THE DONOWAY CENTER NEW HOPE FOR ADVANCED PANCREATIC AND LIVER CANCER PATIENTS Patient’s once diagnosed with locally advanced Pancreatic and Liver Cancers were given little hope and often offered limited treatment options all with certain short life expectancies despite the treatment they were receiving. However, a new procedure called Irreversible Electroporation, also known as IRE or NANO-KNIFE for short, has changed all that. Patients are seeing a doubling and tripling of their life expectancies based on recently published reports. Though currently used in patients with known locally advanced disease it has now found its place in the operating room and used when patients are “unexpectedly” found to have more advanced disease than pre-operative imaging shows.

Dr. Robert Donoway, a surgical oncologist trained at SloanKettering, is the only surgeon performing these procedures. During the procedure, in the operating room, after it has been determined that the patient’s tumor is non-resectable, fine needle probes are placed through the tumor using ultrasound guidance to ensure there is no injury to critical structures such as the Bile Ducts and Portal Vein. High voltage current up to 3000 volts is delivered through the probes in 90 microsecond pulses synchronized with the patient’s heart rhythm to avoid any cardiac problems. The procedure lasts between 1 & 2 hours using imaging to follow the ablative process. After the procedure is completed the probes are removed and the patient is taken to ICU step down for a 24-hour observation period. Most patients are discharged in 2 or 3 days following surgery and because there is no major surgery to recover from they are able to start postoperative neo-adjuvant type chemotherapy and radiation sooner. After 3 to 6 months of combination treatment patients are re-evaluated and restaged. A number have been converted to Resection candidates, which is still deemed the standard of care. Preliminary results have been very encouraging and have more than doubled many patients' life expectancy. Clinical trials are ongoing to use new novel agents including monoclonal antibodies and vaccines as the next line of treatment in this highly selected & heavily pre-treated group. t has been a couple of weeks since those dreadful days. We saw our lights go out, the water come in (and out) and the winds blow. For the most part, however, we were ready. We closed our shutters, prepared our hurricane kits, filled our gas cans and gathered our insurance papers. Some of us evacuated, while others hunkered down and waited for whatever Mother Nature was going to bring. Our community did not come out unscathed, but mercifully the center of the storm avoided us this time. After seeing the near total devastation on the Caribbean island of Barbuda, some of us feel a bit lucky. One of the true honors of publishing this magazine is being able to tell the stories of members of our community doing incredible things. We have already heard countless selfless acts from “Hurricane Heroes” across the community. People putting the welfare of their neighbors before their own. We want to tell these stories. Considering A Divorce?

f you are considering a divorce, it’s critical to understand what would happen in the event of your incapacity or death, either during the divorce or after.

Unfortunately, many divorce lawyers do not discuss incapacity or death with clients simply because they do not have training in estate planning issues and it’s not at the forefront of their minds when they are advising you through your divorce. So, that means you may need to be the one to bring it up. When you do, here are some things for you to keep in mind: Depending on the jurisdiction, as soon as you file for divorce, automated “orders” go into effect which may limit what you can do with your assets during the divorce. While you cannot entirely disinherit your spouse during a marriage in the state of Florida, you can make certain changes to your estate planning in anticipation of your divorce or while it is in process. Talking with your divorce lawyer about these issues (or meet with your Personal Family Lawyer, if he or she has created your estate plan, before you file for divorce) is a wise choice. Keep in mind that if you previously had a single Personal Family Lawyer prepare an estate plan for you and your spouse, you should seek the advice of a new attorney, as a conflict of interest will arise with the attorney that prepared the joint plan. If you have already filed for divorce, you may want to revoke any existing powers of attorney, positions as

trustee, and health care directives giving your soon to be ex-spouse control over your assets and your medical decision-making if you were to become incapacitated, as well as execute what we call a “Divorce Will”, which is a “temporary” Will that would cover the disposition of your assets in the event of your death during your divorce. Talk to your divorce lawyer about these temporary documents that can be executed while you are in the divorce process, and then ensure he or she is coordinating with us on your behalf to get these documents prepared and signed. Be sure to update your “Divorce Will” and estate planning documents once your divorce is finalized and all asset dispositions have been handled. These new documents will take your new reality as a single adult into account. Miramar Community Garden: Planting Season in Full Force! COMMUNITY NEWS

hat a true labor of love! Planting season has begun at the Miramar Community Garden (MCG)! The garden’s planting season is generally tied to the school year calendar, from September (or before) through May of the following year. But, some plants grow throughout the entire year and of course, they need tending. Elsi Rose, Development and Capital Management Coordinator, manages all the garden activities, from planning to harvesting; she has been its guardian since its inception in May 2010. As many residents of Miramar already know, the MCG was built with donations from corporate sponsors. The funds started the original 3,150-square foot garden. According to their official website, they received a $60k grant from GRO1000 Gardens and Green Spaces by the U.S. Conference of Mayors and Scotts Miracle-Gro Company in 2014. The garden grew! To a very nice 7,000-square foot area! It is now home for a butterfly garden, fruit grove, and much, much more! All work in the garden is done by volunteers. Official members include 20 dedicated people that have a variety of talents, four master gardeners, and one chef. Ms. Rose wants to stress: members do NOT need to be residents! Anyone can sign up to be a member at the web address at the end of the article. To date, member-volunteers have logged in excess of 19,000 service hours since May 2010. Approximately 20 events are organized by the members each year. According to Ms. Rose, members join for a variety of reasons. Some join for their love of gardening, some for educational purposes, some for community service hours, and more. MCG is the first “micro farming system” in the county. It provides many opportunities to the community, members, and volunteers by offering a social network for gardening lovers, educational information for volunteers to learn about urban agricultural businesses, a chance for vocational training, and also for service hours (mentioned above). Most importantly, it promotes learning how to grow organic, healthy, natural fruits and veggies in “your very own backyard.” The MCG’s Fact Sheet lists many of the components of the garden. They include, but are not limited to: ▸▸ Gro-bags ▸▸ Drip irrigation ▸▸ A vermiculture station (worm hotel) ▸▸ Compost stations ▸▸ A banana grove ▸▸ Pollinator borders surrounding the garden ▸▸ A demonstration area showcasing sustainable agriculture ▸▸ And rain cisterns Planting season starts with all the planning and preparation you may imagine. The planning stage begins with assigning members as garden “Row Captains.” One member, or “Row Captain,”

is assigned to maintain and direct volunteers for a single row. Each row grows selected garden plants, fruits, and vegetables. However, before that begins, supplies are gathered, from fertilizer and manure to mulch and seeds for planting. Every member is requested to volunteer two hours of what they refer to as “sweat equity” per week. Most donate much more time. Each 3rd Saturday of the month, MCG holds a Volunteer Day at the Garden. Volunteers are needed for monthly projects including tidying up the garden and any other special, ongoing projects. They meet from 8:00am – 10:30am at the garden. It’s a great opportunity for clean air, solid physical but rewarding activity, and area improvement. They also hold a monthly garden general meeting at the Fairway Community Building to coordinate and organize monthly activities and events. Be sure to check their website garden calendar for dates each month. The meeting is open to the public. The MCG members work hand in hand with many schools and other organizations. They work very closely with Jason Fairway Elementary School, adjacent to the garden, and other schools throughout Miramar. They also gain volunteers from colleges, corporations who hold volunteer days, Girl Scouts, Boy Scouts, and many more. Currently the Miramar Community Garden volunteers are planning Garden Markets on upcoming Saturday mornings where people will be able to choose and harvest their preferred crops. Organic practices will be taught and discussed. The Market Garden includes crops such as dragon fruit, sugar cane, pineapples, lettuce, and kale. The garden boasts one Master Gardener and Row Captain who is an expert tomato gardener; the garden grows approximately 42 varieties of tomatoes! The harvesting season presents many opportunities for special events such as Earth Day’s Disco Soup that was held in April of this year. We’ll have much more information in future issues! Our City Miramar has been unable to reach Ms. Rose post Hurricane Irma. We hope there was minimal damage to the garden and all is well. Look for more news in future issues of Our City Miramar. Breast cancer survival has improved over the years due to new, innovative therapies. However, some treatments may cause cardiotoxicity, or damage to your heart. This is especially true if you are at risk for heart disease. According to Thomas Samuel, MD, Cleveland Clinic Florida breast oncologist, “A significant issue for women with breast cancer is the ‘survivorship’ period, which refers to what happens after they survive the cancer. It’s particularly important to be aware of the risk of heart disease.” Many of the therapies used, including chemotherapy, radiation therapy and hormonal therapy, can impact a patient’s longterm cardiac risk. Dr. Samuel adds, “For example, some of the agents we use in chemotherapy increase future risk of heart failure. Certain chemotherapy regimens that include medications called anthracyclines can cause weakness of the heart muscle and congestive heart failure.

“Thankfully, today radiation therapy techniques are very safe and localized, and are designed to spare the heart from any significant damage,” said Dr. Samuel. Cardiotoxicity can occur in various forms, including damage to the heart muscle itself, arteries, or the heart valves. Although cardiotoxicity can be life-threatening, it can often be managed effectively with medication and minimally invasive treatments. Diego Sadler, MD, Cleveland Clinic Florida cardio-oncologist said, “Fortunately, the percentage of patients affected by these treatments is relatively small and there are now sophisticated imaging modalities that allow early detection and treatment of heart disease resulting from cancer treatment for breast cancer.” Breast cancer patients who have undergone these types of treatments, but who are also at high risk for heart disease due to other conditions, are at an increased risk for cardiotoxicity. “Pre-existing factors such as hypertension, diabetes or genetic conditions affect breast cancer survivors similar to how

they affect the general population; however, having undergone certain cancer therapies may put them at an even higher risk for heart disease,” said Dr. Sadler. It is also important to know that some therapies used in the treatment of breast cancer have the potential to cause cardiac disease many years, even decades after treatment. For this reason, surveillance to allow for early detection and treatment can offer improved cardio-vascular outcomes. The relatively new specialty, cardio-oncology, focuses on the effect cancer treatments have on the heart. At Arc Broward’s Main Campus Students Reach Their Full Potential COMMUNITY NEWS

fter a tour of Arc Broward’s main campus, it is even more clear how important the non-profit is to Broward residents. It sits on almost 10 acres of property located in Sunrise, Florida. Built in the late 1980s, the campus has since been home to most of Arc Broward’s 21 programs, including Arc Broward Preschool, which was the program that started the organization in 1957. The Children’s Division has programs that serve children from birth through age 21. One of these is an in-home program called Parents as Teachers (PAT), a preschool, specialized after school and summer camp. The equipment needs are tremendous for this and all programs such as therapy bikes, exercise equipment, and other apparatus geared to help children with disabilities. The campus is in great need of grants to purchase more equipment and build an Outdoor Fitness Zone and Playground. The specialized Zone will be built to specifically to serve requirements for children in the after-school and summer camp program. According to Jessica Rodriguez, Director of Development, Arc Broward received a grant last year from the Florida Panthers that was used to purchase muchneeded equipment that provides for some of their needs. They have applied again this year and hope for positive results.

Ms. Gina DeGesero, one of their valued employees, has two children, Xavier and Oliver, who graduated from the Arc Broward Preschool. She volunteered for quite some time during their attendance and eventually became a full-time employee. She loves her job and helping the children daily. In addition, the campus provides after-school and summer-camp programs geared toward providing needs for children with developmental disabilities and have severe behavioral problems. The facility also has programs for Transitioning Youth: the School of Hire Education and Youth Links, both focused on helping ensure they are career-ready. This Summer they tallied the number of minutes the students worked. Their grand total was an astonishing 349,440 minutes of paid internships! Arc Broward also has a transportation division and vehicle fleet of about 40 vehicles that transport clients, including the Adult Day Program Clients. 9-Year-Old Organizes “Kids on a Mission”

hat a fabulous example for others! Miley Morales is a true hero! According to her mom, Jennifer Rodriguez, after preparing for the catastrophic storm Hurricane Irma, they are thankful their family is just fine. Post Hurricane Irma making its presence known and leaving the area, 9-year-old Miley insisted they do something to help others. Residents of Miramar for a little over three years, they started by Miley and her mom finding a Publix that was open. They bought as many cupcakes as they could, took them home, and froze them for a couple of hours (luckily the freezer was still extremely cold). Then they set out to distribute them to all the public servants they saw working and to the Fire and Police Stations. In an email, Jennifer explained Miley’s next idea. “Mom we bought so many items that thankfully we didn’t need, I’m sure everyone did too, since the stores were so crazy. Why don’t we go door to door and ask people for extra items they would like to donate and we can take them to the Keys to help those that really do need them.” This is when Kids on a Mission was born! In a short time, they were able to enlist the help of: Luis “lucho” Pedraza from the Galiz Cycling Foundation; the Knights of Columbus #14730 of Saint Louis Catholic Church, Pinecrest , FL; and Gerardo “Jerry” Rodriguez, Miami Dade County Councilman District 10.

One young girl with a mission united kids from several communities to help collect donations. For two days, Miley went door-to-door gathering items; then she began hosting a donation drive. On Saturday, September 16th Miley, accompanied by other community children she recruited, went to Boaters Park on 178th and Pembroke Road. Between 9am and 3pm, they accepted donations. Miley’s goal was to fill a “reeeeaaaly big truck” and surpassed that goal by a long shot! On Sunday, a group of volunteers drove with five truckloads to the Florida Keys, set up stakes, and watched people take what they needed. They collected useful clothes, water, canned goods, and much more. Other groups delivered contributions from Homestead all the way to north Broward County. Jennifer’s daughter has worked extremely hard and united more than 50 kids in just two days. All parents participated as Miley managed to get them involved in the community and taught them the joy of giving. Jennifer is very proud of her daughter and says if you were to meet her she has no doubt you would see how unique and special this 9-year-old is. olor blindness is a disorder affecting the capability to see colors under typical light or to discern colors as they are normally seen. Generally, the condition is present at birth, but it can also result from old age or a number of diseases of the eye. The discernment of color depends on cones located in the eye. People are usually born with three kinds of pigmented cones, each of which perceives various wavelengths of color. When it comes to pigment, the size of the wave is directly linked to the perceived color tone. Short waves produce blue tones, middle-sized waves are perceived as green tones and longer waves are seen as reds. Which type of cone is affected impacts the spectrum and severity of the color blindness. Because it is a gender-linked recessive trait, green-red color deficiency is more frequent in men than in females. Still, there are a small number of females who do experience some degree of color blindness, particularly yellow-blue deficiencies. Color vision deficiencies are not a debilitating condition, but it can impair educational progress and work performance. Not having the ability to distinguish colors as friends do can quickly and negatively impact a student’s confidence. For working people, color blindness could become a disadvantage when competing against peers trying to advance in a similar industry.

There are several examinations for color blindness. The most common is the Ishihara color test, named after its inventor. For this test a patient views a plate with a circle of dots in various sizes and colors. Within the circle appears a digit in a particular tint. The patient’s ability to see the number inside the dots of contrasting colors indicates the level of red-green color sight. Even though inherited color vision deficiencies can’t be treated, there are some steps that might improve the situation. Some evidence shows that wearing tinted contacts or anti-glare glasses can help people to see the distinction between colors. More and more, computer applications are becoming available for regular personal computers and even for smaller machines that can assist users to distinguish color better depending upon their specific diagnosis. There are also exciting experiments being conducted in gene therapy to correct the ability to distinguish colors. How much color vision problems limit a person is dependent upon the type and severity of the condition. Some individuals can adapt to their condition by familiarizing themselves with alternate cues for colored objects or signs. For example, many individuals are capable of learning the shapes of traffic signs (rather than recognizing red) or contrasting items with paradigms like a blue body of water or green trees. he process of getting your home ready to be listed for sale goes beyond finding the correct Realtor for the job of selling your home and pricing it correctly at the fair-market value. It is to the seller’s advantage to sell quickly once the home goes on the market, as they usually maximize their profits when they sell earlier in the process rather than later. Very few homeowners ever think about prepping their home’s condition prior to listing in search for that “easy sale.” Sellers have a great deal of control over how their property is perceived, and there are quite a few things that you as a seller can do to prepare your home for sale to maximize its value in the eyes of prospective buyers. Here are a few points to consider prior to listing your house for sale: ▸▸ Before preparing your home for sale, prepare yourself first. Learn to separate your emotions from the selling process. Frankly, this is easier said than done. It is best if a seller totally disconnects. Instead of looking at it as your home, you should look at it as a product that you need to market and sell for the highest possible price. Prepare yourself so you do not take the opinions of prospective buyers and Realtors about the home personally. ▸▸ While getting accustomed to the idea of detaching your emotions from the sale, it is also best to start thinking of de-personalizing the property. This may seem harsh, but buyers tend to visualize the property as his or hers, and not yours. This can be accomplished by removing family portraits, personal photos and other personal effects that could cause a distraction to the buyer viewing the property. ▸▸ Another advantage to selling is to totally de-clutter. Buyers want to get a good feel for the layout and space within the house. Closet and garages in disorder with clutter pose a big turn-off to buyers. ▸▸ Beating your competition with condition is another important factor. Performing repairs to everything that needs maintenance, from the leaking faucet to repainting to cover the nicks and scratches on the walls from the everyday wear and tear. A complete home inspection is recommended, so that you can identify what needs to be repaired and have the opportunity to fix it beforehand. Let’s revisit the number one aspect that counts in selling your home. A seller needs to get real about the pricing. We have access to so much information and knowledge, so today’s buyers are very educated about the market and the comparable sales within the area, which heavily influences the fair market value of your home. Have your Realtor do a comparable market analysis and price the property right from the onset. The adage by where sellers price above the fair market value so that there will be room to negotiate just doesn’t make a lot of sense, does it? Oddly enough, even though we are currently experiencing a shortage of inventory for sale, buyers are “sitting on the fence” and not acting unless the home is priced fairly and is in good condition. My advice has always been to price it correctly from the onset, so that you can have the maximum amount of interest and possibly create a situation where you will have multiple offers on the property! How to Defend Against and Eliminate Deficiency Judgments BY OMAR J. ARCIA, ESQ. FORECLOSURE DEFENSE AND CONSUMER ADVOCACY ATTORNEY

he most recent trend of cases coming into our office is “deficiency judgment” actions brought against homeowners after a foreclosure, short sale or deed in lieu. If you were foreclosed out of your home, completed a short sale or returned your property to the bank through a deed in lieu, the bank may still sue you for the difference between what you owe under the mortgage and the value of the property in question. That is called a deficiency judgment. If is not properly defended, it can lead to garnishment of wages, levying of bank accounts and repossession of vehicles. There are several key ways you can defend against or eliminate deficiency judgments altogether. The first and most effective way of defending against a deficiency judgment is based upon a recently enacted law in Florida, which requires that as of July 1, 2013 a deficiency judgment action be brought within one year of a final judgment, short sale or deed in lieu, instead of the previous law that allowed up to five years to bring a deficiency judgment action. If properly presented in court, the new one-year law can be used to stop a deficiency judgment action in its tracks. The second line of defense against a deficiency judgment is to challenge the right of the party bringing the action to collect on the judgment. Lenders often sell the right to a deficiency judgment to collection agencies, but the transfer may be entirely ineffective for failure to comply with legal formalities. If properly challenged, the new “pretender lender” may voluntarily dismiss their deficiency judgment action, and you may even be entitled to a refund of your attorney’s fees and damages if you have valid claim under one of Florida’s consumer collection protection laws. Of course, one sure-fire way to eliminate any deficiency judgment is to file for bankruptcy protection. Once you file a bankruptcy, not only will all legal proceedings stop instantly, but when you receive a discharge in bankruptcy, your mortgage deficiency, all credit card, medical, and all other unsecured debt is forever eliminated. Bankruptcy, however, should be reserved as a last resort option. Defending a foreclosure, deficiency judgment and filing for bankruptcy are NOT do it yourself propositions. he effects of blasting are still a major concern for the residents of the City of Miramar because of the negative impacts it is causing to our quality of life. The City Commission has been working hard to ensure our residents find relief and get action. Our successful lobbying efforts resulted in Governor Rick Scott and the Florida Legislature getting involved to assist our city in finding solutions. I held an Intergovernmental meeting in the City of Miramar on August 24, 2017 to discuss a path forward to study the blasting in our area and its negative impacts on property and individuals. In attendance were representatives from the Florida State Fire Marshall, City of Miami Lakes and a representative from the Riviera Isles Blasting Committee. To properly address the residents’ issues of blasting, the meeting highlighted areas of concern throughout the discussion. The most important issue discussed was the state funded study to determine the impacts on property based off of the current levels of blasting. The results from this study can then be used to shape any future blasting legislation and regulations, potentially providing relief for residents and mandating more aggressive restrictions on White Rock Quarry. During the discussions, I shared with the Fire Marshall representatives Miramar’s position to ensure the study captured important concerns of our residents. First, the state funded study must include Miramar due to the fact of our unique geology and White Rock Quarry having one of the largest mining operations. Second, the city is demanding that health impacts be included in the study or be concurrently assessed. Finally, I stressed the demand that the study be independent of any consultant that would be influenced by White Rock Quarry. Because we are all in this together, the City of Miramar has created a Blasting Advisory Board made up residents and the business community. The Blasting Advisory Board provides information and recommendations to the commission during this process. Miramar will maintain an active role in the study. Our goal is that the city of Miramar receives a study that will provide answers for our residents. The study should provide regulations that prevent blasting activities from damaging our homes and/or causing mental and emotional distress, and facilitate a claims process that works for residents opposed to the process that exist today that works against residents. Yours, Mine and Ours

sad fact is that the average marriage lasts only seven years, with one out of two marriages ending in divorce. As over seventyfive percent of divorced individuals eventually choose to remarry, blended families now outnumber traditional nuclear families. And while this family dynamic has become the new normal, it’s a far cry from what was portrayed on the classic television series, “The Brady Bunch.” If you are part of a blended family, you face some unique estate planning challenges. These include providing for your current spouse if he or she survives you, and making sure that when your spouse dies your children will be taken care of. Family relationships may change dramatically after the first spouse dies and what the surviving spouse does with his or her assets can often be unpredictable. Let’s review just a few possible estate planning options.

Your spouse

A simple, albeit not wise, approach would be to leave everything to your spouse. As your spouse adores your children, you have no doubt that he/ she will always take care of your children, right? Realistically, this approach might end up totally disinheriting your own children! Consider this. If your spouse becomes incapacitated it is very likely that your spouse’s children will take over the financial affairs of the family. You don’t need a vivid imagination to see how that might turn into a disaster. What happens when your spouse dies? Or remarries? Your assets may ultimately be inherited by your stepchildren, or even by the person who marries your spouse. Proper legal planning can avoid these pitfalls.

Your children

Another solution is to leave assets to your children. Of course, this guarantees that your children will not be disinherited, but this path may also lead to unintended consequences. Leaving assets outright to your children opens up a wide range of concerns, including the possibility that they may squander their inheritance by spending or investing unwisely, or lose most or all in a nasty divorce, an untimely lawsuit, or through bankruptcy. Even if your children are adults, shouldn’t you still consider protecting them from future creditors and predators?
