What Does the Finance Committee Do?

The Finance Committee members have extensive backgrounds in finance, accounting, business, contract law, budgeting, vendor management, and human resources. Initially the committee efforts focused on supporting the HOA board initiative to bid our key contracts. We assist in RFP (Request for Proposal) preparation, evaluation and ultimate vendor selection after a thorough review of vendor proposals/presentations, and preparation of contracts to assure HOA interests are protected.

The Finance Committee provides ongoing financial oversight on all HOA finance and accounting activities. After the turnover from Taylor Morrison, the HOA must evaluate whether any engineering deficiencies, historical vendor overpayments, etc. exist. The committee is evaluating and reviewing past expenses and all deficiencies to ensure the HOA is appropriately reimbursed.

HOWL-A-LAGO – OCTOBER 26TH

Join us for our annual Howl-A-Lago event on Saturday, October 26th at 6pm in the Boat Dock Area. Enjoy festive treats, the tent of terror, and a spectacular laser light display as we kick off the Holiday Season together.

WINTER WONDERLAND – DECEMBER 14TH

Bring the whole family for music, carnival rides, a skating rink and more on Saturday, December 14th at 4pm in the Boat Dock Area. Be sure to stay until dark to join us for our tree lighting event, and perhaps even a special guest visitor!

The Activities & Fun Continue!

Bellalago and Isles of Bellalago residents! We hope you had a fantastic time at our summer events over the past three months. Creating these events has been a joy for us, but the real magic happened because of your enthusiastic participation. It was wonderful meeting and mingling with each of you during these events. We hope that we helped you beat some summer boredom.

We kicked off the summer with our first ever 4th of July Foam Pool Parties and boy that was a fun-filled event! The kids had a blast playing in foam and cooling off in the pool while enjoying entertainment from our DJ and magician! Even though the rain dampened the adult foam party, we still brought the event inside and danced the night away!

Another great event we had was Ladies Night! The ladies enjoyed a night filled with facials, giveaways, dancing, delicious food, and great entertainment!

My personal favorite event of the summer was our Back to School Color Bash. We gave away bookbags and supplies to over 300 Bellalago residents’ children. Not only did we help these kids get

ready for school, but we also had a variety of field games, amazing food, and everyone went home smiling and laughing from the color powder we threw at the end to celebrate the end of the season. What a way to wrap up the summer!

Now as we move into the Holiday Season, get ready for our BIGGEST and most exciting events of the year for our Bellalago and Isles of Bellalago residents! Look out for Howl-A-Lago, Pub Crawl, Winter Wonderland, and more. Make sure to read through the following pages to see what’s coming up and get your tickets fast before they’re sold out. I hope you all are ready because I’m ready to give you the most magical Holiday Season yet! ‘Tis the season!

Recent Events

What Does Living in a Homeowner’s Association Mean?

The concept of a planned unit development originates when the developer has a vision on a parcel of land. They look at the acreage, the proposed amenities that could be constructed and ultimately, what style of home would entice a prospective buyer to purchase one of their homes in this new development.

As they define the design concept, in tandem with compliance with various governing entities on construction requirements, the question is then posed: Who will fund and oversee the maintenance all of these improvements that are for the exclusive use of the homes within this development? This is the basis for the formation of the legal entity, we commonly refer to as a Homeowner’s Association. These privately maintained assets, which are for the exclusive use of the members of this planned unit development, then become a shared maintenance expense for all who own property within.

Specifically for Bellalago and Isles of Bellalago Community Association these assets in summary are: roads, gates, lakes and ponds, sidewalks, fencing, bridges, monument signage, gatehouses, landscaping, pet waste stations, road signage, lighting tied to entries/monuments/ bridges, security services, bulk cable/internet, lease administration, Dwelling Live access control, non-compliance enforcement of the use restrictions and various insurance coverages for their operation. The Board of Directors elected by the unit owners, who are unit owners themselves, then hire a management company to administrate the operations through various service partner agreements and in conjunction with the various committees of homeowner volunteers supporting the Bellalago community.

To define the scope of maintenance responsibilities for a homeowner tied to their personal property vs. common area property (assets

owned by the Association), Covenants Conditions and Restrictions (“CCRs”) are created and recorded in the public record against each lot, before the home is constructed. Within this same document, are the “Use Restrictions” that define a set of standards that each homeowner agrees to by purchasing a home within the community. These “Use Restrictions” are often referred to as the rules. The entirety of the CCR document (not just the “Use Restrictions”) apply to each property owner, their residents, tenants and guests.

The CCR document, also empowers the Association to adopt supplemental policies to expand on the core CCR language for further governance. An example of such a document, would be a Collection Policy. Unit owners can review your governing documents by accessing your Connect Resident Portal.

The concept of a planned unit development is anyone who buys into the community that is looking for an entity to ensure that the homes and common area property are maintained and governed within the standards that are defined within the CCRs for the protection of their investment.

As operational decisions are made, we look to these governing documents on our powers and obligations to ensure we are aligned on a pathway for the betterment of Bellalago and keeping within the core CCRs. We often receive requests to take action on items, in which the Association currently is not empowered to. We understand this can be frustrating; however, if the community was not designed with such governance, then we can not enforce.

To change the CCRs, per Section 34.4, it would take 66 2/3% of the Board to approve AND 75% of the unit owners (in person or by proxy) at a duly called meeting of the members in which a quorum of the members is present. With a total unit count of 2,357 this would entail a large volume of our unit owners to agree to any proposed change.

Bellalago and Isles of Bellalago is amazing and truly a community that individuals dream of owning a home in. As we become further acclimated to the history of Bellalago and its future, please do not hesitate to reach out to management should you have any questions on the governing documents.

ADMINISTRATION OF ASSOCIATION OPERATIONS

A frequent question that comes up is the role of the Board, Committees and Management in the overall administration of the Association’s daily operations. Your Association is a corporate entity that has a legal Board of Directors who are empowered to make the decisions and delegate duties to vendors and committees for the overall operations of the entity. These Board of Directors are homeowner volunteers who were elected by the homeowner membership to represent their interest. Each year, there is an election for positions on the Board of Directors to be voted upon by the membership to select your representatives.

The Board will then look at the responsibilities of the Association per the Declaration and its Amendments, which are recorded against each property in this community. These legal documents provide the core governance, powers and directives for the Association to follow and only can be changed with a vote of the membership. Through these documents, the Board is empowered to create committees and establish charters, that provide specific duties, infrastructure and tasks to help support the Board in research and oversight of various areas of responsibilities.

These committees will review, deliberate, research and provide recommendations to the Board of Directors for their formal approval, prior to implementation of project or process. Bellalago utilizes these committees in roles such as: Architectural, Fining, Finance, Environmental, Landscape, Lakes and Ponds, as well as Safety and Security.

The Board then will contract with various service providers, such as landscape, water management, security and management to carry out duties at their direction on the management of the operations and its physical assets. The scope of service for these vendors would be specified in the contracts with each party as to the specific duties they are responsible for. For example, the Floralawn contract defines mowing schedules, flower replacement and irrigation inspections.

Water management would define the frequency of inspection, water quality assessment/treatment and debris removal. Management will define the number of employees, accounting and administrative tasks, including administration of meetings and tasks as assigned by the Board of Directors.

Through these partnerships, requests are received and evaluated through the respective entities, so all matters have a due process of assessment and response. The Board may have voted on a policy that has a pre-determined answer or there may be a new request to change a process or add an amenity that would need to be assessed and presented for Board deliberation and vote.

Therefore, the pathway for an owner to present a recommendation for change or inquiry as to an existing process, would be to first contact community management via Bellalago@FSResidential.com. The request would be cross compared against approved contracts, policies in place or open discussion items, so the most recent update on the topic could be shared with the owner. Otherwise, the inquiry may be routed to a committee or board for further review/deliberation.

Please take a moment to thank all of the volunteer homeowners who serve your community and its interests through involvement as a board or committee member. The oversight of the 2,357 homes within the community is a large endeavor and together the community can achieve great things, if the focus remains on the preservation of Bellalago and enhancement of property values for all!

Erosion and invasive plants are two problems that threaten our lake and ponds. Erosion eats away at our property lines and in some cases has eroded over a foot of our original land. Invasive plants rapidly increase and can take over a body of water since there are no natural checks and balances.

To combat both of these problems our water management contractor, Solitude, has been spraying the invasive plants and is planting native species to replace them, under the supervision of the Lakes and Ponds Committee. In a program recently completed, Solitude placed 10,000 plants of several native species along the shore lines which include

3,000 duck potato, 3,000 pickerel, 3,000 gulf spikerush and 1,000 bullrush. These plants will help prevent further erosion while adding to the natural beauty of our bodies of water. This is the first phase of an overall lake and pond bank stabilization program which covers the most critical areas. Previous planting efforts were damaged by poor spraying practices used by previous contractors. The Lakes and Ponds Committee has now set specific spraying guidelines and is carefully monitoring them.

It will take a while for the new plants to settle in and thrive. Each of us can help in keeping our lake and ponds healthy and beautiful by not removing or spraying the new plants. Homeowners can also help by picking up and disposing of trash which has floated into plants bordering your property.
