n the span of just six days, eleven people were murdered at the Tree of Life Synagogue in Pittsburgh, Pennsylvania, a man murdered two black shoppers at a grocery store outside of Louisville, Kentucky, and a local man mailed more than a dozen pipe bombs to prominent critics of the President. In summary, it was a horrible week for our country that was driven, in part, by division and hatred. Shortly after the horrible events in Pittsburgh however, Tarek El-Messidi, a founder of the Muslim group Celebrate Mercy, set up a fundraising initiative in partnership with another Muslim group called MPower Change on behalf of the Tree of Life victims. Their goal was to raise $25,000 to help the Jewish families impacted by the assault. In a matter of days, they had raised more than $250,000, mostly from Muslim donors. Perhaps as important as the financial aid is the message they sent: we are all in this together. El-Messidi emphasized his motivation to help was driven by a sense of shared humanity, “We are here for you, if you need anything at all. If you need food for the families, if you just need someone to come to the grocery store because you don’t feel safe, we will be there for you.” In this time of extreme division, we can all learn from the example of the actions of these thoughtful, generous people. When we sit down with our families this holiday season, regardless of whether you celebrate Hanukkah, Christmas or nothing at all, we must all remember that we are in this together, not against each other. Sincerely,

Home Care Assistance Because Living at Home Is the Best Way to Live BY DEBBY TEICH

F

inding high quality and reliable care for an elderly parent, grandparent or family member is often very frustrating and challenging. Matt and Mariela Rogers, owners of Home Care Assistance, understand these struggles first-hand and want you to know that you are not alone. Home Care Assistance provides older adults with quality care in Pembroke Pines and surrounding cities that enables them to live happier, healthier lives at home. It is well-known for the caliber of its caregivers, the responsiveness of the staff, and expertise in live-in care. Caregivers and staff embrace a positive, balanced approach to aging centered on the evolving needs of older adults. Home Care Assistance is changing the way the world ages. Owners Matt and Mariela Rogers answered some commonly asked questions about Home Care Assistance. Why did you start Home Care Assistance? We learned about the challenges that families face when caring for an elderly loved one after Matt’s wonderful great aunt was clinically diagnosed with long-term dementia at the age of 74. The struggles of dealing with hospitalizations, doctor’s appointments, managing medications, and coordinating medical

needs and care left our family confused, frustrated and extremely overwhelmed. Seeing our family struggle during that difficult period helped us realize that caring for an aging family member is a full-time job and cannot be done alone. This is where our call for making a difference in the transitions of elder people came in, and this inspired us to open our own Home Care Assistance location right

Owners Matt and Mariela Rogers learned about the challenges that families face when caring for an elderly loved one after Matt’s Great Aunt Willa was clinically diagnosed with dementia. She still enjoys a variety of activities, including spending time at the family farm.

here in Pembroke Pines. Thankfully, with the right intervention at a critical time, both Matt’s aunt and parents are living and enjoying life again just like before. His great aunt enjoys gardening, sewing, crosswords puzzles and her favorite pastime - watchOwners Matt and ing bird feeders at the Mariela Rogers family farm. What type of care do you provide? We provide personalized care to help you or a loved one live well where most seniors prefer - at home. Our caregivers lend a hand with just about everything from bathing, dressing, and grooming, to preparing meals, medication reminders, and light housekeeping. In addition, our caregivers drive, so they often take clients to doctor’s appointments, to run errands, and even on recreational outings, e.g. the museum or a movie. Why is living at home the best way to live? When seniors live at home, they

are able to maintain their freedom and a well-deserved quality of life. We can offer you or your loved one a comprehensive alternative to a nursing home or assisted living facility. How do you select the best caregiver for clients? Home Care Assistance specializes in hand-selecting a best fit caregiver to optimize each client’s longterm health, safety and well-being. We offer an extensive roster of qualified caregiver employees with a diversity of backgrounds, experiences and personalities to ensure you receive quality care that is customized to your needs and preferences. Describe your care personnel. We provide care personnel for families and senior and health care professionals alike, providing a diverse roster of qualified caregivers to meet each client’s needs. We only hire 1 in 25 applicants. We make sure each caregiver has experience working with seniors and has references from previous clients, professionals and employers. Our caregivers also undergo continuous education on care for seniors through our proprietary Home Care Assistance University on subjects including, chronic conditions that affect seniors, safe transferring and even nutritious culinary training! What part of the care process do you manage? We manage everything. Home Care Assistance manages your caregiver so that you don’t have to. All of our caregivers are employees that are bonded and insured for your protection. Plus, our team manages all aspects of taxes, benefits, and worker’s compensation. We even handle long-term care insurance claims and payment to make the process stress-free for our clients and their families. What is the Balanced Care Method? The Balanced Care Method is an evidencebased program built on studies that demonstrate that only one-third of our

longevity is based on genetics and twothirds on lifestyle factors within our control. Home Care Assistance caregivers are trained in the Method, offering the first senior care solution with an emphasis on balance and longevity. By working with specific lifestyle behaviors, Home Care Assistance caregivers extend and enhance the lives of seniors, helping them live longer, happier, more balanced lives. What do you offer that is new in the field? The Cognitive Therapeutics Method is a brain health program developed by researchers at Home Care Assistance. The program aims to improve quality of life in our clients through a holistic approach incorporating positive lifestyle improvements, as well as personalized, one-on-one activities that engage the main cognitive domains of the brain. Where do most of your clients live? Home Care Assistance provides older adults with quality care in Pembroke Pines, Miramar, Weston, Cooper City, Southwest Ranches, Davie and other cities that surround Pembroke Pines. How can readers find out more information? You don’t have to do it alone. We are here to help. It’ll be our pleasure to discuss the senior care options available to you or your loved one.

Masquerade Party Raises Awareness of Kidney Transplants BY DEBBY TEICH

N

early 100,000 people are on the waiting list for a kidney transplant. In fact, many more people are waiting for a kidney than for all other organs combined. Unfortunately, the number of people waiting for kidneys is much larger than the number of available kidneys from living and deceased donors. On December 29, Ray-j Wedding & Events will host the 1st Annual Masquerade Party at Reign Restaurant & Lounge in Pembroke Pines to raise funds and awareness about the importance of organ donation Judith Charlton and her and the prevention of renal son, Charlton Johnson disease. Proceeds will benefit the National Kidney Foundation of Florida. There will be live entertainment, a silent auction, a special guest appearance and refreshments. The event is black tie and masks are suggested. The champagne reception begins at 7pm. The cost for a single ticket donation is $55. Pembroke Pines Mayor Frank C. Ortis is expected to attend and present a Proclamation, making 12-29 Kidney Health/Organ Donor Awareness Day.

“It’s a party with a purpose – organ donors saving lives,” said Judith Charlton, event founder. Charlton is a passionate advocate of organ donation. She has volunteered much of her time planning and assisting with events for the Transplant Foundation, Inc., which is affiliated with the Miller School of Medicine at the University of Miami. As an organ donor and mother of a son with renal failure, she has first-hand experience with many of the issues associated with organ donation and renal disease. When her first child, Charlton, was born 32 years ago, he was diagnosed with Congenital Nephrotic Syndrome. The prognosis given was that his kidneys would progressively fail and he would not live past the age of four. “That was a big diagnosis for a 6-pound, 7-ounce baby boy,” Judith recalls. “The hospital became our second home, but we quickly realized that we were among the lucky ones as there were many more babies and children far worse off than we were.” Charlton had his first kidney transplant at age 3 ½ and Judith was his donor. Two years later, his kidney

went into chronic rejection. At age 9, he started dialysis. Nine months later, he received his second transplant. A transplant, however, is a treatment, not a cure. For over 10 years, he has been on the transplant list again - awaiting his third transplant. It is now more difficult to find a match, because he has had two other transplants. “He has gone through more surgeries and hospitalizations than most people three times his age, but he keeps a positive attitude,” said Judith. “When asked how he is doing, his answer will always be, ‘I’m fine.’” For information on organ donation, visit the National Kidney Foundation of Florida, www.kidneyfl.org, or the United Network for Organ Sharing, www.unos.org. INSPIRING INDIVIDUAL

Pembroke Pines Resident Receives TIAA’s Difference Maker Award BY DEBBY TEICH

S

arah Garman, Pembroke Pines resident, was recently awarded $10,000 by TIAA for her work with the nonprofit organization North Campus Food Pantry for Students. Sarah was honored as part of TIAA’s Difference Maker 100 Program, a national initiative to recognize the positive impact nonprofit employees have on the world and in their local communities. TIAA received over 4,000 submissions, each one representing an inspiring story that epitomizes what it means to be a difference maker. The final Difference Maker 100 Honorees were selected based on their impact, creativity, perseverance and motive. Each of the 100 honorees received a $10,000 donation in their name to the nonprofit organization they support. “The individuals who are being recognized are selfless in their commitment to serving others,” said Laila Ali,

program ambassador. Garman is a faculty member at Miami Dade College, where she started the North Campus Food Pantry for Students in 2014. The student-run food pantry is stocked with donations from faculty, students and staff. This year, it distributed over 23,000 food items. “The pantry has helped certain students avoid having to decide which to buy - food or their textbooks,” said Garman. “Even though MDC has kept our tuition low, the high costs of housing and low wages have made it difficult for many students to continue their education. It is imperative that they do so, because we know that education is a key way to overcome the many barriers of poverty.” The model has been so successful that it was duplicated on all seven of the college’s campuses. To cope with a growing need, Garman devised a creative form of fundraising: a sponsored

High Tea Party. At the event, school departments purchase tables to decorate and compete for titles, such as Most Beautiful and Most Creative. This year, they raised over $4,500. “We have really made this a campus based initiative,” said Garman. “We have an amazing committee of faculty, staff, and administrators who work hard to keep the pantry working. The whole campus has embraced our food pantry, and we are committed to making it successful. One person cannot keep it going. It requires a village.” They are constantly trying to figure out how to make more food, particularly fresh food, available to students who need it. They are working with the faculty in the Science Department to grow fresh fruit and veggies for the pantry. “The need is great,” said Garman. “As the word spreads, we are serving more and more students and it is difficult

Sarah Garman

to keep up with demand. Many of our students live below the poverty line, but a lot do not qualify for food stamps.” Garman says they are always looking for donations and will even pick up them up. They need canned meats (tuna, chicken), beans, pasta, rice, peanut butter and jelly, cereal bars, oatmeal, canned veggies and fruit. They also need hygiene products like toothpaste, tooth brushes, deodorant, soap, shampoo, and more. In addition, they are in search of an industrial refrigerator. n For information, send an email to sgarman@mdc.edu.

I Got in a Car Accident! Now What? BY CARLOS D. CABRERA s of October 1, 2018, there have been over 290,000 motor vehicle accidents in the state of Florida. With such frightening statistics, it seems a car accident in one’s lifetime is almost inevitable. Hopefully, you will never get into an accident but if you do, you should know your rights and remember to follow some common-sense tips. What are my rights after a car accident? Under Florida law, every driver is required to carry a minimum of $10,000.00 in personal injury protection (PIP) coverage and $10,000.00 in property damage (PD) coverage. Regardless of fault in the accident, Florida law requires your own PIP policy to cover 80% of your medical expenses and 60% of lost wages that are related to the accident. As a result, you have a right to PIP coverage up to a maximum of $10,000.00 under your own PIP policy for treatment and lost wages arising from your car accident, subject to any deductibles you may have chosen. Also, if you meet a certain threshold, you may be able to make a claim against the person(s) at fault for the accident. Accident victims should consult a lawyer immediately to discuss the specifics of their injuries to determine if they meet the threshold. With regard to PD coverage, it covers damage to property you caused in a car accident. It does not provide coverage to your own vehicle or property. There are, of course, many types of other coverages available for purchase. However, Florida law only requires PIP and PD coverage; all other coverages are optional, with some exceptions; for example, if you lease or finance a vehicle, the contract may require you to carry specific coverages and limits. What should I do after a car accident? If possible, attempt to do all of the following without risking further injury or damage: (1) Call the police and make a police report – get a copy of the driver exchange form from the responding police officer; (2) Seek emergency medical treatment, if necessary; (3) Take pictures of your damaged vehicle, the at-fault driver’s vehicle, and the accident scene; (4) Take names, addresses and phone numbers of witnesses; and (5) Take pictures of your injuries. What if I am at fault for my accident? Even if you may have been partly at fault for your accident, you may still be able to recover for your injuries. Florida follows the comparative negligence rule, which means that you can still recover for your injuries if you are at fault, but your recovery may be reduced by your percentage of fault as determined by the trier of fact (usually, a jury). For example, if you are found to be 25% at fault, you may still be able to recover 75% of your damages. This material is provided for general information only and is not intended to provide any legal advice. Every case is unique. Speak to your own lawyer about the specifics of your case.

embroke Pines offered many spooktacular ways to celebrate Halloween, including BOO-Ville. Thousands attended the event, which was hosted by the City of Pembroke Pines at the Charles F. Dodge City Center. Children were dressed up in every costume imaginable, including Superman, Mario Brothers, Spiderman and Batman. Families enjoyed the popular prizepacked pumpkin patch, movies, themed games and activities, a pre-decorated pumpkin carving contest, trick or treat stations, arts & crafts, fallthemed photo stations and many more fun activities. There was also a costume contest, which drew standing room only crowds who cheered for their favorite character. Pembroke Pines also participated in the Teal Pumpkin project, a program sponsored by The Food Allergy Research and Education Foundation, which educates the public about food allergies in children. The Teal Pumpkin stations gave away non-food treats and held different art activities including recycled ghost projects constructed from bubble wrap and spiders made from tissue paper. Joe DiMaggio Children’s Hospital provided reflective orange backpacks for the children to use and bring home.

The Frank Displays Artwork from Schott Communities

BY DEBBY TEICH

T

hrough December 15, area residents can visit The Frank’s new exhibition “Afterglow,” which is about defining the self through fleeting experiences. It features artists Reginald O’Neal (L.E.O.), Kandy G. Lopez and Michael Williams. The exhibit also includes the work of 14 artists from Schott Communities, a South Florida non-profit organization that provides services and classes to persons who are deaf or physically and/or intellectually challenged. The Schott artists created works using acrylic paint on canvas panels. The idea for the Schott exhibition came after The Frank C. Ortis Art Gallery and Exhibit Hall hosted a group of students from Schott Communities’ Adult Day Training program for a field trip during “The Wizard of Oz” exhibition this past summer. After seeing how talented, enthusiastic and proficient many of the students were during the art-making workshop component of the field trip, field trip leader and Program Coordinator Taryn Nicoll asked Schott if the students would be interested in collaborating with The Frank to showcase their artistic abilities. In preparation, The Frank Chief Curator Joshua Carden and some staff visited Schott Communities to help them create the work that is on display. The students

were given the freedom to communicate their own interests and, in turn, their unique artistic identities. They all drew inspiration from different sources; some are motivated by humor and irony, some are stimulated by their surroundings, while others are compelled to express their concerns and emotions. “At The Frank, it is our goal to initiate cultural change and to engage our community through the arts with no barriers to participation,” said Carden. “We specifically focus on supporting non-profit organizations, educational partners, underrepresented populations and community advocacy groups. We are delighted to showcase the collective talent, creativity and positivity of the artists of Schott Communities, and we aim to shine a light on the parents, caretakers, aides and administrators that have made this exhibition possible through their ceaseless support of these remarkable individuals. We hope that this exhibition generates much-needed recognition and celebration of these artists who represent a diverse range of ages and abilities.” The Frank is located in the Charles F. Dodge City Center in Pembroke Pines at 601 City Center Way. Admission is free. For information, call 954-392-2120, email thefrank@ppines.com or visit thefrankgallery.org. Pines Lakes Elementary Participates in Read for the Record BY DEBBY TEICH

P

ines Lakes Elementary School was among the many Pembroke Pines schools that joined the nationwide effort to break the world record for people reading the same book on the same day. They participated in Jumpstart’s Read for the Record, an annual campaign that highlights the importance of building early literacy and language skills for every child. The program sends a powerful message to children about the importance of reading and helps them get them excited about books and learning. On October 25, students at Pines Lakes gathered around to hear this year’s official book, “Maybe Something Beautiful” written by F. Isabel Campoy and

Theresa Howell, and illustrated by Rafael López. Guest readers included: Melinda Hua, Memorial Hospital; Susan Sasse, Pines Lakes principal; Dr. Andrea Taber, ESE Specialist; Laura Funk, STEM Resource; Christine Aron, Speech Pathologist; Rashon Norman, VE Teacher Primary and Johanna Benitez, Literacy Coach. They were united with millions of children and adults throughout the nation who were also reading the children’s story that celebrates the magic that can happen when a community comes together to create something beautiful and bring about change. After the story ended, they celebrated their love of learning by creating their own beautiful artwork and painting a mural.

“Read for the Record Day unites Broward County to raise awareness for early literacy, put books in the hands of our young children, and connect community guest readers to serve as literacy role models,” said Lori Canning Ed.D., Executive Director, ELLA. “Together, we continue to build a literacy foundation for all children as they grow into strong Broward readers.” Broward Children’s Services Council, Broward County Public Schools, and multiple partners have worked together for the past seven years to implement the program across the county. On October 25, police officers and fire officials, multiple city commissions, businesses leaders, community partners and others read at 191 Public Schools and 320 community Early Childhood providers, as well as parks, wildlife sanctuaries, museums, public libraries hospitals and more. Altogether, there were over 1,200 guest readers throughout Broward. In addition, this is the fifth year that each four and five-year-old child received a free copy of the official book. This year, 40,000 children received a copy of “Maybe Something Beautiful.” “After such a big day with so many readers, events, and books, I love to imagine 40,000 children getting tucked in that night with family story time all reading the same book,” said Canning.

Ankle Ligament Injuries in Teenagers and Adults BY ROBERT H. SHEINBERG, D.P.M., D.A.B.P.S., F.A.C.F.A.S. associated with pain, swelling, occasionally discol-

T

he ankle is a complex joint consisting of bones, ligaments, cartilage, tendons and joint lining. The primary motion of the ankle is up and down. It has limited side-to-side motion. When excess motion occurs from side to side, ankle liga-

ments can tear. Ligaments connect bones together. Once the ligaments are torn instability can develop. On the outside of the ankle there are three ligaments. The inside of the ankle has five and connecting the tibia and fibula are three more. Ankle ligament injuries can occur from stepping off of a step and rolling the ankle, to playing sports and coming down and landing on somebody’s foot. It is also very common in women who wear heels and roll their ankle to the outside, causing damage to the ligament structure of the ankle. When ligament injuries occur, it is most often associated with a feeling of a crack or a pop, and is

oration and inability to weightbear. It is always best to evaluate these ankle injuries as soon as possible. A thorough history and physical will allow the doctor to identify the ligaments that have been injured and the extent of the injury. X-rays are taken and occasionally MRIs if the suspected damage is significant.

Treatment is then aimed at reducing the damage to the ligaments and giving the ligaments an opportunity to heal primarily. Treatment for these injuries could be as simple as RICE (rest, ice, compression, elevation). For a very simple stretching injury to the ankle ligaments, an ankle brace is used most often. When the ligaments are torn, then

immobilization is absolutely necessary. A boot or a cast is applied for two to six weeks. Patients are allowed to immediately weightbear. Cross training is completely allowed. Avoid any type of anti-inflammatory. This will help to reduce the inflammation but at the cost of allowing those ligaments to heal because inflammation is a critical part of the healing process. Physical therapy may be necessary after cast removal. A return to sports could take four to eight weeks. Chronic instability may develop if treatment has not been initiated immediately. This may be corrected with a ligament tightening procedure. Longterm prognosis is almost always excellent. Dr. Robert Sheinberg is a Board-Certified Foot, Ankle and Leg Specialist practicing in Weston and Pembroke Pines since 1988. He specializes in the treatment of infants, children, teens and adults with injuries, pain and deformities. ASK THE MAYOR

Pembroke Pines Update BY MAYOR FRANK C. ORTIS his has been incredibly interesting, wonderful and yet challenging year all rolled in together. We have experienced many exciting programs, events and activities. We have also been affected by an array of trying occurrences throughout the country. As Mayor, I often look at how we can better the lives of our residents and businesses and help where help is needed most. A critical problem facing our young people today involves youth mental health. This year we dealt with school threats, bullying incidents and youth suicide as never before. To better understand how we can help and address these issues, I recently held a 2018 Mental Health Resource Meeting with local experts from community organizations, schools, the school board, and city staff. Important and critical information was shared. We left with a renewed focus on how best to share much needed information with parents and children, and strengthened our resolve to work together as community leaders to ensure we are meeting the needs of those suffering and confused. We will be providing resource information on our website, as well as through our city newspaper City Connect, on Pines Media TV and via our social media. I understand there will also be additional forums held in the new year to continue to address these issues and help our youth. Be sure to take part in the many fun activities planned this month throughout the city, including Children’s Holiday in the Pines, Santa’s Hotline and Santa’s Express, our annual Snowfest, as well as numerous programs through our great Carl Shechter Southwest Focal Point Community Center. Please check our website calendar so you don’t miss anything. On a “housekeeping” note, please note the following 2018 holiday schedule for garbage, recycling and trach service for the City of Pembroke Pines. Residents will not receive garbage, recycling and bulk service on Tuesday, December 25, 2018 (Christmas Day). Those residents who do not receive service on Christmas Day should place garbage and recycling out for pick up on the resident’s next regularly scheduled pick up day. Residents who do not receive bulk service on Christmas Day have been rescheduled for Monday, December 31, 2018. There will be no change to the garbage, recycling and bulk schedule for the New Year’s holiday (January 1, 2019). If you have questions, please call the City of Pembroke Pines Public Services Department at 954-518-9000. And lastly, we’ve got an exciting new year just around the corner with events such as ArtFest in the Pines in March and our annual Fur Ball set for October to put smiles on everyone’s faces. Again, please check with our social media, newspaper, TV and website for all the information. I wish you all a very happy and safe holiday, and a great new year.

ASK THE EXPERT

Moderation Is the Best Approach to Cosmetic Surgery BY CHARLES A. MESSA, III, M.D., F.A.C.S. oo much of a good thing is not always the best. Moderation in life results in the ideal balance in many facets of our lives. This holds true for cosmetic surgery as well. From non-invasive treatments to plastic surgery procedures, moderation is the approach I feel yields the best long-term aesthetic results. We have all seen it – from celebrities to people in our local community. The “overdone” “overfilled” or excessively pulled face that resembles an aquatic animal or alien life form more than a natural aesthetic enhanced face or body. The most common mistake is the over injected face and mouth. When fillers are excessively injected to improve facial lines and wrinkles, the natural contours of the face become distorted. Too much Botox or Dysport can leave a patient with a flat, waxy appearing forehead or brow and a motionless mask-like face. The fish mouth or duck lips result from exaggerated injections of soft tissue fillers in and around the mouth. Soft tissue fillers such as Juvéderm and Restylane should be injected to fill lines and creases and restore volume where is has been lost throughout the aging process. It is the physician’s responsibility to know when enough is enough with regard to appropriate injection volume. Facial skin laxity or looseness can’t be treated with fillers alone. Skin tightening, such as performed during a facelift, is necessary to lift and achieve the optimal cosmetic result in cases when soft tissue fillers are not sufficient. More filler does not tighten excess facial and neck skin. When facelift surgery is indicated, the technique utilized should be individualized according to the patient’s anatomy. Excessively large breast implants or oversized buttocks enhancement will lead to long term problems for these patients. Breast implant volume is ideally determined by careful measurement of a woman’s anatomy including breast width, height, soft tissue thickness and stretch. Bigger is not always better. Think moderation and individualized enhancement to achieve the ideal aesthetic improvements. The excessively large, wide buttock from large volume fat transfers or B.B.L. will eventually need to be reduced at some point in that person’s life as the effects of aging and gravity results in a large, sagging buttock. It is up to the physician, as the professional, to help guide a potential patient to make the appropriate decision to achieve best cosmetic enhancement. I highly recommend to any individual who is considering plastic surgery or any cosmetic procedure to consult with a physician who is board certified by the American Board of Medical Specialties (ABMS) organization, such as the American Board of Plastic Surgery, with documented experience prior to proceeding. Dr. Messa is board certified by both the American Board of Plastic Surgery and the American Board of Surgery, an active member of the American Society of Aesthetic Plastic Surgery, American Society of Plastic Surgeons, and a Fellow of the American College of Surgeons. He is a recognized expert in cosmetic plastic surgery and has achieved Allergan’s Black Diamond Award as one of the top 1% of plastic surgery practices in the country by volume. Dr. Messa has also achieved Chairman status with Medicis and Mentor Corporation. This award honors distinguished leaders in cosmetic surgery for demonstrating expertise and excellence through a high volume of aesthetic product procedures. The certification is awarded to leaders in the field of medical aesthetics and demonstrates their commitment to innovation, excellence, and the highest level of patient care.

LEGALLY SPEAKING

Your 2019 Resolutions More than a law firm. We’re your neighbors.

Contact Us Today

954.885.0085

BY BRUCE IDEN, ESQUIRE s the holidays approach and the year comes to a close, we naturally begin to think ahead to resolutions intended to change habits, improve our health or make things better for ourselves and our families. Resolutions are simply promises we make to ourselves. Perhaps your new year’s resolutions include walking 10,000+ steps each day, eating a cleaner diet or spending more time with your children. Whatever your resolutions may be, consider adding to your list an important one: protecting your loved ones. Let’s look at some basic questions and see if you can answer the following: ▸▸ Who will take care of me if I can’t take care of myself? Do I have adequate insurance? Is there a clear successor to manage my financial and business affairs? Are my personal wishes set forth in writing so they are known and accessible when needed? ▸▸ After I am gone, how will my family and loved ones manage the debts, taxes and other legal obligations I leave behind? Have I created a way to reach important family and financial goals? ▸▸ Who will take over my business if I am disabled or gone? What can I do to increase the probability that my business will survive after me? ▸▸ Who will care for my young children if my spouse and I cannot? What financial protection and instructions have I left for their care? ▸▸ When and how will my spouse, children and other loved ones receive their inheritance? How can I be sure they receive their gifts in a manner which maximizes use and enjoyment but protects against creditors, predators or their own possible fiscal mismanagement? Thinking about these matters can be absolutely overwhelming. But because we care about our families, we are obligated to raise these tough questions and explore the answers. As spouses, we want to provide the resources and safeguards to make our loved ones’ futures more secure. As parents, we want our children to have a happy and secure life, especially if that life does not include us. Why not resolve to start the process of caring for your family should something happen to you? The ancient Chinese philosopher Lao Tzu wisely said, “A journey of a thousand miles begins with a single step.”

Please also make a habit of reviewing your plan, including beneficiary designations for insurance policies, retirement accounts and 401(k) plans. Changes in your financial situation, family circumstances and the law may make the revision and updating of your estate plan essential. Life can change in an instant. What are you waiting for? LEGALLY SPEAKING

The Issue of Alimony and Retirement BY EVAN BARON

W

hen a spouse is ordered to pay Permanent Alimony, it will terminate upon the re-marriage of the receiving spouse or the death of either party. Does that mean if one of the above conditions is not met alimony continues forever? Not necessarily. Florida law allows a party to modify or terminate an alimony obligation if there has been “a substantial change of circumstance.” A substantial change of circumstance requires an involuntary change which could not be anticipated at the time of the Final Judgment. Therefore, if someone voluntarily reduces his income, by quitting a job or switching to one which pays less, he cannot seek a modification. The above would be considered a voluntary change, which is not cause for a reduction. Can an individual who is paying alimony voluntarily retire and either reduce or terminate his alimony obligation? Retirement, unless it’s a mandatory retirement, is voluntary. Does a person paying alimony have to work until he dies? The answer is no! A person has the right to retire, but only under certain circumstances. The courts have ruled that a person can retire at an age which is customary in the industry in which he is employed. There are court cases which approve retirement at 55 for a law enforcement officer who is eligible after 30 years of service. There are court cases which state that a person cannot retire until he reached normal retirement age, generally considered to be over 65. Therefore, every situation is different based upon the circumstances. Just because a person retires doesn’t necessarily mean that alimony terminates. It may mean that alimony will not terminate, but be reduced according to the income the paying spouse will be receiving during retirement. The court needs to consider the not only the ability to pay but the continuing needs of the receiving spouse. The court cannot leave either party in poverty. An individual’s assets can also be taken into consideration. There have been two recent opinions from the Appellate courts concerning this issue. In one case, the receiving spouse argued that retirement would always be an anticipated event and therefore should not be the basis of a downward modification. The appellate court rejected that argument stating that their Marital Settlement Agreement did not address the issue of retirement. In another case, the appellate court allowed the trial judge to consider the fact that the wife, upon reaching the age of fifty-nine and a half; could access retirement accounts without a penalty in considering a request by the Husband for a downward modification. As you can see there is no definitive rule as to this issue, and each case must be considered individually. The law firm of Evan H. Baron and Associates is located at 1655 North Commerce Parkway, Suite 201, in Weston. If you have any questions concerning this issue or any other family law matter, call the office at 954-385-9160.

HEALTH AND WELLNESS

What to Expect from a Memory Care Community BY MARY UNDERWOOD, VP MEMORY CARE SERVICES hen a loved one is diagnosed with dementia, learning the world of memory care can feel daunting. Once you start speaking with people well versed in dementia care though, you will likely feel more supported. Memory care communities provide your loved one with a place to live and with assistance that is tailored to their needs. They can also help give you peace of mind about your loved one’s wellbeing, and educate you about Alzheimer’s disease or other forms of dementia. Read on to learn more about the benefits of memory care communities and what to expect. Customized Care Memory care communities are built specifically for people with dementia, from their physical design to the people who staff them. Most memory care communities are secured so families don’t have to worry about their loved ones getting lost or wandering away. Teams at memory care communities are also specially trained to work with people who have dementia so they know the best approaches for helping your loved one feel understood, seen, and well-cared for. Encouraging Activities Although people living with memory loss may not be able to do all the activities they used to, there are still opportunities for them to have fun and make connections. Memory care communities plan activities designed for people with dementia so residents who participate feel encouraged and accomplished instead of frustrated or confused. Many memory care communities include music offerings, as music has been shown to be a powerful therapeutic tool for those living with dementia. Sensory stations and memory boxes that allow residents to touch items and look through photos and mementos are also popular within memory care communities. Support for Everyone If you find out a loved one has dementia you may have endless questions and concerns. Memory care communities not only provide support for your loved one, but you and your family as well. Specialists in these communities are happy to answer questions, provide resources, and listen to what is challenging you or your loved one at the moment. Memory care communities often offer support groups for caregivers so you can talk with other people experiencing similar things to you. Valuable Attention Because memory care is so specialized, it can be more costly than other senior living communities. You and your family will want to research your options before making the decision to choose a memory care community. Consider the level of care your loved one requires and the features that will make them feel most at home.

Around three years ago, a family friend found a dog on the street and we took her in as our own. Her name is Coco, a female, and she is Three and a half years old! She is believed to be a mix of Pit bull and Beagle. Her favorite person to watch football and eat sour cream donuts with is my dad. She loves her tennis ball as her favorite toy, running, and watching tv, but dislikes vegetables. Her favorite thing to do is go to the park and was last seen on the floor watching Netflix.
