t’s hard to believe, but the tropical South Florida heat is with us again. The sun is burning down and the air conditioners are humming at full blast. While we are trying to decide between pool or beach, our kids are already looking forward to their summer break, and we are hurriedly making last minute arrangements for summer camps and family vacations.

In the midst of all this, Spring is passing us by and Mother’s Day has “sneaked up” on us. Let’s take a little pause and honor our mothers (and our wives) for they are always working hard to care for us, look after us, and pamper us. Let’s pamper them for a change!

community news Miramar Commissioner Samuels Hosts “Day of Service”

ast month, more than 160 people gathered at Miramar’s Fairway Park to make a difference. City of Miramar Commissioner Troy R. Samuels organized the “Joining Hands in a Day of Service 2011” project in an effort to foster the common core beliefs of service to others. Samuels initiated the project last year, when more than 130 people from nine different churches partnered with businesses and the City of Miramar to participate in a beautification project at Shirley Branca Park. The volunteers pulled weeds, planted flowers and shrubs, painted park fixtures, resodded a berm and spread mulch throughout the park. “The project was so well received that everyone wanted to do it again,” said Samuels. This year, Samuels personally visited all of Miramar’s places of worship to invite them to participate and 12 congregations agreed to help. Other volunteers included Miramar High School’s flag football and varsity tackle football teams, Miramar City Commissioner Wayne Messam and Broward County School Board Member Patricia Good. The diverse group of 6 to 70 year olds brought their gardening tools and gloves and came ready to work. They raked leaves, distributed mulch, planted shrubs and flowers, painted the hand ball court, picked up garbage, repaved the entryway and more. “The park looked beautiful when were done,” said Samuels. The City provided

the volunteers with hot dogs, snacks and drinks. The project had an immediate impact on the surrounding neighborhood and adjacent Fairway Elementary School. “I believe that it is one of the most important events that we conduct in our City,” said Samuels. “People from all different walks of life and religious beliefs join hands to create something beautiful for the City. It helps to create a sense of community and build fellowship among our residents.” Samuels says he plans to organize the effort again next year at a different park and hopes that even more volunteers will participate. community news Julia Whalen Celebrates 100 years By Debby Teich

ulia Whalen has always loved a good party. Last month, the Pembroke Pines resident was the guest of honor at several of them as she celebrated her 100th birthday. By the time her birthday ended, she had enjoyed at least a half a dozen celebrations, but whose counting! Julia was born and raised in Chicago, where she taught dance to senior citizens at the City College of Chicago. She was married to Jesse Whalen for 45 years. Julia moved to South Florida in 2000 to be closer to her family. She has two daughters, eight grandchildren, five great grandchildren and two great great grandchildren. Julia started her celebration with an early morning birthday shout-out from Today Show’s Willard Scott. Later, she celebrated with her daughters Jewel Ecton of Pembroke Pines and Darlene Donaldson of Michigan, as well as Pembroke Pines Mayor Frank C. Ortis, who read a letter of congratulations to the birthday girl. Dozens of friends also gathered at the Easter Seals of South Florida site located at the Pembroke Pines Southwest Focal Point Senior Center in Pembroke Pines to wish her a happy birthday. “Julia has been our client for 10 years,” said Teresa Meyer, Administrative Assistant for Easter Seals of South Florida. “We simply love her. She is the sweetest woman and her family is delightful.” The celebration was not over yet. Jewel and Darlene planned a large party with friends and family who travelled from near and far to join in the festivities. Everyone had an opportunity to share their fondest memories during a tribute to Julia’s life. They also reminisced as they watched a slide show, looked through a scrap book and participated in a trivia contest with questions about Julia. Some of the guests even won prizes. “Mom enjoyed the kind of attention that comes along once in a lifetime,” said Jewel.

very day, thousands of men and women risk their lives to defend our country’s freedom. Within the next few months, 175 members of the 841st engineer battalion will join them on the battle field. The battalion, comprised of active duty and army reserve soldiers, was recently alerted that it will soon deploy to Afghanistan. The soldiers have been participating in an intense training program to help them prepare. Many of them are young men and women who live in Pembroke Pines and Miramar.

LTC William S. “Clete” Schaper, Commander 841st EN BN, who lives in Pembroke Pines with his wife Lisa and two children – Wilson, 9 and Russ, 6 – will be deploying for the fourth time. “The most difficult part for many of the soldiers is leaving their families behind,” said LTC Schaper. “The families count on their neighbors and the community for support.” Battalian Medical Officer Ray Rakhar has been on several missions, but this is the first time he will be deployed to Afghanistan. He will leave his wife Erika, eighteen-month-old daughter Jayden and a newborn in Pembroke Pines. “I am proud to serve,” said Rakhar. “It is my duty and my passion.”

n a city with successful city-run “A” rated charter schools, education is a very important aspect of life here in the City of Pembroke Pines. When I became Mayor, our Commission formed an Education Advisory Board to make sure that all the schools in Pembroke Pines—charter as well as district schools— were aware of the city’s concern for education and for the success of all students. We want to be a part of the force for academic achievement and educational success in our city. Marilyn Soltanipour is the current Education Advisory Board Chair, and she is doing a great job.

We also formed a principals’ group which meets quarterly to keep all faculty, staff and students informed and engaged about everything happening in our schools. In my capacity as Mayor, I have participated in career days, and reading days at various schools, and even participated in a series of mock Supreme Court scenarios at the Charter High School. Our youth are the future leaders in our community, our state and our country. As such we want them to be as involved as possible in civic activities such as our City Commission meetings. The City of Pembroke Pines and the Pembroke Pines YMCA are partnering to develop a Teen Advisory Council which will encourage active citizenship and community involvement from our teen leaders. It will also help to develop effective leadership skills and cultivate a sense of civic responsibility and public service. The schools are organizing a contest to select a student to be an advisor to the City Commission and will actually sit in on Commission meetings. I believe this would be a great opportunity to have our youth participate in the proceedings.

I have spent some time in Tallahassee fighting for more dollars for education. t is official. According to the U.S. Census, between 2000 and 2010 Miramar grew by a greater percentage than any other South Florida community. Miramar had a population swell of nearly 68 percent, or 49,302 additional residents. In 2000, we went from a residential population of 72,730 to 122,041 in 2010. But what makes the numbers so significant is the diversity. These numbers strengthen our belief that “Miramar is what this nation will look like in the future.” I am especially proud of the fact that unlike other cities, our diversity is our strength. It unites us all, for a better quality of life, and a better tomorrow. Our diversity has made our City a shining example of how people can come together and work toward a common goal. It is this team effort that has brought us to where we are today. It will especially be important during the next few months as we attempt to balance our budget. As we head into the budget cycle, we will be tasked again with making severe reductions. As you are aware, Miramar, like other municipalities in South Florida, has been affected by the real estate market downturn. Property values in Miramar plunged 15.4 percent from 2009 to 2010, according to the Broward County Property Appraiser. We expect tax collections to take a major hit again. Last year, Miramar collected about $49.4 million in property taxes, but projected collections show that we will collect $41.6 million in 2011. Regardless of the numbers, you can be assured that your Commission and City staff are exploring unique and different ways to maintain the City’s quality of life. I hope that you will take the time to let your thoughts be known to your Commission on what types of services are most important to you. I also hope that you are able to share any cost saving and/or revenue enhancing measures the City can implement. We rely heavily on what our residents say, and most importantly, what they believe in. Miramar is more than a City that just grew in numbers. Miramar is a City that grew together and realized that differences did not matter. What mattered was that we all believed in our community. legally speaking The Importance of Uninsured Motorist Coverage in Florida By Howard Citron

s an attorney handling automobile accident claims in South Florida, I frequently counsel individuals to select an insurance policy that best fits their needs. Many times, consumers do not understand the importance of carrying Uninsured Motorist coverage in Florida. Do not confuse Personal Injury Protection (PIP) coverage with Uninsured Motorist (UM) coverage. Drivers in this state are required to carry $10,000.00 in PIP insurance. PIP covers someone that is injured in an accident regardless of whether they are at fault for the crash. Florida law provides that PIP shall cover eighty percent (80%) of medical bills and sixty percent (60%) of lost wages when a person is injured in an accident. This coverage is paid out as the person receives treatment or submits proof of lost wages. However, when someone is injured in an accident, often the coverage provided by PIP is insufficient to fully compensate them for their damages. In Florida, drivers are not required to carry Bodily Injury (BI) coverage. Therefore, if the person that caused the accident did not purchase BI coverage, fled the scene of the crash or carried insufficient coverage, there will not be insurance available to compensate the injured person for their full measure of damages unless they purchased UM coverage. Recent reports indicate that 25-30% of drivers in Florida do not maintain BI coverage. This number is increasing because of the economic climate. Unfortunately, we have seen more and more clients that are the victims of a severe crash where the responsible party did not have BI coverage or their policy limits were insufficient to compensate them for their damages. This is when UM coverage becomes essential. Under Florida law, an insurance company must offer drivers the option to purchase as much UM coverage as liability coverage. Many professionals decide to purchase large amounts of liability coverage to protect themselves and their assets in the event they cause an accident. Unfortunately, these professionals do not understand the importance of also obtaining UM coverage to protect them in the event they are hit by someone with minimal or no bodily injury coverage. It also protects them if they are a victim of a hit-and-run accident. UM coverage can be used to pay for an individual’s medical bills, lost wages, pain and suffering as well as future costs and expenses relating to their injuries. We always make it a point to review a client’s insurance policy and emphasize the importance of obtaining adequate UM coverage. It is critical to review your policy to ensure that you carry sufficient insurance to protect you and your family in the event you are injured in an automobile accident.

tudio 18 in the Pines’ latest exhibition, “Drawn from Experience: Personal, Cultural, Natural, Emotional, and Illusionary,” has been attracting visitors from all over South Florida. The eclectic exhibit showcases the work of several resident artists. The painters, sculptors and illustrators have addressed commonly felt themes such as loss and recovery, emotional discomfort, persistent cycles of change, and the illusion of beauty. The free Jill Slaughter show will remain on display until May 27. The public will have an opportunity to meet the artists and enjoy a wine tasting during the Studio Salon, on May 6, from 7 to 9 p.m. The artists will speak about their work and answer any questions. “The Studio Salon is a great way to learn more about what drives these artists to create,” said Robyn Vegas. Debra Kaszovitz’s multi paneled handmade paper wall reliefs capture aspects of disintegration and regeneration. Found objects suggest the past, but are manipulated using encaustic (wax) paint and paper casts to transcend time and traumatic physical events. Her work has been inspired by her role as care giver to a family member who suffered a medical crisis. Maria Wieder’s masterful painterly technique depicts objects in an isolated, unembellished style. Her literal approach to painting mundane objects invites any viewer to wonder what particular memory she delved into to create an object so perfect. A recent and serious car accident caused Madeleine Bellwoar to focus on both the intricacies of her formidable pen and ink drawings, as well as her life. Figures which hauntingly appear and/or recede into the background of Jill Slaughter’s new work serve as a metaphor for the way she imagines people want to be perceived. Stand in front of one

Students have submitted rocks to NASA as part of the Rock around the World program. “Our students and staff are inspired by all that NASA does,” said East Campus Principal Sean Chance. “The visit from NASA was a once in a lifetime experience for our gifted classes. This experience will profoundly affect our students and be remembered.” Dizengoff has already begun discussions for a representative of NASA’s robotics program to visit the school next year.

Les Gold, Aerospace Education Specialist with NASA’s Aerospace Education Services Project (AESP) turned the media center into a planetarium before talking to 150 gifted and high achieving students in first to fifth grade about planets, rotations, revolutions, night skies and NASA’s space exploration (past, present and future). He also discussed the numerous contributions that space exploration has made to our daily lives. “His presentation was very interactive and engaging,” said science facilitator Lisa Dizengoff, who worked with NASA for almost a year to bring the program to the school. “He was amazed by how much the students knew.” NASA’s Les Gold spoke to students at PPCES. Dizengoff is constantly trying to find ways for science to come alive for the students through hands-on learning and other activities. “Children learn by doing,” said Dizengoff. “We need to find ways to help

Legally Speaking Have You Been a Victim of Predatory Lending Practices? By Omar J. Arcia, Esq., Foreclosure Defense and Bankruptcy Protection Attorney

redatory lending is when a lender imposes abusive, unfair and sometimes illegal loan terms on borrowers, without regard for the borrowers’ ability to repay the loan. When two or more of the following factors are contained in a mortgage loan transaction, the subsequent forensic audit performed on that transaction usually reveals serious violations of federal and state lending laws.

Property Purchased or Refinanced Between 2003 and 2007.

This four year period marked the peak of the real estate boom in South Florida. Just about anyone, including foreign nationals without any past credit history, could obtain a “sub-prime” loan for all the value of the mortgaged property. The sub-prime mortgage market thrived during this time, allowing borrowers to encumber their properties well beyond their true market values.

Mortgage Loan Contains an Adjustable Rate or “ARM” Feature.

These types of loans are initially set at an artificially low interest rate for a brief period of time. They then switch to an adjustable rate for the remaining term of the loan, and the rate can increase as often as every six months. Even if the U.S. interest rate index remains unchanged, the monthly payments on these loans could increase by up to 50%. These loans have the highest delinquency rate of any other loan product.

Mortgage Loan Contains Negative Amortization.

Negative amortization occurs when the monthly mortgage payment is not sufficient to even cover the interest due, and therefore, the balance of the loan increases over time even though payments have been made. If you owe more today on your home loan, than when you originally purchased or refinanced, your loan is negatively amortized.

Mortgage Loan is Interest-Only or Pick-a-Payment.

Under these types of loans, the borrower is only required to pay the interest due on the loan or some other minimal payment that does not even cover the interest on the loan. After a few years, the required monthly payment is usually increased to cover the outstanding balance. Once the loan payment is increased, so does the likelihood the borrower will default, and eventually be subjected to foreclosure.

Mortgage Loan Approval Based Only on Stated Income.

Roughly half of all sub-prime borrowers from 2003-2007 were given “stated income” loans, in which they were qualified based on statements in the loan application as to their income. These statements of income were largely unverified, and often the “stated income” required for the loan to be approved was the exact amount included in the application by the mortgage broker. If any of these factors apply to your current loan, you should at least have a professional forensic audit performed to find out whether you have any viable claims against your lender. If your claims are timely and properly raised, you may be entitled to reduce the amount you owe, or cancel your loan obligation altogether. Tax Talk Tax Implications of Foreign Gifts By Jacqueline F. Rodriguez, CPA

ave you received gifts or bequests from a foreign person, foreign estate, or foreign entity? If you received more than $100,000 in money or other property as gifts or bequests from a foreign person or foreign estate, you are required to report it by your income tax return due date or extension date. A penalty generally applies if it is not reported on time or if the information is incomplete or incorrect. Penalties may accrue for each month that gifts fail to be reported at a rate of 5% of the amount of the foreign gift (not to exceed a total of 25% of the amount of the foreign gift). However, no penalty will apply if a U.S. person shows that the failure to comply with reporting was due to reasonable cause and not willful neglect. To calculate this threshold amount of $100,000 you aggregate all gifts from related foreign persons. For example, if you received a $75,000 gift from a foreign company and a $25,000 gift from a foreign person, and you know that the foreign person owns 100% of the foreign company, then you received the aggregate gift of $100,000 from the foreign person for the calendar year. In addition to this threshold amount, U.S. persons are also required to report lesser amounts, such as the receipt of $14,165 or more from foreign corporations or foreign partnerships (including a foreign person related to the corporation or partnership). At the time of review, however, the IRS may reclassify a gift received from a foreign corporation or partnership as gross income. Now, as defined in the IRS Pub.519 (U.S. Tax Guide for Aliens), a U.S. person refers to a Citizen or Resident of the United States, a domestic partnership, a domestic corporation and any domestic trust. A related person is defined to include, but is not

limited to: your brothers and sisters, half-brothers and half-sisters, spouse, ancestors (parents, grandparents, etc.), lineal descendants (children, grandchildren, etc.), and a corporation in which you, directly or indirectly, own more than 50% in value of the outstanding stock. Finally, foreign persons include non-resident aliens, a corporation created in a foreign country, a partnership created in a foreign country, and a foreign estate (IRC section 7701 (a)). Amounts exempt from this rule are qualified tuitions or medical bills paid on behalf of a U.S. person. Moreover, reporting gifts acquired over a calendar year by a U.S. person would require filing Form 3520 separately from your tax return. The receipt of these gifts requires you to disclose the date of the gift or bequest, description of property received, and Fair Market Value (FMV) of property received. Gifts received from foreign corporations or partnerships require you to disclose date of gift, name of foreign donor, address of foreign donor, description of property received and FMV of property received. Close examination of such transactions and appropriately reporting them to the IRS will save you time and costly penalties in the future. any parents wait until a problem occurs before they bring their children to the dentist for the first time. Prevention is the most important step in helping your child develop a healthy smile. I always encourage parents to bring their children at an early age to identify potential risks, take measures to prevent dental problems, and make sure that their first encounter is a positive one. It is also a great time to learn answers to important questions about oral habits and diet. Here are some of the most common questions parents ask when they bring their children for their first visit to the dentist. When should my child’s first visit to the dentist be? First birthday or first tooth, whichever comes first. The first tooth usually erupts between 6 and 12 months of age. Your first visit establishes a dental home for your child and is the first step in preventive care. Why so early? What problems could a baby have? A major concern is baby bottle tooth decay or nursing caries (now known as Early Childhood Caries). What and when a child eats is a major factor in a whether a child gets cavities. Once a child starts eating anything besides breast milk, teeth present in the mouth can get cavities. How can tooth decay from using a bottle or nursing be prevented? At will feeding should be avoided once the first tooth starts to erupt. Falling asleep with a bottle containing anything except water will cause cavities. Juice should only be given during meals or at snack time. When does thumb sucking and using a pacifier become a problem? Most children stop by age 2. Thumb sucking is normal for infants. Any sucking habit beyond the age of 3 can cause bite problems and crooked teeth. A professional evaluation by your pediatric dentist is recommended. When should I start cleaning my baby’s teeth? Immediately start cleaning your baby’s teeth when they appear, twice per day. Rubbing your infant’s gums with a cloth and water or infant toothbrush and water is great. Children less than 2 years of age get a “smear” of toothpaste (with fluoride) and children 2-5 years of age get a “pea size” of toothpaste (with fluoride). Children do not have the ability to brush their own teeth effectively. What are some teething tips? From 6 months to 3 years of age your child may have sore gums when teeth erupt. Use a clean cold teething ring, cool spoon or cold wet wash cloth. Why are baby teeth important? Chewing is the first step in digesting food and very important to maintain good nutrition. Baby teeth are a major part of speech development. Most importantly, baby teeth save the space for the permanent teeth. Remember, a health smile helps a child feel good. s I counsel women, myself included, I find that over the years, despite noted accomplishments both academically and occupationally, there continues to be a great deal of societal pressure for eternal beauty, silent conformity and endless giving. Although women have come a long way towards balancing work and family, one of the ways they continue to measure their self worth is in terms of body image and ageless attractiveness. Women search for what they are “missing”; struggling with issues of low self esteem. The stress that comes with this pursuit of perfection frequently leads to affective disorders including anxiety and depression. Outer alterations often do little to change women’s self concept and/or disappointment. In fact, what psychotherapists have found is that plastic surgery provides the same type of instant gratification as a shopping spree or a vacation; when the newness wears off the feelings of emptiness or sadness creep back in. In The American Journal of Psychiatry, dated July 2007, studies revealed that the suicide rate of women who received cosmetic breast implants was approximately twice the expected rate based on estimates of the general population. Much like the lotto winner or the movie star, money and fame cannot cure loneliness. The outward appearance and expectations for a generic flawlessness denies the value and worth of authentic inner beauty. So, how do we lower the huge emotional costs associated with these standards for beauty, the need for accumulation of material goods, and the want for external approval? The only remedy for the false promise of the happiness these goals advertise is authenticity, specifically in the form of a creativity, empathy, and generosity. Creativity and individuality are in direct contrast with the superficial beauty of society’s generic standards: the Barbie-esque shape, the wrinkleless face, the impeccable home décor, and/or the brilliant children. The time, money and energy women too often spend on this perception of perfection rob them of valuable moments they could use to pursue fulfilling interests, self exploration and happiness. The freedom from the stress of these unattainable goals often reveals a renewed sense of spontaneity and an inspiration to find happiness in more fulfilling ways. Authentic empathy starts with the woman herself. In her quest to be the ideal “nice girl,” she may deprive herself of the right to voice her opinions, needs and wants. Once she rids herself of the shame and guilt that comes from the unrealistic, often self imposed, expectations for perfection she is able to relax and feel more at ease with herself as well as connected to her family and friends. As she lets go of self criticism she is often able to let love in and tolerate the flaws of others. By making peace with who she really is, she is able to reveal herself openly, patiently and lovingly. Generosity flows freely with authenticity. It comes as a result of giving wholeheartedly only what is comfortable for you. Requests for a woman’s time and/or assistance come from all around her. My female patients all too often say that they have a tendency to offer assistance without analyzing their own needs. They then become overwhelmed and end up with misplaced anger and unspoken resentment. My suggestion is then to give the woman permission to say, “I can’t answer right now, let me get back to you.” This response gives them the time to think about the ramification of the request and/or offer. Women have to ask themselves if what they are offering/giving is self-sacrificing or for someone else “taking.” As we travel in our journey of womanhood let us teach our daughters that they are valuable, worthy and lovable despite being imperfect and flawed.

f I had to choose the question I am asked the most, it is, “How much is a divorce?” My friend who also practices family law responds by asking the individual, “How much is a car?” It may not seem to be a logical response, but in actuality he is making a valid point. You cannot explain how much a car costs anymore than you can explain how much a divorce costs. The price of a car is based upon the type of vehicle you are looking for. There are cars which may cost $18,000 and there are cars which can cost over $100,000. It obviously depends upon a number of factors which affect the price of a car. The explanation of the cost of a divorce is similar. There are a number of factors which affect the cost. Unlike a car, however, some of these factors may be beyond an individual’s control. The similarity is that just like each car can be a different price, so can each divorce.

The cost of a divorce is divided into fees and costs. Costs represent funds that are paid to third parties other than the attorney handling the case. They are typically filing fees, costs of a process server, mediation fees, court reporter fees and expert fees such as accountants, psychologists and Guardian ad Litems. Of course, just like a car, not every case requires the above listed costs. Other than the $409 filing fee, the above mentioned costs are not required and are often not necessary. Once again, each case is different. Attorneys’ fees are based upon billable hours. Each time an attorney performs a task on a case the client is billed for the time necessary to complete the task. The amount that an attorney charges for his/her time is determined by the attorney. You can expect that the more experience an attorney has, the higher his/her hourly rate will be. Obviously, the more time that is spent on a case the greater the cost. As I previously stated, sometimes the costs are not necessarily within the control of either the client or the attorney. If the other spouse is perhaps being aggressive, then it will result in more time being spent to address this issue. As I previously stated, more time, more fees. Sometimes a judge’s busy schedule will result in the parties having to wait for a hearing or perhaps have to return another day to complete a hearing. My philosophy is to get a case resolved as quickly as possible. Of course it is also my responsibility to make sure that the client is protected and as such it may not be concluded as quickly as a client would like. Just like a car, every case is different.
