MAKING YOUR MILES COUNT Robert D. Scheper
This Too Shall Pass A while back I read a biography of John D. Rockefeller (Titan). The author mentioned a time frame of the late 1800’s and early 1900’s and referred to it as one of the most corrupt time frames in US history. Politicians hardly moved a pen without a bag of money. It was a very dark time. However, just ten years later a move of ethics swept the country and the volume of scandals dropped significantly. Through history, society has endured “movements” from one spectrum to the other, especially in free-democratic societies. We as Canadians, are experiencing political corruption, scandals, and extremism. In my opinion, we are very close to the end of one swing. Society seems to be house cleaning political dogma and power. It’s a little like World War One where one side advanced way too far for their supply system to maintain. The troops at the front become isolated and thin; then the counterattack finds them easy pickings to be pushed back... way back... often to behind their original lines. Let me explain.
COVID gave politicians and bureaucracies an opportunity to grab huge spheres of power. Adding new priorities and procedures to an already fragile medical system, the new “overreach” caused many highly qualified and seasoned medical professionals to quit/retire or even be laid off. So, understaffed and with more complex priorities and “mandates”, the fragile medical system began to collapse. 10 • OVER THE ROAD
Backlogs became “write-offs” and faith in the Canadian Health Care system began to drop alongside the faith in government to keep us safe, secure, healthy, and appropriately informed. The problem spread to more government agencies than just Health Care. CRA (with whom I have much history) has a near 18-month backlog of audits. Many staff were taken off “normal” issues to help manage new programs like the: CERB, CTWS, CEWS, CEBA just to name the popular four and the new hiring of staff has not taken a whole lot of issues off the table. New staff are simply too green and too few. The problem is not just the Federal Government as provincial programs, education and other issues add to the near exhaustion of highly demanding systems. The bureaucratic infrastructure of our country is simply not able to handle the demands inflicted by COVID. It barely held together before 2020. While some are clamoring to push even more power through the systems, it will all be in vain. It will only cause it to collapse further. A logical assumption should be a re-engineering of the Canadian government… but that would assume the government has a “logical” approach.
Canada is a very “socialistic” country, arguably more so than even Britain, our mother. We have seven chartered banks... the next country with the lowest number of chartered banks is France which AUGUST 2022
has 135 (Towers of Gold, Feet of Clay, Collins 1982). Canadian governments continuously embrace monopolies and oligopolies. These ideologies are from the dark ages, and they need to be rethought.
There has never been a governmental re-engineering in modern history. When new political parties take over very little changes, even when austerity is sought… at best 2-4% is achieved. What reengineering implies is a critical evaluation of ALL services. Re-engineering generally impacts something in the sphere of 3040% of EVERYTHING. That would mean the discarding of multiple departments and services, some of which should have been discarded decades ago.
Our government (as well as many others) went through re-engineering at the time of the second world war. Citizen’s expectations of their country changed dramatically and therefore, so did the level of all services. If one runs the numbers realistically our country should re-evaluate entire swaths of responsibility and services, not just the classical “tweaking” of department budgets. Canada is the only country in the free world where someone can’t hire/build their own health care services. Given our dismal track record during COVID at the very least we should, as a Nation, reconsider our “single payer health care system”. Government monopolies are a dark age method to fix a new world problem. Options and competition bring efficiency, true professionalism, and accountability. Let those who wish to manage their own health care… manage it. It’s something that many concerned Canadians have been doing anyway, in their own way.
Heroes are vilified, innocent people are imprisoned and the guilty are set free to recommit. Nelson Mandela spent nearly 3 decades in prison… then he rose to become the Prime Minister. I think we should remember that power is never forever, and corruption eventually runs its course. Everything has its end. Secrets can rarely be kept long in an age of technology. People are too used to freedom to accept tyranny for very long. We are just at the far spectrum of the left, complete with all its wild extreme fantasies and its, over-reach of overreaches. This too shall pass.
There is one thing Canadians can all agree on… we love to UN-elect politicians. We enjoy that way more than electing them in the first place.

Eld Differences: Canada vs USA Let’s start with the similarities - there are a few. The actual laws governing the Hours of Service have not changed in the USA and Canada. You still need to accumulate 10 hours off-duty each day. Within both countries, you can only work 14-hours per day. In the USA you can drive 11 hours in your shift and of course, in Canada you can drive 13 hours in your day. As stated, the actual laws governing the Hours of Service have not changed but the thing that did change is that in many cases, the paper logs must now be kept in an electronic format or an Electronic Logging Devices (ELD’s). What are some of the differences between the two countries? There are two major areas that are significantly different. The first one is that in the USA, ELDs are self-certified. This means any manufacturer of an ELD promises the USA Government that their device does exactly what the FMCSA has mandated it to do. Well, let’s just say this didn’t work so well. It is estimated that somewhere between 25% and 50% of the devices on the ‘Approved’ list don’t do what the law says that they are to do. And please take note, the lawyers know which devices 14 • OVER THE ROAD
don’t do what they are supposed to do as well. So, this still creates an unlevel playing field. The legal drivers and companies are still competing against the cheaters. In Canada, we took a different approach. In Canada, every device must be submitted to a third party for certification. The fee for this certification is charged to the device manufacturer. And the fee is not cheap. This fee and third-party certification have done a few things: It has greatly reduced the amount of ELD’s available to Canadian trucking companies (and to the USA carriers that come into Canada) and it makes sure that the devices approved actually perform to Transport Canada regulations. The second area of difference is who is exempt from using an ELD? In the USA and Canada, short-haul drivers don’t have to use an ELD. In both countries, trucks older than 2000 are exempt. For the USA only, also not required to have an ELD are agricultural, farm and livestock vehicles. Another USA-only exemption is for Drivers with 8 days of RODS (Record of Duty Status) in a 30-day period.

In Canada, the exemptions are quite different and there are fewer vehicles that don’t have to have an ELD. For example, agricultural, farm and livestock trucks must have an ELD. As in the USA trucks with an engine older than 2000 are not required to have an ELD. In Canada, the short-haul driver who operates within the 160 KM radius is not required to have an ELD in their truck. And that is about it in Canada for exemptions.
I have seen many violations and convictions for Drivers not being able to show the officer one of these items. The above are the Canadian rules, and the USA regulations are very similar.
Canada has taken a stricter approach to the ELD rules. They have made many fewer exceptions and they mandated a 3rd party testing system to ensure that the approved devices do what they promise to do.

Now what is interesting to me are the ‘New Tickets’ that truck drivers are receiving in both countries. The regulations in both countries for what I’m about to outline next are very similar. Every Driver must carry and be able to give to an officer the following:

WOMEN IN TRUCKING Ellen Voie
Combatting Sexual Harassment in Trucking The Women In Trucking Association strives to be a resource for the trucking industry. This means we spend a great deal of time collecting data from our members. Everything from recruiting and retention to harassment is analyzed and the results are either White Papers, webinars, or benchmarking information. Late last year we conducted a survey on harassment and over 400 drivers responded. The results were disturbing. Nearly seventy percent of drivers claimed verbal harassment and nearly half said they had been verbally threatened at least once. Shockingly, 57 percent reported receiving unwanted physical advances and six percent claimed they had been raped. The results are unfortunate, and now our goal is to work to prevent these occurrences and to make the trucking industry a safe place for women (and male) drivers. Adrienne Lawrence, former anchor, and legal analyst for ESPN wrote about her experience in her book, “Staying in the Game.” The subtitle is, “the playbook for beating workplace sexual 18 • OVER THE ROAD
harassment.” Her insights and her advice are valuable. First, according to Lawrence, men are the dominant initiators of workplace sexual harassment accounting for ninety percent of the harassment toward women (and 70-80 percent of harassment toward men)! Jobs where harassment is most likely to occur are in historically masculine jobs, such as trucking. This is partly due to the gender imbalance, but also increases against those who don’t fit the gender norm for that occupation. Forms of harassment in order of occurrence beginning with the most common are staring, suggestive comments, attempts to talk sex, offensive images, asking the victim out, trying to initiate a sexual relationship and finally, unwanted touching. The author describes five types of harassers. There is the “borderline inappropriate” guy who is subtle but shady and often operates just under the legal description of harassment and will

deny any insensitive behavior. The next guy acts as if he wants to be your mentor or friend and takes you under his wing until you realize he’s crossed a line with his “friendly” behavior and isn’t truly looking out for you. The third type doesn’t even hide his actions, but the company tolerates him because he’s an important part of the team. The final two types of harassers are the power player whose goal is to dominate you and he’s got the authority to make you uncomfortable, and finally, the guy who claims to support you but doesn’t do a thing to stand up to the harasser. Many female drivers will tell you they’ve never experienced harassment while others claim to be the subject of harassment often. How do you know if you’re being harassed or not? Lawrence says to trust your judgement. Ask yourself why you feel uncomfortable around certain people and whether you are making a conscious effort to avoid that person. Would you feel ashamed telling someone else about the behavior? Trust your gut, the author advises! Lawrence’s “playbook” starts with documenting the behavior. Without timely and accurate evidence, the harasser will claim it never happened. If possible, record the interaction with your phone, and use video if possible. A second option is to get an eyewitness account from a AUGUST 2022
bystander and record their recollection. If the harasser leaves a paper or electronic trail, such as notes, emails, text messages or social media posts, be sure to capture them and save them for future reference. Lawrence suggests you send all of these “receipts” to an encrypted email or other account, so you don’t lose them. Adrienne Lawrence sued ESPN for sexual harassment in 2018 for not addressing her complaints dating back to 2015. She reached a settlement the following year. As an attorney, she has a better understanding of the legal terms and describes the process to stop harassing behavior in the workplace.
