Get Informed and Have Fun at the Town of Davie Fire & Police Expo By Debby Teich

hen most Davie residents have an emergency, they call the Davie Police Department or Fire Rescue for help. On February 6, they will have an opportunity to meet and learn more about some of the people who serve them at the Town of Davie Police and Fire Expo. Approximately 1,000 people are expected to attend the annual event held at the Public Safety Complex, from 10am to 2pm. “The event is a great opportunity for adults and children to interact with our officers and to get to know the Davie Police Department by seeing and learning about many of the services that we provide to the community,” said Lieutenant Ed Smith, Public Information Officer for the Davie Police Department. “The Expo gives us an opportunity to showcase many of our specialized units, the police department building, and our various programs, all in a fun and exciting atmosphere. We really hope that everyone will come out and participate.” Visitors to the Expo will enjoy demonstrations from the Police Motorcycle Unit, SWAT team, K-9 team, Dive team, and rappelling exhibition, as well as a fire extinguisher demonstration, CPR demonstration, and a vehicle extrication drill. Throughout the day, they can explore fire engines, rescue trucks, SWAT trucks, community response vehicles, the smoke trailer, the Crime Scene Unit, and more. They can visit with Sparky the Fire Dog and McGruff the Crime Dog. They can also tour the inside of Fire Station 65 and the Police Department, where they will see the equipment that the firefighters and police officers use and carry. Children can even try on some of the gear. Local and state agencies will have tables and booths set up with information about Community Emergency Response Team (CERT), stroke awareness, blood pressure checks, child fingerprinting, child car seat safety, drowning prevention, Davie Crime Watch, and more. Jacob North plans to attend for the third year, with his two young children. “My kids loved the rapelling exhibition,” said North. “They also loved all of the demonstrations. On January 17, Davie residents will have an opportunity to honor his dreams and vision during the Dr. Martin Luther King, Jr. Picnic Celebration at Potters Park, from 1pm to 4pm. Hundreds are expected to attend the celebration, which will include youth entertainment, guest speakers and a poetry contest, as well as kids’ activities, such as bounce houses, a petting farm and more. The Town of Southwest Ranches Celebrates 15 Years Community News

ver 600 people came out to celebrate the Town of Southwest Ranches’ 15th birthday at Rolling Oaks Park. It was a fun-filled day with lots of activities. “Fifteen was a milestone, so we decided to celebrate it,” said Russell Muñiz, Assistant Town Administrator/Town Clerk.

There was face painting, a petting zoo, and a pumpkin patch for the kids. Everyone enjoyed a free barbeque prepared by the culinary experts from the Town of Southwest Ranches Volunteer Fire Rescue Department. Members of the Davie Police Department presented the colors, did a special S.W.A.T. exercise, and also provided child identifica-

tion kits to parents. Although the Town does not celebrate its birthday every year, Muñiz expects they will do it again for its 20th and 25th anniversaries. For information, visit www.southwestranches.org.

Learn About Community Programs & Services at the Senior Lifestyle Expo By Debby Teich

O

n January 16, seniors will have an opportunity to learn more about community programs and services that are available to them at the 2nd Annual Cooper City Senior Lifestyle Expo. The free event will be held from 9am to 12:30pm, at the Cooper City Community Center. “This event will provide a perfect opportunity to learn about and gather information on a variety of activities, services, programs, and other resources available to our adult community, all in one convenient location,” said Annie Boyle, Recreation Program Specialist for the Cooper City Recreation Department. Participants can meet some of the City’s program activity instructors, learn about City services, gather information from vendors on medical services, retirement opportunities, wellness, and more. Organizers are expecting approximately 500 people to attend. Although it is called the “Senior Lifestyle Expo,” it is not limited to seniors. There will be something for everyone and adults of all ages are encouraged to attend. There will be vendors in a variety of fields, such as medical, health/wellness, financial, retirement and more. Participants can visit with representatives from Memorial Regional Hospital’s Acute Care for Elders Unit and the Neuroscience Institute and join in a Silver sneakers mini class. be on-hand to teach home and car safety tips. Resident adults 62 years of age and older in need of transportation services can register that day with the Cooper City Senior Transportation Program. The free monthly class aims to teach and empower senior citizens to better protect themselves in their day-to-day lives. Join the Broward County Butterfly Chapter to Learn More about Butterflies By Debby Teich

T

here are approximately 20,000 species of butterflies in the world. Since 2003, the Broward County Butterfly Chapter (BCBC) of the North American Butterfly Association has offered members a way to learn more about them. The not-for-profit organization aims to develop a healthy ecosystem for butterflies, and to conserve and improve our habitat for butterfly ecology. It meets the second Tuesday of most months at Tree Tops Park. Naturalist Kelli Whitney will speak about trends in Long Key butterfly counts at the next meeting on January 12, from 6:30pm-8:30pm.

“Primarily, we want to attract wildlife, especially butterflies, to our yards,” said Pat Rossi, BCBC president. “If we make space to plant larval and nectar sources for our butterflies, we’ll have a diverse ecosystem and improve our habitat for butterflies. When we provide shelter, food and water for wildlife, we also benefit from it because we affect the health of the soil, water and air.” The group has approximately 75 members and 260 non-members. Membership is restricted to Broward residents, but everyone is invited to the meetings. Both groups represent a cross-section of society, including all professions and ages, from the young to retired citizens. Some are Emerald Award NatureScape Broward winners, noted for their creation of a certified wildlife habitat. “The group supports our chapter, because they are concerned citizens of the environment,” said Rossi. “They volunteer and attend field trips and events. All of them love butterflies and gardening.” The group achieves its goals by promoting conservation of butterflies and their habitat, education, and providing opportunities for the public to experience butterflies outdoors. This month, members will help Gator Run Elementary School install a garden to attract butterflies. They are also helping Kids Ecology with more plants for their butterfly garden. During Broward County’s Water Maters Day, members have a tent where they show larval plants and a live butterfly exhibit with caterpillars and chrysalis. Sometimes visitors are lucky enough to witness the butterflies

emerging. Several members spent a year working on a mosaic bench that was recently installed at Long Key Nature Center in memory of Dr. Elane Nuehring, past president of the Miami Blue Chapter, NABA. The chapter also participates in butterfly counts at Broward parks. The NABA designates an area and the group records every butterfly adult, egg, caterpillar and pupa. The data is compiled and entered into an online count form that is sent to NABA. Since 2004, the Broward chapter has conducted 60 counts and found a total of 2,952 butterflies, excluding pupa, caterpillar and eggs. n December 4, the City of Cooper City kicked off the holiday season with Light Up Cooper City at Memorial Park. The family event included mini twinkle lights and luminaire candles, community youth performances, children’s activities, an indoor craft show, visits with Santa, and more. On December 11, adults had an opportunity to join their friends for a holiday lunch celebration that included music, fun, and games. On December 14, Cooper City children enjoyed a magical meal during Breakfast or Lunch with Santa, at the Cooper City Community Center. Cooper City Dads and Sons Prepare to Spend Quality Time Together Community News

n January 22, Cooper City dads and their sons will have an opportunity to enjoy a special evening together at the Father-Son Adventure Night. If dad is unavailable, grandfathers, step-dads, and uncles are always welcome. The event will be held at the Cooper City Community Center, from 6:30pm-9pm. It is open to Cooper City dads with sons in grades K – 5th. “The Cooper City Father-Son Adventure Night is a great opportunity for some father-son bonding coupled with a little friendly competition,” said Annie Boyle, Recreation Program Specialist. “Don’t miss out on what’s sure to be a fun-filled evening.” Approximately 80 fathers and sons are expected to attend the night of adventure, which will include dinner, activities, and fun. They will rotate around to different activities geared around a central theme. Last year’s event revolved around science-related activi-

ties. Dads and their sons conducted experiments on dry ice, and created mini lava lamps, screaming balloons and shrinking chip bags. They also worked together to try to build a protective casing for their egg, so it would not crack when dropped. Seating is limited and no tickets will be sold at the door. Tickets are on sale at the Community Center. The cost is $24/pair and $10 each additional son. Proof of residency is required. The City of Cooper City has several other events throughout the year to promote positive family relationships. On April 6, tickets will go on sale for the Mother-Daughter Tea, which will be held on May 7. Some other events that will occur later in the year include: Grandparents Day (Sept.), Mom & Son Night of Fun (Sept.) and Daddy-Daughter Dance (Nov.). 8th Annual Autism Awareness Day Acclimates Kids and Responders By Debby Teich

ooper City and the Town of Davie recently hosted the 8th Annual Autism Awareness Day at Broward Sheriff Fire Rescue Station 28. “The Autism Awareness Day program is unique, because it promotes interaction between those with autism and our first responders,” said Sheriff Scott Israel. Approximately 160 people attended the annual family-fun event, which offers an opportunity for those who are affected by autism to learn more about local resources available to them. It also helps children become accustomed to seeing and interacting with uniform public safety professionals. Participants had the opportunity to meet firefighter/paramedics and law enforcement officers in full uniform and gear, tour

their emergency vehicles and see their equipment in a controlled, non-threatening environment. They also enjoyed lunch, compliments of the Davie Professional Firefighters and Benevolent Association Local 2315 and the Broward County Professional Firefighters and Paramedics Local 4321. Deputies from the Broward Sheriff’s Office and firefighters from Broward Sheriff Fire Rescue were joined by officers from the Davie Police Department and Davie Fire Rescue firefighters. As first responders, the event provides a way for public safety personnel to become more familiar with the proper way to manage any incident involving people with disabilities.

South Florida Cloggers Continue to Entertain Audiences SECTION HEAD Community News

T

he South Florida Cloggers have put a modern twist on the traditional folk dance. They continue to receive invitations to perform nationally and internationally. In November and December alone, they had more than 20 performances throughout the Southeast, including one in the Macy’s Day Parade at Universal Studios. “Clogging is aerobic, energizing, and exciting,” said Rebecca Vetter, director, choreographer, lead instructor and the founder of the South Florida Cloggers. “All you need to get started is a pair of shoes.” The group meets at Robbins Lodge in Davie. It is a family atmosphere, with students that range in age from 2 to 84. Mothers and daughters clog together, as well as entire families. Members travel throughout the country to perform, attend clogging workshops and compete. During the season, from October to March, they perform several shows each weekend. At the end of each show, Vetter gets the audience involved by teaching them the first steps of clogging. The Town of Davie has recognized the South Florida Cloggers for their dedication to performing and volunteering in the community. At the 2014 Downtown Hoedown, Davie Mayor Judy Paul presented the group with a proclamation naming June 13 as South Florida Cloggers Day. The group has volunteered for organizations such March of Dimes, Special Olympics, Tour de Broward, Joe DiMaggio Children Hospital, American Cancer Society’s Relay For Life, Kids Corner

ince 1992, the Miami Dolphins have been helping South Florida families in need with funds or Thanksgiving meals during the holidays. Players, coaches, Miami Dolphins Women’s Organization and mascot TD recently donated money to provide 500 Thanksgiving meals prepared by Publix to families in conjunction with Feeding South Florida. The event was held at the Doctor’s Hospital Training Facility at Nova Southeastern University in Davie. “Thanks to the generosity of the Miami Dolphins players and coaches, 500 families who otherwise wouldn’t have a happy Thanksgiving were able to gather around the table and enjoy the holiday festivities,” said Feeding South Florida President & CEO Paco Vélez. “These meals are truly the epitome of changing lives one meal at a time.” The meals were purchased by the players and coaching staff. The families were preselected by Feeding South Florida from 50 nonprofit partner agencies. Each meal was enough to feed seven to eight family members. It included a turkey, mashed potatoes, turkey gravy, stuffing, marshmallow delight and cranberryorange relish. “Every year we look forward to teaming up with our partners, the Miami Dolphins and Feeding South Florida, in an effort to ensure local families in need have a nourishing meal from the Publix Deli and a happy, healthy Thanksgiving,”

very day in our practice we see patients who have been told by their primary care physicians that they are in good health, but just need to eat better to get in top shape. wenty-three years ago, Renee Herman initiated a canned food drive to help 25 families in need. As the effort grew and she needed more space, she moved her collection site to Western High School in Davie. The Harvest Drive is now a yearlong project that culminates in an event that takes place every Thanksgiving. It is a classic example of “children helping children.” “We are teaching the children that together we can create a culture of giving,” said Herman. Western High School is one of 13 high schools in Broward County that serve as distribution centers. It continues to be the largest effort and the hub of the Harvest Drive operation. The entire school gets involved in the Harvest Drive, including staff, administration and every club. This year, the Harvest Drive provided 2,200 families in Broward County with a complete Thanksgiving dinner, plus a week’s worth of groceries. The families, who are referred by social service agencies and Broward County school social workers, receive an average of 10 overflowing bags of groceries containing turkey, stuffing, vegetables, pies and more. They also have an opportunity to “shop” for clothing, shoes, books, and toys. In an effort to fight hunger year round, the Harvest Drive has two on-going food pantry closets that are available for families who are recommended by a social worker. want to give credit where credit is due. So, perhaps a confession can help clear the air so there’s no misunderstanding. Before I talk about my confession, though, let me say a few other things first. Let me start by explaining the photo in this letter. You know, when I meet people in town they usually say, “Oh, yeah, I know you, you’re Dr. Rick. I’ve seen your ad with that picture of you and your family.” Well, I’m the guy on the right. Twenty-five years ago something happened to me that changed my life forever. I was a junior in high school and I started getting migraines. I had suffered from intense headaches since childhood. Over the years, I consulted many medical doctors, and specialists. I went through all kinds of tests, MRIs, and treatments. I tried every drug in the market; our medicine cabinet looked like a hospital’s infirmary. And still, nothing helped. But there’s more… A friend of mine convinced me to give a chiropractor a try. The chiropractor examined me, took X-rays, and then “adjusted” my spine. The adjustment did not hurt; it actually felt good. And guess what…I started feeling so much better! Women’s Over 40 Soccer League Forms in Davie

For Patsy Gibbs, age is clearly just a number. At 69, she recently formed the Women’s Over 40 Soccer League in Davie, so she can continue to play the sport she loves. The league meets on Friday nights at Bamford Park. It is an opportunity for women to get in shape and make new friends, as well as to acquire and/or refine their soccer skills. The games are fun and the atmosphere is friendly. Gibbs grew up in Boynton Beach at a time when there were few team sports for girls and soccer was not popular. In her late 30’s, she joined her first soccer league, which was run by the Cooper City Optimists for women age 30+, and she developed a passion for the sport. In 1995, she and Gayle Smitter formed their own league - Michelob Light Women’s Recreational Soccer League. Registration will be held on January 5 and 8, from 5pm to 7pm, at Bamford Park Community Center, 3801 S. Pine Island Road. Players that register after the deadline will be placed on the waiting list until an opening becomes available. The next season is from September to December. Davie Road Race Dash 4 Cash 5K and Mayor’s Mile Challenge Walk Returns By Debby Teich

n January 24, Rick Case presents the 2016 Davie Road Race Dash 4 Cash 5K Run and Mayor’s Mile Challenge Walk with $1,300 in prize money. All proceeds will benefit the Davie Police Athletic League (PAL) and the Davie Police Memorial Foundation. “We are very excited for this year’s race,” said Officer Tim Albury, Director of Davie PAL. “We encourage the community to come out and get involved by running, walking or just being a spectator along the course cheering everyone on.” The 5K run will begin at 8am at Bergeron Rodeo Grounds and proceed up Davie Road to Nova Drive. Runners will then U-turn back down Davie Road, where they will enter into Broward College and wind around the lake. Runners will then proceed south on Davie Road to the Finish Line. Several high school bands will be located along the race course to provide support for the runners. Mission BBQ will provide sliders and cole slaw for all participants and Menchie’s will be serving yogurt. American Heritage Band played during the 2015 race.

The overall top three winners, male and female, will receive the following: 1st place ($500), 2nd place ($100) and 3rd place ($50). The top three runners in each age group, male and female, will be presented with medals. All participants will receive finisher medals. During the Mayor’s Mile Challenge Walk, which begins at 8:30am, participants can take a walk with Davie Mayor Judy Paul and benefit area schools at the same time. When they sign up for the Challenge, they pick the school they want to support. The school with the most participants will win the Mayor’s Cup Challenge. Each school that participates in the event will receive 20% of the proceeds donated back to that school to benefit its programs. Participants are encouraged to wear their school shirts to show their spirit. All participants receive finisher medals. The Davie PAL is a youth crime prevention program that utilizes educational, athletic and recreational activities to create trust and understanding between police officers and youth in the community. Over 600 kids of all income levels are enrolled in flag football, tutoring, boxing, mentoring, Youth Leadership, and a variety of other programs and activities. Through this event, the Davie PAL has raised money to revitalize the boxing program, which has resulted in two of its athletes winning the National Silver Gloves Championship (Teofimo Lopez) and State PAL Championship (Javuane James). It has also allowed Davie PAL to design and create a new teen room with board games, air hockey, pool, video games and more. Bergeron Rodeo Grounds are located at 4300 Davie Road in Davie. MAV Tank Competition Inspires Innovative Ideas Among Students

tudents from Archbishop Edward A. McCarthy High School have been working on the next “big idea.” They recently participated in the 3rd Annual MAV Tank, a Business Plan Competition featuring student business plans and celebrity judges. Modeled after the television show “Shark Tank,” the competition was heled during Global Entrepreneurship Week, the world’s largest celebration of innovators and job creators. Team STOPIT won first place ($500) for their magnetized multiuse door stopper. “At its core, MAV Tank is a platform for our students to fully develop their ideas and then put them into practice,” said Kim Zocco, Business Education

t’s not uncommon to see older students walking younger ones to class or children holding doors for their teachers at the Sagemont Lower School Campus. These simple acts of kindness are part of the school culture. During the week of January 25th-29th, the entire school will commit to completing 15,000 acts of kindness as students, teachers, and administrators accept the Great Kindness Challenge, a proactive and positive bullying prevention initiative that improves school climate and increases student engagement. Maritza Zea, Guidance Counselor of the Sagemont Lower School Campus, says The Sagemont School supports the Great Kindness Challenge as it strives to create a bully-free, safe and caring school environment. “The Great Kindness Challenge helps fulfill Sagemont’s mission statement of creating a school culture of acceptance, tolerance and respect. Sagemont takes pride in embracing the diversity of the student body and in offering a safe, supportive learning environment to each and every one of our students.” Ms. Zea says Sagemont’s overall goal is to spread kindness school-wide, which will create healthy relationships. “Positive relationships allow students to ease anxiety, bring a sense of belonging to the school, and to focus and engage in learning. Researchers have found that students who performed acts of kindness with their peers, families, and in the community had greater academic success than those who simply recorded seeing acts of kindness.” To kick-off the Great Kindness Challenge, Sagemont has invited the Broward

Sheriff’s Office to greet students in the morning carpool lane, along with Student Council and National Elementary Honor Society members. Every student, teacher and staff member has pledged to perform ten acts of kindness every day for one week, for a total of 15,000 acts of kindness. To help students achieve this goal, each grade will engage in a different activity. For example, Early Childhood Education students will color pictures for the front office staff, maintenance workers, and bus drivers; first graders will make cards of well-wishes for patients at the Nicklaus Children’s Hospital; and fifth grade students will make new friends by adopting a “Kindness Pen Pal” at one of Sagemont’s sister schools, The Honor Roll School in Houston, Texas. Students will also be able to participate in Kindness Stations during recess. Ms. Zea says the hope is that Sagemont students will continue performing acts and words of kindness not just during this particular week, but the whole year. “As kindness becomes a habit, this can effect real change in their learning environment. The ‘living kindness’ conditions will enhance the students’ understanding and their ability to think critically about ways to generate more kindness on an individual and global level.” The Great Kindness Challenge was created by Kids for Peace to provide schools a tool for creating a positive school environment. urglary is one of the most disturbing, traumatizing crimes, and many will be a victim at least once in a lifetime. Anyone, in any neighborhood, can be the victim of a burglary. Burglars these days are not just looking for valuable items, but are often also seeking personal information that can lead to identity theft and fraud. Last January, following six months of investigation and surveillance, BSO’s Burglary Apprehension Team (BAT) arrested the suspected ringleader and a group of his accomplices from a large burglary gang responsible for over 100 residential break-ins throughout Broward County. The gang liked to kick down the front doors of homes – typically in broad daylight when they believed the owner was out – and quickly steal jewelry, electronics, personal information and anything else of value. Unfortunately for these dangerous criminals, our innovative BAT shut them down. This arrest was just one of many early successes since I created the unit in 2014. Most recently, BAT helped apprehend the teenager responsible for a rash of dozens of car smash-and-grab burglaries plaguing Oakland Park.

Since BAT was created, the team helped reduce burglaries in our community by 31% in 2014 (the highest rate of decline statewide) – and we’ve seen an additional 16% drop already in January - September 2015. In just 17 months since being launched, the BAT made 203 felony and misdemeanor arrests for numerous crimes including burglary, dealing in stolen property, grand theft, grand theft auto and active warrants for armed kidnapping, lewd and lascivious molestation and other violent crimes. BAT also recovered more than $21,000 in cash and seized stolen guns from the hands of criminals. The priority of BAT is to identify and arrest those responsible for residential burglaries in Broward County, which most often occur when people are at work or school. The team’s tactics are generally the surveillance of burglary “hot spots” and known or suspected burglars, plus the use of cutting-edge law enforcement technology. The team consists of eight detectives from assorted BSO districts and a BSO sergeant assigned to our countywide regional services. On most days, at least one or two municipal police officers join our BSO detectives to help apprehend suspects who operate across the borders of various local cities when committing their burglaries. The BAT works closely with detectives from many local police departments, including Wilton Manors, Plantation, Margate and Coral Springs. This joint effort has solved burglaries that occurred across Broward County. BAT has also joined forces with Boca Raton Police Department and the Palm Beach Sheriff’s Office to form a multi-jurisdictional burglary task force. The pooling of law enforcement investigators is a vital part of the teamwork that makes BAT so effective. Crooks don’t hesitate to cross city or county borders, so neither does the BAT. You may not see a “BAT signal” in the sky, but this specialized unit is working around the clock to stop burglars and protect your home. here is no doubt that the average age of orthodontic patients has lowered through the years. Just open a yearbook from the 50’s and 60’s and you will see many young adults wearing the stereotypical “train tracks” across their teeth. Movies have spoofed the usage of head gears during the high school years, which was common practice in that era. Braces have become smaller, sleeker, more colorful, and worn with pride by many preteens. For those of you who have young children at home, the main question is whether early treatment is right for your child. To best answer this question, it is first important to define some terms. When discussing “early” treatment, I personally prefer the term “interceptive” treatment. It has the connotation of catching something before it becomes a bigger problem. The more common and practical term is “phased” orthodontic treatment. In this case, treatment done at an earlier age (usually between 6-9 years old) is referred to as Phase I. It is aimed at correction of habits and skeletal discrepancies, as well as severe abnormalities in dental eruption. The later treatment, Phase II, is usually done at around 11-13 years old in order to place all permanent teeth in an ideal position. I call it more practical, because in most cases the second treatment is needed. The name serves as a reminder to the parents of this fact. Currently, the American Association of Orthodontists recommends that the first orthodontic evaluation occur by age 7. Does this mean that all children require phased orthodontic treatment? It certainly does not. The criteria for starting early treatment should be better or more predictable results. In my opinion, this is certainly the case when the upper jaw is too narrow and must be expanded, when upper front teeth are so protrusive (“buck”) that the incidence of trauma is much more likely (unless corrected), and cases of underbite (when the lower jaw is forward of the upper jaw). These treatments are “no brainers” for two reasons. The body of the younger patient is more amenable to these specific orthopedic (growth) corrections and statistically the preteen is more likely to traumatize a front tooth than at any other time. There are other times that treatment may be done for psychosocial reasons, as some children are very conscious of cosmetics. For those parents who are considering early treatment for their children, I recommend listening with an open mind. See if the reasons for starting treatment make sense to you. The rule of thumb would be “if it does not make sense – don’t do it!” I find that most parents have a life philosophy, which may make them either more or less open to preventative type treatments. As a parent, I find that I know what my child will be able to handle and be up to. Most importantly, if you decide as a family to start, have fun with it. Drs. How to Defend Against and Eliminate Deficiency Judgments By Omar J. Arcia, Esq. Foreclosure Defense and Bankruptcy Protection Attorney

T

he most recent trend of cases coming into our office is “deficiency judgment” actions brought against homeowners after a foreclosure, short sale or deed in lieu. If you were foreclosed out of your home, completed a short sale or returned your property to the bank through a deed in lieu, the bank may still sue you for the difference between what you owe under the mortgage and the value of the property in question. That is called a deficiency judgment, and if not properly defended, can lead to garnishment of wages, levying of bank accounts and repossession of vehicles. There are several key ways you can defend against or eliminate deficiency judgments altogether. The first and most effective way of defending against a deficiency judgment is based upon a recently enacted law in Florida which requires that as of July 1, 2013 a deficiency judgment action be brought within one year of a final judgment, short sale or deed in lieu, instead of the previous law that allowed up to five years to bring a deficiency judgment action. If properly presented in court, the new one year law can be used to stop a deficiency judgment action in its tracks. The second line of defense against a deficiency judgment is to challenge the right of the party bringing the action to collect on the judgment. Lenders often sell the right to a deficiency judgment to collection agencies, but the transfer may be entirely ineffective for failure to comply with legal formalities. If properly challenged, the new “pretender lender” may voluntarily dismiss their deficiency judgment action, and you may even be entitled to a refund of your attorney’s fees. Of course, one sure-fire way to eliminate any deficiency judgment is to file for bankruptcy protection at the first suggestion anyone is attempting to seek a deficiency against you. Once you file a bankruptcy, not only will all legal proceedings stop instantly, but when you receive a discharge in bankruptcy, your mortgage deficiency, all credit card, medical, and all other unsecured debt is forever eliminated.

Making a Counteroffer

T

his is a continuation from the article that ran in the December 2015 issue of Our City Davie, “What a Seller Needs to Know before Closing.” To be binding, you must sign the counter offer and deliver it to the buyer or the buyer’s agent Once this is done: ▸▸ You have REJECTED the Buyer’s original offer. Signing a counteroffer cancels the buyer’s original offer. Your counteroffer is a NEW OFFER. This puts the ball back in the buyer’s court. ▸▸ Give the buyer a reasonable amount of time to consider the terms you are proposing. If the buyer does not respond, the counter offer expires. You have now fallen out of negotiations with that particular buyer. Those negotiations can only be reactivated by the buyer submitting a fresh offer. What does the buyer do next? When he receives a counter offer, the buyer has three choices: ▸▸ Accept the offer. The buyer does this by timely signing the counteroffer and delivering the signed offer to your real estate agent. ▸▸ Reject the offer. The buyer can discard your counter offer and take no further action. ▸▸ Counter the counteroffer. The buyer can make a second counteroffer, or even a third or a fourth, until you reach a deal. Multiple counter offers are rare. Most well-advised buyers and sellers reach agreement after one or two rounds of negotiations. When should a Seller counteroffer? Your agent handles offers and counteroffers in the regular course of business and will have a good handle on whether a buyer’s offer is reasonable based on the current market. You, the Seller, have a “price” expectation, and your real estate agent will do his best to meet that expectation. If the offer is clearly unreasonable, your real estate agent will advise you to submit a counteroffer. If you are selling in a buyer’s market, the buyer may have his pick of suitable homes in your area. Making a counteroffer, even one that seems reasonable, may drive the buyer towards the second home on his list, and you may end up with no deal. Conversely, in a seller’s market with a shortage of suitable homes for sale, the buyer engages in two to three rounds of counteroffers. In this scenario, the Seller can probably afford to push for your perfect deal. Your real estate agent should investigate the buyer’s motivation. If the offer is unacceptable and the Seller wants to counter, what type of counteroffer will be best – one that raises the price or one that keeps the price lower, but eliminates any repairs or additional costs to the Seller? The net dollar price of the two counteroffers may be the same, but the buyer may find one deal more palatable than the other. Listen to your Realtor. If you, the Seller, can live with most of the items in the offer, it would behoove you to take it. Having a willing and able buyer under contract is worth far more than a home sitting on the market waiting for “the perfect offer” to come along. I

have been practicing law for over 36 years. I realized many years ago that allowing a judge or jury to make a decision in a case is always a last resort. Cases that ultimately proceed to trial involve either issues that cannot be compromised or individuals who can be unreasonable in their expectations. If you proceed to trial, your ability to control your destiny is severely compromised. You are allowing a third party to dictate the terms and conditions of your future. I can assure you that Judges much prefer to approve a settlement reached by the parties than to decide the fate of individuals. Judges often tell the respective parties that they will always be better off deciding the case between themselves, rather than have he/she decide some of these issues. They are further informed that a judge’s job is to be fair and equitable, which means that after the trial is over both parties usually leave the courthouse unhappy, neither obtaining what they were seeking. Of course that is not always true. There are obviously times when parties’ expectations are within reason and the results obtained at trial are satisfactory.

So how do you know when you should settle versus the alternative of going to trial? That is sometimes a very difficult question to answer. A lawyer can never guarantee results. A lawyer can advise a client about the law as it applies to the facts of his/her case. Often times judges have a great deal of discretion in their decision making, which makes any kind of prediction that much more difficult. Lawyers also assume that a judge will interpret the law as the lawyer interprets it. That is not always the case. When offers or counter-offers are unreasonable and one-sided, it is somewhat easy to make a decision. If you have nothing to lose by going to trial, and your worst result in court is still better than the offer being made, it is an easy decision. The cases which present the more difficult decisions are the ones which result in offers which are perhaps fair, but not quite what a person may envision as their end result. Perhaps the time sharing schedule with the minor children is not quite what was envisioned or the alimony amount is more than you expected to pay. Do you compromise or litigate? There is no easy answer. Each case needs to be looked at independently. A party must consider all possibilities. Cost and time are two important factors. A case which proceeds to trial will always take longer to conclude. The cost will always be greater. I suggest hiring an experienced trial attorney who can assist you in deciding the best way to conclude your case. There really is no substitute for experience. The law firm of Evan H. What are the latest trends in your industry? The latest trend in the health and fitness

industry is large group exercise classes. I am here to tell you that you simply will not get the same results in a large group exercise class as you will with a personalized training program. The main reason large group classes became so popular is because they are cheap. But BodyTrac has now revolutionized personal training and found a way to bring it to the world at a never before seen level of affordability so that you can experience all the amazing benefits of having an exercise program that fits your individual goals. One of latest technological trends that BodyTrac utilizes is heart-rate monitored training. All of our Members wear heart-rate monitors that transmit onto a large display so that our personal trainers can hold each of our Members accountable for the intensity at which they are exercising. This allows us to better motivate our Members to achieve results. We also use this technology to incorporate various challenges throughout the year to reward our Members for their hard work and also spark a little bit of competitive nature for those that enjoy “healthy” competition.
