting like this can happen here, it can happen absolutely anywhere. I am frustrated. There were signs. As with any mass shootings or suicide, there were signs. Yet they were overlooked, and because of that, 17 beautiful and innocent lives were taken away too soon. As for my mom, she’s been through the Vietnam War as a young child, yet she says that nothing compares to what she felt this past

Wednesday. It may sound cliché, but this truly was a parent’s worst nightmare. There is no greater fear than not knowing whether your children are safe, whether they will make it out alive, whether you’ll ever be able to tell your child that you love them again. In all the chaos, I forgot to return my mother’s messages for an hour. She tells me that was the worst hour of her life as she feared for her boy, not knowing if she would ever see me again. We are taking our time to grieve and to pray. People from around the world send their thoughts and prayers to us, and for that, we are truly appreciative. But frankly, thoughts and prayers themselves don’t do much. We must turn our thoughts and prayers into action. Our community feels distraught yet invigorated. The media is here. The whole world is watching, and this is our chance to be heard and make a difference. That way, something like this will not happen anywhere else. No one deserves to feel the

Far-right conservatives argue that we students are in fact not students, but crisis actors, travelling to scenes of tragedies to push some liberal anti-gun agenda. We wish we are acting. We wish this is all a hoax. We wish these deep emotions of misery, anger and frustration aren’t real. But it’s not. We are students. This is real and we

torment that we are experiencing right now. No one deserves to lose a loved one this way, and we are taking steps to ensure that this never happens again. Mass shootings in America aren’t anything new. Gun violence isn’t something rare, but it definitely cannot be something we get used to. Here in Parkland, we are turning our mess into a message and our pain into power. We are the voices for change. This is our moment to be heard. The media is here now, and they’ll probably be here for the next few days or weeks. But after that, they’ll be gone, and our story will probably just become a passing memory. So the time to act is now. My classmates and I are just children. The people in D.C. are the adults, and they must step up and do their jobs – protect and preserve this nation that we all hold so dear. Let our voices reach the legislative offices up in D.C. and get our congressmen and women to act. My friends are dead. Children are dead. Blood is spilled on the floor of our classrooms. We must do everything we can to ensure that Marjory Stoneman Douglas is the last school to suffer from a mass shooting. This isn’t an issue of red vs. blue. This is an issue about life and human suffering. It is rather a moral issue that can be solved through political action. Legislators and the people in office must do all they can to preserve life and protect the people of

Through bipartisanship and working across the political aisle, I believe it can happen. I believe in compromise. Practically everyone recognizes that there is a need for change. Though people have their own views on how to enact such change, there is nothing wrong with a difference of opinions. Such divergence can in fact foster intelligent discussion and the exploration of all possible options, but we must let all viewpoints be heard and acknowledged. I believe most feel we need to pass some common-sense gun laws. I believe we can agree that we must keep guns out of the hands of those who show signs of malicious intent. I believe we can agree upon widening the information stored in background check databases and increasing restrictions on the acquisition of firearms for the mentally ill. From there, we’ll work upwards to ensure the safety of our nation’s children without sacrificing the liberties the foundation of America grants us. Change is new and change can be daunting. Not all changes work but doing nothing isn’t going to solve anything. Let us set aside our political differences to work together. Let us initiate change for the common cause of the preservation of life. Let us use our hindsight as foresight and shape our way to a better future. It didn’t happen after Columbine in 1999, but it will happen now, and the students of Marjory Stoneman Douglas will be the ones behind it. It is all to save a life – maybe even 17, hopefully more.

Imaginations Came Alive at NSU University School’s Fairy Tale Festival BY DEBBY TEICH

Next, they began writing their fairy tales filled with details and strong adjectives to make them come alive. “The fairy tales were quite impressive,” said Dolberg. “They varied from a typical princess theme to a powerful character making a difference in this world today. Students embraced this process and took pride in their final product.” The final activities were the Parade and Fairy Tale Festival. Dressed in costumes, the students paraded around the entire school. They also sang songs from fairy tales and shared their own fairy tales with their parents. “When NSU University School students are asked what they remember about the Lower School, this event is often mentioned,” said Dolberg.

s the Mayor of Davie, it is my pleasure to annually update you on the State of the Town. It pleases me to share our accomplishments and to take a glance at our future. In the past five years, we have seen our population grow nearly 10%, to over 100,000 residents, which is attributed to our A-rated schools, our commitment to public safety, our open spaces and parks system, and providing a higher quality of life to our residents. In addition, we continue to expand our service delivery to the community. For example, we broke ground on Fire Station 86, which will serve northwest Davie with its scheduled opening later this year. The two catalysts for the Town’s future are the Downtown Davie Road Redevelopment and the Academical Village driven by Nova Southeastern University. The Town has enhanced the corridor leading to Downtown from I-595 by constructing landscaped medians and pedestrian improvements that will continue through to Stirling Road. Downtown Davie, a student housing project, is under construction on Davie Road. The Academical Village is breaking ground this year. This project’s first phase will be the construction of a Health Corporation of America Hospital, as well as 100,000 square feet of medical office space. This hospital will serve as the centerpiece of the Village, which will ultimately boast residential, retail, hotel, office, and additional medical space.

The Town is always careful to balance growth with ensuring that recreational opportunities continue to be plentiful while preserving and expanding our open space, park, and recreational/equestrian trail systems. The Town’s first artificial turf fields at Pine Island Park are under construction and will enable these fields to be utilized year-round with no downtime. These fields should be open for play next month. Design is continuing on the conversion of an existing structure at Sunny Lake Bird Sanctuary into a nature center. Finally, two of our largest facilities, Governor Leroy Collins Farm Park and Davie Wetlands Park, are coming closer to construction. Q&A: Ready for a run? There’s much to know before you go. According to recent statistics, U.S. participation in running and jogging has grown 70% over the past decade. In 2017, it was Farah Tejpar, MD estimated that over 60 million Americans were involved in the sport. The number of people running in non-traditional events like warrior and color runs has increased dramatically in the past five years. ike many other processes in the human body, production of Human Growth Hormone (HGH) begins to decline as we age. Released by the pituitary gland, HGH is a protein responsible for growth and cell reproduction. This is exactly why production of HGH rises during childhood years, making children and adolescents grow, and reaches its peak during puberty. By the time a person is 20-30 years of age, production of HGH takes a downward spiral. By age 60, HGH is usually less than half what it was at 25. The Facts About “Laughing Gas” BY DR. MARIA GROSMAN

L

ike many parents in our community, I tend to approach the use of any medicine for my children with a discerning eye. What are the risks and benefits of its use? How long will it last in the system? Are there any side effects I should look for or take-home instructions needed? It is for this reason, that I am happy to educate the public on the use and safety of Nitrous Oxide (also known as “laughing gas”) for use with the apprehensive pediatric dental patient, when indicated. It is first important to point out the very long history and safe track record of its use. Nitrous oxide (N20) was first discovered by Joseph Priestly in 1772. Interestingly, its use for the first 80 years was mostly for entertainment purposes, which is how it received its current nickname “laughing gas.” In 1845, Horace Wells, a dentist from Hartford CT, demonstrated its use as an anesthetic during the extraction of a wisdom tooth at Harvard University. His work on nitrous oxide would eventually earn him the distinction of being the discoverer of anesthesia. Once accepted by the medical community, its method of delivery had been improved and in turn its impeccable safety record had become established. Nitrous oxide is a gas that is delivered through inhalation. Although early documentation showed safe delivery in its pure form, safety has increased exponentially with its combination with oxygen. The addition of oxygen assures that there will be no decrease in oxygenation of the body throughout its use. New sophisticated equipment also assures desired concentrations by a titrating delivery mechanism, allows for rapid reversal, and disallows usage of more than 70% nitrous gas. Se Habla Español! The combination with oxygen has not only made the use of nitrous safer, but has also made its use more versatile. Its first use was prior to the discovery of the local anesthetic, Direct Linelidocaine. very seller wants to maximize the net proceeds when selling his/her home. How does a homeowner receive the maximum?

Many homeowners think that pricing their home a little OVER market value will leave room for negotiation. In most cases, my colleagues will use your home to sell the one down the street that is priced at market. Instead of the sellers trying to “win” the negotiation with one buyer, they should price it so that demand for the home is maximized. By doing this, the seller will not be fighting with a buyer over the price, but will instead have multiple buyers fighting with each other over the house. Creating multiple bids is better than playing the “I gotcha game” or “your move” tactics of endless counteroffers. Multiple bids create a “competitive” atmosphere. May the best buyer win. Even in “as-is” contractual arrangements, buyers are holding the sellers hostage to fix the property. The sellers feel compelled to do so, because their home has been off the market since the contract went into effect. In an effort to keep the deal together and not lose more time, the sellers are pressured into “fixing” versus “not fixing,” so the sellers can just move on.

Use a Real Estate Professional Studies have shown that homes typically sell for more money when handled by a real estate professional. A study by Collateral Analytics reveals that FSBOs don’t actually save any money. In many cases, FSBOs may be costing themselves more by not listing with an agent. In the study, they analyzed home sales in a variety of markets in 2016 and the first half of 2017. The data showed that: “FSBOs tend to sell for lower prices than comparable home sales, and in many cases below the average differential represented by the prevailing commission rate. Very few studies compare prices achieved on For Sale By Owners (FSBO) sales versus traditional marketing using REALTORs. A 1990 study by Miller compared FSBO success rates, but not prices, and found that less than a third of all FSBO attempts were successful. Most FSBO sellers lost patience very quickly and ended up listing with an agent. . .” The results of the study showed that the differential in selling prices for FSBOs when compared to MLS sales of similar properties is about 5.5%. Sales in 2017 suggest the average price was near 6% lower for FSBO sales of similar properties. The FBSO gets fewer dollars and still has to do all the work. Does that make sense? As inventories across South Florida decrease, FSBOs happen. The liability of letting strangers into the homes unvetted and unrepresented is not only crazy, it’s dangerous. am often questioned about the process involved in obtaining a “restraining order.” Many people believe that such an Order can be obtained if a husband and wife get into a verbal argument or if someone is harassing them. This is not true and Florida law is very specific as to the requirements needed to seek such an order. First of all, there is in fact really no such legal document as a “restraining order.” The Order that can be obtained is called an Injunction for Protection Against Domestic Violence. As the title suggests, this order is to protect someone from domestic violence, which is defined as any criminal offense resulting in physical injury or death of one family or household member by another family or household member. The statute goes on to further explain that anyone who is either the victim of domestic violence or has reasonable cause to believe he or she is in imminent danger of becoming the victim of any act of domestic violence has standing to seek an injunction.

The basis for such an injunction, therefore, must be based upon either acts of violence or acts which would result in the other party having a reasonable belief that there was imminent danger of such violence. Conversely, injunctions will not be issued based upon harassment or threats which do not prove to result in imminent fear of harm. To obtain the Injunction, a sworn affidavit must be filed and presented to a judge. If the Judge feels that the evidence is sufficient, a Temporary Injunction will be issued. This will usually require the Respondent (the person who has the injunction issued against him/her) to vacate the marital residence and to have no contact, direct or indirect, with the complaining party. A hearing will then be held within 15 days, giving both parties the opportunity to present their case to a judge. At that hearing, either party can be represented by an attorney. The Judge will then determine if the Injunction shall remain in effect or whether it shall be dismissed. Injunctions can remain in effect for a certain period of time or indefinitely. The Injunction can also be modified allowing minimal contact to discuss issues such as child visitation. The purpose of this Injunction is to offer protection to someone who has been the victim of domestic violence or has a reasonable fear to believe that he/she will be a victim. Unfortunately, it is sometimes abused by individuals who use it as a means to “get back” or punish their spouse. I often say that the Injunction is to be used as a shield, to protect an individual, and not as a sword to harm someone. The Petition seeking the Injunction is sworn to by the applicant as being true. It is unlawful to lie under oath. Nobody should allow themselves to be a victim of domestic violence. pril is National Autism Awareness Month, a time where we shine an important spotlight on the developmental disability that affects many in this country and around the world. Though the exact causes of Autism Spectrum Disorder (ASD) are still uncertain, doctors, experts and activists are feverishly working on raising awareness and aiding in research, diagnosis and treatment of the complex disorder. At the Broward Sheriff’s Office, we are always working on providing special attention to individuals with ASD and other special needs by instituting proactive programs and initiatives and undergoing special training aimed at assisting this special population. One of my personal favorite programs is the Autism in Flight program, which provides a full airport experience in a relaxed setting for individuals about to embark on their first flight. Children and their families check in, go through security, walk the terminal to their gate, board a jetBlue plane and experience a “take-off.” It truly is a special experience. BSO is also in the community at other special events. During the annual Autism Awareness Day, people affected with autism are given an opportunity to learn about the resources available to them, meet with our first responders in full uniform and see their emergency vehicles and equipment in a nonthreatening environment. We’re also huge supporters and participants in the annual Surfers for Autism event, where hundreds of children with autism and developmental delays receive the chance to surf in a safe and secure environment. Yet BSO’s support for this community goes even further. I’m thrilled to have supported historic legislation my good friends Ellen Kleinert and husband Jerry Cohn, who tirelessly worked to get passed into Florida law: the Wes Kleinert Fair Interview Act. It is named after Kleinert’s autistic son and is the first of its kind in the country. The law requires a mental health expert be present during police interviews of developmentally disabled victims, witnesses or suspects. It also makes it easier for authorities to know who may need such assistance by creating a voluntary new designation on state identification cards. Finally, I’m excited to share one of BSO’s biggest and most innovative initiatives. In our ongoing efforts to provide better service and help keep individuals with special needs safer, we recently launched the BSO Special Needs Program. It gives parents or caregivers of individuals with special needs an opportunity to opt in to the program by voluntarily providing biographical information, including a description of the individual’s diagnosis and behavior, which will be captured to improve interactions with first responders. The program will help 911 communications operators convey the critical information to the responding deputy so they can respond more effectively and efficiently. This information can help dispel any concern should the person seem aloof, uncooperative or even in crisis - leading to more positive outcomes.
