lthough it may not feel like it here in South Florida, it’s officially fall. We may not have the cooler temperatures, but we certainly experience everything else that comes with this season – the routine of weekday homework, piano lessons, sports practices and weekend games and birthday parties. Another tell-tale sign of the season is the store shelves lined with Halloween costumes and tasty treats. Now is the time to embrace this playful time of year. Decorate the house for Halloween. Gather the kids to carve the pumpkin. Invite the neighbors over to bob for apples. On Halloween night, let’s all have some fun while watching our little ones roam the neighborhood dressed as fairy princesses, superheroes, or whatever else tickles their fancy. works and why it is important,” said Special Projects Director Bonnie Stafiej, who organizes the program. Last year, more than 200 students, from second grade to high school participated. They spent time touring the Town Hall administrative offices, and visiting with the Mayor, Town Council members and the Town Administrator. The students came with a list of questions. They wanted to know the salaries of government officials and employees; how much schooling the jobs require; why it takes so many people to run a city; why the City keeps raising taxes and more. The older students had an opportunity to participate in a mock Council meeting in the Council chambers. The “mayor” and “council members” responded to the “issues” raised at the “public hearing.” “We want the kids to understand that every resident has a right to come to the council meetings to voice their opinions or ask a question,” said Stafiej. Stafiej says that residents are often afraid to address the local government. “The City has an open door policy and City officials are very accessible,” continued Stafiej. “If residents do not want to go to council meetings, they can ask questions online or by phone.”

his month, hundreds of Davie students will have a much better idea of what it takes to run a city. Some will even get a chance to make important decisions when they play the role of “Mayor”. It is all part of Government Week, which will be held from Oct. 17 to 21. The Florida League of Cities, an association of member municipalities throughout Florida, is sponsoring “My city: I’m part of it; I’m proud of it”. The program is designed to educate school-aged children about city government functions. The Town of Davie will be providing students with tours of Davie Town Hall to inform them about their local government. “We want our young residents to understand how government

Davie Kicks Off 50th Birthday Celebration with a Poster and Essay Contest By Debby Teich

The town is also known for being a center for educational studies, especially the colleges and universities that are located here in the Educational Center. It has a long history in Broward County. The original name of Davie was ‘Zona’. We are celebrating our 50th birthday and we would like to hear from you about the future. Describe your vision of what Davie will look like 50 years into the future.” The winners of the contest have a real opportunity to make a lasting impression. On November 5, the Town will seal a time capsule on the lawn of the historical Davie town hall and the winning poster and essay entries will be in it. The capsule will be opened and shared with the future residents of Davie in the year 2061. The winning entries will also be on display throughout the month of November in the Town Hall Council Chambers and the winning essay will be read on stage during the Birthday Bash Celebration on November 20. Rosettes will be awarded for the best theme posters and essays in all grade levels from participating schools and groups and all entries submitted will receive a participation ribbon.

he Town of Davie is celebrating its 50th birthday with many exciting family fun and educational events that begin this month and end with a Birthday Bash Party at the Bergeron Rodeo Grounds on November 20. Some of them include historical reenactments, a Police and Fire Expo, free concerts, trail rides, professional rodeos, bike rallies, hayrides and a Craft and Green Fair, as well as a poster and essay contest. Davie’s history actually dates back well beyond 50 years. In 1925, Davie was incorporated by the vote of 48 residents who met in the upper room of the Old Davie School. Less than a year later on September 16, 1926, the Great Miami Hurricane struck, leaving Davie with flooded fields, dead cattle, and ruined homes. At the next session of the legislature, Davie residents petitioned and were granted the dissolution of the municipality. The town was officially charted in 1961. The poster and essay contest is designed to engage students in an awareness of the community in which they live and to give them an opportunity to participate in the making of history. The contest will be conducted throughout private and public schools in the Town of Davie. The poster contest is only for grades k - 3 and the essay contest is only for grades 4 - 12. Entries will be judged on the criteria of originality and adhering to the contest prompt, which states, “The Town of Davie is known for its western theme. Cowboys

radford Capuozzo is on his way to sharing a prestigious title with notables like Neil Armstrong, Michael Bloomberg, Gerald R. Ford, Bill Gates Sr., James A. Lovell Jr. and many others. If everything goes as planned, he will soon become Troop 224’s next Eagle Scout. Bradford has been involved with the Boy Scouts of America since he was a toddler. His brother was a Scout and his whole family attended events together. He officially joined when he was in kindergarten and has been working his way toward becoming an Eagle Scout, the highest rank attainable in the program. Requirements include earning at least 21 merit badges, as well as an extensive service project that the Scout plans, organizes, leads, and manages Troop 224 is located in Southwest Ranches so Bradford wanted to do something that would benefit the Town. He met with Town Arborist December Lauretano-Haines to brainstorm ideas. She explained that the Town had planted two yellow tabebuia near the park’s pond, but one had been lost in a storm. He agreed to replant the tree, but wanted to do more. He developed a plan and met with the Town’s Recreation, Forestry and Natural Resources Advisory Board as

well as the Town Council to get approval. Both bodies supported the project wholeheartedly. Using a red, white and blue theme, he would plant dwarf ixora, bridal bouquet, and plumbago. All of these plants are drought tolerant, hardy, evergreens that can be kept to shrub size and will continue flowering through most of the year. He would also plant a second yellow tabebuia, donated by Florida Paradise Nursery, and install a bench so visitors could rest and enjoy the new scenery. After months of planning and soliciting donations, Bradford gathered troop members, friends and others to help him with the beautification project. They removed the grass, covered the area in mulch, dug holes for the trees and planted them. They also installed the bench. A few hours later, the twenty volunteers had transformed the park. “Now it looks more like a park instead of just a pond,” said Bradford. Bradford is used to taking leadership roles and says he owes it all to his experience with the Scouts. He is an instructor for other Scouts in his troop, captain of his swim team, stage manager for HANDS and more. “Scouting has taught me to become a leader,” said Bradford. “Whenever I am involved in something, it is natural position for me to take.”

vendors. The Boy Scouts will be selling water, as well as their infamous roasted corn. There is a playground close by so parents can shop while their kids play. Carolyn Sheron has attended the festival for the past two years with her family and looks forward to returning. “I always find gifts for everyone on my holiday list, including my dog,” said Carolyn. “It is so much fun to browse through all of the crafts. I also enjoy spending time with friends and neighbors and catching up. My whole family loves it!” For those who have the creative bug, it is not too late to sign up to exhibit. If you love to sew, paint, knit, quilt, draw, throw pottery, or do some other type of handiwork and have items to sell to the public, the festival is a great place to do it. All items for the show must be handmade crafts or original art.

ith the holidays approaching, many have already started shopping for those perfect gifts. Chances are you will find them at the 4th Annual Town of Southwest Ranches Country Roads Arts and Crafts Festival. The event will be held on October 15, from 10 a.m. to 4 p.m., at the Sunshine Ranches Equestrian Park. Former Mayor Mecca Fink came up with the idea for the Festival four years ago. She wanted to create a way for the community to gather in order to share their talents and crafts. The first year was a huge success, with more than 1,000 visitors and 60 venders. The festival has continued to grow. “It is a great opportunity to do some holiday shopping, enjoy a beautiful park atmosphere, and spend time with friends and family,” said December Lauretano-Haines, PROS Supervisor. “It offers fun for the whole family.” Most of the items at the Festival are handmade or handembellished. They include stained glass, fabric and leather crafts, specialty wood products, mosaics, paintings, jewelry, children’s clothing, pet items and much more. The Town of Southwest Ranches will be providing entertainment for the event. There will be a blue grass band, bounce house, face painter and more. There will also be plenty of food from

O
n October 24, more than 100 golfers are expected to gather for a fun day of golf, and all for a good cause. The KID Auxiliary Masters Golf Tournament is returning and all of the proceeds will help raise funds for Kids In Distress, a non-profit charitable organization dedicated to protecting children in South Florida from abuse and neglect. KID strives to establish strong and healthy families that can care for their children and keep them safe. Last year, the tournament was held at Jacaranda Golf Club and raised over $23,000. This year it has been moved to Grande Oaks Golf Club in Davie and organizers are hoping to raise even more. The tournament begins with registration and a pre-tournament lunch at 11:30 a.m. There is a shotgun start at 1 p.m., followed by a barbecue dinner complete with raffles and awards. Players of all skill levels are welcome to participate in the 18-hole scramble. The individual player fee of $175 includes greens fees, cart, pre-tournament picnic lunch, dinner and prizes. For $30, non-golfers will
be able to purchase tickets in advance for the dinner. In addition to participating as a golfer, there are also sponsorship opportunities that range from Title ($5,000) to Tee Sponsor ($200). The golf tournament is one of many fundraisers organized by the Kids in Distress Auxiliary. The largest one is the gala, which takes place in March. “The Kids in Distress Auxiliary is a great group of people who are raising money for a worthwhile cause,” said Liz Kelley, golf chair, who has been a member of the Auxiliary for seven years. “It is a wonderful feeling to be part of an organization dedicated to helping children in need.” For information or to purchase tickets, call 954-252-3365 or visit www.kidaux.org.

health & Wellness Dispelling the Myths of Hormones – What Will You Choose? By Dr. Jean-Claude Nerette
T
he use of hormones has sparked much debate on their efficacy and safety. There are many myths circulating about hormones that have no founded evidence or truth to support these statements. I am continuing this series to dispel the common myths surrounding hormone therapy. I will give you true scientific data – so you may have all the options available in order to make an educated choice. Myth – “I don’t need hormones because my lab values are within the normal range”. This is incorrect. For instance, a woman in her fifties may have a level of 0.0 for her testosterone. This number is actually within the normal range, but is 0.0 actually normal? The lab value for your hormones is based on your age group’s hormonal average. If you want to look and feel your age than this normal range is ok for you, but if you want to feel like a thirty year old and look your best at your age than this “normal” level may not be for you. Furthermore, the lab value is just one piece of the puzzle. Symptoms of hormone imbalance or depletion are hot flashes, low libido, fatigue, irritability and the list continues. This list of symptoms along with the labs paint a bigger picture than evaluating one static lab value to determine your need of hormones. Myth – “Testosterone is a hormone for men only.” This is incorrect. In women, testosterone is produced by the ovaries and the adrenal glands. In women the testosterone level continually declines with age. In addition, if the ovaries are removed the level will drop dramatically by 50%. Testosterone is the basis for many functions in females such as lean body mass, bone strength, libido and cognitive functions of the brain. To prevent osteoporosis, improve libido, decrease mental fogginess and mid section body fat, bio-identical testosterone pellet therapy is the best method available. In fact, Bio-identical Hormone Replacement Therapy utilizing pellets has been shown to increase bone density by 8.3% each year which is remarkable compared to other methods such as creams or patches which is less than half this rate (Smith/Studd, british journal of hospital medicine, 1993). Moreover, there have been documented studies from the University of Southern California and the University of California which have shown an increased incidence of dementia and Alzheimer’s disease with low testosterone levels. Although women have only a fraction of testosterone than that of men it is essential to maintain optimal levels for optimal health. rom December 2007 to the present, South Florida has experienced a 400 percent increase in foreclosure filings and 1 out of every 197 homes in the United States is undergoing a foreclosure proceeding. In view of these staggering statistics, most homeowners simply give up the fight for their home before it even begins. However, a foreclosure lawsuit is just like any other lawsuit – the lender must prove its entire case before it can obtain a judgment. Just because you’ve been served with foreclosure papers does not mean you have to leave your home! Here are some suggestions on how to use foreclosure proceedings to your advantage, and possibly beat the bank.
CONDUCT A FORENSIC AUDIT OF YOUR LOAN
First of all, perform a detailed audit of your loan transaction through a qualified mortgage auditing firm. A forensic audit often reveals serious violations of Federal and State laws committed by the same lenders that initiate foreclosure proceedings. An audit may also reveal flaws in the transfer of your mortgage. If you don’t know a reputable mortgage audit firm in your area, please contact the Arcia Law Firm and we will gladly point you in the right direction.
FILE A COUNTERCLAIM AGAINST YOUR LENDER
Using the results of your forensic audit, and assuming you have identified violations of law in connection with your loan, you should file a counterclaim against your lender. In other words, sue your lender within the same foreclosure proceedings as a means to establish better negotiating leverage.
DEMAND THE ORIGINAL NOTE
Most foreclosure proceedings are not initiated by the original lender, but rather by a party who claims to “own and hold” the Note securing payment of the loan. Surprisingly, some of these third parties don’t actually have possession of the original note, or the right to enforce the obligation. The Note is a negotiable instrument, like a bank check. Do you know any bank that will cash a “copy” of a check? Likewise, no Court will decide a foreclosure proceeding based upon a “copy” of your Note. If you demand the original Note, and the lender is unable to produce it, a foreclosure judgment cannot be entered.
CHALLENGE YOUR LENDER’S RIGHT TO BRING THE FORECLOSURE PROCEEDING
Florida law only permits an action to be presented by the “real party in interest.” If you never signed an agreement with the party that filed the foreclosure, you can challenge their right to file the foreclosure proceedings. At minimum, you can challenge the validity of the assignment of mortgage and the endorsement on the promissory note. Judges will not hesitate to dismiss a foreclosure proceeding initiated by a company that has no legal right to bring the action. Legally Speaking An Unexpected Nightmare By Evan Baron

his column is normally reserved for family law issues. Today I want to discuss an issue which affects not only couples going through a divorce but also intact families. We are all aware that there is a housing crisis going on in this country. Foreclosures are still being filed daily and property values are predicted to fall once again. I often ask myself why hasn’t the housing market improved? Interest rates are at an all time low and housing prices are the lowest they have been in years. There have been several government programs to assist buyers, but nothing seems to be working. A couple I know recently attempted to purchase a home on a short sale. A short sale occurs when the sales price is listed for less than what is owed on the house. Generally speaking, the price for the home is discounted and as such it is tempting to prospective buyers. This couple had heard “horror stories” about short sales but they decided to test the market. They made an offer on a home which needed a considerable amount of work to make it habitable. Even with the money they would need to invest for repairs and improvements it was a good deal. Not only must the seller agree to the sales price in a short sale, but the mortgage holder must agree as well. In this case there were two mortgage holders, so the process was expected to take longer. They never thought it would take 4 months and counting. Several days ago they backed out of the deal after two closing dates had passed and there was no relief in sight. The “final straw” came when after waiting for four months the first mortgage holder determined that a new evaluation of the home was necessary because the process had taken so long. The buyers had been prepared to close in June, having obtained the necessary financing. All delays were attributable to the banks and the seller. An evaluation of the property was done by an “independent” broker. This is not an appraisal by a licensed appraiser, but rather a real estate broker determining “market value”. The house, after sitting vacant for well over 6 months and deteriorating from the hot summer weather, was somehow found to have increased in value $60,000! The bank told the buyers that their offer had expired and they were waiting for a counter-offer based upon the new value. The fact that they had contracted to buy the house 4 months prior for a lower number and the fact that they had held on to their “good faith deposit” was not considered. The deal was terminated. As a result the house is headed for foreclosure. The seller will now have a foreclosure on his record. The buyers will have to purchase another home. The workers who were going to be hired to repair the house were no longer needed. And the bank will probably get less money than the original selling price. The real estate agents who worked hard to keep this deal alive will walk away without a cent of commission. It’s a lose-lose. I have spoken to attorneys experienced in real estate and they explained this is a typical story. Once again greed reared its ugly head and the average person suffered the consequences. I am writing this to let people know that in spite of all we hear about trying to stimulate the economy, there are still many roadblocks. If you are considering either selling or purchasing a short sale, I strongly urge you to consult a real estate attorney. Perhaps one day common sense will prevail!

ormalcy: (noun) “According with, constituting, or not deviating from a norm, rule, or principle.” (MerriamWebster Dictionary)
“If you are thinking of selling your home in the next twelve months, selling sooner rather than later will probably get you the higher price. However, in 18-24 months, the market will return to historic appreciation norms.” Steve Harney (KCM Blog). I believe that 18-24 months is extremely optimistic; however, I respect Mr. Harney and his research. He has studied the shadow inventory issue, and further stated that it is difficult to read an article about real estate today without the term ‘shadow inventory’ being mentioned – which he defines as “inventory of homes not yet for sale that will eventually come to market in the near future.” Most definitions include (1) properties already foreclosed on or properties owned by the banks (REOs) (2) those houses in the foreclosure process and (3) those homes where the homeowner is seriously delinquent on their mortgage payment (at least 90 days behind).” Shadow inventory is what is keeping our market from becoming “normal.” It is the inventory that is being slowly released onto the market. The National Association of Realtors has reported that over 30% of all home sales over the last few months have been distressed properties. Major banks currently hold one million homes repossessed through foreclosure, but only 30% have actually made it onto the market according to Sharga of RealtyTrac. Foreclosures have been delayed by the court systems while paperwork was corrected. The banks are rectifying their paperwork and processes. Now, more and more states are clearing the way for the banks to resume repossessing these properties. Again, according to Harney, “as these properties find their way to the market, the prices of non-distressed properties in the region will be adversely impacted for two reasons: There are a finite number of homebuyers in any market. A portion of these buyers will purchase the distressed properties new to the market because they can get them at discounted prices. As these distressed properties sell, they will become comparable sales used by appraisers to establish value on all homes (both distressed and non-distressed) sold in the future. Since these properties are sold at a discount, they will have a negative impact on other valuations. Our housing market will not recover until we clear this shadow inventory. The speed at which these properties come to market and are sold will determine the speed at which the housing market recovers. The latest S&P Shadow Inventory Report shows that the months of shadow inventory already are decreasing. The report explains that the number of families falling ninety days behind on their mortgages has decreased dramatically. It is understandable that based on this report that Harney would conclude: “As we clear these distressed properties there will be much less of a backfill. The end to the housing crisis is finally within sight.”

hen students arrive at Archbishop McCarthy High School in Southwest Ranches each day, the first thing most do is take out their apple, as in “Apple iPad”. At the beginning of the school year, approximately 800 students were using iPads and the school has already placed an order for 400 more. Archbishop is the first school within the Archdiocese of Miami to introduce this level of technology for students to use on a daily basis and the first high school in South Florida to have school-issued iPads. Principal Richard Jean has been leading the initiative at the college prep school in an effort to provide the students with the tools necessary to prepare them for college, as well as their future careers. “We want our students to be on the cutting edge of educational technology,” said Jean. “This changes everything in the classroom and it raises the educational stakes. The iPad program augments the knowledge imparted by the teacher in the classroom.” The teachers have been given extensive training on the most effective ways to integrate the technology into the curriculum. Honors History Teacher Lawrence Boes witnessed the advantage of having iPads when he instructed his students to find the first country to implement Solidarity. “The next thing I knew we had an active discussion on Poland and its use of civil resistance to advance the rights of workers and implement social change,” said Boes. “The students are able to access the facts immediately. This is a great way to fast forward teaching.” Students will be using the iPads to take notes in the classroom, research information, prepare for tests and complete homework. Eventually, the iPads will be used in lieu of school books. “This is an exciting year for us as we introduce a new teaching
aide which is benefits the teachers and the students,” said Technology Director Joe Morano. “It is fantastic to be on the cutting edge.” The iPads come pre-loaded with software specifically designed for the school’s curriculum. They also have plenty of filters to the dismay of those students who dream of surfing the Internet while in class. Her students have been accepted to some of the most prestigious schools in the country, including the Boston Ballet, Joffrey Ballet, Orlando Ballet, American Ballet Theatre, Houston Ballet, Washington Ballet, Milwaukee Ballet, Atlanta Ballet, Nutmeg Conservatory, Walnut Hill and the Rock. They have also earned dance scholarships to the Chicago College for the Performing Arts, Hartt School of Music, Florida State University, New World School of the Arts, University of Central Florida and more. The Academy’s Performing Group is made up of students that have volunteered their time to be a part of many of the shows performed throughout the year. The children are not auditioned, but rather given a chance to enjoy the art of dance. The focus is not on dance recitals or competitions, but rather the training offered by an excellent dance education. Some of the costumes used in the performances have been sewn by moms, dads, and grandmothers or have been used in the past to make the program affordable to everyone.

At the Academy of Arts there is a warm, caring environment where dancers have an opportunity to nurture their love of the arts, as they make new friends and learn social skills. The Academy offers classes from pre-school through adults, from beginners to professionals. At Academy of Arts, there are a variety of dance styles available, such as ballet, pointe, pas de deux, acrocise, combo, jazz, hip-hop, tap, belly dancing, flamenco and modern, as well as musical theater, drama, voice, piano and guitar. The facility has been designed for dancers and includes professional flooring, 25 ft. ceilings, mirrors, and top quality barres. The focus at the Academy is on training. There are no recital fees, no rehearsal fees, no high-cost costumes, no videos and no high-priced tickets to purchase. All of the faculty has had professional careers and are highly qualified, certified instructors. At every level, students are only taught by professionals who give them the personal attention they deserve. There is always a long waiting list of dancers hoping for a coveted spot. “We develop clean dancers and educate them using different theories used worldwide,” said Director Rebeca Russo-Columna. “They have an opportunity to express their own individual style as they learn to become well-rounded performers in the areas of dance, vocals, acting and musical theater. When they leave the Academy they are prepared to dance anywhere.” There are 750 kids enrolled in the school and Rebeca is involved in the enhancement and development of every one of them. She is at the school from opening to closing. All of the students benefit from her extensive training and experience. Rebeca has lived her life according to the motto “there is no substitute for excellence” and expects the same from her students. At age 13, she was awarded a full merit scholarship to
The Academy’s Junior and Senior Dance Company is comprised of very talented young dancers that have been auditioned to be a part of the special program. The Company represents a dancing group of the community and for the community. It is an intense program which includes training in all areas of dance needed to prepare the students for a professional career in dance. These dancers are not only taught by the staff at the Academy, but are also given opportunities to work with guest artists to help them reach their full potential in dance. In the past, many of the Academy’s older students have had to choose between obtaining a college degree and pursuing a career in dance. The Academy recently formed a Professional Company so students like like Jordan Anders and Rachel Martin no longer have to choose. Rachel started at the Academy when she was five years old and has decided to pursue a career in dance. Unlike most students, she was able to find a way to dance while she studies. She is currently studying at the New World School of the Arts in Miami, while earning a Bachelor of Arts degree from its affiliate, the University of Florida. She is a member of the Academy’s Professional Company, Metropolitan Ballet of Florida, which will be making its debut this fall.

t Juice Therapy Café in Davie, the motto is, “Let food be thy medicine.” It is a paradise for customers who juice and eat raw and organic foods to promote a healthier lifestyle. It offers a wide variety of foods that are rich in vitamins and nutrients to help customers feel better, think more clearly, ward off sickness and increase vitality. The menu includes Organic Fruit Smoothies, Organic Green Juices, Wheat Grass Shots, Meal Replacements, Raw Food and Vegetarian Dishes, Organic Salads, Sandwiches and Wraps. Everything is made fresh using organic fruits and vegetables, without any additives. Owner Ivonne Cintron-Pecoraro and all of the staff have experienced the benefits of eating healthy for many years. Ivonne’s partner Chris is a holistic vegan chef who was trained in New York City’s Natural Gourmet Institute for Food and Health. Her brother Phil has owned Discount Health Foods in Davie for the past 10 years. When the retail space next door became available, they decided to share the family’s passion with the community. “It has been a dream of ours to open a store so we could motivate and inspire men, women and children to make better food choices,” said Chris. The store has been an instant success since it opened in September. It has been attracting customers who follow regimented health and fitness routines, as well as those who simply want to feel better. “We want people to feel energized and revitalized, and educated when they leave,” said Ivonne.
