Vive le Canada My wife and I drove to PEI for the grand “reopening” or maybe I should say “demasking” of the island. It was a unique experience. I interviewed a few workers and got a peculiar perspective. I guess choosing to live on an island starts out as self-isolating, so when those who self-isolate must further self-isolate it either magnifies the effect or it’s not even noticed. However, the majority of those I interviewed were greatly looking forward to removing masks, one even told me of a small local party that was celebrating it. Like most Canadians though, respect was the flavour of the day. Since we drove to PEI my wife and I obviously passed through Ontario, Quebec etc. We brought our dog along for company (we won’t do that again). Navigating the hotels that allow dogs is a little hit and miss. Eventually, we just chose a hotel chain that accepted pets and worked our schedule around the chain’s locations. This situation exposed us to an unusual set of experiences. We ended up staying in three separate hotels in Ontario, all belonging to one hotel chain. The first one was “normal” it had a full hot continental breakfast setup, we walked in made our food, and sat down all without masks of course. The second hotel required a hired “supervisor” in the kitchen. We were not allowed to fill our plates, so we just sat at our table and were served. We were told that the COVID protocol didn’t allow us to serve ourselves. Though we thought it strange, we were ok with “being served”. Finally, at 10 • OVER THE ROAD
our last location, we were told to fill our own plates, but we were not allowed to stay in the kitchen (we had to eat it in our rooms), again it was COVID protocol. Each of these experiences were in Ontario. I asked the hotel manager how the protocol could be so different within the same chain and Province. Were the directives from corporate headquarters or from local health inspectors? Unfortunately, she did not answer my question and stopped speaking to me. When Provinces, companies (and even individual locations) each have their own response to regulations, the public begins to lose faith in administrations and government. It was just as confusing when we passed through Quebec. While travelling my wife and I ended up just following our GPS. Without realizing it, after filling our tank (in Quebec) we walked into the convenience store for refreshments… ya… we were not paying attention. The cashier erupted into callisthenics and hysterics behind the counter... OOPS! Back we went to our vehicle for our masks. While returning to the store a delightful French woman came out, ripped off her mask and in a sarcastic yell shouted “Vive la France”, then a longer phrase that included “liberta” which I for the first time in my life chanted in Ottawa last January/February. The polarization of this topic doesn’t seem to diminish over time… at least not yet.

I know several individuals and groups in both the Prairies and Ontario (probably other Provinces as well) who are actively still promoting the mandates and restrictions, not because of their fear of COVID but because of the benefits they derive from them. I know one individual who has become very wealthy from the industries spawned by the pandemic. Personally, he was devastated (more furious than devastated) by the convoy that appeared to set off a string of provincial deregulation announcements. There are many segments of our society, both government and private that are desperate to return to lockdowns. Without a doubt, they have the right to their position, as does all of society to formulate their individual stances. However, I think it must be stated that lobbying for any position with little regard for science while claiming to have the moral high ground (and science) is disingenuous. I thoroughly enjoyed meeting my fellow countrymen in central and eastern Canada. We have a great country… huge and a nearly unmanageable land mass... but great! Our country and the world passed through the industrial revolution, into the Information Age (technological
advancement) right on into the Age of Disinformation (due to the EXCESS of Technology). The solution to this tension is the compassionate heart of individual Canadians who are committed to unity. Reach out and help your neighbour with whatever they are struggling with. Compassion heals all division. Vive le Canada! About the Author: Robert D. An Obligation to Train and Learn I had some incredible feedback on last month’s article regarding how truck drivers seemingly ignore pushrod travel, ABS lights, the ABS system and generally do an incompetent pre-trip. The feedback led to a discussion with one of the readers, and they pointed out how some companies are compliant but not safe.
What does that mean - compliant but not safe? The reader pointed out that many drivers when applying for a new position fill out a ‘mountain’ of paperwork. This paperwork may include dangerous goods training and other signed forms so that they can occupy their correct spot in the driver qualification file. Completing a document, signing, and dating it, is only compliance. No training has taken place. Do you know that training is required for all employees? And drivers, as much as you might hate another ‘New Hire Orientation’ program, at least this carrier (if done correctly) is abiding by the law. That is a good indication as to how they will treat you. 14 • OVER THE ROAD
Each Province or Territory has its own Health and Safety rules, and they generally mirror or mimic the Federal rules. So, in this way, it doesn’t matter whether you are Provincially regulated or Federally covered. The rules are the same, at least in principle. What are some of the training topics that are in the regulations? The main principle is that the employer alert you to ‘known hazards of the job.’ Do you interpret that to mean things like speed and following distance for a truck driver? I know that I do. And supervisors are required to be trained and know the hazards of the job. When was the last time you were trained to know about ‘what is sexual harassment?’ Unfortunately, not many trucking companies train their drivers on this topic. Another area that is supposed to be dealt with is ‘workplace violence.’ Many truck drivers sign a document saying that they have been trained on the ‘Anti-Workplace Violence Policy.’ In fact, they have only signed a paper JUNE 2022
stating that they read the policy and understand the policy. All without even reading the policy. What kind of training is that? And while I’m on a rant about training or the lack thereof, how about the ‘Joint Health and Safety Committee?’ (JHSC) which companies with 20 or more employees are required to have. I can’t tell you how many companies that I visit that will say to me that they don’t have a JHSC! Most fleets with 15 trucks or more would have at least 20 employees. That would be the 15 drivers and then the support workers, the office staff, dispatch, and dock workers. I recently conducted a Certified Director of Safety course. Among the attendees, all with more than 50 power units, not one had a JHSC set up and functioning correctly as per the regulations. Why are trucking companies not correctly training the drivers and other employees in their employ? I partially blame ‘Driver Inc.’ Some employers have told me that because they use Driver Inc. and that Driver Inc. drivers are not employees, this means that they don’t have to train non-employees. And having less than 20 employees means that they are not required to have a JHSC. I would love to hear from a labour lawyer and have that lawyer give JUNE 2022
their thoughts about this. If a Driver Inc. operator gets seriously hurt, what are the obligations of the company? We all know that not abiding by the regulations doesn’t mean much until someone gets hurt or loses their life. Now, suddenly, the family of the injured or dead worker is looking for restitution or compensation. My message in this article is twofold. One. Employers have an obligation to train employees regarding the hazards of their work. Two. Truck drivers should take the training with a smile on their face knowing that employers are following the regulations and doing their due diligence in training them regarding the hazards of the work. WOMEN IN TRUCKING Ellen Voie
Promoting Safety and Preventing Sexual Assault and Sexual Harassment in the Trucking Industry Recently the Department of Labor held a “Day of Action” to promote safety and address these issues in the trucking industry. Since our inception in 2007, our mission has included the goal to address obstacles that might keep women from entering the trucking industry, or from succeeding in a transportation role. For over fifteen years the Women In Trucking Association has already been addressing the subject of sexual harassment and sexual assault against professional drivers. We feel the time is way overdue for the government to support our efforts to address sexual harassment and assault in the trucking industry. In June of 2011, we met with Lynn Rosenthal, who was the White House Advisor on Violence Against Women and Judge Susan Carbon, who served as Director of the Office on Violence Against Women at the Department of Justice who both agreed more needs to be done to address harassment against our professional drivers. In 2011 WIT partnered with J. J. Keller & Associates, Inc. and created an AntiHarassment Employment Guide which we offer as a resource to our corporate members.

In 2017 the FMCSA initiated a project to research harassment against female and minority drivers (renewed in 2020) called Crime Prevention for Truckers. This was a result of our request to the agency to help us identify and address safety and harassment issues against female drivers. We are awaiting the results of this campaign to be released soon. To better understand the prevalence of harassment against our female driver population we initiated a survey late in 2021 which collected the responses of 437 professional drivers. When asked if the respondent felt that trucking was a safe industry for women, 54 percent agreed, and 18 percent disagreed. One of the concerns expressed by drivers was the training situation when it involves opposite-gender trainers. More than half (52%) felt that a same-gender training policy would encourage more women to pursue a career as a driver (only nine % disagreed). The Women In Trucking association advocates for a same-gender training policy OPTION for motor carriers. Currently, trucking companies who do not have sufficient female trainers are unable JUNE 2022
to provide this option due to an EEOC ruling against a carrier that provided male trainees more opportunities to work for them due to a delay in securing female trainers. The trucking industry is the only mode of transportation that does not allow separate sleeping and living quarters for opposite genders. Unfortunately, this has led to an environment that could lead to harassment or assault, as reported by the survey respondents. More than 67 percent of the drivers reported being subjected to verbal offences, with 52 percent reporting the comment as threatening. Over twenty percent of those in the survey reported being threatened with a weapon and 46 percent said they had experienced unwanted physical advances. We have created a series of White Papers based on research conducted with our members which is available to the media, trucking companies and government entities. Our White Papers are available on our website. To educate our members on personal safety we offer sexual harassment training at our events by the Survive Institute. Hundreds of our members have been trained in personal safety and how to avoid being a victim of assault through our programs. As an industry, we need to protect the personal safety of our drivers, particularly our more vulnerable female drivers. Our board of directors has agreed to invest in a partnership with RAINN (Rape, Abuse, and Incest National Network), the nation’s largest anti-sexual violence organization.

We have committed to supporting research to be conducted by RAINN to determine the extent of harassment against professional drivers. Our goal is to create a toll-free hotline for transportation workers to call if they experience sexual harassment or violence. In our survey of drivers, we asked them where they felt least safe, and the top response was in rest areas (85.5%) and truck stops (86.8%). We approached the truck stop industry to help us create an awareness campaign called, Hear Something, Say Something,” to educate drivers on bystander awareness. This project is still in the initial stages until support from the truck stop industry is secured. The Sexual Assault and Prevention Month Day of Action is a project that we feel strongly about supporting, but more importantly, we feel it will benefit our efforts to provide a safer environment for all professional drivers.
